which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit certain COVID–19 vaccination mandates for minors, and to require parental consent for COVID–19 vaccination of minors.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Rights Protection Act</short-title></quote>.</text></section><section id="idD3B631F4DA6C40DCAF64C530978A4116"><enum>2.</enum><header>Prohibitions against COVID–19 vaccination mandates for minors</header><subsection id="id0F4568F49FEA4A4F9DC2E20856659EC8"><enum>(a)</enum><header>Prohibition against mandates</header><text>Neither the Federal Government, nor any agency, grantee, payee, or recipient, including any State, local, Tribal, or territorial governmental entity (including any local educational agency, as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), that receives any Federal funds from the Department of Education or the Department of Health and Human Services may require or otherwise mandate that any individual age 18 or younger receive a COVID–19 vaccine.</text></subsection><subsection id="idF6B3DF025EAB4FAEA1679D59301E6F38"><enum>(b)</enum><header>Prohibition against school mandates</header><paragraph id="id6D7CBDC43CA743AE9C7C25D5A85B0AA2"><enum>(1)</enum><header>In General</header><text>A local educational agency (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) that imposes a mandate requiring any students age 18 or younger to receive a COVID–19 vaccine shall be subject to the penalty described in paragraph (2). </text></paragraph><paragraph id="idC4AE1F5EAD6E4A85B8A139DE8B984EC9"><enum>(2)</enum><header>Penalty</header><text>A local educational agency that imposes a mandate described in paragraph (1) shall not be eligible to receive funding under part A of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>) or under part A of title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611 et seq.</external-xref>) beginning on the later of—</text><subparagraph id="idEFE52A15ADC042DBBA4556FDAA079235"><enum>(A)</enum><text>the date of enactment of this Act; or </text></subparagraph><subparagraph id="idD8359948EF86477685B1CAD496E0FF7F"><enum>(B)</enum><text>the date on which such mandate becomes effective.</text></subparagraph></paragraph><paragraph id="id8EA619B721994AD8A9C1C90F5FEDEE90"><enum>(3)</enum><header>Resumed eligibility</header><text>If a local educational agency ends the mandate described in paragraph (1) that local educational agency shall become eligible to receive the funding described in paragraph (2) as of the date on which that mandate is no longer effective. </text></paragraph></subsection></section><section id="id067C3CF3EB444873A3D8A1B9D854DE42"><enum>3.</enum><header>Parental consent for vaccination of minors</header><text display-inline="no-display-inline">No COVID–19 vaccine may be administered to any individual age 18 or younger unless a parent, guardian, conservator, or attorney-in-fact of the minor provides prior, written, informed consent for the minor to receive such vaccine. </text></section><section id="id17F0DB4E46C14C5B8AD0CCA247443737"><enum>4.</enum><header>Applicable vaccines</header><text display-inline="no-display-inline">For purposes of sections 2 and 3, the term <term>COVID–19 vaccine</term> means any vaccine against COVID–19 that only received authorization by the Food and Drug Administration through an emergency use authorization pursuant to section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>), or that has received such authorization prior to receiving full approval or licensure under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) or section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>).</text></section></legis-body></bill>
