which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Radiation Exposure Compensation Act to improve compensation for workers involved in uranium mining, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id44E49256D54C44B286542D9657931254"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title></quote>.</text></section><section id="HCE56A3F50AE24C88BEAD951C96CF2687"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to or repeal of a section or other provision of law, the reference shall be considered to be made to a section or other provision of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note).</text></section><section id="H8E6EDE9FE05542D5BC3E168789E7A6BA"><enum>3.</enum><header>Extension of fund</header><text display-inline="no-display-inline">Section 3(d) is amended—</text><paragraph id="H2DAD05C931294B88A4DAF361AEA84C00"><enum>(1)</enum><text>by striking the first sentence and inserting <quote>The Fund shall terminate 19 years after the date of the enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>.</quote>; and</text></paragraph><paragraph id="H53EF8986009C4BE68135FAF400B2999C" commented="no"><enum>(2)</enum><text>by striking <quote>2-year</quote> and inserting <quote>19-year</quote>.</text></paragraph></section><section id="HB0C12E4B7F63414F86B3B297BCFA56D"><enum>4.</enum><header>Claims relating to atmospheric testing</header><subsection id="id19FC0311184F4A4DBBE44805E4861840"><enum>(a)</enum><header>Leukemia claims relating to Trinity Test in New Mexico and tests at the Nevada site and in the Pacific</header><text>Section 4(a)(1)(A) is amended—</text><paragraph id="id2ACD4B1DBF5C46E3BEEA6809A3D63028"><enum>(1)</enum><text>in clause (i)—</text><subparagraph commented="no" id="id4CC9644C63194545A04559CD820A1270"><enum>(A)</enum><text>in subclause (I), by striking <quote>October 31, 1958</quote> and inserting <quote>November 6, 1962</quote>;</text></subparagraph><subparagraph id="id83C74FED28F34B668B0D03E96DC6024B"><enum>(B)</enum><text>in subclause (II)—</text><clause id="id6EEB1ACB5841423C96FA900258ED2F76"><enum>(i)</enum><text>by striking <quote>in the affected area</quote> and inserting <quote>in an affected area</quote>; and</text></clause><clause id="id53FBF73EC2EA47D4A84EEA5C94651456"><enum>(ii)</enum><text>by striking <quote>or</quote> after the semicolon;</text></clause></subparagraph><subparagraph id="idE06171A0024C4FBCA93DF16BA00F11C4"><enum>(C)</enum><text>by redesignating subclause (III) as subclause (V); and</text></subparagraph><subparagraph id="id1A0D760D3DA54D29999E0896D186E2DB"><enum>(D)</enum><text>by inserting after subclause (II) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2D3E3CB4F69E470495085B4ECFD4C374"><subclause id="id63D63BEFB93B4F608122EBA752E6E076" indent="up1"><enum>(III)</enum><text>was physically present in an affected area for a period of at least 1 year during the period beginning on September 24, 1944, and ending on November 6, 1962; </text></subclause><subclause id="id579C4BA999914FBE9B09BDB2B7215048" indent="up1"><enum>(IV)</enum><text>was physically present in an affected area—</text><item id="id37BDB7889FC9489CBC33758DB156B9D2"><enum>(aa)</enum><text>for a period of at least 1 year during the period beginning on July 1, 1946, and ending on November 6, 1962; or</text></item><item id="idD4038DFAAF574983904DA0EC40A58453"><enum>(bb)</enum><text>for the period beginning on April 25, 1962, and ending on November 6, 1962; or</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id420CB7E336824191827C12405B15C9A4"><enum>(2)</enum><text>in clause (ii)(I), by striking <quote>physical presence described in subclause (I) or (II) of clause (i) or onsite participation described in clause (i)(III)</quote> and inserting <quote>physical presence described in subclause (I), (II), (III), or (IV) of clause (i) or onsite participation described in clause (i)(V)</quote>.