<external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) made by section 102(a).</text></paragraph><paragraph id="HCE690857EFA842208C88903A9C090778"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="H8FF0E3176F3E404F9734146D57A7B7C2"><enum>(3)</enum><header>Wildlife conservation area</header><text>The term <term>Wildlife Conservation Area</term> means, as applicable—</text><subparagraph id="HFFD4DCFD0D3A4F7AB54B98321C43E7EE"><enum>(A)</enum><text>the Porcupine Gulch Wildlife Conservation Area designated by section 104(a);</text></subparagraph><subparagraph id="H9191B55CC0274548A7607F17B324E363"><enum>(B)</enum><text>the Williams Fork Mountains Wildlife Conservation Area designated by section 105(a); and </text></subparagraph><subparagraph id="id872436e4973249c59462c021aeb63ef3"><enum>(C)</enum><text>the Spraddle Creek Wildlife Conservation Area designated by section 106(a). </text></subparagraph></paragraph></section><section id="H4667EFC077B242CEABDBE229158FC0BF"><enum>102.</enum><header>Colorado Wilderness additions</header><subsection id="H51299AFDAC934A83ABA5282749C5D1C4"><enum>(a)</enum><header>Designation</header><text>Section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) is amended—</text><paragraph id="HB49A7A1C7A8347289A0668DE014C888C"><enum>(1)</enum><text>in paragraph (18), by striking <quote>1993,</quote> and inserting <quote>1993, and certain Federal land within the White River National Forest that comprises approximately 6,896 acres, as generally depicted as <quote>Proposed Ptarmigan Peak Wilderness Additions</quote> on the map entitled <quote>Proposed Ptarmigan Peak Wilderness Additions</quote> and dated June 24, 2019,</quote>; and</text></paragraph><paragraph id="H3FBA887055164AC3811133A0070ECC83"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67B93F83ADAB4820A6E6E133B20FAF53"><paragraph id="H2FE06123C45E41F38054115314B24BFD"><enum>(23)</enum><header>Holy cross wilderness addition</header><text>Certain Federal land within the White River National Forest that comprises approximately 3,866 acres, as generally depicted as <quote>Proposed Megan Dickie Wilderness Addition</quote> on the map entitled <quote>Holy Cross Wilderness Addition Proposal</quote> and dated June 24, 2019, which shall be incorporated into, and managed as part of, the Holy Cross Wilderness designated by section 102(a)(5) of <external-xref legal-doc="public-law" parsable-cite="pl/96/560">Public Law 96–560</external-xref> (94 Stat. 3266).</text></paragraph><paragraph id="idf289f248fd4847f984a3c98de5cc8a88"><enum>(24)</enum><header>Hoosier ridge wilderness</header><text>Certain Federal land within the White River National Forest that comprises approximately 5,235 acres, as generally depicted as <quote>Proposed Hoosier Ridge Wilderness</quote> on the map entitled <quote>Tenmile Proposal</quote> and dated April 22, 2022, which shall be known as the <quote>Hoosier Ridge Wilderness</quote>.</text></paragraph><paragraph id="idd8a959d3efc24b45b878f8a8152ebb6d"><enum>(25)</enum><header>Tenmile wilderness</header><text>Certain Federal land within the White River National Forest that comprises approximately 7,624 acres, as generally depicted as <quote>Proposed Tenmile Wilderness</quote> on the map entitled <quote>Tenmile Proposal</quote> and dated May 1, 2023, which shall be known as the <quote>Tenmile Wilderness</quote>.</text></paragraph><paragraph id="id95cce28cbe524e16b48e758d71c6a5ba"><enum>(26)</enum><header>Eagles nest wilderness additions</header><text>Certain Federal land within the White River National Forest that comprises approximately 7,634 acres, as generally depicted as <quote>Proposed Freeman Creek Wilderness Addition</quote> and <quote>Proposed Spraddle Creek Wilderness Addition</quote> on the map entitled <quote>Eagles Nest Wilderness Additions Proposal</quote> and dated April 26, 2022, which shall be incorporated into, and managed as part of, the Eagles Nest Wilderness designated by <external-xref legal-doc="public-law" parsable-cite="pl/94/352">Public Law 94–352</external-xref> (90 Stat. 870).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA7DCB52010F345818EB6E7F218BB23CD"><enum>(b)</enum><header>Applicable law</header><text>Any reference in the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act for purposes of administering a covered area.</text></subsection><subsection id="H20AE294255074531B00A276FC3FDD195"><enum>(c)</enum><header>Fire, insects, and diseases</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary may carry out any activity in a covered area that the Secretary determines to be necessary for the control of fire, insects, and diseases, subject to such terms and conditions as the Secretary determines to be appropriate.</text></subsection><subsection id="id99cdc5fe10f64fc282977a217803fce5"><enum>(d)</enum><header>Grazing</header><text>The grazing of livestock on a covered area, if established before the date of enactment of this Act, shall be permitted to continue subject to such reasonable regulations as are considered to be necessary by the Secretary, in accordance with—</text><paragraph id="id4232fa59636c4093b3d2c4f8e99b0752"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph><paragraph id="id1e908d0839234333b61e9a9e467b5df3"><enum>(2)</enum><text>the guidelines set forth in the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 5487 of the 96th Congress (H. Rept. 96–617). </text></paragraph></subsection><subsection id="H60C9EBCB50684123BC898A88DBBE2739"><enum>(e)</enum><header>Coordination</header><text>For purposes of administering the Federal land designated as wilderness by paragraph (26) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by subsection (a)(2)), the Secretary shall, as determined to be appropriate for the protection of watersheds, coordinate the activities of the Secretary in response to fires and flooding events with interested State and local agencies.</text></subsection></section><section id="H022E61E18B4B4F9F86DFE037E582EB3C"><enum>103.</enum><header>Williams Fork Mountains potential wilderness</header><subsection id="H94B3A5FD870A4885A902529181FF8188"><enum>(a)</enum><header>Designation</header><text>In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), certain Federal land in the White River National Forest in the State, comprising approximately 8,036 acres, as generally depicted as <quote>Proposed Williams Fork Mountains Wilderness</quote> on the map entitled <quote>Williams Fork Mountains Proposal</quote> and dated June 24, 2019, is designated as a potential wilderness area.</text></subsection><subsection id="HDF5A12A2DA9F498DAF6A72D4D3DC36C0"><enum>(b)</enum><header>Management</header><text>Subject to valid existing rights and except as provided in subsection (d), the potential wilderness area designated by subsection (a) shall be managed in accordance with—</text><paragraph id="HD5B4AC595B4C4AD0BDA474C844A9086B"><enum>(1)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></paragraph><paragraph id="H2828ADB269A640D6BDFD621B3E98EB29"><enum>(2)</enum><text>this section.</text></paragraph></subsection><subsection id="HB63914DF8E7C4BDAA80B5F161D4ACE17"><enum>(c)</enum><header>Livestock use of vacant allotments</header><paragraph id="HA4AC2ADB366E45BA95DA332D729222BB"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, in accordance with applicable laws (including regulations), the Secretary shall publish a determination regarding whether to authorize livestock grazing or other use by livestock on the vacant allotments known as—</text><subparagraph id="H29EA09C967AD4404A73B28E857076D57"><enum>(A)</enum><text>the <quote>Big Hole Allotment</quote>; and</text></subparagraph><subparagraph id="H04AA850D17D745CCA87CC34DF90CBA6E"><enum>(B)</enum><text>the <quote>Blue Ridge Allotment</quote>.</text></subparagraph></paragraph><paragraph id="H0BE90DDAB6564A3294B68B60A7B027DD"><enum>(2)</enum><header>Modification of allotments</header><text>In publishing a determination pursuant to paragraph (1), the Secretary may modify or combine the vacant allotments referred to in that paragraph.</text></paragraph><paragraph id="HF3FA12420A80467BB766B64A353EBE56"><enum>(3)</enum><header>Permit or other authorization</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a determination of the Secretary to authorize livestock grazing or other use by livestock is published under paragraph (1), if applicable, the Secretary shall grant a permit or other authorization for that livestock grazing or other use in accordance with applicable laws (including regulations).</text></paragraph></subsection><subsection id="HE5D6DB165EDB4775AE9A6BF1D284CF30"><enum>(d)</enum><header>Range improvements</header><paragraph id="HDA7854E198C246F69B3C8DF3195070D2"><enum>(1)</enum><header>In general</header><text>If the Secretary permits livestock grazing or other use by livestock on the potential wilderness area under subsection (c), the Secretary, or a third party authorized by the Secretary, may use motorized or mechanized transport or equipment for purposes of constructing or rehabilitating such range improvements as are necessary to obtain appropriate livestock management objectives (including habitat and watershed restoration).</text></paragraph><paragraph id="HFFFB27C883ED472A9B3535417623F603"><enum>(2)</enum><header>Termination of authority</header><text>The authority provided by this subsection terminates on the date that is 2 years after the date on which the Secretary publishes a positive determination under subsection (c)(3).</text></paragraph></subsection><subsection id="HB5A25742634D4D48936DC3EE002A3976"><enum>(e)</enum><header>Designation as wilderness</header><paragraph id="H80FB55B4FBB4401CB6AE742C7F395597"><enum>(1)</enum><header>Designation</header><text>The potential wilderness area designated by subsection (a) shall be designated as wilderness, to be known as the <quote>Williams Fork Mountains Wilderness</quote>—</text><subparagraph id="H595523818C5A4A5D9878D2D2A091A249"><enum>(A)</enum><text>effective not earlier than the date that is 180 days after the date of enactment this Act; and</text></subparagraph><subparagraph id="H2EC7FDD04F1D42EFA1E9DBD0E974BC0D"><enum>(B)</enum><text>on the earliest of—</text><clause id="HD551C768F9404153B5DE8EC2D5DB1F18"><enum>(i)</enum><text>the date on which the Secretary publishes in the Federal Register a notice that the construction or rehabilitation of range improvements under subsection (d) is complete;</text></clause><clause id="HF507596C6C2C4611B44932379ADA36CA"><enum>(ii)</enum><text>the date described in subsection (d)(2); and </text></clause><clause id="H39BB41B681594457AF951308C02723F9"><enum>(iii)</enum><text>the effective date of a determination of the Secretary not to authorize livestock grazing or other use by livestock under subsection (c)(1).</text></clause></subparagraph></paragraph><paragraph id="id4b4628a58cf643249ab5db681082e8c1"><enum>(2)</enum><header>Administration</header><text>Subject to valid existing rights, the Secretary shall manage the Williams Fork Mountains Wilderness in accordance with the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date on which the Williams Fork Mountains Wilderness is designated in accordance with paragraph (1).</text></paragraph></subsection></section><section id="H9CB1E385C3934AB9B69CD4E4C1F9786B"><enum>104.</enum><header>Porcupine Gulch Wildlife Conservation Area</header><subsection id="H6DDAD3B4EE29455CB7F11C128B61D15B"><enum>(a)</enum><header>Designation</header><text>Subject to valid existing rights, the approximately 8,287 acres of Federal land located in the White River National Forest, as generally depicted as <quote>Proposed Porcupine Gulch Wildlife Conservation Area</quote> on the map entitled <quote>Porcupine Gulch Wildlife Conservation Area Proposal</quote> and dated June 24, 2019, are designated as the <quote>Porcupine Gulch Wildlife Conservation Area</quote> (referred to in this section as the <quote>Wildlife Conservation Area</quote>).</text></subsection><subsection id="H67CE168125514BC5BB1FCBA70F7190B0"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Wildlife Conservation Area are—</text><paragraph id="H93F8BB2A67D3432A8B78162B7930C543"><enum>(1)</enum><text>to conserve and protect a wildlife migration corridor over Interstate 70; and</text></paragraph><paragraph id="H0F8C6A4ABE4A4BF1B30959380F6FEA12"><enum>(2)</enum><text>to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the wildlife, scenic, roadless, watershed, and ecological resources of the Wildlife Conservation Area.</text></paragraph></subsection><subsection id="H5AD810236B4A49258BDA28CDEF75918F"><enum>(c)</enum><header>Management</header><paragraph id="HFF30EC6F7CC647208685D03556EDAB5C"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Wildlife Conservation Area—</text><subparagraph id="HAC83148614F04190B4638391D466D65F"><enum>(A)</enum><text>in a manner that conserves, protects, and enhances the purposes described in subsection (b); and</text></subparagraph><subparagraph id="HEF1E7CC056274C18AB67BD3A4418464F"><enum>(B)</enum><text>in accordance with—</text><clause id="H262A4B3EBE42431DBAA9A39FF7A28EDA"><enum>(i)</enum><text>the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></clause><clause id="HDA900629CA0342FFA05F3DFD73ACD7F6"><enum>(ii)</enum><text>any other applicable laws (including regulations); and</text></clause><clause id="H9B18466BA97E43EEA24B74F82DF9781A"><enum>(iii)</enum><text>this section.</text></clause></subparagraph></paragraph><paragraph id="H5725C8497C0E461BA9B719CBC87D09D1"><enum>(2)</enum><header>Uses</header><subparagraph id="H07E700B11E2841858528A235B3FB7CA5"><enum>(A)</enum><header>In general</header><text>The Secretary shall only allow such uses of the Wildlife Conservation Area as the Secretary determines would further the purposes described in subsection (b).</text></subparagraph><subparagraph id="HFCB41168651F4075A1D88257877DAD7D"><enum>(B)</enum><header>Recreation</header><text>The Secretary may permit such recreational activities in the Wildlife Conservation Area that the Secretary determines are consistent with the purposes described in subsection (b).</text></subparagraph><subparagraph id="HF3F2E0FE5F2B41239FC4682E15C5A958"><enum>(C)</enum><header>Motorized vehicles and mechanized transport; new or temporary roads</header><clause id="H0B83D95931B548DF9F60D4B799898145"><enum>(i)</enum><header>Motorized vehicles and mechanized transport</header><text>Except as provided in clause (iii), the use of motorized vehicles and mechanized transport in the Wildlife Conservation Area shall be prohibited.</text></clause><clause id="H774411E411A94E7C8816C7E7B53964A8"><enum>(ii)</enum><header>New or temporary roads</header><text>Except as provided in clause (iii) and subsection (e), no new or temporary road shall be constructed within the Wildlife Conservation Area.