<section id="idefd6a5adf2954cfca4d2300c55c1253e"><enum>2.</enum><header>Expansion of sanctions under Uyghur Human Rights Policy Act of 2020</header>
<subsection id="id0202b13fa78f4ef1abec2549e63f63d7"><enum>(a)</enum><header>In general</header><text>Section 6 of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) is amended—</text> <paragraph id="idaa8c051833364b64972d9457a3967bd1"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id02a4d9ac91884ec0b6312ef2d537feb9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> <clause commented="no" display-inline="no-display-inline" id="idfdc1bdd0f01e4a9a9aafed1c67e49290"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>persons in Xinjiang Uyghur Autonomous Region</quote> and inserting <quote>persons residing in the Xinjiang Uyghur Autonomous Region or members of those groups in countries outside of the People’s Republic of China</quote>;</text></clause>
<clause id="idab4da53c7b7e492d8f5c23a14a9463c8"><enum>(ii)</enum><text>by inserting after subparagraph (F) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id91f921bdec1e48818c54b0e38dfeab47"> <subparagraph id="id86787310f61342a1b301055081640280"><enum>(G)</enum><text>Systematic rape, coercive abortion, forced sterilization, or involuntary contraceptive implantation policies and practices.</text></subparagraph>
<subparagraph id="ida18bd798a93d4c1bafd986fbf969454c"><enum>(H)</enum><text>Human trafficking for the purpose of organ removal.</text></subparagraph> <subparagraph id="id8cf83ca98a8544d2bf4f43f34f0203e9"><enum>(I)</enum><text>Forced separation of children from their parents to be placed in boarding schools. </text></subparagraph>
<subparagraph id="idfee3bc14ad6340a2ab13514fef8f63b1"><enum>(J)</enum><text>Forced deportation or refoulement to the People’s Republic of China.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="id3281E87724CD40FCB1891379DEB57888"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph>
<subparagraph id="id4648BD2C13644AB596E1C4A9616299F6"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id10DD7E3291FD45D9971BF997576638AF"> <paragraph id="id80CCCD8AA83444A5A9F80682E8C6143C"><enum>(2)</enum><header>Additional matters to be included</header><text>The President shall include in the report required by paragraph (1) an identification of—</text>
<subparagraph id="idDE900582180E42C584810181AFA6464B"><enum>(A)</enum><text>each foreign person that knowingly provides significant goods, services, or technology to or for a person identified in the report; and</text></subparagraph> <subparagraph id="id85A65305AD4A4420B2E0037F5D1DB2E3"><enum>(B)</enum><text>each foreign person that knowingly engages in a significant transaction relating to any of the acts described in subparagraphs (A) through (J) of paragraph (1).</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id404F550BC7B744B5ABCCB2A540A19633" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (b), by striking <quote>subsection (a)(1)</quote> and inserting <quote>subsection (a)</quote>; and</text></paragraph> <paragraph id="id195f8b5928d145e19697f3a5b4ffe35f"><enum>(3)</enum><text>by amending subsection (d) to read as follows:</text>

<subsection id="id99a99a248e63414882d6cffda93c7ba3"><enum>(d)</enum><header>Implementation; regulatory authority</header>
<paragraph commented="no" display-inline="no-display-inline" id="idca9781a8ea784fa5a32915db4d4e2451"><enum>(1)</enum><header>Implementation</header><text display-inline="yes-display-inline">The President may exercise all authorities provided under section 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref>) to carry out this section.</text></paragraph> <paragraph id="id347FD040A88647DD86350A88F1ABFF7F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Regulatory authority</header><text display-inline="yes-display-inline">The President shall issue such regulations, licenses, and orders as necessary to carry out this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id605713685d6a46dea92987b2f0a95e68"><enum>(b)</enum><header>Effective date; applicability</header><text>The amendments made by this section—</text> <paragraph id="id26ec4547085d42b8a722085a1b514492"><enum>(1)</enum><text>take effect on the date of the enactment of this Act; and</text></paragraph>
<paragraph id="id3ac933fd3543418a9a963aefd98e2db9"><enum>(2)</enum><text>apply with respect to the first report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 submitted after such date of enactment.</text></paragraph></subsection></section> <section id="id122d23f942434d2aafa3399de3c09db3"><enum>3.</enum><header>Sense of Congress on application of sanctions under Uyghur Human Rights Policy Act of 2020</header> <subsection commented="no" display-inline="no-display-inline" id="id0300fdabf9d149a59535c1fafb418d9e"><enum>(a)</enum><header display-inline="yes-display-inline">Finding</header><text display-inline="yes-display-inline">Congress finds that, as of the date of the enactment of this Act—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id45c1081daab64ab38ed6ce778a4d431c"><enum>(1)</enum><text display-inline="yes-display-inline">the report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) has not been submitted to Congress; and </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id62f75b2c05cf44098a63b3862f6b631b"><enum>(2)</enum><text display-inline="yes-display-inline">the sanctions provided for under that Act have not been employed. </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id0bbd4691d3b3499ab0a9143c75596285"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the President should employ the sanctions provided for under the Uyghur Human Rights Policy Act of 2020—</text> <paragraph commented="no" display-inline="no-display-inline" id="id8ee9baf0a1a24d7db5e258c1f3d446de"><enum>(1)</enum><text display-inline="yes-display-inline">to address ongoing atrocities, in particular the use of forced labor, in the Xinjiang Uyghur Autonomous Region of the People's Republic of China; and </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id44f171ac5f7f455e83cdf998062cc949"><enum>(2)</enum><text display-inline="yes-display-inline">to hold officials of the People’s Republic of China accountable for those ongoing atrocities. </text></paragraph></subsection></section> <section id="idF9B79510B2114C049B547B4AF95C8956"><enum>4.</enum><header>Denial of United States entry for individuals complicit in forced abortions or forced sterilizations</header><text display-inline="no-display-inline">Section 801 of the Admiral James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/113">Public Law 106–113</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1182e">8 U.S.C. 1182e</external-xref>) is amended—</text>
