Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prioritize efforts of the Department of State to combat international trafficking in precursor chemicals and covered synthetic drugs with the Government of Mexico, to provide for the imposition of sanctions with respect to persons of the People's Republic of China contributing to international proliferation of illicit drugs or their means of production, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combatting Fentanyl Trafficking from China and Mexico Act</short-title></quote>.</text></section><section id="id115D25BE69AB4D139873926B01D4E58C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph commented="no" display-inline="no-display-inline" id="id5fa4dab216ee453e84d62fad6cc188c4"><enum>(1)</enum><header>Controlled substance; controlled substance analogue</header><text>The terms <term>controlled substance</term> and <term>controlled substance analogue</term> have the meanings given those terms in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id319290ce711e4bd99fabee2f1e214c59"><enum>(2)</enum><header>Covered synthetic drug</header><text>The term <term>covered synthetic drug</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1a6eb66cc440408ebad2b851695371a8"><enum>(A)</enum><text display-inline="yes-display-inline">a synthetic controlled substance or synthetic controlled substance analogue, including fentanyl or a fentanyl analogue; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92a36efbd0964e2a815fc6543633ff0d"><enum>(B)</enum><text display-inline="yes-display-inline">a new psychoactive substance. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c42d51f3dd8464ab3408e7e82d1d2a6"><enum>(3)</enum><header display-inline="yes-display-inline">Major drug-transit country; major illicit drug producing country</header><text>The terms <term>major drug-transit country</term> and <term>major illicit drug producing country</term> have the meanings given those terms in section 481(e) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291">22 U.S.C. 2291(e)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98cc3af4938c48bd9101812c0bcbd13e"><enum>(4)</enum><header display-inline="yes-display-inline">New psychoactive substance</header><text>The term <term>new psychoactive substance</term> means a substance of abuse, or any preparation thereof, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfce02ddbb4d74f968811597ffba2a777"><enum>(A)</enum><text display-inline="yes-display-inline"> is not—</text><clause commented="no" display-inline="no-display-inline" id="id15b87d085bfd416fb2cf6f8ef3a6ab2e"><enum>(i)</enum><text display-inline="yes-display-inline">included in any schedule as a controlled substance under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idfcf7d199ce144d029239302188f5b916"><enum>(ii)</enum><text display-inline="yes-display-inline">controlled by the Single Convention on Narcotic Drugs, done at New York March 30, 1961, or the Convention on Psychotropic Substances, done at Vienna February 21, 1971; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27b7cfa1863345f790b3e363d38c9878"><enum>(B)</enum><text display-inline="yes-display-inline">is new or has reemerged on the illicit market; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfccbcff8d0844d21a52a387643a710c6"><enum>(C)</enum><text display-inline="yes-display-inline">poses a threat to the public health and safety. </text></subparagraph></paragraph><paragraph id="id147B9E6977AC445186E2E0849E39F4BB" commented="no"><enum>(5)</enum><header>Precursor chemical</header><text>The term <term>precursor chemical</term> has the meaning given the term <term>listed chemical</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5fb563b7ef834bd29e7fb5a5246558eb"><enum>3.</enum><header>Prioritization of efforts of the Department of State to combat international trafficking in precursor chemicals and covered synthetic drugs with the Government of Mexico</header><subsection id="id0e0e10de1c0d4447974fe37df422db20"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall prioritize efforts of the Department of State to combat international trafficking of precursor chemicals and covered synthetic drugs by carrying out programs and activities that include the following: </text><paragraph id="id42dcfc7730624b12b12068ef8a942ba7"><enum>(1)</enum><text>Strengthening law enforcement capabilities, rule of law, and other security-related efforts to strengthen counterdrug institutions and initiatives outlined in the United States-Mexico Bicentennial Framework for Security, Public Health, and Safe Communities and the North American Drug Dialogue.