<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 159</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230131">January 31, 2023</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, and <cosponsor name-id="S403">Ms. Sinema</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to provide an exemption from gross income for mandatory restitution or civil damages as recompense for trafficking in persons.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Human Trafficking Survivor Tax Relief Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id7F4A7C994A814DC6BACCC3659507441B"><enum>2.</enum><header>Exempting from Federal income taxation restitution and civil damages awarded under sections 1593 and 1595 of title 18, United States Code</header><subsection commented="no" id="H82EE3CA84BD6492E9144495DDC5E06B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 140 the following new section: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H86DE5D77061F44C0BC5AF57E1F5E54F8"><section commented="no" id="HCD77234C55644A8D867B10B80F713F25"><enum>139J.</enum><header>Certain amount received as restitution or civil damages as recompense for trafficking in persons</header><subsection commented="no" id="H16A325835C09418CB9FCD3FD97AFD38F"><enum>(a)</enum><header>Exclusion from gross income</header><text display-inline="yes-display-inline">Gross income shall not include any civil damages, restitution, or other monetary award (including compensatory or statutory damages and restitution imposed in a criminal matter) awarded—</text><paragraph commented="no" id="id1967F9D0A331464996DFF0616766F618"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to an order of restitution under section 1593 of title 18, United States Code, or</text></paragraph><paragraph commented="no" id="id66CA4EDCF35A4324B660FCD59F8B1664"><enum>(2)</enum><text display-inline="yes-display-inline">in an action under section 1595 of title 18, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="idCFBD5C1BC6F54974B9220FC371D3F37D"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before the item relating to section 140 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA3795158F6C04D929163F9752EE54216"><toc><toc-entry bold="off" level="section">Sec. 139J. Certain amount received as restitution or civil damages as recompense for trafficking in persons.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id0938E4DEA07049CB94B5F9C96B86E7EB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
