printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To impose sanctions with respect to persons engaged in the import of petroleum from the Islamic Republic of Iran, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Harboring Iranian Petroleum Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id1fc22e4c77e045ef8dc6cb416ecf6c45" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idaa7df0ccc63c4328bfdd201b7970c936"><enum>(1)</enum><header>Alien</header><text>The term <term>alien</term> has the meaning given that term in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id674c916b885f40dab518a543d24611d9"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8ab41c5c1ce2459abb0676985b05c130"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfec1ce5c22eb43a7b8e0af1b38b98fdf"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6326083d94c44a1bd967d74c9ea12b9"><enum>(3)</enum><header>Family member</header><text>The term <term>family member</term> means, with respect to an individual, a spouse, child, parent, sibling, grandchild, or grandparent of the individual.</text></paragraph><paragraph id="idcfde5225c71347ad8ce5816eb6a6f92e"><enum>(4)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac94ab90c1fd454b86de6f8b48b08846"><enum>(5)</enum><header>Foreign port</header><text>The term <term>foreign port</term> means any harbor, marine terminal, or other shore side facility outside of the United States used principally for the movement of goods on the water.</text></paragraph><paragraph id="ida73b0958bf8c4094870d82e16c35329d"><enum>(6)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph><paragraph id="id0e1d780cdb0c40fcbc7baad584c131b8"><enum>(7)</enum><header>Material support</header><text>The term <term>material support</term> has the meaning given the term <term>material support or resources</term> in section 2339A of title 18, United States Code. </text></paragraph><paragraph id="id674844df92204203a57105c11426b453"><enum>(8)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id53152ab79f39403f8e73f4bae5541409"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="id1e80c5fc6f7241179cc9fbf542e27162"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph><paragraph id="id9b93fe081da541d88b254f29f72856e7"><enum>(9)</enum><header>Vessel</header><text>The term <term>vessel</term> means any watercraft or aircraft capable of being used as a means of transportation on, under, or over water. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id88553dc99c8f48718db7df4f78337fe2" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header display-inline="yes-display-inline">Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="ide0f03fb471d94c84b4987d3b1a3538c8"><enum>(1)</enum><text>to deny the Islamic Republic of Iran the ability to engage in destabilizing activities, support international terrorism, fund the development and acquisition of weapons of mass destruction and the means to deliver such weapons by limiting export of petroleum and petroleum products by the Islamic Republic of Iran;</text></paragraph><paragraph id="idb74481ed1a4c40adbdc98118184b0db0"><enum>(2)</enum><text>to deny the Islamic Republic of Iran funds to oppress and commit human rights violations against the Iranian people who are assembling peacefully to redress the Iranian regime; </text></paragraph><paragraph id="id221e7f3ce4304321bba95f78a092bc8a"><enum>(3)</enum><text>to sanction entities that violate the laws of the United States by providing support to the Iranian energy sector; and</text></paragraph><paragraph id="id6ed3466bc56047b99f5219d1918f9161"><enum>(4)</enum><text>that the actions of the Islamic Republic of Iran to finance and facilitate the participation of foreign terrorist organizations in ongoing conflicts and illicit activities is detrimental to the national security interests of the United States. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8410941b05f642aebae6a95b7c911edb" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>4.</enum><header>Sanctions with respect to foreign persons that engage in certain transactions</header><subsection id="id8834aeab58e848df8589e065937dbac1"><enum>(a)</enum><header>Imposition of sanctions</header><paragraph id="id1b6f35ffb69240cb8cc3fa7fe7962ac3"><enum>(1)</enum><header>In general</header><text>On and after the date that is 90 days after the date of the enactment of this Act, the President shall impose the sanctions described in subsection (b) with respect to a foreign person that the President determines knowingly engaged, on or after such date of enactment, in an activity described in paragraph (2).</text></paragraph><paragraph id="id370bdfe78dec4e228371f95e40a7fbce"><enum>(2)</enum><header>Activities described</header><text>A foreign person engages in an activity described in this paragraph if the foreign person—</text><subparagraph id="id41f02c2bf832478695fcc0bb01eaa3eb" commented="no"><enum>(A)</enum><text>owns or operates a foreign port that, on or after the date of the enactment of this Act, permitted to dock at such foreign port a vessel—</text><clause id="id539b202060b8407fb12ff6cd7841e48a" commented="no"><enum>(i)</enum><text>that is included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury for transporting Iranian crude oil; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id04b1794673754cf0a52c6f31c410e6c5"><enum>(ii)</enum><text display-inline="yes-display-inline">of which the operator or owner of such vessel otherwise knowingly engages in a significant transaction to transport, offload, or deal in condensate, refined, or unrefined petroleum products, or other petrochemical products originating from the Islamic Republic of Iran;</text></clause></subparagraph><subparagraph id="id92240e3d48014eaf9b01e9000813fbf8"><enum>(B)</enum><text>owns or operates a vessel that conducts a sea-to-sea transfer involving a significant transaction of any petroleum product originating from the Islamic Republic of Iran; </text></subparagraph><subparagraph id="id9dc6ca35850f4e3db3e8754d3763f878"><enum>(C)</enum><text>owns or operates a refinery that engages in a significant transaction to process, refine, or otherwise deal in any petroleum product originating from the Islamic Republic of Iran;</text></subparagraph><subparagraph id="ida4b4a124c646412d8c54743c996f454a"><enum>(D)</enum><text>is a family member of a foreign person described in subparagraph (A), (B), or (C);</text></subparagraph><subparagraph id="ida964a70ea55a4d26a11cca36b052396e"><enum>(E)</enum><text>is owned or controlled by a foreign person described in subparagraph (A), (B), (C), or (D); or</text></subparagraph><subparagraph id="id31c80b8fc3d747208d5bcb556e73e9b9"><enum>(F)</enum><text>engages in a significant transaction with, or provides material support to, a foreign person described in subparagraph (A), (B), (C), (D), or (E).