</text></clause><clause id="HFD7FE53F76A44CEC848EDACE6D904019"><enum>(iii)</enum><header>Exceptions</header><text>Nothing in clause (i) or (ii) prevents the Secretary from—</text><subclause id="H2E7FB478B25642C1AAD2747FE9E2CF9C"><enum>(I)</enum><text>authorizing the use of motorized vehicles or mechanized transport for administrative purposes;</text></subclause><subclause id="HF3A2B256A5C84E4CAD2B0ACA4B62C959"><enum>(II)</enum><text>constructing temporary roads or permitting the use of motorized vehicles or mechanized transport to carry out pre- or post-fire watershed protection projects;</text></subclause><subclause id="H7EB759D45BB74DA08F7C8FAA9E69A5AE"><enum>(III)</enum><text>authorizing the use of motorized vehicles or mechanized transport to carry out activities described in subsection (d) or (e); or</text></subclause><subclause id="HA5F871ECA56E4E82B544CB4B60754C55"><enum>(IV)</enum><text>responding to an emergency.</text></subclause></clause></subparagraph><subparagraph id="H0DDA6B939E2B4D8C806B35AAAA064B28"><enum>(D)</enum><header>Commercial timber</header><clause id="H66116F53446C4C12A2F55BCD559A94BC"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), no project shall be carried out in the Wildlife Conservation Area for the purpose of harvesting commercial timber.</text></clause><clause id="HA3BFE84F2E854D0288755ECD71C1A81E"><enum>(ii)</enum><header>Limitation</header><text>Nothing in clause (i) prevents the Secretary from harvesting or selling a merchantable product that is a byproduct of an activity authorized under this section.</text></clause></subparagraph></paragraph></subsection><subsection id="iddd2d2a50bf244cbebf8f882ae64319fe"><enum>(d)</enum><header>Fire, insects, and diseases</header><text>The Secretary may carry out any activity, in accordance with applicable laws (including regulations), that the Secretary determines to be necessary to manage wildland fire and treat hazardous fuels, insects, and diseases in the Wildlife Conservation Area, subject to such terms and conditions as the Secretary determines to be appropriate. </text></subsection><subsection id="ide0a6874a637d4b3c8a9080b4d01d3184"><enum>(e)</enum><header>Regional transportation projects</header><text>Nothing in this section or section 110(f) precludes the Secretary from authorizing, in accordance with applicable laws (including regulations) and subject to valid existing rights, the use of the subsurface of the Wildlife Conservation Area to construct, realign, operate, or maintain regional transportation projects, including Interstate 70 and the Eisenhower-Johnson Tunnels. </text></subsection><subsection id="H6F667AAFA3A94FAD9BACF74F4E247C73"><enum>(f)</enum><header>Water</header><text display-inline="yes-display-inline">Section 3(e) of the James Peak Wilderness and Protection Area Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/216">Public Law 107–216</external-xref>; 116 Stat. 1058) shall apply to the Wildlife Conservation Area.</text></subsection></section><section id="H531B4CECEB7A456F9E65D9537E242A7C"><enum>105.</enum><header>Williams Fork Mountains Wildlife Conservation Area</header><subsection id="HA24F98F8D9894B76BFFABE702500CC90"><enum>(a)</enum><header>Designation</header><text>Subject to valid existing rights, the approximately 3,528 acres of Federal land in the White River National Forest in the State, as generally depicted as <quote>Proposed Williams Fork Mountains Wildlife Conservation Area</quote> on the map entitled <quote>Williams Fork Mountains Proposal</quote> and dated June 24, 2019, are designated as the <quote>Williams Fork Mountains Wildlife Conservation Area</quote> (referred to in this section as the <quote>Wildlife Conservation Area</quote>).</text></subsection><subsection id="H1EB6B7449FB94DD9825E6141D3CA9059"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Wildlife Conservation Area are to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the wildlife, scenic, roadless, watershed, recreational, and ecological resources of the Wildlife Conservation Area.</text></subsection><subsection id="HE4533BF67D8C41DBA781EA1202B59906"><enum>(c)</enum><header>Management</header><paragraph id="HC6106A70824B4EC0BD66B5C07CE62FA3"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Wildlife Conservation Area—</text><subparagraph id="H7CB817FDB0D34D33879AFC0B394FE52B"><enum>(A)</enum><text>in a manner that conserves, protects, and enhances the purposes described in subsection (b); and</text></subparagraph><subparagraph id="H503E6F6686854C31AD2BAA11D3959731"><enum>(B)</enum><text>in accordance with—</text><clause id="H2E663579F42445A59923BE9375F4AB29"><enum>(i)</enum><text>the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></clause><clause id="HB7EBE973268D4D1B96FFC26DFB76A1A4"><enum>(ii)</enum><text>any other applicable laws (including regulations); and</text></clause><clause id="H35BF58C65A9B41839EF3D61C3B658B6F"><enum>(iii)</enum><text>this section.</text></clause></subparagraph></paragraph><paragraph id="H69F1BA5743F64C46BCED14DEBCDAA53E"><enum>(2)</enum><header>Uses</header><subparagraph id="HDF7E7BDCAF7E4D3BA61D4A320CC61758"><enum>(A)</enum><header>In general</header><text>The Secretary shall only allow such uses of the Wildlife Conservation Area as the Secretary determines would further the purposes described in subsection (b).</text></subparagraph><subparagraph id="H6430FD6628754106B0D1C809E332B113"><enum>(B)</enum><header>Motorized vehicles</header><clause id="H1DB89402A216455797411682DD5A8DD7"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), the use of motorized vehicles in the Wildlife Conservation Area shall be limited to designated roads and trails.</text></clause><clause id="H26F65E27F35E49AAA8919B5D70FAC8F5"><enum>(ii)</enum><header>New or temporary roads</header><text>Except as provided in clause (iii), no new or temporary road shall be constructed in the Wildlife Conservation Area.</text></clause><clause id="HEC3FED55C5A242ACA9A0ACD38EE566AA"><enum>(iii)</enum><header>Exceptions</header><text>Nothing in clause (i) or (ii) prevents the Secretary from—</text><subclause id="HC3714108F10E41A084E146B22842040D"><enum>(I)</enum><text>authorizing the use of motorized vehicles for administrative purposes;</text></subclause><subclause id="H8B33199C08504AA59A089C50460EBFBE"><enum>(II)</enum><text>authorizing the use of motorized vehicles to carry out activities described in subsection (d); or</text></subclause><subclause id="H76B49BA8BEA3404DB982EC9D7A7C0ED9"><enum>(III)</enum><text>responding to an emergency.</text></subclause></clause></subparagraph><subparagraph id="H9C285DF218254A75AAAAAE7AA8F3DA79"><enum>(C)</enum><header>Bicycles</header><text>The use of bicycles in the Wildlife Conservation Area shall be limited to designated roads and trails.</text></subparagraph><subparagraph id="H36C16D911B12443AA05A2EDB555B70E5"><enum>(D)</enum><header>Commercial timber</header><clause id="HF400EA25AFB64FF9ABE5B115BCBDC23B"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), no project shall be carried out in the Wildlife Conservation Area for the purpose of harvesting commercial timber.</text></clause><clause id="H7C07A199A4D44BF7B5D867A1493219D4"><enum>(ii)</enum><header>Limitation</header><text>Nothing in clause (i) prevents the Secretary from harvesting or selling a merchantable product that is a byproduct of an activity authorized under this section.</text></clause></subparagraph><subparagraph id="H172F5BA9FFD94C878C5B57BC19681C72"><enum>(E)</enum><header>Grazing</header><text>The laws (including regulations) and policies followed by the Secretary in issuing and administering grazing permits or leases on land under the jurisdiction of the Secretary shall continue to apply with regard to the land in the Wildlife Conservation Area, consistent with the purposes described in subsection (b).</text></subparagraph></paragraph></subsection><subsection id="id1cbabbae0bed4c7483ec9e4c3f55cde4"><enum>(d)</enum><header>Fire, insects, and diseases</header><text>The Secretary may carry out any activity, in accordance with applicable laws (including regulations), that the Secretary determines to be necessary to manage wildland fire and treat hazardous fuels, insects, and diseases in the Wildlife Conservation Area, subject to such terms and conditions as the Secretary determines to be appropriate. </text></subsection><subsection id="HD42E6E66A65B4131A2682E681506AAAC"><enum>(e)</enum><header>Water</header><text display-inline="yes-display-inline">Section 3(e) of the James Peak Wilderness and Protection Area Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/216">Public Law 107–216</external-xref>; 116 Stat. 1058) shall apply to the Wildlife Conservation Area.</text></subsection></section><section id="iddc63aa1dfa49445a8b7cb63acba6918e"><enum>106.</enum><header>Spraddle Creek Wildlife Conservation Area</header><subsection id="id13d53a2886704f1e90093badc075fe38"><enum>(a)</enum><header>Designation</header><text>Subject to valid existing rights, the approximately 2,674 acres of Federal land in the White River National Forest in the State, as generally depicted as <quote>Proposed Spraddle Creek Wildlife Conservation Area</quote> on the map entitled <quote>Eagles Nest Wilderness Additions Proposal</quote> and dated April 26, 2022, are designated as the <quote>Spraddle Creek Wildlife Conservation Area</quote> (referred to in this section as the <quote>Wildlife Conservation Area</quote>).</text></subsection><subsection id="ida6e2298d9a9e49d886265fd78d01b157"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Wildlife Conservation Area are to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the wildlife, scenic, roadless, watershed, recreational, and ecological resources of the Wildlife Conservation Area.</text></subsection><subsection id="id8cf0a1c2d611431f949888ae68b8f57f"><enum>(c)</enum><header>Management</header><paragraph id="id2ebca953c99c4ed7a09effef07c54db7"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Wildlife Conservation Area—</text><subparagraph id="id562f7fb0622e4c42a94aabad29803455"><enum>(A)</enum><text>in a manner that conserves, protects, and enhances the purposes described in subsection (b); and</text></subparagraph><subparagraph id="id10542479d49646528a3ec7e4b9186adf"><enum>(B)</enum><text>in accordance with—</text><clause id="id7d981256f4464a37b4b19fea0e90cac6"><enum>(i)</enum><text>the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></clause><clause id="id340e5bb2fdbc4b32a53f0eec1139a973"><enum>(ii)</enum><text>any other applicable laws (including regulations); and</text></clause><clause id="id90631ed909ad41fd94a74f6643e3561d"><enum>(iii)</enum><text>this title.</text></clause></subparagraph></paragraph><paragraph id="ida4c4d3425926409e9f5eff55456376ca"><enum>(2)</enum><header>Uses</header><subparagraph id="idacaaa54a03b84b15acc2f62acd85e954"><enum>(A)</enum><header>In general</header><text>The Secretary shall only allow such uses of the Wildlife Conservation Area as the Secretary determines would further the purposes described in subsection (b).</text></subparagraph><subparagraph id="id9cf6368aa1244aeb88a0bea9e5cdcf17"><enum>(B)</enum><header>Motorized vehicles and mechanized transport</header><text>Except as necessary for administrative purposes or to respond to an emergency, the use of motorized vehicles and mechanized transport in the Wildlife Conservation Area shall be prohibited.</text></subparagraph><subparagraph id="id9abe5032700d4fc4991d22f4ec2bfbdf"><enum>(C)</enum><header>Roads</header><clause id="idFC6A6B9AAC51496A90C8B06B05705436"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), no road shall be constructed in the Wildlife Conservation Area.</text></clause><clause id="idca01de28a02e4512a1aaa8af733514cc"><enum>(ii)</enum><header>Exceptions</header><text>Nothing in clause (i) prevents the Secretary from—</text><subclause id="ide0a37dae62154a62a192592a6f8822b4"><enum>(I)</enum><text>constructing a temporary road as the Secretary determines to be necessary as a minimum requirement for carrying out a vegetation management project in the Wildlife Conservation Area; or</text></subclause><subclause id="id77e3268e287a492290b33e2a6bb38b79"><enum>(II)</enum><text>responding to an emergency.</text></subclause></clause><clause id="id2398878fc6164a7aba13c97465b00b55"><enum>(iii)</enum><header>Decommissioning of temporary roads</header><text>Not later than 3 years after the date on which the applicable vegetation management project is completed, the Secretary shall decommission any temporary road constructed under clause (ii)(I) for the applicable vegetation management project.</text></clause></subparagraph><subparagraph id="id9f9c08e1867d446baeeac9e490b2759f"><enum>(D)</enum><header>Commercial timber</header><clause id="id5749fcc07bfb4179b7e183f9f10a96ec"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), no project shall be carried out in the Wildlife Conservation Area for the purpose of harvesting commercial timber.</text></clause><clause id="idd0f8265485274b7eb4161291ace91c23"><enum>(ii)</enum><header>Limitation</header><text>Nothing in clause (i) prevents the Secretary from harvesting or selling a merchantable product that is a byproduct of an activity authorized in the Wildlife Conservation Area under this section.</text></clause></subparagraph></paragraph></subsection><subsection id="id640aa1aee7ab4c9683951910b66766d4"><enum>(d)</enum><header>Fire, insects, and diseases</header><text>The Secretary may carry out any activity, in accordance with applicable laws (including regulations), that the Secretary determines to be necessary to manage wildland fire and treat hazardous fuels, insects, and diseases in the Wildlife Conservation Area, subject to such terms and conditions as the Secretary determines to be appropriate.</text></subsection><subsection id="id59f55c56904749cb8b546acbf07d54b8"><enum>(e)</enum><header>Water</header><text>Section 3(e) of the James Peak Wilderness and Protection Area Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/216">Public Law 107–216</external-xref>; 116 Stat. 1058) shall apply to the Wildlife Conservation Area. </text></subsection></section><section id="H7FAD0F1CF22E431498E04F05663821E1"><enum>107.</enum><header>Sandy Treat Overlook</header><text display-inline="no-display-inline">The interpretive site located beside United States Route 24 within the Camp Hale-Continental Divide National Monument, at 39.431N 106.323W, is designated as the <quote>Sandy Treat Overlook</quote>.</text></section><section id="HF4CF62908EA24D1BBF37522656F68253"><enum>108.</enum><header>White River National Forest boundary modification</header><subsection id="H5CC3EBF8585545F8971C93F0B41FD309"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The boundary of the White River National Forest is modified to include the approximately 120 acres comprised of the SW<fraction>1/4</fraction>, the SE<fraction>1/4</fraction>, and the NE<fraction>1/4</fraction> of the SE<fraction>1/4</fraction> of sec. 1, T. 2 S., R. 80 W., 6th Principal Meridian, in Summit County in the State.