which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Power Act to modernize and improve the licensing of non-Federal hydropower projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idd407c0c152fe454faa9bfd506d1cbbc6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community and Hydropower Improvement Act</short-title></quote>.</text></section><section id="id77c96018b1124cc7b9300c96388b021a"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>) is amended—</text><paragraph id="id9811873609434f6695a3b402022ea374"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="id0cfc9658848d4cd783ae3ef4eba510e3"><enum>(A)</enum><text>by striking <quote>tribal lands embraced within Indian reservations,</quote>; and</text></subparagraph><subparagraph id="idb3e69466154841749e2fd0ea97b6fe34"><enum>(B)</enum><text>by striking <quote>also</quote> and inserting <quote>land and interests in land held in legal title by the United States in trust for the benefit of an Indian Tribe; and</quote>;</text></subparagraph></paragraph><paragraph id="id18a7256cc8f141059d51e229d88fd6a2"><enum>(2)</enum><text>in paragraph (5), by inserting <quote>Indian Tribe,</quote> after <quote>State,</quote>; and</text></paragraph><paragraph id="id4604fd206d554b28943ae91d539f0e79"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb40deb63bf764deaa5064eae71df25cd"><paragraph id="idf175d6ea938b4af9960dd7d48059438e"><enum>(30)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published annually pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="ide5b65b3b616a454c8f59b8739292ef83"><enum>(31)</enum><header>Project effects</header><text>The term <term>project effects</term> has the meaning given the term in paragraph (1) of section 2403(c) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/797d">16 U.S.C. 797d(c)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id0221b163b4c243168a13dd564783424f"><enum>3.</enum><header>General powers of the Federal Energy Regulatory Commission</header><subsection id="id152A2504BDC04556A755A6349A8CE8C0"><enum>(a)</enum><header>Technical correction to the Energy Policy Act of 2005 and Federal Power Act</header><paragraph id="id6EF38A0051D345C683D8D79955405ECB"><enum>(1)</enum><header>Energy Policy Act of 2005</header><subparagraph id="id90ACE57C28E1416F87FAF3641DAB6D45"><enum>(A)</enum><header>In general</header><text>Section 241(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 674) is amended by striking <quote>after <quote>adequate protection and utilization of such reservation.</quote> at the end of the first proviso</quote> and inserting <quote>after <quote>adequate protection and utilization of such reservation</quote> at the end of the first proviso a period and</quote>.</text></subparagraph><subparagraph id="id7BBA7CCFCAA44095AC2282C3D2F77BA9"><enum>(B)</enum><header>Execution</header><text>Subparagraph (A) and the amendments made by that subparagraph shall take effect as if included in the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801 et seq.</external-xref>), and section 241(a) of that Act (Public Law 1058; 119 Stat. 674) and the amendments made by that section shall be executed as if the amendment made by subparagraph (A) had been included in that Act. </text></subparagraph></paragraph><paragraph id="id65ef5fb01e0a44d48b46d6bbe6a90983"><enum>(2)</enum><header>Federal Power Act</header><text>Section 4(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>) is amended by striking the period after <quote>Federal Energy Regulatory Commission</quote>. </text></paragraph></subsection><subsection id="idA34778F92EB642428230BA9F8CADE6FD"><enum>(b)</enum><header>Issuance of licenses</header><text>Section 4(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>) is amended—</text><paragraph id="id9999EB35D0DB4151989586208F04C7AC"><enum>(1)</enum><text>by striking the colon each place it appears and inserting a period;</text></paragraph><paragraph id="idB9701750F9A34CF8B2A6658B79E89A7A"><enum>(2)</enum><text>in the fourth proviso, by striking <quote><italic>And provided further</italic>, That upon</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id110EBD070E7049B0922FDD8F84B5E6E1"><paragraph id="id2EA09422E269419FBCB2674EFFCF02DA"><enum>(5)</enum><header>Notice; and</text></subclause><subclause id="id5C480DD054E74CF7B385B0ECF1E73D45"><enum>(III)</enum><text>and opportunities for all parties to a trial-type hearing to participate in settlement negotiations before and after the hearing.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id605C461FE69747A8AC204AB85C03BFBC"><enum>(B)</enum><text>in the third sentence—</text><clause id="id937bb477defc453eba7edc4b1c1c4be5"><enum>(i)</enum><text>by striking <quote>by the relevant resource</quote> and inserting <quote>by the relevant</quote>; and</text></clause><clause id="idC5FCDEE83B8542E7B8C198C71178B9F8"><enum>(ii)</enum><text>by striking <quote>The license applicant</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B0F72DFCE5D4ACD88394EFD61D73BD0"><subparagraph id="id81B74C9BCA0F4D3FAF487E84CE2568DC"><enum>(B)</enum><header>Hearing</header><clause id="id7D2EF646715B4ACE8F363B4DA7298DE5"><enum>(i)</enum><header>In general</header><text>The license applicant</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id1B708F77E02445E0BE883404859BD298"><enum>(D)</enum><text>in the first sentence, by striking <quote>shall deem necessary for the adequate protection and utilization of such reservation</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id7116994e85c3438781bfdfb06a45e587"><text>or the applicable Indian Tribe, as provided in section 37, shall deem—</text><clause id="idc26f4d182140485ba18abfc49fa447e6"><enum>(i)</enum><text>necessary for the adequate protection and utilization of such reservation; and</text></clause><clause id="id1f48db36249d4ebc985250a22da2b346"><enum>(ii)</enum><text>reasonably related to project effects on—</text><subclause id="idc50ba9fbc29f4c1dbddb7c7534655ae0"><enum>(I)</enum><text>the reservation; and</text></subclause><subclause id="id0d48115e74c44764af91aec22d155ecc"><enum>(II)</enum><text>the utilization of the reservation</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0bbfdf26418d4653b27234d8084bfbcf"><enum>(9)</enum><text>in paragraph (5) (as designated by paragraph (2)), by inserting <quote>addressing the effects of hydrologic alterations that may occur over the license term,</quote> after <quote>the protection of recreational opportunities,</quote>.</text></paragraph></subsection><subsection id="id8f1d7ebf73b0488d9d5dceafeaa75243"><enum>(c)</enum><header>Preliminary permits; notice of application</header><text>Section 4(f) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(f)</external-xref>) is amended, in the proviso, by inserting <quote>, Indian Tribe,</quote> after <quote>in writing to any State</quote>.</text></subsection></section><section id="id3f4610d1ad74499e8a14d3af2237f475"><enum>4.</enum><header>Approach to environmental review</header><subsection id="idb35d1ff9c3d243a1a0c7024517c2e960"><enum>(a)</enum><header>In general</header><text>Section 2403 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/797d">16 U.S.C. 797d</external-xref>) is amended—</text><paragraph id="id7347232ebb2d449b80d37f26de4f8aa8"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Third party contracting by FERC</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Approach to environmental review</header-in-text></quote>; </text></paragraph><paragraph id="id0dee17f2020a46a38909d0ad6ce44e6f"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id28F3C2FF60AD4C62A3730600D3A767CE"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Environmental impact statements</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Third-Party contracting by the Federal Energy Regulatory Commission</header-in-text></quote>; and</text></paragraph><paragraph id="ida2c7e52fd87c447199b1245cb9b158ff"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcacd924008604c4ea0dd9cadb16c1996"><subsection id="id928ac2b5b6164ab2a414975267593c26"><enum>(b)</enum><header>Cooperation with other agencies</header><paragraph id="id97C803973C124EBC9EE4CDA3EEDD22F0"><enum>(1)</enum><header>In general</header><text>The Federal Energy Regulatory Commission shall request that any Federal, State, or local agency or Indian Tribe with a responsibility under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or comparable State or Tribal law requirements with respect to the licensing of a project cooperate in the preparation of the environmental assessment or environmental impact statement that will be a record basis for the decisions of the applicable agency or Indian Tribe with respect to the applicable application. </text></paragraph><paragraph id="id173D40A90C8B4B74AB408871A153CBF8"><enum>(2)</enum><header>Effect</header><text>Cooperation under paragraph (1) shall not impair the right of a cooperating agency or Indian Tribe to participate as a party in a proceeding, subject to appropriate protections against ex parte communications.</text></paragraph></subsection><subsection id="ide8192f2def2c429eb11cb49ad4017766"><enum>(c)</enum><header>Environmental effects</header><paragraph id="idE40D2FD172AE488B99F5A22CA6E2FE80"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" id="id2a85372b433947a3a9af60f612539048"><enum>(A)</enum><header>Nonrecurring past effect</header><text>The term <term>nonrecurring past effect</term>, with respect to a project, means an environmental effect that—</text><clause commented="no" id="id30FC7213489F4E5FAEC44406F0C710CE"><enum>(i)</enum><text>may have been caused by—</text><subclause commented="no" id="id8A6CF92B78424ED1B5B53CA13BC3642F"><enum>(I)</enum><text>the original construction or development of the project; or</text></subclause><subclause commented="no" id="id0A73DD3420BB4E37AB1CA729445D01CA"><enum>(II)</enum><text>prior operations of the project; but</text></subclause></clause><clause commented="no" id="idB6DE5A210E164914ADC1C895F3D15F41"><enum>(ii)</enum><text>has no ongoing effect on environmental resources. </text></clause></subparagraph><subparagraph commented="no" id="id152f1f2ca5db4de5bd1779920ff40478"><enum>(B)</enum><header>Ongoing effect</header><text>The term <term>ongoing effect</term>, with respect to a project, means a material environmental effect that would not occur or that would be different, but for the continued existence, operation, or maintenance of the project.</text></subparagraph><subparagraph commented="no" id="id83B3F29FC2254E288ABE3161AE8EE7D0"><enum>(C)</enum><header>Project</header><text>The term <quote>project</quote> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></subparagraph><subparagraph commented="no" id="id8091738963d041f19e688e02cc2f541c"><enum>(D)</enum><header>Project effects</header><text>The term <term>project effects</term> means the ongoing effects and reasonably foreseeable effects of a project.</text></subparagraph><subparagraph commented="no" id="idcbac880fde894d3fb91f0e55447768ce"><enum>(E)</enum><header>Reasonably foreseeable effect</header><text>The term <term>reasonably foreseeable effect</term>, with respect to a project, means a material future environmental effect that—</text><clause id="id542b2fa74d304f5a95882809f5ff303b"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id06C7B4F1DF5848229466D20642614D5E"><enum>(I)</enum><text>in the case of new construction, would not occur or would be different, but for the construction, existence, operation, or maintenance of the project; or</text></subclause><subclause indent="up1" id="idE130963BBF4F493EB4D02A39BA63F5EF"><enum>(II)</enum><text>in the case of no new construction, would not occur or would be different, but for the existence, operation, or maintenance of the project; and</text></subclause></clause><clause commented="no" id="id40CEEE87D2B0456CBC2EF58E28B565B5"><enum>(ii)</enum><text>the Federal Energy Regulatory Commission, another agency, or an Indian Tribe determines, based on substantial evidence—</text><subclause commented="no" id="idACBC1C66A4CC45478CB1D913A00D4594"><enum>(I)</enum><text>is not speculative or improbable; and </text></subclause><subclause commented="no" id="id7BA6E8371C7440E3A23DC3460ED192B3"><enum>(II)</enum><text>is supported by monitoring, modeling, or other scientific analysis that is generally accepted in the scientific community. </text></subclause></clause></subparagraph></paragraph><paragraph id="id237567CBE9044083A274B7464525A47F"><enum>(2)</enum><header>Required considerations</header><text>In carrying out any authorities and responsibilities under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) with respect to resources affected by the project, the Federal Energy Regulatory Commission, other agencies, and Indian Tribes—</text><subparagraph id="id1058a879342e4753a9d7df6a0de3966f"><enum>(A)</enum><text>shall consider ongoing and reasonably foreseeable effects of any existing dam and other appurtenant project works included as part of an application under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>);</text></subparagraph><subparagraph id="id4582F76F67454FD9837E13420139D45B"><enum>(B)</enum><text>shall not consider nonrecurring past effects of the dam and other appurtenant works of the project;</text></subparagraph><subparagraph id="idAB36B0507D744E3BA6F6447E24311647"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id4E6F5210C91F482983F8D8123009A269"><enum>(i)</enum><text>shall consider whether the project has an adverse effect on any fish species; and </text></clause><clause indent="up1" id="id701D12B6E5444269912EF41F613C582A"><enum>(ii)</enum><text>if a determination is made in the affirmative under clause (i), shall consider passage and nonpassage strategies for reasonably mitigating the adverse effect, as appropriate, based on— </text><subclause id="id7E02BE56C2F142A59412E5D5F5574B78"><enum>(I)</enum><text>the extent and quality of habitat upstream and downstream of the project, including the feasibility of creating new habitat or improving existing habitat through habitat improvement projects; </text></subclause><subclause id="id13C0F0C60E944D6BB13E5E5ED7F728F9"><enum>(II)</enum><text>off-site mitigation as provided in section 39 of the Federal Power Act;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idde5085f30f7e497da73f776a9c9b1520"><enum>(III)</enum><text>risks to the health of the fish and the river system associated with both passage and nonpassage strategies;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2ea52a82be3f4ac1b1dadfc4ebcc2d8e"><enum>(IV)</enum><text display-inline="yes-display-inline">costs of construction, operation, and maintenance associated with both passage and nonpassage strategies; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id04b6a417a0994506baec9aa629c93d42"><enum>(V)</enum><text>such other biological, operational, and economic factors determined to be relevant by the Federal Energy Regulatory Commission, other agencies, and Indian Tribes; </text></subclause></clause></subparagraph><subparagraph id="id2774b86ead6742d484e4c60dd530a15d"><enum>(D)</enum><text>shall evaluate reasonably foreseeable project effects on hydrologic patterns, other aspects of environmental quality and developmental uses during the term of the license, based on fieldwork investigations, literature reviews, resource monitoring, technical models, or other appropriate methodologies, consistent with generally accepted scientific practices;</text></subparagraph><subparagraph id="idba46ccedb00c4bbaaf117f8b1395f37a"><enum>(E)</enum><text>shall—</text><clause id="id5AD4A38D85B14ACD8643CA82EE6B918C"><enum>(i)</enum><text>for purposes of deploying a model under this subsection, encourage the preferential use of open-sourced technical models, subject to the limitation that nothing in this clause prohibits the use of a proprietary model or proprietary data; and</text></clause><clause id="id73626C582BF749A595D2CC2A70E870D9"><enum>(ii)</enum><text>for purposes of using or otherwise relying on a model or data under this subsection—</text><subclause id="idF860EC5D06F843D0BAC2A2C0F2B4423C"><enum>(I)</enum><text>ensure the validity of the model or data through validation analysis entered into the record; and</text></subclause><subclause id="idF9F04374D51E4B46BDD881D5A0DFDFE0"><enum>(II)</enum><text>provide for the model, including data and other modeling inputs and outputs, to be reasonably available for evaluation, operation, reporting, and review by licensing participants, subject to appropriate protections relating to—</text><item id="id039F07CACEEF4554A4C423105C53283E"><enum>(aa)</enum><text> duplication or public disclosure of intellectual property associated with the model, such as software code or algorithms; and</text></item><item id="id74dee175b1b84b4d9140c4927eca3823"><enum>(bb)</enum><text>the public disclosure of proprietary or other data that would reveal trade secrets, other information that is competitively sensitive, or critical electric infrastructure information (as defined in section 215A(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o-1">16 U.S.C. 824o–1(a)</external-xref>));</text></item></subclause></clause></subparagraph><subparagraph id="id079a36a14ce846ca8e52642ecd104882"><enum>(F)</enum><text>shall consider reasonably foreseeable effects of hydrologic alterations over the license term in the region in which the project is located, including any change in project effects due to the hydrologic alterations and the potential of the project to contribute to the protection and enhancement of the beneficial public uses identified in paragraph (5) of section 4(e) and section 10(a)(1) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>, 803(a)(1));</text></subparagraph><subparagraph id="idf1a06e34d3d047a98a1bdca984c3223d"><enum>(G)</enum><text>shall ensure that any Federal requirements applicable in the project area under any applicable Federal treaty with an Indian Tribe, as determined by a court of competent jurisdiction, are met; </text></subparagraph><subparagraph id="id5e75d6e942644e4fa3ac58758df40f18"><enum>(H)</enum><text>shall consider innovative solutions and emerging technologies as a means of meeting responsibilities and authorities under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) in a cost-effective manner; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd540fcac484f424586d5b2be8cc3f983"><enum>(I)</enum><text>shall consider, based on an analysis prepared by the Federal Energy Regulatory Commission, impacts of the determination or decision of the Federal Energy Regulatory Commission, other agency, or Indian Tribe, as applicable, on—</text><clause id="id866d5659225143f4a6f707f76a2c6bd7"><enum>(i)</enum><text>grid reliability;</text></clause><clause id="id0d9e4dc9c7624a29b62d3d7b58650567"><enum>(ii)</enum><text>any increase in the price of energy, power, and essential grid services to consumers of power; and</text></clause><clause id="id6e8c9fc318a24337a62c1c18c9d20066"><enum>(iii)</enum><text>the ability to integrate intermittent generation resources.