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id276a2ef53193458383ff72b10462b0b6"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="ide05e5175af38420b9b7d47619b6b0d4e"><enum>(1)</enum><header>Sanctions on foreign vessels</header><text>Subject to such regulations as the President may prescribe, the President may prohibit a vessel described in subsection (a)(2)(A) or (a)(2)(B) from landing at any port in the United States—</text><subparagraph id="id78d065e2596646eea40889ae1f770fcc"><enum>(A)</enum><text>with respect to a vessel described in subsection (a)(2)(A), for a period of not more than 2 years beginning on the date on which the President imposes sanctions with respect to a related foreign port described in subsection (a)(2)(A); and</text></subparagraph><subparagraph id="id3d5f263c8b5740b58d0d7c62654955ce"><enum>(B)</enum><text>with respect to a vessel described in subsection (a)(2)(B), for a period of not more than 2 years. </text></subparagraph></paragraph><paragraph id="ida783c64f75e0446690576b4b833a6777"><enum>(2)</enum><header>Property blocking</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="id36cb34282d384878a4011e4b8049313e"><enum>(3)</enum><header>Ineligibility for visas, admission, or parole</header><subparagraph commented="no" display-inline="no-display-inline" id="id9c67f65bb6c24149b3e62688e6b67cd4"><enum>(A)</enum><header>Visas, admission, or parole</header><text display-inline="yes-display-inline">In the case of an alien, the alien is—</text><clause id="id6f626d836c8c4ea58cb41660c5f2dd66"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="idf908cef1acdc4c8d8db120928f90a5e7"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id46243e7e7ea64b5f86e3fa9d833cb2a6"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="id417d8da092e1440b9e7184709fbc07a8"><enum>(B)</enum><header>Current visas revoked</header><clause id="idec5390061b8e4b44aa6e09e3c2d36ecb"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subparagraph (A) shall be revoked, regardless of when such visa or other entry documentation was issued. </text></clause><clause id="ide7a516cd545d489aaa5e382ac5c0f462"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="idc4029e5bd1294047a35fd96083ade475"><enum>(I)</enum><text>take effect immediately; </text></subclause><subclause id="idb6406249f812433d915dbc580d279b27"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien's possession; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida8367b0fe9d0455f8d22ef8781fab917"><enum>(III)</enum><text>be implemented in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="id9b509ec6dc7146d19905e839b94726f4"><enum>(4)</enum><header>Implementation; penalties</header><subparagraph id="ida7f156d07e52465ea499f1949b566956"><enum>(A)</enum><header>Implementation</header><text>The President—</text><clause commented="no" display-inline="no-display-inline" id="id4f4890e850f04937af3104d868f9b243"><enum>(i)</enum><text display-inline="yes-display-inline">may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9dc59c661f0e4cde91c984d59babaffd"><enum>(ii)</enum><text>not later than 180 days after the date of the enactment of this Act, shall prescribe such regulations as necessary to carry out this Act. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64d08bb1f375489dbe6e744920a706e3"><enum>(B)</enum><header>Notification to Congress</header><text>Not later than 10 days before the effective date of any regulation prescribed under subparagraph (A)(ii), the President shall brief the appropriate congressional committees on the proposed regulations and the provisions of this Act relating to such regulations.</text></subparagraph><subparagraph id="id780b1ee38f35477681804cf6671aea04"><enum>(C)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></subparagraph></paragraph></subsection><subsection id="idc7bdc37a39f243b6bb103c421703ecbb"><enum>(c)</enum><header>Exceptions</header><paragraph id="idf61cd4ab2aea4cc1b8e363b4ba6ee593"><enum>(1)</enum><header>Exception relating to importation of goods</header><subparagraph id="id1b3c2ef07d334b59a3848e4201e53484"><enum>(A)</enum><header>In general</header><text>A requirement to block and prohibit all transactions in all property and interests in property under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id84c79225ad95443fac88327153effadc"><enum>(B)</enum><header>Good</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subparagraph></paragraph><paragraph id="idf571272655fb4bc68fd4b4b39978b9ab"><enum>(2)</enum><header>Exception to comply with United Nations headquarters agreement and law enforcement activities</header><text>Sanctions under subsection (b)(3) shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48c381564ef74bbf94feff6da4355652"><enum>(3)</enum><header>Exception to comply with intelligence, law enforcement, and other national security activities</header><text>Sanctions under subsection (b) shall not apply with respect to a foreign person if such foreign person is a subject or target of, or otherwise involved in, an intelligence, law enforcement, or national security activity of the United States, as determined by the President.</text></paragraph></subsection><subsection id="idaf27b0a1979244949afed3c9b5f85d1d"><enum>(d)</enum><header>Waivers</header><paragraph commented="no" display-inline="no-display-inline" id="id5bbe04ad733a4f2eaab63cc1ee291b6a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive the application of sanctions under this section with respect to a foreign person for a period not to exceed 180 days if the President—</text><subparagraph id="ide991f72b46e54e949c469b3d415509f0"><enum>(A)</enum><text>determines that such a waiver is vital to the national interests of the United States; and</text></subparagraph><subparagraph id="id8cfe2a2f8b714af3bc6b7773b720ad63"><enum>(B)</enum><text>not less than 15 days before the granting of the waiver, submits to the appropriate congressional committees a notice of and justification for the waiver. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff5c8999454948a099a408b19da333e0"><enum>(2)</enum><header>Special rule</header><subparagraph commented="no" display-inline="no-display-inline" id="id4cfe5faf5bcb4a1d8b474de00509a911"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive the application of sanctions under this section with respect to a foreign person if the President certifies in writing to the appropriate congressional committees that—</text><clause commented="no" display-inline="no-display-inline" id="idce72f15eb2294e678c35c5375b7ee18e"><enum>(i)</enum><text display-inline="yes-display-inline">the foreign person—</text><subclause commented="no" display-inline="no-display-inline" id="idd070ca9d7cf5471e84e6429ee11d4b80"><enum>(I)</enum><text display-inline="yes-display-inline">has ceased engaging in activities described in subsection (b); or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1fcd1df1e5284f0bba7b5ff2e9a529fe"><enum>(II)</enum><text display-inline="yes-display-inline">has taken and is continuing to take significant verifiable steps toward ceasing such activities; and </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf7762de14b0544f3a6fd95a6a7bcf5b3"><enum>(ii)</enum><text display-inline="yes-display-inline">the President has received reliable assurances from the government of the foreign country that such foreign person will not resume engaging in any activity described in subsection (b).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb666df7a717b4c90aca0188a4021eb8a"><enum>(B)</enum><header>Sunset</header><text>The authority to grant a waiver under this paragraph shall terminate on the date that is 5 years after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc83b95e926f2446cb14fc4d637467bc9" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>5.