Recreation Area Act to include certain additions to the Smith River National Recreation Area, to amend the Wild and Scenic Rivers Act to designate certain wild rivers in the State of Oregon, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smith River National Recreation Area Expansion Act</short-title></quote>.</text></section><section id="idB695CC90C67F4F64B1EFBA75F18FCBE9"><enum>2.</enum><header>Additions to the Smith River National Recreation Area</header><subsection id="idD733FDEDAC6442C3A8E4BBE10543E417"><enum>(a)</enum><header>Definitions</header><text>Section 3 of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-1">16 U.S.C. 460bbb–1</external-xref>) is amended—</text><paragraph id="id8940BA27F7A84F00B83D8E43720A9118"><enum>(1)</enum><text>in paragraph (1), by striking <quote>referred to in section 4(b)</quote> and inserting <quote>entitled <quote>Proposed Smith River National Recreation Area</quote> and dated July 1990</quote>; and</text></paragraph><paragraph id="idA48B7349EF12407EAE267515436D4148"><enum>(2)</enum><text>in paragraph (2), by striking <quote>the Six Rivers National Forest</quote> and inserting <quote>an applicable unit of the National Forest System</quote>.</text></paragraph></subsection><subsection id="idD5B44842B48747C09EE2C0D4A5A5CBEF"><enum>(b)</enum><header>Boundaries</header><text>Section 4(b) of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-2">16 U.S.C. 460bbb–2(b)</external-xref>) is amended—</text><paragraph id="id329B788DF3E547148BFF8A520A59A4CD"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idB1C5948F35C44E8C9D1B9279A6417EA0"><enum>(A)</enum><text>in the first sentence, by inserting <quote>and on the map entitled <quote>Proposed Additions to the Smith River National Recreation Area</quote> and dated January 23, 2023</quote> after <quote>1990</quote>; and</text></subparagraph><subparagraph id="id46F51A96D584483BA0236A32D47FDEC7"><enum>(B)</enum><text>in the second sentence, by striking <quote>map</quote> and inserting <quote>maps</quote>; and</text></subparagraph></paragraph><paragraph id="id01E6886EC6D84975B250AE30400F5684"><enum>(2)</enum><text>in paragraph (2), by striking <quote>map</quote> and inserting <quote>maps described in paragraph (1)</quote>.</text></paragraph></subsection><subsection id="id183508C0BA244065BBFCBE4E5B79E9A0"><enum>(c)</enum><header>Administration</header><text>Section 5 of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-3">16 U.S.C. 460bbb–3</external-xref>) is amended—</text><paragraph id="id68430873849543669F3369D98C0D63CA"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id6398DE76C3D745C097265E867B08EF49"><enum>(A)</enum><text>in paragraph (1), in the first sentence, by striking <quote>the map</quote> and inserting <quote>the maps</quote>; and</text></subparagraph><subparagraph id="id683370E2168E4A529825657F7658A641"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idE0DC66D2759B49D4B0110CF91CE20B55"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>area shall be on</quote> and inserting <quote>area and any portion of the recreation area in the State of Oregon shall be on roadless</quote>; and</text></clause><clause id="id2437C89C869D4881965B29521AD70D2D"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2DD1E213A31B42E287F19D093D4E187E"><subparagraph id="id545ea03effd54569b28951134db4d86e"><enum>(I)</enum><text>The Kalmiopsis Wilderness shall be managed in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>).</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id28D3D016459B432996BA5DB9557ACC50"><enum>(2)</enum><text>in subsection (c), by striking <quote>by the amendments made by section 10(b) of this Act</quote> and inserting <quote>within the recreation area</quote>; and</text></paragraph><paragraph id="id42456E01989349EA8341BA8C5D1DCD99"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6A6074AEFA684A4C9DE047D5514A6F7A"><subsection id="id55848db481624867bfd03add3605ac04"><enum>(d)</enum><header>Study; report</header><paragraph id="idBCB448BE309E4C42BBD6C62059413322"><enum>(1)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this subsection, the Secretary shall conduct a study of the area depicted on the map entitled <quote>Proposed Additions to the Smith River National Recreation Area</quote> and dated January 23, 2023, that includes inventories and assessments of streams, fens, wetlands, lakes, other water features, and associated land, plants (including Port-Orford-cedar), animals, fungi, algae, and other values, and unstable and potentially unstable aquatic habitat areas in the study area.