<section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS International Cyber Partner Act of 2023</short-title></quote>.</text></section> <section id="idb39b36afbce94fd59f3074fcd19832dc" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to authorize the Secretary of Homeland Security to assign personnel to foreign locations to support the missions of the Department of Homeland Security.</text></section>
<section id="idbaa9c5ae7f26457f93156889d8742645" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>International assignment</header>
<subsection id="id8c35b0ad1af94346a4ece6fc3bec7f63"><enum>(a)</enum><header>In general</header><text>Title I of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id6cd37a8e189e40e2bae072e8342f231f" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"> <section id="idc623389f593b49d1b5a00091caf22f46"><enum>104.</enum><header>International assignment</header> <subsection id="id36955ce31c7e4b9d9ec60963449fe04d"><enum>(a)</enum><header>International assignment</header> <paragraph id="id0d899a3214984c03b40b871af70d00a9"><enum>(1)</enum><header>In general</header><text>The Secretary, with the concurrence of the Secretary of State, may assign personnel of the Department to a duty station that is located outside the United States at which the Secretary determines representation of the Department is necessary to accomplish the cybersecurity and infrastructure security missions of the Department and to carry out duties and activities as assigned by the Secretary.</text></paragraph>
<paragraph id="id1f806baad3ee410ebeebfe912499fb81"><enum>(2)</enum><header>Concurrence on activities</header><text>The activities of personnel of the Department who are assigned under this subsection shall be— </text> <subparagraph id="idCAECB5616C4E414C96D09254BAF30F90"><enum>(A)</enum><text>performed with the concurrence of the chief of mission to the foreign country to which such personnel are assigned; and</text></subparagraph>
<subparagraph id="idBB39D7036BA642EABECF700872AF6B54"><enum>(B)</enum><text>consistent with the duties and powers of the Secretary of State and the chief of mission for a foreign country under section 103 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4802">22 U.S.C. 4802</external-xref>) and section 207 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3927">22 U.S.C. 3927</external-xref>), respectively.</text></subparagraph></paragraph></subsection> <subsection id="id33dc4bd3b09147508dfe8f73d1483e73"><enum>(b)</enum><header>Rule of construction</header><text>This section shall not be construed to affect, augment, or diminish the authority of the Secretary of State or any other officer of the Federal Government.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection>
<subsection id="id0C341197B7894D1CAE9FDCFE76706235"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/196">Public Law 107–196</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 103 the following: </text> <quoted-block style="OLC" id="idba4af517-144a-4466-b827-9a1c6febc2e1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"> <toc changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"> <toc-entry level="section" idref="idc623389f593b49d1b5a00091caf22f46">Sec. 104. International assignment.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="ida209ce480e0f41a0b805139da3d08d19" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>4.</enum><header>CISA Activities</header> <subsection id="id43b0a6c9b48540869a04f653f2c5e8e8"><enum>(a)</enum><header>Foreign locations</header><text>Section 2202(g)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/652">6 U.S.C. 652(g)(1)</external-xref>) is amended by inserting <quote>, including locations outside the United States</quote> before the period at the end.</text></subsection>
<subsection id="ide1bba50c75b841c5ad57b3c284c9f907"><enum>(b)</enum><header>Cyber planning</header><text>Section 2216 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665b">6 U.S.C. 665b</external-xref>) is amended—</text> <paragraph id="id38dce98893b0431392190b5d020b4987" commented="no"><enum>(1)</enum><text>in subsection (a), in the first sentence, by inserting <quote>, including international partners, as appropriate</quote> after <quote>for public and private sector entities</quote>; and</text></paragraph>
<paragraph id="id0e59d384049c4974becbd3d2774296af"><enum>(2)</enum><text>in subsection (c)(2)—</text> <subparagraph id="id576866B7633348DE90BC49A5DDD97EE4"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph>
<subparagraph id="id764B2656770E42D398C6B089C8530EE8"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph> <subparagraph id="id2985902A88224DE4BB8B9FD4783C1EDC"><enum>(C)</enum><text>by adding at the end the following</text>

<subparagraph id="id6874A84F6AA14D8EA9D6ACE994EAE2DA"><enum>(G)</enum><text>for planning with international partners, the Department of State.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="id3347d4e558d3494db1de33ba42afe346"><enum>(c)</enum><header>Cybersentry</header><text>Section 2220C of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665i">6 U.S.C. 665i</external-xref>) is amended— </text>