</text></subsection><subsection id="H572A105F68544CF3BDE048EDAE7E4E69"><enum>(b)</enum><header>Land and water conservation fund</header><text>For purposes of section 200306 of title 54, United States Code, the boundaries of the White River National Forest, as modified by subsection (a), shall be considered to be the boundaries of the White River National Forest as in existence on January 1, 1965.</text></subsection></section><section id="H2AD778844D6F45B1A02B4D6260E144C1"><enum>109.</enum><header>Rocky Mountain National Park potential wilderness boundary adjustment</header><subsection id="H417AE2948E554186A9081580AC006646"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to provide for the ongoing maintenance and use of portions of the Trail River Ranch and the associated property located within Rocky Mountain National Park in Grand County in the State.</text></subsection><subsection id="HA59F36E9BA8849BAAA8C731D1F327242"><enum>(b)</enum><header>Boundary adjustment</header><text>Section 1952(b) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1070) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC7EC75C0538D4D8E830210ECA625F134"><paragraph id="HD22804C86E154C7A8A84E7D3691ABD79"><enum>(3)</enum><header>Boundary adjustment</header><text>The boundary of the Potential Wilderness is modified to exclude the area comprising approximately 15.5 acres of land identified as <quote>Potential Wilderness to Non-wilderness</quote> on the map entitled <quote>Rocky Mountain National Park Proposed Wilderness Area Amendment</quote> and dated January 16, 2018.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0498827F20314B1E9FE64A701FEA4812"><enum>110.</enum><header>Administrative provisions</header><subsection id="H7FAF910BCC53422B99E6B043B9DB3924"><enum>(a)</enum><header>Fish and wildlife</header><text>Nothing in this title affects the jurisdiction or responsibility of the State with respect to fish and wildlife in the State.</text></subsection><subsection id="HAF19FD43876E40B1B1A568180454428E"><enum>(b)</enum><header>No buffer zones</header><paragraph id="HF22CB5CCF6B042C1A44079E5C643A1ED"><enum>(1)</enum><header>In general</header><text>Nothing in this title or an amendment made by this title establishes a protective perimeter or buffer zone around—</text><subparagraph id="HF475484D98D8402EBCC45345FE406F43"><enum>(A)</enum><text>a covered area;</text></subparagraph><subparagraph id="H50D71643C9CC47B3BE90D318D44ED208"><enum>(B)</enum><text>a wilderness area or potential wilderness area designated by section 103; or</text></subparagraph><subparagraph id="H4FD32CCD53D147CBA7A6E4272B637E67"><enum>(C)</enum><text>a Wildlife Conservation Area.</text></subparagraph></paragraph><paragraph id="H6E7004B7511B4AC888201A36F9A9591B"><enum>(2)</enum><header>Outside activities</header><text>The fact that a nonwilderness activity or use on land outside of an area described in paragraph (1) can be seen or heard from within the applicable area described in paragraph (1) shall not preclude the activity or use outside the boundary of the applicable area described in paragraph (1).</text></paragraph></subsection><subsection id="idD0759B19297B434D8F91F5A5D94FB435"><enum>(c)</enum><header>Tribal rights and uses</header><paragraph id="idB478BA20387F4E83896B3A191FC65E91"><enum>(1)</enum><header>Treaty rights</header><text>Nothing in this title affects the treaty rights of an Indian Tribe.</text></paragraph><paragraph id="id88D5AF1E44CB4036A78C25A2AC3080EE"><enum>(2)</enum><header>Traditional tribal uses</header><text>Subject to any terms and conditions that the Secretary determines to be necessary and in accordance with applicable law, the Secretary shall allow for the continued use of the areas described in subsection (b)(1) by members of Indian Tribes—</text><subparagraph id="idC719FFD515C7431BBE77C7B97454C7DE"><enum>(A)</enum><text>for traditional ceremonies; and </text></subparagraph><subparagraph id="id4E8747BE41604EEA8C85AC9B750BBD9C"><enum>(B)</enum><text>as a source of traditional plants and other materials. </text></subparagraph></paragraph></subsection><subsection id="HB8BB72FCD4E841E0A087822AD3CF3958"><enum>(d)</enum><header>Maps and legal descriptions</header><paragraph id="H0EA78A2FD8864154B7B0FBA86BACD894"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare maps and legal descriptions of each area described in subsection (b)(1) with—</text><subparagraph id="H171E0DD094664C72A42737A4F1B67C49"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph><subparagraph id="H12BC9710B9AC410E87B892FEFE040A09"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph><paragraph id="id59463426211f43109188722683f87a91"><enum>(2)</enum><header>Force of law</header><text>Each map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may—</text><subparagraph id="iddfdad578fb9c437fb3bf0345ef4dad55"><enum>(A)</enum><text>correct any typographical errors in the maps and legal descriptions; and</text></subparagraph><subparagraph id="idf0be5d37202d436f87639e8e7285eb9b"><enum>(B)</enum><text>in consultation with the State, make minor adjustments to the boundaries of the Porcupine Gulch Wildlife Conservation Area designated by section 104(a) and the Williams Fork Mountains Wildlife Conservation Area designated by section 105(a) to account for potential highway or multimodal transportation system construction, safety measures, maintenance, realignment, or widening. </text></subparagraph></paragraph><paragraph id="HE65A8DA3664C40C9B0E2D65A6ED4F28F"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text></paragraph></subsection><subsection id="HD0647DA989584E8C9C6D24C5BA66388F"><enum>(e)</enum><header>Acquisition of land</header><paragraph id="id41232252cfc9497499c05cf8bea432c1"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire any land or interest in land within the boundaries of an area described in subsection (b)(1) by donation, purchase from a willing seller, or exchange.</text></paragraph><paragraph id="H91017E1D3D8D4BAF92C4CA3750862AE5"><enum>(2)</enum><header>Management</header><text>Any land or interest in land acquired under paragraph (1) shall be incorporated into, and administered as a part of, the wilderness area or Wildlife Conservation Area, as applicable, in which the land or interest in land is located.</text></paragraph></subsection><subsection id="H9FD8E7235CEE4B2E83CC977E6FD50B13"><enum>(f)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the areas described in subsection (b)(1) are withdrawn from—</text><paragraph id="H20A7515F2C824E9790D43527EDCD97D3"><enum>(1)</enum><text>entry, appropriation, and disposal under the public land laws;</text></paragraph><paragraph id="H41D65DA7B3B8428EAB6529C2C6E3CA24"><enum>(2)</enum><text>location, entry, and patent under mining laws; and</text></paragraph><paragraph id="H9172249EE5464DD790B58A78B8DA401E"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection><subsection id="HA3FD797D56294D1FBC2CC5F33FBD9108"><enum>(g)</enum><header>Military overflights</header><text>Nothing in this title or an amendment made by this title restricts or precludes—</text><paragraph id="H20F297702A414020B8C84DF234E204BA"><enum>(1)</enum><text>any low-level overflight of military aircraft over any area subject to this title or an amendment made by this title, including military overflights that can be seen, heard, or detected within such an area;</text></paragraph><paragraph id="HB3BDBA487C5D4C479FC6251AA929AD3B"><enum>(2)</enum><text>flight testing or evaluation over an area described in paragraph (1); or</text></paragraph><paragraph id="H52D99FD520B1447796844A62EAC26A67"><enum>(3)</enum><text>the use or establishment of—</text><subparagraph id="H6F11E393613448DFAC2D7C5756BBEFE2"><enum>(A)</enum><text>any new unit of special use airspace over an area described in paragraph (1); or</text></subparagraph><subparagraph id="HDF901267454C49F6925A1BD5A088DDC4"><enum>(B)</enum><text>any military flight training or transportation over such an area.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HAEABC6A663C3469C9A8FFEA38A2D1884"><enum>(h)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that military aviation training on Federal public land in the State, including the training conducted at the High-Altitude Army National Guard Aviation Training Site, is critical to the national security of the United States and the readiness of the Armed Forces.</text></subsection></section></title><title id="H43B2B1DF00514E8D9062CB84D8EACE48"><enum>II</enum><header>San Juan Mountains</header><section id="H45C94CA94D2741AFA337C37FAA5841D6"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HB05C39F394984CF2B737184E1DB4A2BC"><enum>(1)</enum><header>Covered land</header><text>The term <term>covered land</term> means—</text><subparagraph id="H3C29163922444FE497D522EE84F8B6E0"><enum>(A)</enum><text>land designated as wilderness under paragraphs (27) through (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202); and</text></subparagraph><subparagraph id="HE9D41E79F07E4DA9BD45879E7DDB74D1"><enum>(B)</enum><text>a Special Management Area.</text></subparagraph></paragraph><paragraph id="H791EDFB1AF9C49738E1DDFA5F95D014F"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="HEDFA786E3FA549109FDF4F3B33E3E095"><enum>(3)</enum><header>Special management area</header><text>The term <term>Special Management Area</term> means each of—</text><subparagraph id="HB6677A8D99224E30921DA76888C726C1"><enum>(A)</enum><text>the Sheep Mountain Special Management Area designated by section 203(a)(1); and</text></subparagraph><subparagraph id="H047451F23D034143AB88F4D82CBB75D7"><enum>(B)</enum><text>the Liberty Bell East Special Management Area designated by section 203(a)(2).</text></subparagraph></paragraph></section><section id="HA05F9F54038144458E7261BBF951C883"><enum>202.</enum><header>Additions to National Wilderness Preservation System</header><text display-inline="no-display-inline">Section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; Sneffels Wilderness</quote> and dated September 6, 2018, which is incorporated in, and shall be administered as part of, the Mount Sneffels Wilderness.</text></subparagraph></paragraph><paragraph id="H15FC20B3C7754F1DBD6655F3BC5BEE3E"><enum>(29)</enum><header>McKenna peak wilderness</header><text>Certain Federal land in the State of Colorado comprising approximately 8,884 acres of Bureau of Land Management land, as generally depicted on the map entitled <quote>Proposed McKenna Peak Wilderness Area</quote> and dated September 18, 2018, to be known as the <quote>McKenna Peak Wilderness</quote>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF85869FC316340528035676A33BA6B31"><enum>203.</enum><header>Special management areas</header><subsection id="H8CEF6F979ED4473FBD6B53C57338FB16"><enum>(a)</enum><header>Designation</header><paragraph id="H3C096B86CFEE4E169979A1A1292057FE"><enum>(1)</enum><header>Sheep mountain special management area</header><text>The Federal land in the Grand Mesa, Uncompahgre, and Gunnison and San Juan National Forests in the State comprising approximately 21,663 acres, as generally depicted on the map entitled <quote>Proposed Sheep Mountain Special Management Area</quote> and dated September 19, 2018, is designated as the <quote>Sheep Mountain Special Management Area</quote>.</text></paragraph><paragraph id="HCA8337163828484BB205F86ACDD8C483"><enum>(2)</enum><header>Liberty bell east special management area</header><text>The Federal land in the Grand Mesa, Uncompahgre, and Gunnison National Forests in the State comprising approximately 792 acres, as generally depicted on the map entitled <quote>Proposed Liberty Bell and Last Dollar Additions to the Mt. Sneffels Wilderness, Liberty Bell East Special Management Area</quote> and dated September 6, 2018, is designated as the <quote>Liberty Bell East Special Management Area</quote>.</text></paragraph></subsection><subsection id="H1E94A091EC3643369B6B74C70CAD5100"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Special Management Areas is to conserve and protect for the benefit and enjoyment of present and future generations the geological, cultural, archaeological, paleontological, natural, scientific, recreational, wilderness, wildlife, riparian, historical, educational, and scenic resources of the Special Management Areas.</text></subsection><subsection id="HE916A857EED74E2BBAEC2F6A8E689316"><enum>(c)</enum><header>Management</header><paragraph id="HA1425609CEBE44B3ABCA5150F4CF5692"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Special Management Areas in a manner that—</text><subparagraph id="HFBE85CAA418D48C5B019958038BEE1FF"><enum>(A)</enum><text>conserves, protects, and enhances the resources and values of the Special Management Areas described in subsection (b);</text></subparagraph><subparagraph id="HE71BABD6F8394CB99A5B350CB505DBDD"><enum>(B)</enum><text>subject to paragraph (3), maintains or improves the wilderness character of the Special Management Areas and the suitability of the Special Management Areas for potential inclusion in the National Wilderness Preservation System; and</text></subparagraph><subparagraph id="HE1275CCEFA404D16BE7E3A8770AC3176"><enum>(C)</enum><text>is in accordance with—</text><clause id="H558A69F5ED8E44609BEEB470A0112C29"><enum>(i)</enum><text>the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></clause><clause id="H2683231622274A3082DCCD5730294067"><enum>(ii)</enum><text>this title; and</text></clause><clause id="H39CCEE8813EA4969A343408A7AC5021A"><enum>(iii)</enum><text>any other applicable laws.</text></clause></subparagraph></paragraph><paragraph id="HE3EF79D214DD4D1FAC522A769DBF643D"><enum>(2)</enum><header>Prohibitions</header><text>The following shall be prohibited in the Special Management Areas:</text><subparagraph id="H87C1A16F91004E40A76D557F879C8B09"><enum>(A)</enum><text>Permanent roads.</text></subparagraph><subparagraph id="H3BD51A1F30F64AE981DFE665709157A2"><enum>(B)</enum><text>Except as necessary to meet the minimum requirements for the administration of the Federal land, to provide access for abandoned mine cleanup, and to protect public health and safety—</text><clause id="H30DA0BEEA7144CB8B835D1013913B803"><enum>(i)</enum><text>the use of motor vehicles, motorized equipment, or mechanical transport (other than as provided in paragraph (3)); and</text></clause><clause id="H19094C7911EB41DA98C4974EF77CE9F3"><enum>(ii)</enum><text>the establishment of temporary roads.</text></clause></subparagraph></paragraph><paragraph id="H63F9C2F38619443994551849528BA6EA"><enum>(3)</enum><header>Authorized activities</header><subparagraph id="HE3347D8C3ECF406588D0D7B10E229AE9"><enum>(A)</enum><header>In general</header><text>The Secretary may allow any activities (including helicopter access for recreation and maintenance and the competitive running event permitted since 1992) that have been authorized by permit or license as of the date of enactment of this Act to continue within the Special Management Areas, subject to such terms and conditions as the Secretary may require.