</enum><header>Report on petroleum and petroleum product exports from Iran</header><subsection id="id71c5dfa6fce148f18d5fc5e8c220f37e"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Administrator of the Energy Information Administration shall submit to the appropriate congressional committees a report on the increase exports of petroleum and petroleum products by the Islamic Republic of Iran.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida15621fa95864a1195b37ab947918121"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include the following:</text><paragraph id="id3c29f3e54f6044cabccb576408bae59c"><enum>(1)</enum><text>An analysis of the export and sale of petroleum and petroleum products by the Islamic Republic of Iran since 2018, including—</text><subparagraph id="idd794868320244364931904f94ece1ad9"><enum>(A)</enum><text>an estimate of the annual revenue of the export and sale of petroleum by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="idd933fedd6f0646d3b13f72d845a6b4e6"><enum>(B)</enum><text>an estimate of the annual revenue of the export and sale of petroleum to the People's Republic of China by the Islamic Republic of Iran, Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id6c1f6276967f4ef785bf474bd6456da3"><enum>(D)</enum><text>the number of petroleum and crude oil barrels annually exported to the People's Republic of China by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id8e3ee861105248e2a1a564189bdbde3f"><enum>(E)</enum><text>the number of petroleum and crude oil barrels annually exported to countries other than the People's Republic of China by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="idb38f0683577a4d2996234407917c5c6a"><enum>(F)</enum><text>the average price per petroleum and crude oil barrel annually exported by the Islamic Republic of Iran, disaggregated by year; and</text></subparagraph><subparagraph id="id97f07e5d795246c5ba1a46d322799a5f"><enum>(G)</enum><text>the average price per petroleum and crude oil barrel annually exported to the People's Republic of China by the Islamic Republic of Iran, disaggregated by year.</text></subparagraph></paragraph><paragraph id="id48c8c8c7466248d3a57dbbc8dc674ef6"><enum>(2)</enum><text>An analysis of the labeling practices of the Islamic Republic of Iran with respect to exported petroleum and petroleum products.</text></paragraph><paragraph id="idbc63e6a0ae9b45a5b73ce3ceef1cd394"><enum>(3)</enum><text>A description of persons involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph><paragraph id="idf81e9504abad45a9b52d69493f9e5ef7"><enum>(4)</enum><text>A description of vessels involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph><paragraph id="id1145d0cdf6e5460aa0cd3f6e5d4f6057"><enum>(5)</enum><text>A description of foreign ports involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph></subsection><subsection id="id5aa7317e8a914a3a95bd76764b4458fd"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form but may include a classified annex.</text></subsection><subsection id="iddd5db380ba494a1b92b454fdacc96b35"><enum>(d)</enum><header>Publication</header><text>The unclassified portion of the report required by subsection (a) shall be posted on a publicly available website of the Energy Information Administration.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id4a923c4291ff4625ae61459a1dcbdb9e" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Harboring Iranian Petroleum Act of 2024</short-title></quote>.</text></section><section id="idad089bd0e93d4895a76a28d3cb3004e3" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6f2ac6be3acf4febb9e7fb0db3bbd634"><enum>(1)</enum><header>Admission; admitted; alien; lawfully admitted for permanent residence</header><text>The terms <quote>admission</quote>, <quote>admitted</quote>, <quote>alien</quote>, and <quote>lawfully admitted for permanent residence</quote> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="id8ee5091320ad4e16af595b2821827ed0"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id03723a266bc04729855a8364e2c7c7ab"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></subparagraph><subparagraph id="id1258fcfcf3c74a78bb82f7e2a57c4bbf"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idf0d851a796994d269cc83c3212d6f263"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph><paragraph id="id03633025c6814835bff0699da7529d87"><enum>(4)</enum><header>Foreign port</header><text>The term <term>foreign port</term> means any harbor, marine terminal, or other shore side facility outside of the United States used principally for the movement of goods on the water.</text></paragraph><paragraph id="id3591a699e3a14d51827b7c812105e74a"><enum>(5)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph><paragraph id="id5d7c4d26bb6b4aa4ba56089eb533541a"><enum>(6)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idd96011ff34e3436fbf79e2456dba1ef0"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="idfd077aeacce9458a9f8517072c2c859f"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph><paragraph id="id127ad9cfb9084fb0ae35a2134ae46325"><enum>(7)</enum><header>Vessel</header><text>The term <term>vessel</term> means any watercraft or aircraft capable of being used as a means of transportation on, under, or over water.</text></paragraph></section><section id="id469a6c8041324b068188412e54a4cb7e" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="ida36c8427488e42e2b02c314d1d5c611c"><enum>(1)</enum><text>to deny the Islamic Republic of Iran the ability to engage in destabilizing activities, support international terrorism, fund the development and acquisition of weapons of mass destruction and the means to deliver such weapons by limiting export of petroleum and petroleum products by the Islamic Republic of Iran;</text></paragraph><paragraph id="idfe036993a2ae4243a940596615f4ee42"><enum>(2)</enum><text>to deny the Islamic Republic of Iran funds to oppress and commit human rights violations against the Iranian people who are assembling peacefully to redress the Iranian regime; </text></paragraph><paragraph id="id2849f06dfabb4d9b81ff65da15fb3d51"><enum>(3)</enum><text>to sanction entities that provide support to the Iranian energy sector; and</text></paragraph><paragraph id="idbbe7f87ed1444f95bb939ab90f2439c3"><enum>(4)</enum><text>to counter the efforts of the Islamic Republic of Iran to finance and facilitate the participation of foreign terrorist organizations in ongoing conflicts and illicit activities in the region and beyond, which is detrimental to the national security interests of the United States.</text></paragraph></section><section id="idc7a7cb8ef7234d359945b504d7ea9044" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header>Sanctions with respect to foreign persons that engage in certain transactions</header><subsection id="id080c21e0ea7448b18f199a341bbddbe4"><enum>(a)</enum><header>Imposition of sanctions</header><paragraph id="id7793b9b0988646699d4e99b75a927b8a"><enum>(1)</enum><header>In general</header><text>On and after the date that is 180 days after the date of the enactment of this Act, the President shall impose the sanctions described in subsection (b) with respect to a foreign person that the President determines knowingly engaged, on or after such date of enactment, in an activity described in paragraph (2).