<paragraph id="id1670a62152024cfb9fd1105d4d108710"><enum>(1)</enum><text>in subsection (a), by striking <quote>may not</quote> each place it appears and inserting <quote>shall not</quote>;</text></paragraph> <paragraph id="id9bf663c9a2b642169aff8b46aad416cb"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id6C6CC897A4FE4353BA8D828E5616B7B4">
<subsection id="id1e11a8eec69144b0a6c6eeebe7532f83"><enum>(c)</enum><header>Waiver</header><text>The Secretary of State may waive the prohibitions in subsection (a) with respect to a foreign national if the Secretary—</text> <paragraph commented="no" display-inline="no-display-inline" id="iddc477ba96a4045598dbc6be48f789a6b"><enum>(1)</enum><text display-inline="yes-display-inline">determines that—</text>
<subparagraph id="idf71d769c0f7745359fccd77bff04526c"><enum>(A)</enum><text>the foreign national is not directly complicit in atrocities, specifically the oversight of programs or policies the intent of which is to destroy, in whole or in part, a national, ethnic, racial, or religious group through the use of forced sterilization, forced abortion, or other egregious population control policies; </text></subparagraph> <subparagraph id="id29e91283988c4e17ba20b237b1fac054"><enum>(B)</enum><text>admitting or paroling the foreign national into the United States is necessary—</text>
<clause id="ida1bfbd5c30e94d09b748267f4dcb9c95"><enum>(i)</enum><text>to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success on June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States; or</text></clause> <clause id="id8968e5f74d1e4089b9aa75a0d6732925"><enum>(ii)</enum><text>to carry out or assist law enforcement activity of the United States; and</text></clause></subparagraph>
<subparagraph id="id7b9c516e580a41fb9c416037098a74ad"><enum>(C)</enum><text>it is important to the national security interest of the United States to admit or parole the foreign national into the United States; and</text></subparagraph></paragraph> <paragraph id="id5f8251a10aa04c34937b615c45e00ea6"><enum>(2)</enum><text>provides written notification to the appropriate congressional committees containing a justification for the waiver.</text></paragraph></subsection>
<subsection id="id320facf10deb44feabae81398fb8230b"><enum>(d)</enum><header>Notice</header><text>The Secretary of State shall make a public announcement whenever the prohibitions under subsection (a) are imposed under this section.</text></subsection> <subsection id="idae79375d578f42d786d73cb6e83d0e64"><enum>(e)</enum><header>Information requested by Congress</header><text>The Secretary of State, upon the request of a Member of Congress, shall provide—</text>
<paragraph id="id3657326a45ef47c3a1a03fccefd243a7"><enum>(1)</enum><text>information about the use of the prohibitions under subsection (a), including the number of times such prohibitions were imposed, disaggregated by country and by year; or</text></paragraph> <paragraph id="ide63e334799fc4abeb58449767909d155" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>a classified briefing that includes information about the individuals subject to such prohibitions or subject to sanctions under any other Act authorizing the imposition of sanctions with respect to the conduct of such individuals.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="id2278e331bd3a40db9fe13a689eb1affc"><enum>5.</enum><header>Physical and psychological support for Uyghurs, Kazakhs, and other ethnic groups</header>
<subsection id="id0e6832193fbb4acb854c7f7b0deaa0b4"><enum>(a)</enum><header>Authorization</header>
<paragraph commented="no" display-inline="no-display-inline" id="id799ba81e699f4412aaeab19bbb046aa8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Using funds appropriated to the Department of State in annual appropriations bills under the heading <quote><header-in-text style="appropriations" level="appropriations-small">development assistance</header-in-text></quote>, the Secretary of State, in conjunction and in consultation with the Administrator of the United States Agency for International Development, is authorized, subject to the requirements under chapters 1 and 10 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) and section 634A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2394-1">22 U.S.C. 2394–1</external-xref>)— </text> <subparagraph commented="no" display-inline="no-display-inline" id="idfa23cdc5bdc24d549ca86b33dbc99648"><enum>(A)</enum><text display-inline="yes-display-inline">to provide the assistance described in paragraph (2) to individuals who—</text>
<clause commented="no" display-inline="no-display-inline" id="id57d626734cfb4079bd1e6328e3e5f48e"><enum>(i)</enum><text display-inline="yes-display-inline">belong to the Uyghur, Kazakh, Kyrgyz, or another oppressed ethnic group in the People’s Republic of China;</text></clause> <clause commented="no" display-inline="no-display-inline" id="idc3622b26d11d4b7987570a6c2475b101"><enum>(ii)</enum><text display-inline="yes-display-inline">experienced torture, forced sterilization, rape, forced abortion, forced labor, or other atrocities in the People’s Republic of China; and </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id7fba37a0d29b4b84884453ca567a5be3"><enum>(iii)</enum><text display-inline="yes-display-inline">are residing outside of the People’s Republic of China; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id11db17727eca49ccb411d36c53aac2a8"><enum>(B)</enum><text>to build local capacity for the care described in subparagraph (A) through—</text>
