<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1788</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230601">June 1, 2023</action-date><action-desc><sponsor name-id="S354">Ms. Baldwin</sponsor> (for herself and <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the United States Fish and Wildlife Service to update the Post-delisting Monitoring Plan for the Western Great Lakes Distinct Population Segment of the Gray Wolf, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id4a0ac85f4e2b40e992932a2b20dd6592"><enum/><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idef52242dab03430db9bce069360c8ae8"><enum>(1)</enum><header>1978 Rule</header><text>The term <term>1978 Rule</term> means the final rule of the United States Fish and Wildlife Service relating to <quote>Reclassification of the Gray Wolf in the United States and Mexico, with Determination of Critical Habitat in Michigan and Minnesota</quote> (43 Fed. Reg. 9607 (March 9, 1978)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd85a9fef3f604e46a51b9124c52f9428"><enum>(2)</enum><header display-inline="yes-display-inline">Advisory committee</header><text>The term <term>advisory committee</term> means the Northern Great Lakes Region Gray Wolf Advisory Committee established under section 3(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9463b039fa00440b8522a5a705e7e55e"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id6ef4ea5d0f8f4b2ba3fb0e81fde8971f" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Monitoring Plan</header><text>The term <term>Monitoring Plan</term> means the document of the United States Fish and Wildlife Service entitled <quote>Post-delisting Monitoring Plan for the Western Great Lakes Distinct Population Segment of the Gray Wolf</quote> and dated February 2008 (as described in the notice of document availability of the United States Fish and Wildlife Service entitled <quote>Post-Delisting Monitoring Plan for the Western Great Lakes Distinct Population Segment of the Gray Wolf (Canis lupus)</quote> (73 Fed. Reg. 19525 (April 10, 2008))).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11fc34afd2ba45efa0f8db526097dee9"><enum>(5)</enum><header display-inline="yes-display-inline">Northern Great Lakes Region</header><text>The term <term>Northern Great Lakes Region</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id540368cf447c4b95ad7861a6f9be50de"><enum>(A)</enum><text display-inline="yes-display-inline">the State of Minnesota;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65ed05cedacb42049224ed6dfbc3a877"><enum>(B)</enum><text>the State of Wisconsin; and</text></subparagraph><subparagraph id="id7678fcf80f5b43b688ffcf539f8bdf82" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the Upper Peninsula of the State of Michigan. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae22e365ae6843b087672ec06054f699"><enum>(6)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection></section><section id="id032aa97c8efc4f3da26b22a374c1983e"><enum>2.</enum><header>Update to the Post-delisting Monitoring Plan for the Western Great Lakes Distinct Population Segment of the Gray Wolf; delisting rule</header><subsection commented="no" display-inline="no-display-inline" id="id1e99b32715df403384b2b743beed90b9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in consultation with the advisory committee, shall update the Monitoring Plan with respect to the populations of Gray Wolf (Canis lupus) in the Northern Great Lakes Region.</text></subsection><subsection id="id872856542abe4949a9d2649172595233"><enum>(b)</enum><header>Expanded gray wolf population in 1978 rule</header><text>For purposes of the 1978 Rule and the rule required under subsection (c), the population of Gray Wolf (Canis lupus) described in the 1978 Rule as the Minnesota population shall include the population of Gray Wolf (Canis lupus) in the Northern Great Lakes Region.</text></subsection><subsection id="id10f5a47c828c4bfd9a6f27f72e2aa3a2"><enum>(c)</enum><header>Rule required</header><text>On updating the Monitoring Plan in accordance with subsection (a), the Secretary, in consultation with the advisory committee, shall issue a rule delisting the population of Gray Wolf (Canis lupus) within the Northern Great Lakes Region under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id71d61d56bc8543a5b635839e442cb744"><enum>(d)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in this section alters or modifies any other population of Gray Wolf (Canis lupus) described in, or any other portion of, the 1978 Rule other than the population of Gray Wolf (Canis lupus) located in the Northern Great Lakes Region.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idb778cb27d6dd41c19fe30cfdc3aef55c"><enum>3.</enum><header>Advisory committee</header><subsection commented="no" display-inline="no-display-inline" id="idf6cdf458db2349b588535b29fb8351d9"><enum>(a)</enum><header>Establishment</header><text>Not later than 30 days after the date of enactment of this Act, the Director shall establish an advisory committee, to be known as the <quote>Northern Great Lakes Region Gray Wolf Advisory Committee</quote>, in accordance with this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida91e0ec607f045dca042c3fce6b61376"><enum>(b)</enum><header>Membership</header><text>The advisory committee shall be composed of—</text><paragraph commented="no" display-inline="no-display-inline" id="id55ffed7e9a694ec88ec56fb762cc8d1d"><enum>(1)</enum><text>the Assistant Secretary for Indian Affairs;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf2cf5a3765c4fd58cb41b2d282df81d"><enum>(2)</enum><text>the Secretary of Agriculture;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3f49d1d35fb34b9bb40a64e327ee3074"><enum>(3)</enum><text>the Administrator of the Animal and Plant Health Inspection Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id518e38ea9a424658a276eeb8c3535028"><enum>(4)</enum><text>the Chief of the Forest Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79051b34a4984d34917bb59f9ffacc13"><enum>(5)</enum><text>representatives of federally recognized Indian Tribes and Tribal organizations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e110f7e9fa04f05b251151cd769712f"><enum>(6)</enum><text>the heads of applicable State agencies in the Northern Great Lakes Region, to be nominated by the governors of the applicable States in the Northern Great Lakes Region and appointed by the Director; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc400ed5f7600486099503e94defd9a6f"><enum>(7)</enum><text>other appropriate individuals with expertise on wolf biology, wolf management, and wolf predation, as determined by the Director.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id99a2b75916a2445cbb8cf96138fae15c"><enum>(c)</enum><header>Duties</header><text>The advisory committee shall consult with—</text><paragraph commented="no" display-inline="no-display-inline" id="id840840056a284a3da6298d4a4034f301"><enum>(1)</enum><text>the Director with respect to the updating of the Monitoring Plan under section 2(a); and</text></paragraph><paragraph id="idd25da8c06ea3462f9461fb7e24edd70a"><enum>(2)</enum><text>the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3ec4837f12e34970b1e9597da55be85b"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to the issuing of the delisting rule under section 2(c); and</text></subparagraph><subparagraph id="id4defad61585e46c4937eda114e14961a"><enum>(B)</enum><text>during the 5-year post-delisting monitoring period following the issuance of that rule.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