</text></paragraph><paragraph id="id2cec30e8d90545189757c7175660748f"><enum>(2)</enum><header>Activities described</header><text>A foreign person engages in an activity described in this paragraph if the foreign person—</text><subparagraph id="id7f4a7e5ac31645a69f5ee52bb2ea9eda" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>(A)</enum><text>owns or operates a foreign port at which, on or after the date of the enactment of this Act, such person knowingly permits to dock a vessel—</text><clause id="ida19b00772f564cbf92ebd6fa4dd25c5b"><enum>(i)</enum><text>that is included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury for transporting Iranian crude oil or petroleum products; or</text></clause><clause id="ida41cbaf3f2eb4f66a625034f9df148d2"><enum>(ii)</enum><text>of which the operator or owner of such vessel otherwise knowingly engages in a significant transaction involving such vessel to transport, offload, or deal in significant transactions in condensate, refined, or unrefined petroleum products, or other petrochemical products originating from the Islamic Republic of Iran;</text></clause></subparagraph><subparagraph id="id1a6b766a42ac4e51aa1b325466712a8c" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>(B)</enum><text>owns or operates a vessel through which such owner knowingly conducts a sea-to-sea transfer involving a significant transaction of any petroleum product originating from the Islamic Republic of Iran;</text></subparagraph><subparagraph id="idcf00011a94e04c3db3d603d5f52aec05" changed="added" reported-display-style="italic"><enum>(C)</enum><text>owns or operates a vessel that is knowingly used by a foreign person for the transportation of significant amounts of petroleum or petroleum products from the Islamic Republic of Iran; </text></subparagraph><subparagraph id="id85f7ff94bf9d43faaf22dc431caede0b" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>(D)</enum><text>owns or operates a refinery through which such owner knowingly engages in a significant transaction to process, refine, or otherwise deal in any petroleum product originating from the Islamic Republic of Iran;</text></subparagraph><subparagraph id="id6fdc73b14b5a46939868b2e7dbaa15c8" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>(E)</enum><text>is a covered family member of a foreign person described in subparagraph (A), (B), or (D); or</text></subparagraph><subparagraph id="id50624abcfaf34412b55d449ebb082f66" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>(F)</enum><text>is owned or controlled by a foreign person described in subparagraph (A), (B), or (D), and knowingly engages in an activity described in subparagraph (A), (B), or (D). </text></subparagraph></paragraph></subsection><subsection id="id211a545855144da0968468747f51c62d"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="ideb1212daa21a4cf6af64cd847b0946d3"><enum>(1)</enum><header>Sanctions on foreign vessels</header><text>Subject to such regulations as the President may prescribe, the President may prohibit a vessel described in subsection (a)(2)(A) or (a)(2)(B) from landing at any port in the United States—</text><subparagraph id="ida51cc03178a14f1bba7851560db2b766"><enum>(A)</enum><text>with respect to a vessel described in subsection (a)(2)(A), for a period of not more than 2 years beginning on the date on which the President imposes sanctions with respect to a related foreign port described in subsection (a)(2)(A); and</text></subparagraph><subparagraph id="ide146fb2919134becba952c0ffeee167c"><enum>(B)</enum><text>with respect to a vessel described in subsection (a)(2)(B), for a period of not more than 2 years.</text></subparagraph></paragraph><paragraph id="idf2103f059d9c40e99efa1e744dbb02f7"><enum>(2)</enum><header>Property blocking</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="ida3c3cc420e4c4a1f999d1e7d0f7a2457"><enum>(3)</enum><header>Ineligibility for visas, admission, or parole</header><subparagraph id="id20bf45a5ed8d412ba14d235a41410aef"><enum>(A)</enum><header>Visas, admission, or parole</header><text>In the case of an alien, the alien is—</text><clause id="id1e83dfe477c946deb087c9c16399a2c5"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="iddd1a43764be548f580f5f79325b66de4"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id3e93a3a8574740fca058945b0c75c6fa"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="id68b96b17d58242609e56012ceef77f06"><enum>(B)</enum><header>Current visas revoked</header><clause id="idd363ecf10e13433dbff183f7897f2892"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subparagraph (A) shall be revoked, regardless of when such visa or other entry documentation was issued.</text></clause><clause id="idf3aa67e950aa4a099ce26310f9c1ca6b"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="id38f64f5f90f547f3a2048c42f1360ad6"><enum>(I)</enum><text>take effect immediately;</text></subclause><subclause id="id3187883126dc411492edca9fddc66fbb"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien’s possession; and</text></subclause><subclause id="id02a9d8298b4b4923882f053634b1d4aa"><enum>(III)</enum><text>be implemented in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="id6056d379654a43b3a58cebe89e00f1fe"><enum>(4)</enum><header>Implementation; penalties</header><subparagraph id="id72cfd0a8158649ac998ca5972e086b3d"><enum>(A)</enum><header>Implementation</header><text>The President—</text><clause id="id6d34891846294df4877ef9b035562947"><enum>(i)</enum><text>may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section; and</text></clause><clause id="id7af37dfeabcf488490295504c5d1210b"><enum>(ii)</enum><text>not later than 180 days after the date of the enactment of this Act, shall prescribe such regulations as necessary to carry out this Act.</text></clause></subparagraph><subparagraph id="ida7c182aa60bf4d0d81cdac07b4f76f89"><enum>(B)</enum><header>Notification to Congress</header><text>Not later than 10 days before the effective date of any regulation prescribed in accordance with subparagraph (A)(ii), the President shall brief the appropriate congressional committees on the proposed regulations and the provisions of this Act relating to such regulations.</text></subparagraph><subparagraph id="idc51d0dcbb26f405082dfa193ebe4df9b"><enum>(C)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subparagraph></paragraph></subsection><subsection id="ided2de77d541349158fe28b4f71244603"><enum>(c)</enum><header>Waivers</header><paragraph id="id830fe043bc9742e4878805d774406507"><enum>(1)</enum><header>In general</header><text>The President may waive the application of sanctions under this section for renewable periods not to exceed 180 days if the President—</text><subparagraph id="id073480151ab5481ba0cbd47d5f786b2b"><enum>(A)</enum><text>determines that such a waiver is in the vital national security interests of the United States; and</text></subparagraph><subparagraph id="id1100b0ad9ace40268ef072a3c5749709"><enum>(B)</enum><text>not less than 15 days before the granting of the waiver, submits to the appropriate congressional committees a notice of and justification for the waiver.