<clause commented="no" display-inline="no-display-inline" id="idefa596a779a04d5693cb415e178f2e48"><enum>(i)</enum><text display-inline="yes-display-inline">grants to treatment centers and programs in foreign countries in accordance with section 130(b) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152">22 U.S.C. 2152(b)</external-xref>); and</text></clause> <clause id="id569d2e73affb4c45902fda75da571981"><enum>(ii)</enum><text>research and training to health care providers outside of such treatment centers or programs in accordance with section 130(c)(2) of such Act. </text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idcc4259dde03944b8b9b49e41d2d5c291"><enum>(2)</enum><header>Authorized assistance</header><text display-inline="yes-display-inline">The assistance described in this paragraph is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id61c97acf0e0e4339afe61dda46b5954a"><enum>(A)</enum><text display-inline="yes-display-inline">medical care;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id6743a48dbd7d468da98bcd08019774a8"><enum>(B)</enum><text display-inline="yes-display-inline">physical therapy; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idc7f4b8ca6f364b16bb3d29c5e10f2363"><enum>(C)</enum><text display-inline="yes-display-inline">psychological support.</text></subparagraph></paragraph></subsection>
<subsection id="idf354b94e17f34179a9b5d9fec97df020"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of State shall submit a report to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that describes—</text> <paragraph commented="no" display-inline="no-display-inline" id="ida208036be6e1407ebb0a1093a3843517"><enum>(1)</enum><text display-inline="yes-display-inline">the direct care or services provided in foreign countries for individuals described in subsection (a)(1)(A); and </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id94de989b50154696ab4ff350b9ab01c1"><enum>(2)</enum><text display-inline="yes-display-inline">any projects started or supported in foreign countries to provide the care or services described in paragraph (1).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="ide1c39cc3a4794f7eb998e6e646da71d2"><enum>(c)</enum><header>Federal share</header><text>Not more than 50 percent of the costs of providing the assistance authorized under subsection (a) may be paid by the United States Government.</text></subsection></section>
<section id="idb98b23a6870345de9d994d12886740df"><enum>6.</enum><header>Preservation of cultural and linguistic heritage of ethnic groups oppressed by the People’s Republic of China</header>
<subsection id="id4661a05a15d8495c94e6426b66757b5c"><enum>(a)</enum><header>Finding</header><text>Congress finds that the genocide perpetrated by officials of the Government of the People’s Republic of China in the Xinjiang Uyghur Autonomous Region aims to erase the distinct cultural and linguistic heritage of oppressed ethnic groups.</text></subsection> <subsection id="id3f0a5462aa2442e89e29f6d74ddfc8d9"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the United States Government should use its diplomatic, development, and cultural activities to promote the preservation of cultural and linguistic heritages of ethnic groups in the People’s Republic of China threatened by the Chinese Communist Party.</text></subsection>
<subsection id="id21c9740250d94ab5b4d19094033a6af3"><enum>(c)</enum><header>Report required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of State, in consultation with the Administrator of the United States Agency for International Development, shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report that assesses the feasibility of establishing a grant program to assist communities facing threats to their cultural and linguistic heritage from officials of the Government of the People’s Republic of China.</text></subsection> <subsection id="id59fd446c592e4308affd5836e247af54"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $2,000,000 for each of fiscal years 2024 through 2027, to support the establishment of a Repressed Cultures Preservation Initiative within the Smithsonian Institution to pool Institution-wide efforts toward research, exhibitions, and education related to the cultural and linguistic heritage of ethnic and religious groups the cultures of which are threatened by repressive regimes, including the Chinese Communist Party. </text></subsection></section>
<section id="idf2fa079f980a4bba86f5b223a7cbbe9d"><enum>7.</enum><header>Determination of whether actions of certain Chinese entities meet criteria for imposition of sanctions</header>
<subsection id="iddb17d71dce684056a0e9990c5e243fc1"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of the Treasury, in consultation with the Secretary of State and the Attorney General, shall—</text> <paragraph id="id0767a23826f2402cb3a22c014f632ef5"><enum>(1)</enum><text>determine whether any entity specified in subsection (b)—</text>
<subparagraph id="id5b53dd3ee2b149b9a75a6164c6fbb6a8"><enum>(A)</enum><text>is responsible for or complicit in, or has directly or indirectly engaged in, serious human rights abuses against Uyghurs or other predominantly Muslim ethnic groups in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China; or</text></subparagraph> <subparagraph id="idb61e63340ab444aeb4582e694f354bbb"><enum>(B)</enum><text>meets the criteria for the imposition of sanctions under—</text>
<clause id="id5111984a14a24e84a8eac48355db3768"><enum>(i)</enum><text>the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10101">22 U.S.C. 10101 et seq.</external-xref>);</text></clause> <clause id="id0805b1c88261465b9b587d8fc6546e44"><enum>(ii)</enum><text>section 6 of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note);</text></clause>
<clause id="id0a6580560ab24e81bfd5f2a538077f2f"><enum>(iii)</enum><text>section 105, 105A, 105B, or 105C of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/22/8514">22 U.S.C. 8514</external-xref>, 8514a, 8514b, and 8514c);</text></clause> <clause id="id6af84f464d554e51976451e457fc8bc6"><enum>(iv)</enum><text>Executive Order 13818 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking the property of persons involved in serious human rights abuse or corruption), as amended on or after the date of the enactment of this Act; or</text></clause>