</text></paragraph></subsection><subsection id="HAF2BA007FC284C97B5A0FB57F4AE28DA"><enum>(b)</enum><header>Amounts for claims related to leukemia</header><text display-inline="yes-display-inline">Section 4(a)(1) is amended—</text><paragraph id="H886E9916959F4381A24278F119978DA2"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>an amount</quote> and inserting <quote>the amount</quote>; and</text></paragraph><paragraph id="HC7342494DC4E4984A20038B52CD43208"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAAFC933B6C3C4604B263DF47BEF988D8"><subparagraph id="H7DDEAF4E554B43D3B7A102001DE6EAC"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">If the conditions described in subparagraph (C) are met, an individual who is described in subparagraph (A) shall receive $150,000.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id626E48BBDF784862A87E5F0450F667FD"><enum>(c)</enum><header>Conditions for claims related to leukemia</header><text>Section 4(a)(1)(C) is amended—</text><paragraph id="id9C0FD1B065E94711B5E7E466A1BB7749"><enum>(1)</enum><text>by striking clause (i); and</text></paragraph><paragraph id="id3371909C84A14D38997C487280207A14"><enum>(2)</enum><text>by redesignating clauses (ii) and (iii) as clauses (i) and (ii), respectively.</text></paragraph></subsection><subsection id="id3EC86D602A3A4CDAB51A656B25FA637A"><enum>(d)</enum><header>Specified diseases claims relating to Trinity Test in New Mexico and tests at the Nevada site and in the Pacific</header><text>Section 4(a)(2) is amended—</text><paragraph id="id37E2B5A6F02C4475ABCC9FF8DB691458"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="id00482CADD5414218BDD17F4EDE94EDDF"><enum>(A)</enum><text>by striking <quote>in the affected area</quote> and inserting <quote>in an affected area</quote>; </text></subparagraph><subparagraph id="id4BF25F9EF4FA49B8A89227614F64FCA7"><enum>(B)</enum><text>by striking <quote>2 years</quote> and inserting <quote>1 year</quote>; and</text></subparagraph><subparagraph id="idD0AD71E6D67C43F5BF41C35F52939BDC"><enum>(C)</enum><text>by striking <quote>October 31, 1958</quote> and inserting <quote>November 6, 1962</quote>;</text></subparagraph></paragraph><paragraph id="idDCAA4FD70C994324A80075977956C29F"><enum>(2)</enum><text>in subparagraph (B)— </text><subparagraph id="idF8F66D0256264B07A69F76D0BA165270"><enum>(A)</enum><text>by striking <quote>in the affected area</quote> and inserting <quote>in an affected area</quote>; and</text></subparagraph><subparagraph id="id21E91DA905DA476FB93F84BF4CD328FF"><enum>(B)</enum><text>by striking <quote>or</quote> at the end;</text></subparagraph></paragraph><paragraph id="idCFDE359382F64A1B9E5BD474A4842273"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (E); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A63F779A1DE43A99D8AD08B8EFA3093"><enum>(4)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD2D81D5CD85D469589F0AE9031034F02"><subparagraph commented="no" display-inline="no-display-inline" id="id084E7A9648524A5E8E9344354634401E"><enum>(C)</enum><text display-inline="yes-display-inline">was physically present in an affected area for a period of at least 1 year during the period beginning on September 24, 1944, and ending on November 6, 1962; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF160297FE023496FB84D8262638BF9A2"><enum>(D)</enum><text display-inline="yes-display-inline">was physically present in an affected area—</text><clause commented="no" display-inline="no-display-inline" id="idB897766DEC8142F98BAD567A85600FEC"><enum>(i)</enum><text display-inline="yes-display-inline">for a period of at least 1 year during the period beginning on July 1, 1946, and ending on November 6, 1962; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6F95741D87AD487F9B35340CF0E7E9A3"><enum>(ii)</enum><text display-inline="yes-display-inline">for the period beginning on April 25, 1962, and ending on November 6, 1962; or</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H793A64A7656E4374A287AD11CC697590"><enum>(e)</enum><header>Amounts for claims related to specified diseases</header><text>Section 4(a)(2) is amended in the matter following subparagraph (E) (as redesignated by subsection (d) of this section) by striking <quote>$50,000 (in the case of an individual described in subparagraph (A) or (B)) or $75,000 (in the case of an individual described in subparagraph (C)),</quote> and inserting <quote>$150,000</quote>.