which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XVIII and XIX of the Social Security Act with respect to nursing facility requirements, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7F098994D3A24650A5762D1F6E05BEE7"><section section-type="section-one" id="HE7ABFDE3A1C64B9CA2E13A2247E4D1C9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Seniors’ Access to Quality Care Act</short-title></quote>.</text></section><section id="H4E746C3351294E38B9A6B79F241A141B"><enum>2.</enum><header>Training and competency evaluation programs</header><subsection id="H0E35BAF1220C4E9382BB395CEA6ABA40"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(f)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(2)</external-xref>) is amended—</text><paragraph id="H3F5F64138D15499AB92C8C8E48CC8F33"><enum>(1)</enum><text>in subparagraph (A)(iv)(I), by striking <quote>(unless the facility is described in subparagraph (B)(iii)(I))</quote>;</text></paragraph><paragraph id="H12B33FC9CBCE473C8AFFF0573290B922"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="HE0C95BB21A684639A51B4646C7A7B8D5"><enum>(A)</enum><text>in clause (i)—</text><clause id="H717E120F428C442F99970723DD8ACB3A"><enum>(i)</enum><text>by striking <quote>(subject to clause (iii))</quote>; and</text></clause><clause id="H660D9C4CFE9145F4BD4FD3EF767A9BB3"><enum>(ii)</enum><text>by inserting <quote>and</quote> after the semicolon;</text></clause></subparagraph><subparagraph id="H3882355C045E447AB1E6221BD2FA3834"><enum>(B)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a period; and</text></subparagraph><subparagraph id="H9C0827090F7F494788E91908F2244331"><enum>(C)</enum><text>by striking clause (iii);</text></subparagraph></paragraph><paragraph id="HBC89CCBF63324875ACBBAF6A9CBD64A0"><enum>(3)</enum><text>by striking <quote>A State may not delegate (through subcontract or otherwise) its responsibility under clause (iii)(II) to the skilled nursing facility.</quote>;</text></paragraph><paragraph id="HE665CA5B4F4948ADA2DBA8138B5C81CA"><enum>(4)</enum><text>by striking subparagraphs (C) and (D); and</text></paragraph><paragraph id="H8F201528907543FBA9BAB440C2D3ED21"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0AAB3622ED2F452FB450EA223C461C37"><subparagraph id="HF2B573E7A2CE44E3A296F15842FBAAC0"><enum>(C)</enum><header>Disapproval of nurse aide training and competency evaluation programs and nurse aide competency evaluation programs</header><clause id="HB41CE231C91D469C83EC823F2E9080CA"><enum>(i)</enum><header>In general</header><text>With respect to a State, the Secretary shall, in consultation with such State, disapprove, for a period not to exceed 2 years, a nurse aide training and competency evaluation program or a nurse aide competency evaluation program offered by or in a skilled nursing facility if such facility—</text><subclause id="H02DB32297EDE4A31946680BBE402FB6C"><enum>(I)</enum><text display-inline="yes-display-inline">has been assessed a civil monetary penalty under subsection (h)(2)(B)(ii) or section 1919(h)(2)(A)(ii) of not less than $10,697 for providing substandard quality of care; and</text></subclause><subclause id="HC149A5EAAD294C7C973B934FCD98B435"><enum>(II)</enum><text>has not, in the determination of the Secretary, corrected the deficiencies in quality of care for which such civil monetary penalty was assessed.</text></subclause></clause><clause commented="no" id="HF73D692120C548FF8C8F50FEC49EE3FA"><enum>(ii)</enum><header>Rescission of disapproval</header><text display-inline="yes-display-inline">The Secretary shall rescind a disapproval under clause (i) upon demonstration by a skilled nursing facility that—</text><subclause commented="no" id="id85412F3919B54878A73B0A874D566A0D"><enum>(I)</enum><text display-inline="yes-display-inline">all deficiencies for which the civil monetary penalty described in clause (i)(I) was assessed have been remedied;</text></subclause><subclause commented="no" id="id625521A8A0E24F2496AF9D87129E02D6"><enum>(II)</enum><text>the facility has not received deficiencies related to direct patient harm for substandard quality of care deficiencies in the prior 2 years; and</text></subclause><subclause commented="no" id="idE0B97BF4E2564C0F88749C46BA5A9B27"><enum>(III)</enum><text>the Secretary certifies that the civil monetary penalty assessed under clause (i)(I) did not result in immediate jeopardy for direct patient harm or injury related to an abuse or neglect deficiency.