which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require Executive agencies to submit to Congress a study of the impacts of expanded telework and remote work by agency employees during the COVID–19 pandemic and a plan for the agency’s future use of telework and remote work, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7BF2AD7D26254746A8856A6BFF466741"><section section-type="section-one" id="H50BEFB6F2A9042B7A4D4F7345F055A89"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Home Office Work’s Unproductive Problems Act of 2023</short-title></quote> or the <quote><short-title>SHOW UP Act of 2023</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" id="id5287d4a7d0c3429085a52d09349a69cf"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idB0E5A945655F48D9A8684C760C890A4D"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <quote>agency</quote> has the meaning given the term <quote>Executive agency</quote> in section 105 of title 5, United States Code.</text></paragraph><paragraph id="id0306B43190DA4DE5B9916EA29962D943"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The term <quote>Director</quote> means the Director of the Office of Personnel Management.</text></paragraph><paragraph id="idAB693CDE825C4F28881E03BD525BA820"><enum>(3)</enum><header>Locality pay</header><text display-inline="yes-display-inline">The term <quote>locality pay</quote> means locality pay provided for under section 5304 or 5304a of title 5, United States Code.</text></paragraph><paragraph id="id11D83191F4674D1196ABA96DF38A02BE" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Telework; teleworking</header><text>The terms <quote>telework</quote> and <quote>teleworking</quote>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id539d5d284bdf489f9afe05544341e0e5"><enum>(A)</enum><text display-inline="yes-display-inline">have the meaning given those terms in section 6501 of title 5, United States Code; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbed1e67eb1584f1abdcad7819ed3de62"><enum>(B)</enum><text display-inline="yes-display-inline">include remote work. </text></subparagraph></paragraph></section><section commented="no" id="HAE6DE402B92E4DC49A574DC40BFDE06C"><enum>3.</enum><header>Reinstatement of pre-pandemic telework policies, practices, and levels for Executive agencies</header><subsection commented="no" display-inline="no-display-inline" id="iddaee39ab0542484690bb56072378800d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 30 days after the date of enactment of this Act, the head of each agency shall reinstate and apply the telework policies, practices, and levels of the agency that were in effect on December 31, 2019.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf1c4fb7ac22646998e0fb50c5916d320"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">The head of an agency may not expand any policy, practice, or level described in subsection (a) until the date on which the head of the agency submits to Congress—</text><paragraph commented="no" display-inline="no-display-inline" id="id47e991ef2b2943e7929a043e43b362d1"><enum>(1)</enum><text display-inline="yes-display-inline">an agency plan under section 4(a)(2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e57a98bfa384796abf800c0a3840b9e"><enum>(2)</enum><text display-inline="yes-display-inline">a certification under section 4(a)(3).</text></paragraph></subsection></section><section id="H70D7C73FC4FC45C5BCAD131290B48EB1"><enum>4.</enum><header>Study, plan, and certification regarding Executive agency telework policies, practices, and levels for Executive agencies</header><subsection id="H66020EB953AF4096A03BD976F3DE5CF8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the head of each agency, in consultation with the Director, shall submit to Congress—</text><paragraph id="HBB24D99477994B1C91BE955F3F0DDF8B"><enum>(1)</enum><text display-inline="yes-display-inline">a study on the impacts on the agency and the mission of the agency of expanding telework for employees as a result of the public health emergency relating to the Coronavirus Disease 2019 (COVID–19) pandemic declared under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, including an analysis of—</text><subparagraph id="HB12FE63BBF98485789B8BB0C14E85B58"><enum>(A)</enum><text>any adverse impacts of that expansion on the performance by the agency of the mission of the agency, including the performance of customer service by the agency;</text></subparagraph><subparagraph id="HC7F84C6B8E334FBAA96951D83607E143"><enum>(B)</enum><text display-inline="yes-display-inline">any costs to the agency during that expansion attributable to—</text><clause id="H00253F89D13542558A5A996E176CA5C5"><enum>(i)</enum><text>owning, leasing, or