</text></subsection><subsection display-inline="no-display-inline" id="HD6677E4A29CE4F73971CC0385D45D0E3"><enum>(f)</enum><header>Medical Benefits</header><text display-inline="yes-display-inline">Section 4(a) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB1C1F179A7954AD68690A4FCAFE13037"><paragraph id="H92B027CE93CD49C191297409D1D5053F"><enum>(5)</enum><header>Medical Benefits</header><text display-inline="yes-display-inline">An individual receiving a payment under this section shall be eligible to receive medical benefits in the same manner and to the same extent as an individual eligible to receive medical benefits under section 3629 of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384t">42 U.S.C. 7384t</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="H44E2C17AF5D040AA8FCD64ED16CF16B6"><enum>(g)</enum><header>Downwind States</header><text display-inline="yes-display-inline">Section 4(b)(1) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC2934CEFA9BC4C4697031196FE8538A0"><paragraph id="HC0F1D8C35F59494081CCFE900D2F6DE"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>affected area</quote> means—</text><subparagraph id="idBDDDEA8BED1042C49813823F153F6325"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided under subparagraphs (B) and (C), Arizona, Colorado, Idaho, Montana, Nevada, New Mexico, Utah, and Guam; </text></subparagraph><subparagraph id="id3EDB41F102644466ADF88ABB5986C461"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a claim by an individual under subsection (a)(1)(A)(i)(III) or subsection (a)(2)(C), only New Mexico; and</text></subparagraph><subparagraph id="id20F99B363DF5470BA2FE6AB96ADDAEFD"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to a claim by an individual under subsection (a)(1)(A)(i)(IV) or subsection (a)(2)(D), only Guam.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="idA853C144193C41019F364CD646498E94"><enum>(h)</enum><header>Chronic lymphocytic leukemia as a specified disease</header><text>Section 4(b)(2) is amended by striking <quote>other than chronic lymphocytic leukemia</quote> and inserting <quote>including chronic lymphocytic leukemia</quote>.</text></subsection></section><section id="H15EC6E94604849EF880094E09B529C00"><enum>5.</enum><header>Claims relating to uranium mining</header><subsection id="H6CFE5EA027FC4151AE7EE2F51E661450"><enum>(a)</enum><header>Employees of mines and mills</header><text>Section 5(a)(1)(A)(i) is amended—</text><paragraph commented="no" id="H35366FA61445414BB2FB692090C4E0C2"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(I)</quote> after <quote>(i)</quote>;</text></paragraph><paragraph id="HB62B26FF029544D3B1B4A0BE06CF5400"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>December 31, 1971; and</quote> and inserting <quote>December 31, 1990; or</quote>; and</text></paragraph><paragraph id="HE8FF677D71EB421ABC92BF7D0734E91"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2D239B603D8C4A1A9E00E30033002BA"><subclause id="HCDAB0AF36236440AB740DAC134786506" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">was employed as a core driller in a State referred to in subclause (I) during the period described in such subclause; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H00C9E2B60A034815828B081774AB665F"><enum>(b)</enum><header>Miners</header><text display-inline="yes-display-inline">Section 5(a)(1)(A)(ii)(I) is amended by inserting <quote>or renal cancer or any other chronic renal disease, including nephritis and kidney tubal tissue injury</quote> after <quote>nonmalignant respiratory disease</quote>.</text></subsection><subsection id="HBE027BF3E1F24ABE8F002E15ABD8C201"><enum>(c)</enum><header>Millers, core drillers, and ore transporters</header><text display-inline="yes-display-inline">Section 5(a)(1)(A)(ii)(II) is amended—</text><paragraph id="H96B93C284DCB4B34BB627700A8BFD00"><enum>(1)</enum><text>by inserting <quote>, core driller,</quote> after <quote>was a miller</quote>;</text></paragraph><paragraph id="idDA8A59AE657845428DFB982976E45BF3"><enum>(2)</enum><text>by inserting <quote>, or was involved in remediation efforts at such a uranium mine or uranium mill,</quote> after <quote>ore transporter</quote>;</text></paragraph><paragraph id="H8E51DF4DF03549B0814492A86E4F53F7"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting <quote>(I)</quote> after <quote>clause (i)</quote>; and</text></paragraph><paragraph id="H83496DAFF5CD460484046DD8CD28BF66"><enum>(4)</enum><text>by striking all that follows <quote>nonmalignant respiratory disease</quote> and inserting <quote>or renal cancer or any other chronic renal disease, including nephritis and kidney tubal tissue injury; or</quote>.