<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1564</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230511">May 11, 2023</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Office of Personnel Management to establish, or otherwise ensure the provision of, a training program on artificial intelligence for Federal management officials and supervisors, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Artificial Intelligence Leadership Training Act</short-title></quote> or the <quote><short-title>AI Leadership Training Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idbb185028227846da9d77f0fe35b7d16f"><enum>2.</enum><header>Artificial intelligence leadership training program</header><subsection commented="no" display-inline="no-display-inline" id="id6fd20509f37e400586761a8a58b842ff"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida770142b795a40c28fb14b499317670a"><enum>(1)</enum><header display-inline="yes-display-inline">AI</header><text>The term <term>AI</term> has the meaning given the term <term>artificial intelligence</term> in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note).</text></paragraph><paragraph id="id10ee8fba70724ef6b69c50aea69c448c"><enum>(2)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54616dea56cd424cb494b44198d5a546"><enum>(A)</enum><text>a management official;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id991d639eab11437095209460f21fa8d2"><enum>(B)</enum><text>a supervisor; or</text></subparagraph><subparagraph id="id1ad22828ffe64046b601ded79efd6c97"><enum>(C)</enum><text>any other employee of an executive agency— </text><clause commented="no" display-inline="no-display-inline" id="ide8f629fcded14c9c98ccfe7a0ae79eeb"><enum>(i)</enum><text display-inline="yes-display-inline">as determined appropriate by the Director for the purposes of this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id27ada64325404e448f8c237bdc501edf"><enum>(ii)</enum><text>who is designated by the head of that executive agency to participate in the Program.</text></clause></subparagraph></paragraph><paragraph id="id30d5834ee54143a6bb8317b425d71094"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26ea229a94e64bfea90e1e6400578725"><enum>(4)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph><paragraph id="id11f529b284b24e089076468771f57941"><enum>(5)</enum><header>Management official; supervisor</header><text>The terms <term>management official</term> and <term>supervisor</term> have the meanings given those terms in section 7103(a) of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8bcf1d5b78c34aa9b5c86b7f9e74f2fc"><enum>(6)</enum><header>Program</header><text>The term <term>Program</term> means the AI leadership training program established and implemented (or the provision of which is otherwise ensured) by the Director under subsection (b)(1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7e7481f961744326af4df4c6228c05c6"><enum>(b)</enum><header>Program</header><paragraph commented="no" display-inline="no-display-inline" id="id465394f6cc964de3b71e904a3b9215a9"><enum>(1)</enum><header>In general</header><subparagraph commented="no" display-inline="no-display-inline" id="id2c9d7f9509cb43fc9b6571311244e98a"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment of Program</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in consultation with any other person determined relevant by the Director, shall develop and implement (or otherwise ensure the provision of) an AI leadership training program for covered employees, under which training in accordance with the requirements of this section shall be provided to covered employees on an annual basis.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22cff7baea8b4514bfb46086911d1717"><enum>(B)</enum><header>Incorporation of existing training permitted</header><text>For the purposes of subparagraph (A), the Director may include executive agency or other training that the Director determines is relevant to providing the information required under paragraph (3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8dfd3aeda9594ee294647d12af7bd160"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Program shall be to ensure that covered employees have knowledge regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd2c48195292642b9b65196a7b2f71a72"><enum>(A)</enum><text>the capabilities and risks associated with AI;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59335d81fd234b139fd221d3f97a379a"><enum>(B)</enum><text>safety and ethical issues relating to AI;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id688ca2c14e46478cb1e119f96fd080f2"><enum>(C)</enum><text>Federal Government requirements and best practices with respect to AI, such as with respect to the procurement, use, testing, evaluation, and auditing of AI capabilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf71e006b48f24398b4a231bb36908177"><enum>(D)</enum><text>other matters relating to requirements for the development and use of AI within and by the Federal Government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcd57e5b764f548bfb2bb50966deecd71"><enum>(3)</enum><header>Topics</header><text>At a minimum, the Program shall include information relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida5f20745b99649ca9fd2a1a079613ca1"><enum>(A)</enum><text>what AI is and how AI works;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f752d0c869e44438010fd3b3c4dce59"><enum>(B)</enum><text>introductory concepts regarding, and features of, different types of AI;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id995f48b34597433786a778276b184d96"><enum>(C)</enum><text>the benefits offered, and the risks posed, by AI;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd351131343ff4d25b711af7fd537f724"><enum>(D)</enum><text>the role of data in AI systems and the risks of not using sufficiently representative training data in those systems;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e0918d606fc4ad6853380ae53b5cd86"><enum>(E)</enum><text>the ways in which AI can fail;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07e8cb32e3ee46739a496f614879dd1c"><enum>(F)</enum><text>the need for continuous refinement of AI as part of the development and deployment of AI;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida390f995a61441e8b01151d6f6d201a0"><enum>(G)</enum><text>ways to mitigate the risks of AI, including through efforts to create and identify AI that is reliable, safe, trustworthy, and fair; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf50bee655a3a44ab99f270ab62d201d6"><enum>(H)</enum><text>organizational considerations for the development and deployment of AI, including necessary norms and practices, workforce training, and specific use cases.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida86938a706644fe98e40aeda6358ace7"><enum>(4)</enum><header>Updates</header><text>Not less frequently than once every 2 years after the date on which the Director develops and implements (or otherwise ensures the provision of) the Program under paragraph (1), the Director shall update the Program to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1aafb3b53064d6e8bb1eecaf5e48d04"><enum>(A)</enum><text>incorporate new information relating to AI; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50b94b12a84b454293be4dc001013791"><enum>(B)</enum><text>ensure that the Program continues to satisfy the requirements under paragraph (3) and any other requirements determined by the Director.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5a7e8ea1871498fb0c03a1ed3a37562"><enum>(5)</enum><header>Metrics</header><text>The Director shall establish a means by which to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6768534d57da432980e61cb5f027e2a7"><enum>(A)</enum><text>understand and measure the participation of covered employees in the Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida60b943252ea472e9f0f83ad8ba4c466"><enum>(B)</enum><text>receive and consider feedback from participants in the Program so as to improve the Program through updates implemented under paragraph (4).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dde6aa5c30f411f87757ed615b29088"><enum>(6)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Director should ensure that training provided under the Program includes interactions with technologists, scholars, and other experts from the private, public, and nonprofit sectors.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd884113d3fc14c4d9bd430ddce1ecc2a"><enum>(7)</enum><header>Sunset</header><text>Effective on the date that is 10 years after the date of enactment of this Act, this section shall have no force or effect.</text></paragraph></subsection></section></legis-body></bill>
