which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent the theft of catalytic converters and other precious metal car parts, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H67D6E469CCA844D88132791D3EC3297A"><section section-type="section-one" id="H1C9B2E645FB04146AF61C94C50AF1469"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Auto Recycling Theft Act</short-title></quote> or the <quote><short-title>PART Act</short-title></quote>.</text></section><section id="H382C688EFF45471A8044B72AEAD19550"><enum>2.</enum><header>Requirements for new motor vehicle regulations relating to catalytic converters</header><subsection id="H024DF1791EE8453B8128C065AC8E29A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the National Highway Traffic Safety Administration (referred to in this section as the <term>Administrator</term>) shall—</text><paragraph id="HC1782DEBC2C94DD4A3201659BAB846BF"><enum>(1)</enum><text>issue a notice of proposed rulemaking to revise the motor vehicle theft prevention standard contained in section 541.5 of title 49, Code of Federal Regulations (or a successor regulation), to include catalytic converters among the parts specified in subsection (a) of that section;</text></paragraph><paragraph id="idEE1281A04EDA482DBD26D43846792C57"><enum>(2)</enum><text>issue a notice of proposed rulemaking to revise part 543 of title 49, Code of Federal Regulations (or successor regulations), to require that, notwithstanding the granting of a petition under that part, all catalytic converters be marked in accordance with section 541.5 of that title (as revised pursuant to paragraph (1)); and</text></paragraph><paragraph id="HEFA7416A9BCD4F429A301637AE77DEA4"><enum>(3)</enum><text>update other regulations, as necessary, to ensure that, with respect to catalytic converters, the requirements of section 541.5 and part 543 of title 49, Code of Federal Regulations (as revised in accordance with paragraphs (1) and (2), respectively), apply to any vehicle covered by part 565 of that title (or successor regulations).</text></paragraph></subsection><subsection commented="no" id="H7128BD4556874F44B74411818EF5D5A6"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/331">chapter 331</external-xref> of title 49, United States Code, in the case of a vehicle described in section 565.2 of title 49, Code of Federal Regulations (or a successor regulation), that has not been sold to the first purchaser (as defined in section 33101 of title 49, United States Code), the requirements added to section 541.5 of title 49, Code of Federal Regulations (or a successor regulation), by the Administrator in accordance with paragraph (1) of subsection (a) shall apply to the vehicle beginning on the date that is 180 days after the date on which the Administrator makes the revisions and updates required by that subsection, regardless of the model year of the vehicle or the date on which the vehicle is manufactured.</text></subsection><subsection commented="no" id="id7FD481136853487DA33FEEC5F64D9A7B"><enum>(c)</enum><header>Marking of catalytic converters notwithstanding an exemption</header><text>Section 33106 of title 49, United States Code, is amended—</text><paragraph id="id1ea24440c5d245c78b206aacdfe3e241"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="id9632BC47757A4B97990565BBBE44008F"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id0D7F9786CA01412A9D28564E4D66A69B"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="idF0BA76554969474092B1BC5129957FEF"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id08A41182C54741749B6AC9E0889A1076"><paragraph id="id354cc5e4dc9a4e96b504cfe058ab38cc"><enum>(3)</enum><text>a certification that the catalytic converter will be marked in accordance with sections 33101 through 33104, including associated regulations; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4f7cf1ccbc4d47adac9e23ad9b8b538a"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9a686168e3e4c7682a3a15a92fcf9d9"><subsection id="id603331f8a67f45bfb73763128374e496"><enum>(f)</enum><header>Requirements for marking catalytic converters</header><text>The Administrator of the National Highway Traffic Safety Administration shall promulgate regulations requiring catalytic converters on a vehicle line to be marked in accordance with sections 33101 through 33104, including associated regulations.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section section-type="subsequent-section" id="H77BA2F605D6F484082F4DB675CB649E2"><enum>3.</enum><header>Grant program for VIN stamping</header><subsection id="HC353CA19FBC9417E83AF1200DFF6A8A3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id23D875A9ABB04A6689EE43F65FDA7D82"><enum>(1)</enum><header>Covered activity</header><subparagraph id="idB6D33FB3649B4AB08F75E42E38F55A41"><enum>(A)</enum><header>In general</header><text>The term <term>covered activity</term>, with respect to a motor vehicle, means die or pin stamping of the full vehicle identification number on the outside of the catalytic converter in a conspicuous manner.