Definitions.</toc-entry></toc></subsection></section><section section-type="subsequent-section" id="id58B2A6340B204412ADF548E334AE2B2A"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="id5cd568d09b62409a91abd0d1f1579988"><enum>(1)</enum><text display-inline="yes-display-inline">substantial and deliberate investments across languages are essential to protect the safety of users online and ensure equitable access to digital spaces;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd0e1a197c2064d41aee01e744d2f0688"><enum>(2)</enum><text>online platforms have historically under-invested in ensuring non-English content moderation and automated content detection and filtering processes keep pace with their English counterparts, providing little transparency into the efficacy of efforts to detect, review, and remove content that violates laws or platform policies across languages; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ba8ab1619d247d889ae3f1d83abf1c8"><enum>(3)</enum><text>this difference in enforcement for platforms' existing policies and uneven moderation practices across both manual and automated processes has increased the proliferation of illegal and harmful content across many languages and the deliberate targeting of non-English-speaking communities for fraud and harassment; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id010fd97ac4bd48c48c25d0a149963430"><enum>(4)</enum><text>any reform effort for online platform safety must ensure equitable investment across languages in order to promote economic opportunity, public health, and civil rights.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="iddb7dfcba8c78424aa8eeeff99ad493bb"><enum>3.</enum><header display-inline="yes-display-inline">Duty to ensure consistent enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idb5cf6337dde7453e9b43fefa78d7ecd8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The operator of a covered platform shall provide that processes used by the platform for detecting, suppressing, and removing illegal content, or content that otherwise violates platform policies, are reasonably consistent for languages in which the covered platform engages in monetization practices.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddf4390495ebd4fd7980c42a316ca1257"><enum>(b)</enum><header>Considerations</header><text>Any entity enforcing or promulgating rules under subsection (a) shall take into consideration factors that may impact the covered platform's ability to enforce its policies with respect to content in a given language, including staffing levels and language proficiency, or the effectiveness of automated systems designed to filter or flag content for additional review.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c86670bedca4d37b45395c9c1581543"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction; limitation on regulation</header><text>Nothing in this section shall be construed to require, and no regulation issued by the Commission to carry out this section may require, that a covered platform take any particular action on a specific piece of content or class of content.</text></subsection></section><section id="id43D747071E1C4C958582ED783BEE67D8"><enum>4.</enum><header>Disclosures on staffing and automated processes</header><subsection id="idE6EADED7035C4D94B64D5EC6159B7CD9"><enum>(a)</enum><header>In general</header><text>The operator of a covered platform shall, not less than annually, submit to the Commission and make available to the public, in a machine-readable format, a clear and easily comprehensible report on any manual and algorithmic content moderation that the covered platform engaged in during the relevant period. Each such report shall be in compliance with the rules established under subsection (b).</text></subsection><subsection id="idE7E07AB713264EFF968AFEFCE439C6F2"><enum>(b)</enum><header>Rules</header><text>The Commission shall, in accordance with section 8, establish rules for reports under subsection (a). Such rules shall require that a report include the following information:</text><paragraph id="id49120c9fa9c1480b8ac83fa8fafe03ae"><enum>(1)</enum><header>Content moderation staffing</header><subparagraph id="id1B2BAB5092D64B8DA3641C5046096F53"><enum>(A)</enum><header>In general</header><text>The number of staff employed by the covered platform (whether directly employed by the platform or contracted through a third party) for the purposes of manually reviewing content for removal or other interventions, in aggregate and broken down by—</text><clause id="idc84bb4711ced43169dad7fd1008ba8ba"><enum>(i)</enum><text>the countries in which the employees are located;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3846df3075704cbabf4b655b14beb25a"><enum>(ii)</enum><text>the geographic or regional area to which the employees are assigned; and</text></clause><clause