which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require U.S. Customs and Border Protection to expand the use of non-intrusive inspection systems at land ports of entry.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4af919fef8604d6098d65d0971c5e868"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Non-Intrusive Inspection Expansion Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id7AD109B26F324E07A13A1F38289381B3"><enum>2.</enum><header>Use of non-intrusive inspection systems at land ports of entry</header><subsection id="id792A56A2EC5147D5A73FD757A7D40019"><enum>(a)</enum><header>Fiscal year 2026</header><text display-inline="yes-display-inline">Using non-intrusive inspection systems acquired through previous appropriations Acts, beginning not later than September 30, 2026, U.S. Customs and Border Protection shall use non-intrusive inspection systems at land ports of entry to scan not fewer than— </text><paragraph id="ida0099a40b0744c67b5dec4b771dd7e4a"><enum>(1)</enum><text>40 percent, cumulatively, of passenger vehicles entering the United States through land ports of entry; and</text></paragraph><paragraph id="idd1428bc97314425eb6e54652b44867fd"><enum>(2)</enum><text>90 percent, cumulatively, of commercial vehicles entering the United States through land ports of entry.</text></paragraph></subsection><subsection id="id7EF545B09455441682070658C39CC77A"><enum>(b)</enum><header>Subsequent fiscal years</header><text>Beginning in fiscal year 2027, U.S. Customs and Border Protection shall use non-intrusive inspection systems at land ports of entry to reach the next projected benchmark for incremental scanning of passenger and commercial vehicles entering the United States at such ports of entry. </text></subsection><subsection id="id3fdf9b0a643f428fabaaf5fbd8764b90"><enum>(c)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than May 30, 2026, the Commissioner of U.S. Customs and Border Protection shall brief the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made during the first half of fiscal year 2026 in achieving the scanning benchmarks described in subsection (a). </text></subsection><subsection id="id0475ae8e395b4b559b13c3c223ac6989"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">If the scanning benchmarks described in subsection (a) are not met by the end of fiscal year 2026, not later than 120 days after the end of that fiscal year, the Commissioner of U.S. Customs and Border Protection shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that—</text><paragraph id="id9376374BD5764A68A3BD4738A0BE6CA5"><enum>(1)</enum><text display-inline="yes-display-inline">analyzes the causes for not meeting such requirements;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id218845e1855542ca9d6fd8765aabaccb"><enum>(2)</enum><text display-inline="yes-display-inline">identifies any resource gaps and challenges; and</text></paragraph><paragraph id="idB0912871FE6B40BE8EDA3C2C541D4014"><enum>(3)</enum><text display-inline="yes-display-inline">details the steps that will be taken to ensure compliance with such requirements in the subsequent fiscal year.</text></paragraph></subsection></section><section id="id241D52E526F04B759D8F6BEF551B92F5" changed="not-changed"><enum>3.</enum><header>Non-intrusive inspection systems for outbound inspections</header><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id862bacaf963a47e98f13f47b09e65c64"><enum>(a)</enum><header display-inline="yes-display-inline">Feasibility study</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that analyzes the feasibility of using non-intrusive inspection systems to scan 10 percent of all vehicles exiting the United States through land ports of entry with equipment available on the date of the enactment of this Act.</text></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id2633da12ffe74638ba448f33bfdfdae1"><enum>(b)</enum><header>Implementation</header><text>Beginning not later than September 30, 2026, U.S. Customs and Border Protection shall use non-intrusive inspection systems at land ports of entry to scan not fewer than 10 percent of all vehicles exiting the United States through land ports of entry. </text></subsection></section><section id="idE9A7C97DDFC246CBA593B1CAF5548039" changed="not-changed"><enum>4.</enum><header>GAO review and report</header><subsection id="id91C6A150637F49BBB09B648449D0CF52" changed="not-changed"><enum>(a)</enum><header>Review</header><paragraph id="id50E58B6D88904F82BFF03C50A063A586" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a review of the use by U.S. Customs and Border Protection of non-intrusive inspection systems for border security.</text></paragraph><paragraph id="id7B1163E962C64015A568C1930A70FF49" changed="not-changed"><enum>(2)</enum><header>Elements</header><text>The review required under paragraph (1) shall—</text><subparagraph id="idB0CFF16859F44873B728E5222204BE8D" changed="not-changed"><enum>(A)</enum><text>identify—</text><clause id="id9AC7EE226B0A4716BBAB52C48DFD03A5" changed="not-changed"><enum>(i)</enum><text>the number and types of non-intrusive inspection systems deployed by U.S. Customs and Border Protection; and</text></clause><clause id="id9FDBA4D35AAD463282808D07EE296643" changed="not-changed"><enum>(ii)</enum><text>the locations to which such systems have been deployed; and</text></clause></subparagraph><subparagraph id="id9EEB6C869B0F4D26AA3779FF9505BA5D" changed="not-changed"><enum>(B)</enum><text>examine the manner in which U.S. Customs and Border Protection—</text><clause id="id9386AD49CFAC4AD48608F0202B3ABCAB" changed="not-changed"><enum>(i)</enum><text>assesses the effectiveness of such systems; and </text></clause><clause id="idD9824B06CA184356911D76940F832F0B" changed="not-changed"><enum>(ii)</enum><text>uses such systems in conjunction with other border security resources and assets, such as border barriers and technology, to detect and interdict drug smuggling and trafficking at the southwest border of the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="idFEECF72FA04C45AF8BB1189224E0129B" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> containing the findings of the review conducted pursuant to subsection (a). </text></subsection></section></legis-body></bill>