<clause id="id269a3e5c1236445da312a272b70ea24b"><enum>(v)</enum><text>Executive Order 13553 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of certain persons with respect to serious human rights abuses by the Government of Iran and taking certain other actions), as amended on or after the date of the enactment of this Act;</text></clause></subparagraph></paragraph> <paragraph id="idfe850fb3ca20461bac4a81cde75f9f9b"><enum>(2)</enum><text>if the Secretary of the Treasury determines under paragraph (1) that an entity is responsible for or complicit in, or has directly or indirectly engaged in, serious human rights abuses described in subparagraph (A) of that paragraph or meets the criteria for the imposition of sanctions described in subparagraph (B) of that paragraph, include the entity on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control; and</text></paragraph>
<paragraph id="idf90aa58abe4e47b29e89b33393d35d04"><enum>(3)</enum><text>submit to Congress a report on that determination that includes the reasons for the determination.</text></paragraph></subsection> <subsection id="id53ef992f629645e2bcebc3d3727fd47d"><enum>(b)</enum><header>Entities specified</header><text>An entity specified in this subsection is any of the following:</text>

<section id="idcc67ecb78534486bb91465979c677a38"><enum>8.</enum><header>Countering propaganda from the People’s Republic of China about genocide</header>
<subsection id="id5ad85fb169df4a1abde8898dfdf82514"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of State, in conjunction with the United States Agency for Global Media, shall submit a strategy to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> for countering propaganda and other messaging from news and information sources associated with the Government of the People’s Republic of China or entities associated with the Chinese Communist Party or influenced by the Chinese Communist Party or the Government of the People’s Republic of China that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5a536c79dce441938c4b80c94cf7a94a"><enum>(1)</enum><text display-inline="yes-display-inline">deny the genocide, crimes against humanity, and other egregious human rights abuses experienced by Uyghurs and other predominantly Muslim ethnic groups in the Xinjiang Uyghur Autonomous Region;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id4b068a5688364295ab3901e59f87fe43"><enum>(2)</enum><text display-inline="yes-display-inline">spread propaganda regarding the role of the United States Government in imposing economic and reputational costs on the Chinese Communist Party or the Government of the People’s Republic of China for its ongoing genocide; </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id4934b5c68c8740099faa313f060bdb0a"><enum>(3)</enum><text display-inline="yes-display-inline">target Uyghurs and other people who publicly oppose the Government of the People's Republic of China’s genocidal policies and forced labor practices, including the detention and intimidation of their family members; or</text></paragraph>
<paragraph id="id24fc3332fa6b4291a0b7f2f7f1b8215e"><enum>(4)</enum><text>increase pressure on member countries of the United Nations to deny or defend genocide or other egregious violations of internationally recognized human rights in the People’s Republic of China within international organizations and multilateral fora, including at the United Nations Human Rights Council. </text></paragraph></subsection> <subsection id="id3a9887440f6441a29e6fee14bbfb791e"><enum>(b)</enum><header>Strategy elements</header><text>The strategy required under subsection (a) shall include—</text>
<paragraph id="id80e190855bfd427489fd9c41ae714bfc"><enum>(1)</enum><text>existing messaging strategies and specific broadcasting efforts to counter the propaganda described in paragraphs (1) and (2) of subsection (a) and the reach of such strategies and efforts to audiences targeted by such propaganda;</text></paragraph> <paragraph id="id9a1c6df9005e4573b7f9a190fcf944d9"><enum>(2)</enum><text>specific metrics used for determining the success or failure of the messaging strategies and broadcasting efforts described in paragraph (1) and an analysis of the impact of such strategies and efforts;</text></paragraph>
<paragraph id="id49ba5812f44d4fed991966ecce87a83f"><enum>(3)</enum><text>a description of any new or pilot messaging strategies and broadcasting efforts expected to be implemented during the 12-month period beginning on the date of the enactment of this Act and an explanation of the need for such strategies and efforts;</text></paragraph> <paragraph id="id2a57039007d74dbd9f903a091582b624"><enum>(4)</enum><text>measurable goals to be completed during the 12-month period beginning on the date of the enactment of this Act and tangible outcomes for expanding broadcasting efforts and countering propaganda; and</text></paragraph>
<paragraph id="id504eb97f233b45c39ad21abcabaad533"><enum>(5)</enum><text>estimates of additional funding needed to counter the propaganda described in paragraphs (1) and (2) of subsection (a).</text></paragraph></subsection> <subsection id="ide9ad85c5855549fba540261478bc1793" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Funding</header><text>The Secretary of State is authorized to use amounts made available for the Countering PRC Influence Fund under section 7043(c)(2) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2022 (division K of <external-xref legal-doc="public-law" parsable-cite="pl/117/103">Public Law 117–103</external-xref>) to develop and carry out the strategy required under subsection (a). </text></subsection></section>
<section id="id8ae16abb542b43deb108725fbbf1d39c"><enum>9.</enum><header>Documenting atrocities in the Xinjiang Uyghur Autonomous Region</header><text display-inline="no-display-inline">The Secretary of State and the Administrator of the United States Agency for International Development may provide assistance, including financial and technical assistance, as necessary and appropriate, to support the efforts of entities, including nongovernmental organizations with expertise in international criminal investigations and law, to address genocide, crimes against humanity, and their constituent crimes by the Government of the People’s Republic of China by—</text> <paragraph id="idc81be4390af444bf84890aeb6032d575"><enum>(1)</enum><text>collecting, documenting, and archiving evidence, including the testimonies of victims and visuals from social media, and preserving the chain of custody for such evidence;</text></paragraph>