</text></clause></subparagraph></paragraph><paragraph id="idBC0C2ADFDC944E9CA85C3307EAAB8AB6"><enum>(3)</enum><header>Technical conferences</header><text>Not later than 180 days after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title> and periodically thereafter, as determined to be appropriate by the Federal Energy Regulatory Commission, the Federal Energy Regulatory Commission, in consultation with the Secretary, shall convene a technical conference to consider new technologies and methodologies that may be available and generally accepted in the scientific community or by agencies that manage water resources for power production, water supply, or flood control in the applicable region to quantify the considerations required under paragraph (2)(F) within an acceptable calculated range in licensing proceedings under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id6ae70822a0524d3a84948f40cfa53f0f"><enum>(d)</enum><header>Citations to record</header><text>In carrying out authorities and responsibilities under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), and sections 4(e), 10, 18, 33, and 37 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>, 803, 811, 823d), the Federal Energy Regulatory Commission and other agencies and Indian Tribes shall—</text><paragraph id="id079C8319CADE41B68D60AF7376211033"><enum>(1)</enum><text>cite to the specific parts of documents and other evidence that are the basis for the findings on issues of material fact for which the record contains inconsistent or conflicting information; and</after-quoted-block></quoted-block></paragraph><paragraph id="idcb06e3e098084707bd09ffca231b36b4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd5a6d989a05f426683032cbd68d0807e"><subsection id="id4b16e04952f44f2e9730420e66e5c9b6"><enum>(b)</enum><header>Procedures for surrender of license</header><paragraph id="id6ABDFEC954D94DFC9F4B1B1354F80499"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subsection, the Commission, after providing for public notice and comment, shall promulgate regulations establishing procedures for license surrender proceedings initiated by a licensee. </text></paragraph><paragraph id="id039A99BA50A24F8283A325AAF6B648BD"><enum>(2)</enum><header>Inclusions</header><text>The regulations promulgated under paragraph (1) shall include— </text><subparagraph id="id94CBFE264BEF40AAB19B16DDE7527721"><enum>(A)</enum><text>a requirement for a licensee seeking a license surrender to prepare an initial public report that describes and analyzes—</text><clause id="idB4068B1107714881AADC52521950776A"><enum>(i)</enum><text>the surrender proposal;</text></clause><clause id="id06CEF49A6DA64F859F024C391421B8D8"><enum>(ii)</enum><text>any alternatives considered for the disposition of project works; </text></clause><clause id="id27565b73eac149cbaf8f264422ccbe75"><enum>(iii)</enum><text>any impacts of the proposed license surrender on—</text><subclause id="id7053C02894C74894B3F8CEA6CCF80869"><enum>(I)</enum><text>grid reliability;</text></subclause><subclause id="idEA511A7E36644CA2A741CC7F0E063F9B"><enum>(II)</enum><text>any increase in the price of energy, power, and essential grid services to consumers of power; and </text></subclause><subclause id="id4A182EDA03D3479280D4931A9DE724E1"><enum>(III)</enum><text>the ability to integrate intermittent generating resources; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id60ee157f85fc4311bbf1cbe6e5b3c754"><enum>(iv)</enum><text>any benefits of the proposed license surrender to—</text><subclause commented="no" display-inline="no-display-inline" id="id4e9e9de91e064d57bc4e0712aebe3169"><enum>(I)</enum><text display-inline="yes-display-inline">surrounding communities; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id34f794bcee6a4688b709a3d622f3e815"><enum>(II)</enum><text display-inline="yes-display-inline">the natural environment; </text></subclause></clause></subparagraph><subparagraph id="id0E35BDD43700453BB921117F327979CA"><enum>(B)</enum><text>opportunities for the public—</text><clause id="idC447BC3475E046A49B6B664950C2D574"><enum>(i)</enum><text>to comment on—</text><subclause id="idF9818412F9CE4974BA538B7C321EDB42"><enum>(I)</enum><text>the initial public report; and </text></subclause><subclause id="idBEBDC892909B4294BC0AA9BA7165BFAB"><enum>(II)</enum><text>the surrender application;</text></subclause></clause><clause id="id7AECD346D7CB4D7A90307DEAD24E8794"><enum>(ii)</enum><text>to propose other alternatives for the disposition of project works for consideration by the Commission and licensee; and</text></clause><clause id="id5F0100FBF6614AF0B120BD64025D9924"><enum>(iii)</enum><text>to otherwise participate in the surrender proceeding; </text></clause></subparagraph><subparagraph id="idC7320BB1D0E44777BA1D68F9DC8BD27F"><enum>(C)</enum><text>requirements for the licensee to consult with applicable Federal and State resource agencies, Indian Tribes, and interested members of the public before filing the surrender application with the Commission;</text></subparagraph><subparagraph id="id15AE634AE8C64897868DF3ED2DA28A88"><enum>(D)</enum><text>procedures to develop a schedule for each surrender proceeding; and</text></subparagraph><subparagraph id="id3202EA2F08EC40F8B63E9687E3C2CA69"><enum>(E)</enum><text>procedures to expedite the surrender proceeding for a license that does not—</text><clause id="idB70E8A78996E4B37A72ABF694B9D8EFE"><enum>(i)</enum><text>present complex resource issues;</text></clause><clause id="id28DA674842D9430084C1545664495D7E"><enum>(ii)</enum><text>involve significant controversy or public opposition; or </text></clause><clause id="id015E9B9666BF4085BE751FE31589E166"><enum>(iii)</enum><text>require other major regulatory approvals.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd2da6ef33af9431da68fa761e4fa57f7"><enum>(b)</enum><header>Effect on Federal dams</header><paragraph id="idD9B0724B135A4331A901E4EF91E01E29"><enum>(1)</enum><header>In general</header><text>Nothing in this section (including an amendment made by this section) affects the continued operation of any federally owned dam, including the Federal dams on the Lower Snake River operated by the Corps of Engineers.</text></paragraph><paragraph id="idBE48322356CD4668A27F5DD5E562BDF3"><enum>(2)</enum><header>No precedent</header><text>No action carried out under section 6 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/799">16 U.S.C. 799</external-xref>) establishes a precedent for an action relating to a dam referred to in paragraph (1).</text></paragraph></subsection></section><section id="id07b90b1551fe4397bde1f04550f5814c"><enum>6.</enum><header>Conditions of license; report requirement</header><subsection id="id7e04986b37924bbe9b866aff90da773c"><enum>(a)</enum><header>Modification of plans; factors considered To secure adaptability of project; recommendations for proposed terms and conditions</header><text>Section 10(a)(2) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida23de6a153334333b20a18cd36c2d43e"><subparagraph id="id14020e929b744ca5abeb86483396415b"><enum>(D)</enum><text>Current and reasonably foreseeable future economic conditions material to the value of the project, over the term of the license, with respect to—</text><clause id="id6E606F9374EF4AC4B4AEBFA492B07AFA"><enum>(i)</enum><text>providing revenues from sales of power, generation capacity, and ancillary services; and</text></clause><clause id="id0967BE5AE100465C836084E4DDCE50EC"><enum>(ii)</enum><text>other uses of the project.</text></clause></subparagraph><subparagraph id="idf0c13d8f8a3a4debaf506cfeff24e881"><enum>(E)</enum><text>Methods to collect and, as appropriate, publicly report hydrologic data relating to the operations of the project during a time interval appropriate for effective management of any affected waterways.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id558a051d3bb54981af075b945677f86a"><enum>(b)</enum><header>Annual charges payable by licensees; maximum rates; application; review and report to congress</header><text>Section 10(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803(e)</external-xref>) is amended—</text><paragraph id="id9426c1d555c64735a758aac4f6f49e67"><enum>(1)</enum><text>in paragraph (1), in the first sentence, by inserting <quote>, in accordance with paragraph (5)</quote> after <quote>for purposes of administering their responsibilities under this part</quote>; and</text></paragraph><paragraph id="idf0bfca9dea3846d9b6ca63f3fd15ea17"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2e3a0143780445aeb0c13a4270777483"><paragraph id="id595e6d5c88a741579defb8876c665f0c"><enum>(5)</enum><text>In fixing reasonable annual charges under paragraph (1) for purposes of administering the responsibilities of the United States under this part, the Commission—</text><subparagraph id="id712474fb5452479e97c6c6f407fb3143"><enum>(A)</enum><text>notwithstanding section 9701 of title 31, United States Code, section 3401 of the Omnibus Budget Reconciliation Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/7178">42 U.S.C. 7178</external-xref>), or any other provision of Federal law relating to annual charges fixed under paragraph (1), shall ensure that all administrative costs of the United States, other than the administrative costs of the Commission, do not exceed the direct costs incurred by any department of the Federal Government or any agency, bureau, office, or other subdivision of the applicable department, in the participation of the applicable department in license proceedings under this part;</text></subparagraph><subparagraph id="id8a24f6966e3e4c4e9bd4cf93895b954c"><enum>(B)</enum><text>shall not include costs of any department of the Federal Government or any agency, bureau, office, or other subdivision of the applicable department that are reimbursed directly to the applicable department or subdivision of the applicable department by the licensee or license applicant;</text></subparagraph><subparagraph id="id1f6b87720ab74601928a77f6ad4b0ed5"><enum>(C)</enum><text>shall include costs of a third-party contractor retained by any department of the Federal Government or any agency, bureau, office, or other subdivision of the applicable department that are incurred in supporting the applicable department in administering the responsibilities of the applicable department under this part, if the costs— </text><clause id="idD0891BAB664548919217289B99BA2A55"><enum>(i)</enum><text>are not otherwise reimbursed directly to the department or subdivision of the department, as provided in subparagraph (B); and </text></clause><clause id="idA4CCC9919F014BEB8FC334B473928F41"><enum>(ii)</enum><text>meet the requirements of subparagraph (D);</text></clause></subparagraph><subparagraph id="id32b284eb77df40599587eb32d9e2326d"><enum>(D)</enum><text>shall provide a reasonable opportunity for public review and comment on the determinations of the Commission under subparagraphs (A) through (C) before issuing any bills for annual charges for purposes of the administration of this part under paragraph (1); and</text></subparagraph><subparagraph id="id2281f1baa3bc47519feb8f93d9b6c306"><enum>(E)</enum><text>shall—</text><clause id="id53B7EAEA3CA44BBFBAD50FA8C4472CED"><enum>(i)</enum><text>respond to all comments received under subparagraph (D) before issuing any bills for annual charges for the administrative costs of the United States under this part under paragraph (1); and </text></clause><clause id="idC046E16DAC124EBAA7B265B036643D70"><enum>(ii)</enum><text> make any adjustments to the billing determinations in response to the comments received under subparagraph (D), as appropriate.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id039170f37a0f4b0c858fedb92ecdfa60"><enum>(c)</enum><header>Fish and wildlife protection, mitigation, and enhancement; consideration of recommendations; findings</header><text>Section 10(j) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803(j)</external-xref>) is amended—</text><paragraph id="id2b6eb803a7be4a458a7f2ad98e2b9e19"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following: <quote>For any project that may affect fish and wildlife resources protected under a Federal treaty with an Indian Tribe, as determined by a court of competent jurisdiction, the conditions under this subsection shall be based on recommendations received from the applicable Indian Tribe.</quote>; and</text></paragraph><paragraph id="id2ffa9dbbad63437385948e2754aa7685"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id5493892F5BFF4F85878453B695F995A8"><enum>(A)</enum><text>in the first sentence, by inserting <quote>and Indian Tribes</quote> after <quote>and statutory responsibilities of such agencies</quote>; and</text></subparagraph><subparagraph id="idbfe290cd828744b281a918a18ec9a92f"><enum>(B)</enum><text>in the second sentence, in the matter preceding subparagraph (A), by inserting <quote>or Indian Tribe</quote> after <quote>a recommendation of any such agency</quote>.</text></subparagraph></paragraph></subsection><subsection id="id0cffd7186e434357b7f6b4454a5d7230"><enum>(d)</enum><header>Supporting statement and use of existing studies</header><text>Section 10 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2054f1a4eb2d45719560fc2c35a4386d"><subsection id="idbc36ad9e59de4ec4ae878918da4dd670"><enum>(k)</enum><header>Supporting statement for certain license conditions</header><paragraph id="idd722937c93c54607bbef4a256c5cae31"><enum>(1)</enum><header>In general</header><text>In any case in which the applicable Secretary exercises authority to submit a license condition to the Commission for inclusion in the license under section 4(e)(2), 18, 33, or 37 or through authority reserved in the license under 1 or more of those sections, the applicable Secretary shall include with the submitted condition or prescription a written statement—</text><subparagraph id="idc38f7d16e6764af2832f1830937d83c2"><enum>(A)</enum><text>demonstrating that the applicable Secretary considered alternatives to the submitted condition;</text></subparagraph><subparagraph id="id354f76df732c43849b121103faa31002"><enum>(B)</enum><text>providing a scientific and technical rationale for—</text><clause id="idAA7C1AEC75FB4C6995F3B38BF2DB5A65"><enum>(i)</enum><text>the condition submitted; and </text></clause><clause id="id8492B7A1907D47F6B50648E3223F2782"><enum>(ii)</enum><text>any alternatives considered but not adopted; and</text></clause></subparagraph><subparagraph id="ide649005828e244c5b8a157f6a62fbbaf"><enum>(C)</enum><text>identifying specific facts relied on in the record.</text></subparagraph></paragraph><paragraph id="idBC1B50BDC7F04AAFB25386E95F098D5C"><enum>(2)</enum><header>Studies, data, and other factual information</header><text>Along with the written statement included under paragraph (1), the applicable Secretary shall submit any studies, data, and other factual information relied on by the applicable Secretary that is relevant to the decision of the applicable Secretary.</text></paragraph></subsection><subsection id="idc55bbe2fa5794806b6cf1a6a1fcaed13"><enum>(l)</enum><header>Use of existing studies</header><paragraph id="id65f4276af9f6459791d0094ba7c5ad36"><enum>(1)</enum><header>In general</header><text>To the extent reasonably practicable, the Commission and other Federal and State agencies with responsibilities under this part shall—</text><subparagraph id="idde8eff66ceb549dabeb9e209f415d32b"><enum>(A)</enum><text>use relevant existing studies, monitoring information, and data; and</text></subparagraph><subparagraph id="id9d0184df61234b4f975a70776406ff0c"><enum>(B)</enum><text>avoid duplicating current, existing studies that are applicable to the relevant project.