</text></subparagraph></paragraph><paragraph id="ideacd01aeac324f5d82ec00cfd79714d5"><enum>(2)</enum><header>Form</header><text>The waiver described in paragraph (1) may be transmitted in classified form.</text></paragraph><paragraph id="id314df3e8579a492ebf22439d30b06c71"><enum>(3)</enum><header>Special rule</header><text>The President may waive the application of sanctions under this section with respect to a foreign person if the President certifies in writing to the appropriate congressional committees that the foreign person—</text><subparagraph id="idafd4ddb24764454894520bf4ef7c4b36"><enum>(A)</enum><text>has ceased engaging in activities described in subsection (a)(2); or</text></subparagraph><subparagraph id="idb04c579a4f184eb692367f90594c40a8"><enum>(B)</enum><text>has taken and is continuing to take significant verifiable steps toward ceasing such activities.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id32f5caa64f6f43f4962cf9ff9e29efec"><enum>(d)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authority to impose sanctions under this section, and any sanctions imposed under this section, shall terminate on the date that is 4 years after the date of the enactment of this Act.</text></subsection><subsection id="id12976fc7fc134585983928b751b07fa3"><enum>(e)</enum><header>Covered family member defined</header><text>In this section, the term <term>covered family member</term>, with respect to a foreign person who is an individual, means a spouse, adult child, parent, or sibling of the person who engages in the sanctionable activity described under subsection (a)(2) or who demonstrably benefits from such activity. </text></subsection></section><section id="id64be9f3a601e4aa19b8aa286bee778d2" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Report on petroleum and petroleum product exports from Iran</header><subsection id="idd179dbb4c1674fd9b6e36b98b3612836"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Administrator of the Energy Information Administration shall submit to the appropriate congressional committees a report on the increase of exports of petroleum and petroleum products by the Islamic Republic of Iran.</text></subsection><subsection id="id71b4cd180b85404ba2bb021d6a5f5b71"><enum>(b)</enum><header>Contents</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="idf36a3f7f1f7b460fac01b4012ca808bd"><enum>(1)</enum><text>An analysis of the export and sale of petroleum and petroleum products by the Islamic Republic of Iran since 2018, including—</text><subparagraph id="ide4942ec0cb594055971d5c58cce5fb31"><enum>(A)</enum><text>an estimate of the annual revenue of the export and sale of petroleum by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id05c3c0b32f4141cab0337d2c7986905a"><enum>(B)</enum><text>an estimate of the annual revenue of the export and sale of petroleum to the People’s Republic of China by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id8d0fd564962942ce9847490cfafe4002"><enum>(C)</enum><text>the number of petroleum and crude oil barrels annually exported by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id61da858ef2794d2a8d74080e5a977942"><enum>(D)</enum><text>the number of petroleum and crude oil barrels annually exported to the People’s Republic of China by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="idac954559feea408d91ad23af35cab90e"><enum>(E)</enum><text>the number of petroleum and crude oil barrels annually exported to countries other than the People’s Republic of China by the Islamic Republic of Iran, disaggregated by year;</text></subparagraph><subparagraph id="id8d0b2b2c0757408aa6f173e5cda86293"><enum>(F)</enum><text>the average price per petroleum and crude oil barrel annually exported by the Islamic Republic of Iran, disaggregated by year; and</text></subparagraph><subparagraph id="idaf73750f0c5140e2b60313a2fc22af96"><enum>(G)</enum><text>the average price per petroleum and crude oil barrel annually exported to the People’s Republic of China by the Islamic Republic of Iran, disaggregated by year.</text></subparagraph></paragraph><paragraph id="id67de5bd5aef84559bb4c0dba25cba5e7"><enum>(2)</enum><text>An analysis of the labeling practices of the Islamic Republic of Iran with respect to exported petroleum and petroleum products.</text></paragraph><paragraph id="id433eab4933c241b6affb10adc9743a3f"><enum>(3)</enum><text>A description of persons involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph><paragraph id="id4096eca3bba74658bca08fba090ea26b"><enum>(4)</enum><text>A description of vessels involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph><paragraph id="id9f26375ac2d44295883b476e05a578f6"><enum>(5)</enum><text>A description of foreign ports involved in the export and sale of petroleum and petroleum products from the Islamic Republic of Iran.</text></paragraph></subsection><subsection id="id35103d2bc1874437b293c0b1b73611f2"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection><subsection id="id3f60858310de4804996c616145724965"><enum>(d)</enum><header>Publication</header><text>The unclassified portion of the report required by subsection (a) shall be posted on a publicly available website of the Energy Information Administration.</text></subsection></section><section id="idd136269aac4b47e88ac5d99a8ce84a4a" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>6.</enum><header>Modification and extension of Sanctioning the Use of Civilians as Defenseless Shields Act</header><subsection id="id4f9c4279e5024cf18a55d2197c0c6670"><enum>(a)</enum><header>In general</header><text>Section 3 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph id="id1780733b7f764722a2ff208fd2f42d58"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idaa601e75b0ff4351b2ca11e6c1ba7ea9"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="idf1419bc11a3c4a859dfedda0b1f99185"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbf6ae467cce940f28d58fc1a9cf2cc89" changed="added" reported-display-style="italic" committee-id="SSFR00"><paragraph id="idde74a7768b984cae956bafad85b8ee18"><enum>(3)</enum><text>Each foreign person that the President determines, on or after the date of the enactment of the <short-title>Stop Harboring Iranian Petroleum Act of 2024</short-title>—</text><subparagraph id="id875732cecb3b4d999d30aedd914aaf42"><enum>(A)</enum><text>is a member of Palestine Islamic Jihad or is knowingly acting on behalf of Palestine Islamic Jihad; and</text></subparagraph><subparagraph id="ida3218ac838e447c890aca3312d380141"><enum>(B)</enum><text>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb9eb4b66468e4fbc928964e6f4aff295"><enum>(2)</enum><text>by redesignating subsections (e), (f), (g), (h), and (i) as subsections (f), (g), (h), (i), and (j), respectively; and</text></paragraph><paragraph id="idac55282bd24b430191878089e239bc4e"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6101eb99ae904aeca4f9da07ab9c4061" changed="added" reported-display-style="italic" committee-id="SSFR00"><subsection id="id29f4563b85f841569c2dd2a67c7eeb8f"><enum>(e)</enum><header>Congressional requests</header><text>Not later than 120 days after receiving a request from the chairman and ranking member of one of the appropriate congressional committees with respect to whether a foreign person meets the criteria of a person described in subsection (b) or (c), the President shall—</text><paragraph id="id87b45516a5b64c8c867e133356af2906"><enum>(1)</enum><text>determine if the person meets such criteria; and</text></paragraph><paragraph id="id01bb8c8a26664ec180ae619f55381186"><enum>(2)</enum><text>submit a written justification to the chairman and ranking member detailing whether or not the President imposed or intends to impose sanctions described in subsection (b) or (c) with respect to such person.