<paragraph id="idb6307b1657984356ae3c1880ae8d43e3"><enum>(2)</enum><text>identifying suspected perpetrators of genocide and crimes against humanity;</text></paragraph> <paragraph id="id5f9293f7c28d4010baf159827a8af290"><enum>(3)</enum><text>conducting criminal investigations of atrocity crimes, including by developing indigenous investigative and judicial skills through partnerships, direct mentoring, and providing the necessary equipment and infrastructure to effectively adjudicate cases for use in prosecutions in domestic courts, hybrid courts, and internationalized domestic courts; </text></paragraph>
<paragraph id="id3d6f857bb7614442889b64b054ddff9c"><enum>(4)</enum><text>supporting investigations conducted by foreign countries, civil society groups, and multilateral organizations, such as the United Nations; and</text></paragraph> <paragraph id="id6c6a16f912744dfaac0547973911a844"><enum>(5)</enum><text>supporting and protecting witnesses participating in such investigations.</text></paragraph></section>
<section id="idd4cab98f7a924d7a904cd9626e88cd96"><enum>10.</enum><header>Prohibition on certain United States Government agency contracts</header>
<subsection id="idb9cc0a5ecef84c12b2e54131322713bb"><enum>(a)</enum><header>Prohibition</header><text>The head of an executive agency may not enter into a contract for the procurement of goods or services with or for any of the following:</text> <paragraph id="id1b101b7247724d95aff2bd9e0d45e0dd"><enum>(1)</enum><text>Any person identified in the report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note).</text></paragraph>
<paragraph id="id52c8fbab572a48599d04b32f5479f1bb"><enum>(2)</enum><text>Any person that mined, produced, or manufactured goods, wares, articles, and merchandise detained and denied entry into the United States by U.S. Customs and Border Protection pursuant to section 3 of the Act entitled <quote>An Act to ensure that goods made with forced labor in the Xinjiang Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes</quote>, approved December 23, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) (commonly referred to as the <quote>Uyghur Forced Labor Prevention Act</quote>).</text></paragraph> <paragraph id="ida777f7dc925e4f8aa5fb428b365ba769"><enum>(3)</enum><text>Any person that the head of the executive agency determines, with the concurrence of the Secretary of State, facilitates the genocide and human rights abuses occurring in the Xinjiang Uyghur Autonomous Region of the People's Republic of China.</text></paragraph>
<paragraph id="idd49fdd6f6df64ac4af6d72f42b3e7dac"><enum>(4)</enum><text>Any person, program, project, or activity that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id92e72237c963404babdf54c2acffae93"><enum>(A)</enum><text display-inline="yes-display-inline">contributes to forced labor, particularly through the procurement of any goods, wares, articles, and merchandise mined, produced, or manufactured wholly, or in part, in the Xinjiang Uyghur Autonomous Region or by the forced labor of ethnic Uyghurs or other persecuted individuals or groups in the People’s Republic of China; or </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idaa35891d29a84f38ae9b40811d017b5a"><enum>(B)</enum><text display-inline="yes-display-inline">violates internationally recognized labor rights of individuals or groups in the People’s Republic of China.</text></subparagraph></paragraph></subsection> <subsection id="idbb2d34a351ea4dffac0c99df33642757"><enum>(b)</enum><header>Consultations</header><text>The head of each executive agency shall consult with the Forced Labor Enforcement Task Force, established under section 741 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4681">19 U.S.C. 4681</external-xref>), with respect to the implementation of subsection (a)(2).</text></subsection>
<subsection id="id4a3c29583c9c40c39cdf400766e7ae88"><enum>(c)</enum><header>Report required</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit a report on the implementation of this section to—</text> <paragraph commented="no" display-inline="no-display-inline" id="ida25b02db3db34693a1cdf4be5ef9c288"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Finance, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs of the Senate; and </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id077df524eb00460ab4cfb35f8bae4aae"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Ways and Means, the Committee on Foreign Affairs, and the Committee on Oversight and Accountability of the House of Representatives.</text></paragraph></subsection> <subsection id="id58a88d2675fb4a2c936a3402368be25f"><enum>(d)</enum><header>Executive agency defined</header><text>In this section, the term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></subsection></section>
<section id="id3248b68d692f4f718b34b4c74f29324e"><enum>11.</enum><header>Disclosures to Securities and Exchange Commission of certain activities related to Xinjiang Uyghur Autonomous Region</header>
<subsection id="id462fd095dc2743039e09cc398e2c87a5"><enum>(a)</enum><header>Amendment of requirements for applications To register on national securities exchanges</header><text>Section 12 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78l">15 U.S.C. 78l</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idef175e41106047b0a9f65e9356801433"> <subsection id="id091d003c20394daa8d07462b57cb8b86"><enum>(m)</enum><header>Reporting of certain activities relating to the Xinjiang Uyghur Autonomous Region</header> <paragraph id="idCAFA330FE36942BEB4431DCCFBE68267"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>covered entity</term> means any entity that is—</text>
<subparagraph id="id8D87F00835E647B583E0DC04420497FD"><enum>(A)</enum><text>engaged in providing technology or other assistance to create mass-population surveillance systems in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China;</text></subparagraph> <subparagraph id="id1BC12977D18B4BE7BA4527DF6580B7F5"><enum>(B)</enum><text>an entity operating in the People’s Republic of China that is on the Entity List maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations;</text></subparagraph>