</text></subparagraph><subparagraph id="id52B2A97F2EA94293812C925D1FFF23C7"><enum>(B)</enum><header>Stamping</header><text>For purposes of subparagraph (A), the term <term>stamping</term> means stamping—</text><clause id="id7CB98C6A78E64C5598F3ADCCC8813A28"><enum>(i)</enum><text>in a typed (not handwritten) font; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idA76C4730248D4ECC9A3AF7B503C566F1"><enum>(ii)</enum><text>covered through the application of a coat of high-visibility, high-heat theft deterrence paint. </text></clause></subparagraph></paragraph><paragraph id="idC390237A94C143D0A4743B5CD85B0E7F"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idCAC3250E1F7A49D08CBB78949ABD190A"><enum>(A)</enum><text>a law enforcement agency;</text></subparagraph><subparagraph id="id505E831D0D684C66973C27FB0D3C1E9B"><enum>(B)</enum><text>an automobile dealer;</text></subparagraph><subparagraph id="id99556A13C2664C1DA8FBC8BE72279223"><enum>(C)</enum><text>an automobile repair shop and service center; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idECA6C8081BE04E2DAAA2FC83C5816903"><enum>(D)</enum><text display-inline="yes-display-inline">a nonprofit organization.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95B48747BAF34FA1AEE50DF810E6EE0D"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="id68D4F8C4294C477C813834C13AE1B0B8"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide grants to eligible entities to carry out covered activities (excluding wages) relating to catalytic converters.</text></subsection><subsection id="H5E600BC1BEA04CB9A90BA83E6C9A6DB2"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H885E9BC45F4B4DAEA94268821F5F6394"><enum>(d)</enum><header>Requirement</header><text>A covered activity carried out with a grant awarded under this section shall be carried out at no cost to the owner of—</text><paragraph id="idA55B8ADACBB144F1A7BE7E1190164DDB"><enum>(1)</enum><text>the motor vehicle being stamped; or </text></paragraph><paragraph id="idFB0C061DB4DE4580A4A97F14C1633881"><enum>(2)</enum><text>any motor vehicle otherwise receiving service from an eligible entity. </text></paragraph></subsection><subsection id="HFDD71718E70A45B6BA3D5B3E156FA80F"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to—</text><paragraph id="H5681BB7953B649FDBAD46D8AD138B0F1"><enum>(1)</enum><text>eligible entities operating in areas with the highest need for covered activities, including the areas with the highest rates of catalytic converter theft, as determined by the Secretary; and</text></paragraph><paragraph commented="no" id="H666A25264A9D4BB9AA3ED763EB71DE89"><enum>(2)</enum><text>eligible entities that are in possession of motor vehicles that are subject to the requirement described in section 2(b).</text></paragraph></subsection><subsection id="H70CD9DE4A73B47A8B048EC3C8F5D20C5"><enum>(f)</enum><header>Procedures for marking</header><text display-inline="yes-display-inline">In carrying out the grant program under this section, the Secretary shall issue such regulations as are necessary to establish procedures to mark catalytic converters of vehicles most likely to be targeted for theft with unique identification numbers using a combination of die or pin stamping and high-visibility, high-heat theft deterrence paint without damaging the function of the catalytic converter. </text></subsection><subsection id="HCE4E5987AC4D4159A5464233070F5504"><enum>(g)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter for 10 years, the Secretary shall submit to Congress a report on the grant program established under subsection (b) that includes a description of the progress, results, and any findings of the grant program, including—</text><paragraph id="idD3EAF5A471F64A1D9916E6C0AF658F55"><enum>(1)</enum><text>the total number of catalytic converters marked under the grant program; and </text></paragraph><paragraph id="id519EACF12E644E6BA3DE0C5BA6CF9E78"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6F0EE7FB680C46F599F99FCCB4C64801"><enum>(A)</enum><text>to the extent known, whether any catalytic converters marked under the grant program were stolen; and </text></subparagraph><subparagraph id="id58C051419338418B8DD43A2C1EB7E017" indent="up1"><enum>(B)</enum><text>the outcome of any criminal investigation relating to those thefts.</text></subparagraph></paragraph></subsection><subsection id="id5fbb82ccd3b94e0eab514b00950debcf"><enum>(h)</enum><header>Funding</header><paragraph id="id45bfb92905a5430990144a9020809b7b"><enum>(1)</enum><header>Unobligated funding available</header><text>Of the unobligated amounts appropriated by the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 4), $7,000,000 shall be made available to carry out this section.