</text></paragraph><paragraph id="idC4D79905625041FBA096AC600DF51914"><enum>(2)</enum><header>Modification of management plans; report</header><text>On completion of the study under paragraph (1), the Secretary shall—</text><subparagraph id="id5dc7f4d82f3b42f087bb1c6b76770f4f"><enum>(A)</enum><text>modify any applicable management plan to fully protect the inventoried values under the study, including to implement additional standards and guidelines; and</text></subparagraph><subparagraph id="id405ac11372174e5b821c96fa2666f91c"><enum>(B)</enum><text>submit to Congress a report describing the results of the study.</text></subparagraph></paragraph></subsection><subsection id="id8bac443e546f4dc3acfcbd5f75d8ca81"><enum>(e)</enum><header>Wildfire management</header><text>Nothing in this Act affects the authority of the Secretary (in cooperation with other Federal, State, and local agencies, as appropriate) to conduct wildland fire operations within the recreation area, consistent with the purposes of this Act.</text></subsection><subsection id="id2a7bdd275636404c80f427cc61727df1"><enum>(f)</enum><header>Vegetation management</header><text>Nothing in this Act prohibits the Secretary from conducting vegetation management projects (including wildfire resiliency and forest health projects) within the recreation area, to the extent consistent with the purposes of the recreation area.</text></subsection><subsection id="id39AA4E68A27B4FB5B589ABA94580A0DB"><enum>(g)</enum><header>Application of Northwest Forest Plan and roadless rule to certain portions of the recreation area</header><text>Nothing in this Act affects the application of the Northwest Forest Plan or part 294 of title 36, Code of Federal Regulations (commonly referred to as the <quote>Roadless Rule</quote>) (as in effect on the date of enactment of this subsection), to portions of the recreation area in the State of Oregon that are subject to the plan and those regulations as of the date of enactment of this subsection.</text></subsection><subsection id="id7fb4e55e99544536adfabe820a399617"><enum>(h)</enum><header>Protection of tribal rights</header><paragraph id="idbf3f2aa8757748dd8cad88feba40152c"><enum>(1)</enum><header>In general</header><text>Nothing in this Act diminishes any right of an Indian Tribe.</text></paragraph><paragraph id="id06748d6b4772452a881847e33e29aa44"><enum>(2)</enum><header>Memorandum of understanding</header><text>The Secretary shall seek to enter into a memorandum of understanding with applicable Indian Tribes with respect to—</text><subparagraph id="id6cbd5340f0c844298578320cf59d37af"><enum>(A)</enum><text>providing the Indian Tribes with access to the portions of the recreation area in the State of Oregon to conduct historical and cultural activities, including the procurement of noncommercial forest products and materials for traditional and cultural purposes; and</text></subparagraph><subparagraph id="id5e236e077eef4d03b42f52ce672190d2"><enum>(B)</enum><text>the development of interpretive information to be provided to the public on the history of the Indian Tribes and the use of the recreation area by the Indian Tribes.