which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Environmental Protection Agency to provide grants to reduce the quantity of food waste, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA393C063500E4DCFBADE9F7D62E1C9C6"><section section-type="section-one" id="H4D38A09D22E64D6086B138468D5E8F60"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zero Food Waste Act</short-title></quote>.</text></section><section id="H56956757178E449C9A9AAFEF9D85D040"><enum>2.</enum><header>Food waste reduction grants</header><subsection id="HF46EA4C7C14B4A6DB609929E71CDD8B8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5CD193A09FBB43F7ABB8FF716F6E7C0B"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H185B42EE0B4046D8BF18D9184B6AE03F"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" id="H6103B7C09A8242788D5FF4255546EBC8"><enum>(A)</enum><text display-inline="yes-display-inline">a State, a local government, a territorial government, or a Tribal government;</text></subparagraph><subparagraph id="H6C88CD66E4314B38978B1301C8BE3BCD"><enum>(B)</enum><text>a nonprofit organization; and</text></subparagraph><subparagraph commented="no" id="HBAEFCAF6E371440F86688802B7F7923A"><enum>(C)</enum><text>a partnership of 2 or more of any of the entities described in subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph commented="no" id="HF2F769775B4240469ABAA18C45330223"><enum>(3)</enum><header>Food waste</header><text display-inline="yes-display-inline">The term <term>food waste</term> means any uneaten food and inedible parts of food.</text></paragraph><paragraph commented="no" id="H11E07BD1F9E84B599E10547A9EB4C553"><enum>(4)</enum><header>Food waste reduction activity</header><text>The term <term>food waste reduction activity</term> means any method or activity that reduces the quantity of food waste disposed of in landfills or incinerated, including through prevention, rescue, upcycling, and recycling.</text></paragraph><paragraph id="HF2DDDBADDEAA4E0CAC295C1A24B92383"><enum>(5)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code. </text></paragraph><paragraph commented="no" id="HB0CFA476F9D84DB394672D91862BA6A5"><enum>(6)</enum><header>Prevent</header><text display-inline="yes-display-inline">The term <term>prevent</term> means to forestall the generation of food waste.</text></paragraph><paragraph id="H1334EE3C8525463FA335383D16487C52"><enum>(7)</enum><header>Recycle</header><text display-inline="yes-display-inline">The term <term>recycle</term> means to reuse food waste as a feedstock for a nonfood product.</text></paragraph><paragraph commented="no" id="H5F89880DC1FA4E469EDE53147AADCE36"><enum>(8)</enum><header>Rescue</header><text display-inline="yes-display-inline">The term <term>rescue</term> means to redirect surplus food for consumption.</text></paragraph><paragraph id="HE941E8DF13EA45B1BC3A5F9129C6F695"><enum>(9)</enum><header>Source separated organics</header><subparagraph id="HD29017EFB92349ACAC3FED995EA853BE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>source separated organics</term> means organic waste that is separated from other waste by the waste generator.</text></subparagraph><subparagraph id="H9DC07C79585F43D8A15F516B3C110AA4"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>source separated organics</term> includes materials that are certified to meet ASTM standard D6400 or D6868.</text></subparagraph><subparagraph id="H7A70FAD6CD0E47499BE051DCF38DF110"><enum>(C)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>source separated organics</term> does not include mixed solid waste.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H335F845913A3428B82198D6941881AEC"><enum>(10)</enum><header>Upcycle</header><text display-inline="yes-display-inline">The term <term>upcycle</term> means to make new food from ingredients that otherwise would become food waste.</text></paragraph></subsection><subsection id="H4D28EF3E627440618F956252BC33E0E2"><enum>(b)</enum><header>Program</header><paragraph id="HF16490DEE4A1402DAF1ABBAB1F8A36F1"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish and carry out a program to award competitive grants in accordance with paragraph (3).</text></paragraph><paragraph id="H82BDD1CF434A4C23AC7357BF6329D066"><enum>(2)</enum><header>Purpose</header><text>The purpose of the program established under paragraph (1) is to help reduce the quantity of food waste by 50 percent by 2030, relative to that quantity in 2010.</text></paragraph><paragraph id="HEB3C3555A99F41C5BE630BCB4CD011AF"><enum>(3)</enum><header>Grants</header><subparagraph id="HA5DADBC6067B471CB61F23D8AAB59555"><enum>(A)</enum><header>Study on food waste generation and food waste management planning</header><text display-inline="yes-display-inline">Under the program established under paragraph (1), the Administrator may award a grant to an eligible entity, excluding any eligible entity that is a nonprofit organization—</text><clause id="H74007DDD98764296B6D9F1F53E113666"><enum>(i)</enum><text>to study—</text><subclause id="H7C4685183004462AB19960736548DE29"><enum>(I)</enum><text>the generation of food waste in the State or area in which the eligible entity is located or otherwise serves; and</text></subclause><subclause id="HF7E6B5DD25254C95B348B8DFAF771344"><enum>(II)</enum><text>policies and programs that significantly reduce the quantity of food waste, including policies and programs to carry out food waste reduction activities; and</text></subclause></clause><clause id="HCF6E47AE583446D3A60862CD5FE6656C"><enum>(ii)</enum><text>to develop a plan under which the eligible entity will carry out at least 1 food waste reduction activity, prioritizing prevention to the extent practicable.