<subparagraph id="id93CAD361405548FEAF8D449F814F2B74"><enum>(C)</enum><text>an individual residing in the People’s Republic of China or an entity operating in the People’s Republic of China that is on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury;</text></subparagraph> <subparagraph id="idEFDF4052913143278C7F2EB240EE7BE8"><enum>(D)</enum><text>constructing or operating detention facilities for Uyghurs in the Xinjiang Uyghur Autonomous Region;</text></subparagraph>
<subparagraph id="idABC0AEECC81A4F48A5E4E6D35A545A9B"><enum>(E)</enum><text>a foreign person identified in the report submitted under section 5(c) of the Act entitled <quote>An Act to ensure that goods made with forced labor in the Xinjiang Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes</quote>, approved December 23, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) (commonly referred to, and referred to in this subsection, as the <quote>Uyghur Forced Labor Prevention Act</quote>);</text></subparagraph> <subparagraph id="id29D4E9BC631D4E44801CE83088BBE1EC"><enum>(F)</enum><text>engaged in the <quote>pairing assistance</quote> program that subsidizes the establishment of manufacturing facilities in the Xinjiang Uyghur Autonomous Region;</text></subparagraph>
<subparagraph id="idBDEFC622DD2C45638C92D86BBEA6046A"><enum>(G)</enum><text>the Xinjiang Production and Construction Corps;</text></subparagraph> <subparagraph id="id8310A265867E4697A72608EB3E3F6AD7"><enum>(H)</enum><text>operating in the People’s Republic of China and producing goods subject to a withhold release order issued by U.S. Customs and Border Protection pursuant to section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>);</text></subparagraph>
<subparagraph id="id35FF70018EA540968253BAB0223D87A9"><enum>(I)</enum><text>on a list required by clause (i), (ii), (iv), or (v) of section 2(d)(2)(B) of the Uyghur Forced Labor Prevention Act;</text></subparagraph> <subparagraph id="id5B2B74EA1BDF46299766C57A5642F277"><enum>(J)</enum><text>any person the property and interests in property of which have been blocked, pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) or any other provision of law, for actions relating to the detention or abuse of Uyghurs and other predominantly Muslim ethnic groups in the Xinjiang Uyghur Autonomous Region;</text></subparagraph>
<subparagraph id="id91F50676D19E4E6D95A989FFD615E153"><enum>(K)</enum><text>an individual residing in the People’s Republic of China, or an entity operating in the People’s Republic of China, the property and interests in property of which have been blocked pursuant to section 1263 of the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10102">22 U.S.C. 10102</external-xref>);</text></subparagraph> <subparagraph id="idCE71327FCB174670A88764E0DB147922"><enum>(L)</enum><text>any person responsible for, or complicit in, the commission of atrocities in the Xinjiang Uyghur Autonomous Region; or</text></subparagraph>
<subparagraph id="idA288F0846C6C46638925DDE0964EFB46"><enum>(M)</enum><text>an affiliate of an entity described in any of subparagraphs (A) through (L).</text></subparagraph></paragraph> <paragraph id="id29f7c7c652fe46f3ad9c41bbaf11ff3b"><enum>(2)</enum><header>Issuance of rules</header><text>Not later than 180 days after the date of enactment of this subsection, the Commission shall issue rules—</text>
<subparagraph id="id0d2743f1fb7b416aab3f75535298b33b"><enum>(A)</enum><text>to require an issuer filing an application to register a security with a national securities exchange—</text> <clause id="id330e8c231bfe49029c6dcf6a41020a81"><enum>(i)</enum><text>to include in the application the documentation described in paragraph (3); and</text></clause>
<clause id="idc587b003c1fb4d19906024a5c6ba455c"><enum>(ii)</enum><text>to file the application and documentation with the Commission;</text></clause></subparagraph> <subparagraph id="idfdd4577fce9146a781014fa600536e1a"><enum>(B)</enum><text>to require an issuer to file a report with the Commission containing the documentation described in paragraph (3) if the securities of the issuer are not listed on a national securities exchange and merges with another issuer, the securities of which are listed on such an exchange; and</text></subparagraph>
<subparagraph id="id9378de1bb19d4d3bbda7d0b8e8664560"><enum>(C)</enum><text>to require an issuer filing a registration statement under subsection (g) to include with that statement the documentation described in paragraph (3).</text></subparagraph></paragraph> <paragraph id="id4e7f36d58e2f4a8e9129a5e1947e2aac"><enum>(3)</enum><header>Documentation required</header> <subparagraph commented="no" display-inline="no-display-inline" id="idea4440979cde415aa65fe566270ae441"><enum>(A)</enum><header display-inline="yes-display-inline">Significant transactions</header><text>With respect to an issuer, the documentation described in this paragraph is documentation showing that neither the issuer nor any affiliate of the issuer, directly or indirectly, has engaged in a significant transaction with a covered entity.</text></subparagraph>
