which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that whistleblowers, including contractors, are protected from retaliation when a Federal employee orders a reprisal, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Whistleblower Protections for Contractors Act of 2023</short-title></quote>.</text></section><section id="id45C8651DA91B4262BD1347542512D076"><enum>2.</enum><header>Defense contractor employees: protection from reprisal for disclosure of certain information</header><text display-inline="no-display-inline">Section 4701 of title 10, United States Code, is amended—</text><paragraph id="id056D35AF44AD49CF8E2C7286AFB22E8E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id7AECE3E51CF441C195151999B2253C2E"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id649EE9EA6A8D481EAB468A1EECDB6E58"><enum>(i)</enum><text>in the matter preceding subparagraph (A)—</text><subclause id="id3276BFB9FD2B4F4D90F1E5CBCA8D3072"><enum>(I)</enum><text>by striking <quote>An employee</quote> and all that follows through <quote>services contractor</quote> and inserting <quote>A protected individual</quote>; and</text></subclause><subclause id="id4167721A0C4F493B80A0A43D35EFBFED"><enum>(II)</enum><text>by striking <quote>disclosing</quote> and all that follows through <quote>evidence of</quote>; and</text></subclause></clause><clause id="id1EDBD6DB7BD346A3AD198009DF2A8F79"><enum>(ii)</enum><text>by striking subparagraphs (A), (B), and (C) and inserting the following subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8637562540A04607B851CDB8F223D377"><subparagraph id="idb628c9067bbe4e75af8179742a4820b4" indent="up1"><enum>(A)</enum><text>Objecting or refusing to participate in any activity, policy, practice, or assigned task that the protected individual reasonably believes to be in violation of any law, rule, order, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="id589E86E37DEC41C6B2D82ABBDE5D7F81" indent="up1"><enum>(B)</enum><text>Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="id5723BB92F39848FA904CDB5204C81FAF"><enum>(i)</enum><text>Gross mismanagement of any Department of Defense contract or grant, any gross waste of Department funds, any abuse of authority relating to any Department contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Department contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="idc9e9ba29635948259117ec4e904a46aa"><enum>(ii)</enum><text>Gross mismanagement of any National Aeronautics and Space Administration contract or grant, any gross waste of Administration funds, any abuse of authority relating to an Administration contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Administration contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="idADFCEE1F323F4D09B36AEC6E73FDB1DD"><enum>(iii)</enum><text>A substantial and specific danger to public health or safety.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id76DE9FFEEF114133A9D34A76FAD7483C"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="id21303BA4C277431FB35E4C4DC99E32D9"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="id39549563A4D64EDA9B7B48E1CFD76F63"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB5DF10C7A4564F9BA231EFCA47DEFD7E"><subparagraph id="id2D5AECBABB034509B835372DC739FD7E" indent="up1"><enum>(B)</enum><text>it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id7DAD1BFA75A64E95A77F4E1F24D1A72C"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id4835E1754B25418F99858D347DD88436"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id061EFC37A4224BBCBDDBC3957AE34322"><subparagraph id="idE657AFB39E9649E5AD6D70595E20DCEF" indent="up1"><enum>(E)</enum><text>Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idD9ACA56A1D5B4053B012B0EB4C325079"><enum>(B)</enum><text>by striking paragraph (7) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB5FE413B11EE4C8FAE5D60DD291ED7BD"><paragraph id="idDB321C185ADB4656A8D9614A952D81A9" indent="up1"><enum>(7)</enum><header>Clarification for scope of waiver restrictions</header><subparagraph commented="no" display-inline="yes-display-inline" id="idE7A8F5C451A64B87AE8DE2236AC5AE6D"><enum>(A)</enum><text>The rights, forum, and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></subparagraph><subparagraph id="id6261538CE1794CA0832F854471EB4552" indent="up1"><enum>(B)</enum><text>No predispute arbitration agreement shall be valid or enforceable if it requires arbitration of a dispute arising under this section.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idF9E1E63ED289441FA6BC51C629ECD223"><enum>(3)</enum><text>in subsection (f)—</text><subparagraph id="id27DCAB1395D24DDDBA0026CAEA3F3590"><enum>(A)</enum><text>by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></subparagraph><subparagraph id="id6488305592EE4354B217F3A8EBE8B57E"><enum>(B)</enum><text>by striking <quote>the employee</quote> and inserting <quote>the protected individual</quote>; </text></subparagraph></paragraph><paragraph id="idB81FE5548B1446809C0D599A75CCF1B0"><enum>(4)</enum><text>by redesignating subsection (g) as subsection (h);</text></paragraph><paragraph id="idB305693E293540E6AE88A4DE7A1C7B02"><enum>(5)</enum><text>by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc7624a9b699b475fa1e7f8c83589252d"><subsection id="idfb23986051814a849aa7354f8a7d494b"><enum>(g)</enum><header>Affirmative defense</header><text>Engaging in any activity protected against reprisal under this section shall be an affirmative defense in any civil or criminal action that seeks liability for engaging in such activity.