</text></subparagraph><subparagraph id="HA14DC8B0E0614731B77E867B95BF0A21"><enum>(B)</enum><header>Permitting</header><text>The designation of the Special Management Areas by subsection (a) shall not affect the issuance of permits relating to the activities covered under subparagraph (A) after the date of enactment of this Act.</text></subparagraph><subparagraph id="HAB342C69CC3C4A07BB76775210533EB8"><enum>(C)</enum><header>Bicycles</header><text>The Secretary may permit the use of bicycles in—</text><clause id="H2B3B938C0E874DB6A392184FCA086FDD"><enum>(i)</enum><text>the portion of the Sheep Mountain Special Management Area identified as <quote>Ophir Valley Area</quote> on the map entitled <quote>Proposed Sheep Mountain Special Management Area</quote> and dated September 19, 2018; and</text></clause><clause id="H5E72E9B5D19347178219879D0C0ADB86"><enum>(ii)</enum><text>the portion of the Liberty Bell East Special Management Area identified as <quote>Liberty Bell Corridor</quote> on the map entitled <quote>Proposed Liberty Bell and Last Dollar Additions to the Mt. Sneffels Wilderness, Liberty Bell East Special Management Area</quote> and dated September 6, 2018.</text></clause></subparagraph></paragraph></subsection><subsection id="HD853A3F99CC840F8BD529E37CEEBA84F"><enum>(d)</enum><header>Applicable law</header><text>Water and water rights in the Special Management Areas shall be administered in accordance with section 8 of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 762), except that, for purposes of this title—</text><paragraph id="H7833E222FBE046D38B470B78685B49A9"><enum>(1)</enum><text>any reference contained in that section to <quote>the lands designated as wilderness by this Act</quote>, <quote>the Piedra, Roubideau, and Tabeguache areas identified in section 9 of this Act, or the Bowen Gulch Protection Area or the Fossil Ridge Recreation Management Area identified in sections 5 and 6 of this Act</quote>, or <quote>the areas described in sections 2, 5, 6, and 9 of this Act</quote> shall be considered to be a reference to <quote>the Special Management Areas</quote>; and</text></paragraph><paragraph id="H132AC5E0852D4B2DA16FD29E2934D6CB"><enum>(2)</enum><text>any reference contained in that section to <quote>this Act</quote> shall be considered to be a reference to <quote>the <short-title>Colorado Outdoor Recreation and Economy Act</short-title></quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc5f02c7c9f1f46fa81d7c09f37a81230"><enum>(e)</enum><header>Sheep Mountain Special Management Area Nordic ski safety study</header><paragraph commented="no" display-inline="no-display-inline" id="id3b66ead28951455e8174262f658c0f3f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary, in consultation with interested parties, shall complete a study on ensuring safe access for Nordic skiing in the vicinity of the Sheep Mountain Special Management Area, consistent with the purposes of the Sheep Mountain Special Management Area. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e79bf734aa545cca38bdc4774eb8d22"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Secretary, in coordination with San Miguel County in the State, the State Department of Transportation, and other interested stakeholders, shall identify a range of reasonable actions that could be taken by the Secretary to provide or facilitate off-highway parking areas along State Highway 145 to facilitate safe access for Nordic skiing in the vicinity of the Sheep Mountain Special Management Area. </text></paragraph></subsection></section><section id="H47D3C8224DE748A5822D3260BC113A59"><enum>204.</enum><header>Release of wilderness study areas</header><subsection id="H5B918F7E10D44A5795CE0B1FB3D2D832"><enum>(a)</enum><header>Dominguez canyon wilderness study area</header><text>Subtitle E of title II of <external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref> is amended—</text><paragraph id="HADC6DE9D7CF74D4CB3A93C3CAE361FFF"><enum>(1)</enum><text>by redesignating section 2408 (<external-xref legal-doc="usc" parsable-cite="usc/16/460zzz-7">16 U.S.C. 460zzz–7</external-xref>) as section 2409; and</text></paragraph><paragraph id="HA8CA750D58F142E19F5B1B49BCCF609B"><enum>(2)</enum><text>by inserting after section 2407 (<external-xref legal-doc="usc" parsable-cite="usc/16/460zzz-6">16 U.S.C. 460zzz–6</external-xref>) the following:</text><quoted-block style="OLC" id="HD11C10E1086A4D83BF1AB6BA3AC3E8F0"><section id="HA54CA27C3DEB49799F7BED2B2E913C92"><enum>2408.</enum><header>Release</header><subsection id="HA8AB532C040148299B33F203BEB04CE8"><enum>(a)</enum><header>In general</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the portions of the Dominguez Canyon Wilderness Study Area not designated as wilderness by this subtitle have been adequately studied for wilderness designation.</text></subsection><subsection id="H365426C020E24E7CB2900380F0EF9677"><enum>(b)</enum><header>Release</header><text>Any public land referred to in subsection (a) that is not designated as wilderness by this subtitle—</text><paragraph id="H95F464A1DF6F497DBD8D01B4D4543ED9"><enum>(1)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></paragraph><paragraph id="H818B5A64CAE7435AB761F3846BC8BBBC"><enum>(2)</enum><text>shall be managed in accordance with this subtitle and any other applicable laws.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8A2F853FA64C4BAC8FA0852CF8CC2C1C"><enum>(b)</enum><header>McKenna peak wilderness study area</header><paragraph id="H1FC2ABFFC4B14FC38D8DF179AF64404F"><enum>(1)</enum><header>In general</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the portions of the McKenna Peak Wilderness Study Area in San Miguel County in the State not designated as wilderness by paragraph (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202) have been adequately studied for wilderness designation.</text></paragraph><paragraph id="H17E9D7E927C94BCC8054E05CD53F087F"><enum>(2)</enum><header>Release</header><text>Any public land referred to in paragraph (1) that is not designated as wilderness by paragraph (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202)—</text><subparagraph id="H50A6C0A4B58C4670B8229FAE233823B5"><enum>(A)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></subparagraph><subparagraph id="HC0EB7202FDE6408993D845EC469B42BF"><enum>(B)</enum><text>shall be managed in accordance with applicable laws.</text></subparagraph></paragraph></subsection></section><section id="HE2F84A654A52425299CC3DE9D93A176B"><enum>205.</enum><header>Administrative provisions</header><subsection id="H1AD7029CED1447049BDACB8C42989A69"><enum>(a)</enum><header>Fish and wildlife</header><text>Nothing in this title affects the jurisdiction or responsibility of the State with respect to fish and wildlife in the State.</text></subsection><subsection id="HFB11A58300C54CB598053DE3C5382F96"><enum>(b)</enum><header>No buffer zones</header><paragraph id="H89789A7F12C94CC88D330A74D0BA1972"><enum>(1)</enum><header>In general</header><text>Nothing in this title establishes a protective perimeter or buffer zone around covered land.</text></paragraph><paragraph id="HD3D9BFF6DEB84F3F8089504564D6143E"><enum>(2)</enum><header>Activities outside wilderness</header><text>The fact that a nonwilderness activity or use on land outside of the covered land can be seen or heard from within covered land shall not preclude the activity or use outside the boundary of the covered land.</text></paragraph></subsection><subsection id="id65453E031CF149148E6D46754067B5A3"><enum>(c)</enum><header>Tribal rights and uses</header><paragraph id="idac5820a6e04744c997b2b10338c3c9d3"><enum>(1)</enum><header>Treaty rights</header><text>Nothing in this title affects the treaty rights of any Indian Tribe, including rights under the Agreement of September 13, 1873, ratified by the Act of April 29, 1874 (18 Stat. 36, chapter 136).</text></paragraph><paragraph id="id63245ef2331a4f008f259f6ebf9d1210"><enum>(2)</enum><header>Traditional tribal uses</header><text>Subject to any terms and conditions as the Secretary determines to be necessary and in accordance with applicable law, the Secretary shall allow for the continued use of the covered land by members of Indian Tribes—</text><subparagraph id="id51581ece782f437caac5a9ebf92f00d6"><enum>(A)</enum><text>for traditional ceremonies; and</text></subparagraph><subparagraph id="ide13ca768ffcc44c0833d6d3d129699ee"><enum>(B)</enum><text>as a source of traditional plants and other materials.</text></subparagraph></paragraph></subsection><subsection id="H4F00A2BFA74D4FC5B897E77028AA0D0B"><enum>(d)</enum><header>Maps and legal descriptions</header><paragraph id="H30ADB48F114B4211AACA7DBEA9E9080B"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary or the Secretary of the Interior, as appropriate, shall file a map and a legal description of each wilderness area designated by paragraphs (27) through (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202) and the Special Management Areas with—</text><subparagraph id="HA5F000E002D94FF2B9FEF9760DF37137"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph><subparagraph id="H55761ED307B34D1786AE00B9D2F18ECF"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph><paragraph id="H9AB919A1ECAE49D89620EFFFBBB3D3A9"><enum>(2)</enum><header>Force of law</header><text>Each map and legal description filed under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary or the Secretary of the Interior, as appropriate, may correct any typographical errors in the maps and legal descriptions.</text></paragraph><paragraph id="H971BC034E25C4C0E9683D1E46404A257"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management and the Forest Service.</text></paragraph></subsection><subsection id="H79A596BD771B43938DEE4C8119045434"><enum>(e)</enum><header>Acquisition of land</header><paragraph id="ide50d329dadae4b57862b2845db9771a9"><enum>(1)</enum><header>In general</header><text>The Secretary or the Secretary of the Interior, as appropriate, may acquire any land or interest in land within the boundaries of a Special Management Area or the wilderness designated under paragraphs (27) through (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202) by donation, purchase from a willing seller, or exchange.</text></paragraph><paragraph id="H17FC11DE0E2040AAAA9BEF5E0C31FFB1"><enum>(2)</enum><header>Management</header><text>Any land or interest in land acquired under paragraph (1) shall be incorporated into, and administered as a part of, the wilderness or Special Management Area in which the land or interest in land is located.</text></paragraph></subsection><subsection id="HD25F784354574389A1F263CC913C1700"><enum>(f)</enum><header>Grazing</header><text>The grazing of livestock on covered land, if established before the date of enactment of this Act, shall be permitted to continue subject to such reasonable regulations as are considered to be necessary by the Secretary with jurisdiction over the covered land, in accordance with—</text><paragraph id="HC828F5C080684BDC9EB1169EB81C1ACB"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph><paragraph id="HB3B00AF265164D0DB0E374CA77AB0C81"><enum>(2)</enum><text>the applicable guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405) or H.R. 5487 of the 96th Congress (H. Rept. 96–617).</text></paragraph></subsection><subsection id="HDB113E57B9FD4A499186484DBC2830F9"><enum>(g)</enum><header>Fire, insects, and diseases</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary with jurisdiction over a wilderness area designated by paragraphs (27) through (29) of section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>) (as added by section 202) may carry out any activity in the wilderness area that the Secretary determines to be necessary for the control of fire, insects, and diseases, subject to such terms and conditions as the Secretary determines to be appropriate.</text></subsection><subsection id="H76729C03852E4D729F8BB4E1965D6C3A"><enum>(h)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the covered land and the approximately 6,590 acres generally depicted on the map entitled <quote>Proposed Naturita Canyon Mineral Withdrawal Area</quote> and dated September 6, 2018, is withdrawn from—</text><paragraph id="H04BD431CD15A48A58675316C0D185620"><enum>(1)</enum><text>entry, appropriation, and disposal under the public land laws;</text></paragraph><paragraph id="H5628CD799E5041F09EE05E0121FEBD78"><enum>(2)</enum><text>location, entry, and patent under mining laws; and</text></paragraph><paragraph id="H627FB0FB4E2243E68442B248E476553B"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection></section></title><title id="HD501D6794C17469F9DC771F75E56C2B1"><enum>III</enum><header>Thompson Divide</header><section id="HECD9869B6B6E45F89EEEB72964382FE0"><enum>301.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text><paragraph id="H0A4C1FA5BBA64B258FE441A9BF5707BF"><enum>(1)</enum><text>subject to valid existing rights, to withdraw certain Federal land in the Thompson Divide area from mineral and other disposal laws in order to protect the agricultural, ranching, wildlife, air quality, recreation, ecological, and scenic values of the area; and </text></paragraph><paragraph id="HB216702910A34048B1FB6FBDC2AC5809"><enum>(2)</enum><text>to promote the capture of fugitive methane emissions that would otherwise be emitted into the atmosphere.</text></paragraph></section><section id="H8F02DBB16D7C43D59FB9C4089313E16F"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id91250c84358147bc86ba6faaefe4cd3d"><enum>(1)</enum><header>Fugitive methane emissions</header><text>The term <term>fugitive methane emissions</term> means methane gas from the Federal land or interests in Federal land in Garfield, Gunnison, Delta, or Pitkin County in the State, within the boundaries of the <quote>Fugitive Coal Mine Methane Use Pilot Program Area</quote>, as generally depicted on the pilot program map, that would leak or be vented into the atmosphere from—</text><subparagraph id="id350d6132d3204aaa9c34bdb131356862"><enum>(A)</enum><text>an active or inactive coal mine subject to a Federal coal lease; or</text></subparagraph><subparagraph id="idb822c36bc2ce4029892092e5bba6e9e1"><enum>(B)</enum><text>an abandoned underground coal mine or the site of a former coal mine—</text><clause id="id20457530f23b4f31b34baddbaa72e569"><enum>(i)</enum><text>that is not subject to a Federal coal lease; and</text></clause><clause id="idd6c7c5ef575a4c71be4abf60e66e6d78"><enum>(ii)</enum><text>with respect to which the Federal interest in land includes mineral rights to the methane gas. </text></clause></subparagraph></paragraph><paragraph id="H03D57C3CCFCC4747B460DAD3E5C52DAC"><enum>(2)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the Greater Thompson Divide Fugitive Coal Mine Methane Use Pilot Program established by section 305(a)(1).