</text></subparagraph></paragraph><paragraph id="idfe3a17a6b83f45edbfeadafe69078010"><enum>(2)</enum><header>Written statement</header><text>In requiring any new study or collection of information, the Commission and other Federal and State agencies and Indian Tribes with responsibilities under this part shall prepare a written statement that—</text><subparagraph id="id90b665a2a1a247899dda9d06db4f7575"><enum>(A)</enum><text>explains why the new study or other information is necessary to support the decisionmaking relative to the responsibilities of the applicable agency under this part;</text></subparagraph><subparagraph id="idfdfa2fb5d82a4864ba25f0920e1dc875"><enum>(B)</enum><text>identifies how existing information reasonably available to the applicable agency, including any monitoring information collected by the licensee during the existing license term, is inadequate to support the decisionmaking of the applicable agency; and</text></subparagraph><subparagraph id="id8f0146266e4944f293de4806517d1996"><enum>(C)</enum><text>explains the manner in which the information produced by the required new study or other information supports the cost of producing the information.</text></subparagraph></paragraph><paragraph id="id7010e3f685b547cca21aef951194567d"><enum>(3)</enum><header>Requirement</header><text>In modifying or denying a request to require a new study or collection of information that is submitted to the Commission by another agency with responsibilities under this part, the Commission shall include in a written statement of the Commission an explanation of the manner in which the Commission considers the modification or denial to be consistent with—</text><subparagraph id="id0565E6E869184DC8B1085CA15EB40460"><enum>(A)</enum><text>the responsibilities of the requestor to compile a record under applicable law; and </text></subparagraph><subparagraph id="id4C4B412C48334461B818D8DAFFD701CE"><enum>(B)</enum><text>the obligation of the Commission and other agencies to undertake to develop a joint study plan pursuant to section 38(c)(2).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idcaf1d8c106e34566af76d554da931281"><enum>(e)</enum><header>Report</header><text>Section 10 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803</external-xref>) (as amended by subsection (d)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6A15C92F093A4D27B8B7C9B2BBD92806"><subsection id="id4F329F8E46BB4903A6C09B75C5A1E83E"><enum>(m)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this subsection, and every 5 years thereafter, the Commission shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report, prepared in consultation with each affected licensee or exemptee under this part, that— </text><paragraph id="id04FA59CED03F4C4F89CD7F74826C193B"><enum>(1)</enum><text>identifies any project or individual unit of development that—</text><subparagraph id="idFEA4D5F7E5A64B51BA1232E49CF03C83"><enum>(A)</enum><text>is licensed, or exempted from the license requirements, under this part; and </text></subparagraph><subparagraph id="id67FD4180228D48B4A4402350C88C008C"><enum>(B)</enum><text>has been continually out-of-service for not fewer than 5 years preceding the report; </text></subparagraph></paragraph><paragraph id="id01F0E4B045D644E493CE96D626FA35D2"><enum>(2)</enum><text>explains the reason why each project or development has been out-of-service;</text></paragraph><paragraph id="idE6F0A32C16EB495C8F6A1E66BC88F603"><enum>(3)</enum><text>identifies any plans of the licensee and the Commission for the rehabilitation or other disposition of the project or development; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38620412FAA4482FA248FCD35DEBFB5B"><enum>(4)</enum><text>describes the anticipated timelines and requirements of the Commission for the rehabilitation or other final disposition of the project or development.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id99bffacdaf304d1e86c59166fed16415"><enum>7.</enum><header>Disposition of charges arising from licenses</header><text display-inline="no-display-inline">Section 17 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/810">16 U.S.C. 810</external-xref>) is amended—</text><paragraph id="id008C973CD0854D66980677352A2A351F"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>(a) All proceeds</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14252165F80C423FBF1C472CF82F2367"><section id="idADC920EF028E4B91A18BDBFBD2F225F2"><enum>17.</enum><header>Disposition of charges arising from licenses</header><subsection id="id8ADDAE1ECBB34CAB8801E87E6016C71A"><enum>(a)</enum><header>Receipts from charges</header><text>All proceeds</text></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idfd8fd40193a54ee88760254c47370f57"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id56C2B46B9E7D4CD0A4719634B3ACE331"><enum>(A)</enum><text>in the second sentence—</text><clause id="id4D59187DCFAE4432BD47BEA8A42CF4D3"><enum>(i)</enum><text>by striking <quote>be paid into the Treasury of the United States and credited to <quote>Miscellaneous receipts</quote></quote> and inserting <quote>be deposited in the Licensing Administration Reimbursement Fund established by subsection (c)</quote>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id041cca4f8dde4366b9f0b2f00afbe1cc"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9656aa3b5238487dbbe675407786d28b"><subsection id="id6b7252bfc5584750a80d75eaa8ccceb3"><enum>(c)</enum><header>Licensing administration reimbursement fund</header><paragraph id="id63c43efeb6f442a69493e299663a7141"><enum>(1)</enum><header>In general</header><text>There is established within the Treasury of the United States a fund, to be known as the <quote>Licensing Administration Reimbursement Fund</quote> (referred to in this subsection as the <quote>Fund</quote>), to be administered by the Commission.</text></paragraph><paragraph id="id6714F8B2582D4110AE1505FE1231E44F"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Fund is to reimburse Indian Tribes, State fish and wildlife agencies, and other State natural and cultural resource agencies for any administrative costs of carrying out the responsibilities of Indian Tribes or the agencies under this part.</text></paragraph><paragraph id="id56fd912dfec341ff96d6cdb872293538"><enum>(3)</enum><header>Contents</header><text>The Fund shall consist of any amounts deposited in the Fund under subsection (a).</text></paragraph><paragraph id="idd9b6a46fa74b4d388e99ecec63fcc7da"><enum>(4)</enum><header>Requirement</header><text>Amounts in the Fund shall be available to Indian Tribes, State fish and wildlife agencies, and other State natural and cultural resource agencies that document the participation of the Indian Tribe or agency in license proceedings for purposes of carrying out the responsibilities of the Indian Tribe or agency under this part.</text></paragraph><paragraph id="id7872327b08424c25b65c07a5fcfaa478"><enum>(5)</enum><header>Limitation</header><text>Amounts in the Fund shall not be available for any costs that are otherwise reimbursable to an Indian Tribe, a State fish and wildlife agency, or a State natural and cultural resource agency.</text></paragraph><paragraph id="id4c05df1bebf34b4ab8ca29fbef586565"><enum>(6)</enum><header>Application; distribution</header><text>The Commission shall establish standards governing the application for, and distribution of, amounts from the Fund.</text></paragraph><paragraph id="idfbcbd5904b694ef28d67581eb59a8180"><enum>(7)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of enactment of this subsection, the Commission shall promulgate regulations, after providing public notice and an opportunity for comment, that establish the standards and process for the distribution and use of amounts from the Fund.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id85e7747f3661413388f0db21846712a6"><enum>8.</enum><header>Operation of navigation facilities; rules and regulations; penalties</header><text display-inline="no-display-inline">Section 18 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/811">16 U.S.C. 811</external-xref>) is amended—</text><paragraph id="id884781f146774ef992006b0710abbc71"><enum>(1)</enum><text> in the first sentence, by inserting <quote>to address project effects and other relevant factors</quote> before the period at the end;</text></paragraph><paragraph id="id092ac9af0d364ad2854e503744e6a841"><enum>(2)</enum><text> in the second sentence, by inserting <quote>, including alternative prescriptions submitted under section 33(b), as applicable,</quote> after <quote>on any disputed issues of material fact with respect to such fishways</quote>;</text></paragraph><paragraph id="id70f55c8983544256ac7e9925af88f938"><enum>(3)</enum><text>in the third sentence, by striking <quote>relevant resource</quote> and inserting <quote>resource</quote>; and</text></paragraph><paragraph id="id17586186e9b44676958eb0f6f004f62d"><enum>(4)</enum><text>by striking the fourth sentence and inserting the following: <quote>Not later than 180 days after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>, the Secretary of the Interior, the Secretary of the Army, the Secretary of Commerce, and the Secretary of Agriculture shall update jointly, by rule, after consultation with the Commission and providing notice and opportunity for public comment, the procedures for an expedited trial-type hearing under this section and section 4(e)(2), including the opportunity to undertake discovery and cross-examine witnesses, providing a forum for conditions submitted under section 33(b) to obtain a hearing, a requirement that the party raising a disputed issue, or the proponent of an alternative, bears the burden of proof by a preponderance of the evidence, and opportunities for all parties to a trial-type hearing to participate in settlement negotiations before and after the hearing.</quote>.</text></paragraph></section><section id="id2a24fa262d2b4b179fedc2e3f3c509c0"><enum>9.</enum><header>Conduit hydroelectric facilities</header><text display-inline="no-display-inline">Section 30(c) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823a">16 U.S.C. 823a(c)</external-xref>) is amended—</text><paragraph id="id948c14acb767415e99cdf2eeb617a134"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, affected Indian Tribes,</quote> after <quote>consult with the United States Fish and Wildlife Service</quote>;</text></paragraph><paragraph id="id464a4999717247369db4a25b79dff964"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="idFC1D9CA3941D474FA3DD8A952D90C51B"><enum>(A)</enum><text> by striking <quote>Fish and Wildlife Service National Marine Fisheries Service and the State agency</quote> and inserting <quote>United States Fish and Wildlife Service, National Marine Fisheries Service, and the State agency</quote>; and</text></subparagraph><subparagraph id="idD50F49986FF6488DB961172A0523037A"><enum>(B)</enum><text>by striking <quote>Act, and</quote> and inserting <quote>Act; and</quote>; and</text></subparagraph></paragraph><paragraph id="id815CE0576460405F89E0730BEE4B8EF8"><enum>(3)</enum><text>in paragraph (2), by striking <quote>insure</quote> and inserting <quote>ensure</quote>.</text></paragraph></section><section id="id9d4bf416c47847c7be64a7b5eeeee72b"><enum>10.</enum><header>Alternative conditions and prescriptions</header><subsection id="idb2718e55b91745bcb7d239718224669f"><enum>(a)</enum><header>Alternative conditions</header><text>Section 33(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823d">16 U.S.C. 823d(a)</external-xref>) is amended—</text><paragraph id="id093d307fa09d49d4846a252c6f6c5722"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idB4DF787B000D452DBC3509E92B399A41"><enum>(A)</enum><text>by inserting <quote>or an Indian Tribe, as provided in section 37,</quote> after <quote>(referred to in this subsection as the <quote>Secretary</quote>)</quote>; and</text></subparagraph><subparagraph id="id2ced24154a39437da0a5a71337996b4e"><enum>(B)</enum><text>by striking <quote>the first proviso of section 4(e)</quote> and inserting <quote>section 4(e)(2)</quote>;</text></subparagraph></paragraph><paragraph id="id29b65c76a8a9411ebf06a9b29d4f33d7"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id36AD64FE0E3E4677BF9E30C467043533"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>the first proviso of section 4(e)</quote> and inserting <quote>section 4(e)(2)</quote>;</text></subparagraph><subparagraph id="idfeda00b693894de68a8b55c3737714d0"><enum>(B)</enum><text>by striking <quote>the Secretary</quote> each place it appears and inserting <quote>the Secretary or Indian Tribe</quote>; or</text></subparagraph><subparagraph id="id172763fbe26147a88553700d56ba637d"><enum>(B)</enum><text>would—</text><clause id="id2581fa0b91b646699d855087e5372b61"><enum>(i)</enum><text>be no less protective of the reservation than the condition initially deemed to be necessary by the Secretary or applicable Indian Tribe; and</text></clause><clause id="idb60972a2eecb40dabad33133ab235f4f"><enum>(ii)</enum><text>as compared to the condition initially deemed to be necessary by the Secretary or applicable Indian Tribe—</text><subclause id="id61e99f7b36d44feaa4fd262f79a9a0c2"><enum>(I)</enum><text>cost significantly less to implement; or</text></subclause><subclause id="ide70e794e25d243c48fcb6a3990420b40"><enum>(II)</enum><text>result in improved operation of the project works for electricity production.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idee1f4952036c4b3caf0599a46152c7e1"><enum>(3)</enum><text>in paragraph (3), by striking <quote>the Secretary</quote> each place it appears and inserting <quote>the Secretary or Indian Tribe</quote>;</text></paragraph><paragraph id="id501F553FEB2C43FD98A8CDE773698A62"><enum>(4)</enum><text>by redesignating paragraph (5) as paragraph (6);</text></paragraph><paragraph id="idcd79e4d5e609418d8f84a69db5f7386a"><enum>(5)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida1d249a083d54e148e77a26349a33b1d"><paragraph id="id9e1cb6e886024c1686acf4703351ca70"><enum>(4)</enum><header>Public record</header><text>The Secretary or applicable Indian Tribe shall submit into the public record of the Commission proceeding with any condition under section 4(e)(2) or alternative condition accepted by the Secretary or applicable Indian Tribe under this subsection a detailed analysis establishing and explaining how the condition adopted by the Secretary or applicable Indian Tribe meets the criteria under paragraph (2), as compared to—</text><subparagraph id="id7d54ab79e9444cd79cce8936c5acf78e"><enum>(A)</enum><text>the condition initially determined to be necessary by the Secretary or applicable Indian Tribe; and</text></subparagraph><subparagraph id="idec422f8a2687449aaf07ad3e2b5bbaf1"><enum>(B)</enum><text>each alternative condition proposed by the license applicant or any other party to the license proceeding, as provided in paragraph (1), that is not adopted by the Secretary or applicable Indian Tribe.</text></subparagraph></paragraph><paragraph id="id1535788868024d3b8e4924f24b08d8e6"><enum>(5)</enum><header>Written statement</header><subparagraph id="id4d674eeaf1844c43a464d3e1be51a11b"><enum>(A)</enum><header>In general</header><text>Any submission by the Secretary under paragraph (4) shall include a written statement demonstrating that the Secretary gave equal consideration to the effects of the condition adopted and alternatives not adopted on—</text><clause id="id2873de32aa04475c9adad518ded99c28"><enum>(i)</enum><text>energy supply, distribution, cost, and use;</text></clause><clause id="id67df089987034a2b9201c9d1bde8d0db"><enum>(ii)</enum><text>flood control;</text></clause><clause id="id6bb40c0127264414a4428d94b0e5a616"><enum>(iii)</enum><text>navigation;</text></clause><clause id="id9bf1415d07404ee2b31128b80b631af1"><enum>(iv)</enum><text>water supply;</text></clause><clause id="idaa276fbd9e71418babb4f88e7aaea289"><enum>(v)</enum><text>hydrologic alterations that may occur over the license term;</text></clause><clause id="id2018b8552839444584630b92f8efa9f7"><enum>(vi)</enum><text>air quality; and</text></clause><clause id="ide1ebd22675fb4a00bc42043a0c034e40"><enum>(vii)</enum><text>the preservation of other aspects of environmental quality.</text></clause></subparagraph><subparagraph id="id89f514b606b24a1b90d7d831af29bc55"><enum>(B)</enum><header>Basis</header><text>The written statement included under subparagraph (A) shall be based on information available to the Secretary, including information voluntarily provided in a timely manner by the applicant and others.</text></subparagraph><subparagraph id="id9e739bf8b60c468094bd5e48a4c9d08a"><enum>(C)</enum><header>Studies; data</header><text>Along with the written statement included under subparagraph (A), the Secretary shall submit any studies, data, and other factual information available to the Secretary and relevant to the determination of the Secretary under paragraph (2).