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id25B935C1661249CCA7DA20DAA6F5F0D1"><enum>(6)</enum><text>in subsection (h), as so redesignated—</text><subparagraph id="id0153E3A562FD416BA31246DDF6DC9A94"><enum>(A)</enum><text>in paragraph (3), by inserting <quote>, including any <quote>Federal award</quote> as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note)</quote> after <quote>agency</quote>; </text></subparagraph><subparagraph id="idB533D91E379B4F919A40A4F3D6AC0DE0"><enum>(B)</enum><text>in paragraph (4), by inserting <quote>, including any person that is recipient of a <quote>Federal award</quote> as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note)</quote> after <quote>agency</quote>; and</text></subparagraph><subparagraph id="idA1AAF2D58D2F431890E5603C22689C8E"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCF14481940794C908EAE36EF0CB7450B"><paragraph id="id22A1DA3E7915460C98C4AC37D30AE964"><enum>(8)</enum><text>The term <term>protected individual</term> means—</text><subparagraph id="id2b469c35d5ee4bd0851669a16fcefa10"><enum>(A)</enum><text>a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, including—</text><clause id="id3B37EE6B55C0494C91D6E55F56ECAF0A"><enum>(i)</enum><text> the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id668E51C267FB4A258295EFCEDE413321"><enum>(ii)</enum><text> the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause id="idDAB86C9DE30745F6A71B007BC5BE096B"><enum>(iii)</enum><text>any entity that is recipient of a <term>Federal award</term> as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note); </text></clause></subparagraph><subparagraph id="id7e557b40c7674a7abb7ad29d8c105e21"><enum>(B)</enum><text>an employee, applicant, or former employee of a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, including an employee of—</text><clause id="idD49DB7A1CB0545169F1C4DB9C05A1F95"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; and</text></clause><clause id="id928DF5DA81F54DC6B2E5B914D28B2E1E"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); or </text></clause></subparagraph><subparagraph id="idc577aaddaff34334a50b31ba439eea5a"><enum>(C)</enum><text>a person performing personal services for the Department of Defense or the National Aeronautics and Space Administration pursuant to a contractual agreement for the performance of personal services, including a personal services contract or personal services agreement, and who engages in an activity for which any reprisal is prohibited under subsection (a), including a person performing personal services pursuant such a contractual agreement for—</text><clause id="id161F751D3DDD4DC4A6E353DC390F6045"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; and</text></clause><clause id="id1D3E06F51438486A9F677C7FCDCB7A9D"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i). </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idB787A7928B31450CA6663A3099F17DD7"><enum>3.</enum><header>Enhancement of non-defense contractor protection from reprisal for disclosure of certain information</header><text display-inline="no-display-inline">Section 4712 of title 41, United States Code, is amended—</text><paragraph id="id71B85715EE894F7CAE723737ADAA1C12"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id34520122DC424805933B6472CAF445F1"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5619CF633237451B99B000A2401257F5"><paragraph id="id2F9011ABC6504685B46E07835F5A28E4"><enum>(1)</enum><header>In general</header><text>A protected individual may not be discharged, demoted, or otherwise discriminated against as a reprisal for the following:</text><subparagraph id="id2C4F07CAD78A49AFAFEE008093DFC6FD"><enum>(A)</enum><text>Objecting or refusing to participate in any activity, policy, practice, or assigned task that the protected individual reasonably believes to be in violation of any law, rule, order, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="idA395FBC7829C491C82AEF6D76995BDFF"><enum>(B)</enum><text>Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="idBF5849D7B23E49F4A65ED5BB3BCF4E64"><enum>(i)</enum><text>Gross mismanagement of any Federal contract or grant, any gross waste of Federal funds, any abuse of authority relating to any Federal contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Federal contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="id91AC464F8EC64775B5876E9CE1924ED3"><enum>(ii)</enum><text>A substantial and specific danger to public health or safety.