</text></paragraph><paragraph id="H16C685B0FD4E40D39745C41F27711694"><enum>(3)</enum><header>Pilot program map</header><text>The term <term>pilot program map</term> means the map entitled <quote>Greater Thompson Divide Fugitive Coal Mine Methane Use Pilot Program Area</quote> and dated April 29, 2022.</text></paragraph><paragraph id="H99F0CC0472994DC990534CD43BBA5227"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HF9E1DBA3C3A14529852B1A81227C8910"><enum>(5)</enum><header>Thompson divide lease</header><subparagraph id="H0AC9A5BF162B4B0D910BEC6B742A348C"><enum>(A)</enum><header>In general</header><text>The term <term>Thompson Divide lease</term> means any oil or gas lease in effect on the date of enactment of this Act within the Thompson Divide Withdrawal and Protection Area.</text></subparagraph><subparagraph id="HFD6070073416444E9B959CA01EE04933"><enum>(B)</enum><header>Exclusions</header><text>The term <term>Thompson Divide lease</term> does not include any oil or gas lease that—</text><clause id="HF6103B64B4DC4D668F59B17F06099501"><enum>(i)</enum><text>is associated with a Wolf Creek Storage Field development right; or</text></clause><clause id="H10FA3B52E10B408485E0EA90167F1D10"><enum>(ii)</enum><text>before the date of enactment of this Act, has expired, been cancelled, or otherwise terminated.</text></clause></subparagraph></paragraph><paragraph id="HE714952CBE29493FB49570B807496AE8"><enum>(6)</enum><header>Thompson divide map</header><text>The term <term>Thompson Divide map</term> means the map entitled <quote>Greater Thompson Divide Area Map</quote> and dated May 15, 2023.</text></paragraph><paragraph id="id78b86e5db68140b9ae488475ad98bbbd"><enum>(7)</enum><header>Thompson divide withdrawal and protection area</header><text>The term <term>Thompson Divide Withdrawal and Protection Area</term> means the Federal land and minerals within the area generally depicted as the <quote>Thompson Divide Withdrawal and Protection Area</quote> on the Thompson Divide map. </text></paragraph><paragraph id="H9B3E1E462DC749948F0B2AE080E91C30"><enum>(8)</enum><header>Wolf creek storage field development right</header><subparagraph id="id31cbd552797b41d681612fa1e7f9ebed"><enum>(A)</enum><header>In general</header><text>The term <term>Wolf Creek Storage Field development right</term> means a development right for any of the Federal mineral leases numbered COC 0007496, COC 0007497, COC 0007498, COC 0007499, COC 0007500, COC 0007538, COC 0008128, COC 0015373, COC 0128018, COC 0051645, and COC 0051646, as generally depicted on the Thompson Divide map as <quote>Wolf Creek Storage Agreement</quote>.</text></subparagraph><subparagraph id="H7BD758B9FBE74BBEB611936B23F38781"><enum>(B)</enum><header>Exclusions</header><text>The term <term>Wolf Creek Storage Field development right</term> does not include any storage right or related activity within the area described in subparagraph (A).</text></subparagraph></paragraph></section><section id="H43AA3329D5F44917A2DA24F4E30B8C5F"><enum>303.</enum><header>Thompson Divide Withdrawal and Protection Area</header><subsection id="H487B6923D230493D81D89BB9AB10705C"><enum>(a)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the Thompson Divide Withdrawal and Protection Area is withdrawn from—</text><paragraph id="H65D257E82C1240D59BD67D2780086FDC"><enum>(1)</enum><text>entry, appropriation, and disposal under the public land laws;</text></paragraph><paragraph id="H9D698E01E8464E3D8C6E3C9A498E4084"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="HCFA0203B580B413CBB174262056AB9BB"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection><subsection id="H8D29FC24526848EFA799BE3FCC5853E8"><enum>(b)</enum><header>Surveys</header><text>The exact acreage and legal description of the Thompson Divide Withdrawal and Protection Area shall be determined by surveys approved by the Secretary, in consultation with the Secretary of Agriculture.</text></subsection><subsection id="HF9F3AE00AC0C4335A1BFFD482578BAF8"><enum>(c)</enum><header>Grazing</header><text display-inline="yes-display-inline">Nothing in this title affects the administration of grazing in the Thompson Divide Withdrawal and Protection Area.</text></subsection></section><section id="HB37ED3B49AB0452EBCE30DDBF937913F"><enum>304.</enum><header>Thompson Divide lease credits</header><subsection id="HBAC82382F8D94ECFB4ED54D426A64292"><enum>(a)</enum><header>In general</header><text>In exchange for the relinquishment by a leaseholder of all Thompson Divide leases of the leaseholder, the Secretary may issue to the leaseholder credits for any bid, royalty, or rental payment due under any Federal oil or gas lease on Federal land in the State, in accordance with subsection (b).</text></subsection><subsection id="H0230B529B928466EADA1D33595B46063"><enum>(b)</enum><header>Amount of credits</header><paragraph id="HD9CF4E46C2384ECDA66C0D57789CB2E6"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amount of the credits issued to a leaseholder of a Thompson Divide lease relinquished under subsection (a) shall—</text><subparagraph id="H469FDF7176654BB696A2BAA048CE7E9C"><enum>(A)</enum><text>be equal to the sum of—</text><clause id="H57FA6C0E2DF1439AA4184762A3EBBA9F"><enum>(i)</enum><text>the amount of the bonus bids paid for the applicable Thompson Divide leases;</text></clause><clause id="H8C8D718388124EA7949AA59CE2D52D97"><enum>(ii)</enum><text>the amount of any rental paid for the applicable Thompson Divide leases as of the date on which the leaseholder submits to the Secretary a notice of the decision to relinquish the applicable Thompson Divide leases; and</text></clause><clause id="H24862E1E6E844A74B1ED1E60D8A3A68C"><enum>(iii)</enum><text>the amount of any reasonable expenses incurred by the leaseholder of the applicable Thompson Divide leases in the preparation of any drilling permit, sundry notice, or other related submission in support of the development of the applicable Thompson Divide leases as of January 28, 2019, including any expenses relating to the preparation of any analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></clause></subparagraph><subparagraph id="HF70532E976D4489F97501EAF07D8A7D4"><enum>(B)</enum><text>require the approval of the Secretary.</text></subparagraph></paragraph><paragraph id="ide5e41e218b4d4413a035e4be7205b05c"><enum>(2)</enum><header>Exclusion</header><text>The amount of a credit issued under subsection (a) shall not include any expenses paid by the leaseholder of a Thompson Divide lease for—</text><subparagraph id="ide332bb5bab1140fa9e16fd2e4367c93e"><enum>(A)</enum><text>legal fees or related expenses for legal work with respect to a Thompson Divide lease; or</text></subparagraph><subparagraph id="id8c2739bcb93b4e5d95b551af5d38b566"><enum>(B)</enum><text>any expenses incurred before the issuance of a Thompson Divide lease. </text></subparagraph></paragraph></subsection><subsection id="H34721B558B22448B91123E3C70E99CAE"><enum>(c)</enum><header>Cancellation</header><text>Effective on relinquishment under this section, and without any additional action by the Secretary, a Thompson Divide lease—</text><paragraph id="H0EC1344AED8F441B9EA4FFC3EFD791F8"><enum>(1)</enum><text>shall be permanently cancelled; and</text></paragraph><paragraph id="HD4CC910A9D044702BF451E3DBB0FE368"><enum>(2)</enum><text>shall not be reissued.</text></paragraph></subsection><subsection id="H5009FB1D3B984B838835BDA105686920"><enum>(d)</enum><header>Conditions</header><paragraph id="HD512EB358C264C4C873A555C1F04681C"><enum>(1)</enum><header>Applicable law</header><text>Except as otherwise provided in this section, each exchange under this section shall be conducted in accordance with—</text><subparagraph id="H85553687A55C498EB69406929B3829A2"><enum>(A)</enum><text>this title; and</text></subparagraph><subparagraph id="H0366B5D4EC934864A531D10E8517CC47"><enum>(B)</enum><text>other applicable laws (including regulations).</text></subparagraph></paragraph><paragraph id="HA26C11E7F70344C1B53E80C056D04905"><enum>(2)</enum><header>Acceptance of credits</header><text>The Secretary shall accept credits issued under subsection (a) in the same manner as cash for the payments described in that subsection.</text></paragraph><paragraph id="H73CD5AFD8F3F43AFA44CA95070795BE8"><enum>(3)</enum><header>Applicability</header><text>The use of a credit issued under subsection (a) shall be subject to the laws (including regulations) applicable to the payments described in that subsection, to the extent that the laws are consistent with this section.</text></paragraph><paragraph id="H5FC0C32EEFD74168B9025848083FC67D"><enum>(4)</enum><header>Treatment of credits</header><text>All amounts in the form of credits issued under subsection (a) accepted by the Secretary shall be considered to be amounts received for the purposes of—</text><subparagraph id="H0A47579BAE2941EE88ED4964132E7BAC"><enum>(A)</enum><text>section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>); and</text></subparagraph><subparagraph id="HDC9DC241442948D284BD3F65DF5CA2D2"><enum>(B)</enum><text>section 20 of the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1019">30 U.S.C. 1019</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HB254BCA254864E66B40A12BA002D5EBA"><enum>(e)</enum><header>Wolf creek storage field development rights</header><paragraph id="H7F027166B30349948F70098291E69206"><enum>(1)</enum><header>Conveyance to secretary</header><text>As a condition precedent to the relinquishment of a Thompson Divide lease under this section, any leaseholder with a Wolf Creek Storage Field development right shall permanently relinquish, transfer, and otherwise convey to the Secretary, in a form acceptable to the Secretary, all Wolf Creek Storage Field development rights of the leaseholder.</text></paragraph><paragraph id="id295e9905ad14432886875b124df95d56"><enum>(2)</enum><header>Credits</header><subparagraph id="id194cf1d0241846bcb4d0fdc06148a658"><enum>(A)</enum><header>In general</header><text>In consideration for the transfer of development rights under paragraph (1), the Secretary may issue to a leaseholder described in that paragraph credits for any reasonable expenses incurred by the leaseholder in acquiring the Wolf Creek Storage Field development right or in the preparation of any drilling permit, sundry notice, or other related submission in support of the development right as of January 28, 2019, including any reasonable expenses relating to the preparation of any analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph><subparagraph id="id8426dd6f6f744f6198b327aa8e16310a"><enum>(B)</enum><header>Approval</header><text>Any credits for a transfer of the development rights under paragraph (1), shall be subject to—</text><clause id="id0088af38e8164c6a9bfaa33297baf9f5"><enum>(i)</enum><text>the exclusion described in subsection (b)(2);</text></clause><clause id="ide47c5591de8a4a86be1febf84d05c866"><enum>(ii)</enum><text>the conditions described in subsection (d); and</text></clause><clause id="idd70fcf4048994a95bdf751c17fdcb8a6"><enum>(iii)</enum><text>the approval of the Secretary. </text></clause></subparagraph></paragraph><paragraph id="HA2B989C0C27A4479A69510A2CF28B6FE"><enum>(3)</enum><header>Limitation of transfer</header><text>Development rights acquired by the Secretary under paragraph (1)—</text><subparagraph id="id5e6aac11d8d740fda4982dbf7ec5b4c0"><enum>(A)</enum><text>shall be held for as long as the parent leases in the Wolf Creek Storage Field remain in effect; and </text></subparagraph><subparagraph id="HCA7926A3583F4537982D09EC957DDE19"><enum>(B)</enum><text>shall not be—</text><clause id="HEA5210C1677B4F369229219B9167C6AA"><enum>(i)</enum><text>transferred;</text></clause><clause id="HB519E32251194FA1B9ED23613A609F7C"><enum>(ii)</enum><text>reissued; or</text></clause><clause id="H80F0FD55B7FF4344B48FF23FC81D3877"><enum>(iii)</enum><text>otherwise used for mineral extraction.</text></clause></subparagraph></paragraph></subsection></section><section id="HCCB10F5A87164098999247BA95989C68"><enum>305.</enum><header>Greater Thompson Divide Fugitive Coal Mine Methane Use Pilot Program</header><subsection id="H0EE8423E93CD4D37B845430D1B758346"><enum>(a)</enum><header>Fugitive coal mine methane use pilot program</header><paragraph id="H367647C987D44818BCA0F7D95EC664EB"><enum>(1)</enum><header>Establishment</header><text>There is established in the Bureau of Land Management a pilot program, to be known as the <quote>Greater Thompson Divide Fugitive Coal Mine Methane Use Pilot Program</quote>.</text></paragraph><paragraph id="H2E1C6B436BD44D79AF9AF369C6B96BE6"><enum>(2)</enum><header>Purpose</header><text>The purpose of the pilot program is to promote the capture, beneficial use, mitigation, and sequestration of fugitive methane emissions—</text><subparagraph id="HAE09AADA00C7406598F9644CAD5B1B50"><enum>(A)</enum><text>to reduce methane emissions;</text></subparagraph><subparagraph id="H8F9B551E2D204E74A9596D9F66E99FB6"><enum>(B)</enum><text>to promote economic development;</text></subparagraph><subparagraph id="H05F45345864D4C7A9B6E511FDBBB2CCF"><enum>(C)</enum><text>to improve air quality; and</text></subparagraph><subparagraph id="HFB4D7043625748F291FA27FB732771DF"><enum>(D)</enum><text>to improve public safety.</text></subparagraph></paragraph><paragraph id="HF3915777BABA45C58992CE82C0AE6CDF"><enum>(3)</enum><header>Plan</header><subparagraph id="HC6C9332867C8416CB4FDCAF82A6BAED4"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall develop a plan—</text><clause id="HC7668C5C4E524BDEB9E256BEA655014F"><enum>(i)</enum><text>to complete an inventory of fugitive methane emissions in accordance with subsection (b);</text></clause><clause id="H75B645D5EA2E4170B3D5BE01BB1A0F85"><enum>(ii)</enum><text>to provide for the leasing of fugitive methane emissions in accordance with subsection (c); and</text></clause><clause id="HD845EE1FCEB34E02940F5FB5588B136B"><enum>(iii)</enum><text>to provide for the capping or destruction of fugitive methane emissions in accordance with subsection (d).</text></clause></subparagraph><subparagraph id="H58C7A7EA9A884593A088D057FBC8CE6B"><enum>(B)</enum><header>Coordination</header><text>In developing the plan under this paragraph, the Secretary shall coordinate with—</text><clause id="H65667FF8380A49B28108F02AA012640A"><enum>(i)</enum><text>the State;</text></clause><clause id="H2B5EDFD52F2042B1840118B4DB34C0D5"><enum>(ii)</enum><text>Garfield, Gunnison, Delta, and Pitkin Counties in the State;</text></clause><clause id="HD886F48969134884B834430E26B898E5"><enum>(iii)</enum><text>lessees of Federal coal within the counties referred to in clause (ii);</text></clause><clause id="H373E9B6FDE724B8F94C25D175ACC32AA"><enum>(iv)</enum><text>interested institutions of higher education in the State; and</text></clause><clause id="H733FD5B1B8124FB1BB9DAEBA3A64FA24"><enum>(v)</enum><text>interested members of the public.