</text></paragraph><paragraph id="id6a62faa85d7642ca90975fc7ec057284"><enum>(2)</enum><text>Strengthening joint bilateral efforts between the United States and Mexico to, among other issues—</text><subparagraph id="idCC42CE5FECF1420AA730AB208EB64E61"><enum>(A)</enum><text>combat covered synthetic drugs and the illicit production of other drugs; </text></subparagraph><subparagraph id="id59962B94E26D49B5ADC909217930C598"><enum>(B)</enum><text>better understand and reduce demand for drugs in the United States and Mexico; </text></subparagraph><subparagraph id="id51A70DE558E042BEABAD567ABAC7F970"><enum>(C)</enum><text>increase interdiction of precursor chemicals and covered synthetic drugs;</text></subparagraph><subparagraph id="id1951BDD31ACC487CBD3DB1E64769DC95"><enum>(D)</enum><text>pursue prosecutions of transnational criminal organizations and illicit financing of those organizations; and </text></subparagraph><subparagraph id="id899F62CD613A417B92AF23C95ED7BDDC"><enum>(E)</enum><text>reduce the number of illicit firearms crossing the border between the United States and Mexico.</text></subparagraph></paragraph><paragraph id="idcdb3a946ac374719b7a71a75757e9221"><enum>(3)</enum><text>Providing technical assistance and equipment, as appropriate, to strengthen the capacity of enforcement agencies of the Government of Mexico with respect to precursor chemicals and covered synthetic drugs. </text></paragraph></subsection><subsection id="id9303480637d74f02b9deb26006756e8e"><enum>(b)</enum><header>Report</header><paragraph id="id3e01871b312245a5909b9ef844089bbe"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report on the implementation of this section.</text></paragraph><paragraph id="id45dc6fdb5d8f480883d1507e0c38f943"><enum>(2)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text><subparagraph id="ided19f38e8145469891d709de92d2faa7"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="idbfcff4cfa20c465e91de75190e40db98"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives. </text></subparagraph></paragraph></subsection></section><section id="id5f1b868e1cb34ce98716bdfafc809fbf"><enum>4.</enum><header>Imposition of sanctions with respect to persons of the People's Republic of China contributing to international proliferation of illicit drugs or their means of production</header><subsection id="idd33e2c10c79c4ab0b963cc70433fc870"><enum>(a)</enum><header>In general</header><text>The President may impose any of the sanctions described in subsection (c) with respect to a foreign person described in subsection (b) that is determined by the President—</text><paragraph id="id91c7f2f35fe24e039a129adc4ded24dd"><enum>(1)</enum><text>to have engaged in, or attempted to engage in, activities or transactions that have materially contributed to, or pose a significant risk of materially contributing to, the international proliferation of illicit drugs or their means of production; </text></paragraph><paragraph id="id81a5be1a5d0d4bcd8db4bb42e91d4ce3"><enum>(2)</enum><text>to have knowingly received any property or interest in property that the foreign person knows—</text><subparagraph id="id456c6af442fa4d0b87cca080df04e91a"><enum>(A)</enum><text>constitutes or is derived from proceeds of activities or transactions described in paragraph (1); or</text></subparagraph><subparagraph id="id4c6b69a52ce54622aab8c81a8db18067"><enum>(B)</enum><text>was used or intended to be used to commit or to facilitate such activities or transactions;</text></subparagraph></paragraph><paragraph id="id62df40cf276946cc8ef17a7c1c15f94d"><enum>(3)</enum><text>to have provided, or attempted to provide, financial, material, or technological support for, or goods or services in support of—</text><subparagraph id="iddb50fd0dfeec4c2682864405a32471bb"><enum>(A)</enum><text>any activity or transaction described in paragraph (1); or</text></subparagraph><subparagraph id="idd1f5fbbe2c5346dc98c6e0abc837ef7e"><enum>(B)</enum><text>any sanctioned person;</text></subparagraph></paragraph><paragraph id="ide84839275b4c4463b352bdfdecb37475"><enum>(4)</enum><text>to be or have been a leader or official of any sanctioned person or of any foreign person described in subsection (b) that has engaged in any activity or transaction described in paragraph (1); or</text></paragraph><paragraph id="id7f127e34698c45529f18d339af621131"><enum>(5)</enum><text>to be owned, controlled, or directed by, or to have acted or purported to act for or on behalf of, directly or indirectly, any sanctioned person.