id="id800a634c5a474bd4accc3a8f2fd6d597"><enum>(iii)</enum><text>languages spoken by the employees relevant to their employment and their levels of language proficiency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28625a4608ee4641a66fa3e670e6d309"><enum>(B)</enum><header>Staff support</header><text>A description of the training and support provided to content moderation staff, including—</text><clause id="id738f0e60c4a544f2bf426783a47ede69"><enum>(i)</enum><text>the training processes and guidelines provided;</text></clause><clause id="idcb657a398196468787afa716afef6d97"><enum>(ii)</enum><text>the support services, such as mental health services, available to the employee; and</text></clause><clause id="id237d5fc207ed4b149c56dea678c1a544"><enum>(iii)</enum><text>if training or support services differ by factors such as geographic region, languages spoken, or direct-hire versus contracted employees, descriptions and breakdowns of such differences.</text></clause></subparagraph></paragraph><paragraph id="id455415aceedb4269a9adbf756e8e659b"><enum>(2)</enum><header>Automated content detection and decision-making processes</header><text>If the covered platform elects to use algorithmic processes to detect content for additional manual review or automated decision-making for content moderation, information on such processes, including—</text><subparagraph id="idc3c6259b91a74dfeba5321fd4f83f02e"><enum>(A)</enum><text>performance metrics that are monitored to ensure consistent behavior for such processes across languages and the languages that are monitored; and</text></subparagraph><subparagraph id="idAEFB58CA74BD4D8D8C2A6A92B872A5DE"><enum>(B)</enum><text>other safeguards in place to ensure consistent behavior of such systems across languages.</text></subparagraph></paragraph><paragraph id="ida70a92cecbd44a60953b678ad97dc98c"><enum>(3)</enum><header>Monetization across languages</header><text>The list of languages in which the covered platform engages in monetization practices and the percentage breakdown by language of the covered platform's revenue throughout the duration of the relevant reporting period.</text></paragraph><paragraph id="idb74b266ac0b14d31989c75b52457fcc5"><enum>(4)</enum><header>In-language review</header><text>Of all content that is manually reviewed by staff, provide information on content that is reviewed in the original language used to create the content rather than being subject to automated translation before review, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id17e4c00e95254bac9cf17c2f714a87f2"><enum>(A)</enum><text>the percentage of content reviewed in the original language for each language in which the covered platform engages in monetization practices; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd5f0c6d84922453eae0e1216822e0d5a"><enum>(B)</enum><text>a description of the policies governing whether and to what extent content will be manually reviewed in the original language or automatically translated prior to manual review.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b7a45fa802b43d58c9db5cd2ebb7427"><enum>(5)</enum><header>Translation and review processes</header><text>With respect to the content review practices of the covered platform—</text><subparagraph commented="no" display-inline="no-display-inline" id="id61fce5347d1b4285ae6f13621e301b79"><enum>(A)</enum><text display-inline="yes-display-inline">the list of languages in which content is reviewed without translation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1717515d7ff54df8baf91ad9757fba3d"><enum>(B)</enum><text>for languages in which automated translation is applied prior to manual review, a description of—</text><clause id="idb3616e45cba642b486c3f7b3b9e555ee"><enum>(i)</enum><text>the process by which content is translated; and</text></clause><clause id="id05ed2a3cc72a4d6da81df276196eae9f"><enum>(ii)</enum><text>the process by which that content is reviewed and how, if at all, that process differs from the process used to review content in the original language.</text></clause></subparagraph></paragraph><paragraph id="idF56A6B07012840D8A7CD3FF92774E1E4"><enum>(6)</enum><header>Content moderation outcome measures</header><subparagraph commented="no" display-inline="no-display-inline" id="idc069f40db4a8426fb060e7d92bd0edda"><enum>(A)</enum><header display-inline="yes-display-inline">Number of content takedowns</header><text>The number of content takedowns over the relevant reporting period for each language in which the covered platform engages in monetization practices.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8846b7eba23e4a0983e9b6955893012d"><enum>(B)</enum><header>Response time</header><text>The average response time to user-initiated takedown or content review requests over the relevant reporting period for each language in which the covered platform engages in monetization practices.