</text></subclause><continuation-text continuation-text-level="clause">For purposes of rescinding disapproval under this clause, the Secretary may require additional oversight of the skilled nursing facility for a period not to exceed the period of disapproval imposed under clause (i) with respect to such facility.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3272B782095543878D0CC2256AF9293B"><enum>(b)</enum><header>Medicaid</header><text>Section 1919(f)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(f)(2)</external-xref>) is amended—</text><paragraph id="H419C46206DCD4F8A8D25E6B900D91CD2"><enum>(1)</enum><text>in subparagraph (A)(iv)(I), by striking <quote>(unless the facility is described in subparagraph (B)(iii)(I))</quote>;</text></paragraph><paragraph id="H32558D79DBB2424AA3FF0A813B772C08"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph id="HE5A10A019A434249B3E9CB2627B80F78"><enum>(A)</enum><text>in clause (i), by inserting <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="H2B33F1EDD6F047A68E26BAABAF15A67C"><enum>(B)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a period;</text></subparagraph><subparagraph id="H7DECC8AA542E43B0999F522EB472C431"><enum>(C)</enum><text>by striking clause (iii); and</text></subparagraph><subparagraph id="H04F180D9FA904E46BE1B0C49CFA12411"><enum>(D)</enum><text>by striking <quote>A State may not delegate (through subcontract or otherwise) its responsibility under clause (iii)(II) to the nursing facility.</quote>;</text></subparagraph></paragraph><paragraph id="H5F99D9B63DC641DD83E7268ECB44AD5D"><enum>(3)</enum><text>by striking subparagraphs (C) and (D); and</text></paragraph><paragraph id="HE850D0833C5C484184A904A5A5329DED"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H79F32182CE10492AAA9625D53865640F"><subparagraph id="H72694A3C2A444B6BADC4A21E52229AD9"><enum>(C)</enum><header>Disapproval of nurse aide training and competency evaluation programs and nurse aide competency evaluation programs</header><clause id="HDF1ACE6B603249A7936B8044A288D746"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a State, the Secretary shall, in consultation with such State, disapprove, for a period not to exceed 2 years, a nurse aide training and competency evaluation program or a nurse aide competency evaluation program offered by or in a nursing facility if such facility—</text><subclause id="H3F5EDCA1E35344188F9D640745414C29"><enum>(I)</enum><text display-inline="yes-display-inline">has been assessed a civil monetary penalty under section 1819(h)(2)(B)(ii) or subsection (h)(2)(A)(ii) of not less than $10,697 for providing substandard quality of care; and</text></subclause><subclause id="H681D8A3A2F3F40D2A962DBADDA731C40"><enum>(II)</enum><text display-inline="yes-display-inline">has not, in the determination of the Secretary, corrected the deficiencies in quality of care for which such civil monetary penalty was assessed.</text></subclause></clause><clause commented="no" id="id0B2CC5BD1B774E1AB4930393FCB1B59F"><enum>(ii)</enum><header>Rescission of disapproval</header><text display-inline="yes-display-inline">The Secretary shall rescind a disapproval under clause (i) upon demonstration by a nursing facility that—</text><subclause commented="no" id="id1D83A8691B874BDA8C2968A04DD6F434"><enum>(I)</enum><text display-inline="yes-display-inline">all deficiencies for which the civil monetary penalty described in clause (i)(I) was assessed have been remedied;</text></subclause><subclause commented="no" id="id4203FFFB711449F58617B2A920ED4210"><enum>(II)</enum><text>the facility has not received deficiencies related to direct patient harm for substandard quality of care deficiencies in the prior 2 years; and</text></subclause><subclause commented="no" id="id9FB5FB1A95494ADFA4699A127E66ADFE"><enum>(III)</enum><text>the Secretary certifies that the civil monetary penalty assessed under clause (i)(I) did not result in immediate jeopardy for direct patient harm or injury related to an abuse or neglect deficiency.