which was read twice and referred to the <committee-name committee-id="SLIN00">Select Committee on Intelligence</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Defense Intelligence Agency to conduct a comparative study on the defense budgets of the People's Republic of China and the United States, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>China Defense Spending Transparency Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id540ac9d7a1f9478b99f5481d4fc6a0f6"><enum>2.</enum><header>Comparative study on defense budget transparency of the People’s Republic of China and the United States</header><subsection id="id8759cd2f20d446ba8a27a6763c13fd33"><enum>(a)</enum><header>Study required</header><paragraph id="idff14d0699ab84e57a0b7c52a0295a34f"><enum>(1)</enum><header>Defense intelligence agency study</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Defense Intelligence Agency shall complete and submit to the appropriate committees of Congress a public comparative study on the defense budgets of the People’s Republic of China and the United States.</text></paragraph><paragraph id="id24b0e81eba9947ca90c79987a90221c0"><enum>(2)</enum><header>Methodology</header><text>The study required by paragraph (1) shall employ a robust methodology that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc51b8b883eec401ca9a760914600961d"><enum>(A)</enum><text display-inline="yes-display-inline">does not depend on the official pronouncements of the Government of the People’s Republic of China or the Chinese Communist Party; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5a8a3160262474bb3999d1eea71ced2"><enum>(B)</enum><text display-inline="yes-display-inline">takes into account the military-civil fusion present in the People's Republic of China; and</text></subparagraph><subparagraph id="idafa0f39f6cda457fbabfe0bf68593e75"><enum>(C)</enum><text>employs the building block method of analysis or a similar method of analysis. </text></subparagraph></paragraph><paragraph id="idb865c4920e9b4b2384fa10f25afb6730"><enum>(3)</enum><header>Goal</header><text>The goal of the study required by paragraph (1) shall be to provide the people of the United States with an accurate comparison of the defense spending of the People’s Republic of China and the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3DCFDE19E3842D68627BCE12823052B"><enum>(4)</enum><header>Public availability</header><text>The Director shall make the study required by paragraph (1) available to the public on the internet website of the Defense Intelligence Agency. </text></paragraph></subsection><subsection id="idfb0f75ee2de0450e94a0a28236a1d664"><enum>(b)</enum><header>Elements</header><text>The study required by this section shall do the following:</text><paragraph id="idbc7e6327d5684b4b8865745dd4bfc485"><enum>(1)</enum><text>Determine the amounts invested by each subject country across functional categories for spending, including—</text><subparagraph id="id30e32fba9b3242b094153fce6d0df46e"><enum>(A)</enum><text>defense-related research and development;</text></subparagraph><subparagraph id="id28925326cda1473ab7a2f8c3a93d1bc2"><enum>(B)</enum><text>weapons procurement from domestic and foreign sources;</text></subparagraph><subparagraph id="id982cd4fbec524042a9b57f5fe415a501"><enum>(C)</enum><text>operations and maintenance;</text></subparagraph><subparagraph id="id8cbcf94a2d1849cbba82e2b38c0353be"><enum>(D)</enum><text>pay and benefits; and</text></subparagraph><subparagraph id="id910b5a422ed8429e89cf09e0452803fa"><enum>(E)</enum><text>military pensions.</text></subparagraph></paragraph><paragraph id="id6043e3ac243e4b89b6895d463080b8dd"><enum>(2)</enum><text>Consider the effects of purchasing power parity and market exchange rates, particularly on nontraded goods.</text></paragraph><paragraph id="id8ae59e2fea5347a693443ef8ca2cb2e7"><enum>(3)</enum><text>Estimate the magnitude of omitted spending from official defense budget information and account for such spending in the comparison.</text></paragraph><paragraph id="id73939362d94142069d7fd2deafc500f6"><enum>(4)</enum><text>Exclude spending related to veterans’ benefits, other than military pensions provided to veterans.</text></paragraph></subsection><subsection id="idb335cf9bee76466cb7adf3cad87e2eaa"><enum>(c)</enum><header>Considerations</header><text>The study required by this section may take into consideration the following:</text><paragraph id="id3e0f498d32ec4c1f85f983076b89a104"><enum>(1)</enum><text>The effects of State-owned enterprises on the defense expenditures of the People’s Republic of China.</text></paragraph><paragraph id="idde72567953e847a0911cb9ed63fca3fe"><enum>(2)</enum><text>The role of differing acquisition policies and structures with respect to the defense expenditures of each subject country.</text></paragraph><paragraph id="id88c8af24c8d943e5819c035f03466c3d"><enum>(3)</enum><text>Any other matter relevant to evaluating the resources dedicated to the defense spending or the various military-related outlays of the People’s Republic of China.</text></paragraph></subsection><subsection id="id3f2196edcbcb46eaa4343d67d9171bf5" commented="no"><enum>(d)</enum><header>Form</header><text>The study required by this section shall be submitted in unclassified form, but may include a classified annex.</text></subsection><subsection id="idfe9f6f43ac654c8da2dc9195e52ebcd0"><enum>(e)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="id38645d37838d455daa4e0f0da541d985"><enum>(1)</enum><text>the Committee on Appropriations, the Committee on Armed Services, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="id0cf58064f8264429a301d8ef08926b3a"><enum>(2)</enum><text>the Committee on Appropriations, the Committee on Armed Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives. </text></paragraph></subsection></section></legis-body></bill>