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9C7D447FBF17422CA1ADA3E361C2D08E"><enum>(d)</enum><header>Acquisition</header><text>Section 6(a) of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-4">16 U.S.C. 460bbb–4(a)</external-xref>) is amended—</text><paragraph id="id7C6F8554D8F2400B9AD9428B5B532DF1"><enum>(1)</enum><text>in the fourth sentence, by striking <quote>All lands</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5F45A43757FA4C2CBCA9D0164637A81E"><paragraph id="id687DB0B8D43B4B968588CBE5A8F758ED"><enum>(4)</enum><header>Applicable law</header><text>All land</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id3B3CF79551404A0784648AF54D9F559F"><enum>(2)</enum><text>in the third sentence—</text><subparagraph id="idCF7BCAE95E184BA9B46DD42951C582EB"><enum>(A)</enum><text>by striking <quote>The id="id28F0B9B1D39C43C0A48F08F46B3E45DA"><enum>(C)</enum><text>by striking <quote>donation or</quote> and inserting <quote>purchase, donation, or</quote>;</text></subparagraph></paragraph><paragraph id="idE8F686A6BA434C47816D00B35F8E4B0F"><enum>(3)</enum><text>in the second sentence, by striking <quote>In exercising</quote> and inserting the following:</text><quoted-block style="OLC" available funding, the Secretary shall acquire all right, title, and interest in and to the approximately 555 acres of land known as the <quote>Cedar Creek Parcel</quote> located in sec. 16, T. 41 S., R. 11 W., Willamette Meridian.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7A5F5F7547EB4C42AAAA10A67D667197"><enum>(e)</enum><header>Fish and game</header><text>Section 7 of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-5">16 U.S.C. 460bbb–5</external-xref>) is amended—</text><paragraph id="id8F03E96AE0AE435598389EDA38ABB44C"><enum>(1)</enum><text>in the first sentence, by inserting <quote>or the State of Oregon</quote> after <quote>State of California</quote>; and</text></paragraph><paragraph id="id53B745763AD242D58FA39C43942DEB8F"><enum>(2)</enum><text>in the second sentence, by inserting <quote>or the State of Oregon, as applicable</quote> after <quote>State of California</quote>.</text></paragraph></subsection><subsection id="idF28407374C3140A6A7B6CF2CEBC93A04"><enum>(f)</enum><header>Management planning</header><text>Section 9 of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-7">16 U.S.C. 460bbb–7</external-xref>) is amended—</text><paragraph id="idA1BA8AB9FE1840A6A1D903D19A8EB618"><enum>(1)</enum><text>in the first sentence, by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3191788CB5964926B6B8803E7758A05C"><subsection id="id120B28D33BF44F6797A5A72A7766B008"><enum>(a)</enum><header>Revision of management plan</header><text>The Secretary</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id76E932DDBA434DDD9C25C7E1011EB615"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF46E90A15DB943A8A2E89193D632D6B4"><subsection id="idD97BBECD1E1A4B67B68A8C283AF75CE9"><enum>(b)</enum><header>Smith River National Recreation Area Management Plan revision</header><text>As soon as practicable after the date of the first revision of the forest plan after the date of enactment of this subsection, the Secretary shall revise the management plan for the recreation area—</text><paragraph id="id9BDB878926EE43FB98FB919EDD711B8E"><enum>(1)</enum><text>to reflect the expansion of the recreation area into the State of Oregon under the <short-title>Smith River National Recreation Area Expansion Act</short-title>; and</text></paragraph><paragraph id="idB1FE31368F2847BB86D4D4C56B62C7F3"><enum>(2)</enum><text>to include an updated recreation action schedule to identify specific use and development plans for the areas described in the map entitled <quote>Proposed Additions to the Smith River National Recreation Area</quote> and dated January 23, 2023.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idDCF151C52B85454E95F20E3884E7528A"><enum>(g)</enum><header>Streamside protection zones</header><text>Section 11(b) of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-8">16 U.S.C. 460bbb–8(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF8D11506EAB245FE90CD258504BCE903"><paragraph id="id477af8e368524480b028244eac4cbcb5"><enum>(24)</enum><text>Each of the river segments described in subparagraph (B) of section 3(a)(92) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)(92)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD497E8E277CE4372939A65D8C4E975A9"><enum>(h)</enum><header>State