</text></clause></subparagraph><subparagraph id="HDFD295EAFADA433286CBF037C38EC93F"><enum>(B)</enum><header>Food waste data and reports</header><text display-inline="yes-display-inline">Under the program established under paragraph (1), the Administrator may award a grant to an eligible entity, excluding any eligible entity that is a nonprofit organization—</text><clause id="HA22B8C8AED414EDF8CAE0FFDBDF4288A"><enum>(i)</enum><text>to collect data on the quantity of food waste generated in the State or area in which the eligible entity is located or otherwise serves; and</text></clause><clause id="HA94D6517FD504804AA32531A8496D326"><enum>(ii)</enum><text>to publish, on any publicly available website (which may include the website of a nongovernmental organization), a monthly or quarterly report on the data collected under clause (i).</text></clause></subparagraph><subparagraph id="H54BF66A19E5043B08E3EE3CBB3A2E28F"><enum>(C)</enum><header>Food waste reduction projects</header><text display-inline="yes-display-inline">Under the program established under paragraph (1), the Administrator may award a grant to an eligible entity—</text><clause id="HB7BDC615E4BD495D9AE29BB3675A5AA6"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HBE3E3C1F9ECA4340A2CA9E586BD29A12"><enum>(I)</enum><text display-inline="yes-display-inline">to carry out or otherwise support a food waste reduction activity;</text></subclause><subclause id="H894B4420FB2E4DC4AE4538637B682508" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">to implement a differential pricing policy on the disposal of food waste—</text><item display-inline="no-display-inline" id="H3A936DCC7CDC4037A0C909C2A56C136B"><enum>(aa)</enum><text>to disincentivize disposing of food waste by incineration or deposit in a landfill; and</text></item><item id="HF32C4BAEE02B43BDB9557D8F21FCB311"><enum>(bb)</enum><text display-inline="yes-display-inline">to incentivize carrying out food waste reduction activities;</text></item></subclause><subclause display-inline="no-display-inline" id="HD10D648A11C4467F85659903A1F659EE" indent="up1"><enum>(III)</enum><text>to pay for or provide technical assistance to carry out a food waste reduction activity;</text></subclause><subclause id="H6D111D0425264433A1C7F5E427272FC0" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">to implement restrictions on disposing of food waste by incineration or deposit in a landfill;</text></subclause><subclause id="HDCECC82B8E77494EBED65326C201C469" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">to implement food waste reduction activity requirements;</text></subclause><subclause id="HA293F447F447461BA96DFF5037B71CE9" indent="up1"><enum>(VI)</enum><text>to implement demand-stimulating policies for recycling end-markets; or</text></subclause><subclause id="H42BD8C4754774807A7F9E6487D404D74" indent="up1"><enum>(VII)</enum><text>to carry out any other activity the Administrator determines will reduce the quantity of food waste in the applicable area; and</text></subclause></clause><clause id="H251C3B682FCD40B0A2A70FF52A15793E"><enum>(ii)</enum><text display-inline="yes-display-inline">to collect data and publish reports as described in subparagraph (B).</text></clause></subparagraph></paragraph></subsection><subsection id="HC3E4F1B07300450B8035E0751CAADCD2"><enum>(c)</enum><header>Applications</header><paragraph commented="no" display-inline="no-display-inline" id="H893D6E1999B340EE8FF7F17D93958375"><enum>(1)</enum><header>In general</header><text>To apply for a grant under this section, an eligible entity shall submit to the Administrator an application at such time and in such form as the Administrator may require, which shall demonstrate how the eligible entity will use the grant in accordance with subsection (b)(3).</text></paragraph><paragraph id="H0BDF96F8ECDE4366B3A98016C319BDC3"><enum>(2)</enum><header>Nonprofit organizations</header><text>In the case of an application under paragraph (1) from an eligible entity that is a nonprofit organization, the application shall include—</text><subparagraph id="HF1F8A167A97B41D18335D90447D191F2"><enum>(A)</enum><text>a letter of support for the proposed use of the grant from—</text><clause id="H20BB1A4FB62E427093753051765407BF"><enum>(i)</enum><text display-inline="yes-display-inline">the relevant local government, territorial government, Tribal government, or State; or</text></clause><clause id="HA96A827026214A369B1624B58E095454"><enum>(ii)</enum><text>another nonprofit organization that—</text><subclause id="H7C97EA088D594073BCA54C17F0FAF36C"><enum>(I)</enum><text>has a demonstrated history of undertaking work in the geographic region where the proposed use of the grant is to take place, as determined by the Administrator; and</text></subclause><subclause id="HC8CD0E92E8674E74ACFF5892146D7813"><enum>(II)</enum><text>would not be involved in the proposed use of the grant; and</text></subclause></clause></subparagraph><subparagraph id="HE856FFB21E204E4BB8E5A287FD683CAD"><enum>(B)</enum><text>any other information the Administrator may require.