</text></clause></subparagraph></paragraph></subsection><subsection id="H254EF8C1C7974716B1106E59AF1372DE"><enum>(b)</enum><header>Fugitive methane emissions inventory</header><paragraph id="idc1ff33a5381b4660b3a73b05f160bfe8"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete an inventory of fugitive methane emissions.</text></paragraph><paragraph id="ideef5ac1494074c759d48279629d566bf"><enum>(2)</enum><header>Conduct</header><subparagraph id="id1FECA743CCF740B4BCE70E4C4E0E9E64"><enum>(A)</enum><header>Collaboration</header><text>The Secretary may conduct the inventory under paragraph (1) through, or in collaboration with—</text><clause id="id59A507E3A9524A478C8D4139C08A9D4D"><enum>(i)</enum><text>the Bureau of Land Management;</text></clause><clause id="id62C0D8ECED044187861E51733592671D"><enum>(ii)</enum><text>the United States Geological Survey;</text></clause><clause id="idADF176D43DCE4375AB301AA6955BD9FC"><enum>(iii)</enum><text>the Environmental Protection Agency;</text></clause><clause id="idB743856DA89A480DBA7454639185F8C7"><enum>(iv)</enum><text>the United States Forest Service;</text></clause><clause id="idD6CE23CF4B5543FCA4794B59225BD0DB"><enum>(v)</enum><text>State departments or agencies;</text></clause><clause id="idF2D0CEDB83E64ECEA0456ABB8297F724"><enum>(vi)</enum><text>Garfield, Gunnison, Delta, or Pitkin County in the State;</text></clause><clause id="id12ADD32824AC4BFA9629354995A88D27"><enum>(vii)</enum><text>the Garfield County Federal Mineral Lease District;</text></clause><clause id="idAFAA5564C4C94B2C9BC1A6A8BC758FA1"><enum>(viii)</enum><text>institutions of higher education in the State;</text></clause><clause id="idBE0FDAB147B448C191CA60E1859A87E2"><enum>(ix)</enum><text>lessees of Federal coal within a county referred to in subparagraph (F);</text></clause><clause id="idF53616116D6B409D9AE46731C10A8C36"><enum>(x)</enum><text>the National Oceanic and Atmospheric Administration;</text></clause><clause id="idD14609046D874A6FB9A219855CAA0EC7"><enum>(xi)</enum><text>the National Center for Atmospheric Research; or</text></clause><clause id="id8AF44079F9D24D208CD39BD8EBCCDE8D"><enum>(xii)</enum><text>other interested entities, including members of the public.</text></clause></subparagraph><subparagraph id="idD0855284051A4D1DA930FE0D5CC6AA08"><enum>(B)</enum><header>Federal split estate</header><clause id="idAD7A1E60EE144E539BC7EEB779EDFF74"><enum>(i)</enum><header>In general</header><text>In conducting the inventory under paragraph (1) for Federal minerals on split estate land, the Secretary shall rely on available data.</text></clause><clause id="id64BE85C4B4A545D68B6DE313AB5EA8C0"><enum>(ii)</enum><header>Limitation</header><text>Nothing in this section requires or authorizes the Secretary to enter or access private land to conduct the inventory under paragraph (1). </text></clause></subparagraph></paragraph><paragraph id="H8F02E360999A4DEDAB97A1918A0D8360"><enum>(3)</enum><header>Contents</header><text>The inventory conducted under paragraph (1) shall include—</text><subparagraph id="idab52dd4993f847e39a1e636670d83e28"><enum>(A)</enum><text>the general location and geographic coordinates of vents, seeps, or other sources producing significant fugitive methane emissions;</text></subparagraph><subparagraph id="iddc8ae53fb1b0411594b8c1e78a5dea3d"><enum>(B)</enum><text>an estimate of the volume and concentration of fugitive methane emissions from each source of significant fugitive methane emissions, including details of measurements taken and the basis for that emissions estimate; </text></subparagraph><subparagraph id="H797C9774C8A9474DB5124A2C029D8469"><enum>(C)</enum><text>relevant data and other information available from—</text><clause id="HC863102A0F614483B6EB7AEDEFE92E08"><enum>(i)</enum><text>the Environmental Protection Agency;</text></clause><clause id="H10AFE4C1AD554FFC9BF6F719B9732811"><enum>(ii)</enum><text>the Mine Safety and Health Administration;</text></clause><clause id="H347B4888021645E6B38B3C28E8CEFEB4"><enum>(iii)</enum><text>the Colorado Department of Natural Resources;</text></clause><clause id="HA8B67AD46761436280EDFB003B76A3F5"><enum>(iv)</enum><text>the Colorado Public Utility Commission;</text></clause><clause id="HB97A5F8669D644F3A50853A555491EA3"><enum>(v)</enum><text>the Colorado Department of Health and Environment; and</text></clause><clause id="H92B1619721E64D68BEF52F11C481F631"><enum>(vi)</enum><text>the Office of Surface Mining Reclamation and Enforcement; and</text></clause></subparagraph><subparagraph id="H8FC5F8D224A5439DAD2DBAF6D31DCE59"><enum>(D)</enum><text>such other information as may be useful in advancing the purposes of the pilot program.</text></subparagraph></paragraph><paragraph id="H8080D0F7A8C54CBEBF1D9C283ECECE17"><enum>(4)</enum><header>Public participation; disclosure</header><subparagraph id="id237e79d330014928b8ec808fe32ddc02"><enum>(A)</enum><header>Public participation</header><text>The Secretary shall, as appropriate, provide opportunities for public participation in the conduct of the inventory under paragraph (1).</text></subparagraph><subparagraph id="H04023FA3384C4D338619C523BBFB794C"><enum>(B)</enum><header>Availability</header><text>The Secretary shall make the inventory conducted under paragraph (1) publicly available.</text></subparagraph><subparagraph id="HA3E0561CF01D43A39D3FEAFD33EC5E4D"><enum>(C)</enum><header>Disclosure</header><text>Nothing in this subsection requires the Secretary to publicly release information that—</text><clause id="H55C75FF5A7D342A0851039659A9B8182"><enum>(i)</enum><text>poses a threat to public safety;</text></clause><clause id="HDBBCCCFBB69541D08B99C8D0D2F93490"><enum>(ii)</enum><text>is confidential business information; or</text></clause><clause id="H03E17DC135B3423D86B348E88E016019"><enum>(iii)</enum><text>is otherwise protected from public disclosure.</text></clause></subparagraph></paragraph><paragraph id="idfd3e65e9a0814bcc9d7ab9a8492394b4"><enum>(5)</enum><header>Impact on coal mines subject to lease</header><subparagraph id="idF9D27BD2AF144787A0B47615CB224580"><enum>(A)</enum><header>In general</header><text>For the purposes of conducting the inventory under paragraph (1), for land subject to a Federal coal lease, the Secretary shall use readily available methane emissions data.</text></subparagraph><subparagraph id="id3684E6F3B7884B9B98B65409E5FE4259"><enum>(B)</enum><header>Effect</header><text>Nothing in this section requires the holder of a Federal coal lease to report additional data or information to the Secretary. </text></subparagraph></paragraph><paragraph id="HEF166F6735B44EE0A82274CE7309D880"><enum>(6)</enum><header>Use</header><text>The Secretary shall use the inventory conducted under paragraph (1) in carrying out—</text><subparagraph id="H27AED78B922B4BA0A7B1FA003382034B"><enum>(A)</enum><text>the leasing program under subsection (c); and</text></subparagraph><subparagraph id="H0B2D549E09904C70AFF213740B054EB0"><enum>(B)</enum><text>the capping or destruction of fugitive methane emissions under subsection (d).</text></subparagraph></paragraph></subsection><subsection id="H7BB39135C05B4F3094D91C1F3B1FF872"><enum>(c)</enum><header>Fugitive methane emissions leasing program and sequestration</header><paragraph id="idfc58ea51dd194b20a631ba73aa1ae98d"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and in accordance with this section, not later than 1 year after the date of completion of the inventory required under subsection (b), the Secretary shall carry out a program to encourage the use and destruction of fugitive methane emissions.</text></paragraph><paragraph id="H36B8FE05E30C49BB88D4B4856704C776"><enum>(2)</enum><header>Fugitive methane emissions from coal mines subject to lease</header><subparagraph id="ide38bc428e9404ab394ca83e6e2781c48"><enum>(A)</enum><header>In general</header><text>The Secretary shall authorize the holder of a valid existing Federal coal lease for a mine that is producing fugitive methane emissions to capture for use or destroy the fugitive methane emissions.</text></subparagraph><subparagraph id="HE68260A6E8874675B3B3710A3DCD3643"><enum>(B)</enum><header>Conditions</header><text>The authority under subparagraph (A) shall be subject to—</text><clause id="H483231CCD15147AEA8EB11DF2C3A3DF1"><enum>(i)</enum><text>valid existing rights; and</text></clause><clause id="H2A8B7D37617C4FC5B2AAC99CAB642FBE"><enum>(ii)</enum><text>such terms and conditions as the Secretary may require.</text></clause></subparagraph><subparagraph id="id7d4342cecb6f40d59a1206da8b7cc942"><enum>(C)</enum><header>Limitations</header><text>The program carried out under paragraph (1) shall only include fugitive methane emissions that can be captured for use or destroyed in a manner that does not— </text><clause id="H8AB7DD5E21C24D85AAFD6E9B823FF427"><enum>(i)</enum><text>endanger the safety of any coal mine worker; or</text></clause><clause id="HB4251893FB204F448F489BE81F7B6B45"><enum>(ii)</enum><text>unreasonably interfere with any ongoing operation at a coal mine.</text></clause></subparagraph><subparagraph id="HFD5A2203A97045BFBF4345CC33FE239F"><enum>(D)</enum><header>Cooperation</header><clause id="H865165FE720740DABF932014E4A67C66"><enum>(i)</enum><header>In general</header><text>The Secretary shall work cooperatively with the holders of valid existing Federal coal leases for mines that produce fugitive methane emissions to encourage—</text><subclause id="H6ED1248DABE44E4D89A6414200C632EB"><enum>(I)</enum><text>the capture of fugitive methane emissions for beneficial use, such as generating electrical power, producing usable heat, transporting the methane to market, or transforming the fugitive methane emissions into a different marketable material; or</text></subclause><subclause id="H1CA8FF95C2F84AC8B160C4598DB79B6A"><enum>(II)</enum><text>if the beneficial use of the fugitive methane emissions is not feasible, the destruction of the fugitive methane emissions.</text></subclause></clause><clause id="id1254e9f55a5a4b5580bda293bcb3a2d7"><enum>(ii)</enum><header>Guidance</header><text>In support of cooperative efforts with holders of valid existing Federal coal leases to capture for use or destroy fugitive methane emissions, not later than 1 year after the date of enactment of this Act, the Secretary shall issue guidance to the public for the implementation of authorities and programs to encourage the capture for use and destruction of fugitive methane emissions, while minimizing impacts on natural resources or other public interest values. </text></clause></subparagraph><subparagraph id="H1DC293125DC54E858FC0E354442004C5"><enum>(E)</enum><header>Royalties</header><text>The Secretary shall determine whether any fugitive methane emissions used or destroyed pursuant to this paragraph are subject to the payment of a royalty under applicable law.</text></subparagraph></paragraph><paragraph id="id531661e102f24f9fb7198b449379eda0"><enum>(3)</enum><header>Fugitive methane emissions from land not subject to a Federal coal lease</header><subparagraph id="idf398a6d9d97c44819e2a8e0c74565cc5"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this section, notwithstanding section 303 and subject to valid existing rights and any other applicable law, the Secretary shall, for land not subject to a Federal coal lease—</text><clause id="id1531027c968e4a03812142a3980ec4e4"><enum>(i)</enum><text>authorize the capture for use or destruction of fugitive methane emissions; and</text></clause><clause id="id3c3575d035cb4d0ab5d0e5b674aa6985"><enum>(ii)</enum><text>make available for leasing such fugitive methane emissions as the Secretary determines to be in the public interest.</text></clause></subparagraph><subparagraph id="id2a839c991f914e8fa940df158fc8192c"><enum>(B)</enum><header>Source</header><text>To the extent practicable, the Secretary shall offer for lease, individually or in combination, each significant source of fugitive methane emissions on land not subject to a Federal coal lease. </text></subparagraph><subparagraph id="HCC571825D22D4AF8BA11D4C29EA4D3E0"><enum>(C)</enum><header>Bid qualifications</header><text>A bid to lease fugitive methane emissions under this paragraph shall specify whether the prospective lessee intends—</text><clause id="HCAE12183738B414A97114E0856757C85"><enum>(i)</enum><text>to capture the fugitive methane emissions for beneficial use, such as generating electrical power, producing usable heat, transporting the methane to market, or transforming the fugitive methane emissions into a different marketable material;</text></clause><clause id="HDA44F9F22A4D41589CACBC87BF695835"><enum>(ii)</enum><text>to destroy the fugitive methane emissions; or</text></clause><clause id="HD9D8EAB1B5D947D2945E4BADD744DFB2"><enum>(iii)</enum><text>to employ a specific combination of—</text><subclause id="HC4304A282F894B0DA3E90F5958644BD2"><enum>(I)</enum><text display-inline="yes-display-inline">capturing the fugitive methane emissions for beneficial use; and</text></subclause><subclause id="H7ED5658E4B1C4566A03DABE1AEFEF866"><enum>(II)</enum><text>destroying the fugitive methane emissions.</text></subclause></clause></subparagraph><subparagraph id="H6EF9E7929D9D40AA9AB47E9B77CF1657"><enum>(D)</enum><header>Priority</header><clause id="HBB3B3C5B29AB4AAF86BC6D806A2CC8D4"><enum>(i)</enum><header>In general</header><text>If there is more than 1 qualified bid for a lease under this paragraph, the Secretary shall select the bid that the Secretary determines is likely to most significantly advance the public interest.</text></clause><clause id="HF07516F7AAF74F4D8FE26B2A65CD9F60"><enum>(ii)</enum><header>Considerations</header><text>In determining the public interest under clause (i), the Secretary shall take into consideration—</text><subclause id="id03b113e16c034ff79d6f6f13ead45ce3"><enum>(I)</enum><text>the overall decrease in the fugitive methane emissions; </text></subclause><subclause id="HD8385B5C225443F889EE16246A2ED79D"><enum>(II)</enum><text>the impacts to other natural resource values, including wildlife, water, and air; and</text></subclause><subclause id="H0281A9AA2F7B44EAAE5C1CCDFD0B586B"><enum>(III)</enum><text>other public interest values, including scenic, economic, recreation, and cultural values.</text></subclause></clause></subparagraph><subparagraph id="H969B885220CC4DD18FEE7DD9E70F8230"><enum>(E)</enum><header>Lease form</header><clause id="H160C5334BE164EBD80090FE30B26DA0D"><enum>(i)</enum><header>In general</header><text>The Secretary shall develop and provide to prospective bidders a lease form for leases issued under this paragraph.