<subparagraph id="idf7ff2ccf904142dfb14edf9c178641c1" commented="no"><enum>(B)</enum><header>Transparent documentation of supply chain links</header><text>In issuing rules under paragraph (2), in addition to the documentation required under subparagraph (A), the Commission shall also require an issuer to which those rules apply to document the name (in English and in the most commonly spoken language of the country in which the issuer is incorporated, if other than English) and address of, and sourcing quantities from, each smelter, refinery, farm, or manufacturing facility (as appropriate)—</text> <clause commented="no" display-inline="no-display-inline" id="id51b0eb11b270409fabe791aa8365619c"><enum>(i)</enum><text display-inline="yes-display-inline">with which the issuer has a business relationship; and </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id817c890685124e76b5c47b0816b0acfa"><enum>(ii)</enum><text display-inline="yes-display-inline">that is owned or operated by—</text> <subclause commented="no" display-inline="no-display-inline" id="id60b538485cf94c74978efdd585768736"><enum>(I)</enum><text display-inline="yes-display-inline"> a person located in the Xinjiang Uyghur Autonomous Region; or </text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="id36317c6f851a4e47b1b01b6c5160c53b"><enum>(II)</enum><text display-inline="yes-display-inline">a person working with the Government of the Xinjiang Uyghur Autonomous Region to recruit, transport, transfer, harbor, or receive labor of Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of the Xinjiang Uyghur Autonomous Region.</text></subclause></clause></subparagraph></paragraph> <paragraph id="idb2d66225c8d2420cbc956577a2c6bbfd"><enum>(4)</enum><header>Independent verification of documentation</header><text>In issuing rules under paragraph (1), the Commission shall—</text>
<subparagraph id="id83d0e8503fdf4a3e85f1e22eb6a06ab5"><enum>(A)</enum><text>require an issuer to obtain independent verification of the documentation described in paragraph (3) by a third-party auditor approved by the Commission, before the filing of an application, report, or registration statement containing the documentation; and</text></subparagraph> <subparagraph id="id87deec826a7c4b0d80f6124cfe1a9dfb"><enum>(B)</enum><text>require that the identity of the third-party auditor described in subparagraph (A) remain confidential.</text></subparagraph></paragraph>
<paragraph id="iddc8bff03801e4dbb88c46d6c36b10157"><enum>(5)</enum><header>Public availability of documentation</header><text>The Commission shall make all documentation received under this subsection available to the public.</text></paragraph> <paragraph id="id61b3a67170314aa5956e264e187fd21d"><enum>(6)</enum><header>Penalty</header><text>With respect to an application or report described in paragraph (2), if an issuer fails to comply with the requirements of this subsection (including any misrepresentation of the information described in paragraph (3))—</text>
<subparagraph id="idf58b68424df24167b395b9991d8e0892"><enum>(A)</enum><text>in the case of an application described in paragraph (2)(A)—</text> <clause id="idf3596f62f7604c2aba94651ab28a199f"><enum>(i)</enum><text>the applicable national securities exchange may not approve the application; and</text></clause>
<clause id="idc24e33de770046919796953e4c8db83d"><enum>(ii)</enum><text>the issuer may not refile the application for 1 year; and</text></clause></subparagraph> <subparagraph id="id6c0fabbd8cb4473aabe5abbbfc299d5a"><enum>(B)</enum><text>in the case of a report described in paragraph (1)(B) or a registration statement described in paragraph (1)(C)—</text>
<clause id="ide02b319d00fc454583ac6252e7fd24f3"><enum>(i)</enum><text>the President shall—</text> <subclause id="id77c34f8b36bb46b6a119e3064ebb8586"><enum>(I)</enum><text>make a determination with respect to whether—</text>
<item id="idfb3d8dc42e474b06bb7f2746c2efed3f"><enum>(aa)</enum><text>the Secretary of the Treasury should initiate an investigation with respect to the imposition of sanctions under the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10101">22 U.S.C. 10101 et seq.</external-xref>); or</text></item> <item id="id0f71f44500074f62be8f693f90baddc8"><enum>(bb)</enum><text>the Attorney General should initiate an investigation under any provision of law intended to hold accountable individuals or entities involved in the importation of goods produced using forced labor, including section 545, 1589, or 1761 of title 18, United States Code; and</text></item></subclause>
<subclause id="id912cd7647b29486fba6c2c8f28b79479"><enum>(II)</enum><text>not later than 180 days after initiating an investigation described in subclause (I), make a determination with respect to whether—</text> <item id="idb9e4ddf328dd46e69db8084f338d57ce"><enum>(aa)</enum><text>to impose sanctions under the Global Magnitsky Human Rights Accountability Act with respect to the issuer or affiliate of the issuer (as the case may be); or</text></item>
<item id="id80d6b9dde9c1479aadd40401d4a74f0f"><enum>(bb)</enum><text>to refer the case to the Department of Justice or another relevant Federal agency for further investigation.</text></item></subclause></clause></subparagraph></paragraph> <paragraph id="ida22db6e6eebf4363ada2ec6a5f055946"><enum>(7)</enum><header>Reports</header> <subparagraph id="idc457afb97364471eaeef7c04d870aecd"><enum>(A)</enum><header>Annual report to Congress</header><text>The Commission shall—</text>
<clause id="idac177a3ff0ba488dbc73b47d40da36b2"><enum>(i)</enum><text>conduct an annual assessment of the compliance of issuers with the requirements of this subsection; and</text></clause> <clause id="id234a138a12a04994a3030c484c26b9a4"><enum>(ii)</enum><text>submit to Congress a report containing the results of each assessment conducted under clause (i).</text></clause></subparagraph>
<subparagraph id="id386b5b6368fa4c8083dafc4ead10b232"><enum>(B)</enum><header>Government Accountability Office report</header><text>The Comptroller General of the United States shall periodically evaluate and report to Congress on the effectiveness of the oversight by the Commission of the requirements of this subsection.</text></subparagraph></paragraph> <paragraph id="id0875b49005f04fb1ac050dc622576726" commented="no"><enum>(8)</enum><header>Sunset</header><text>The provisions of this subsection shall terminate on the date that is 30 days after the date on which the President submits the determination described in section 6(2) of the Uyghur Forced Labor Prevention Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id63b6d87a2cae4736a9e930d08f408317"><enum>(b)</enum><header>Amendments of periodical reporting requirements for issuers on National Securities Exchanges</header><text>Section 13 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78m">15 U.S.C. 78m</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id11A6C40A99B04FFD9682B4FFEF83F5BF"> <subsection id="idbbbbed96e47b4f99b3fed1e3958d6966"><enum>(t)</enum><header>Disclosure of certain activities relating to Xinjiang Uyghur Autonomous Region of the People’s Republic of China</header> <paragraph id="id381ae3c39fa84b39a626e6ef36c912a5" commented="no"><enum>(1)</enum><header>In general</header><text>Each issuer required to file an annual or quarterly report under subsection (a) shall disclose in that report the information required by paragraph (2) if, during the period covered by the report, the issuer or any affiliate of the issuer engaged, directly or indirectly, in an activity (including through a business relationship, ownership interest, or other financial or personal interest) with a covered entity, as defined in section 12(m).</text></paragraph>