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc6c702e09844e9995b46eb5a7433f69"><enum>(7)</enum><header display-inline="yes-display-inline">Additional information</header><text>Other information determined appropriate by the Commission, including additional categories or criteria relevant to the information described in paragraphs (1), (2), and (4).</text></paragraph></subsection></section><section id="idE3143F23710C4FFEA35FF534EF8BC963"><enum>5.</enum><header>Consistent access to tools and documentation</header><text display-inline="no-display-inline">The operator of a covered platform shall—</text><paragraph id="id5941efa009c44085b345331155af76f5"><enum>(1)</enum><text>provide that all user tools for reporting content for review or automated action are accessible across all languages in which the covered platform offers its service; and</text></paragraph><paragraph id="idb45a4ad3578b4cbd88974f22887fd033"><enum>(2)</enum><text>post all platform policies and other information concerning acceptable use of the covered platform in the same manner for all languages in which the platform offers its service.</text></paragraph></section><section id="id2990C9AF9DD34858A103105A8050103D"><enum>6.</enum><header>Advisory Group</header><subsection id="id1e29236ad41a4816be6165773da318e8"><enum>(a)</enum><header>Establishment</header><text>Not later than 360 days after the date of enactment of this Act, the Commission shall establish a group to be known as the <quote>Advisory Group on Language-Sensitive Technologies</quote> (referred to in this section as the <term>Advisory Group</term>).</text></subsection><subsection id="idaf411754fbe340f4af85b7d369598329"><enum>(b)</enum><header>Duties</header><paragraph id="id63B7914A5977408CA8CC5E2764315D92"><enum>(1)</enum><header>In general</header><text>The Advisory Group shall provide consensus advice and guidance to the Commission on best practices for private enterprises or public entities using covered technology that may have different performance outcomes depending on the underlying language of the content being analyzed in order to ensure the nondiscriminatory application of such technology.</text></paragraph><paragraph id="idF0B14F6370154588B1B80F42508C4BA6"><enum>(2)</enum><header>Covered technology</header><text>For purposes of paragraph (1), the term <term>covered technology</term> means technology used to—</text><subparagraph id="idf08bdf79feb64df593a6b976b3144926"><enum>(A)</enum><text>detect and process input language from sources, such as analog text and audio, into a machine-readable format, such as speech and optical character recognition; </text></subparagraph><subparagraph id="ida6781c1de0bb43368e365607d80ab4d9"><enum>(B)</enum><text>process or generate language stored in a machine-readable format, such as natural language processing, including large language models; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65898da6335f441d9a8dcf496a5a29af"><enum>(C)</enum><text>detect and process images and videos into a machine-readable format, or process images or videos stored in a machine-readable format; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb957439e2e7449bc952690cd1d64ef30"><enum>(D)</enum><text>make automated decisions related to content removal, ranking, or presentation to a user of an online platform.</text></subparagraph></paragraph><paragraph id="id4F883BEBD12E4823AB74E481BA7D0EB0"><enum>(3)</enum><header>Membership</header><text>The Commission shall appoint the members of the Advisory Group. In making such appointments, the Commission shall provide that the membership of the Advisory Group—</text><subparagraph id="idA6726CC97B4D4A6B832A07A701C00BAD"><enum>(A)</enum><text>includes different points of view and background experience; and </text></subparagraph><subparagraph id="id20CF63C1FAE24BDB9E4CD749FF581ED9"><enum>(B)</enum><text>includes both Federal employees and non-Federal employee stakeholders, including representatives of communities most impacted by the systemic risks of harmful non-English language content and current or former content moderators and employees of covered platforms. </text></subparagraph></paragraph><paragraph id="id9d45d2f09f9346faa8d76c9edbe02766"><enum>(4)</enum><header>Report</header><text>The Commission shall make available on its website the findings of the Advisory Group with recommendations and best practices as reported by the Advisory Group concerning the use of covered technology. </text></paragraph></subsection><subsection id="IDC0F48F3EB7C340C9BB05BD65FEBEFDFD" commented="no"><enum>(c)</enum><header>Non-Applicability of the Federal Advisory Committee Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the Advisory Group.</text></subsection><subsection id="idF3194ABA5B6747DC97F0131C325920DB"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Advisory Group such sums as are necessary to carry out the requirements of this section.