</text></paragraph></subsection><subsection id="id8EB56023FA6442BDBC615963E79FA55C"><enum>(b)</enum><header>Foreign persons described</header><text>A foreign person described in this subsection is a foreign person that is—</text><paragraph id="idC04BB23349A64BE18A9158ED7AC5A269"><enum>(1)</enum><text>a citizen or national of the People's Republic of China, including the Hong Kong Special Administrative Region; or</text></paragraph><paragraph id="id627BDBD8E04E4E32B9FF22ADCF17B9B9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>an entity organized under the laws of the People's Republic of China (including the Hong Kong Special Administrative Region) or otherwise subject to the jurisdiction of the Government of the People's Republic of China. </text></paragraph></subsection><subsection id="id80E390776CAB4DA1BED62A13697AD20D"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="idbad41c1bef9b437ebbd0b208fb0196bf"><enum>(1)</enum><header>Blocking of property</header><text>The President may, pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), block and prohibit all transactions in property and interests in property of the sanctioned person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PH06AD34046A3E4775BEFEA8F77603855C"><enum>(2)</enum><header display-inline="yes-display-inline">Banking transactions</header><text display-inline="yes-display-inline">The President may prohibit any transfers of credit or payments between financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve any interest of the sanctioned person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PHE839607806344081A38D20CAFE4CF59A"><enum>(3)</enum><header display-inline="yes-display-inline">Loans from United States financial institutions</header><text display-inline="yes-display-inline">The President may prohibit any United States financial institution from making loans or providing credit to the sanctioned person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PHFB880DE1C08641F380A01D622592602E"><enum>(4)</enum><header display-inline="yes-display-inline">Foreign exchange transactions</header><text display-inline="yes-display-inline">The President may prohibit any transactions in foreign exchange that are subject to the jurisdiction of the United States and in which the sanctioned person has any interest.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PHC995E76A02A04E2F92C5DD5E2707679B"><enum>(5)</enum><header display-inline="yes-display-inline">Prohibition on investment in equity or debt of sanctioned person</header><text display-inline="yes-display-inline">The President may prohibit any United States person from investing in or purchasing significant amounts of equity or debt instruments of the sanctioned person.</text></paragraph><paragraph id="PH28648A2CB6BF4F0B87A1A4133D839C41"><enum>(6)</enum><header>Prohibitions on financial institutions</header><text>The President may direct that the following prohibitions be imposed with respect to a sanctioned person that is a financial institution:</text><subparagraph id="PH4E5A1826E80F4DF6ABBC920DA041547C"><enum>(A)</enum><header>Prohibition on designation as primary dealer</header><text>Neither the Board of Governors of the Federal Reserve System nor the Federal Reserve Bank of New York may designate, or permit the continuation of any prior designation of, the financial institution as a primary dealer in United States Government debt instruments.</text></subparagraph><subparagraph id="PH2168E4EDDAC641B2B8AE5E49E831DD8D"><enum>(B)</enum><header>Prohibition on service as a repository of government funds</header><text>The financial institution may not serve as agent of the United States Government or serve as repository for United States Government funds.