<paragraph id="idf3847e55b96e49feb97809d8f4e7b951" commented="no"><enum>(2)</enum><header>Information required</header><text>If an issuer or an affiliate of an issuer has engaged, directly or indirectly, in any activity described in paragraph (1), the issuer shall disclose a detailed description of each such activity, including—</text> <subparagraph id="idb141fad4b8864f68b33401735ed230cc" commented="no"><enum>(A)</enum><text>the nature and extent of the activity;</text></subparagraph>
<subparagraph id="id9af18a5c94a140c39c438cc3aea1d907" commented="no"><enum>(B)</enum><text>the gross revenues and net profits, if any, attributable to the activity; and</text></subparagraph> <subparagraph id="id78b76376daab429bab6df4c948e1908d" commented="no"><enum>(C)</enum><text>whether the issuer or the affiliate of the issuer (as the case may be) intends to continue the activity.</text></subparagraph></paragraph>
<paragraph id="idd8445768e0c14c5f9b0783b23df3ec14" commented="no"><enum>(3)</enum><header>Notice of disclosures</header><text>If an issuer reports under paragraph (1) that the issuer or an affiliate of the issuer has engaged in any activity described in that paragraph, the issuer shall separately file with the Commission, concurrently with the annual or quarterly report under subsection (a), a notice that the disclosure of that activity has been included in that annual or quarterly report that identifies the issuer and contains the information required under paragraph (2).</text></paragraph> <paragraph id="id99f86d51d39d4765932a51b28926f600" commented="no"><enum>(4)</enum><header>Public disclosure of information</header><text>Upon receiving a notice under paragraph (3) that an annual or quarterly report includes a disclosure of an activity described in paragraph (1), the Commission shall promptly—</text>
<subparagraph id="id3e085b1ee0a54fd7b844d96dbfb0c25b" commented="no"><enum>(A)</enum><text>transmit the report to—</text> <clause id="id7a4efc2c67e04a6cbf79a202e96db7c6" commented="no"><enum>(i)</enum><text>the President;</text></clause>
<clause id="ida8deee034fee4e5f97cfbc7748d2b73d" commented="no"><enum>(ii)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and </text></clause> <clause id="id6b7ac5aa32754e6bb1e83d5d96e7d9ae" commented="no"><enum>(iii)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives; and</text></clause></subparagraph>
<subparagraph id="id85e8dc1b0d874bd6be8fa6433a0b0869" commented="no"><enum>(B)</enum><text>make the information provided in the disclosure and the notice available to the public by posting the information on the internet website of the Commission.</text></subparagraph></paragraph> <paragraph id="idce516eebaeca40a091627a6f8828562b" commented="no"><enum>(5)</enum><header>Investigations</header><text>Upon receiving a report under paragraph (4) that includes a disclosure of an activity described in paragraph (1) by an issuer or an affiliate of the issuer, the President shall—</text>
<subparagraph id="id47ef1fc18bfb48409baedac2a0eb19a3" commented="no"><enum>(A)</enum><text>make a determination with respect to whether—</text> <clause commented="no" display-inline="no-display-inline" id="id45a67f52be2b48d8bc2debf957b020cd"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of the Treasury should initiate an investigation with respect to the imposition of sanctions under the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10101">22 U.S.C. 10101 et seq.</external-xref>); or </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id6c229f01a7da476fb1621cdd3de517aa"><enum>(ii)</enum><text display-inline="yes-display-inline">the Attorney General should initiate an investigation under any provision of law intended to hold accountable individuals or entities involved in the importation of goods produced using forced labor, including section 545, 1589, or 1761 of title 18, United States Code; and</text></clause></subparagraph> <subparagraph id="iddb26e28a2aa94dda9c75974f7cfc08c7" commented="no"><enum>(B)</enum><text>not later than 180 days after initiating such an investigation, make a determination with respect to whether—</text>
<clause commented="no" display-inline="no-display-inline" id="idf91c2cd800e54510aad4e6c0d0d05646"><enum>(i)</enum><text display-inline="yes-display-inline">to impose sanctions under the Global Magnitsky Human Rights Accountability Act with respect to the issuer or affiliate of the issuer (as the case may be); or </text></clause> <clause commented="no" display-inline="no-display-inline" id="idf29153f63890406a955b506023a819fb"><enum>(ii)</enum><text>to refer the case to the Department of Justice or another relevant Federal agency for further investigation.</text></clause></subparagraph></paragraph>
<paragraph id="iddd1e3b0717fd4de993bc49bb6fc42137" commented="no"><enum>(6)</enum><header>Sunset</header><text>The provisions of this subsection shall terminate on the date that is 30 days after the date on which the President submits the determination described in section 6(2) of the Act entitled <quote>An Act to ensure that goods made with forced labor in the Xinjiang Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes</quote>, approved December 23, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note).</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection> <subsection id="id2a61455211764aee9a60561c37968670" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to any application, registration statement, or report required to be filed with the Securities and Exchange Commission after the date that is 180 days after the date of enactment of this Act.</text></subsection></section>
