103 Stat. 169)—</text><paragraph commented="no" display-inline="no-display-inline" id="id28012c48dc134b55ab9673202127f667"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>As used in this Act, the following terms shall have the following meanings—</quote> and inserting <quote>In this Act:</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id881b14647eed4d5f8c4fdd4be95a12fa"><enum>(2)</enum><text>in each of paragraphs (1), (2), (4), and (5), by inserting a paragraph heading, the text of which comprises the term defined in that paragraph;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idedd02a4a4e3d4d65897ce5723f1c6647"><enum>(3)</enum><text>in paragraph (3), by inserting <quote><header-in-text style="OLC" level="paragraph">County; Clark County</header-in-text>.—</quote> before <quote>The term</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0542decd300745ab98a7775a5c8ad712"><enum>(4)</enum><text>in paragraph (6)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6adab01e976240d98c0613eff1252d86"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text style="OLC" level="paragraph">FLPMA terms</header-in-text>.—</quote> before <quote>All</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c232c4fe52b4a1cb5544fac4328253e"><enum>(B)</enum><text>by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>)</quote> before the period at the end;</text></subparagraph></paragraph><paragraph id="H2F78FDB0A43640069B054FACF189413C"><enum>(5)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), and (6) as paragraphs (7), (6), (4), (5), (2), and (8), respectively;</text></paragraph><paragraph id="H93259993511345409965864DC24864D6"><enum>(6)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB439C5FBFFC04B5A9AD7E8119199A503" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph id="H289422A3E4B84ABEA2BD188F4D4DE8E2"><enum>(1)</enum><header>Apex Industrial Park Owners Association</header><text display-inline="yes-display-inline">The term <term>Apex Industrial Park Owners Association</term> has the meaning given the term in the charter document for the entity entitled <quote>Apex Industrial Park Owners Association</quote>, which was formed on April 9, 2001, and any successor documents to the charter document, as on file with the Nevada Secretary of State.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45ba8ee0c812452f89568dd548427ff9"><enum>(7)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B053B2296FD459AA7CA10B44113568B" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph commented="no" display-inline="no-display-inline" id="id5675c8bdd93242bcba4a71068d191a37"><enum>(3)</enum><header>City</header><text>The term <quote>City</quote> means the city of North Las Vegas, Nevada.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb94e8644133b4c6793079ee4ec45c1b7"><enum>(b)</enum><header>Kerr-McGee site transfer</header><text>Section 3(b) of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 170) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbf327465d588445c91deeeca93b8fb3b"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence—</text><subparagraph id="HDE953790E93345A38B0602C3309888F1"><enum>(A)</enum><text>by striking <quote>Clark County for the connection</quote> and inserting <quote>Clark County, the City, and the Apex Industrial Park Owners Association, individually or jointly, as appropriate, for the connection</quote>;</text></subparagraph><subparagraph id="H9DAB9C2AA0F44C3FA1A71F1B76957927"><enum>(B)</enum><text>by striking <quote>Kerr-McGee Site</quote> and inserting <quote>Kerr-McGee Site and other land conveyed in accordance with this Act</quote>; and</text></subparagraph><subparagraph id="HEE31D1E97AAD44699930AE4F9B375865"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting <quote>(or any successor map prepared by the Secretary)</quote> after <quote>May 1989</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31fcd74d5d834ce7986272b995ebb08d"><enum>(2)</enum><text>in the third sentence, by inserting <quote>, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate,</quote> after <quote>Clark County</quote>.</text></paragraph></subsection><subsection id="H12A5D96A901C44E98031E6A3B7BDF80B"><enum>(c)</enum><header>Authorization for additional transfers</header><text>Section 4 of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 171)—</text><paragraph commented="no" display-inline="no-display-inline" id="id6768b7e33cb5425a9da1eb4469d0b251"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>Pursuant</quote> and all that follows through <quote>Clark County</quote> and inserting <quote>During any period in which the requirements of section 6 are met, pursuant to applicable law, the Secretary shall grant to Clark County, the City, and the Apex Industrial Park Owners Association</quote>; and</text></paragraph><paragraph id="H41D37FFCC2DD4C1D9E342FB5D5D47AD4"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb5e52e9f27634f93bce622ea59f56c58"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking the last sentence and inserting <quote>The withdrawal made by this subsection shall continue in perpetuity for all land transferred in accordance with this Act.