which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require reports on the adoption of cryptocurrency as legal tender in El Salvador.</official-title></form><legis-body><section id="idBE5C419636794973B78119916B405263" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability for Cryptocurrency in El Salvador Act</short-title></quote> or the <quote><short-title>ACES Act</short-title></quote>.</text></section><section id="id934F934F99A44C1B9544DBC564071D0C"><enum>2.</enum><header>Reports on adoption of cryptocurrency as legal tender in El Salvador</header><subsection id="id54479d99-cebe-4516-880f-456e2c8d0e2d" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of State and the Secretary of the Treasury shall jointly submit to the appropriate committees of Congress a report on the adoption by the Government of El Salvador of a cryptocurrency as legal tender. </text></subsection><subsection id="id5023423e-046f-4df1-81e7-a0d3d5869ba7" changed="not-changed"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="id68515465-63dd-4271-a198-0fb8c1b1bf13" changed="not-changed"><enum>(1)</enum><text>A description of the process followed by the Government of El Salvador to develop and enact the Bitcoin Law (Legislative Decree No. 57, Official Record No. 110, Volume 431, enacted June 9, 2021), which provides the cryptocurrency, Bitcoin, with legal tender status in El Salvador.</text></paragraph><paragraph id="id68974491-309b-462f-a2c1-e05a67088add" changed="not-changed"><enum>(2)</enum><text>An assessment of—</text><subparagraph id="id03c874b09a3547f7a7bd856686f7fe63"><enum>(A)</enum><text>potential gaps in the Anti-Money Laundering/Combatting the Financing of Terrorism (AML/CFT) framework in El Salvador, and illicit finance risks associated with virtual assets in El Salvador, including El Salvador’s adoption of Bitcoin as legal tender; </text></subparagraph><subparagraph id="id798b69a3-9350-4183-a103-658effebff05" changed="not-changed"><enum>(B)</enum><text>the impact on individuals and businesses of requiring tender of Bitcoin; and</text></subparagraph><subparagraph id="id51412f49-7f1b-4a1b-9995-095112a1a769" changed="not-changed"><enum>(C)</enum><text>the impact of such adoption of a cryptocurrency on—</text><clause id="id4d69151e-8c1f-4715-aef7-dee4beef0aac" changed="not-changed"><enum>(i)</enum><text>the macroeconomic stability and public finances of El Salvador, including taxation; </text></clause><clause id="id0f0c9977-0327-4711-967c-b988e9572159" changed="not-changed"><enum>(ii)</enum><text>the rule of law and democratic governance in El Salvador; </text></clause><clause id="id11790a11-8cd6-4ede-9aa2-750baf7379aa" changed="not-changed"><enum>(iii)</enum><text>the unbanked population in El Salvador;</text></clause><clause id="ida495652a-6bd3-4eda-8821-be7da9c0c2b7" changed="not-changed"><enum>(iv)</enum><text>the flow of remittances from the United States to El Salvador;</text></clause><clause id="id8fe1d1da-b4ae-4d84-ae93-8c706c02c088" changed="not-changed"><enum>(v)</enum><text>El Salvador's relations with multilateral financial institutions, such as the International Monetary Fund and the Word Bank;</text></clause><clause id="ida6b1d5e9-e7e7-469e-a4bd-e207ec12a73f" changed="not-changed"><enum>(vi)</enum><text>bilateral and international efforts to combat transnational illicit activities; and</text></clause><clause id="id3cdf2015-da9c-490d-a193-2660a9e2c75b" changed="not-changed"><enum>(vii)</enum><text>El Salvador's bilateral economic and commercial relationship with the United States and the potential for reduced use by El Salvador of the United States dollar.</text></clause></subparagraph></paragraph><paragraph id="id7bd084bb-da58-48d7-a26b-8443ea4727de" changed="not-changed"><enum>(3)</enum><text>A description of the internet infrastructure of El Salvador and an assessment of—</text><subparagraph id="idcd69a04b-613b-44c3-82fc-b7184be94c04" changed="not-changed"><enum>(A)</enum><text>the degree to which cryptocurrency is used in El Salvador; </text></subparagraph><subparagraph id="id0c80f175-4eb0-4397-a4dc-8885096789b9" changed="not-changed"><enum>(B)</enum><text>matters relating to chain of custody and the potential for hacking and cybertheft of cryptocurrency; and </text></subparagraph><subparagraph id="id3f09148f-abea-4a70-879a-65d53f6f9446" changed="not-changed"><enum>(C)</enum><text>access to transparent and affordable internet and digital infrastructure among the unbanked population of El Salvador.</text></subparagraph></paragraph></subsection><subsection id="id6951acb14bb349cda0bcf36a730c91e7"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection><subsection id="id0b9d2579-f821-40e5-b7d3-9dc835cbd020" changed="not-changed"><enum>(d)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="id62eef356-4960-4b39-8c4a-fe422c957332" changed="not-changed"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></paragraph><paragraph id="idc4003117-2d07-4cef-9f64-4fed9a3d7041" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives. </text></paragraph></subsection></section></legis-body></bill>