and local jurisdiction and assistance</header><text>Section 12 of the Smith River National Recreation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460bbb-9">16 U.S.C. 460bbb–9</external-xref>) is amended—</text><paragraph id="idC0D377D4DA434E46AA740623D4C6C493"><enum>(1)</enum><text>in subsection (a), by striking <quote>California or any political subdivision thereof</quote> and inserting <quote>California, the State of Oregon, or a political subdivision of the State of California or the State of Oregon</quote>;</text></paragraph><paragraph id="idDD8A332B5EB1433EB157B53CB649157A"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>California or its political subdivisions</quote> and inserting <quote>California, the State of Oregon, or a political subdivision of the State of California or the State of Oregon</quote>; and</text></paragraph><paragraph additions, Oregon</header><paragraph id="idE067107F86254D1B9EC84326430F8131"><enum>(1)</enum><header>Finding</header><text display-inline="yes-display-inline">Congress finds that the source tributaries of the North Fork Smith River in the State of Oregon possess outstandingly remarkable wild anadromous fish and prehistoric, cultural, botanical, recreational, and water quality values.</text></paragraph><paragraph id="id4CE79AD4550D4802842587B64B8A41B3"><enum>(2)</enum><header>Designation</header><text display-inline="yes-display-inline">Section 3(a)(92) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)(92)</external-xref>) is amended—</text><subparagraph id="id9DAA3FC8C3F648059FC175DAA59A799D"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>scenic</quote> and inserting <quote>wild</quote>;</text></subparagraph><subparagraph id="id8FA682D3F4A641109E790E5790FC0C00"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="id4167FDF0F0644B299D9996F83A9A27A2"><enum>(C)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking all perennial tributaries, to the confluence with the North Fork Smith in T. 39 S., R 10 W., T. 40 S., R. 10 W., and T. 41 S., R. 11 W., Willamette Meridian, as a wild river.</text></clause><clause id="id704a6623e7d545e787124cc05150dd5a"><enum>(ii)</enum><text>The 3.58-mile segment from the headwaters of Taylor Creek to the confluence with Baldface Creek, as a wild river.</text></clause><clause id="idf5b0619773ec47ca8c1f78817f76b139"><enum>(iii)</enum><text>The 4.38-mile segment from the headwaters of the unnamed tributary to Biscuit Creek and the headwaters of Biscuit Creek to the confluence with Baldface Creek, as a wild river.</text></clause><clause id="idb1b83f479a7f474f8b0e429d93ea5145"><enum>(iv)</enum><text>The 2.27-mile segment from the headwaters of Spokane Creek to the confluence with Baldface Creek, as a wild river.</text></clause><clause id="id76db0176c88b492b9b6f385f2f754640"><enum>(v)</enum><text>The 1.25-mile segment from the headwaters of Rock Creek to the confluence with Baldface Creek, flowing south from sec. 19, T. 40 S., R. 10 W., Willamette Meridian, as a wild river.</text></clause><clause id="id991382fed4924a0382492d5cd68897c0"><enum>(vi)</enum><text>The 1.31-mile segment from the headwaters of the unnamed tributary number 2 to the confluence with Baldface Creek, flowing north from sec. 27, T. 40 S., R. 10 W., Willamette Meridian, as a wild river.</text></clause><clause id="id5a67dd453a2747ccbd75bbe23300b591"><enum>(vii)</enum><text>The 3.6-mile segment from the 2 headwaters of the unnamed tributary number 3 to the confluence with Baldface Creek, flowing south from secs. 9 and 10, T. 40 S., R. 10 W., Willamette Meridian, as a wild river.</text></clause><clause id="id97e52167b9a04ed99f0c6590fd986aeb"><enum>(viii)</enum><text>The 1.57-mile segment from the headwaters of the unnamed tributary number 4 to the confluence with Baldface Creek, flowing north from sec. 26, T. 40 S., R. 10 W., Willamette Meridian, as a wild river.</text></clause><clause id="id6296c4479e0c40368ca7a98f5c95620f"><enum>(ix)</enum><text>The 0.92-mile segment from the headwaters of