</quote>; and</text></subparagraph><subparagraph id="H17FE37001A404E40AEF3C637513ED279"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id078E23BEB2294981AA66984B4E64EAC3" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph id="id5c8fde3beb0b4d76b59cf313bc314bd6" indent="up1"><enum>(3)</enum><header>Mineral materials sale</header><text display-inline="yes-display-inline">In the case of the sale of mineral materials resulting from grading, land balancing, or other activities on the surface of a parcel within the Apex Site for which the United States retains an interest in the minerals—</text><subparagraph commented="no" display-inline="no-display-inline" id="id27e93f161c0b4f57a61fac522c0f6e1d"><enum>(A)</enum><text>it shall be considered impracticable to obtain competition for purposes of section 3602.31(a)(2) of title 43, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Apex Area Technical Corrections Act</short-title>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f42094b1d754dcb82d607ef80fe17dc"><enum>(B)</enum><text>the sale shall be exempt from the quantity and term limitations imposed on noncompetitive sales under subpart 3602 of that title (as in effect on the date of enactment of the <short-title>Apex Area Technical Corrections Act</short-title>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HFD44E6CC1CCE40D389C9D88BF5C59C29"><enum>(d)</enum><header>Environmental considerations</header><text>Section 6 of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 173) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H9C15FE525267426F99DF67F4F9D86990" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><subsection id="H59FB9B8C7DD540E7B64449D74800548F"><enum>(d)</enum><header>Compliance with environmental assessments</header><text display-inline="yes-display-inline">Each transfer by the United States of land or interest in lands within the Apex Site or rights-of-way issued pursuant to this Act shall be conditioned on the compliance with applicable Federal land laws, including the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id8a1cc444-c63c-4482-97ed-a168d2f9284a" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Apex Project, Nevada Land Transfer and Authorization Act Amendments Act</short-title></quote>.</text></section><section id="id73602a74-ef4c-421e-ab1b-24ee2f4eab63" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Amendments to the Apex Project, Nevada Land Transfer and Authorization Act of 1989</header><subsection id="ida4625d39-9810-48ce-bfd0-0838e4433cfe"><enum>(a)</enum><header>Definitions</header><text>Section 2(b) of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 169) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0df601ad-c12b-465e-9b3a-98a6a35851a8"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>As used in this Act, the following terms shall have the following meanings—</quote> and inserting <quote>In this Act:</quote>; and </text></subparagraph><subparagraph id="idC4A98D4E31CB4A45827F7F9C56CD28F8"><enum>(B)</enum><text>by striking <quote>Site</quote> and inserting <quote>Site and other land conveyed in accordance with this Act</quote>; 103 Stat. 171) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id27bb8b3f-e42e-40b9-96a7-c99023258bc8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking “Clark County” and inserting “Clark County, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate,”; and</text></paragraph><paragraph id="id6bff6115-7550-4ede-8299-62c354233604"><enum>(2)</enum><text>in subsection (e), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB391CF2318DC4A07AA65495DEBF9A98D" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph id="id683b786b-9263-45f2-af4d-cc393bd6a273" indent="up1"><enum>(3)</enum><header>Mineral materials sale</header><text display-inline="yes-display-inline">Notwithstanding the requirements of part 3600 of title 43, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Apex Project, Nevada Land Transfer and Authorization Act Amendments Act</short-title>), the Secretary may sell, at not less than fair market value, without advertising or calling for bids and without regard to volume or time limitations, mineral materials resulting from grading, land balancing, or other activities on the surface of a parcel of land within the Apex Site for which the United States retains an interest in the minerals.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7e378de9-832e-4d2f-8cac-263fba46d014"><enum>(d)</enum><header>Environmental considerations</header><text>Section 6 of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>;