</text></paragraph></subsection><subsection id="H0D50512E23BC45A88DBF5F769700E822"><enum>(d)</enum><header>Combined work histories</header><text display-inline="yes-display-inline">Section 5(a)(1)(A)(ii) is further amended—</text><paragraph display-inline="no-display-inline" id="H45E8AE856D5D4466BD4F9FF6D1471600"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of subclause (I); and</text></paragraph><paragraph id="H1ECD92FC0C984C5981005E8597F1BEB9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2B377FEA2C7940BBB5EF07C9C62CE279"><subclause id="H0B4E42A8C1AA44CD804399BA78CFD1DE" indent="up1"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="H9D745F7D28574828ACA8E630E5D4DEE8"><enum>(aa)</enum><text>does not meet the conditions of subclause (I) or (II);</text></item><item id="H76BFE125E0134C9BB5A8D454D78EC97" indent="up1"><enum>(bb)</enum><text>worked, during the period described in clause (i)(I), in two or more of the following positions: miner, miller, core driller, and ore transporter;</text></item><item id="HD543396746614AD78BD926736FDF54CC" indent="up1"><enum>(cc)</enum><text>meets the requirements of paragraph (4) or (5), or both; and</text></item><item id="HBD9DAADAD8A04D8AA099D68F87AF41B9" indent="up1"><enum>(dd)</enum><text>submits written medical documentation that the individual developed lung cancer or a nonmalignant respiratory disease or renal cancer or any other chronic renal disease, including nephritis and kidney tubal tissue injury after exposure to radiation through work in one or more of the positions referred to in item (bb);</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3817516E3A744AE2BFD2115D0217A0FF"><enum>(e)</enum><header>Dates of operation of uranium mine</header><text>Section 5(a)(2)(A) is amended by striking <quote>December 31, 1971</quote> and inserting <quote>December 31, 1990</quote>.</text></subsection><subsection id="H9BDFF1619886428EA744A2585E09169D"><enum>(f)</enum><header>Special rules relating to combined work histories</header><text>Section 5(a) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1F1EDD68F5B14E69B47CFD00151E2B56"><paragraph id="HAF2E8236509E4729905EF98178E3615B"><enum>(4)</enum><header>Special rule relating to combined work histories for individuals with at least one year of experience</header><text display-inline="yes-display-inline">An individual meets the requirements of this paragraph if the individual worked in one or more of the positions referred to in paragraph (1)(A)(ii)(III)(bb) for a period of at least one year during the period described in paragraph (1)(A)(i)(I).</text></paragraph><paragraph id="H708ACCCEBCD84CB0B4767655373CC582"><enum>(5)</enum><header>Special rule relating to combined work histories for miners</header><text display-inline="yes-display-inline">An individual meets the requirements of this paragraph if the individual, during the period described in paragraph (1)(A)(i)(I), worked as a miner and was exposed to such number of working level months that the Attorney General determines, when combined with the exposure of such individual to radiation through work as a miller, core driller, or ore transporter during the period described in paragraph (1)(A)(i)(I), results in such individual being exposed to a total level of radiation that is greater or equal to the level of exposure of an individual described in <internal-xref idref="HAF2E8236509E4729905EF98178E3615B" legis-path="(4)">paragraph (4)</internal-xref>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H13D91BEC4982414BBB4923465E5627A2"><enum>(g)</enum><header>Definition of Core driller</header><text>Section 5(b) is amended—</text><paragraph id="HFFA26DE35B72464CA169A1649B000038"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (7);</text></paragraph><paragraph id="H25587C1E114941E89D413C93CD91561F"><enum>(2)</enum><text>by striking the period at the end of paragraph (8) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H2B15A674B69A4B5596B3D78C80C12390"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D3298DED2B34EC19BE8187BAAE84F47"><paragraph id="HB9E219042C3248468214E922BC148DF4"><enum>(9)</enum><text display-inline="yes-display-inline">the term <term>core driller</term> means any individual employed to engage in the act or process of obtaining cylindrical rock samples of uranium or vanadium by means of a borehole drilling machine for the purpose of mining uranium or vanadium.