</text></subparagraph></paragraph><paragraph id="PHFC7E2FBD7203400FB12B8A7CD263CF6A"><enum>(7)</enum><header>Procurement ban</header><text>The President may direct that the United States Government may not procure, or enter into any contract for the procurement of, any goods or services from the sanctioned person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PHAC9A3A2126D941F78A2C923E63F6E122"><enum>(8)</enum><header display-inline="yes-display-inline">Exclusion of corporate officers</header><text display-inline="yes-display-inline">The President may direct the Secretary of State to deny a visa to, and the Secretary of Homeland Security to exclude from the United States, any alien that the President determines is a leader, official, senior executive officer, or director of, or a shareholder with a controlling interest in, the sanctioned person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PH4B2F9E94468A4088ABE4DEBCFBBBAF94"><enum>(9)</enum><header display-inline="yes-display-inline">Sanctions on principal executive officers</header><text display-inline="yes-display-inline">The President may impose on the principal executive officer or officers of the sanctioned person, or on individuals performing similar functions and with similar authorities as such officer or officers, any of the sanctions described in paragraphs (1) through (8) that are applicable. </text></paragraph></subsection><subsection id="idB1A1E3A1010D4AA4AFD1DCF8761CDB76"><enum>(d)</enum><header>Inadmissibility of certain sanctioned persons</header><paragraph id="idff7b747c5a2049eb865cf8c4c52eabd6"><enum>(1)</enum><header>Visas, admission, or parole</header><text>Except as provided by paragraph (3), an alien with respect to whom the President imposed sanctions under paragraph (1) or (8) of subsection (c) shall be—</text><subparagraph id="id75a2bc7d8a974e3daee749f2ecdae0c3"><enum>(A)</enum><text>inadmissible to the United States;</text></subparagraph><subparagraph id="idb598b6ae4df4432792f6ddcf0001a0dd"><enum>(B)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></subparagraph><subparagraph id="idb8a7c60d37c64a1da0ce9704d8a69218"><enum>(C)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id58f6873bf5c24e2d80d1040a958767ce"><enum>(2)</enum><header>Current visas revoked</header><subparagraph id="idea44dad2dbc44f19b9f6755e0d9a4456"><enum>(A)</enum><header>In general</header><text>The visa or other entry documentation of any alien described in paragraph (1) is subject to revocation regardless of the date on which the visa or other entry documentation is or was issued.</text></subparagraph><subparagraph id="iddfb9474b213d4d3d8cc0157ff9782df1"><enum>(B)</enum><header>Immediate effect</header><text>A revocation under subparagraph (A) shall—</text><clause id="idc2167789459e4a52af3ec28f877d0719"><enum>(i)</enum><text>take effect immediately; and</text></clause><clause id="idb1b18e57367c41beadea11d63c9c6467"><enum>(ii)</enum><text>cancel any other valid visa or entry documentation that is in the possession of the alien.</text></clause></subparagraph></paragraph><paragraph id="id97E572D00BBD4F36A1D6220AD03D5121"><enum>(3)</enum><header>Exceptions</header><text>Paragraphs (1) and (2) shall not apply with respect to the admission of an alien described in paragraph (1) if the President determines that the admission of the alien would not be contrary to the interests of the United States, including if the President determines that the admission of the alien would further important United States law enforcement objectives.</text></paragraph></subsection><subsection id="idcb3d9670685a4786bac22a34c221358b"><enum>(e)</enum><header>Implementation; penalties</header><paragraph id="id6272aed3e7fe410abc3653a0f27b116f"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></paragraph><paragraph id="id61e1a2e87e094b999c6af930b65161ea"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></paragraph></subsection><subsection id="idE71990C0218949AB9002268D02520EE4"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0053c98c9d284711a555cd66b9c9b872"><enum>(1)</enum><header>Admission; admitted; alien; lawfully admitted for permanent residence; national</header><text>The terms <term>admission</term>, <term>admitted</term>, <term>alien</term>, <term>lawfully admitted for permanent residence</term>, and <term>national</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="id7149e32f98a64740a69e8804002bd8cc"><enum>(2)</enum><header>Entity</header><text>The term <term>entity</term> means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization. </text></paragraph><paragraph id="id5e510413659f42b0bfbad3913b013907"><enum>(3)</enum><header>Financial institution</header><text>The term <term>financial institution</term> includes—</text><subparagraph