which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a United States security strategy for the Western Hemisphere, and for other purposes.</official-title></form><legis-body><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Western Hemisphere Security Strategy Act of 2023</short-title></quote>.</text></section><section id="id40bd3ae6d1874b19ac226d40ab9e5b30"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id1fbf63ab2f984b48b3d80f3525dc6080"><enum>(1)</enum><text>the security, stability, prosperity, and state of democratic governance in the countries of the Western Hemisphere are vital to the national interests of the United States and to the national interests of such countries;</text></paragraph><paragraph id="id9487429351514ffea1fc89c4c54f442d"><enum>(2)</enum><text>the harmful and malign influence in Latin America and the Caribbean of the Government of the People’s Republic of China, the Government of the Russian Federation, and the Government of the Islamic Republic of Iran poses risks to—</text><subparagraph id="idA427CDBEAD5C4E5E875B3DC326DE1A97"><enum>(A)</enum><text>the people and countries of the Western Hemisphere; and</text></subparagraph><subparagraph id="idAA2948DBD7034FC996DF49F26AC2A79A"><enum>(B)</enum><text>the national interests of the United States;</text></subparagraph></paragraph><paragraph id="id442f05b4e1eb4cf7b2dfcfa54101c070"><enum>(3)</enum><text>the United States should expand its engagement in the Western Hemisphere by—</text><subparagraph id="id4f336cc057b148538e2519e2d1c7f60a"><enum>(A)</enum><text>strengthening its alliances and partnerships with countries in the Western Hemisphere;</text></subparagraph><subparagraph id="id534cb4c3dbd945e39938a70b3d033243"><enum>(B)</enum><text>fostering security cooperation among countries in the Western Hemisphere to facilitate trade, investment, training, and humanitarian assistance in the near and long term; and</text></subparagraph><subparagraph id="id951575c3d6c648f5bb1d63378afb779e"><enum>(C)</enum><text>working with security and law enforcement agencies in the Western Hemisphere—</text><clause id="id57f48bb66f2b4184b35c6e12a7644be4"><enum>(i)</enum><text>to address the shared challenges of—</text><subclause id="id05b15f92c5dd4cadb6d7c8b226060dd1"><enum>(I)</enum><text>narcotics trafficking, including the trafficking of fentanyl, the illicit use of which is now the leading cause of death among adults in the United States between the ages of 18 and 45 years;</text></subclause><subclause id="id309799236F8946B89D798AB5F9C631F5"><enum>(II)</enum><text>human trafficking; </text></subclause><subclause id="id100F22728EF5423BB2BB06564D6853AD"><enum>(III)</enum><text>other forms of illicit trafficking; </text></subclause><subclause id="idb4eb4eaa824d4b44be748dfc8b97b7ec"><enum>(IV)</enum><text>transnational criminal organizations; and</text></subclause><subclause id="idc7bcac258dbf40b68804c667fcd063ad"><enum>(V)</enum><text>cybersecurity; and </text></subclause></clause><clause id="ide5e672584cfa4a6f94283f0cc0514131"><enum>(ii)</enum><text>to support the rule of law, democracy, and human rights in the region;</text></clause></subparagraph></paragraph><paragraph id="idd6bff1391bc54f429cf822d6a47d9c4b"><enum>(4)</enum><text>the United States should maintain credible security capabilities dedicated to Latin America and the Caribbean—</text><subparagraph id="id5F7A3FA5AD454317AF3CBE950E35B397"><enum>(A)</enum><text>to build partner country capacity; </text></subparagraph><subparagraph id="id94FF9EAE3E6B422C9F86BD3C5E6B82A8"><enum>(B)</enum><text>to support the delivery of humanitarian assistance and disaster relief;</text></subparagraph><subparagraph id="idEE83028CF0A44C92BBD520DA43C45ADD"><enum>(C)</enum><text>to deter acts of aggression; and </text></subparagraph><subparagraph id="idF091AD1C74F04F4797031F3E41FAD8C9"><enum>(D)</enum><text>to respond, if necessary, to regional threats and threats to the national security of the United States; and</text></subparagraph></paragraph><paragraph id="idb2ee1af1fd3d49feafbf195fedb31c3c"><enum>(5)</enum><text>the Department of State and the Department of Defense should continue to commit additional assets and increase investments in the Western Hemisphere so as to maintain robust United States security partnerships with countries in the region.