</text></subclause><continuation-text continuation-text-level="clause">For purposes of rescinding disapproval under this clause, the Secretary may require additional oversight of the nursing facility for a period not to exceed the period of disapproval imposed under clause (i) with respect to such facility.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDF3D7B5BCE1F46558A477AAA1C5723F5"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate regulations as necessary to implement the amendments made by this section.</text></subsection><subsection id="H263B33E299E04726BD62F9477165CAA0"><enum>(d)</enum><header>Applicability</header><paragraph id="H90E93047EF7345388900B33A0E8418E6"><enum>(1)</enum><header>In general</header><subparagraph id="H6F732434D66C4DE2B8004CE95BE84BE3"><enum>(A)</enum><header>Timing of determinations</header><text>The amendments made by subsections (a)(4) and (b)(4) of this section shall apply only to a civil monetary penalty if the relevant covered determination was made on or after the date of enactment of this Act.</text></subparagraph><subparagraph id="H362562126A60458C97245B98F43878F6"><enum>(B)</enum><header>Covered determination defined</header><text>The term <term>covered determination</term> means, with respect to a skilled nursing facility or a nursing facility in a State, a determination by the State or the Secretary of Health and Human Services that the facility has provided a substandard quality of care for which a civil monetary penalty described in section 1819(f)(2)(C)(i)(I) or 1919(f)(2)(C)(i)(I) of the Social Security Act (as such sections have been amended by this Act) may be assessed.</text></subparagraph></paragraph><paragraph id="HAC1223F059584FCF8045AEA5BCA83AE7"><enum>(2)</enum><header>Previously prohibited programs</header><subparagraph id="H93AB95484E374135BDF21C2CFD35CC16"><enum>(A)</enum><header>Waiver</header><text display-inline="yes-display-inline">With respect to a skilled nursing facility or a nursing facility subject, on the day before the date of enactment of this Act, to a prohibition under item (a) of either section 1819(f)(2)(B)(iii)(I) or section 1919(f)(2)(B)(iii)(I) of the Social Security Act (as in effect on the day before such date of enactment), such prohibition shall no longer apply to the facility on or after such date of enactment.</text></subparagraph><subparagraph id="H5FCCE6892708479D9E353C1BBA0D81E4"><enum>(B)</enum><header>Survey or civil monetary penalty</header><text display-inline="yes-display-inline">With respect to a skilled nursing facility or a nursing facility subject, on the day before the date of enactment of this Act, to a prohibition under item (b) or (c) of either section 1819(f)(2)(B)(iii)(I) or section 1919(f)(2)(B)(iii)(I) of the Social Security Act (as in effect on the day before such date of enactment), such prohibition shall no longer apply to the facility on or after such date of enactment upon a determination by the Secretary of Health and Human Services that the facility has corrected the issue that resulted in such prohibition.</text></subparagraph></paragraph></subsection></section><section id="idF3CCD6F319E54E08803CF0F002B2441D"><enum>3.</enum><header>Permitting Medicare and Medicaid providers to access the National Practitioner Data Bank to conduct employee background checks</header><text display-inline="no-display-inline">Section 1921(b)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-2">42 U.S.C. 1396r–2(b)(6)</external-xref>) is amended—</text><paragraph id="id9A5E57FEEB1B419D85981D3DC94A0585"><enum>(1)</enum><text>by striking <quote>and other health care entities (as defined in section 431 of the Health Care Quality Improvement Act of 1986)</quote> and inserting <quote>, other health care entities (as defined in section 431 of the Health Care Quality Improvement Act of 1986), providers of services (as defined in section 1861(u)), suppliers (as defined in section 1861(d)), and providers of items or services under a State plan under this title (or a waiver of such a plan)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21A526C9E8BF4B64BBCD70777B7A1481"><enum>(2)</enum><text>by striking <quote>such hospitals or other health care entities</quote> and inserting <quote>such hospitals, health care entities, providers, or suppliers</quote>.</text></paragraph></section></legis-body></bill>
