which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to permit retired members of the uniformed services who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs for their disability and either retired pay by reason of their years of military service or Combat-Related Special Compensation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Retired Pay Restoration Act</short-title></quote>.</text></section><section id="HD91CC545B2754B1C8FEF38E0D0D89D9F"><enum>2.</enum><header>Eligibility for payment of both retired pay and veterans’ disability compensation for military retirees with compensable service-connected disabilities</header><subsection id="H1BEB925D44454C7AB6E4947CF08401C"><enum>(a)</enum><header>In general</header><text>Subsection (a) of 1414 of title 10, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1abeb9129d19423e95f7744bc37e3bea"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Subject to subsection (b)</quote> and all that follows through <quote>paid both for that month</quote> and inserting <quote>A qualified retiree is entitled to be paid both retired pay and veterans’ disability compensation for a month</quote>; and</text></paragraph><paragraph id="HBA0EF1F19F6340C2B08B4E59BF48DBEC"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HFBFA39440EC8471B9181FF00EF5E6591"><paragraph id="H70243EB208A34141A4BFEC749521A1F" indent="down1"><enum>(2)</enum><header>Qualified retirees</header><text>For purposes of this section, a qualified retiree, with respect to any month, is a member or former member of the uniformed services who—</text><subparagraph id="HD066CAA09E8347CEA36EC2829E1B6A5"><enum>(A)</enum><text>is entitled to retired pay (other than by reason of section 12731b of this title); and</text></subparagraph><subparagraph id="HB70B92E4DB274A31B545075800F08E00"><enum>(B)</enum><text>is also entitled for that month to veterans’ disability compensation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEE14E391D1E041A6005C782FBB5F8506" commented="no"><enum>(b)</enum><header>Repeal of reduction in retired pay</header><text>Such section is further amended by striking subsection (b).</text></subsection><subsection id="H77C4FFB70E344452A33BCB4152CE3514"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph id="id77339235AC114E029418E50D89958F69"><enum>(1)</enum><header>Amendments reflecting end of concurrent receipt phase-in period</header><text display-inline="yes-display-inline">Such section is further amended—</text><subparagraph id="id270784952ED643B3BFE80AE6CCA30344"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>During the period</quote> and all that follows through <quote>unemployability.</quote>;</text></subparagraph><subparagraph id="id493555FB85A143F8B515E93466580CFE"><enum>(B)</enum><text>by striking subsection (c); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id183efeab0c6d4c2f8c1906aa303108d5"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) and (e) as subsections (b) and (c), respectively; and</text></subparagraph><subparagraph id="id469B80E9CD054189895604AFF25E5127" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>in subsection (c), as so redesignated, by striking paragraphs (3) and (4).</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H419A1609DD6F401C8EB89F43968F7990"><enum>(2)</enum><header>Section heading</header><text>The heading of such section is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7D3F4A4A5AF0464787AA2D9E49518271"><section id="H971BAF5751824ABA9F776FC54F12964C"><enum>1414.</enum><header>Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent payment of retired pay and disability compensation</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFD49F80CF5E046FFB6805DAC701EB3D7"><enum>(3)</enum><header>Table of sections</header><text>The item relating to such section in the table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/71">chapter 71</external-xref> of title 10, United States Code, is amended to read as follows:</text><quoted-block style="OLC" id="HCEB1CC3F5AE1401B8248C4DE711831AA"><toc regeneration="no-regeneration"><toc-entry level="section">1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent payment of retired pay and disability compensation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idEF6F718663F64300AC9D360B3F541423"><enum>(4)</enum><header>Conforming amendment</header><text>Section 1413a(f) of such title is amended by striking <quote>Subsection (d)</quote> and inserting <quote>Subsection (b)</quote>.</text></paragraph></subsection><subsection id="HD72CA8FFEAC94050918E8C0747C04CBD" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2024, and shall apply to payments for months beginning on or after that date. </text></subsection></section></legis-body></bill>
