<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 165</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230131">January 31, 2023</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S399">Mr. Hawley</cosponsor>, and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of Federal and local funds to impose or enforce a COVID–19 vaccine mandate in District of Columbia schools, and to repeal the Coronavirus Immunization of School Students and Early Childhood Workers Regulation Amendment Act of 2021 enacted by the District of Columbia Council.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id3df2f642f95c4ecca195334d83e5294f" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let Them Learn Act</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Prohibition on use of Federal and local funds to impose or enforce COVID–19 vaccine mandate in District of Columbia schools</header><subsection id="idEB3B4AA786504BEAB1BF65949B321088"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idCC9EEA73C6584A6BB5A7B3A5BF4BC99D"><enum>(1)</enum><header>Covered school</header><text>The term <term>covered school</term> means an elementary school or a secondary school, as those terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), in the District of Columbia.</text></paragraph><paragraph id="idD924F4D15F43494DAB1589F287250A58"><enum>(2)</enum><header>COVID–19 vaccine</header><text>The term <term>COVID–19 vaccine</term> means any vaccine for the prevention of Coronavirus Disease 2019 (COVID–19) caused by severe acute respiratory syndrome coronavirus 2 (SARS–CoV–2) that is approved under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) or section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) or authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>).</text></paragraph></subsection><subsection id="idE74767ED5E214F61A4371F854E097D4E"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No Federal or local funds may be used by the District of Columbia or a covered school to impose or enforce a COVID–19 vaccine requirement on a student in connection with enrollment by the student in a covered school, including any requirement that a student receive a COVID–19 vaccine in order to be able to attend in-person classroom instruction or participate in any school-related activity on or off campus, including an athletic or academic competition.</text></subsection></section><section id="id6BDA3F4A2A354C1DAAB99ECBD20F10AD"><enum>3.</enum><header>Repeal of Coronavirus Immunization of School Students and Early Childhood Workers Regulation Amendment Act of 2021</header><text display-inline="no-display-inline">The Coronavirus Immunization of School Students and Early Childhood Workers Regulation Amendment Act of 2021 (D.C. Law 24–85), enacted by the District of Columbia Council on January 12, 2022, and effective on March 2, 2022, shall have no force or effect.</text></section></legis-body></bill>