id="idC2043EA64DDB473AADA8267CBE3D0E50"><enum>(A)</enum><text>a depository institution (as defined in section 3(c)(1) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(c)(1)</external-xref>)), including a branch or agency of a foreign bank (as defined in section 1(b)(7) of the International Banking Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3101">12 U.S.C. 3101(7)</external-xref>)); </text></subparagraph><subparagraph id="id901FCD59434F4B34BCB2E3081ED1F667"><enum>(B)</enum><text>a credit union; </text></subparagraph><subparagraph id="id8EFBA5B14F8C477FB98421F68C679E58"><enum>(C)</enum><text>a securities firm, including a broker or dealer; </text></subparagraph><subparagraph id="idD92AA75FE9874E50A7FB01A408952AB2"><enum>(D)</enum><text>an insurance company, including an agency or underwriter; and </text></subparagraph><subparagraph id="id7D6B36BE881A4B6F9A63FFEBE58F9B1E"><enum>(E)</enum><text>any other entity that provides financial services.</text></subparagraph></paragraph><paragraph id="idbad6b6d119954cb8b1c0a7372e0aef6b"><enum>(4)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means—</text><subparagraph id="idAD60AFDC69C448FEA922A2E28C949DE7"><enum>(A)</enum><text>any citizen or national of a foreign country (including any such individual who is also a citizen or national of the United States, if the individual does not reside in the United States); or </text></subparagraph><subparagraph id="idB4A139AF80D5419C96E453AED7585474"><enum>(B)</enum><text>any entity not organized under the laws of the United States or of any jurisdiction within the United States.</text></subparagraph></paragraph><paragraph id="id31DBB75F137E4C64BBF5CC02E863F920"><enum>(5)</enum><header>Knowingly; knows</header><text>The terms <term>knowingly</term> and <term>knows</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph><paragraph id="idcb09bdcdc438433d8d0055a1b5e6c6a9"><enum>(6)</enum><header>Means of production</header><text>The terms <term>means of production</term> includes any activities or transactions involving any equipment, chemical, product, or material that may be used, directly or indirectly, in the manufacture of illicit drugs or precursor chemicals.</text></paragraph><paragraph id="id26a82c988655410f92f09a634aa084b2"><enum>(7)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="id814e48a7ec2d494fa2baacedba70ac1d"><enum>(8)</enum><header>Proliferation of illicit drugs</header><text>The term <term>proliferation of illicit drugs</term> means any illicit activity to produce, manufacture, distribute, sell, or knowingly finance or transport narcotic drugs, controlled substances, listed chemicals, or controlled substance analogues, as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="id53af765ee124478ab9c197f5b94c97e3"><enum>(9)</enum><header>Sanctioned person</header><text>The term <term>sanctioned person</term> means any person with respect to which sanctions are imposed under this section.</text></paragraph><paragraph id="id97f5d588a76549b69e6cad9bb25570dd"><enum>(10)</enum><header>United States financial institution</header><text>The term <term>United States financial institution</term> means a financial institution (including its foreign branches)—</text><subparagraph id="idB344A1DE31CF47478D6A8E1F6DF8685A"><enum>(A)</enum><text>organized under the laws of the United States or of any jurisdiction within the United States; or </text></subparagraph><subparagraph id="idDB9A4248A7CD44D7B1C353385900439A"><enum>(B)</enum><text>located in the United States.</text></subparagraph></paragraph><paragraph id="id7d876c81a63a49949e5304b10c4fd3bd"><enum>(11)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id653c7219fc454477a4f5c3c7d4ea03ad"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="id540226f48d8e407aace6a94b6c6dea58"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="id42b4c55903634d318314a021b4fdb5ce" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection></section><section id="ide345ff1609a74d51a8adfb9f539bcd22"><enum>5.