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection></section><section id="H931EBAA8161140329541A02E8B38DF3B"><enum>6.</enum><header>Expansion of use of affidavits in determination of claims; regulations</header><subsection id="HD3C3E63985604CADBE2DCFE92C4FB630"><enum>(a)</enum><header>Affidavits</header><text display-inline="yes-display-inline">Section 6(b) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5426E362CB354B588B038DF2BD41353"><paragraph id="HA9D025AF3BB248F483B1A2B8575858E"><enum>(3)</enum><header>Affidavits</header><subparagraph id="HEEEFD382E2F54D13A2B48F2788CCF79E"><enum>(A)</enum><header>Employment History</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate the employment history of an individual as a miner, miller, core driller, or ore transporter if the affidavit—</text><clause id="H44218BE6E444474DAFE0D21186A26C00"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the employment history of the individual;</text></clause><clause display-inline="no-display-inline" id="HBDC2FB30A8AF4CBC97113ED6D85624EB"><enum>(ii)</enum><text>attests to the employment history of the individual;</text></clause><clause id="H4AEB9396B4C445F500A87F00A1BFDB03"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause><clause commented="no" id="H22442C9471DF491EBBC895A8624D821D"><enum>(iv)</enum><text display-inline="yes-display-inline">is made by a person other than the individual filing the claim.</text></clause></subparagraph><subparagraph id="HEA2F31B9421040EABBF698F3844474C"><enum>(B)</enum><header>Physical Presence in Affected Area</header><text display-inline="yes-display-inline">For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s physical presence in an affected area during a period described in section 4(a)(1)(A)(i) or section 4(a)(2) if the affidavit—</text><clause id="H4310F4CA168040FD9420314BEA8700D9"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s presence in an affected area during that time period;</text></clause><clause display-inline="no-display-inline" id="H98ACD2584EEF406F92F3C84D88ACD99"><enum>(ii)</enum><text display-inline="yes-display-inline">attests to the individual’s presence in an affected area during that period;</text></clause><clause display-inline="no-display-inline" id="H7A18FEEBEFAD4727B1F2BEA54C65DEB"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE44B2B7E244A40ECA1469CF8D45B717C"><enum>(iv)</enum><text display-inline="yes-display-inline">is made by a person other than the individual filing the claim.</text></clause></subparagraph><subparagraph id="HD771FEF1F4AC46D2AE73224B4E2235A6"><enum>(C)</enum><header>Participation at Testing Site</header><text display-inline="yes-display-inline">For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device if the affidavit—</text><clause display-inline="no-display-inline" id="HB30B55BC024C473F8D004086F9F76B00"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause><clause display-inline="no-display-inline" id="HBE98804E012C460382413B31145CA0A9"><enum>(ii)</enum><text display-inline="yes-display-inline">attests to the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause><clause display-inline="no-display-inline" id="H00E8529F239B4B00AEA0E8641037CD7F"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8BBAB28943FD4A1400EFD4FD005E4078"><enum>(iv)</enum><text display-inline="yes-display-inline">is made by a person other than the individual filing the claim.