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id218a67ebfe9e40138281fc7277e27c4b"><enum>(6)</enum><text>in paragraph (6) (as so redesignated)—</text><subparagraph id="id13fed5e2285f42b5bba65c2b6a233705"><enum>(A)</enum><text>in the first sentence, by striking <quote>the Secretary’s final condition</quote> and inserting <quote>the final condition of the Secretary or applicable Indian Tribe</quote>;</text></subparagraph><subparagraph id="ida9f0e5a922264fb389ee8a5d381b2800"><enum>(B)</enum><text>in the second sentence, by striking <quote>the Secretary</quote> and inserting <quote>the Secretary or applicable Indian Tribe</quote>;</text></subparagraph><subparagraph id="id739cae7aa8e54337bb039be4b303987a"><enum>(C)</enum><text>in the third sentence, by striking <quote>Secretary</quote> each place it appears and inserting <quote>Secretary or applicable Tribe</quote>; and</text></subparagraph><subparagraph id="idb65f634cdc8a4251a1c56f3497794499"><enum>(D)</enum><text>in the fourth sentence—</text><clause id="idf7eefd5802f145e1a60f78249d518fc5"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>The Secretary or applicable Indian Tribe</quote>; and</text></clause><clause id="id8c7de606500c4645b18fa13fc393be84"><enum>(ii)</enum><text>by striking <quote>Secretary’s final written determination</quote> and inserting <quote>final written determination of the Secretary or applicable Indian Tribe</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="idb997d7987dbc4d608e10e125410a3362"><enum>(b)</enum><header>Alternative prescriptions</header><text>Section 33(b) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823d">16 U.S.C. 823d(b)</external-xref>) is amended—</text><paragraph id="id34b2ab022e2d4656b3eac908cd0a5221"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Secretary of Commerce</quote> and inserting <quote>Secretary of Commerce, as applicable (referred to in this subsection as the <quote>Secretary concerned</quote>),</quote>;</text></paragraph><paragraph id="id869cba5b24b54b39a70ef58abc3f622b"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id483bd016e36a411cb057d8ad60172901"><enum>(A)</enum><text>in the matter preceding subparagraph (A)—</text><clause id="id6F2E628ECF2B4B9484F1AD854FB35BD6"><enum>(i)</enum><text>by striking <quote>of the Interior or the Secretary of Commerce, as appropriate,</quote> and inserting <quote>concerned</quote>; </text></clause><clause id="idE7C6AC2B72354CD28D89115465F66064"><enum>(ii)</enum><text>by striking <quote>of the appropriate department</quote> and inserting <quote>concerned</quote>; and</text></clause><clause id="id93AAF8838BB04F6B959B68915293570E"><enum>(iii)</enum><text>by striking <quote>to the Secretary</quote> and inserting <quote>to the Secretary concerned</quote>; and</text></clause></subparagraph><subparagraph id="id963f4ed352504bf5a0f10c629babea52"><enum>(B)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2a487f4bc2604fa2a93f6bc344ebbd60"><subparagraph id="id35da3d523c194299913dc777ca5bf790"><enum>(A)</enum><text>would result in improved protection for fish at no additional cost to the project, including the value of foregone power or energy, as compared to the fishway initially prescribed by the Secretary concerned; or</text></subparagraph><subparagraph id="idaa8d7845ddc743bb8c2de1315ed2514a"><enum>(B)</enum><text>would—</text><clause id="id1688bef7d17b458dab303ca4349d3ab6"><enum>(i)</enum><text>be no less protective than the fishway initially prescribed by the Secretary concerned; and</text></clause><clause id="id77b9cf9c37e8494d9a9c3d7fbfc7366b"><enum>(ii)</enum><text>as compared to the fishway initially prescribed by the Secretary concerned—</text><subclause id="id68981885f56942fcb10cc8e8b0d66d90"><enum>(I)</enum><text>cost significantly less to implement; or</text></subclause><subclause id="idfc4736ac700440d28cc5a87be738152a"><enum>(II)</enum><text>result in improved operation of the project works for electricity production.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id6006CFEE17DA4BA2929C702C0DC01FAC"><enum>(3)</enum><text>in paragraph (3), by striking <quote>the Secretary</quote> each place it appears and inserting <quote>the Secretary concerned</quote>;</text></paragraph><paragraph id="id09532993cfbc4c5494c5b7fb535fcaa6"><enum>(4)</enum><text>by redesignating paragraph (5) as paragraph (6);</text></paragraph><paragraph id="idfc1a2db9cffa44e69392ce36b6bc1744"><enum>(5)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4dd1b33bfff1435ea7f643069218e802"><paragraph id="id1098ff8514a64b3690e271232a536314"><enum>(4)</enum><header>Public record</header><text>The Secretary concerned shall submit into the public record of the Commission proceeding with any prescription under section 18 or alternative prescription accepted by the Secretary concerned under this subsection a detailed analysis establishing and explaining how the prescription adopted by the Secretary concerned meets the criteria under paragraph (2), as compared to—</text><subparagraph id="id1c5482053f9e4267b8338afb70ac49c7"><enum>(A)</enum><text>the prescription initially prescribed by the Secretary concerned; and</text></subparagraph><subparagraph id="ided2f30ea467f4381add5d2bbfc880f78"><enum>(B)</enum><text>each alternative proposed by the license applicant or any other party to the license proceeding, as provided in paragraph (1), that is not adopted by the Secretary concerned.</text></subparagraph></paragraph><paragraph id="id91a2a1ac1e124eac8edacab013288632"><enum>(5)</enum><header>Written statement</header><subparagraph id="ide8f2499ae4f54079925211ff33e9b1ea"><enum>(A)</enum><header>In general</header><text>Any submission by the Secretary concerned under paragraph (4) shall include a written statement demonstrating that the Secretary concerned gave equal consideration to the effects of the prescription adopted and alternatives not adopted on—</text><clause id="idc938a136fef7490ab8df8453c2126737"><enum>(i)</enum><text>energy supply, distribution, cost, and use;</text></clause><clause id="id9ecf678a40ef4e7d91dc6a31145ad16a"><enum>(ii)</enum><text>flood control;</text></clause><clause id="id7e315e809323429e80be721097fcbc86"><enum>(iii)</enum><text>navigation;</text></clause><clause id="idc119bf1a159743a1900a99e49c0f56de"><enum>(iv)</enum><text>water supply;</text></clause><clause id="id9e5ec67648c64e3aaaa4a928d03c4095"><enum>(v)</enum><text>hydrologic alterations that may occur over the license term;</text></clause><clause id="id0f76339e8b8d4176b05e16ee5bae8517"><enum>(vi)</enum><text>air quality; and</text></clause><clause id="id22fb9e4002fd4b03861c7fcf63f48602"><enum>(vii)</enum><text>the preservation of other aspects of environmental quality.</text></clause></subparagraph><subparagraph id="ida1f85e59be2047ceaf4fd59d7e9d5ecf"><enum>(B)</enum><header>Basis</header><text>The written statement included under subparagraph (A) shall be based on information available to the Secretary concerned, including information voluntarily provided in a timely manner by the applicant and others.</text></subparagraph><subparagraph id="ida6ec745fc99f467fa3d5e67d79d95f7e"><enum>(C)</enum><header>Studies; data</header><text>Along with the written statement included under subparagraph (A), the Secretary concerned shall submit any studies, data, and other factual information available to the Secretary concerned and relevant to the determination of the Secretary concerned under paragraph (2).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idac078320dc314ae5bd0174b4674179d3"><enum>(6)</enum><text>in paragraph (6) (as so redesignated)—</text><subparagraph id="id091e9003de3a41eda9e18bf91d0184dd"><enum>(A)</enum><text>in the first sentence, by striking <quote>the Secretary’s final prescription</quote> and inserting <quote>the final prescription of the Secretary concerned</quote>;</text></subparagraph><subparagraph id="id257CFBFD03524839B1DF507C76B40C5E"><enum>(B)</enum><text>in the second sentence, by striking <quote>the Secretary</quote> and inserting <quote>the Secretary concerned</quote>;</text></subparagraph><subparagraph id="idF51CF7010A9F4BA499FEDD39F98DF55F"><enum>(C)</enum><text>in the third sentence, by striking <quote>Secretary</quote> each place it appears and inserting <quote>Secretary concerned</quote>; and</text></clause><clause id="idDD582788F6DD476F904E041C713B2E01"><enum>(ii)</enum><text>by striking <quote>Secretary’s final written determination</quote> and inserting <quote>final written determination of the Secretary concerned</quote>.</text></clause></subparagraph></paragraph></subsection></section><section id="idc0e0079d694245d2aabcabe2e82d35a3"><enum>11.</enum><header>Promoting hydropower development at existing nonpowered dams</header><text display-inline="no-display-inline">Section 34 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823e">16 U.S.C. 823e</external-xref>) is amended—</text><paragraph id="id35d5fcbd3cc84a248d39b7210582a692"><enum>(1)</enum><text>by striking subsection (c);</text></paragraph><paragraph id="idd8c349bd28444bb4bbb62d8293517767"><enum>(2)</enum><text>by redesignating subsections (a), (b), (d), (e), and (f) as subsections (b), (c), (g), (a), and (h), respectively, and moving the subsections so as to appear in alphabetical order;</text></paragraph><paragraph id="id9bc24ecd4fb04f4399d44d02a5626f13"><enum>(3)</enum><text>in subsection (a) (as so redesignated)—</text><subparagraph id="id6ced002e89bd49729fc5ab2c35adba6b"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id26805c245bf04807a2befc2868e0ecad"><enum>(i)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></clause><clause id="id5030e9dac47b4411b66d23d99f5e016b"><enum>(ii)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="id0dccc426451f4deaba7e279a4e4f640e"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida7e14532664948daba29ead36d258c60"><subparagraph id="id918e4c7bd22e4498b206e04baaddd02b"><enum>(F)</enum><text>the Commission determines, after considering the notification of intent submitted by the applicant under subsection (e)(1), any supporting information, and comments received under subsection (e)(2)(A), and any consultation under subsection (e)(2)(B), that an expeditious licensing decision under this section is reasonably practicable, taking into consideration, as appropriate—</text><clause id="idf6edfad2fc404ba6b2bbc0f617f93cf3"><enum>(i)</enum><text>whether any applicable environmental or dam safety considerations demonstrate that the qualifying nonpowered dam associated with the qualifying facility is likely to be removed during the term of a license;</text></clause><clause id="id1819a1ac8dd443888a17e01e151393f3"><enum>(ii)</enum><text>whether existing information establishes that the qualifying nonpowered dam associated with the qualifying facility will no longer serve an existing public purpose during the term of a license;</text></clause><clause id="ide2508fd47b484d02af0b3e1f1056dcfc"><enum>(iii)</enum><text>whether any adverse resource effect associated with the qualifying nonpowered dam, including lack of fish passage, is—</text><subclause id="idc8464a48e13c4019b2f0f5444979f550"><enum>(I)</enum><text>presently unmitigated; and</text></subclause><subclause id="id08436bfec7cf44c583c716d800e4db3a"><enum>(II)</enum><text>likely to remain unmitigated under future operation;</text></subclause></clause><clause id="idbca5db08c1434e979d63ac0b01c12df5"><enum>(iv)</enum><text>whether the licensing of the facility by the Commission has the potential to mitigate or enhance environmental conditions associated with the qualifying nonpowered dam associated with the qualifying facility, including any preliminary protection, mitigation, and enhancement measures identified by the applicant;</text></clause><clause id="ide4fa842f4c3c469dbf93f003c517b3d8"><enum>(v)</enum><text>whether the resource issues likely to be involved in the licensing process are unusual or complex; and</text></clause><clause id="id9cbbe8d561f4418cb01626d8ffd28be1"><enum>(vi)</enum><text>whether information submitted with, or referenced in, the notification of intent is adequate to support the development of the license application.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idae7e81c2f46d47ddb9f01c6775c9b61b"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddca41878762e4e4ebef5005d4d7bbbe2"><paragraph id="id873b4541b6b64b8db401e037d4dcc3c6"><enum>(2)</enum><header>Qualifying facility</header><subparagraph id="idf8a4b1bbecf0427c962c9476c2c827d9"><enum>(A)</enum><header>In general</header><text>The term <term>qualifying facility</term> means a facility that—</text><clause id="idc5a5f755655c48a4a14121e67bc19202"><enum>(i)</enum><text>includes only—</text><subclause id="id2f6f3239c3524701866ec712f8b8df49"><enum>(I)</enum><text>the power house, power tunnel, penstocks, and tailrace;</text></subclause><subclause id="idb320f01a611348b7ab148247026c1274"><enum>(II)</enum><text>any other water conveyance infrastructure connected directly to the powerhouse;</text></subclause><subclause id="id4db7a24d59dc4d688af3af8b55748a16"><enum>(III)</enum><text>each primary line transmitting power from the facility to the point of junction with the distribution system or the interconnected primary transmission system; and</text></subclause><subclause id="idfe9e1da7c6ee4cad8a76b28345d840ea"><enum>(IV)</enum><text>any other new, miscellaneous structures used and useful in connection with the facility; and</text></subclause></clause><clause id="id689bbcb5b4d6466491aba85fca1ec0a1"><enum>(ii)</enum><text>is determined under this section to meet the qualifying criteria.</text></clause></subparagraph><subparagraph id="ida4367b49784340dea1ec13022c813c83"><enum>(B)</enum><header>Exclusions</header><text>Notwithstanding subparagraph (A)(i)(IV) and section 3(11), the term <term>qualifying facility</term> does not include, with respect to the complete unit of improvement or development of a facility described in subparagraph (A)—</text><clause id="id45697ed24cfb4a05ad4bc2fdf037914c"><enum>(i)</enum><text>a dam or appurtenant work or structure (including a navigation structure);</text></clause><clause id="idc023f5be7d4b48cf8caef63fc4105ddd"><enum>(ii)</enum><text>a dike;</text></clause><clause id="id6b0a572d6481435d9e0fc95cf3cd57fd"><enum>(iii)</enum><text>any other water retention or diversion infrastructure;</text></clause><clause id="idd5d8d07289e84316864fc5a50eeb61b0"><enum>(iv)</enum><text>an impoundment;</text></clause><clause id="id7d27558af263489abe05ac9a6ab1dc9d"><enum>(v)</enum><text>a shoreline;</text></clause><clause id="id8f039cacde384eae9fce1526c60e91e4"><enum>(vi)</enum><text>an access road; or</text></clause><clause id="ide0cc2658726d4dbb90ae447ed5b300bf"><enum>(vii)</enum><text>any recreational or other infrastructure associated with an existing nonpowered dam or impoundment.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idd8990ed5cf464dcebe182ce16e1d83ca"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="id3f39f7bc335c4f40a7088344b6a364fc"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>Federal or non-Federal</quote> after <quote>means any</quote>; and</text></clause><clause id="id2a8938011df24985b0be8fac05c7b4ea"><enum>(ii)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc9c468652fa44bbca33e4c2449b6edd3"><subparagraph id="id0e091cb139b741758490652d7e34d12f"><enum>(C)</enum><text>that—</text><clause id="idd38838078bd94340bbbcd12a19996800"><enum>(i)</enum><text>for a non-Federal dam—</text><subclause id="id6feb96e469444400aefe5733e7e5fed0"><enum>(I)</enum><text>as of October 23, 2018, is not generating electricity using any hydropower-generating facility that is—</text><item id="idcd302687270e42a99cba3fba672df5ae"><enum>(aa)</enum><text>licensed under this part; or</text></item><item id="id3a054d19547e4c548c27ef06a3ff559c"><enum>(bb)</enum><text>exempted from the license requirements contained in this part; and</text></item></subclause><subclause id="idc58f6d96a8a9446eaf043bf5c77d4efe"><enum>(II)</enum><text>is regulated by an established dam safety program of the State in which the non-Federal dam is located; or</text></subclause></clause><clause id="id42e5131bb7644c3eb078555a9eb030d8"><enum>(ii)</enum><text>for a Federal dam—</text><subclause id="id81539a64ef1e4ed3a869161589df5ed2"><enum>(I)</enum><text>is available for non-Federal power development; and</text></subclause><subclause id="iddf4a8ba7a95b4b31950a80d15b1a0ac6"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id34f2c676d74d4642834ddd9fc5b7475a"><enum>(aa)</enum><text>is not equipped with power generating equipment; or</text></item><item id="idecb306e54c1745349b3f9ba5f6fa1221" indent="up1"><enum>(bb)</enum><text>has available incremental generation potential for non-Federal power development.