</enum><header>Authorization to terminate certain sanctions and export control measures if the Government of the People's Republic of China takes certain counternarcotics measures</header><subsection id="id927D0B2C2FC846F48C507A998E283734"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the President makes the determination described in subsection (b), the President may—</text><paragraph id="idE481B85A1CA24E89B42C304369F1BCAD"><enum>(1)</enum><text display-inline="yes-display-inline">terminate the application of sanctions imposed with respect to persons of the People's Republic of China under section 2 or Executive Order 14059 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to imposing sanctions on foreign persons involved in the global illicit drug trade); and</text></paragraph><paragraph id="idAC71D45618184870B4DA9A6E8983C1F7"><enum>(2)</enum><text>remove such persons from the Entity List maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 4 to part 744 of title 14, Code of Federal Regulations.</text></paragraph></subsection><subsection id="id435E62A55CDA496A891E51AC8E9310D4"><enum>(b)</enum><header>Certification described</header><text>A determination described in this subsection is a determination that, during the 12 months preceding the determination, the Government of the People's Republic of China made substantial efforts—</text><paragraph id="id120483A638924858824E2A93CF3FAAE2"><enum>(1)</enum><text display-inline="yes-display-inline">to adhere to its obligations under international counternarcotics agreements; and </text></paragraph><paragraph id="idECA0129BD77845F78122D073DBE42F55" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to take the counternarcotics measures described in section 489(a)(1) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291h">22 U.S.C. 2291h(a)(1)</external-xref>). </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id54413678F0AB4C769B4EA6177436742A"><enum>(c)</enum><header>Person of the People's Republic of China defined</header><text>In this section, the term <term>person of the People's Republic of China</term> means—</text><paragraph id="id42059d335ee44d56a54db73995efcb69"><enum>(1)</enum><text>an individual who is a citizen or national of the People's Republic of China; or</text></paragraph><paragraph id="ideca76f0bd7c845138fac66ba2b9456d1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>an entity organized under the laws of the People's Republic of China or otherwise subject to the jurisdiction of the Government of the People's Republic of China. </text></paragraph></subsection></section><section id="id469529EA4FE143F3B49456CAC320BF1C" section-type="subsequent-section"><enum>6.</enum><header>Reports on airports, ports, and States in Mexico that are major transit sites for precursor chemicals or covered synthetic drugs</header><subsection id="id4EE321B2065E45F1B65BC04DFF9B3110"><enum>(a)</enum><header>Reports</header><text>Not later than 90 days after any date on which the President identifies Mexico as a major drug-transit country or major illicit drug producing country under section 706(1) of the Foreign Relations Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j-1">22 U.S.C. 2291j–1(1)</external-xref>), the President shall submit to the appropriate congressional committees a report identifying—</text><paragraph id="idb1606a3862604244a78bbf3afc654f44"><enum>(1)</enum><text>each airport and maritime port in Mexico that serves as a major transit site or major producing site of precursor chemicals or covered synthetic drugs; and</text></paragraph><paragraph id="id3f80ffc3c91d4f4fbddbd2653e4ac003"><enum>(2)</enum><text>each State in Mexico that serves as a major transit State or major producing State of precursor chemicals or covered synthetic drugs.</text></paragraph></subsection><subsection id="id3b5e58e3d9db4f2d9cbbb50d46982018"><enum>(b)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id24D5251F45EF429EBCAD0EE45FBAB8A7"><enum>(1)</enum><text>the Committee on Foreign Relations of the Senate; and </text></paragraph><paragraph id="id543C67CF89A643679AA2C06D989144C4"><enum>(2)</enum><text>the Committee on Foreign Affairs of the House of Representatives.</text></paragraph></subsection></section><section commented="no" id="idD25ECED0F3E44C2FB463DBBEF1D2E5F4"><enum>7.</enum><header>Authorization of appropriations</header><subsection id="id87216c888eb342d5a7bd39a8349f0702"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="idfb2122c8fa3c41a09f15e401ef8d02d8"><enum>(1)</enum><header display-inline="yes-display-inline">International Narcotics and Law Enforcement</header><text>There is authorized to be appropriated to the Secretary of State, for each of fiscal years 2024 through 2027, $100,000,000 for International Narcotics and Law Enforcement for Mexico.