</text></subsection></section><section id="id1C443A575FAA4745B3FF83D3829D5EA6"><enum>7.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idb31b34d4-b455-4123-a1cf-9b3eda436c8c"><enum>(a)</enum><header display-inline="yes-display-inline">Enforcement by the Federal Trade Commission</header><paragraph commented="no" display-inline="no-display-inline" id="id34895b78-9415-4c33-9c0c-d31ab4641102"><enum>(1)</enum><header display-inline="yes-display-inline">Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of section 3, 4, or 5 shall be treated as a violation of a rule defining an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2aae6977-256a-4c23-a7e2-8db1300fb35c"><enum>(2)</enum><header display-inline="yes-display-inline">Powers of Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="idbc4b49b3-628b-4811-b9bf-30dee95a0464"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62badbc8-b144-471b-87c5-8de40c6979bb"><enum>(B)</enum><header display-inline="yes-display-inline">Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates section 3, 4, or 5 shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4eb0393a3ce54c0bbfec97e16f6b23e7"><enum>(C)</enum><header display-inline="yes-display-inline">Authority preserved</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id342a978d-e8d3-4ed4-9158-aefda3b8e579"><enum>(b)</enum><header display-inline="yes-display-inline">Enforcement by States</header><paragraph commented="no" display-inline="no-display-inline" id="idba9783cd-ff38-4b5b-972d-c4d0db40174f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of any person subject to section 3 or 5 in a practice that violates such section, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd962281-273a-4766-a709-6e109e357225"><enum>(A)</enum><text display-inline="yes-display-inline">to enjoin further violation of such section by such person;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b625a08-aae1-4015-ab75-4b4a55330112"><enum>(B)</enum><text display-inline="yes-display-inline">to compel compliance with such section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f5817a0-3efa-44d1-8e52-8ca71f8ddf98"><enum>(C)</enum><text display-inline="yes-display-inline">to obtain damages, restitution, or other compensation on behalf of such residents.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c0bbc61-ba0e-49fc-ae3c-df51dbafe5de"><enum>(2)</enum><header display-inline="yes-display-inline">Scope of jurisdiction</header><text>The attorney general of a State may not bring a civil action under this subsection against a person for a violation of section 3 or 5 if the Commission would not be able to bring an enforcement action against the person for such violation under subsection (a) because the person is exempt from coverage under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id833b324aa4344b4ab64f0dd10e4986f2"><enum>(3)</enum><header display-inline="yes-display-inline">Rights of Federal Trade Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id1546e4ba-664b-4b4d-88e3-d4b6aa3f4341"><enum>(A)</enum><header display-inline="yes-display-inline">Notice to Federal Trade Commission</header><clause commented="no" display-inline="no-display-inline" id="ide25159e6-67fe-4133-b32a-1eb1dfaa6ac3"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (iii), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under paragraph (1) before initiating the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idefccc8b6-04f8-42ce-a1db-d06b3db86a62"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The notification required by clause (i) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf8545e37-45fb-416d-b695-3632b5db5b11"><enum>(iii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If it is not feasible for the attorney general of a State to provide the notification required by clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c60fa1f-225d-4448-8666-6439e095b5e0"><enum>(B)</enum><header display-inline="yes-display-inline">Intervention by Federal Trade Commission</header><text display-inline="yes-display-inline">The Commission may—</text><clause commented="no" display-inline="no-display-inline" id="id42614303-0f94-4c33-ac49-a5fd2ad6e603"><enum>(i)</enum><text display-inline="yes-display-inline">intervene in any civil action brought by the attorney general of a State under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5929a413-d6cc-49b9-a33d-ce57b7c1c88d"><enum>(ii)</enum><text display-inline="yes-display-inline">upon intervening—</text><subclause commented="no" display-inline="no-display-inline" id="idad6c4890-4d67-499d-befc-e28609b9c5af"><enum>(I)</enum><text display-inline="yes-display-inline">be heard on all matters arising in the civil action; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbb931fcb-adaf-4946-9e0d-35caf4ba4d29"><enum>(II)</enum><text display-inline="yes-display-inline">file petitions for appeal.