which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XIX and XXI of the Social Security Act to provide a consistent standard of health care to incarcerated individuals, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7DB57381BB854E6A9B845F36496985B0"><section section-type="section-one" id="HA7468158AFBD41F59812C5CD52AA04F3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Humane Correctional Health Care Act</short-title></quote>.</text></section><section id="H2A3896C73FC24FC6B1976DA748F322D4"><enum>2.</enum><header>Repeal of Medicaid and CHIP exclusions relating to incarcerated individuals</header><subsection id="H7067E6D28D1C40298DE6B8E786ED14CA"><enum>(a)</enum><header>Medicaid</header><text>Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the matter following paragraph (31), by striking <quote>such term does not include—</quote> and all that follows through <quote>patient in an institution for mental diseases</quote> and inserting <quote>such term does not include any such payments with respect to care or services for any individual who has not attained 65 years of age and who is a patient in an institution for mental diseases</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7f30952af46f42d9883a15a03114f507"><enum>(b)</enum><header>CHIP</header><text>Section 2110(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf58a4c0108ce4e0f88cea45c579ee40e"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>except as provided</quote> and all that follows through <quote>public institution or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida96b08ee1def4ee292cf99d618988f96"><enum>(2)</enum><text>by striking paragraph (7).</text></paragraph></subsection><subsection commented="no" id="H6CC8F007421340F4B152ECCC75D02FDF"><enum>(c)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idce6c395a17614a8e899f2f61b23a23c8"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text><subparagraph commented="no" id="H1DF9CBA9203F4848BDA43D7C4FECD26B"><enum>(A)</enum><text>in subsection (a), by striking paragraph (84); and</text></subparagraph><subparagraph commented="no" id="HDB464C0BE5FC49418DFDC7C17EACDE4F"><enum>(B)</enum><text>by striking subsection (nn).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ea84529447149488442dec125f1c50f"><enum>(2)</enum><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>), as amended by subsection (a), is amended, in the matter following paragraph (31), by striking <quote>set forth in the subdivision (B) following paragraph (30) of the first sentence of this subsection</quote> and inserting <quote>set forth in the portion of the first sentence of this subsection that follows the last numbered paragraph of this subsection</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7680684124b34665ba522b61ae3b4ef2"><enum>(3)</enum><text display-inline="yes-display-inline">Section 5122 of division FF of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is repealed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC429381643394E9999255D4ADC74F2E2"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to medical assistance, child health assistance, and pregnancy-related assistance provided on or after January 1, 2024.</text></subsection></section><section id="H33590C27B2FF40A3826B11ADE26753AB"><enum>3.</enum><header>Report by Comptroller General</header><text display-inline="no-display-inline">Not later than the date that is 3 years after the date of enactment of this Act, and annually thereafter for each of the following 5 years, the Comptroller General of the United States shall submit to Congress a report containing the following information:</text><paragraph id="H4CEE1F0B62E044D38ACA1F485CF77EE2"><enum>(1)</enum><text>The percentage of incarcerated individuals that receive medical assistance under a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) or child health assistance or pregnancy-related assistance under a State plan under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>).</text></paragraph><paragraph id="H0C6EAB485EA648D5B5257631255A063B"><enum>(2)</enum><text>The access of incarcerated individuals to health care services, including specialty care, and health care providers.</text></paragraph><paragraph id="H63E91C4573724F6F8349E00578B3B71A"><enum>(3)</enum><text>The quality of health care services provided to incarcerated individuals.</text></paragraph><paragraph id="HDE3A0B0985DF484A8CC515D85EF03A66"><enum>(4)</enum><text>Any impact of coverage under such a State plan on recidivism.</text></paragraph><paragraph id="HF8134320E7654F2A8279B38BCB6AB478"><enum>(5)</enum><text>The percentage of incarcerated individuals who, upon release, are—</text><subparagraph id="H9C9C3E7058884E58BD3331759E07AE51"><enum>(A)</enum><text>enrolled under such a State plan; and</text></subparagraph><subparagraph id="H6A9D53E0130C487BB31DF8BF561A8FBB"><enum>(B)</enum><text>connected to a primary care provider in their community.</text></subparagraph></paragraph><paragraph id="H6B8872B3E6E2404A8748ADC008042251"><enum>(6)</enum><text>Trends in the prevalence and incidence of illness and injury among incarcerated individuals.</text></paragraph><paragraph id="H04D8DF9676B749989A807A207114A2E1"><enum>(7)</enum><text>Any other information the Comptroller General determines necessary regarding the health of incarcerated individuals.</text></paragraph></section><section id="HE88D0A81C0EB4EE080A7C9DFF99C5B86"><enum>4.</enum><header>Sense of Congress on incarceration and community-based health services</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="HF358DC87846845D9A72BD33823392A26"><enum>(1)</enum><text>no individual in the United States should be incarcerated for the purpose of being provided with health care that is unavailable to the individual in the individual’s community;</text></paragraph><paragraph id="H2FEC82C81E83455AA767E21917C9673D"><enum>(2)</enum><text>each State and unit of local government should establish programs that offer community-based health services (including mental health and substance use disorder services) commensurate with the principle stated in paragraph (1); and</text></paragraph><paragraph id="HC3E84192BF424A8AA9570E7D3CE3E491"><enum>(3)</enum><text>Federal reimbursement for expenditures on medical assistance, child health assistance, or pregnancy-related assistance made available through the amendments made by this Act should not supplant an investment in community-based services.</text></paragraph></section></legis-body></bill>