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc8cc5918491640e1a487e2f3a1c34537"><enum>(b)</enum><header>Definitions</header><text>Section 4 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph id="id25740a8c9dbb4d6795d5a186f5d5133c"><enum>(1)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></paragraph><paragraph id="id10e08767e218424da9cf1a37da293b49"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11f5f85aa9514a0eab414c58e747f268" changed="added" reported-display-style="italic" committee-id="SSFR00"><paragraph id="id782422fc0d764c92bf44a5164ff5ba82"><enum>(7)</enum><header>Palestine islamic jihad</header><text>The term <term>Palestine Islamic Jihad</term> means—</text><subparagraph id="id5ee48ba2026e4dd58c38e427132c479f"><enum>(A)</enum><text>the entity known as Palestine Islamic Jihad and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text></subparagraph><subparagraph id="ide8251356c8394ce79126cb1abcef3dd8"><enum>(B)</enum><text>any person identified as an agent or instrumentality of Palestine Islamic Jihad on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of the Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id05e4b880766e45bead4611282f91246f"><enum>(c)</enum><header>Sunset</header><text>Section 5 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by striking <quote>December 31, 2023</quote> and inserting <quote>December 31, 2030</quote>.</text></subsection></section><section id="id257e5eb6c847494d8f0dce16dbffe0ca" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>7.</enum><header>Confronting asymmetric and malicious cyber activities</header><subsection id="id546c27b14f6c4c33acec9ad96aa77780"><enum>(a)</enum><header>In general</header><text>On and after the date that is 180 days after the date of the enactment of this Act, the President may impose the sanctions described in subsection (b) with respect to any foreign person that the President determines, on or after such date of enactment—</text><paragraph id="id088ec6e733fd4e929922ddcbab6a32e8"><enum/></paragraph><paragraph commented="no" display-inline="yes-display-inline" id="id8c72f3f8407645adbffb54cead6814f1"><enum>(1)</enum><text>is responsible for or complicit in, or has engaged knowingly in, significant cyber-enabled activities originating from, or directed by persons located, in whole or in substantial part, outside the United States that are reasonably likely to result in, or have materially contributed to, a significant threat to the national security, foreign policy, or economic health or financial stability of the United States;</text></paragraph><paragraph id="id9793fedfbb3f412399ec01821d12e319"><enum>(2)</enum><text> materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of, any activity described in this subsection or any person whose property and interests in property are blocked pursuant to this section;</text></paragraph><paragraph id="id5d30be61808548f39a81a644ca3e4f0b"><enum>(3)</enum><text>is owned or controlled by, or has acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked pursuant to this section; or</text></paragraph><paragraph id="ida437c64fbd04479399f3c4c9b366a491"><enum>(4)</enum><text>has attempted to engage in any of the activities described in paragraph (1), (2), or (3). </text></paragraph></subsection><subsection id="iddc21135b105d45ec89f894460d520998"><enum>(b)</enum><header>Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection are the following:</text><paragraph id="id70853ed4fff04113becd3dfbc5cc88cf"><enum>(1)</enum><header>Inadmissibility to United States</header><text>In the case of an alien—</text><subparagraph id="id20c4a317c6cf4ff9885821014145f9ca"><enum>(A)</enum><text>ineligibility to receive a visa to enter the United States or to be admitted to the United States; or</text></subparagraph><subparagraph id="id23DB41F3835C4CBEA50F949DC276BCBA"><enum>(B)</enum><text>if the individual has been issued a visa or other documentation, revocation, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>), of the visa or other documentation.</text></subparagraph></paragraph><paragraph id="id735e783aa93d4baa9a0ac65f55e29b3c"><enum>(2)</enum><header>Blocking of property</header><text>The blocking, in accordance with the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), of all transactions in all property and interests in property of a foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection><subsection id="id6eaaa3c6d98e4c548da6d2ed22b3f250"><enum>(c)</enum><header>Requests by appropriate congressional committees</header><paragraph id="idd0a1554d59fa4781998c75f1c48bd550"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after receiving a request that meets the requirements of paragraph (2) with respect to whether a foreign person has engaged in an activity described in subsection (a), the President shall—</text><subparagraph id="id4064a0667b254418ade651e15b922a91"><enum>(A)</enum><text>determine if that person has engaged in such an activity; and</text></subparagraph><subparagraph id="id1a5de73d06534e44bab179f116dc6471"><enum>(B)</enum><text>submit a classified or unclassified report to the chairperson and ranking member of the committee or committees that submitted the request with respect to that determination that includes—</text><clause id="id770cdf9128a14a39a05674ba8f0ffda5"><enum>(i)</enum><text>a statement of whether or not the President imposed or intends to impose sanctions with respect to the person;</text></clause><clause id="ida4e33bb53a2446018392c62704890bf3"><enum>(ii)</enum><text>if the President imposed or intends to impose sanctions, a description of those sanctions; and</text></clause><clause id="id82b61b6560de44e5b95f2f324890e942"><enum>(iii)</enum><text>if the President does not intend to impose sanctions, a description of actions that meet the threshold for the President to impose sanctions.</text></clause></subparagraph></paragraph><paragraph id="id39876eece8a1468086d0d1b9810f91a6"><enum>(2)</enum><header>Requirements</header><text>A request under paragraph (1) with respect to whether a foreign person has engaged in an activity described in subsection (a) shall be submitted to the President in writing jointly by the chairperson and ranking member of one of the appropriate congressional committees. </text></paragraph></subsection></section><section id="ide3a2ae3572774227a41cbd0dd59b43bd" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>8.