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89566779-3d81-477d-9d54-f84623db7db0"><enum>(4)</enum><header display-inline="yes-display-inline">Investigatory powers</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4cfa5a4-30ef-4f9e-b6b7-7b091f58e8c9"><enum>(5)</enum><header display-inline="yes-display-inline">Preemptive action by Federal Trade Commission</header><text display-inline="yes-display-inline">If the Commission institutes a civil action or an administrative action with respect to a violation of section 3 or 5, the attorney general of a State may not, during the pendency of such action, bring a civil action under paragraph (1) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6a681d1-07b6-45ff-9ab7-bc561ca76579"><enum>(6)</enum><header display-inline="yes-display-inline">Venue; service of process</header><subparagraph commented="no" display-inline="no-display-inline" id="id52b045de-ac01-4b82-a316-00e43d768e0a"><enum>(A)</enum><header display-inline="yes-display-inline">Venue</header><text display-inline="yes-display-inline">Any action brought under paragraph (1) may be brought in—</text><clause commented="no" display-inline="no-display-inline" id="id28fc2525-4c7a-48b7-9972-92207e07e68f"><enum>(i)</enum><text display-inline="yes-display-inline">the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id19e1d9d6-2174-428d-b61c-b3714efcc735"><enum>(ii)</enum><text display-inline="yes-display-inline">another court of competent jurisdiction.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd6bd73e-41f9-4edc-bc0d-1231c7c07872"><enum>(B)</enum><header display-inline="yes-display-inline">Service of process</header><text display-inline="yes-display-inline">In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause commented="no" display-inline="no-display-inline" id="id9261f9ca-85a2-4183-8a73-926309b6bbbc"><enum>(i)</enum><text display-inline="yes-display-inline">is an inhabitant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0641951c-ecaa-4fc0-b092-1526e35b6ecc"><enum>(ii)</enum><text display-inline="yes-display-inline">may be found.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73a7dc36-cbc2-4d22-a718-60043049a5d4"><enum>(7)</enum><header display-inline="yes-display-inline">Actions by other State officials</header><subparagraph commented="no" display-inline="no-display-inline" id="id4bdc9da3-e8f2-4162-afde-e6322d13eadb"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to civil actions brought by attorneys general under paragraph (1), any other consumer protection officer of a State who is authorized by the State to do so may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30c0521f-b48a-440d-8070-d0a7a5ad7e0e"><enum>(B)</enum><header display-inline="yes-display-inline">Savings provision</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</text></subparagraph></paragraph></subsection></section><section id="idA6F9EA6D222644E28B09DEE5EC1C5C93"><enum>8.</enum><header>Regulations</header><subsection id="id878A06CBD9DF40C586BD4C44CD131729"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall, pursuant to section 553 of title 5, United States Code promulgate— </text><paragraph id="id4A106A1DD66E4FE9B490EF531B70685B"><enum>(1)</enum><text display-inline="yes-display-inline">regulations to carry out the provisions of sections 3 and 4; and</text></paragraph><paragraph id="idE8CA91541D45492CA5CBBD548FDE87F0"><enum>(2)</enum><text display-inline="yes-display-inline">such other regulations as the Commission determines necessary to carry out the provisions of this Act.</text></paragraph></subsection><subsection id="id0F22D457050A4433BAD67708D971CCDB" commented="no"><enum>(b)</enum><header>Timing</header><text>The Commission shall begin the rulemaking process for promulgating regulations to carry out the provisions of sections 3 and 4 not later than 120 days after the date of enactment of this Act.</text></subsection></section><section id="id9394A748419B4514BD36447498E8719B"><enum>9.</enum><header>Effective dates</header><text display-inline="no-display-inline">The requirements of sections 3 and 4 shall take effect 120 days after the promulgation by the Commission of regulations to carry out such sections, and the requirements of section 5 shall take effect 120 days after the date of enactment of this Act.</text></section><section id="id3d02f2af12f24d458e52039c58447389"><enum>10.