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7B5C22E5A8BE469C9AA7E6C65569F4D1"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 6 is amended—</text><paragraph id="idA26E296E9FC34FB1AC73AC4B957A3EF3"><enum>(1)</enum><text>in subsection (b)(2)(C), by striking <quote>section 4(a)(2)(C)</quote> and inserting <quote>section 4(a)(2)(E)</quote>;</text></paragraph><paragraph id="idEB9C3AB74C7844E5AA40FECE1072D0AC"><enum>(2)</enum><text>in subsection (c)(2)—</text><subparagraph id="id92527BB954D744A29640CDDA612566B6"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="idA363052D7DC440A2854C87CF5EB59E95"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), (a)(2)(C), or (a)(2)(D) of section 4</quote>; and</text></subparagraph></paragraph><paragraph id="id1E25F8489BFF4472AA7E3A4A04A01F46"><enum>(3)</enum><text>in subsection (e), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), (a)(2)(C), or (a)(2)(D) of section 4</quote>.</text></paragraph></subsection><subsection id="H16CBE7C2A733405E8DE6FF35977D4497"><enum>(c)</enum><header>Regulations</header><paragraph id="id25465190AD28431C82DB2F0C85EF9362"><enum>(1)</enum><header>In general</header><text>Section 6(k) is amended by adding at the end the following: <quote>Not later than 180 days after the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>, the Attorney General shall issue revised regulations to carry out this Act.</quote>.</text></paragraph><paragraph id="idD595869FB6A84CE3862FC9845789647C"><enum>(2)</enum><header>Considerations in revisions</header><text>In issuing revised regulations under section 6(k) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note), as amended under paragraph (1), the Attorney General shall ensure that procedures with respect to the submission and processing of claims under such Act take into account and make allowances for the law, tradition, and customs of Indian tribes, including by accepting as a record of proof of physical presence for a claimant a grazing permit, a homesite lease, a record of being a holder of a post office box, a letter from an elected leader of an Indian tribe, or a record of any recognized tribal association or organization. </text></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="HD25F3C859E634098AE2D13FB60F13F00"><enum>7.</enum><header>Limitation on claims</header><subsection id="H2E1477C072D0460A83127C2C408698B8" commented="no"><enum>(a)</enum><header>Extension of filing time</header><text>Section 8(a) is amended—</text><paragraph id="H8EE04975FA4045220000FEDFE93CFDB6" commented="no"><enum>(1)</enum><text>by striking <quote>2 years</quote> and inserting <quote>19 years</quote>; and</text></paragraph><paragraph id="H873B7FE36C2649CEABEA96B2D0F4B4CC" commented="no"><enum>(2)</enum><text>by striking <quote>2022</quote> and inserting <quote>2023</quote>.</text></paragraph></subsection><subsection id="HECF2BA1839DD4B6581727532F325EECA"><enum>(b)</enum><header>Resubmittal of claims</header><text>Section 8(b) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC5EE0CA9F17844E389F2E100728F942F"><subsection id="H6AFE0CE7A6B540458EDA6000BBFC7B3F"><enum>(b)</enum><header>Resubmittal of claims</header><paragraph id="H663CE3661C7F4C4281B4ED98E09AE27"><enum>(1)</enum><header>Denied claims</header><text display-inline="yes-display-inline">After the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>, any claimant who has been denied compensation under this Act may resubmit a claim for consideration by the Attorney General in accordance with this Act not more than three times. Any resubmittal made before the date of the enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title> shall not be applied to the limitation under the preceding sentence.</text></paragraph><paragraph id="H27FF2B5CF95245948BD0EAE5095FDDA7"><enum>(2)</enum><header>Previously successful claims</header><subparagraph id="H6761C104D75B487CBCD83E71996589EC"><enum>(A)</enum><header>In general</header><text>After the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>, any claimant who received compensation under this Act may submit a request to the Attorney General for additional compensation and benefits. Such request shall contain—</text><clause id="H7C08939A1E6C4416A05FB18800A200CB"><enum>(i)</enum><text>the claimant’s name, social security number, and date of birth;</text></clause><clause id="H70EC938871454679BFBA962229520235"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of award received under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>;</text></clause><clause id="H1507722215A843C7B875F9E5BB704B35"><enum>(iii)</enum><text display-inline="yes-display-inline">any additional benefits and compensation sought through such request; and</text></clause><clause id="H59100A1A6F364B6000C7067B04ADB598"><enum>(iv)</enum><text display-inline="yes-display-inline">any additional information required by the Attorney General.