</text></paragraph><paragraph id="id0c97634076834d66b1375976bb52f655"><enum>(2)</enum><header>Authorization of appropriations</header><text>In the event that the total of $7,000,000 of the funds described in paragraph (1) may not be made available to carry out this section, there is authorized to be appropriated to carry out this section an amount equal to the remaining funding necessary to total $7,000,000.</text></paragraph></subsection></section><section id="HE4252DF9572F44BF8D490AE76DBABDD5"><enum>4.</enum><header>Requirements for purchase of catalytic converters and retention of seller information</header><subsection id="H49377C687B9E42F68C71D51599BB2962"><enum>(a)</enum><header>Inclusion of catalytic converters</header><text display-inline="yes-display-inline">Section 33101(6) of title 49, United States Code, is amended—</text><paragraph id="HFCBD5FAA84F349E0B15A40DAE1A72A02"><enum>(1)</enum><text>in subparagraph (K), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph><paragraph id="id736FA6F63C204992B11F55C9A077F7CC"><enum>(2)</enum><text>by redesignating subparagraph (L) as subparagraph (M);</text></paragraph><paragraph id="id8F71BB875793477A876B08828CBF3415"><enum>(3)</enum><text>by inserting after subparagraph (K) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id142C1BAF20AF4CADA38BA7FF8114F57A"><subparagraph id="id0C21F8CBF2FD45FD901C1B1A93B7500A"><enum>(L)</enum><text display-inline="yes-display-inline">the catalytic converter; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5C9339BEA47B47A5A4D7EFEF36163EAC"><enum>(4)</enum><text>in subparagraph (M) (as so redesignated), by striking <quote>subclauses (A)–(K) of this clause</quote> and inserting <quote>subparagraphs (A) through (L) of this paragraph</quote>.</text></paragraph></subsection><subsection id="H0E8A027B710741C7937F54AA47BA7669"><enum>(b)</enum><header>Retention of records</header><text display-inline="yes-display-inline">Section 33111 of the title 49, United States Code, is amended—</text><paragraph id="HD6F4A3A255BE45238AC165A158C196A1"><enum>(1)</enum><text>in subsection (a), in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">General requirements</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Prohibitions related to selling motor vehicle parts</header-in-text></quote>;</text></paragraph><paragraph id="H9DB760C08826429BAFADF284A17182B3"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text></paragraph><paragraph id="H2D925C9494ED4F4C8DFB3E22088E6141"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id365E9117C7174834B74AE7D80F7079C1"><subsection id="HC2B1EADE93F24E83913FD0621E233C27"><enum>(b)</enum><header>Retention of records</header><paragraph id="H4C8B698D2C094F469923698108E74EDF"><enum>(1)</enum><header>Definition of precious metals</header><text>In this subsection, the term <term>precious metals</term> has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations (or a successor regulation). </text></paragraph><paragraph id="id758369D31FFF4EAE8955B15DBEB49F09"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">A seller of motor vehicles or motor vehicle parts that contain precious metals, including a person engaged in the business of salvaging, dismantling, recycling, or repairing motor vehicles or motor vehicle parts that contain precious metals, shall provide to a purchaser on the sale of the motor vehicle or motor vehicle part, as applicable—</text><subparagraph id="HEEA7B2E0818342F3B961988FBF9B8C6F"><enum>(A)</enum><text>the name, address, telephone number, and a photocopy of a government-issued identification of the seller; and</text></subparagraph><subparagraph id="HE4641EC1D2F649AABCE831232E0AE5AE"><enum>(B)</enum><text>the make, model, vehicle identification number, date of purchase, and a description of the motor vehicle or, with respect to a motor vehicle part, a description of the motor vehicle from which the part was removed.</text></subparagraph></paragraph><paragraph id="HABE16C050C9E4028B0AA1A84E8992B8C"><enum>(3)</enum><header>Duration of retention</header><text>A person shall retain the information described in paragraph (2) for a period of not less than 2 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA20EE724B64A4737B48565528DA45832"><enum>(c)</enum><header>Prohibition on sale of partial catalytic converters</header><text display-inline="yes-display-inline">It shall be unlawful to sell or purchase any—</text><paragraph id="id7F9749328BEB4D37878D05BA574B1528"><enum>(1)</enum><text display-inline="yes-display-inline">partial or de-canned catalytic converter parts; or </text></paragraph><paragraph id="id137C7795E703448BB60A85A0CE90C72D"><enum>(2)</enum><text display-inline="yes-display-inline">catalytic converter which has had identifying markings removed or otherwise tampered with.