</enum><header>International online communication research activities pilot program</header><subsection commented="no" display-inline="no-display-inline" id="idf6f91143578c4958bdc23f4bd12dbe80"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the United States Agency for International Development (referred to in this section as <quote>USAID</quote>) shall, in coordination with the Secretary of State, evaluate and prioritize support to select countries, from among the countries eligible for assistance from USAID, for research and programming, such as tool development, civil society capacity building, and other activities, aimed at addressing the prevalence and impacts of non-English online communication that—</text><paragraph commented="no" display-inline="no-display-inline" id="id3c41a9b9b6ef4e94a095160ba33df1a6"><enum>(1)</enum><text display-inline="yes-display-inline">promotes hate, harassment, or abuse of racial, ethnic, gender, religious, or sexual minorities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2abd7a0a0d3841f99316ba1994c1604d"><enum>(2)</enum><text display-inline="yes-display-inline">incites violence; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59481b4934b5476189f81f0ac5bb1e13"><enum>(3)</enum><text display-inline="yes-display-inline">is false, misleading, or intended to harm—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida70d2983d6694966bc54f1e1fc72ff42"><enum>(A)</enum><text display-inline="yes-display-inline">targeted individuals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc28593d7796b4874b8f5d73790570a07"><enum>(B)</enum><text>public health; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51fc1ca2b8054abca7fa11c5efba0c69"><enum>(C)</enum><text>democratic integrity; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4ab170f3c3b44d5ac605d6b8c9c9a11"><enum>(D)</enum><text>civil rights;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id236d2598ea424a41b75864657046a0cf"><enum>(E)</enum><text>humanitarian response; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b0300cdf5474aed97913076234d1458"><enum>(F)</enum><text>economic integrity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd15b1de44514d8eb281671dab76e1ec"><enum>(G)</enum><text>public safety.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc3c9aa9128848c7b4c392f722541165"><enum>(b)</enum><header>Authorized activities</header><paragraph commented="no" display-inline="no-display-inline" id="ida0aa7d2215e94b60b186400fd2758425"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Administrator may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb5352bf0e7e49b38599cffb0288547d"><enum>(A)</enum><text display-inline="yes-display-inline">build lexicons of terms and phrases commonly used in communications described in subsection (a);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1eaa20d03d1d4d459b160d364f0b9dff"><enum>(B)</enum><text display-inline="yes-display-inline">identify and improve the understanding of how real or falsified text, videos, or imagery are being used to spread hate, abuse, scams, fraud, and false or misleading information in non-English languages;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1696cf22555409cb422ae5cbe4487da"><enum>(C)</enum><text>strengthen the capacities of civil society, local private sector, academia, and governments to develop and implement activities focused on preventing, mitigating, or responding to non-English online communication that is hateful, abusive, fraudulent, false, or misleading; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9209675c45f2479b96ddb751c594c3d6"><enum>(D)</enum><text display-inline="yes-display-inline">improve awareness and the abilities of the civil society and governments of countries that receive support under subsection (a) to discover and interpret non-English online communication that is hateful, abusive, fraudulent, false, or misleading that—</text><clause commented="no" display-inline="no-display-inline" id="id4c1d3261bb594df2aacdbfe2f7143e98"><enum>(i)</enum><text display-inline="yes-display-inline">is perpetuated or sponsored by malign actors or extremist organizations;</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb4c4e39eff2458393be6cd76d51c190"><enum>(ii)</enum><text display-inline="yes-display-inline">is influenced, regulated, or moderated by governments, social media companies, and internet service providers; </text></clause><clause commented="no" display-inline="no-display-inline" id="id433137ec043e4d50b3e17e387d654897"><enum>(iii)</enum><text display-inline="yes-display-inline">is perceived by, or impacts the target or other consumers of online communications or specific communities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd288f849b18482fb0ac8ee80a4da301"><enum>(iv)</enum><text>leads to economic, mental, physical, or other harms at the individual, household, organization, or community levels. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8862300fee145789df4367b0f6a9688"><enum>(2)</enum><header>Locally led requirement</header><text display-inline="yes-display-inline">Recipients of not less than 50 percent of the amounts appropriated pursuant to subsection (d) shall substantially engage with organizations led by individuals who—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb25a64fd15cc4546abc018d579a2242b"><enum>(A)</enum><text display-inline="yes-display-inline">are living in a place from which communication described in subsection (a) originates or to which such communication is targeted;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef2065a6cd1a4ffd84ec0188f7b454f4"><enum>(B)</enum><text display-inline="yes-display-inline">are familiar with the cultural context in such a place; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id329b6b2138eb456bb6b30b50e47316ab"><enum>(C)</enum><text display-inline="yes-display-inline">have experience researching or working to address such digital or online communication.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23d3896d416b4244878c31ca457e63f8"><enum>(3)</enum><header>Intersectionality requirement</header><text display-inline="yes-display-inline">Research funded by amounts appropriated pursuant to subsection (d) shall focus on better understanding how online communication that is hateful or abusive, incites violence, violates relevant data privacy laws, divulges personal information, or involves false or misleading information has a disparate impact on people who are members of racial, ethnic, gender, religious, or sexual minorities in their communities, including women, indigenous populations, and people who identify as lesbian, gay, bisexual, transgender, queer, intersex, or as another sexual minority. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id965037b5ec444a0fbf558d4cec283cf8"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting requirement</header><paragraph commented="no" display-inline="no-display-inline" id="ida8020f0d91a348f7988ada36d7bca7fb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after all of the programs receiving funding appropriated pursuant to subsection (d) are terminated, the Administrator of the United States Agency for International Development shall provide a briefing, and submit a report, to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> describing the findings of the research conducted by such programs and the outcomes of the activities carried out by such programs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4cecd770ba8843b18f4ca5170410d9f9"><enum>(2)</enum><header>Public availability</header><text>The report required under paragraph (1) shall be made publicly available on a text-based and searchable internet website.</text></paragraph></subsection><subsection id="id98f6311b23e144b9862a1a55579df06c" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>There is authorized to be appropriated $3,000,000 in each of the fiscal years 2024 and 2025 to carry out this section. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8552e8fdeea84bcfb8835c046505f9b8"><enum>11.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id2b1138b3-caa2-453e-b9a4-8ffe6f375274"><enum>(1)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Trade Commission. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5C630C74A8E548568AAE906EF9B7F082"><enum>(2)</enum><header>Covered platform</header><text>The term <term>covered platform</term> means a website, internet application, or mobile internet application that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0b678b7561e74130957c3bc2b8d74dfb"><enum>(A)</enum><text display-inline="yes-display-inline">allows users to create, share, view, or search for and access user-generated or third-party content, including a social media platform, online search engine, and a service with direct or group messaging capabilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32E735DF53804E47BE6E50226307B6CA"><enum>(B)</enum><text>has had at least 10,000,000 monthly active users for 3 or more of the past 12 months within the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5cd362b1f0e7472088e6c4d2d58a9022"><enum>(3)</enum><header>Monetization practices</header><text>The term <term>monetization practices</term> means any avenues through which a covered platform might garner revenue, including accepting monetary, in-kind, or other compensation—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc203fae91e0f44e0b7da9ee2eca0ddd3"><enum>(A)</enum><text>in exchange for displaying or amplifying specific content; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa464332610341b5a2128512919ca60b"><enum>(B)</enum><text>from businesses or other entities to utilize the covered platform as a means to find, charge, or communicate with customers.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8e1c4eb827a49d38cf3dedb730e8a4d"><enum>(4)</enum><header>Platform policies</header><text>The term <term>platform policies</term> means any terms, conditions, and clauses, regardless of their name or form, which govern the contractual relationship between a covered platform and a user, or any community guidelines that a covered platform maintains that govern conduct on the covered platform.</text></paragraph></section></legis-body></bill>