</text></clause></subparagraph><subparagraph id="H8FF724F7E23141BC879297C083429971"><enum>(B)</enum><header>Additional Compensation</header><text display-inline="yes-display-inline">If the claimant received compensation under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title> and submits a request under <internal-xref idref="H6761C104D75B487CBCD83E71996589EC" legis-path="(b)(2)(A)">subparagraph (A)</internal-xref>, the Attorney General shall—</text><clause id="H4D2F4F305641496F8F1BE8088904D67D"><enum>(i)</enum><text display-inline="yes-display-inline">pay the claimant the amount that is equal to any excess of—</text><subclause id="H6EE871781A7F453EB2477DCB461212D2"><enum>(I)</enum><text display-inline="yes-display-inline">the amount the claimant is eligible to receive under this Act (as amended by the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>); minus</text></subclause><subclause id="H5F02A8BB74D84FF4009D044C51C83C15"><enum>(II)</enum><text>the aggregate amount paid to the claimant under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2023</short-title>; and</text></subclause></clause><clause id="H413335DE815E4A92B73272C9F63D63E0"><enum>(ii)</enum><text>in any case in which the claimant was compensated under section 4, provide the claimant with medical benefits under section 4(a)(5).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id0EF091CAB7774C69AA5986CBC2EDE34B"><enum>8.</enum><header>Grant program on epidemiological impacts of uranium mining and milling</header><subsection id="id3B113F64B07F4A1C89375BE750E3B41F"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id4615179882B9406F8BECA19918672750"><enum>(1)</enum><text>the term <term>institution of higher education</term> has the meaning given under section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>);</text></paragraph><paragraph id="idA95BF23FEFAC42439094BAE3EB2C0AE4"><enum>(2)</enum><text>the term <term>program</term> means the grant program established under subsection (b); and</text></paragraph><paragraph id="id8DD5345064DC4543B9060E2AD7A82596"><enum>(3)</enum><text>the term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="idEA781614BBCC4516869CA6D55941FD70"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a grant program relating to the epidemiological impacts of uranium mining and milling. Grants awarded under the program shall be used for the study of the epidemiological impacts of uranium mining and milling among non-occupationally exposed individuals, including family members of uranium miners and millers.</text></subsection><subsection id="id56ABAF4037644732A7386068BC37B215"><enum>(c)</enum><header>Administration</header><text>The Secretary shall administer the program through the National Institute of Environmental Health Sciences.</text></subsection><subsection id="idAACBA58742634E5391846827AAE40C5B"><enum>(d)</enum><header>Eligibility and application</header><text>Any institution of higher education or nonprofit private entity shall be eligible to apply for a grant. To apply for a grant an eligible institution or entity shall submit to the Secretary an application at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection><subsection id="ID8F61DCA28AD140DFBD3B7672EC07DCC0"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2024 through 2026.</text></subsection></section><section id="id5A5141F3481743E98769E7F3F7FE71C2"><enum>9.</enum><header>Energy Employees Occupational Illness Compensation Program</header><subsection id="id90DB4DAC99F041E6B47374C3F70658ED"><enum>(a)</enum><header>Covered employees with cancer</header><text>Section 3621(9) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384l">42 U.S.C. 7384l(9)</external-xref>) is amended by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53DC8489021B4D35929E07769F412E4B"><subparagraph id="IDae0bf359912f46ffa0ed8af284c1b2a6"><enum>(A)</enum><text>An individual with a specified cancer who is a member of the Special Exposure Cohort, if and only if—</text><clause id="idA57C25E872574E2EAA5981B9E353019A"><enum>(i)</enum><text>that