</text></clause><clause id="id49753140b1dc4fc5b25de2b2165d5e42"><enum>(ii)</enum><header>Due diligence</header><text>The lease form developed under clause (i) shall include terms and conditions requiring the leased fugitive methane emissions to be put to beneficial use or destroyed by not later than 3 years after the date of issuance of the lease.</text></clause></subparagraph><subparagraph id="id3d2d61552a764461956372889b4141cd"><enum>(F)</enum><header>Royalty rate</header><text>The Secretary shall develop a minimum bid, as the Secretary determines to be necessary, and royalty rate for leases under this paragraph.</text></subparagraph></paragraph></subsection><subsection id="id17746c8831f6479683d0cdf051b5eedd"><enum>(d)</enum><header>Sequestration</header><text>If, by not later than 4 years after the date of completion of the inventory under subsection (b), any significant fugitive methane emissions are not leased under subsection (c)(3), the Secretary shall, subject to the availability of appropriations and in accordance with applicable law, take all reasonable measures— </text><paragraph id="id0672f6c56eda42c293de0a01b6a0a321"><enum>(1)</enum><text>to provide incentives for new leases under subsection (c)(3);</text></paragraph><paragraph id="idd0adc5200be44f0a8859f7a1dadd4fd1"><enum>(2)</enum><text>to cap those fugitive methane emissions at the source in any case in which the cap will result in the long-term sequestration of all or a significant portion of the fugitive methane emissions; or</text></paragraph><paragraph id="id42682233afaf42e2be8e879e2ae87593"><enum>(3)</enum><text>to destroy the fugitive methane emissions, if incentivizing leases under paragraph (1) or sequestration under paragraph (2) is not feasible, with priority for locations that destroy the greatest quantity of fugitive methane emissions at the lowest cost. </text></paragraph></subsection><subsection id="HBE73458CE5D0455892D7C486F7AF98C1"><enum>(e)</enum><header>Report to Congress</header><text>Not later than 4 years after the date of enactment of this Act the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report detailing—</text><paragraph id="HB83C5ECE91DD4D8092C50CD407CF43CC"><enum>(1)</enum><text>the economic and environmental impacts of the pilot program, including information on increased royalties and estimates of avoided greenhouse gas emissions; and</text></paragraph><paragraph id="id7dbda8a4c43c4dfca53be3591254d106"><enum>(2)</enum><text>any recommendations of the Secretary on whether the pilot program could be expanded to include—</text><subparagraph id="idc0a2d2c6b13c4cf6bff99fa2b5ee7c08"><enum>(A)</enum><text>other significant sources of emissions of fugitive methane located outside the boundaries of the area depicted as <quote>Fugitive Coal Mine Methane Use Pilot Program Area</quote> on the pilot program map; and</text></subparagraph><subparagraph id="id523eccb300b04d3c9db5f97e3ba1664e"><enum>(B)</enum><text>the leasing of natural methane seeps under the activities authorized pursuant to subsection (c)(3). </text></subparagraph></paragraph></subsection></section><section id="H8D271CECFCAB4F498B48ACAA14B7D1D3"><enum>306.</enum><header>Effect</header><text display-inline="no-display-inline">Except as expressly provided in this title, nothing in this title—</text><paragraph id="H5026BA329F6A496BAF6AC8CE0A8E9172"><enum>(1)</enum><text>expands, diminishes, or impairs any valid existing mineral leases, mineral interest, or other property rights wholly or partially within the Thompson Divide Withdrawal and Protection Area, including access to the leases, interests, rights, or land in accordance with applicable Federal, State, and local laws (including regulations);</text></paragraph><paragraph id="H118C14855199458DB5DB5E3294E6F73D"><enum>(2)</enum><text>prevents the capture of methane from any active, inactive, or abandoned coal mine covered by this title, in accordance with applicable laws; or</text></paragraph><paragraph id="H2071F780E7FC478685355986D7094DED"><enum>(3)</enum><text>prevents access to, or the development of, any new or existing coal mine or lease in Delta or Gunnison County in the State.</text></paragraph></section></title><title id="HC8E6F494350D4A39827C00D19384EE12"><enum>IV</enum><header>Curecanti National Recreation Area</header><section id="HB6113B8118FE445E8319975C0EFC4082"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="idd8122824d0d745a68f286eb5ceca01c3"><enum>(1)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Curecanti National Recreation Area, Proposed Boundary</quote>, numbered 616/100,485D, and dated April 25, 2022. </text></paragraph><paragraph id="HA81CF35189C740488CB635792ABF5EE6"><enum>(2)</enum><header>National recreation area</header><text>The term <term>National Recreation Area</term> means the Curecanti National Recreation Area established by section 402(a).</text></paragraph><paragraph id="H9CB5316E7D6D4E53BBBB7F129CF98E45"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H9FEC2119CA2C4A308477F47C5656FC21"><enum>402.</enum><header>Curecanti National Recreation Area</header><subsection id="H9345E670CFB14DA6888A676BE99D5432"><enum>(a)</enum><header>Establishment</header><text>Effective beginning on the earlier of the date on which the Secretary approves a request under subsection (c)(2)(B)(i)(I) and the date that is 1 year after the date of enactment of this Act, there shall be established as a unit of the National Park System the Curecanti National Recreation Area, in accordance with this Act, consisting of approximately 50,300 acres of land in the State, as generally depicted on the map as <quote>Curecanti National Recreation Area Proposed Boundary</quote>.</text></subsection><subsection id="H77E04612515E4ACEB05D4540E7E9D91E"><enum>(b)</enum><header>Availability of map</header><text>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection><subsection id="H92709C58E5D14448A0E7C49C4540C516"><enum>(c)</enum><header>Administration</header><paragraph id="HE79A471FDFC447348A447F3232B6A87A"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the National Recreation Area in accordance with—</text><subparagraph id="H305A881844194B24A2F57735113E11A7"><enum>(A)</enum><text>this title; and</text></subparagraph><subparagraph id="HD8239550B6C0454AB9C2DA6F2BEC0D86"><enum>(B)</enum><text>the laws (including regulations) generally applicable to units of the National Park System, including section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54, United States Code.</text></subparagraph></paragraph><paragraph id="HE369B61A4D1843FB9B63268ACC678AC8"><enum>(2)</enum><header>Dam, power plant, and reservoir management and operations</header><subparagraph id="H7E71D0F77E7342C3A33A808683C2A06F"><enum>(A)</enum><header>In general</header><text>Nothing in this title affects or interferes with the authority of the Secretary—</text><clause id="HD26BA8EC21E14AF5BF82FA0F95B601D1"><enum>(i)</enum><text>to operate the Uncompahgre Valley Reclamation Project under the reclamation laws;</text></clause><clause id="HDFA5986341BD49EFB8ACA475CA7D3EEB"><enum>(ii)</enum><text>to operate the Wayne N. Aspinall Unit of the Colorado River Storage Project under the Act of April 11, 1956 (commonly known as the <quote>Colorado River Storage Project Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/620">43 U.S.C. 620 et seq.</external-xref>); or</text></clause><clause id="HD3E9BD9F34E84E0B86CDB60A4D666D5A"><enum>(iii)</enum><text>under the Federal Water Project Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-12">16 U.S.C. 460l–12 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H4B621E4552864C5EB902E078D76CBA42"><enum>(B)</enum><header>Reclamation land</header><clause id="H7E1C16B2044D414A8F946D9DA9E763EC"><enum>(i)</enum><header>Submission of request to retain administrative jurisdiction</header><text>If, before the date that is 1 year after the date of enactment of this Act, the Commissioner of Reclamation submits to the Secretary a request for the Commissioner of Reclamation to retain administrative jurisdiction over the minimum quantity of land within the land identified on the map as <quote>Lands withdrawn or acquired for Bureau of Reclamation projects</quote> that the Commissioner of Reclamation identifies as necessary for the effective operation of Bureau of Reclamation water facilities, the Secretary may—</text><subclause id="H39BAF3A2571F4CEB91A71DDC78CC904A"><enum>(I)</enum><text>approve, approve with modifications, or disapprove the request; and</text></subclause><subclause id="H05D48E754DBE41399E0CC7340A9E1DCE"><enum>(II)</enum><text>if the request is approved under subclause (I), make any modifications to the map that are necessary to reflect that the Commissioner of Reclamation retains management authority over the minimum quantity of land required to fulfill the reclamation mission.</text></subclause></clause><clause id="H4D186283C66A4978B6BCF4E1940ABF47"><enum>(ii)</enum><header>Transfer of land</header><subclause id="HE3CA141892B24843B9E8F9B989286478"><enum>(I)</enum><header>In general</header><text>Administrative jurisdiction over the land identified on the map as <quote>Lands withdrawn or acquired for Bureau of Reclamation projects</quote>, as modified pursuant to clause (i)(II), if applicable, shall be transferred from the Commissioner of Reclamation to the Director of the National Park Service by not later than the date that is 1 year after the date of enactment of this Act.</text></subclause><subclause id="H5494407850FF4D5FB3F85FFCBE8D3046"><enum>(II)</enum><header>Access to transferred land</header><item id="H5F721A891CDD41A0BC435EB357EB67B7"><enum>(aa)</enum><header>In general</header><text>Subject to item (bb), the Commissioner of Reclamation shall retain access to the land transferred to the Director of the National Park Service under subclause (I) for reclamation purposes, including for the operation, maintenance, and expansion or replacement of facilities.</text></item><item id="H0659D079648848FA84EB29A13E5FAECF"><enum>(bb)</enum><header>Memorandum of understanding</header><text>The terms of the access authorized under item (aa) shall be determined by a memorandum of understanding entered into between the Commissioner of Reclamation and the Director of the National Park Service not later than 1 year after the date of enactment of this Act.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="HB902B692742A46F9A925961805426F83"><enum>(3)</enum><header>Management agreements</header><subparagraph id="HAA38033B8C524710A5A5ED1EFD86AC92"><enum>(A)</enum><header>In general</header><text>The Secretary may enter into management agreements, or modify management agreements in existence on the date of enactment of this Act, relating to the authority of the Director of the National Park Service, the Commissioner of Reclamation, the Director of the Bureau of Land Management, or the Chief of the Forest Service to manage Federal land within or adjacent to the boundary of the National Recreation Area.</text></subparagraph><subparagraph id="HA1AF0375AB2A485E97957BBB8133C0FD"><enum>(B)</enum><header>State land</header><text>The Secretary may enter into cooperative management agreements for any land administered by the State that is within or adjacent to the National Recreation Area, in accordance with the cooperative management authority under section 101703 of title 54, United States Code.</text></subparagraph></paragraph><paragraph id="H886E576743294A18B33548676E92D31B"><enum>(4)</enum><header>Recreational activities</header><subparagraph id="H51746902886042F2B6E1E8124EB24310"><enum>(A)</enum><header>Authorization</header><text>Except as provided in subparagraph (B), the Secretary shall allow boating, boating-related activities, hunting, and fishing in the National Recreation Area in accordance with applicable Federal and State laws.</text></subparagraph><subparagraph id="HF18A969058784EFAB19F4702E6FB5C15"><enum>(B)</enum><header>Closures; designated zones</header><clause id="HC849D16779504E53BC28BBBDCBF1F121"><enum>(i)</enum><header>In general</header><text>The Secretary, acting through the Superintendent of the National Recreation Area, may designate zones in which, and establish periods during which, no boating, hunting, or fishing shall be permitted in the National Recreation Area under subparagraph (A) for reasons of public safety, administration, or compliance with applicable laws.</text></clause><clause id="HF6538D4165C44668BC6C622AC045931D"><enum>(ii)</enum><header>Consultation required</header><text>Except in the case of an emergency, any closure proposed by the Secretary under clause (i) shall not take effect until after the date on which the Superintendent of the National Recreation Area consults with—</text><subclause id="H13F0EA8009A64124A444CD44AA80820B"><enum>(I)</enum><text>the appropriate State agency responsible for hunting and fishing activities; and</text></subclause><subclause id="H9F39C7BAEA8C41F688FEAB8320CC114B"><enum>(II)</enum><text>the Board of County Commissioners in each county in which the zone is proposed to be designated.</text></subclause></clause></subparagraph></paragraph><paragraph id="ida09107d4d652402d945d26ba8a8b4891"><enum>(5)</enum><header>Landowner assistance</header><text>On the written request of an individual that owns private land located within the area generally depicted as <quote>Conservation Opportunity Area</quote> on the map entitled <quote>Preferred Alternative</quote> in the document entitled <quote>Report to Congress: Curecanti Special Resource Study</quote> and dated June 2009, the Secretary may work in partnership with the individual to enhance the long-term conservation of natural, cultural, recreational, and scenic resources in and around the National Recreation Area—</text><subparagraph id="id3fa94ac07f9541d2aed4424610eee6d3"><enum>(A)</enum><text>by acquiring all or a portion of the private land or interests in private land within the Conservation Opportunity Area by purchase, exchange, or donation, in accordance with section 403; </text></subparagraph><subparagraph id="HC5D8F3C17AA9411FA56EF039D954A975"><enum>(B)</enum><text>by providing technical assistance to the individual, including cooperative assistance;</text></subparagraph><subparagraph id="HA3667B1F559943E0B0A33D5503D9A3E0"><enum>(C)</enum><text>through available grant programs; and</text></subparagraph><subparagraph id="H72AEB70B51C84E0B9677CF76B735E896"><enum>(D)</enum><text>by supporting conservation easement opportunities.