Shao II Fentanyl Public Health Emergency and Overdose Prevention Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id0dec55ffae3c4d3d8454cd9362310e1c"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id9fd2db033559475297bc402b43d73482"><enum>(1)</enum><text>More than 100,000 Americans died from drug overdoses during 2021, with the majority of such deaths caused by fentanyl.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42af07ff3eed4187bc4fd3b226c18583"><enum>(2)</enum><text display-inline="yes-display-inline">Fentanyl is a potent synthetic opioid drug that is 50 times more potent than heroin and 100 times more potent than morphine.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87c683a3ebfd4c0e89136bcc257e7dc7"><enum>(3)</enum><text>Fentanyl is involved in more deaths of Americans younger than 50 years of age than any other cause of death, including heart disease, cancer, homicide, suicide, and other accidents.</text></paragraph><paragraph id="ida9941a3a80274890b2dcbeb0e7d033a4"><enum>(4)</enum><text>In 2022, the United States Drug Enforcement Agency seized 50,000,000 fentanyl-laced pills and over 10,000 pounds of fentanyl powder, which is enough fentanyl to kill every American.</text></paragraph><paragraph id="id3e9f29d8105c41bc875d7cfcd2efba42"><enum>(5)</enum><text>Just 2 milligrams of fentanyl is considered a lethal dose. </text></paragraph><paragraph id="id18bab04eb19c42d3a8a776c0db87c878" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">The smuggling of fentanyl into the United States constitutes a major public health crisis.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idcceeee1898b14362b245a868e41eee7d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id971fe9bb7d364405b6fcbdb7f9c3996c"><enum>(1)</enum><header>Covered alien</header><text>The term <term>covered alien</term> means any person who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ae7b297f00c4adeabf33fe5f26c309a"><enum>(A)</enum><text display-inline="yes-display-inline">is attempting to unlawfully enter the United States from Canada or from Mexico;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74cc4e35449f494a94c73ded9d52f953"><enum>(B)</enum><text>does not possess the required travel documents to be admitted to the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1751b73ca9c4f43bbabf9052fb3faac"><enum>(C)</enum><text display-inline="yes-display-inline">is being held at a point of entry or a Border Patrol station to facilitate immigration processing.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea9aaa57ff4446bc8536c3667a932c09"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="iddc85e1983eef4bae87af1b06a026e697"><enum>4.</enum><header display-inline="yes-display-inline">Suspending the introduction of covered aliens into the United States due to the fentanyl public health crisis</header><subsection commented="no" display-inline="no-display-inline" id="id6b5589e16c0b4f5aa3c00f386723a69b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date of the enactment of this Act, the admittance of covered aliens into the United States is suspended to protect the public health.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide8a36d59c6b649f682a0edb26170e2cf"><enum>(b)</enum><header>Relocation</header><text display-inline="yes-display-inline">Covered aliens who attempt to enter the United States, either through a point of entry or between points of entry, while the suspension described in subsection (a) remains in place shall be returned to their country of origin or to the country from which they entered the United States as rapidly as possible to lower the risk of such aliens introducing, selling, trafficking, or otherwise illicitly disseminating or promoting the dissemination of deadly fentanyl into the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id410404b1554445d9b7c99cdfd041329a"><enum>(c)</enum><header>Repatriation flights</header><text display-inline="yes-display-inline">The Secretary is authorized to transport covered aliens being relocated pursuant to subsection (b) on scheduled repatriation flights, on a space available basis.</text></subsection></section></legis-body></bill>