individual contracted that specified cancer after beginning employment at a Department of Energy facility (in the case of a Department of Energy employee or Department of Energy contractor employee) or at an atomic weapons employer facility (in the case of an atomic weapons employee); or</text></clause><clause id="idD58101D7D061489BACD05EB9D6157EF4"><enum>(ii)</enum><text>that individual—</text><subclause id="id88E39951A8184BC6AABFD931574972AC"><enum>(I)</enum><text>contracted that specified cancer after beginning employment in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, or any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3A7821534A5E4C019C9B84BB67DF0E1C"><enum>(II)</enum><text>was employed in a uranium mine or uranium mill described under subclause (I) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) at any time during the period beginning on January 1, 1942, and ending on December 31, 1990.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAAECEE5D56614139878A0102E61EC215"><enum>(b)</enum><header>Members of Special Exposure Cohort</header><text>Section 3626 of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384q">42 U.S.C. 7384q</external-xref>) is amended—</text><paragraph id="idE8954D447D1843A4B779EC3A6777D08F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE8941546D0F47158C4996D8412C9C6B"><paragraph id="id3132E2565A5D4300B634BA3FCD4E7B51"><enum>(1)</enum><text>The Advisory Board on Radiation and Worker Health under section 3624 shall advise the President whether there is a class of employees—</text><subparagraph id="id994EC2ABAD164CA994A030C459DBAC8F"><enum>(A)</enum><text>at any Department of Energy facility who likely were exposed to radiation at that facility but for whom it is not feasible to estimate with sufficient accuracy the radiation dose they received; and</text></subparagraph><subparagraph id="idD4E2393B35CF4AD0BE14FBDA5883634F"><enum>(B)</enum><text>employed in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, and any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act, at any time during the period beginning on January 1, 1942, and ending on December 31, 1990, who likely were exposed to radiation at that mine or mill but for whom it is not feasible to estimate with sufficient accuracy the radiation dose they received.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idD24847F04B7D494CB760AA1C0C49D8EF"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9988305770544E16872105BDCFA28283"><subsection id="ID30801204c3444f77a63e71d99131599a"><enum>(b)</enum><header>Designation of additional members</header><paragraph id="IDaf0737d8c97b4390a77a7aaa89fef95f"><enum>(1)</enum><text>Subject to the provisions of section 3621(14)(C), the members of a class of employees at a Department of Energy facility, or at an atomic weapons employer facility, may be treated as members of the Special Exposure Cohort for purposes of the compensation program if the President, upon recommendation of the Advisory Board on Radiation and Worker Health, determines that—</text><subparagraph id="IDf9aebdb627fa4c7590ad72b0a2dc3f2f"><enum>(A)</enum><text>it is not feasible to estimate with sufficient accuracy the radiation dose that the class received; and</text></subparagraph><subparagraph id="ID6a27f9b3342244c1b2673a53771a84ab"><enum>(B)</enum><text>there is a reasonable likelihood that such radiation dose may have endangered the health of members of the class.</text></subparagraph></paragraph><paragraph id="id7DE528C135234207B8396747D8CD83B0"><enum>(2)</enum><text>Subject to the provisions of section 3621(14)(C), the members of a class of employees employed in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, and any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act, at any time during the period beginning on January 1, 1942, and ending on December 31, 1990, may be treated as members of the Special Exposure Cohort for purposes of the compensation program if the President, upon recommendation of the Advisory Board on Radiation and Worker Health, determines that—</text><subparagraph id="id178021D4561542A8ACC81C8935B89919"><enum>(A)</enum><text>it is not feasible to estimate with sufficient accuracy the radiation dose that the class received;