<paragraph id="idC6A675E8DA00457B8DEBA01CDCAB4CF0"><enum>(1)</enum><text>by redesignating subsections (d), (e), (f), and (g) as subsections (e), (f), (g), and (h), respectively; and </text></paragraph> <paragraph id="id848476A57C8D44CAB1A28819E446DE5D"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="id9B1D36420FD3499AB65AE89D443F1CE6" commented="no"><enum>(d)</enum><header>International</header>
<paragraph commented="no" display-inline="no-display-inline" id="idea96a6f0ddbe4662850b4ed90ecfc24e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director may, subject to approval by the Secretary and pursuant to section 104 and subsection (b) of this section, enter into agreements or arrangements with foreign governments and foreign owners and operators of critical infrastructure that, in the determination of the Director, in consultation with the Secretary and the Secretary of State, would further the homeland security interests of the United States and enhance the ability of a foreign government or foreign owner or operator of critical infrastructure to work cooperatively with the United States to advance the homeland security interests of the United States.</text></paragraph> <paragraph id="idc79670b30dc44db3b085aa9f882cc0a2" commented="no"><enum>(2)</enum><header>Reimbursement of expenses</header><text>The Director is authorized to collect payment from the receiving entity for the cost of services, technical assistance, or expertise provided under this subsection and any accompanying shipping costs.</text></paragraph>
<paragraph id="id274372546c3940bdbe9d8e6dbb5309da" commented="no"><enum>(3)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding section 3302 of title 31, United States Code, any amount collected under this subsection—</text> <subparagraph id="id77762506f6f44781877687d7a150d900" commented="no"><enum>(A)</enum><text>shall be credited as offsetting collections to the account that finances the services, technical assistance, or expertise for which the payment is received; and</text></subparagraph>
<subparagraph id="id3bb9ee9211d0498d87035db1df7802d8" commented="no"><enum>(B)</enum><text>shall remain available until expended for the purpose of providing for the security interests of the homeland.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body> <legis-body display-enacting-clause="no-display-enacting-clause"> <section section-type="section-one" id="id5fa6ff9c-9f47-4931-b24f-e7853357318c" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS International Cyber Partner Act of 2023</short-title></quote>.</text></section>
<section id="id0a3a7865-f5e1-49f4-996e-1d851ff2cd17" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are to—</text> <paragraph commented="no" display-inline="no-display-inline" id="id515225e9d97c4757b8710668bb4f1793"><enum>(1)</enum><text display-inline="yes-display-inline">authorize the Secretary of Homeland Security to assign personnel to foreign locations to support the missions of the Department of Homeland Security; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ida1fbf5103cc744a48a4c0e72ab0d9e33"><enum>(2)</enum><text display-inline="yes-display-inline">provide assistance and expertise to foreign governments, international organizations, and international entities on cybersecurity and infrastructure security.</text></paragraph></section> <section id="idf2b6671d-f4ac-4be0-9e86-762f3798d311" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>International assignment and assistance</header> <subsection id="id4a4ecb99-664d-4bf0-8420-f416c8321c08"><enum>(a)</enum><header>In general</header><text>Title I of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111 et seq.</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="id9573ace0-00f0-4d56-902e-3f87f0b48583"><enum>(1)</enum><header>In general</header><text>The Secretary, with the concurrence of the Secretary of State, may assign personnel of the Department to a duty station that is located outside the United States at which the Secretary determines representation of the Department is necessary to accomplish the cybersecurity and infrastructure security missions of the Department and to carry out duties and activities as assigned by the Secretary.</text></paragraph> <paragraph id="id0c2da346-9dfd-489f-a6e8-bef6e5718041"><enum>(2)</enum><header>Concurrence on activities</header><text>The activities of personnel of the Department who are assigned under this subsection shall be— </text>
<subparagraph id="id84efcd4f-9b42-4fa4-9976-bfcc5d617a99"><enum>(A)</enum><text>performed with the concurrence of the chief of mission to the foreign country to which such personnel are assigned; and</text></subparagraph> <subparagraph id="ide3a21a7c-4112-4b66-bbcf-7505ab85cd45"><enum>(B)</enum><text>consistent with the duties and powers of the Secretary of State and the chief of mission for a foreign country under section 103 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4802">22 U.S.C. 4802</external-xref>) and section 207 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3927">22 U.S.C. 3927</external-xref>), respectively.</text></subparagraph></paragraph></subsection>
<subsection id="ide0b0df1a738b49f7b6c3a345bf8741e2"><enum>(b)</enum><header>International support</header>
