<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 172</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230131">January 31, 2023</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To terminate any existing mask mandates imposed by the Federal Government, to prevent the implementation of new mask mandates, to preserve individual liberty, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Mask Mandates Act of 2023</short-title></quote>.</text></section><section id="idF0025E10CAEF4C81ADEEE82E98163F7F"><enum>2.</enum><header>Termination of face mask orders</header><subsection id="id18EB73DA794146DCBD4F6AB647006550"><enum>(a)</enum><header>Termination</header><text>Effective on the date of enactment of this Act, the following shall be void and have no force or effect:</text><paragraph id="id1db8c036675f4bffa39759138ab5894f"><enum>(1)</enum><text>Executive Order 13991 (86 Fed. Reg. 7045), issued on January 20, 2021.</text></paragraph><paragraph id="id25038364f86949a28335befea758eed1"><enum>(2)</enum><text>The order issued by the Centers for Disease Control and Prevention on January 29, 2021, pursuant to section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>), requiring persons to wear masks while on conveyances and at transportation hubs.</text></paragraph></subsection><subsection id="idA9E684EB44724854870C00B1BFE2CEF1"><enum>(b)</enum><header>No authority To issue subsequent orders</header><text>Notwithstanding any other provision of law, no Federal agency or office may issue an order requiring persons to wear face masks in response to COVID–19. </text></subsection><subsection id="id82EB74FD1EDB4C6BA4452FE0CB613D65"><enum>(c)</enum><header>No authority To issue mandates in response to a public health emergency</header><text>Section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id72AAF2B6F1FC46718572736D5B811939"><subsection id="id0FA6ABDB625E4CDB829ECDBFA36C1A47"><enum>(f)</enum><text>Nothing in this section authorizes the Secretary to require persons to wear face masks in response to a public health emergency declared under section 319.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6fc4252e299c45e1a71499dc0537b61f"><enum>3.</enum><header>Restrictions on the use of previously appropriated funds</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, no funds previously appropriated by Congress may be used by any executive agency or department of the United States to develop, implement, or otherwise enforce any Federal rule, regulation, or order requiring persons to wear masks in response to COVID–19. </text></section></legis-body></bill>