maintaining underutilized real property; or</text></clause><clause id="HE9998F83039847FF99D8D01E8AD04604"><enum>(ii)</enum><text>paying higher rates of locality pay to teleworking employees as a result of incorrectly classifying those employees as teleworkers rather than remote workers;</text></clause></subparagraph><subparagraph id="H0C3B4A23013640029DF418DE54C0C646"><enum>(C)</enum><text display-inline="yes-display-inline">any degree to which the agency failed during that expansion to provide teleworking employees with secure network capacity, communications tools, necessary and secure access to appropriate agency data assets and Federal records, and equipment sufficient to enable teleworking employee to be fully productive;</text></subparagraph><subparagraph id="HC9B849F2289E4157AB15790D55CE8B44"><enum>(D)</enum><text display-inline="yes-display-inline">any degree to which that expansion facilitated dispersal of the agency workforce around the United States; and</text></subparagraph><subparagraph id="HBF5B8A85E5034EDB85FBE7C5B14AEC8E"><enum>(E)</enum><text>any other impacts of that expansion that the head of the agency or the Director considers appropriate; </text></subparagraph></paragraph><paragraph id="H5D9D4E02FFAB487F932153D98F657E21"><enum>(2)</enum><text display-inline="yes-display-inline">any agency plan to expand telework policies, practices, or levels beyond the telework policies, practices, and levels of the agency that were in effect on December 31, 2019; and</text></paragraph><paragraph commented="no" id="H4735AE7AEECB44D18134E0103768FDB0"><enum>(3)</enum><text display-inline="yes-display-inline">a certification by the Director that the agency plan described in paragraph (2) will—</text><subparagraph commented="no" id="HB0BA31310DCF4712952367A83BE3709A"><enum>(A)</enum><text>have a substantial positive effect on—</text><clause id="HFC286A1B247A4A9DBDC4A597F445647B"><enum>(i)</enum><text>the performance of the mission of the agency, including the performance of customer service;</text></clause><clause id="H75E8B44FDD6A4209845970CCDC86DE8B"><enum>(ii)</enum><text>increasing the level of dispersal of agency personnel throughout the United States; and</text></clause><clause commented="no" id="HBAAD5D41C1EF47DCB0FE3636D259F166"><enum>(iii)</enum><text>the reversal of any adverse impacts described in paragraph (1)(A);</text></clause></subparagraph><subparagraph commented="no" id="HA55CA06FAC9A4DA5B699BD2F431E2E7A"><enum>(B)</enum><text>substantially lower the costs of the agency relating to owning, leasing, or maintaining real property;</text></subparagraph><subparagraph id="H41B928AB8B91435EBB155317B8F2E06A"><enum>(C)</enum><text>substantially lower the costs of the agency attributable to paying locality pay to agency personnel working from locations outside the pay locality of their position’s official worksite; and</text></subparagraph><subparagraph id="HD1A922545C7648DB93FA9A1DB746287C"><enum>(D)</enum><text display-inline="yes-display-inline">ensure that teleworking employees will be provided with secure network capacity, communications tools, necessary and secure access to appropriate agency data assets and Federal records, and equipment sufficient to enable each teleworking employee to be fully productive, without substantially increasing the agency’s overall costs for secure network capacity, communications tools, and equipment.</text></subparagraph></paragraph></subsection><subsection id="H9DB245F8A98042C081204E35D36A605B"><enum>(b)</enum><header>Limitation</header><paragraph id="HD5981C8DF2F0477985B049407A0FDE39" commented="no"><enum>(1)</enum><header>In general</header><text>The head of an agency may not implement an agency plan described in subsection (a)(2) for which the Director does not issue a certification described in subsection (a)(3).</text></paragraph><paragraph commented="no" id="H4AF8540B1A6C453B93CCC8C0E339F6D8"><enum>(2)</enum><header>Subsequent plans</header><text>If the head of an agency unsuccessfully submits an agency plan described in subsection (a)(2) to the Director for the certification described in subsection (a)(3), the head of the agency may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf5fea58f01974d239b9450a4cc3f6d40"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Director subsequent agency plans until the head of the agency receives the certification; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3964a37ea2c4b5aabfdd4ffe934baf8"><enum>(B)</enum><text display-inline="yes-display-inline">submit a subsequent agency plan described in subparagraph (A) that is certified by the Director to Congress. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