</text></paragraph></subsection><subsection id="HECC29B49CB53498BA5EFE7EDE1DEA4D4"><enum>(d)</enum><header>Regulations</header><text>The Attorney General shall prescribe regulations to carry out this section and the amendments made by this section, including the enforcement and penalties that apply to a violation of this section and the amendments made by this section.</text></subsection></section><section id="H5F50C554023D4DBB9DD37E1C95D5B390"><enum>5.</enum><header>Criminal penalties</header><subsection id="HFA25B2BC7259440582567622AEFB742C"><enum>(a)</enum><header>Theft of catalytic converters</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/31">Chapter 31</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H1B1279622B1F46578FB1DBEC731A6F03"><enum>(1)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA49091DB83894D3EADBE4C3126DDCB35"><section id="HBEECE9A6B51347C798DD28A62D2E5118"><enum>671.</enum><header>Theft of catalytic converters</header><subsection id="id4BF673B680D94C90AF0D5B869C03AD46"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>precious metals</term> has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations, or any successor regulation.</text></subsection><subsection id="id6027D6B25CBE47799B6B665797212D95"><enum>(b)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful to steal or knowingly and unlawfully take, carry away, or conceal a catalytic converter from another person’s motor vehicle, or knowingly purchase such a catalytic converter, with the intent to distribute, sell, or dispose of the catalytic converter or any precious metal removed therefrom in interstate or foreign commerce.</text></subsection><subsection id="idA9401C32B5C340B0BD7374B94899E3E4"><enum>(c)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (b) shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1C5532EAB7E94EBFB3AA4239C65991F9"><enum>(2)</enum><text>in the table of sections, by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H0838AADC761C4154BFDE9CC6D357940D"><toc regeneration="no-regeneration"><toc-entry level="section">671. Theft of catalytic converters.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H04134F3168E8409A9CDBC9AF50843A13"><enum>(b)</enum><header>Definitions</header><text>Section 2311 of title 18, United States Code, is amended by inserting after <quote>for running on land but not on rails;</quote> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCB6F8D97AC5142FC9547AFBEDD064965"><subsection id="HE1F9831155454DEE9E348F3BAA358A4D"><enum/><text display-inline="yes-display-inline"><term>Precious metals</term> has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations, or any successor regulation;</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2449C79CB36D40749CB08752AD45ABEA"><enum>(c)</enum><header>Trafficking in car parts containing precious metals</header><text>Section 2321 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDD2BEC1A41774C178F60784DE96A3375"><subsection id="HF7312224CA884D6592FC2841A1AC95F4"><enum>(d)</enum><header>Trafficking in motor vehicle parts containing precious metals</header><paragraph id="idFE2A6722E49541EEB3E84834CA36E844"><enum>(1)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful to buy, receive, possess, or obtain control of, with intent to sell or otherwise dispose of, a catalytic converter (including a de-canned catalytic converter), knowing that the catalytic converter has been stolen.</text></paragraph><paragraph id="id23291CD9F9F748C9865064089A7A7C9C"><enum>(2)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who violates paragraph (1) shall be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6A1731AED7DB44DA95456BCB4C0C144B"><enum>(d)</enum><header>Chop shops</header><text>Section 2322(b) of title 18, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H2EE6CC4C7FE149FFB92F58A0D5F61A20"><subsection id="HC710BFDB7BD640B5A5BCEFD5F9051A68"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>chop shop</term> means any building, lot, facility, or other structure or premise where 1 or more persons engage in receiving, concealing, destroying, disassembling, dismantling, reassembling, or storing any motor vehicle or motor vehicle part that has been unlawfully obtained in order to alter, counterfeit, deface, destroy, disguise, falsify, forge, obliterate, extract any precious metal therefrom, or remove the identity, including the vehicle identification number or derivative thereof, or other identification marking, of the vehicle or vehicle part and to distribute, sell, or dispose of the vehicle or vehicle part, or precious metal extracted from the vehicle or vehicle part, in interstate or foreign commerce.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