</enum><header>Sanctions with respect to threats to current or former United States officials</header><subsection id="id7f941b4ccf2e44f8a85ef12616fd45c6"><enum>(a)</enum><header>In general</header><text>On and after the date that is 180 days after the date of the enactment of this Act, the President shall impose the sanctions described in subsection (b) with respect to any foreign person the President determines has, on or after such date of enactment, ordered, directed, or taken material steps to carry out any use of violence or has attempted or threatened to use violence against any current or former official of the Government of the United States.</text></subsection><subsection id="idd735d173d718408887a60301e1fbc0d5"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="id5f1cf8cc3a5f4b9199f58ab2eea47fda"><enum>(1)</enum><header>Inadmissibility to United States</header><text>In the case of a foreign person who is an individual—</text><subparagraph id="id0eeff35b2aa14171a5d4a5fda5d88401"><enum>(A)</enum><text>ineligibility to receive a visa to enter the United States or to be admitted to the United States; or</text></subparagraph><subparagraph id="id2963f487414c4e398cc058d5b3db3a2a"><enum>(B)</enum><text>if the individual has been issued a visa or other documentation, revocation, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>), of the visa or other documentation.</text></subparagraph></paragraph><paragraph id="id4d44321093b24de998ea941d4d71c5fc"><enum>(2)</enum><header>Blocking of property</header><text>The blocking, in accordance with the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), of all transactions in all property and interests in property of a foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection><subsection id="id74dd7af4a9734be389eeadb3572e83c0"><enum>(c)</enum><header>Enforcement of blocking of property</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of a sanction described in subsection (b)(2) that is imposed by the President or any regulation, license, or order issued to carry out such a sanction shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection><subsection id="id8556f1d4b4ed416e899f19d80039f6ad"><enum>(d)</enum><header>Waiver</header><paragraph id="ide22cc074e3b5427a869fdcb940e52bbd"><enum>(1)</enum><header>In general</header><text>The President may waive the application of sanctions under this section for renewable periods not to exceed 180 days if the President—</text><subparagraph id="id1ce53c9af5534e0997c8f1742428c82a"><enum>(A)</enum><text>determines that such a waiver is in the vital national security interests of the United States; and</text></subparagraph><subparagraph id="id08b0ca92a5f34b05b4364c3038f3a8f0"><enum>(B)</enum><text>not less than 15 days before the granting of the waiver, submits to the appropriate congressional committees a notice of and justification for the waiver.</text></subparagraph></paragraph></subsection><subsection id="id0597ec1ff95a45fd9892bca1eb71614d"><enum>(e)</enum><header>Termination and sunset</header><paragraph id="ida3ef2b28094f4a69a5aa47695355bfc0"><enum>(1)</enum><header>Termination of sanctions</header><text>The President may terminate the application of sanctions under this section with respect to a person if the President determines and reports to the appropriate congressional committees not later than 15 days before the termination of the sanctions that—</text><subparagraph id="ida66bf10f63ac4d0dadf25c7158ea95fe"><enum>(A)</enum><text>credible information exists that the person did not engage in the activity for which sanctions were imposed;</text></subparagraph><subparagraph id="id9aaac3c80a56411286f85bfe81a2b081"><enum>(B)</enum><text>the person has credibly demonstrated a significant change in behavior, has paid an appropriate consequence for the activity for which sanctions were imposed, and has credibly committed to not engage in an activity described in subsection (a) in the future; or</text></subparagraph><subparagraph id="idf1d3c1cdda964811b786cfa1eaf14d6b"><enum>(C)</enum><text>the termination of the sanctions is in the vital national security interests of the United States.</text></subparagraph></paragraph><paragraph id="id6b8cce4a49164132aa188e4bb61364cd"><enum>(2)</enum><header>Sunset</header><text>The requirement to impose sanctions under this section shall terminate on the date that is 4 years after the date of the enactment of this Act. </text></paragraph></subsection></section><section id="id430da60f9e244630806bf768559e5684" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>9.</enum><header>Resources for sanctions implementation at the Department of State</header><subsection id="iddd330fa47ecb4f9c9205dba567304f57"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that sanctions are a vital foreign policy and national security tool, and as such, it is critical that the Department of State and other agencies with responsibilities relating to sanctions across the executive branch—</text><paragraph id="idf3d033564cc246d7a7f28646df757c24"><enum>(1)</enum><text>are fully staffed, including through the prompt confirmation by the Senate of a qualified head of the Office of Sanctions Coordination of the Department of State; and</text></paragraph><paragraph id="ida6ca2301b3634eb4875bdbbdcf943374"><enum>(2)</enum><text>have the resources and infrastructure necessary for the successful development and implementation of sanctions.</text></paragraph></subsection><subsection id="id920dc5347c4048f08680ed088d554230"><enum>(b)</enum><header>Increasing resources and improving modernization for sanctions implementation</header><text>The Secretary of State shall take steps to modernize the sanctions infrastructure and increase resources dedicated to implementing sanctions, including by—</text><paragraph id="idbec73fbdf1c947dbb5df3b9f78859ac0"><enum>(1)</enum><text>ensuring the Department of State has necessary subscriptions and access to open-source databases for purposes of making determinations to support the designation of persons for the imposition of sanctions;</text></paragraph><paragraph id="ide020fa32357e4bda956cd954c5e0a5db"><enum>(2)</enum><text>equipping bureaus involved in drafting and reviewing evidentiary packages to support such designations with sufficient technical resources to do so, including an adequate number of workstations that can be used to review classified information; and</text></paragraph><paragraph id="id20ac378ac3e44f2cb5dd352f97999644"><enum>(3)</enum><text>increasing the number of personnel dedicated to making and reviewing such designations.</text></paragraph></subsection><subsection id="id6918c2f3a0e14cdcbada8bd27f45c869"><enum>(c)</enum><header>Report on modernizations efforts</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report describing steps the Department of State is taking to address challenges in the ability of the Department to support the designation of persons for the imposition of sanctions.</text></subsection><subsection id="id48a392068ef5425b89663a90ca936fab"><enum>(d)</enum><header>Authorization of appropriation</header><text>There is authorized to be appropriated to the Secretary of State for fiscal year 2025 $15,000,000 to carry out this section. </text></subsection></section><section id="id778cfe2a6e9445b0baba21211ab54bda" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>10.