</text></item></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idcf1bec3cd03b404885061a69fb4818df"><enum>(4)</enum><text>in subsection (b) (as so redesignated)—</text><subparagraph id="idd7ab728397e44b32a265ff7c1f64ca80"><enum>(A)</enum><text>in the subsection heading, by inserting <quote>Certain</quote> after <quote>Process for</quote>;</text></subparagraph><subparagraph id="id5b95530452e94f2ab9c9e517459c8079"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="id4a698e5267c043c89efc226930e35e77"><enum>(i)</enum><text>by striking <quote>As provided in this section, the Commission may issue and amend</quote> and inserting <quote>The Commission may issue</quote>; and</text></clause><clause id="id85a6e94c4d9e41b99c8b8f82bdd8ae93"><enum>(ii)</enum><text>by inserting <quote>in accordance with this section</quote> before the period at the end;</text></clause></subparagraph><subparagraph id="id113131f302c544418a868239939016cc"><enum>(C)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id474d5f6f26904022a86cf1368a092558"><paragraph id="id9ec3f4f21ca7460093685a0590574009"><enum>(2)</enum><header>Updating regulations</header><text>Not later than 180 days after the date of enactment of the <short-title>Community and Hydropower Improvement Act</short-title>, after consulting with the interagency task force under paragraph (3) and providing notice and an opportunity for public comment, the Commission shall update regulations of the Commission for issuing licenses for qualifying facilities under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0deaf8c21ded43c8ac26e301f5bf89ea"><enum>(D)</enum><text>in paragraph (3)—</text><clause id="id595a35252cfd4ef8814f7f933c1ed02e"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id42a697da2870484b87de9fb97cf64ac9"><enum>(I)</enum><text>by striking <quote>(A) In establishing the expedited process</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7cb847e7db1246fda155582a2811feac"><subparagraph id="id31effbac56384434abba73398a9797d8"><enum>(A)</enum><header>In general</header><text>In updating regulations</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="ida165539134a04b6eb29cad6e0da4e54f"><enum>(II)</enum><text>by striking <quote>and Indian tribes</quote> and inserting <quote>, Indian Tribes, and the public</quote>; and</text></subclause></clause><clause id="idbbd3187ea5c24b5b988c5c8fbd8c011e"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25e26db42bf441da81f3cddf1e88f4f6"><subparagraph id="id31dc3281e9514b53b4e20497264d0c7c"><enum>(B)</enum><header>Workshops and meetings</header><text>Before issuing any proposed rule for public comment pursuant to paragraph (2), the Commission shall convene workshops and other meetings with the interagency task force under this paragraph to develop procedures that allow the Commission and appropriate Federal and State agencies and Indian Tribes to exercise authority in accordance with subsection (d).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ideebc55a27d034f96bf5bc34c3d55440a"><enum>(E)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id335237471f0e48e3b613d3e2306f1725"><paragraph id="id6904f91d8d3a4cf0a4b4974a107bc6e6"><enum>(4)</enum><header>Deadline</header><text>The Commission shall issue a final decision regarding an application for a license for a qualifying facility submitted under subsection (e)(3) not later than 2 years after the date on which the Commission determines under subsection (e)(2) that the proposed hydroelectric facility that is the subject of the application is a qualifying facility.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3ecc195cd20541ee8fe096b12cfc4267"><enum>(5)</enum><text>in subsection (c) (as so redesignated)—</text><subparagraph id="id4ebee628887642dc8697af2aa27e481f"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="idee01971af28f4e7a9f296b8edfcbab90"><enum>(B)</enum><text>by redesignating paragraph (1) as paragraph (2);</text></subparagraph><subparagraph id="id6f57c40e65b146a8ab8d722a360e0b08"><enum>(C)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25fc507ca9864308b4fcdf36a139b08f"><paragraph id="id8a55f230ab624821b4fb50334e17950f"><enum>(1)</enum><header>Applicability of safety regulations</header><subparagraph id="id8bae5af200aa46dc85573db647d3d9ab"><enum>(A)</enum><header>In general</header><text>The rules and regulations of the Commission relating to the protection of life, health, and property shall apply to a qualifying facility licensed under this section, only with respect to the potential effects of the construction, operation, and maintenance of the qualifying facility on the safety of the applicable qualifying nonpowered dam.</text></subparagraph><subparagraph id="id3acef1df4c4e46ed89155e950724c781"><enum>(B)</enum><header>State regulations</header><text>For any qualifying facility licensed at a non-Federal qualifying nonpowered dam, the applicable dam safety rules and regulations of the State in which the qualifying nonpowered dam is located shall apply to—</text><clause id="id5b53e88990404be0bc4c682e579dbf81"><enum>(i)</enum><text>the qualifying nonpowered dam; and</text></clause><clause id="ide3a4c8a654894831b2f84c615d08c130"><enum>(ii)</enum><text>any infrastructure associated with the qualifying nonpowered dam that is not a part of the qualifying facility that is the subject of the license.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id2b72bacd2f62455d9d345485fd8ccd54"><enum>(D)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id50d18a7ee3bf4bb3b6438683cec9c328"><paragraph id="id88a74a9fee4a413c9de809845b519eb2"><enum>(3)</enum><header>Requirements</header><text>Before issuing any license for a qualifying facility at a non-Federal qualifying nonpowered dam, the Commission shall—</text><subparagraph id="id733ea78cb91640a596aad8e45dfb7f8e"><enum>(A)</enum><text>ensure that the qualifying nonpowered dam, and each other structure associated with the qualifying facility, is or will be consistent with the applicable dam safety standards of the Commission; and</text></subparagraph><subparagraph id="idf4557803cf57413ba40a28945e1d66c2"><enum>(B)</enum><text>consult with the applicable dam regulator in the State in which the qualifying facility is located to ensure appropriate continued oversight of the qualifying nonpowered dam associated with the qualifying facility, and associated structures, over the term of the license.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idfb284e4f2a30448aaa3d57b34d7d29f9"><enum>(6)</enum><text>by inserting after subsection (c) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id55513a7eb0b84ef4b3195237de81feed"><subsection id="id15fe5501fc71406cafb2e442aa0e0550"><enum>(d)</enum><header>Storage, release, and flow operations</header><paragraph id="id4b2d7e17012f473e8ccaf840c5c4b40b"><enum>(1)</enum><header>Limitations</header><subparagraph id="idef70c6c71569480ca50309e0abe3ea9a"><enum>(A)</enum><header>Obligations</header><text>Notwithstanding any other legal requirement pertaining to a qualifying facility licensed under this section, the Commission, Federal and State agencies, and Indian Tribes shall not impose any obligation in the licensing of the qualifying facility that would interfere with, or materially change or affect in any way, the storage, release, or flow operations of the qualifying nonpowered dam associated with the qualifying facility, other than the routing of release or flow operations through the qualifying facility.</text></subparagraph><subparagraph id="idc7e9da7dff9a4746bd95ec677df2c32d"><enum>(B)</enum><header>Interference</header><text>Notwithstanding any other legal requirement pertaining to a qualifying facility licensed under this section, the licensing of a qualifying facility under this section by the Commission shall not interfere with, or materially change or affect in any way, any other Federal, State, or Tribal authority pertaining to the storage, release, or flow operations applicable to the qualifying nonpowered dam associated with the qualifying facility, other than the routing of release or flow operations through the qualifying facility.</text></subparagraph></paragraph><paragraph id="ida4b2ad6d21ac444d87d7ba2620dbca3a"><enum>(2)</enum><header>Condition in license</header><text>The Commission shall include in any license issued pursuant to this section a condition prohibiting the licensee from materially changing the storage, release, or flow operations of a qualifying nonpowered dam associated with the qualifying facility for the sole purpose of improving the power value of the qualifying facility.</text></paragraph></subsection><subsection id="ida0f8176454834f1dad563ad4b100afde"><enum>(e)</enum><header>Expedited process</header><paragraph id="id204d3098a5194863aadd0d95cff4c96e"><enum>(1)</enum><header>Notification of intent and supporting information</header><text>The applicant for a qualifying facility shall commence the licensing process under this section by submitting to the Commission a notification of intent to file an application for a license, together with supporting information, which shall inform the determination of the Commission under paragraph (2).</text></paragraph><paragraph id="idf0c99df26cab4034a6efad9824df8d3d"><enum>(2)</enum><header>Commission determination</header><subparagraph id="id10d13b013b4741bf8517abe4c5240835"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date on which an applicant submits to the Commission a notification of intent under paragraph (1), the Commission, after providing notice and an opportunity for public comment, shall—</text><clause id="id8d14e73bafb842ff82250d56c95d2311"><enum>(i)</enum><text>determine whether the proposed hydroelectric facility is a qualifying facility under this section; and</text></clause><clause id="id9bdb8cbf186f4cb49ae7093e49b1be57"><enum>(ii)</enum><text>include in a determination under clause (i) information, including analyses supported by information in the public record, relating to the factual basis for the determination.</text></clause></subparagraph><subparagraph id="id3f667817916342d98507bc0c099ed93a"><enum>(B)</enum><header>Consultation</header><text>In making a determination under subparagraph (A) with respect to a proposed facility, the Commission shall consult with Federal and State agencies and Indian Tribes with authority over the facility regarding any qualifying criteria that may disqualify the facility from the expedited process under this section.</text></subparagraph><subparagraph id="ida964c652d06a45f3b29464e73d87c1c3"><enum>(C)</enum><header>Resolution</header><text>If the Commission determines under subparagraph (B) that any qualifying criteria potentially disqualify a proposed facility from the expedited process under this section, the Commission shall—</text><clause id="idfbd951b4b3454bd89c5a6f94c5f5f29b"><enum>(i)</enum><text>seek to resolve any issues in advance of issuing a determination regarding whether the proposed facility is a qualifying facility under this paragraph; and</text></clause><clause id="id690a79b7c6024a61adb3d04d1fd1fe91"><enum>(ii)</enum><text>include in a determination under clause (i) information relevant to efforts to resolve the issues.</text></clause></subparagraph></paragraph><paragraph id="id3ba42b10dcf94fb282de8f18cfbe4bd4"><enum>(3)</enum><header>Qualifying facility applications</header><subparagraph id="idc1d4387061584c62b4d275b6d35063b1"><enum>(A)</enum><header>In general</header><text>After submitting a notification of intent under paragraph (1), an applicant for a qualifying facility shall submit to the Commission an application for a license under this section.</text></subparagraph><subparagraph id="id51700964c8364912acf9975ca33d4a9f"><enum>(B)</enum><header>Inclusions</header><text>An application under subparagraph (A) shall include a description of each protection, mitigation, and enhancement measure proposed to be carried out in order for the applicable qualifying facility to receive a license from the Commission, in accordance with subsection (f).</text></subparagraph><subparagraph id="ide65fb3416f7d4f0b994d92ceb45a371d"><enum>(C)</enum><header>Deadline for submission</header><text>An application under this paragraph shall be submitted to the Commission not later than the later of—</text><clause id="id45f85707ee2f4f019ae9a6cf15cd10fb"><enum>(i)</enum><text>the date that is 30 days after the close of a single season of studies conducted in support of the application; and</text></clause><clause id="id02e96ef5d1b54f6e8cc921708ecaf7bd"><enum>(ii)</enum><text>the date that is 1 year after the date on which a determination of the Commission is provided under paragraph (2).</text></clause></subparagraph></paragraph></subsection><subsection id="id1cc9ef59dd9b481183e94c08d3b015c3"><enum>(f)</enum><header>Requirements</header><text>In determining whether to approve an application for a license for a qualifying facility under subsection (e)(3), in accordance with the deadline described in subsection (b)(4), the Commission, in consultation with applicable Federal and State resource agencies and Indian Tribes with regulatory responsibility for the qualifying facility, shall—</text><paragraph id="id12edb041cffb4086971422b4fe70e0b1"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc8d8cd0421f242f3b57f76d75f854711"><enum>(A)</enum><text>use relevant existing studies, monitoring information, and data that are applicable to the relevant qualifying facility, in accordance with section 10(l);</text></subparagraph><subparagraph id="id2cd2a196d6be4e87b9ac49b790289c60" indent="up1"><enum>(B)</enum><text>avoid duplicating current, existing studies; and</text></subparagraph><subparagraph id="id527e67a7e7ca43adbc4347408a285a85" indent="up1"><enum>(C)</enum><text>design any new studies and information requirements to be consistent with the ability of the Commission to meet the licensing deadline under subsection (b)(4);</text></subparagraph></paragraph><paragraph id="id9c66c03ff3074892901ca24765a2c1fa"><enum>(2)</enum><text>consider whether obligations under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) may be met through—</text><subparagraph id="id6f0d95f64b45441ca52ae58dfe2c942f"><enum>(A)</enum><text>preparing an environmental assessment; or</text></subparagraph><subparagraph id="ide4978b02193e49ff823495b3054d2254"><enum>(B)</enum><text>supplementing a previously prepared environmental assessment or environmental impact statement;</text></subparagraph></paragraph><paragraph id="id4c5d6619de9849f4aa9ee661a6d55ceb"><enum>(3)</enum><text>develop a licensing process that reduces administrative burdens on resource agencies, Indian Tribes, the applicant, and the public by avoiding unnecessary paperwork, meetings, and other process obligations, subject to the condition that nothing in this paragraph eliminates any applicable consultation requirement under Federal or State law (including regulations);</text></paragraph><paragraph id="ide1cbc55ebba6468d87dc3bd2dd2b2213"><enum>(4)</enum><text>exercise authorities commensurate with the limited unit of development and improvement for a qualifying facility described in subsection (a)(2)(A)(i), recognizing—</text><subparagraph id="id18c0871aee0b4666a85899e19740b40a"><enum>(A)</enum><text>the existence of infrastructure at the time of the license application; and</text></subparagraph><subparagraph id="ide41ff3644edd44a5865ba59b6224443f"><enum>(B)</enum><text>that ongoing operations of existing infrastructure, including water releases, will be materially unchanged as a result of the development and operation of the qualifying facility, in accordance with subsection (d); and</text></subparagraph></paragraph><paragraph id="id0e975fa4628f4fc7ba096e7e6a7d5194"><enum>(5)</enum><text>consider a set of standard license terms and conditions that generally would apply to all qualifying facilities licensed under this section, based on common technical considerations and environmental effects, subject to the condition that the development of standard license terms and conditions shall not limit the imposition of facility-specific conditions for any particular qualifying facility.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6d04618cb94e477fa71da83778fa7734"><enum>(7)</enum><text>in subsection (h) (as so redesignated)—</text><subparagraph id="id8ec3c8e4775143d9913c498310874a94"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id1118fa9249c343f89ac4f94f05de8075"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id98ed71efa14e4e16bdf89cff8bf99177"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4e09ef54572243a58646f9e84161b3c2"><paragraph id="idebd3de42c002480aa5f32326a617c328"><enum>(3)</enum><text>any applicable State or Tribal law relating to a qualifying nonpowered dam, dike, conduit, impoundment, or shoreline, or any land or infrastructure associated with such qualifying nonpowered dam, that is not a component of a license issued pursuant to this section, including such a law relating to dam safety, property ownership and control, public access and safety, or the appropriation, use, or distribution of water at the qualifying nonpowered dam.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="ideca8f1cfe0f748069a0a01c89c30415b"><enum>12.</enum><header>Closed-loop and off-stream pumped storage projects</header><text display-inline="no-display-inline">Section 35 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823f">16 U.S.C. 823f</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id733DCAE413DA47C28794DDC387D9574A"><section id="id47AD6BB2CC93499CAB956D25C671213A"><enum>35.