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id51092C7FF803457E85F28333EDAEB527"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="idBF2E8BB550BC4421AE73A76B2AB90125"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="id6627383FCD70477483FEA94A39DF280F"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6C3EECBAC3F54A6E8F970441450A18A8"><subparagraph id="idCEA5983AAE4A4F9195E8EB9154A4D3C0"><enum>(B)</enum><text>it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id0E3D886AA2C6483393C5A6C89512B65B"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id3559F67FBC9B484B8D72E63B15260BC7"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC2F393ACA089421B83A946CFC2FF40A4"><subparagraph id="id2378E1EBAAAE404E9CB726A22805B944"><enum>(E)</enum><text>Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id8D9C02C14DBC44F89C12118C44D08A22"><enum>(B)</enum><text>by striking paragraph (7) and inserting the following paragraph:</text><quoted-block id="idE89B4729B17F4CDB8F8A9D984FD9DCB9" display-inline="no-display-inline" style="OLC"><paragraph id="idCF5FD80B77354C1BA4ED6E1147A6D9FF"><enum>(7)</enum><header>Rights, forum, and remedies not waivable</header><subparagraph id="id728DC1D3865F4F3ABA6A1042A92273A3"><enum>(A)</enum><header>In general</header><text>The rights, forum, and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></subparagraph><subparagraph id="id13E9F1AF76354CC0BFFB89D03331C5A0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Validity</header><text>No predispute arbitration agreement shall be valid or enforceable if it requires arbitration of a dispute arising under this section.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idB2D1AFC08DEE4CD7808F0A8A06B60642"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="idF5A021DF5BCE4EECBEEE9B5FD3205A04"><enum>(A)</enum><text>by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></subparagraph><subparagraph id="id39E8D15F3750456B82B3D6342348E706" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by striking <quote>the employee</quote> and inserting <quote>the protected individual</quote>; </text></subparagraph></paragraph><paragraph id="idA8D09A79CD8E4A1D8F3F9845D9AAF65D"><enum>(4)</enum><text>in subsection (g)—</text><subparagraph id="idAD8D536592E343F9A6DD963FBE976B99"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3); </text></subparagraph><subparagraph id="id722822326A104933AE131D45CA8ED397"><enum>(B)</enum><text>by inserting after paragraph (1) the following new paragraph (2):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD3E45F695E24F1FA2E06E69CEC5CDD8"><paragraph id="id9302c591e4524ed29791d2ad8e2bfe9d"><enum>(2)</enum><text>The term <term>contract</term> includes any <quote>Federal award</quote> as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id701901d5a137464a982755778bb45c49"><enum>(C)</enum><text>by inserting after paragraph (3), as so redesignated, the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE4FAF6FFF6FB48799A564C7C928305A4"><paragraph id="id40BD025A95C54B91AB9E00BAEF11A9B5"><enum>(4)</enum><text>The term <term>protected individual</term> means—</text><subparagraph id="id161818DD59A54C0FAF55330DFFD5115C"><enum>(A)</enum><text>a contractor, subcontractor, grantee, or subgrantee of the Federal Government, including—</text><clause id="id8419621d5c474f27a02b8304fb9771a6"><enum>(i)</enum><text> the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="idef6e918d8c1e4e9592ac60f31a71bdbf"><enum>(ii)</enum><text> the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause id="id64185095DE724ED9A88D7B047B9D7C98"><enum>(iii)</enum><text>any entity that is recipient of a <term>Federal award</term> as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note);</text></clause></subparagraph><subparagraph id="id757BD75EDFAA49FB89E65841CA4540A7"><enum>(B)</enum><text>an employee, applicant, or former employee of a contractor, subcontractor, grantee, or subgrantee of the Federal Government, including an employee of—</text><clause id="id558b30d79103463481f280b45dccca82"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; and</text></clause><clause id="idf43026386d8d4c9e8ead4e37b32e77a6"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); or</text></clause></subparagraph><subparagraph id="idA555853E553D4AABBB980E2BB58F069D"><enum>(C)</enum><text>a person performing personal services for the Federal Government pursuant to a contractual agreement for the performance of personal services, including a personal services contract or personal services agreement, including a person performing personal services pursuant to such a contractual agreement for—</text><clause id="id36ebc56bb386416db3256d7c67fbfcee"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; and</text></clause><clause id="idd6699e309c8a4756831623f0cad8c2e1"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id689C28D6BDC04108AB1F90E5F3B6D540"><enum>(5)</enum><text>by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph id="id21F5699D89AA4382890A383E0CCA7CC0"><enum>(6)</enum><text>by inserting after subsection (g) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53600B9C98FC4899B579DCB097702F20"><subsection id="id1218B3C894D643A68E64222284DA46A9"><enum>(h)</enum><header>Affirmative defense</header><text>Engaging in any activity protected against reprisal under this section shall be an affirmative defense in any civil or criminal action that seeks liability for engaging in such activity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