</text></paragraph></section><section id="id1F7EA6C7F4C24E718C0C4D3E4D7BE78E"><enum>3.</enum><header>Security strategy for the Western Hemisphere</header><subsection id="id80eb9d70e1ec4db6abcbf3b1769bf50d"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State and the Secretary of Defense shall jointly submit to the appropriate committees of Congress a multi-year strategy, to be known as the <quote>Western Hemisphere Security Strategy</quote>—</text><paragraph id="id5AE0E0DDAE164DA6870DA3E592C2776B"><enum>(1)</enum><text>to enhance diplomatic engagement and security assistance and cooperation; </text></paragraph><paragraph id="id8FFB914094AB4F27B461668F28C36AAB"><enum>(2)</enum><text>to promote regional security and stability; and </text></paragraph><paragraph id="id8905A89E3CFA45269BAD392D780DE4F7"><enum>(3)</enum><text>to advance United States strategic interests in the Western Hemisphere.</text></paragraph></subsection><subsection id="id9DDF7F28EDAA4EAFA65E3FC44FC0A296"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall include the following:</text><paragraph id="idce061f48768f44d9b1920c90859806db"><enum>(1)</enum><text>A proposal for increasing and improving United States bilateral and multilateral security assistance and cooperation in Latin America and the Caribbean.</text></paragraph><paragraph id="iddf49725a9a8b4444bc2c9f09a2095dc6"><enum>(2)</enum><text>Activities to build the defense and security capacity of partner countries in Latin America and the Caribbean so as to enable such countries to defend themselves against conventional and unconventional threats, including cyberattacks.</text></paragraph><paragraph id="id704d84a162b246ff84d183714bbfed03"><enum>(3)</enum><text>Activities to counter—</text><subparagraph id="idA38CAE4060724A9DBE7A5B81F85B8F30"><enum>(A)</enum><text>malign influence by state actors; </text></subparagraph><subparagraph id="idA349FEEE7FA94B1D8CE6994B7353291B"><enum>(B)</enum><text>transnational criminal organizations with connections to—</text><clause id="id550dae6672ac49dfb92060ef5087fc11"><enum>(i)</enum><text>illicit trafficking of gold, narcotics, and weapons;</text></clause><clause id="id3552879a64d34d54ad948336b0a4d407"><enum>(ii)</enum><text>human trafficking and smuggling; and</text></clause><clause id="id00d8e5fa1d4441f5a1088e5324187503"><enum>(iii)</enum><text>terrorism; and </text></clause></subparagraph><subparagraph id="idAEDEA89E18F94CDFA3A6C6771D920518"><enum>(C)</enum><text>corruption and kleptocracy in governments of countries in the Western Hemisphere.</text></subparagraph></paragraph><paragraph id="id981477f1589241c78e9b3428c53b62a7"><enum>(4)</enum><text>Efforts to disrupt, degrade, and counter transnational illicit trafficking, with an emphasis on illicit narcotics and precursor chemicals that produce illicit narcotics.</text></paragraph><paragraph id="idb04a118e8afa43b1b103f61cbd43ac00"><enum>(5)</enum><text>Activities to increase transparency in, and support for, strong and accountable defense, security, and law enforcement institutions through institutional capacity-building efforts, including efforts to ensure respect for human rights and direction and oversight by civilian authorities.</text></paragraph><paragraph id="id319df86e5f1f484a85642b637df7e810"><enum>(6)</enum><text>Programs and initiatives to enhance public diplomacy and engagement with the people of the Western Hemisphere for the purpose of demonstrating that the security of their countries is enhanced to a greater extent if their countries are aligned with the United States and democratic values rather than with authoritarian countries such as the People’s Republic of China, the Russian Federation, and the Islamic Republic of Iran. </text></paragraph><paragraph id="id9655c713ccd44e46b1ceade103321d43"><enum>(7)</enum><text>Efforts to expand bilateral and multinational