which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize security deposit and moving costs assistance for low-income households, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H29A61D98F5F046819101613EE1F670B0"><section section-type="section-one" id="HD01767143BC84CCAA889C1CC18015C4E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Delivering Essential Protection, Opportunity, and Security for Tenants Act</short-title></quote> or the<quote><short-title>DEPOSIT Act</short-title></quote>.</text></section><section id="H6640F25D6B824F82A22FC978B6693320"><enum>2.</enum><header>Rental security deposit and moving cost assistance for housing choice voucher holders</header><text display-inline="no-display-inline">Section 8(q) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(q)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8929F7FAA5B241E5B996D6EA67166578"><paragraph id="HED92DDB607214F4D82E77789333DABA8"><enum>(6)</enum><header>Supplements for security deposit and moving cost assistance</header><subparagraph id="H86F74FFCF87F460D8E85A5DF8CC1FC06"><enum>(A)</enum><header>Security deposits</header><clause commented="no" display-inline="no-display-inline" id="id012c362123d049a49761341865626e31"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall, to the extent amounts are provided in advance in appropriations Acts for assistance under this subparagraph, provide supplemental fees under this subsection to public housing agencies for the costs of providing, on behalf of families assisted under subsection (o), assistance to cover the costs of a reasonable security deposit for the assisted dwelling unit of the family. </text></clause><clause commented="no" display-inline="no-display-inline" id="idbb31ee9ee251488ebf60fea76a7d66e6"><enum>(ii)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each public housing agency that receives supplemental fees under clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="id2c9d7c0fb3c642e9a1ce7550ea970a00"><enum>(I)</enum><text display-inline="yes-display-inline">shall require the owner of a dwelling unit for which security deposit assistance is provided under that clause to return any unused amounts of security deposit assistance upon the termination of the family’s tenancy; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd61b88c8fc8748848fafcd8cb2100d6c"><enum>(II)</enum><text display-inline="yes-display-inline">may make such returned amounts available only for assistance under this subparagraph.</text></subclause></clause></subparagraph><subparagraph id="HED076A0889B74E5DA50FB81BD5F3CDE4"><enum>(B)</enum><header>Moving costs</header><text display-inline="yes-display-inline">The Secretary may provide supplemental fees under this subsection to public housing agencies for the costs of providing, on behalf of families assisted under subsection (o), assistance to cover the reasonable costs of moving into a new assisted dwelling unit.</text></subparagraph><subparagraph id="HEAD73D48211D4C4D80EA8A02687F30EC"><enum>(C)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary such sums as may be necessary for assistance under subparagraphs (A) and (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2459D0D22DCF444ABAAD616CD9D5A5BF"><enum>3.</enum><header>Rental security deposit assistance under HOME program</header><subsection id="HA7E2D051B407469CB322E17D54B82061"><enum>(a)</enum><header>Eligible use</header><text display-inline="yes-display-inline">Section 212(a) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12742">42 U.S.C. 12742(a)</external-xref>) is amended by inserting after paragraph (3) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE76F16E5588E44F3825F2D99D2717F31"><paragraph id="H0A0D43E9AF7444F5A2C3C2292C405A33"><enum>(4)</enum><header>Security deposit assistance</header><subparagraph commented="no" display-inline="no-display-inline" id="id97072ff008fd4bd897e52f740ac41b31"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A participating jurisdiction may use funds provided under this subtitle to provide loans or grants to very low- and low-income families for security deposits for rental of dwelling units, regardless of whether the family is provided tenant-based rental assistance pursuant to paragraph (3). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide655926cd3c845c3b9e613d6c26152bc"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each participating jurisdiction that provides loans or grants under subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id2d889a3dd8574156b6621e4df9f866c4"><enum>(i)</enum><text display-inline="yes-display-inline">shall require the owner of the dwelling unit for which security deposit assistance is provided under that subparagraph to return any unused amounts of security deposit assistance upon the termination of the family’s tenancy; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf4917cfb0bbc491b860257b89bdb4a0f"><enum>(ii)</enum><text display-inline="yes-display-inline">may use such returned amounts only for assistance under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB14001A0BBEB4A96B2D42CD7B7F7042E"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of Housing and Urban Development such sums as may be necessary for assistance under subtitle A of title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12741">42 U.S.C. 12741 et seq.</external-xref>), to be made available only for providing security deposit assistance under paragraph (4) of section 212(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12742">42 U.S.C. 12742(a)</external-xref>) (as added by the amendment made by subsection (a) of this section).</text></subsection></section><section id="H4BE75E98A18A454E9EF3208EDE5754F4"><enum>4.</enum><header>Study on alternatives to security deposits</header><subsection id="HAE96B37A8ED445B6ADCBB63B8EC6238D"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall conduct a study to identify and analyze—</text><paragraph id="HE4F104211A034C93843760CACA622727"><enum>(1)</enum><text>alternatives to rental housing security deposits, including products that require a tenant of a dwelling unit to pay a monthly insurance premium to cover costs of repairing damage to the dwelling unit; and</text></paragraph><paragraph id="H352D4E5CE512479282504006D967E2DB"><enum>(2)</enum><text>the impact that the alternatives described in paragraph (1) have on the rental housing market and tenants, including how the alternatives affect tenants based on tenant race, income, age, sex, disability, and other demographic characteristics. </text></paragraph></subsection><subsection id="HB65BB62AB1EC438DB47471DE1DEB539E"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Housing and Urban Development shall submit to Congress a report setting forth the findings and conclusions of the study conducted under subsection (a).</text></subsection></section></legis-body></bill>