</text></subparagraph></paragraph><paragraph id="id5fe8db40c4ce4cec8c00a9b808bac1bb"><enum>(6)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land acquired by the United States under paragraph (5) shall—</text><subparagraph id="idb6a823d9185a4fd281ba23942b5415a6"><enum>(A)</enum><text>become part of the National Recreation Area; and</text></subparagraph><subparagraph id="idd5819a4834ba4dae8120c360cc23852c"><enum>(B)</enum><text>be managed in accordance with this title. </text></subparagraph></paragraph><paragraph id="H43D7910019A749848CE59435AB6742FF"><enum>(7)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the National Recreation Area, including land acquired pursuant to this section, is withdrawn from—</text><subparagraph id="HB65E73F721B143B8844B1F8750CB474B"><enum>(A)</enum><text>entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="H6F39ABE9A1C4445284034E12B1730B37"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="H2D964F9601C04B0493763A694EAB1335"><enum>(C)</enum><text display-inline="yes-display-inline">operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></subparagraph></paragraph><paragraph id="HC7D59A5C2F3548A6B6FA2B29C5761024"><enum>(8)</enum><header>Grazing</header><subparagraph id="H131D2147A040412B8BBEA38095505453"><enum>(A)</enum><header>State land subject to a state grazing lease</header><clause id="H95ACFBC139E84DA8A4375599636BE169"><enum>(i)</enum><header>In general</header><text>If State land acquired under this title is subject to a State grazing lease in effect on the date of acquisition, the Secretary shall allow the grazing to continue for the remainder of the term of the lease, subject to the related terms and conditions of user agreements, including permitted stocking rates, grazing fee levels, access rights, and ownership and use of range improvements.</text></clause><clause id="HDB4012C9F41243BDAA801968822D0BA8"><enum>(ii)</enum><header>Access</header><text>A lessee of State land may continue to use established routes within the National Recreation Area to access State land for purposes of administering the lease if the use was permitted before the date of enactment of this Act, subject to such terms and conditions as the Secretary may require.</text></clause></subparagraph><subparagraph id="HBDA2398511F0404AA9C45A0568A11F67"><enum>(B)</enum><header>State and private land</header><text>The Secretary may, in accordance with applicable laws, authorize grazing on land acquired from the State or private landowners under section 403, if grazing was established before the date of acquisition.</text></subparagraph><subparagraph id="HC5369FD76A074A89B1254E85B7A2E27F"><enum>(C)</enum><header>Private land</header><text>On private land acquired under section 403 for the National Recreation Area on which authorized grazing is occurring before the date of enactment of this Act, the Secretary, in consultation with the lessee, may allow the continuation and renewal of grazing on the land based on the terms of acquisition or by agreement between the Secretary and the lessee, subject to applicable law (including regulations).</text></subparagraph><subparagraph id="H2F7A905C1D8642EE92112DC776F70682"><enum>(D)</enum><header>Federal land</header><text>The Secretary shall—</text><clause id="HE41DCCC50EAC4463B501483A87ED4F66"><enum>(i)</enum><text>allow, consistent with the grazing leases, uses, and practices in effect as of the date of enactment of this Act, the continuation and renewal of grazing on Federal land located within the boundary of the National Recreation Area on which grazing is allowed before the date of enactment of this Act, unless the Secretary determines that grazing on the Federal land would present unacceptable impacts (as defined in section 1.4.7.1 of the National Park Service document entitled <quote>Management Policies 2006: The Guide to Managing the National Park System</quote>) to the natural, cultural, recreational, and scenic resource values and the character of the land within the National Recreation Area; and</text></clause><clause id="H31AAE9EC0F734F3DB195BEEB3E38A66F"><enum>(ii)</enum><text>retain all authorities to manage grazing in the National Recreation Area.</text></clause></subparagraph><subparagraph id="H921B2D478E994590B0FCAD6817A42D11"><enum>(E)</enum><header>Termination of leases</header><text>Within the National Recreation Area, the Secretary may—</text><clause id="H60C734073B8643BEB1CE1681CD88BD17"><enum>(i)</enum><text>accept the voluntary termination of a lease or permit for grazing; or</text></clause><clause id="HDDA6B1B0B032474480FFFBAB57F562E6"><enum>(ii)</enum><text>in the case of a lease or permit vacated for a period of 3 or more years, terminate the lease or permit.</text></clause></subparagraph></paragraph><paragraph id="HD66555791DA9402DA27B343DFD059470"><enum>(9)</enum><header>Water rights</header><text>Nothing in this title—</text><subparagraph id="H011BFDE1817240BF8B076E15ADA8AF46"><enum>(A)</enum><text>affects any use or allocation in existence on the date of enactment of this Act of any water, water right, or interest in water;</text></subparagraph><subparagraph id="HEB55162A0DD24C4E8C195ECB6BA44CC0"><enum>(B)</enum><text>affects any vested absolute or decreed conditional water right in existence on the date of enactment of this Act, including any water right held by the United States;</text></subparagraph><subparagraph id="H25EE830B85AC4FEAB3D5BCA99DFC7D57"><enum>(C)</enum><text>affects any interstate water compact in existence on the date of enactment of this Act;</text></subparagraph><subparagraph id="HB6D7CC0A200449ED82991676B6115129"><enum>(D)</enum><text>shall be considered to be a relinquishment or reduction of any water right reserved or appropriated by the United States in the State on or before the date of enactment of this Act; or</text></subparagraph><subparagraph id="H56746A00E9E24A21AAE86A03186084C3"><enum>(E)</enum><text display-inline="yes-display-inline">constitutes an express or implied Federal reservation of any water or water rights with respect to the National Recreation Area.</text></subparagraph></paragraph><paragraph id="HEE5108BBE18E4BF7BF05A85FC30BCAF1"><enum>(10)</enum><header>Fishing easements</header><subparagraph id="HF77CCB0D6C494CE493CA23B294E89B73"><enum>(A)</enum><header>In general</header><text>Nothing in this title diminishes or alters the fish and wildlife program for the Aspinall Unit developed under section 8 of the Act of April 11, 1956 (commonly known as the <quote>Colorado River Storage Project Act</quote>) (70 Stat. 110, chapter 203; <external-xref legal-doc="usc" parsable-cite="usc/43/620g">43 U.S.C. 620g</external-xref>), by the United States Fish and Wildlife Service, the Bureau of Reclamation, and the Colorado Division of Wildlife (including any successor in interest to that division) that provides for the acquisition of public access fishing easements as mitigation for the Aspinall Unit (referred to in this paragraph as the <quote>program</quote>).</text></subparagraph><subparagraph id="HFD8F56D2B2954200AEDB6D65D2C0EBE4"><enum>(B)</enum><header>Acquisition of fishing easements</header><text>The Secretary shall continue to fulfill the obligation of the Secretary under the program to acquire 26 miles of class 1 public fishing easements to provide to sportsmen access for fishing within the Upper Gunnison Basin upstream of the Aspinall Unit, subject to the condition that no existing fishing access downstream of the Aspinall Unit shall be counted toward the minimum mileage requirement under the program.</text></subparagraph><subparagraph id="HA46FFA6D048D4DCC8DDF4897A7263297"><enum>(C)</enum><header>Plan</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall develop a plan for fulfilling the obligation of the Secretary described in subparagraph (B) by the date that is 10 years after the date of enactment of this Act.</text></subparagraph><subparagraph id="id574D38BEFC834361A15436B3B1F5E7ED"><enum>(D)</enum><header>Reports</header><text>Not later than each of 2 years, 5 years, and 8 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that describes the progress made in fulfilling the obligation of the Secretary described in subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="id80f31b6fa010420aa93da5fb3db764a0"><enum>(d)</enum><header>Tribal rights and uses</header><paragraph id="id00ab9a5a45c14761b0724c5b82e8d87d"><enum>(1)</enum><header>Treaty rights</header><text>Nothing in this title affects the treaty rights of any Indian Tribe.</text></paragraph><paragraph id="id6dfaa663ff134928858b127c8ed468b0"><enum>(2)</enum><header>Traditional Tribal uses</header><text>Subject to any terms and conditions as the Secretary determines to be necessary and in accordance with applicable law, the Secretary shall allow for the continued use of the National Recreation Area by members of Indian Tribes—</text><subparagraph id="idcc05ae40c950483f94f28bf6dd6ea3e4"><enum>(A)</enum><text>for traditional ceremonies; and</text></subparagraph><subparagraph id="id6ec22f63881d4522b76af0808d6e879d"><enum>(B)</enum><text>as a source of traditional plants and other materials. </text></subparagraph></paragraph></subsection></section><section id="H083A2BA4FF5B4481992A836C7525234F"><enum>403.</enum><header>Acquisition of land; boundary management</header><subsection id="H744D2D5783804E1EAC15C06E23A4EE98"><enum>(a)</enum><header>Acquisition</header><paragraph id="H7EEC832E963841D8A6048911D3EAB379"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire any land or interest in land within the boundary of the National Recreation Area.</text></paragraph><paragraph id="H4A059753C7764B339F5CAD24285E3855"><enum>(2)</enum><header>Manner of acquisition</header><subparagraph id="H36B9A2A12C9B489DBC62E973DDE3C147"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), land described in paragraph (1) may be acquired under this subsection by—</text><clause id="H6B471BC2988A4D66824DB6ABE8878E65"><enum>(i)</enum><text>donation;</text></clause><clause id="H97E1A1C3A32E494DB587A3F272171644"><enum>(ii)</enum><text>purchase from willing sellers with donated or appropriated funds;</text></clause><clause id="HD1A6E371358E429489E4F475BCAAE113"><enum>(iii)</enum><text>transfer from another Federal agency; or</text></clause><clause id="H3D783D3B7D324BADAFCC75EAC9BB8975"><enum>(iv)</enum><text>exchange.</text></clause></subparagraph><subparagraph id="H6A0BC9BFE5044B2599819DECF276934F"><enum>(B)</enum><header>State land</header><text>Land or interests in land owned by the State or a political subdivision of the State may only be acquired by purchase, donation, or exchange.</text></subparagraph></paragraph></subsection><subsection id="H3D7F0E68E68747EA90A2BF989E31DB93"><enum>(b)</enum><header>Transfer of administrative jurisdiction</header><paragraph id="H8741C35DE2034D3F801D93F0D1ABE2CD"><enum>(1)</enum><header>Forest service land</header><subparagraph id="H93FB4AC5AD3F4AD9932D142EDD778579"><enum>(A)</enum><header>In general</header><text>Administrative jurisdiction over the approximately 2,500 acres of land identified on the map as <quote>U.S. Forest Service proposed transfer to the National Park Service</quote> is transferred to the Secretary, to be administered by the Director of the National Park Service as part of the National Recreation Area.</text></subparagraph><subparagraph id="HBE93ED89A58647A18D2AD9431CC58842"><enum>(B)</enum><header>Boundary adjustment</header><text>The boundary of the Gunnison National Forest shall be adjusted to exclude the land transferred to the Secretary under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HAE11D9A4F7A64B9EB3FC937708EA438E"><enum>(2)</enum><header>Bureau of land management land</header><text>Administrative jurisdiction over the approximately 6,100 acres of land identified on the map as <quote>Bureau of Land Management proposed transfer to National Park Service</quote> is transferred from the Director of the Bureau of Land Management to the Director of the National Park Service, to be administered as part of the National Recreation Area.</text></paragraph><paragraph id="H4868D477247E496EA7DC41CE46511C78"><enum>(3)</enum><header>Withdrawal</header><text>Administrative jurisdiction over the land identified on the map as <quote>Proposed for transfer to the Bureau of Land Management, subject to the revocation of Bureau of Reclamation withdrawal</quote> shall be transferred to the Director of the Bureau of Land Management on relinquishment of the land by the Bureau of Reclamation and revocation by the Bureau of Land Management of any withdrawal as may be necessary.</text></paragraph></subsection><subsection id="HD6AF95B98F6142A895DA468F68151A8C"><enum>(c)</enum><header>Potential land exchange</header><paragraph id="HA589BB5BC7D14DE3A29D0937CE89A108"><enum>(1)</enum><header>In general</header><text>The withdrawal for reclamation purposes of the land identified on the map as <quote>Potential exchange lands</quote> shall be relinquished by the Commissioner of Reclamation and revoked by the Director of the Bureau of Land Management and the land shall be transferred to the National Park Service.</text></paragraph><paragraph id="H6D4F5558136C417B8A78AC96B53E2D94"><enum>(2)</enum><header>Exchange; inclusion in national recreation area</header><text>On transfer of the land described in paragraph (1), the transferred land—</text><subparagraph id="HEBC31F9CE16C4422BDBDA0117C254A9F"><enum>(A)</enum><text>may be exchanged by the Secretary for private land described in section 402(c)(5)—</text><clause id="H2DEA1199035A400E956BD2414F1D5C9D"><enum>(i)</enum><text>subject to a conservation easement remaining on the transferred land, to protect the scenic resources of the transferred land; and</text></clause><clause id="HAA5C84660A09478F8BFF3C8A3A047349"><enum>(ii)</enum><text>in accordance with the laws (including regulations) and policies governing National Park Service land exchanges; and</text></clause></subparagraph><subparagraph id="HAE05EE2280AB4C969C17BB64F7A2284A"><enum>(B)</enum><text>if not exchanged under subparagraph (A), shall be added to, and managed as a part of, the National Recreation Area.</text></subparagraph></paragraph></subsection><subsection id="H323480154D6944DDB3A958AC9DBF0471"><enum>(d)</enum><header>Addition to national recreation area</header><text>Any land within the boundary of the National Recreation Area that is acquired by the United States shall be added to, and managed as a part of, the National Recreation Area.</text></subsection></section><section id="H8FC7AEEF74DE407E9B61BB254BFF3EBB"><enum>404.</enum><header>General management plan</header><text display-inline="no-display-inline">Not later than 3 years after the date on which funds are made available to carry out this title, the Director of the National Park Service, in consultation with the Commissioner of Reclamation, shall prepare a general management plan for the National Recreation Area in accordance with section 100502 of title 54, United States Code.</text></section><section id="H23F5293092214CD7B416E83CF544F418"><enum>405.</enum><header>Boundary survey</header><text display-inline="no-display-inline">The Secretary (acting through the Director of the National Park Service) shall prepare a boundary survey and legal description of the National Recreation Area. </text></section></title></legis-body></bill>
