<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1834</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230606">June 6, 2023</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the President from negotiating or concluding any withdrawal, suspension, waiver, or modification to the Agreement on Trade-Related Aspects of Intellectual Property Rights without explicit authorization from Congress.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Free TRIPS Act</short-title></quote>.</text></section><section id="id44A3DB819B914BEA803E7493E9AAEF59"><enum>2.</enum><header>Limitation on modification of Agreement on Trade-Related Aspects of Intellectual Property Rights</header><subsection id="id6DA56217CDCA4099BFF10D8625F0F12F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President, and any official, employee, or agent of the United States, may not negotiate or conclude any withdrawal, suspension, waiver, or modification to the TRIPS Agreement without obtaining explicit authorization from Congress before beginning negotiations with respect to that withdrawal, suspension, waiver, or modification.</text></subsection><subsection id="idf295732f055b429cb45f456e54357fea"><enum>(b)</enum><header>TRIPS agreement defined</header><text>In this section, the term <term>TRIPS Agreement</term> means the Agreement on Trade-Related Aspects of Intellectual Property Rights referred to in section 101(d)(15) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(15)</external-xref>).</text></subsection></section></legis-body></bill>
