which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require agencies to notify the Director of the Office of Management and Budget when the agency suspends or terminates a Federal award, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Outlay of Payments Act</short-title></quote>.</text></section><section id="id606ECA8C6683420CB604155EF3CBADEB"><enum>2.</enum><header>Federal grants</header><subsection id="id52F0A838EFC6432BB69A308FA0BBB76B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idF2CBF92D728D46AE96A9A5571566AEEC"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means—</text><subparagraph id="idCC31F07384484D02AB4C38ADD3AD08D2"><enum>(A)</enum><text>an Executive agency, as defined in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph id="id12C84866261343F1A7533A86BECFBBA4"><enum>(B)</enum><text>an independent regulatory agency, as defined in section 3502 of title 44, United States Code.</text></subparagraph></paragraph><paragraph id="id38EBD883D8554E5AA615034BBDB04579"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id0E71FE407EB149A9B1C7EF3B51524AF3"><enum>(3)</enum><header>Federal award</header><text>The term <term>Federal award</term> means a grant, subgrant, contract, subcontract, loan, award, or cooperative agreement awarded by an agency.</text></paragraph><paragraph id="idE4156FE7C3F14138BD634819589ACE07"><enum>(4)</enum><header>Suspended entity</header><text>The term <term>suspended entity</term> means a recipient of a Federal award, any portion of which the head of an agency suspends or terminates for a reason described in subsection (b)(2).</text></paragraph></subsection><subsection id="idD9C6377347B24FA1A5E738A5825E2738"><enum>(b)</enum><header>Notification</header><paragraph id="id504090C4746C480DA71824F0308449D3"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date on which an agency suspends or terminates any portion of a Federal award to the recipient of the Federal award for a reason described in paragraph (2), the head of an agency shall notify the Director of the suspension or termination.</text></paragraph><paragraph id="idECF07B759676461597B3D635CADB9772"><enum>(2)</enum><header>Reason for suspension or termination</header><text>A reason for a suspension or termination of a Federal award described in this paragraph is a failure of the recipient of the Federal award to comply with—</text><subparagraph id="idA1E9862CA0624A9CB85EAFDAAFFB6219"><enum>(A)</enum><text>the terms and conditions of the Federal award;</text></subparagraph><subparagraph id="id99C1AD6C282049B19498658152594C86"><enum>(B)</enum><text>a Federal law or regulation; or</text></subparagraph><subparagraph id="idD7ADE7DD6B9644758539C800653ADF32"><enum>(C)</enum><text>a request by the agency awarding the Federal award for information or materials relating to the Federal award.</text></subparagraph></paragraph><paragraph id="id0A46AA43E6BE448FAAC71393B84A2B54"><enum>(3)</enum><header>List of suspensions</header><text>The Director shall maintain an up-to-date list of suspended entities on the website of the Office of Management and Budget.</text></paragraph></subsection><subsection id="idDC62D05AAF8C4619A7D5B6DD16A26106"><enum>(c)</enum><header>Effect on other grants</header><paragraph id="id85D344627A6C4737A1DC086A50FDB039"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the head of an agency may not award a Federal award or disburse funds under a Federal award to a suspended entity until the date on which the suspended entity remedies the reason for a suspension or termination of a Federal award of the suspended entity under subsection (b)(2).</text></paragraph><paragraph id="id026B09B411604CA59256AB98B3C81CD4"><enum>(2)</enum><header>Exceptions</header><text>The head of an agency may award a Federal award and disburse funds under a Federal award to a suspended entity if—</text><subparagraph id="idA4039954D59D48B2B65AC7EDB7A1A80B"><enum>(A)</enum><text>the suspended entity has been classified as a suspended entity as a result of a clerical error; or</text></subparagraph><subparagraph id="id3ED2252A29A64B14AB8EF591E5B87BA0"><enum>(B)</enum><text>the suspended entity has an agreement with the agency that suspends or terminates the Federal award of the suspended entity to resolve the reason for the suspension or termination described in subsection (b)(2).</text></subparagraph></paragraph><paragraph id="idB8AB0EF7F30C46E09F899EAB002A2387"><enum>(3)</enum><header>Compliance</header><text>For the purpose of complying with paragraph (1), the head of an agency shall reference the list of suspended entities maintained by the Director under subsection (b)(3).</text></paragraph></subsection></section></legis-body></bill>