</enum><header>Closed-loop and off-stream pumped storage projects</header><subsection id="id115BC0B52F084F279D47C78B16681F31"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idde8b76721c3f4530940dba1066a80aca"><enum>(1)</enum><header>Closed-loop or off-stream pumped storage project</header><text>The term <term>closed-loop or off-stream pumped storage project</term> means a project—</text><subparagraph id="id0F14C5972ED24FAB86637D9ACA7825F0"><enum>(A)</enum><text>that—</text><clause id="idF3B3EA3CE7F046DF9FAA2F1E779DAE8B"><enum>(i)</enum><text>is configured to use 2 or more natural or artificial reservoirs or other water bodies at different elevations; and</text></clause><clause id="id2971EDFF09A44610B881C16714D6A0D8"><enum>(ii)</enum><text>can—</text><subclause id="idF9A30C049C6E4B268EE8EF9B111DFE05"><enum>(I)</enum><text>generate power as water moves down through a turbine; and</text></subclause><subclause id="id43B351428E7D4CAFAEB69EB458D48E28"><enum>(II)</enum><text>recharge by pumping water to the upper reservoir; </text></subclause></clause></subparagraph><subparagraph id="id30082760e20f44d9a78ab90e3d7b9307"><enum>(B)</enum><text>that is designed for construction and operation in a manner that ensures that the upper and lower reservoirs or other water bodies do not impound any stream channel of a natural surface waterway, unless—</text><clause id="id31c2e823c3734795a55721e2da44d575"><enum>(i)</enum><text>1 or more project reservoirs are located on, or connected to, a stream channel of a natural waterway that has flowing water only during, and for a short duration after, precipitation events during a typical year; or</text></clause><clause id="id3a88ff94145949349cf629953ac83b2a"><enum>(ii)</enum><text>not more than 1 project reservoir is located on, or directly connected to, a natural surface watercourse, subject to the conditions that the reservoir—</text><subclause id="id1f9a8dd58f0b4adc8be6c37341638871"><enum>(I)</enum><text>is in existence on the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>;</text></subclause><subclause id="id5aa5b96998e34c5093664ca1acecf54a"><enum>(II)</enum><text>receives the vast majority of water from—</text><item id="id7AB7E4EA075E4BE2A6DBD6A984FB1006"><enum>(aa)</enum><text>surfacewater of a different natural watershed via an existing pipeline, aqueduct, or other conveyance infrastructure; or</text></item><item id="id3BEAEA67022240D7B41AC1585A2DAA19"><enum>(bb)</enum><text>groundwater; and</text></item></subclause><subclause id="id83a192fb4f224242860755519862eddc"><enum>(III)</enum><text>obtains not more than 10 percent of the volume of the average annual inflow of surfacewater from the natural watershed in which the reservoir is located; and</text></subclause></clause></subparagraph><subparagraph id="idEC10B4FA90764C4F8F1C1C55AAB3DD7C"><enum>(C)</enum><text>any project reservoir (except for a reservoir described in subparagraph (B)(ii)) of which, if the reservoir is connected to a natural surface waterway, is connected for the sole purpose of the initial fill and periodic recharge of reservoirs needed for project operation.</text></subparagraph></paragraph><paragraph id="ida5cf148f07514ae4955b256fa252e5d3"><enum>(2)</enum><header>Qualifying criteria</header><text>The term <term>qualifying criteria</term>, with respect to a closed-loop or off-stream pumped storage project, means that the closed-loop or off-stream pumped storage project—</text><subparagraph id="idfd8ac3debe7b4fb3b5f1da6ec9198a9e"><enum>(A)</enum><text>is unlikely to involve any fish or wildlife species listed as a threatened or endangered species, or any habitat designated as a critical habitat of such a species, under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), unless the applicable notification of intent identifies proposed measures to protect or mitigate damages to the applicable species or habitat;</text></subparagraph><subparagraph id="id07f8579ec6884f6ea1673a65a99beb95"><enum>(B)</enum><text>is unlikely to involve resource issues that are unusual or complex in the licensing process and associated environmental review;</text></subparagraph><subparagraph id="idb4dd9ee89cf04dedae4041924b35fe90"><enum>(C)</enum><text>is supported by sufficient information and proposed environmental study plans submitted with the notification of intent to support expedited environmental review and consideration of the application;</text></subparagraph><subparagraph id="id3a360fbb36674a6fb0c4c8f43e52fdda"><enum>(D)</enum><text>proposes construction, development, and operation the environmental effects of which are likely capable of protection, mitigation, and enhancement through the licensing provisions contained in this part; and</text></subparagraph><subparagraph id="ida5ff955b7f164a20a2d74d613f74dce7"><enum>(E)</enum><text>is not located within any land or interest in land the legal title to which is held by the United States in trust for the benefit of an Indian Tribe, unless the affected Indian Tribe—</text><clause id="idF8C30CDCBCCA48B18F4E888B8A89CD54"><enum>(i)</enum><text>is a project proponent; or</text></clause><clause id="idC10C17FC913F4E84BC6E17D444565DD4"><enum>(ii)</enum><text>consents, in writing, to the location.</text></clause></subparagraph></paragraph></subsection><subsection id="id36514C0AA17940AAB8F1FF5368652BC1"><enum>(b)</enum><header>Expedited licensing process for closed-Loop and off-Stream pumped storage projects</header><paragraph commented="no" display-inline="no-display-inline" id="HA086B3A98CDE4EA1B9F6B7E7C0860818"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission may issue licenses, as appropriate, for any closed-loop or off-stream pumped storage project that meets the qualifying criteria, as determined by the Commission, in accordance with this section.</text></paragraph><paragraph id="ida21202b493a04ce9953b8d8218f40cf3"><enum>(2)</enum><header>Updating regulations</header><text>Not later than 180 days after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>, after consultation with the interagency task force under paragraph (3) and providing notice and an opportunity for public comment, the Commission shall update regulations of the Commission for issuing licenses for closed-loop or off-stream pumped storage projects that meet the qualifying criteria.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B91A92AF4114A728CFFA28CC914A607"><enum>(3)</enum><header display-inline="yes-display-inline">Interagency task force</header><subparagraph commented="no" display-inline="no-display-inline" id="idB6505ACC67A840A88561E310C8621DED"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In updating regulations under this section, the Commission shall convene an interagency task force, with appropriate Federal and State agencies, Indian Tribes, and the public represented, to coordinate the regulatory processes associated with the authorizations required to construct and operate closed-loop or off-stream pumped storage projects that meet the qualifying criteria.</text></subparagraph><subparagraph id="id584530cc44a342d49d365b764c8af623"><enum>(B)</enum><header>Workshops and meetings</header><text>Before issuing a proposed rule for public comment under paragraph (2), the Commission shall convene workshops and other meetings with the interagency task force under this paragraph to develop procedures that allow the Commission and appropriate Federal and State agencies and Indian Tribes to exercise authority in accordance with—</text><clause id="idE57E251590B8401EB2B4381B7F25870D"><enum>(i)</enum><text>this section; and</text></clause><clause id="id11ACBBDCD9D54CF3B70BC95783210C47"><enum>(ii)</enum><text>the applicable requirements of this part.</text></clause></subparagraph></paragraph><paragraph id="id605EDBBD6B154B65A5B5561D254811A6"><enum>(4)</enum><header>Deadline</header><text>The Commission shall issue a final decision regarding an application for a license for a proposed closed-loop or off-stream pumped storage project submitted under subsection (d)(3) not later than 3 years after the date on which the Commission determines under subsection (d)(2) that the closed-loop or off-stream pumped storage project meets the qualifying criteria.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB57C473860FF4DC7B29D93D34E04D6F1"><enum>(c)</enum><header display-inline="yes-display-inline">Dam safety</header><text display-inline="yes-display-inline">Before issuing any license for a closed-loop or off-stream pumped storage project that meets the qualifying criteria, the Commission shall assess the safety of relevant existing dams and other project works.</text></subsection><subsection id="idaeccb60d9aed4bdeb2d7327e0c697421"><enum>(d)</enum><header>Expedited process</header><paragraph id="idf45cbbebd77f407bb50c378861d5fac4"><enum>(1)</enum><header>Notification of intent and supporting information</header><text>The applicant for a closed-loop or off-stream pumped storage project shall commence the licensing process under this section by submitting to the Commission a notification of intent to file an application for a license, together with supporting information, which shall inform the determination of the Commission under paragraph (2). </text></paragraph><paragraph id="id572a7c8ae54b4c6394dcd6bae12125ab"><enum>(2)</enum><header>Commission determination</header><subparagraph id="id4FE9EE1EDD4D43BAB7A04C6895B61F08"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date on which an applicant submits to the Commission a notification of intent under paragraph (1), the Commission, after providing notice and an opportunity for public comment, shall—</text><clause id="id43E553FF41C84B7CB4FBB69BCC9CB3EF"><enum>(i)</enum><text>determine whether the closed-loop or off-stream pumped storage project described in the notification meets the qualifying criteria; and</text></clause><clause commented="no" id="id624D6B0C9C534A30A6685DC821DD746B"><enum>(ii)</enum><text>include in a determination under clause (i) information, including analyses supported by information in the public record, relating to the factual basis for the determination.</text></clause></subparagraph><subparagraph id="id448CAD086A924B6E86CA86828300F7FD"><enum>(B)</enum><header>Consultation</header><text>In making a determination under subparagraph (A) with respect to a closed-loop or off-stream pumped storage project, the Commission shall consult with Federal and State agencies and Indian Tribes with authority over the closed-loop or off-stream pumped storage project regarding any qualifying criteria that may disqualify the closed-loop or off-stream pumped storage project from the expedited process under this section.</text></subparagraph><subparagraph id="id0B59A28E662E46F79E323B7A8C206939"><enum>(C)</enum><header>Resolution</header><text>If the Commission determines under subparagraph (B) that any qualifying criteria potentially disqualify a closed-loop or off-stream pumped storage project from the expedited process under this section, the Commission shall—</text><clause id="idD032D87B18A241CD846CB997F5E24444"><enum>(i)</enum><text>seek to resolve any issues in advance of issuing a determination regarding whether the closed-loop or off-stream pumped storage project meets the qualifying criteria under this paragraph; and</text></clause><clause id="idC7135A6CEB714D128CC5E3BB9B1D5309"><enum>(ii)</enum><text>include in a determination under clause (i) information relevant to efforts to resolve such issues.</text></clause></subparagraph></paragraph><paragraph id="id74CE5E3102C54E349F6139FEA49A5657"><enum>(3)</enum><header>Closed-loop and off-stream pumped storage project applications</header><subparagraph id="idE109712A8220459081702E3153595B66"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date on which the Commission determines under paragraph (2) that a closed-loop or off-stream pumped storage project meets the qualifying criteria, an applicant for the closed-loop or off-stream pumped storage project shall submit to the Commission an application for a license under this section.</text></subparagraph><subparagraph id="id21A8EE67DD0B465D98872D1B27D80561"><enum>(B)</enum><header>Inclusions</header><text>An application under subparagraph (A) shall include a description of each protection, mitigation, and enhancement measure proposed to be carried out in order for the applicable closed-loop or off-stream pumped storage project to receive a license from the Commission, in accordance with subsection (e).</text></subparagraph></paragraph></subsection><subsection id="id1F19E7FDBA2D4F44AD86D9A6DDFF9EB4"><enum>(e)</enum><header>Requirements</header><text>In determining whether to approve an application submitted for a closed-loop or off-stream pumped storage project under subsection (d)(3), in accordance with the deadline described in subsection (b)(4), the Commission, in consultation with applicable Federal and State resource agencies and Indian Tribes with regulatory responsibility for the closed-loop or off-stream pumped storage project, shall— </text><paragraph id="idC93B7ACD6A3C4E7B99C87ECA833DFCB8"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE9A3C5C88D7D4FBBADA04651C127E610"><enum>(A)</enum><text>use relevant existing studies, monitoring information, and data that are applicable to the relevant project, in accordance with section 10(<italic>l</italic>);</text></subparagraph><subparagraph id="idE991368CE9FE47158DD5ECC9E3B924D3" indent="up1"><enum>(B)</enum><text>avoid duplicating current, existing studies; and</text></subparagraph><subparagraph indent="up1" id="idBFBAF9CEC59B4CE89BE307456D847DF1"><enum>(C)</enum><text>design any new studies and information requirements to be consistent with the ability of the Commission to meet the licensing deadline under subsection (b)(4);</text></subparagraph></paragraph><paragraph id="id4E624C1653A8447387F0FFD5767659B9"><enum>(2)</enum><text>consider whether obligations under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) may be met through—</text><subparagraph id="idFB79C37F9678459AB4F2B8A79E3CB356"><enum>(A)</enum><text>preparing an environmental assessment; or</text></subparagraph><subparagraph id="idFC26ED19350D44F7B5B08E217649B4A4"><enum>(B)</enum><text>supplementing a previously prepared environmental assessment or environmental impact statement;</text></subparagraph></paragraph><paragraph id="id4CA7F6D4291542BFAED3A55AB0FAE551"><enum>(3)</enum><text>develop a licensing process that reduces administrative burdens on resource agencies, Indian Tribes, the applicant, and the public by avoiding unnecessary paperwork, meetings, and other process obligations, subject to the condition that nothing in this paragraph eliminates any applicable consultation requirement under Federal or State law (including regulations); and</text></paragraph><paragraph id="id7B73ACEBC9174BE789B41563C6AB8175"><enum>(4)</enum><text>consider a set of standard license terms and conditions that generally would apply to all closed-loop or off-stream pumped storage projects licensed under this section, based on common technical considerations and environmental effects, subject to the condition that the development of standard license terms and conditions shall not limit the imposition of project-specific conditions for any particular closed-loop or off-stream pumped storage project.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC83D4A9B13E949F0B5AE8CAF843C1A76"><enum>(f)</enum><header display-inline="yes-display-inline">Transfers</header><text display-inline="yes-display-inline">Notwithstanding section 5, regardless of whether the holder of a preliminary permit for a closed-loop or off-stream pumped storage project claims a municipal preference under section 7(a) in obtaining a permit, on request by a municipality, the Commission may, to facilitate development of a closed-loop or off-stream pumped storage project—</text><paragraph commented="no" display-inline="no-display-inline" id="H505DB0A9809846AFBDC038E8AF449AA7"><enum>(1)</enum><text>add 1 or more entities as joint permittees following the issuance of a preliminary permit; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H664DAA8B14384534BAC4BD593DFB1DDA"><enum>(2)</enum><text>transfer a license in part to 1 or more nonmunicipal entities as co-licensees with a municipality, if the municipality retains majority ownership of the closed-loop or off-stream pumped storage project for which the license was issued.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id84AFC36BADCB479C9E0B71531FF71B08"><enum>(g)</enum><header>Developing abandoned mines for pumped storage</header><paragraph commented="no" display-inline="no-display-inline" id="id1EB597B9F4674B67872381B20CB8D5C8"><enum>(1)</enum><header>Workshop</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall hold a workshop to explore potential opportunities for development of closed-loop pumped storage projects at abandoned mine sites.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48C583ADF9B04002BBC7A4278950FB80"><enum>(2)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall issue guidance to assist applicants for licenses or preliminary permits for closed-loop pumped storage projects at abandoned mine sites.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD734C1312C5F48429A158754EEF12AED"><enum>(h)</enum><header display-inline="yes-display-inline">Savings clause</header><text display-inline="yes-display-inline">Nothing in this section affects any authority of the Commission to license a closed-loop or off-stream pumped storage project under any other provision of this part.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id564e7253155a4292a0b78a71a5b29873"><enum>13.</enum><header>Conditions to protect Tribal resources</header><text display-inline="no-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF0ACB9BC36043D89CF6B43BE2D0B9E3"><section id="id75cace2b8b02426983b37b6c38f085ea"><enum>37.</enum><header>Conditions to protect Tribal resources</header><subsection id="ide457bfee4b17451288da4180b1727635"><enum>(a)</enum><header>Necessary conditions of Indian Tribes</header><paragraph id="ide5b88593ba4740a0a0e3e27fc12b9525"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (c), an Indian Tribe shall have exclusive authority to deem a condition to a license under this part to be necessary under section 4(e)(2) if the license is issued for a project located within any land or an interest in land the legal title to which is held by the United States in trust for the benefit of the Indian Tribe, regardless of whether the Indian Tribe is a licensee or applicant for the project, subject to paragraph (2).