</text></paragraph><paragraph id="id90117eb1d9f04e40af0c8f6c11aa5d99"><enum>(2)</enum><header>Gun trafficking</header><text>There is authorized to be appropriated to U.S. Customs and Border Protection, for each of fiscal years 2024 through 2027, in addition to amounts otherwise made available for such purposes, $50,000,000, which shall be used—</text><subparagraph id="idB06BAA1011C24A399A0686A12C8428DF"><enum>(A)</enum><text>to interdict the outbound flow of smuggled firearms and illicit currency that facilitate the activities of transnational criminal organizations; and </text></subparagraph><subparagraph id="id825DA79053FF496F9F7F825A441F1848" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>to increase the number of weapons and the amount of currency being seized from individuals attempting to smuggle such firearms and currency from the United States to Mexico. </text></subparagraph></paragraph><paragraph id="id531483172bdd4e6ca8d47466517e4286"><enum>(3)</enum><header>Transnational Criminal Investigative Unit</header><text>There is authorized to be appropriated to the Homeland Security Investigations, for the period of fiscal years 2024 through 2027, $2,500,000, which shall be used to pay vetted members of a Transnational Criminal Investigative Unit in Mexico a monetary stipend in accordance with section 890C(d) of the Homeland Security Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/6/475">6 U.S.C. 475(d)</external-xref>), as added by the Transnational Criminal Investigative Unit Stipend Act (section 7105 of <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc082925e28884d528948c68082a87d79"><enum>(b)</enum><header>Limitation on use of funds</header><text>None of the amounts authorized to be appropriated under subsection (a) may be obligated or expended until the Secretary of State certifies and reports to Congress that the Government of Mexico is taking sustained and effective steps—</text><paragraph commented="no" display-inline="no-display-inline" id="idc6e220cf68504876b269f17fdb73eeb1"><enum>(1)</enum><text display-inline="yes-display-inline">to increase bilateral law enforcement cooperation with the United States to counter precursor chemicals and covered synthetic drugs, including steps—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfbf21cd02e4045049235f3400ab5f223"><enum>(A)</enum><text display-inline="yes-display-inline">to identify laboratories of covered synthetic drugs and illicit production sites of those drugs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id672fd8f60d794c6993bff32033927485"><enum>(B)</enum><text display-inline="yes-display-inline">to identify routes used to transit precursor chemicals and covered synthetic drugs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idff964b3f2f5942aaaba4ad50ea29ca64"><enum>(C)</enum><text display-inline="yes-display-inline">to increase interdiction of precursor chemicals and covered synthetic drugs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77a28d8410734ad38961b054967ffbe7"><enum>(D)</enum><text>to share samples of seized precursor chemicals and covered synthetic drugs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa7a8bc21e554753a6e7d90302540a0d"><enum>(E)</enum><text>to pursue prosecutions of transnational criminal organizations and illicit financing of those organizations; and</text></subparagraph></paragraph><paragraph id="id83DE4B1EC51E48B8BBED28FD550F0E0B" commented="no"><enum>(2)</enum><text>to increase cooperation in multilateral fora to address precursor chemicals and covered synthetic drugs, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ff1c44ae7cf46699b71c3e8de5a8723"><enum>(A)</enum><text display-inline="yes-display-inline">the United Nations Commission on Narcotic Drugs; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2405c43cba68427e9e94d82ac4f79bd4"><enum>(B)</enum><text display-inline="yes-display-inline">the World Health Organization Expert Committee on Drug Dependence; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2bacbf3e1c5948e188c605bffeea0d3b"><enum>(C)</enum><text display-inline="yes-display-inline">the International Narcotics Control Board; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide797c248a5164dd1a5dfda22a8c5d9ee"><enum>(D)</enum><text display-inline="yes-display-inline">the United Nations Office on Drugs and Crime. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