</enum><header>Exceptions</header><subsection id="id5503b40db9e843768753782d218388c8"><enum>(a)</enum><header>Exception relating to importation of goods</header><paragraph id="id108bdf7774da47f1add730f84a2f1076"><enum>(1)</enum><header>In general</header><text>A requirement to block and prohibit all transactions in all property and interests in property under this Act shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></paragraph><paragraph id="idbeab80f24ffd41d78186a0e7086e9f93"><enum>(2)</enum><header>Good</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection><subsection id="id375bb6684cc94081aad474b578b8ec90"><enum>(b)</enum><header>Exception To comply with United Nations Headquarters Agreement and law enforcement activities</header><text>Sanctions under this Act shall not apply with respect to the admission of an alien to the United States if admitting or paroling the alien into the United States is necessary—</text><paragraph commented="no" display-inline="no-display-inline" id="ida190ac6f5004417b9ec8d441604c9432"><enum>(1)</enum><text display-inline="yes-display-inline">to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14a82802ead64597bf5dcc0b6adfe800"><enum>(2)</enum><text>to carry out or assist authorized law enforcement activity in the United States.</text></paragraph></subsection><subsection id="idd56ffe24f9804c5b8500fb2ae7af052c"><enum>(c)</enum><header>Exception To comply with intelligence activities</header><text>Sanctions under this Act shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></subsection><subsection id="idf80c6375162540e0a8ceb8d54514c78c"><enum>(d)</enum><header>Humanitarian assistance</header><paragraph commented="no" display-inline="no-display-inline" id="idac7f40bf280a48c3b1c208cf8e0ba0ca"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Sanctions under this Act shall not apply to—</text><subparagraph id="id18cc971a49d64c3d8031434b56d8830e"><enum>(A)</enum><text>the conduct or facilitation of a transaction for the provision of agricultural commodities, food, medicine, medical devices, humanitarian assistance, or for humanitarian purposes; or</text></subparagraph><subparagraph id="idfe8bacf3678a4bdfa834a60c818ac4c4"><enum>(B)</enum><text>transactions that are necessary for or related to the activities described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="id9e6c9ea481224f9fb23a17dd1640e30f"><enum>(2)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="id90010dc19df842bba280d2fcc2acd5a3"><enum>(A)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> has the meaning given that term in section 102 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5602">7 U.S.C. 5602</external-xref>).</text></subparagraph><subparagraph id="idd712f47c60c24900992b8c99e142a65d"><enum>(B)</enum><header>Medical device</header><text>The term <term>medical device</term> has the meaning given the term <term>device</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></subparagraph><subparagraph id="idb85da29d03a6482fa069cb66f3d891dc"><enum>(C)</enum><header>Medicine</header><text>The term <term>medicine</term> has the meaning given the term <term>drug</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="iddc506b07606248fd9b29f7e511038146"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to affect the availability of any existing authorities to issue waivers, exceptions, exemptions, licenses, or other authorization.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3987253597ac4ee2ba76ac910dec3ca4"><enum>(f)</enum><header display-inline="yes-display-inline">Annual report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report that describes each activity that would be sanctionable under this Act if not excepted pursuant to subsections (b) and (c). </text></subsection></section><section id="id65a1830bf0e94de4902efaee2ac7207f" changed="added" reported-display-style="italic"><enum>11.</enum><header>Report on impacts on the Islamic Republic of Iran of sanctions imposed by the United States</header><subsection id="id157477a6d52c489fbd71000aefb1ed08"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment this Act, the Secretary of State, in consultation with the Secretary of the Treasury and drawing on subject-matter experts including economists and statisticians from the Department of State and the Department of the Treasury, shall submit to the appropriate congressional committees (as defined in section 2(c)) a report on the impacts on the Islamic Republic of Iran of sanctions imposed by the United States. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddff3ad25e7944fab94c80ca7f41b2ce7"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include an assessment of the following:</text><paragraph id="idc8eeb49f05cc4ba891b0c444311a16fb"><enum>(1)</enum><text>The impact of sanctions imposed by the United States on the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id369e24cee12e463882fa5f8acb2c57f4"><enum>(A)</enum><text display-inline="yes-display-inline">Problematic activities and policies of the Islamic Republic of Iran, including ballistic missile development, proliferation of Iranian drones and missiles to state and non-state actors, uranium enrichment, and funding of terrorist groups in the <quote>Axis of Resistance</quote>, and how sanctions have meaningfully impacted the ability of such groups to operate.</text></subparagraph><subparagraph id="iddc9f6e5961de41778a2fea8c53b090cb"><enum>(B)</enum><text>Key officials of the Iranian regime, including their access to alternative financial markets, their standard of living, and impacts to their personal wealth.</text></subparagraph><subparagraph id="ided7096af5df245af8cd9ce093018d0ce"><enum>(C)</enum><text>The operations of independent civil society organizations in Iran, including the ability of such organizations to access products that would allow them to document and share human rights abuses, promote democratic norms, and engage in political dissent.</text></subparagraph><subparagraph id="id6f8b264b12f34058855c8ed5970d4609"><enum>(D)</enum><text>The efficacy of licensing actions aimed at ensuring the people of Iran have access to circumvention technologies around Iranian regime firewalls and censors to promote internet freedom, including General License D-2 of the Department of the Treasury. </text></subparagraph><subparagraph id="id2339bc9572ac48af9225dc2c8347cf5f"><enum>(E)</enum><text>The standard of living of the people of Iran, including—</text><clause commented="no" display-inline="no-display-inline" id="iddffd64e7adf54ee4b39f9ab606a29709"><enum>(i)</enum><text display-inline="yes-display-inline">the impact on the purchasing power of the people of Iran and their ability to afford and acquire food and medicine; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1ace8e6dec844653a55f0d0db6a28457"><enum>(ii)</enum><text display-inline="yes-display-inline">changes in the size of the working and middle classes in Iran, including impacts to the poverty rate in Iran.</text></clause></subparagraph><subparagraph id="id64a0433f912749dd97b001420795666e"><enum>(F)</enum><text>The growth of unofficial economies controlled by officials of the Iranian regime and members of the Islamic Revolutionary Guard Corps.</text></subparagraph></paragraph><paragraph id="idf654014b153b45449b63c37cf6b731f3"><enum>(2)</enum><text>What industries in Iran remain unaffected by such sanctions.