</text></paragraph><paragraph id="iddf4371f4ff7e408bbfc8433efd2d8134"><enum>(2)</enum><header>Condition; written statement</header><text>On deeming a condition to be necessary pursuant to paragraph (1), an Indian Tribe shall submit to the Commission—</text><subparagraph id="id3D6B150B56724697828EE02F3EB71B92"><enum>(A)</enum><text>the condition; </text></subparagraph><subparagraph id="idA94A6C5F9A5641DCB8FFB97B168C6181"><enum>(B)</enum><text>a written statement—</text><clause id="id28425ad591cf46f2b737d8c36ac4b660"><enum>(i)</enum><text>demonstrating that the Indian Tribe considered alternatives to the submitted condition;</text></clause><clause id="id4A4AECC496234B52B8E9D12A286FA56D"><enum>(ii)</enum><text>providing a scientific and technical rationale for—</text><subclause id="idABFA3D8FCC674AE6BAE916E27563F722"><enum>(I)</enum><text>the condition submitted; and </text></subclause><subclause id="id96B2AA133E2141DB94BFA9004203534B"><enum>(II)</enum><text>alternatives considered but not adopted; and</text></subclause></clause><clause id="id93c516e80c0244dd9b53961e839dc873"><enum>(iii)</enum><text>identifying specific facts relied on in the record; and</text></clause></subparagraph><subparagraph id="idCC5F35CB2D6B4B2490493D401954747C"><enum>(C)</enum><text>any studies, data, and other factual information relied on by the Indian Tribe that is relevant to the decision of the Indian Tribe.</text></subparagraph></paragraph></subsection><subsection id="id7a178fecbf6246319ebe7701b92f90cc"><enum>(b)</enum><header>Other reservations</header><text>For any license issued within any reservation other than a reservation described in subsection (a), the Secretary of the agency responsible for the supervision of the reservation, in deeming conditions of the license to be necessary under section 4(e)(2), shall consult with the Secretary of the Interior and any potentially affected Indian Tribes regarding the responsibilities of the United States in the project area under any applicable treaty with an Indian Tribe, as determined by a court of competent jurisdiction.</text></subsection><subsection id="id21ecc1faab924724ba809c7b533b666f"><enum>(c)</enum><header>Exclusion</header><text>This section shall not apply to any project that, as of the date of enactment of the <short-title>Community and Hydropower Improvement Act</short-title>—</text><paragraph id="id029ce75898af4a26bfbbd48bdf490393"><enum>(1)</enum><text>is licensed under this part; and</text></paragraph><paragraph id="id0a923b8354ba4cdb81b1bdcb0ca72bd7"><enum>(2)</enum><text>is not located on any land or interest in land, the legal title to which is held by the United States in trust for the benefit of an Indian Tribe.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb86de8c23c2f4f51aa59e392f33d2157"><enum>14.</enum><header>Coordination of Commission and other agencies issuing Federal authorizations</header><text display-inline="no-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) (as amended by section 13) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfc8dcf06c9774dccbb7c53ac91378a94"><section id="id8af3827d944a418f8502bb2d8339f645"><enum>38.</enum><header>Coordination of Commission and other agencies issuing Federal authorizations</header><subsection id="ida554bfbc050b49e0893bb83c8a1d3119"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id27589d6ecfc2437c9cfba684871b59fa"><enum>(1)</enum><header>Conditioning agency</header><text>The term <term>conditioning agency</term> means a Federal agency (other than the Commission), a State agency, or an Indian Tribe that has the authority to issue a Federal authorization.</text></paragraph><paragraph id="id5b9f3320970e4ca59cf079fbc787249c"><enum>(2)</enum><header>Federal authorization</header><text>The term <term>Federal authorization</term> means any authorization required under Federal law with respect to an application for a license, including any—</text><subparagraph id="id726e694a389d4be28dfb4e67300e0389"><enum>(A)</enum><text>license;</text></subparagraph><subparagraph id="idf321638f98d54e55b92e06648c081119"><enum>(B)</enum><text>condition of a license submitted by the applicable Secretary or an Indian Tribe under section 4(e)(2);</text></subparagraph><subparagraph id="id63717c90931c4b528cad9403a7dfbc45"><enum>(C)</enum><text>prescription submitted by the applicable Secretary under section 18;</text></subparagraph><subparagraph id="idc452b7d823334f77aeb3b55d4bfdca8a"><enum>(D)</enum><text>permit;</text></subparagraph><subparagraph id="idcf063a47b6da477290578c1790f65511"><enum>(E)</enum><text>special use authorization;</text></subparagraph><subparagraph id="id6402d444dea94193ab319b990db3235b"><enum>(F)</enum><text>certification;</text></subparagraph><subparagraph id="id82519455880542cb99326c91352db2bb"><enum>(G)</enum><text>opinion;</text></subparagraph><subparagraph id="idfe1a65e2c048407dabc7a0607750fa62"><enum>(H)</enum><text>consultation;</text></subparagraph><subparagraph id="idf244a897f50a413cb09d72a1b1860f0f"><enum>(I)</enum><text>determination; or</text></subparagraph><subparagraph id="idff988c3029064a78bd81e9231f726baf"><enum>(J)</enum><text>other approval.</text></subparagraph></paragraph></subsection><subsection id="idb9b4007a326240338b8521203fb374d3"><enum>(b)</enum><header>Coordination of schedule</header><paragraph id="id87ab2de1f5e84e48821aa0cda153e555"><enum>(1)</enum><header>Initial conference</header><text>Not later than 90 days after the date on which an applicant submits to the Commission a notification of intent to apply for a license under this part, the Commission, after consultation with each conditioning agency, shall convene a technical conference, with a transcript to be taken by the Commission and submitted to the public record, to coordinate the respective efforts and schedules of the Commission and the conditioning agencies relating to studies and other information, consultations, environmental reviews, and decisionmaking.</text></paragraph><paragraph id="iddb4f347f0796478eb8fd51f8311ddb53"><enum>(2)</enum><header>Joint schedule and record</header><subparagraph id="idc62e5bce454d4ba9a21d4706219a1814"><enum>(A)</enum><header>Establishment</header><text>To the extent reasonably practicable, the Commission and the applicable conditioning agencies shall establish, with respect to each project that is the subject of a notification of intent to apply for a license under this part—</text><clause id="id73b48950fb6b4089bea7cdb0270a16eb"><enum>(i)</enum><text>a joint schedule that will permit the timely completion of decisions required to be made with respect to, and timely issuance of, Federal authorizations by the Commission and the conditioning agencies; and</text></clause><clause id="ida8dd9bff00a44b22a46a892addb395fa"><enum>(ii)</enum><text>a record supporting the basis for the respective decisions of the Commission and the conditioning agencies.</text></clause></subparagraph><subparagraph id="idcee5c10186f149b2b1a6d6b0e65c9126"><enum>(B)</enum><header>Consideration of waivers and modifications</header><text>The Commission and the conditioning agencies shall consider waivers or modifications of the requirements of respective rules, within statutory limits, as appropriate—</text><clause id="id6825f1bf4b684ac08ad503df04f20e63"><enum>(i)</enum><text>to establish a joint schedule for the proceeding; and</text></clause><clause id="idcf62246a406148f98d9b0e4495d798c7"><enum>(ii)</enum><text>to ensure timely decisionmaking.</text></clause></subparagraph></paragraph><paragraph id="idb2c1c86bd49e43f5be2fca738ac24540"><enum>(3)</enum><header>Subsequent conferences</header><subparagraph id="idA98FAB9B2F944A919485DB6D74473737"><enum>(A)</enum><header>In general</header><text>After the date on which the initial conference is convened under paragraph (1), the Commission shall convene subsequent technical conferences, as appropriate and after consultation with each conditioning agency, to address changed circumstances that may—</text><clause id="id3F79DEA221E14051BD2A570DBC21C1B0"><enum>(i)</enum><text>allow for greater coordination of efforts and schedules; or </text></clause><clause id="idAC52E7F76C0F4607A61A3B8B27BAE9B8"><enum>(ii)</enum><text>threaten the ability of the Commission or any conditioning agency to maintain any joint schedule established under paragraph (2). </text></clause></subparagraph><subparagraph id="id2D972468F943499FA9128621F62E5250"><enum>(B)</enum><header>Transcript</header><text>The Commission shall take a transcript of any technical conference convened under this paragraph, to be submitted to the public record.</text></subparagraph></paragraph><paragraph id="id9103aee3f67d4917ab4cdf43ffb3a8f9"><enum>(4)</enum><header>Failure to agree</header><text>If the Commission and a conditioning agency are unable to establish or maintain a joint schedule under paragraph (2), the Commission and conditioning agency shall submit to the public record maintained by the Commission, not later than 30 days after the conclusion of the technical conference under paragraph (1) or (3), as applicable, a statement that—</text><subparagraph id="id923ee909b94743a0b378c28e498e43b1"><enum>(A)</enum><text>identifies each inconsistency or conflict;</text></subparagraph><subparagraph id="iddcc217241587462ea03c285add22127b"><enum>(B)</enum><text>explains the position taken by each agency causing the inconsistency or conflict; and</text></subparagraph><subparagraph id="idf99dc54cfcf545818ab0317856b01f7b"><enum>(C)</enum><text>provides an analysis, supported by information in the public record, of the factual basis for the inconsistent or conflicting position taken by each agency.</text></subparagraph></paragraph></subsection><subsection id="id70e3bf8d6fc7474f84ee809be7489b47"><enum>(c)</enum><header>Coordination of information and studies</header><paragraph id="idb27563c55e294dca907586c299f2122b"><enum>(1)</enum><header>Conference</header><text>As early as practicable after the date on which an applicant submits to the Commission a notification of intent to apply for a license under this part, the Commission, after consultation with each conditioning agency, shall convene a technical conference to address existing information and potential new studies relevant to the development of the record that would support agency decisionmaking.</text></paragraph><paragraph id="id5bbde8c22cd045268d898f23eac3aa29"><enum>(2)</enum><header>Joint study plan</header><text>To the extent reasonably practicable, the Commission and the applicable conditioning agencies shall establish, with respect to each project that is the subject of a notification of intent to apply for a license under this part, a joint study plan.</text></paragraph><paragraph id="id929cefa4f04045419b3127a26cdc8188"><enum>(3)</enum><header>Failure to agree</header><text>If 1 or more agencies are unable to establish or maintain a joint study plan, the applicable agencies shall submit to the public record maintained by the Commission, not later than 30 days after the conclusion of the technical conference under paragraph (1), a statement that—</text><subparagraph id="id7967a2f628cf48c8bc97f98ec591ad63"><enum>(A)</enum><text>identifies each inconsistency or conflict;</text></subparagraph><subparagraph id="id8b8a74dde3bc4ba48d0cbaf36a137a2e"><enum>(B)</enum><text>explains the position taken by each agency causing the inconsistency or conflict; and</text></subparagraph><subparagraph id="idec5c83c31e2e4d29910272e7338a480f"><enum>(C)</enum><text>provides an analysis, supported by information in the public record, of the factual basis for the inconsistent or conflicting position taken by each agency.</text></subparagraph></paragraph></subsection><subsection id="idae579a76425e46478ebe389b635e4b13"><enum>(d)</enum><header>Trial-Type hearing</header><text>For any trial-type hearing conducted under section 4(e)(2) or 18, the Commission—</text><paragraph id="idb5b1a824334440069f1eeb789d405aa9"><enum>(1)</enum><text>may participate as a party for purposes of advocating the factual analyses of Commission staff relating to any disputed issue of material fact; and</text></paragraph><paragraph id="id70847aeebe94480eb03fe1b334219d61"><enum>(2)</enum><text>shall give due weight to the findings of fact resulting from the trial-type hearing in preparing any environmental analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id970aa542dc3a40ca8051ee7ca1b2a8b1"><enum>(e)</enum><header>Consultation on inconsistent or conflicting license terms</header><paragraph id="id9311217620514ae3aa71b98aed666a4e"><enum>(1)</enum><header>In general</header><text>If a term or condition of a Federal authorization submitted or recommended for inclusion in a license under this part conflicts or is otherwise inconsistent with another such term or condition in a Federal authorization, the Commission shall initiate and facilitate consultation with the conditioning agencies submitting conflicting or inconsistent terms or conditions, to attempt to resolve the inconsistency or conflict.</text></paragraph><paragraph id="id17fc0f8c59ff4783807201cca4b24caf"><enum>(2)</enum><header>Requirements</header><text>The consultation period under paragraph (1) shall—</text><subparagraph id="idf7082f5ebf7542bf890f9b26e7e1388c"><enum>(A)</enum><text>be not longer than 90 days; and</text></subparagraph><subparagraph id="idd7b13a27ee3c4e0c97ee5f0bec5d4c47"><enum>(B)</enum><text>include at least 1 technical conference or similar meeting.</text></subparagraph></paragraph><paragraph id="ida629f4ae63314addb633108f92967680"><enum>(3)</enum><header>Action on agreement</header><text>If the agencies submitting terms or conditions of a Federal authorization resolve an inconsistency or conflict under this subsection, the agencies shall establish a reasonable schedule and deadline, not later than 90 days after the conclusion of the consultation, to amend and reissue the relevant Federal authorizations to reflect that resolution, as appropriate.</text></paragraph><paragraph id="id66ea56e65002444a8c580dea3e84fe10"><enum>(4)</enum><header>Failure to agree</header><text>If the agencies submitting terms or conditions of a Federal authorization are unable to resolve an inconsistency or conflict under this subsection, the agencies shall submit to the public record maintained by the Commission, not later than 30 days after the conclusion of the consultation, a statement that—</text><subparagraph id="id0acfed5b5e454b419f34cedaf6ab104d"><enum>(A)</enum><text>identifies the inconsistency or conflict; and</text></subparagraph><subparagraph id="id170f88cd375f40fbb72e5bc23c1d0182"><enum>(B)</enum><text>explains the reason for the inconsistency or conflict, supported by information in the public record.</text></subparagraph></paragraph></subsection><subsection id="id7cf55242a5cd4d4aa812509460104cc3"><enum>(f)</enum><header>Public notice and participation</header><paragraph id="idFA581539EDD7485DAC22C287ACB46BD5"><enum>(1)</enum><header>Notice</header><text>The Commission shall issue public notice of each technical conference between the Commission and a conditioning agency under this section.</text></paragraph><paragraph id="idDF525BA7E63F4E8099F8D60769211509"><enum>(2)</enum><header>Participation</header><text>Each technical conference under this section shall be held open to participation by—</text><subparagraph id="idAF9EB3B608D6444787370981DFA11B5E"><enum>(A)</enum><text>the applicable license applicant; and</text></subparagraph><subparagraph id="id2EDEA77F4795407FB78F0585BC0A1C8A"><enum>(B)</enum><text>other licensing participants.</text></subparagraph></paragraph></subsection><subsection id="id672f9d99e5e04ae3928d3c81829edc2c"><enum>(g)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>, after providing notice and an opportunity for public comment, the Commission shall promulgate regulations to implement the requirements of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ide1bab51d438245edbde364c6c54cc8b2"><enum>15.</enum><header>Off-site considerations in hydropower licensing</header><text display-inline="no-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) (as amended by section 14) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDD043B6523E941C3927F875EEEF5E70D"><section id="id76f36f48c208441992fcd64b353d98b7"><enum>39.</enum><header>Off-site considerations in hydropower licensing</header><subsection id="id5d92c9172bc242e98ebb4f84e70232b4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd70d0dda407a4f32a94d56dc9eb8156d"><enum>(1)</enum><header>Conditioning agency; Federal authorization</header><text>The terms <term>conditioning agency</term> and <term>Federal authorization</term> have the meanings given the terms in section 38(a).</text></paragraph><paragraph id="id81dc93dbb8144eb2807499383e7042e8"><enum>(2)</enum><header>Nonjurisdictional dam</header><text>The term <term>nonjurisdictional dam</term> means any non-Federal dam, dike, embankment, or other barrier that—</text><subparagraph id="idCC067AC5C56F4B989FD7BA8F1AABA7F7"><enum>(A)</enum><text>is constructed to hold back or divert water; and</text></subparagraph><subparagraph id="id638f88fe7e39441b9c57c0b6fbed634a"><enum>(B)</enum><text>is not—</text><clause id="id79C8A26D2CAD4FAF8F3F0CD3DB12D693"><enum>(i)</enum><text>licensed under this part; or</text></clause><clause id="id448291CCC37D4810A7E18BEAE9EEDB03"><enum>(ii)</enum><text>exempted from the license requirements contained in this part.