</text></subparagraph></paragraph><paragraph commented="no" id="H38B74799A81B4C4C8495739E4880F338"><enum>(3)</enum><header>Prioritization</header><text>In awarding grants under this section, the Administrator shall—</text><subparagraph commented="no" id="HCAC042C8D01F47CA87FA935383F1E167"><enum>(A)</enum><text>seek to award grants for use in diverse locations and for diverse uses; and</text></subparagraph><subparagraph id="HC7F2E2B0A4D747DF8F4E574C5179E84C"><enum>(B)</enum><text>prioritize awarding grants to—</text><clause id="H627AA97B1EC546D5BB78D162EB341110"><enum>(i)</enum><text display-inline="yes-display-inline">any eligible entity, excluding any eligible entity that is a nonprofit organization, that—</text><subclause id="H0AA36F64CAA84FE7AC8EF5B0EF9A4968"><enum>(I)</enum><text>implements a program to carry out food waste reduction activities; or</text></subclause><subclause id="HA822797D86C44B608CFCDAE061503DEF"><enum>(II)</enum><text display-inline="yes-display-inline">has a demonstrated need, as determined by the Administrator, for additional investment in infrastructure or other resources to be able to implement a program to carry out food waste reduction activities; or</text></subclause></clause><clause commented="no" id="H9618908C3E174004B9E14F05638EAE32"><enum>(ii)</enum><text display-inline="yes-display-inline">an eligible entity that will use the grant in accordance with subsection (b)(3)(C)(i) in a community of color, low-income community, or Tribal community that has been disproportionately affected by adverse human health or environmental effects.</text></clause></subparagraph></paragraph><paragraph id="HB9FCB0C12AA147E09758A77F7281D0EE"><enum>(4)</enum><header>Anaerobic digestion projects</header><text display-inline="yes-display-inline">With respect to any grant awarded under subsection (b)(3)(C) to carry out an anaerobic digestion project, the Administrator shall—</text><subparagraph id="H2CB537FFE6C147A3922980989EFED990"><enum>(A)</enum><text display-inline="yes-display-inline">require the applicant to submit to the Administrator a plan for end-product recycling that, in accordance with guidelines the Administrator shall establish—</text><clause id="H26A935FB34F24200BF02B3A201DE476F"><enum>(i)</enum><text display-inline="yes-display-inline">provides for the use of the material resulting from the project as a soil amendment; and</text></clause><clause id="H273BBD1BF21C41F8A15F3DDD7B3BE4E9"><enum>(ii)</enum><text display-inline="yes-display-inline">ensures that the use of the material resulting from the project does not create an environmental hazard; and</text></clause></subparagraph><subparagraph commented="no" id="H936086316628419EACCCF9A65EADA4A5"><enum>(B)</enum><text display-inline="yes-display-inline">require the eligible entity that is carrying out the project—</text><clause commented="no" id="H5522A5129D1A4D919ED388F59034E677"><enum>(i)</enum><text display-inline="yes-display-inline">to limit its use of animal waste to not more than 20 percent of the total feedstock of the project; and</text></clause><clause commented="no" id="H7719776EE79E47FE8F7D52FA5EC0BC39"><enum>(ii)</enum><text display-inline="yes-display-inline">to only use source separated organics as the portion of the total feedstock that is not animal waste.</text></clause></subparagraph></paragraph></subsection><subsection id="H33024DD850E84E15ACFE6928ABE59B8E"><enum>(d)</enum><header>Reporting</header><paragraph commented="no" id="H4274BF7B218E434B801EF5A4A38921E3"><enum>(1)</enum><header>Effect of use of grant</header><text display-inline="yes-display-inline">Each eligible entity that receives a grant under this section shall submit to the Administrator a report, at such time and in such form as the Administrator may require, on the results of the use of the grant, which shall include any relevant data requested by the Administrator for purposes of tracking the effectiveness of the program established under subsection (b)(1).</text></paragraph><paragraph id="HAF6A85045E22466CB734C53D14F86F93"><enum>(2)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Administrator shall submit to Congress and make publicly available on the website of the Environmental Protection Agency an annual report describing—</text><subparagraph id="H8EA8AEF89BE147698D082FA8C78C587F"><enum>(A)</enum><text display-inline="yes-display-inline">the effectiveness of the program established under subsection (b)(1) in reducing the quantity of food waste by 50 percent by 2030, relative to that quantity in 2010, including information on the progress of that reduction; and</text></subparagraph><subparagraph id="HEB80ADB27F7B4ABD9684411D16520F21"><enum>(B)</enum><text>the means by which the Administrator is promoting learning among grantees and other stakeholders to better achieve results.</text></subparagraph></paragraph></subsection><subsection id="H4CC8567F58034CA6818A2554DF576915"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $650,000,000 for each of fiscal years 2023 through 2032, to remain available until expended.</text></subsection></section></legis-body></bill>
