which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the National Oceanic and Atmospheric Administration to establish a grant program to fund youth fishing projects. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth Coastal Fishing Program Act of 2023</short-title></quote>.</text></section><section id="id48b0741c72604df082e4380b93304016"><enum>2.</enum><header>Youth coastal fishing grant program</header><subsection id="id9b542d96f9c24615a771e7df4d9782bc"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a program to award grants and provide technical assistance to eligible entities for the purpose of establishing youth fishing projects.</text></subsection><subsection id="id38987d3b04804f98b6b8cbc207e983ca"><enum>(b)</enum><header>Applications</header><text>An eligible entity seeking a grant under this section shall submit an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="id57489f7f07b74f6d9077759667adf164"><enum>(c)</enum><header>Determinations of eligibility</header><text>The Secretary shall develop criteria for purposes of determining whether an entity is eligible to receive a grant under this section in consultation with relevant offices of the National Oceanic and Atmospheric Administration, such as the Office of Coastal Management, the National Sea Grant Office, the National Marine Fisheries Service, and the Office of National Marine Sanctuaries.</text></subsection><subsection id="id757f1425284c40d09221718e1979c236"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity that receives a grant award under this section shall use the amount of the award for purposes related to conducting a youth fishing project, including—</text><paragraph id="id9ecb16caa03849899becac547f470432"><enum>(1)</enum><text>the purchase or rental of fishing equipment;</text></paragraph><paragraph id="idde4a2c96aa3640b390cc9cb265069248"><enum>(2)</enum><text>the cost of transporting participants to and from a youth fishing project;</text></paragraph><paragraph id="idf2d7a19da2954dc085b8edba55dad82e"><enum>(3)</enum><text>fees associated with boat rental, pier access, or other facilities;</text></paragraph><paragraph id="id9ff7c56de6aa4d9db97f9bd06240a05c"><enum>(4)</enum><text>fishing license purchases;</text></paragraph><paragraph id="id5f29fc7ef4e14eae97e67daccd609f15"><enum>(5)</enum><text>fishing guide costs; or</text></paragraph><paragraph id="idb976cfd229f04674ae84c5bb5ebcf5fc"><enum>(6)</enum><text>such other expenses related to conducting a youth fishing project as the Secretary considers appropriate.</text></paragraph></subsection><subsection id="iddf3f4ed8720c4e00a9f9a5d37fad68cb"><enum>(e)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to applications containing proposals for youth fishing projects focused on an underserved community.</text></subsection><subsection id="id71a13977274b4b41b56496da24cb7061"><enum>(f)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to Congress a report on—</text><paragraph id="idc889ba46f7964411a47c2397a2060a40"><enum>(1)</enum><text>the eligible entities awarded grants under this section;</text></paragraph><paragraph id="idd208a048d7c74ceda11b6d76c0a376b5"><enum>(2)</enum><text>the amount each such entity received;</text></paragraph><paragraph id="id4984264591ea4660ad91447b1bc91b1a"><enum>(3)</enum><text>how those entities used the grant award; and</text></paragraph><paragraph id="id5bcfb488693d4d8aacf703791a1fbf4d"><enum>(4)</enum><text>the number of participants in youth fishing projects funded by grants under this section.</text></paragraph></subsection><subsection id="id5caefcf8b7634f14ba4d1571ebe76e56"><enum>(g)</enum><header>Funding</header><paragraph id="idc5a5cffefed245c0bd866ac3578ce335"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $2,000,000 for each of fiscal years 2024 through 2028 to carry out this section.</text></paragraph><paragraph id="idf493a685b2714332988bfea76e9fc520"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated pursuant to the authorization of appropriations under paragraph (1) shall remain available until expended.</text></paragraph><paragraph id="id8d506ca5b0f24e6e8bd6c09e8e4bc546"><enum>(3)</enum><header>Administrative costs</header><text>Not more than 3 percent of amounts appropriated pursuant to the authorization of appropriations under paragraph (1) may be used by the Secretary for the administrative costs of carrying out this section. </text></paragraph></subsection><subsection id="ida75ea74e9edf4730bb42bf0e7594e20d"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id9ccd6804e2f342b8affa014dd4e2398c"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" id="id2cca0487e39c4cad95997cef9ca73875"><enum>(A)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph commented="no" id="id3f7214bf7ad94bc28794ba4742c75e81"><enum>(B)</enum><text>an educational institution;</text></subparagraph><subparagraph commented="no" id="id6264974e686946b1be4a4a2b9abe3e26"><enum>(C)</enum><text>a State, local, or Tribal government; or</text></subparagraph><subparagraph commented="no" id="id3f32143b96504826acd5ca5ec1f403fb"><enum>(D)</enum><text>a Native Hawaiian organization (as defined in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>)).</text></subparagraph></paragraph><paragraph id="id96ff70ae1a5148e1b3ed9c383c7c2c18"><enum>(2)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under 501(a) of that Code. </text></paragraph><paragraph id="idF04F4322AD96475EAD0DE91F2A8C2C55"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere. </text></paragraph><paragraph id="idcf804005026d486fa6d8be0492102fba"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Virgin Islands of the United States, and any other territory or possession of the United States. </text></paragraph><paragraph id="id5423cb98e1544dd69e128bdc4f5fe0f6"><enum>(5)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of the enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph><paragraph id="id90f6ca92bec845238738fa2cee426d71"><enum>(6)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means a population of individuals sharing a particular characteristic, or a geographic community, that has been systematically denied a full opportunity to participate in aspects of economic, social, and civic life, such as—</text><subparagraph id="idb5ca3437f4f74a4b8a87877cd3c52ea7"><enum>(A)</enum><text>racial and ethnic minorities;</text></subparagraph><subparagraph id="id8fde2ae57a134f9091f77999988623b5"><enum>(B)</enum><text>individuals with access and functional needs; or</text></subparagraph><subparagraph id="id1c5b7bd6998349ea86a5b6ca56c2bfd1"><enum>(C)</enum><text>individuals otherwise adversely affected by persistent poverty or inequality.</text></subparagraph></paragraph><paragraph id="id886106318fac45fa800fd002af2a9e4f"><enum>(7)</enum><header>Youth fishing project</header><text>The term <term>youth fishing project</term> means a project that provides youth with—</text><subparagraph id="idf7f42e0191474026a389263c7c6c952c"><enum>(A)</enum><text>a recreational fishing experience conducted from a shore, pier, or boat located in the Great Lakes, coastal waters, ocean waters, or a tidal river;</text></subparagraph><subparagraph id="id658f42f89c8741c09b2c6e072e3cf5ad"><enum>(B)</enum><text>education about marine science, conservation, and fishing regulations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb85dc1b602c3475b839efc3d3d9e56e8"><enum>(C)</enum><text>information on where and how to continue fishing. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
