which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make the assault of a law enforcement officer a deportable offense, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8ED5EFDFF0614F5091337D2C9DD52A15"><section section-type="section-one" id="H3481792A0E584CA5A1305E0352A52E16"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Law enforcement with Immigration Control and Enforcement Act of 2023</short-title></quote> or the <quote><short-title>POLICE Act of 2023</short-title></quote>.</text></section><section id="H9172BFF027274D1590DB3982F7CBAA48"><enum>2.</enum><header>Assault of law enforcement officer</header><text display-inline="no-display-inline">Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H89D649233D104E09A48A7D7C6BDB47F2"><subparagraph id="H22BF763F3AB14BFAAC835B4131B21530"><enum>(G)</enum><header>Assault of law enforcement officers</header><clause commented="no" display-inline="no-display-inline" id="id8e84dda004f948078925d88b52fdc89c"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts constituting the essential elements of, and offense involving the assault of a law enforcement officer is deportable.</text></clause><clause commented="no" display-inline="no-display-inline" id="idd1a3710300f94d91b36db673938e1028"><enum>(ii)</enum><header>Circumstances</header><text display-inline="yes-display-inline">The circumstances referred to in clause (i) are that the law enforcement officer was assaulted—</text><subclause commented="no" display-inline="no-display-inline" id="id240cd4e903f64515943ed5f19f319534"><enum>(I)</enum><text display-inline="yes-display-inline">while he or she was engaged in the performance of his or her official duties;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id434ab64c53f64e01987f41490ce5cb44"><enum>(II)</enum><text display-inline="yes-display-inline">because of the performance of his or her official duties; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8fc97d2e13e242a1ba90d35733446945"><enum>(III)</enum><text display-inline="yes-display-inline">because of his or her station as a law enforcement officer.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf38cd4ae3d594d61a45f520617b9cbb1"><enum>(iii)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subparagraph—</text><subclause commented="no" display-inline="no-display-inline" id="id27fd6a56b8c045d4afc4ca815ffc97ed"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>assault</term> has the meaning given such term in the jurisdiction where the act occurred; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf9a2359b818f45838d7025f06b6d53b5"><enum>(II)</enum><text display-inline="yes-display-inline">the term <term>law enforcement officer</term> is a person authorized by law (in the jurisdiction where the act occurred)—</text><item commented="no" display-inline="no-display-inline" id="id71f053a7f5364fbbb744f9a980e45c13"><enum>(aa)</enum><text display-inline="yes-display-inline">to apprehend, arrest, or prosecute an individual for any criminal violation of law; or</text></item><item commented="no" display-inline="no-display-inline" id="ided4ff2c96ec64746af3c0080e1ad7499"><enum>(bb)</enum><text display-inline="yes-display-inline">to be a firefighter or other first responder.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