military training exercises with partner countries in the Western Hemisphere. </text></paragraph><paragraph id="id3b7195ffbfb34345bcdb5d148d237485"><enum>(8)</enum><text>Humanitarian assistance and disaster relief initiatives to support partner countries by promoting the development and growth of responsive institutions through activities such as—</text><subparagraph id="idc9f599e9752f41b9aba073018af4d1ef"><enum>(A)</enum><text>the provision of appropriate equipment, training, and logistical support;</text></subparagraph><subparagraph id="idbbdb17fc0e3349188ba52145ebc3627d"><enum>(B)</enum><text>transportation of humanitarian supplies or personnel of foreign security forces;</text></subparagraph><subparagraph id="id49d1e755fedb47bbb64a0119271b7451"><enum>(C)</enum><text>making available, preparing, and transferring on-hand nonlethal supplies, and providing training on the use of such supplies, for humanitarian or health purposes to respond to unforeseen emergencies;</text></subparagraph><subparagraph id="ida36cf65a421841db81526de3c457457e"><enum>(D)</enum><text>the provision of Department of State humanitarian demining assistance; and</text></subparagraph><subparagraph id="id440d390c202f4c70afab6df1ec2c48c0"><enum>(E)</enum><text>conducting medical support operations and medical humanitarian missions, such as hospital ship deployments and base-operating services, to the extent required by the operation.</text></subparagraph></paragraph><paragraph id="idb526e33fa72c4b95be82218855dfbfdf"><enum>(9)</enum><text>Continued support for the women, peace, and security initiatives of the Department of State to support the capacity of partner countries in the Western Hemisphere—</text><subparagraph id="id4bf5cb87f65444039ec67e214f5365cc"><enum>(A)</enum><text>to ensure—</text><clause id="idC521C263AFF94FA4BE5C851AFA0A208C"><enum>(i)</enum><text>the safety and security of women and girls; and</text></clause><clause id="idAA7D3438C2C64C6492903CBCBE99B368"><enum>(ii)</enum><text>that the rights of women and girls are protected; and</text></clause></subparagraph><subparagraph id="id8aad6d80e76b4630bcdf104c7acb93cd"><enum>(B)</enum><text>to promote the meaningful participation of women in—</text><clause commented="no" display-inline="no-display-inline" id="idf257bfd163eb41fb950ebcd1145d2f92"><enum>(i)</enum><text display-inline="yes-display-inline">the defense and security sectors; and</text></clause><clause id="id0f82015bfe71491d951309a36ac47bf9"><enum>(ii)</enum><text>mediation and negotiation processes seeking to prevent, mitigate, or resolve violent conflict, in accordance with the Women, Peace, and Security Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/68">Public Law 115–68</external-xref>; 131 Stat. 1202). </text></clause></subparagraph></paragraph><paragraph id="idf538082186d843a181631f2eae1d5d58"><enum>(10)</enum><text>Professional military education initiatives, such as the Department of State’s International Military and Education Training program.</text></paragraph><paragraph id="id87ce08cdca0b4df592eaaee53d15ce63"><enum>(11)</enum><text>A detailed assessment of the resources required to carry out such strategy and a plan to be executed not later than fiscal year 2024.</text></paragraph></subsection><subsection id="id8B6131F156DE4596B35BB2CAB5495AB9"><enum>(c)</enum><header>Implementation</header><paragraph id="idCB51404C2DF74518A900762DD3B75C8B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date on which the Western Hemisphere Security Strategy is submitted under subsection (a), the Secretary of State and the Secretary of Defense shall commence implementation of the strategy.</text></paragraph><paragraph id="id10648981D71A435CA483E6CD30C82D8C"><enum>(2)</enum><header>Briefing</header><text>Not later than 1 year after the date on which the implementation of the Western Hemisphere Security Strategy commences, and annually thereafter, the Secretary of State and the Secretary of Defense shall jointly provide a briefing to the appropriate committees of Congress on the implementation of the strategy.