<paragraph id="id5e39ab0b70c9476da32af020972fc1f7"><enum>(1)</enum><header>In general</header><text>If the Secretary makes a determination described in paragraph (2), the Secretary, with the concurrence of the Secretary of State, may provide equipment, services, technical assistance, or expertise on cybersecurity, infrastructure security, and resilience to a foreign government, an international organization, or an international entity, with or without reimbursement, including, as appropriate—</text> <subparagraph id="idfa04895d75f344adb12aaee5610a18f7"><enum>(A)</enum><text>cybersecurity and infrastructure security advice, training, capacity development, education, best practices, incident response, threat hunting, and other similar capabilities;</text></subparagraph>
<subparagraph id="id4da776618a394e8c9da1de74f16d7448"><enum>(B)</enum><text>sharing and exchanging cybersecurity and infrastructure security information, including research and development, threat indicators, risk assessments, strategies, and security recommendations;</text></subparagraph> <subparagraph id="idff28c62d2b2345f99c4d0275f76a81a2"><enum>(C)</enum><text>cybersecurity and infrastructure security test and evaluation support and services;</text></subparagraph>
<subparagraph id="id574682260a684957aa98f6b12aa5f972"><enum>(D)</enum><text>cybersecurity and infrastructure security research and development support and services; and</text></subparagraph> <subparagraph id="id4182d6e33fbc4fd0a81073262fd76168"><enum>(E)</enum><text>any other assistance that the Secretary prescribes.</text></subparagraph></paragraph>
<paragraph id="id0d2921cff0ac4650b7f6dcda6ea78627"><enum>(2)</enum><header>Determination</header><text>A determination described in this paragraph is a determination by the Secretary that providing equipment, services, technical assistance, or expertise under paragraph (1) would—</text> <subparagraph id="id1efcd0cca4f94ed99438db3ee8621cea"><enum>(A)</enum><text>further the homeland security interests of the United States; and</text></subparagraph>
<subparagraph id="idfed6be024fe149cc8601bef46ddd6560"><enum>(B)</enum><text>enhance the ability of a foreign government, an international organization, or an international entity to work cooperatively with the United States to advance the homeland security interests of the United States.</text></subparagraph></paragraph> <paragraph id="id44603647c66848b8b1fcb68a3a2b327a"><enum>(3)</enum><header>Limitations</header><text>Any equipment provided under paragraph (1)—</text>
<subparagraph id="ide4c9b450922446cc97f5fd99e963c87b"><enum>(A)</enum><text>may not include offensive security capabilities; and</text></subparagraph> <subparagraph id="id0d976bb99ee143d793bb7ad329e4593f"><enum>(B)</enum><text>shall be limited to enabling defensive cybersecurity and infrastructure security activities by the receiving entity, such as cybersecurity tools or explosive detection and mitigation equipment. </text></subparagraph></paragraph>
<paragraph id="idad8c4f3cb6ae44799cf816ed127753d7"><enum>(4)</enum><header>Reimbursement of expenses</header><text>If the Secretary determines that collection of payment is appropriate, the Secretary is authorized to collect payment from the receiving entity for the cost of equipment, services, technical assistance, and expertise provided under paragraph (1) and any accompanying shipping costs.</text></paragraph> <paragraph id="id8326ecde949e4615964fcb649b727e7e"><enum>(5)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding section 3302 of title 31, United States Code, any amount collected under paragraph (4)—</text>
<subparagraph id="id651528ab8fe943b08ea704810e14ebbc"><enum>(A)</enum><text>shall be credited as offsetting collections to the account that finances the equipment, services, technical assistance, or expertise for which the payment is received; and</text></subparagraph> <subparagraph id="id9ac60e935fe7446da18d047059ef5da9"><enum>(B)</enum><text>shall remain available until expended for the purpose of providing for the security interests of the homeland. </text></subparagraph></paragraph></subsection>
<subsection id="id33009e79-22fe-4bd5-bc1b-3619bae6c450"><enum>(c)</enum><header>Rule of construction</header><text>This section shall not be construed to affect, augment, or diminish the authority of the Secretary of State.</text></subsection> <subsection id="id81e7d56da0614cc0b926b6ce9384ecd0"><enum>(d)</enum><header>Congressional reporting and notification</header> <paragraph commented="no" display-inline="no-display-inline" id="id97cac1fc76014cecb140fa6f0148aa06"><enum>(1)</enum><header>Report on assistance</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>DHS International Cyber Partner Act of 2023</short-title>, and every year thereafter, the Secretary shall provide to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a report that includes, for each instance in which assistance is provided under subsection (b)—</text>
<subparagraph id="ida4fa9c415e6e42778e0ee696ce93fad3"><enum>(A)</enum><text>the foreign government, international organization, or international entity provided the assistance;</text></subparagraph> <subparagraph id="id09a2c50f5a034851b2dab3df4f9a4f91"><enum>(B)</enum><text>the reason for providing the assistance;</text></subparagraph>