</text></clause></subparagraph></paragraph><paragraph id="id0bebbd78d66c40b8ae8d7a74e0692140"><enum>(3)</enum><header>Off-site measure</header><text>The term <term>off-site measure</term> means any activity intended to mitigate the project effects by replacing or providing substitute resources or habitat at a location different from the project area.</text></paragraph></subsection><subsection id="idd123b6b81eff44fa9f8b803da4642f6b"><enum>(b)</enum><header>Off-Site measures</header><paragraph id="iddf0a994f98944cd6a5d1b470553a10d0"><enum>(1)</enum><header>In general</header><text>In discharging responsibilities under any Federal authorization for the protection of, mitigation of damage to, and enhancement of resources affected by a project, the Commission and conditioning agencies—</text><subparagraph id="idBF5D5E30FA914CFA954DA8124DC4F6CC"><enum>(A)</enum><text>shall consider and include in the public record off-site measures recommended by any licensing participant, including Federal resource agencies, State resource agencies Indian Tribes, and the public; but</text></subparagraph><subparagraph id="id80C2D00E065D4777BA6FF220D8712D60"><enum>(B)</enum><text>shall not require any off-site measure that is not proposed by the applicant.</text></subparagraph></paragraph><paragraph id="id97D1F9AFE7FE435B81629079227EB255"><enum>(2)</enum><header>Coordination</header><text>An off-site measure under this subsection may include coordination with another project in the applicable basin.</text></paragraph><paragraph id="id9c31a89b89e84efe80dbaa95d01b4a61"><enum>(3)</enum><header>Effect on regulatory responsibilities</header><text>The adoption by the Commission or any conditioning agency of an off-site measure proposed by an applicant shall satisfy the applicable requirements of a Federal authorization that otherwise would be necessary or appropriate to mitigate a project effect associated with the project site, subject to the condition that the Commission and conditioning agencies shall give preference to onsite measures to achieve that mitigation.</text></paragraph><paragraph id="id57de25f960bb4f3d883936f93ba28e41"><enum>(4)</enum><header>Project extent</header><text>Notwithstanding section 3(11), the land, infrastructure, improvements, and waters associated with any off-site mitigation measure shall not be required to be included as part of a project, subject to the condition that any off-site measure adopted under this section shall be included, implemented, and enforced as a license condition issued by the Commission under this part.</text></paragraph></subsection><subsection id="idb07f939b3d1e4825b87621e0f3592df9"><enum>(c)</enum><header>Nonjurisdictional dam removal</header><paragraph id="idBAFE6B1E034A4DC08D9A5B90AF12EFEA"><enum>(1)</enum><header>In general</header><text>The requirements of this subsection apply to any off-site measure that—</text><subparagraph id="idA4A09D24E29E46D08710CAA7D8A1C9CB"><enum>(A)</enum><text>includes removal of a nonjurisdictional dam;</text></subparagraph><subparagraph id="id56E9D3FB075946F8815EAF0542AD5039"><enum>(B)</enum><text>is proposed by an applicant; and</text></subparagraph><subparagraph id="id95B45C57BC7E4C03B944ED027CB58681"><enum>(C)</enum><text>is approved by the Commission or a conditioning agency under a Federal authorization.</text></subparagraph></paragraph><paragraph id="id9007fae852f546b48ada7fc4379bed74"><enum>(2)</enum><header>Liability protection</header><subparagraph id="ide1243e75134b4af39ec533d875d7cbcc"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of Federal, State, Tribal, local, or common law, a licensee shall not be liable for any harm, loss, or other damage to an individual or entity, property, a natural resource, or the environment, or any damages resulting from dam removal, arising from, relating to, or triggered by an action associated with the removal of a nonjurisdictional dam under this section, including any damage caused by the release of any material or substance (including a hazardous substance), if the licensee and the owner of the nonjurisdictional dam or third party have entered into a legally enforceable agreement ensuring that the owner (or an assignee) or third party retains that liability.</text></subparagraph><subparagraph id="id8c0fb9dd3f834088a2507a529f31cfbe"><enum>(B)</enum><header>Funding</header><text>Notwithstanding any other provision of Federal, State, local, or common law, no individual or entity contributing funds for removal of a nonjurisdictional dam under this section shall be held liable, solely by virtue of that funding, for any harm, loss, or other damage to an individual or entity, property, or the environment, or damages, arising from the removal of a facility or facility operations arising from, relating to, or triggered by an action associated with removal of the nonjurisdictional dam, including any damage caused by the release of any material or substance (including a hazardous substance).</text></subparagraph></paragraph><paragraph id="idfd7b7b8018694be9aa8e9a045ad39ef3"><enum>(3)</enum><header>Preemption</header><subparagraph id="idE765F8CF3AD142C7B7FF874C70627596"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 10(c), except as provided in subparagraph (B), protection from liability under this subsection shall preempt the law of any State or Indian Tribe to the extent that the State or Tribal law is inconsistent with this section.</text></subparagraph><subparagraph id="idB1D2D8870C9C4AC9917CEFA2E928F24A"><enum>(B)</enum><header>Exception</header><text>Nothing in this subsection limits any otherwise-available immunity, privilege, or defense under any other provision of law.</text></subparagraph></paragraph></subsection><subsection id="id71B19E184C3A444EA4F97849F8A0D3DF"><enum>(d)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>, the Commission, after providing notice and an opportunity for public comment, shall promulgate regulations to implement the requirements of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc00f499a2f734cebb003b4d766ef7dfe"><enum>16.</enum><header>Micro hydropower facilities</header><text display-inline="no-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) (as amended by section 15) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id42281F3B60884BAC9AB42353579EE0B6"><section id="id5f36079b6d6b41b89ea09af993a1029e"><enum>40.</enum><header>Micro hydropower facilities</header><subsection id="id13ece211af85468dafd26a08fe1e57a4"><enum>(a)</enum><header>In general</header><text>To improve the regulatory process and reduce delays and costs for new development of hydropower facilities with an installed capacity of 1,000 kilowatts or less (referred to in this section as <term>micro hydropower facilities</term>), the Commission shall investigate—</text><paragraph id="ida44c6f18896f4177ba745d618842e823"><enum>(1)</enum><text>opportunities to expand the use of micro hydropower facilities in the United States for purposes of—</text><subparagraph id="id7b83a3f832f34ffaa9158df2ed555f60"><enum>(A)</enum><text>capturing the electric generating potential of existing hydraulic processes without requiring the construction of any new dam or similar infrastructure;</text></subparagraph><subparagraph id="idae99156bc8e845fc826c960bc8ede68b"><enum>(B)</enum><text>reducing United States dependence on fossil fuel resources for power and energy; and</text></subparagraph><subparagraph id="id3203bf91ce4a4d868c2caea44581093e"><enum>(C)</enum><text>serving rural, underserved, or isolated communities; and</text></subparagraph></paragraph><paragraph id="id72e95bb72ab74d79b174a9b84b7ec2b1"><enum>(2)</enum><text>regulatory processes for, and administration of, micro hydropower facilities, including with respect to—</text><subparagraph id="id4e27ee07a13e41b480c45c10096b1878"><enum>(A)</enum><text>the protection, mitigation, and enhancement of fish and wildlife (including related spawning grounds and habitat) and other beneficial public uses, including irrigation, flood control, water supply, and recreational and other purposes referred to in section 4(e)(5);</text></subparagraph><subparagraph id="id5692e3e7fe714d538ef675494682fd8f"><enum>(B)</enum><text>achieving cost-effective and administratively efficient regulation of micro hydropower facilities that are commensurate with the size, expanse, and environmental effects of micro hydropower facilities; and</text></subparagraph><subparagraph id="id6fefa5802f3e47fcb6cfd7e38f3f880a"><enum>(C)</enum><text>protecting public safety and the structural integrity of project works.</text></subparagraph></paragraph></subsection><subsection id="id07a4d10801c64fe8b40874697f8254bd"><enum>(b)</enum><header>Information gathering</header><text>In carrying out subsection (a), the Commission shall—</text><paragraph id="id6D8A87373B384783BB06D19F8D33B636"><enum>(1)</enum><text>consult with the Secretary of Energy, Federal and State resource agencies, Indian Tribes, and the public; and</text></paragraph><paragraph id="idB32EB9AD359A4A66899EF2520955C6F4"><enum>(2)</enum><text>at a minimum—</text><subparagraph id="id6ccf11880fc74a1bb05c9cb9e24dee63"><enum>(A)</enum><text>solicit—</text><clause id="id36B1A73B5D1F4EE1BAD45ACFB2570384"><enum>(i)</enum><text>relevant technical, scientific, and regulatory information; and</text></clause><clause id="idB69CA587FF51432D96503901F59FF234"><enum>(ii)</enum><text>public comment;</text></clause></subparagraph><subparagraph id="ida31430601ec349d8935196e322d90464"><enum>(B)</enum><text>convene regional technical conferences to address the investigation subjects described in subsection (a); and</text></subparagraph><subparagraph id="id35755AD5C20F47DDAD2746FBD0A1D264"><enum>(C)</enum><text>provide an opportunity for public comment after the technical conferences under subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="id3e35c770648c4ce2a53fc81c0e1cb907"><enum>(c)</enum><header>Report</header><paragraph id="id3a401bef2e1441bfb62bd3c0069666e8"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Community and Hydropwer Improvement Act</short-title>, the Commission shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</text><subparagraph id="id4c5764c9016f457da79472363ca518db"><enum>(A)</enum><text>analyzes each of the investigation subjects described in subsection (a), including—</text><clause id="idDB411BE2FE1C4592B3986BEDD4B98581"><enum>(i)</enum><text>a quantitative assessment of—</text><subclause id="idB2401646970C4E4D9C51669ABB8E90CC"><enum>(I)</enum><text>the quantity of energy that could likely be produced by a program to expand the use of micro hydropower facilities in the United States; and</text></subclause><subclause id="id8E846C1764044AC881CDDC3DDDDE5851"><enum>(II)</enum><text>the environmental and economic feasibility of an expanded use of micro hydropower facilities; and</text></subclause></clause><clause id="id11A24AFD7B1D4C1494A1C791C3D679C6"><enum>(ii)</enum><text>specific recommendations regarding the means by which Congress may address or remedy each identified issue;</text></clause></subparagraph><subparagraph id="idbbb5a6949df245f9bf65a5bf810b0d0f"><enum>(B)</enum><text>describes the processes adopted, and any comments received, under subsection (b), including the response of the Commission to comments received from the Secretary of Energy, Federal and State resource agencies, Indian Tribes, and the public; and</text></subparagraph><subparagraph id="id638567226E8640E3AD998938D08536D6"><enum>(C)</enum><text>includes—</text><clause id="idF6563C9B6DF040B49C7E88BC2AA31D3B"><enum>(i)</enum><text>a description of each recommendation submitted relating to the draft report under paragraph (2); and</text></clause><clause id="idB53F3C5806A64D3D9EDB2D54037C8126"><enum>(ii)</enum><text>an explanation of the reasons of the Commission for not adopting any submitted recommendation, if applicable, as supported by information gathered under subsection (b).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93cc053c909d4897bc51690731fdce30"><enum>(2)</enum><header>Draft report</header><text>Before submitting the report under paragraph (1), the Commission shall provide a draft report to the Secretary of Energy, Federal and State resource agencies, Indian Tribes, and the public for review and comment for a period of not less than 60 days.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idff1871031d744323a203d1257de12a04"><enum>17.</enum><header>Reporting requirement</header><subsection commented="no" display-inline="no-display-inline" id="id2244ef4bc9364a369cfbb01ece703fbd"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act and every 5 years thereafter, the Federal Energy Regulatory Commission shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes progress with respect to the implementation of this Act and the amendments made by this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf0b461767fbd4256bbe3b53fe89b440d"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">A report submitted under subsection (a) shall—</text><paragraph id="idc7dad6b48a724e8cb88ed7b8dd0379c4"><enum>(1)</enum><text>identify any facilities for which expedited licensing was sought under section 34 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823e">16 U.S.C. 823e</external-xref>) during the period covered by the report, including—</text><subparagraph id="id3260df5667c9427f8830bd74e16b2407"><enum>(A)</enum><text>the licensing status for each facility, including all incomplete Federal authorizations needed for a licensing decision;</text></subparagraph><subparagraph id="id5d4c095a20f140d683137a44f60671b5"><enum>(B)</enum><text>whether the facility qualified for expedited licensing under that section; and</text></subparagraph><subparagraph id="id1ac3baf4ccd44282ab04eca241caa7a9"><enum>(C)</enum><text>if the facility did not qualify for expedited licensing under that section, the reasons for such determination;</text></subparagraph></paragraph><paragraph id="id060ecb96dbb142b48f06e7c3b5f28a4d"><enum>(2)</enum><text>identify all closed-loop and off-stream pumped storage projects for which expedited licensing was sought under section 35 of the Federal Power Act (as added by section 12) during the period covered by the report, including—</text><subparagraph id="id1e2dc7598d8141f7a8dd8085ed549ae7"><enum>(A)</enum><text>the licensing status for each project, including all incomplete Federal authorizations needed for a licensing decision;</text></subparagraph><subparagraph id="id2d1de51246914cc89a70dc02d427baf3"><enum>(B)</enum><text>whether the project qualified for expedited licensing under that section; and</text></subparagraph><subparagraph id="ide29a0494621b4d14970d44bb8f3c79e1"><enum>(C)</enum><text>if the project did not qualify for expedited licensing under that section, the reasons for such determination;</text></subparagraph></paragraph><paragraph id="id61eb395302984c909dc945e810612b6f"><enum>(3)</enum><text>identify each instance in which an Indian Tribe exercised the right of an Indian Tribe under section 37 of the Federal Power Act (as added by section 13) by deeming a condition to a license under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) to be necessary under paragraph (2)(A) of section 4(e) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>), including—</text><subparagraph id="idf9a31fbe203c48d6b8be6dabb7e083f7"><enum>(A)</enum><text>the nature of the condition and the Tribal resources protected by the condition; and</text></subparagraph><subparagraph id="id2f1c5aa4af69437a9731e1ebfcae19ef"><enum>(B)</enum><text>whether any party to the proceeding sought a trial-type hearing related to the condition under paragraph (2)(B) of that section, an alternative condition under section 33(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823d">16 U.S.C. 823d(a)</external-xref>), or otherwise challenged the condition;</text></subparagraph></paragraph><paragraph id="idfeb9e409d3af44d394c442f0cd449a81"><enum>(4)</enum><text>identify and describe the outcomes of the efforts of Federal agencies to establish or maintain joint schedules under section 38(b) of the Federal Power Act (as added by section 14), with a discussion of specific examples that demonstrate trends, conflicts, and successes associated with the joint schedules;</text></paragraph><paragraph id="id566a3b8dd9184b61920f733a73c70948"><enum>(5)</enum><text>identify and describe the outcomes of the efforts of Federal agencies to establish or maintain joint study plans under section 38(c) of the Federal Power Act (as added by section 14), with a discussion of specific examples that demonstrate trends, conflicts, and successes associated with the joint study plans; and</text></paragraph><paragraph id="id297b631d33884bc29f429539c9957717"><enum>(6)</enum><text>identify and describe the outcomes of the efforts of Federal agencies to resolve inconsistent or conflicting license terms under section 38(e) of the Federal Power Act (as added by section 14), with a discussion of specific examples that demonstrate trends, conflicts, and successes associated with the opportunity to seek resolution of inconsistent or conflicting license terms. </text></paragraph></subsection></section></legis-body></bill>