</text></paragraph><paragraph id="idE7D04CDFA0C24FB7B99AD4C47AE89344"><enum>(3)</enum><header>Termination</header><text>The authority under this section shall terminate on the date that is three years after the date of the enactment of this Act. </text></paragraph></subsection><subsection id="idf600052720c64239a7e8a6af29978404"><enum>(d)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="idb60683e8b6bb47ffb9b8ab499ca51b89"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Armed Services of the Senate; and</text></paragraph><paragraph id="iddc83afd4c39b4917ade0463cd023f971" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Armed Services of the House of Representatives.</text></paragraph></subsection></section><section id="idac55b70c3f8d4889b817e5be8a560e5c"><enum>4.</enum><header>Report on efforts to capture and detain United States citizens as hostages</header><subsection id="id9762c4914be640298972862577344bec"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on efforts by the Maduro regime of Venezuela to detain United States citizens and lawful permanent residents.</text></subsection><subsection id="id40eb21e3958844c8944b3e9e1280300f"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include, regarding the arrest, capture, detainment, and imprisonment of United States citizens and lawful permanent residents—</text><paragraph id="id6f76bf2175a94c38a7d88909b7d8b424"><enum>(1)</enum><text>the names, positions, and institutional affiliation of Venezuelan individuals, or those acting on their behalf, who have engaged in such activities;</text></paragraph><paragraph id="idae83246da0a846c9b9f8401e9940fb61"><enum>(2)</enum><text>a description of any role played by transnational criminal organizations, and an identification of such organizations; and</text></paragraph><paragraph id="id05b010888bb745b98a2cfb2f2844e8dc"><enum>(3)</enum><text>where relevant, an assessment of whether and how United States citizens and lawful permanent residents have been lured to Venezuela.</text></paragraph></subsection><subsection id="id36e2cfc086894ee38775e2fb4472efcd"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but shall include a classified annex, which shall include a list of the total number of United States citizens and lawful permanent residents detained or imprisoned in Venezuela as of the date on which the report is submitted. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="ida689e7deba5442458be3fdb9e3d45802"><enum>5.</enum><header>Technical assistance</header><text display-inline="no-display-inline">The Secretary of State, in coordination with the Secretary of the Treasury, the Attorney General, the United States Trade Representative, and the Chief Executive Officer of the Development Finance Corporation, shall provide technical assistance to partner countries in the Western Hemisphere to establish frameworks or mechanisms, similar to the frameworks set forth in section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>), for the purpose of enabling such partner countries to screen, review, and address the long-term financial sustainability and national security implications of investments in strategic sectors or services, including energy, telecommunications, and infrastructure, by entities controlled or directed by the governments of adversarial countries, including—</text><paragraph id="idf9d1117e28814a7d946d54cf3c3003c2"><enum>(1)</enum><text>the People’s Republic of China;</text></paragraph><paragraph id="id52e8484445d64491b344d17ca39a24f7"><enum>(2)</enum><text>the Russian Federation;</text></paragraph><paragraph id="iddc9f37df637a4a5ba3cf2bd5f739902d"><enum>(3)</enum><text>the Islamic Republic of Iran;</text></paragraph><paragraph id="idb91e7ba33cfd4596bd76dc909fbbc94d"><enum>(4)</enum><text>the Democratic People’s Republic of Korea; and</text></paragraph><paragraph id="idac2b0c75806d4360a996f9fb8f05d56e" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>any other country the Secretary of State determines to be adversarial to the national security interests of the United States. </text></paragraph></section></legis-body></bill>