<subparagraph id="id6c6c32dce18347909060b1441c34a14b"><enum>(C)</enum><text>the equipment, services, technical assistance, or expertise provided; and</text></subparagraph> <subparagraph id="idc1b17e065fb1452e846d6d37381a33a8"><enum>(D)</enum><text>whether the equipment, services, technical assistance, or expertise was provided on a reimbursable or nonreimbursable basis, and the rational for why the assistance was provided with or without reimbursement.</text></subparagraph></paragraph>
<paragraph id="id572aa6913b20483ab253aa3991f50fe3"><enum>(2)</enum><header>Copies of agreements</header><text>Not later than 30 days after the effective date, under the authority under subsection (b), of a contract, memorandum, or agreement with a foreign government, international organization, or international entity to provide assistance, the Secretary shall provide to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a copy of the contract, memorandum, or agreement.</text></paragraph> <paragraph id="id34c7f0afddb141ad9664f84d74158af5"><enum>(3)</enum><header>Notice on assignments</header><text>Not later than 30 days after assigning personnel to a duty station located outside the United States in accordance with subsection (a)(1), the Secretary shall notify the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives regarding the assignment.</text></paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection>
<subsection id="id3466db15-192e-43d2-aa59-909bd3bc013a"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/196">Public Law 107–196</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 103 the following: </text> <quoted-block style="OLC" id="idccef133b-5ae8-4748-bc2d-51e63f769d73" changed="added" reported-display-style="italic" committee-id="SSGA00"> <toc changed="added" reported-display-style="italic" committee-id="SSGA00"> <toc-entry level="section" idref="idc623389f593b49d1b5a00091caf22f46">Sec. 104. <paragraph id="idecd50615069e45cd94745e011fe39949"><enum>(1)</enum><text>in paragraph (13), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="id38fa9b0276ac43efbef98b4b62e2d8ff"><enum>(2)</enum><text>by redesignating paragraph (14) as paragraph (15); and</text></paragraph>
<paragraph id="id68698f5db945496ebbafd1eeb769fbe5"><enum>(3)</enum><text>by inserting after paragraph (13) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idbfdfe5befcfb472696ee47e0b1050470" changed="added" reported-display-style="italic" committee-id="SSGA00"> <paragraph id="iddc25ef3e04ab4feb86302cef9df1a3b8"><enum>(14)</enum><text>provide support for the cybersecurity and physical security of critical infrastructure of international partners and allies in furtherance of the homeland security interests of the United States, which may include, consistent with section 104, assigning personnel to a duty station that is located outside the United States and providing equipment, services, technical assistance, or expertise; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="idfb0f4592-f3bb-4592-9818-f36bbf224327"><enum>(b)</enum><header>Foreign locations</header><text>Section 2202(g)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/652">6 U.S.C. 652(g)(1)</external-xref>) is amended by inserting <quote>, including locations outside the United States</quote> before the period at the end.</text></subsection> <subsection id="idd8850f04-b162-423b-afb8-6b4790cc1a6a"><enum>(c)</enum><header>Cyber planning</header><text>Section 2216 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665b">6 U.S.C. 665b</external-xref>) is amended—</text>
<paragraph id="id0f59689e-efbf-49b4-8140-142ad045519e" commented="no"><enum>(1)</enum><text>in subsection (a), in the first sentence, by inserting <quote>, including international partners, as appropriate</quote> after <quote>for public and private sector entities</quote>; and</text></paragraph> <paragraph id="id423a732d-f7a3-4cfd-9af8-8b0700a0d206"><enum>(2)</enum><text>in subsection (c)(2)—</text>
<subparagraph id="id11e7917f-7555-45b3-ab57-8f9d4d6fae47"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="idbb02ecfd-334e-4598-b6a3-db41834216f3"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph>
<subparagraph id="id6671ef1c-b278-416d-acc5-83e5c57ee176"><enum>(C)</enum><text>by adding at the end the following</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id8075e600-366f-42ef-b105-d5e7a0bce404" changed="added" reported-display-style="italic" committee-id="SSGA00"> <subparagraph id="id8b0af233-4971-4ac3-a39e-2443c260a0a8"><enum>(G)</enum><text>for planning with international partners, the Department of State.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section>
<section id="idff89d9ea22da4258ad0be62890778a30" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>5.</enum><header>Limitations</header><text display-inline="no-display-inline">Under the authority provided under this Act, or an amendment made by this Act, the Secretary of Homeland Security may not—</text> <paragraph id="id91323861188a4c89aa12917df8a7ba29"><enum>(1)</enum><text>engage in any activity that would censor a citizen of the United States;</text></paragraph>
<paragraph id="id9bcc375987d848a1882e541ddc710c7a"><enum>(2)</enum><text>conduct surveillance of a citizen of the United States; or</text></paragraph> <paragraph id="id893d098a09a74dc990831da634bd86e4"><enum>(3)</enum><text>interfere with an election in the United States.</text></paragraph></section>
