which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide grants to State, local, territorial, and Tribal law enforcement agencies to purchase chemical screening devices and train personnel to use chemical screening devices in order to enhance law enforcement efficiency and protect law enforcement officers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Officers With Electronic Resources Act</short-title></quote> or the <quote><short-title>POWER Act</short-title></quote>.</text></section><section id="idA2CBB8A69E9144AB87706E86E5AF7AF6"><enum>2.</enum><header>Findings; purpose</header><subsection id="idCADF287DFE2043D6BE9A1CCA1ECFC009"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="id7B285DCB5FD443458A1F0BF1725370BD"><enum>(1)</enum><text>chemical screening devices enhance the ability of law enforcement agencies to identify unknown chemical substances seized or otherwise encountered by law enforcement officers; and</text></paragraph><paragraph id="id9E056048AF5E451592683EB55565CEE7"><enum>(2)</enum><text>equipping law enforcement agencies with technology that can more efficiently identify substances, such as heroin, fentanyl, methamphetamine, and other narcotics, will ensure that law enforcement agencies can—</text><subparagraph id="id37E3FC30AA34478C95B4EDA84702BCCE"><enum>(A)</enum><text>investigate cases more quickly and safely;</text></subparagraph><subparagraph id="id6F14CC1DF6B649CE8E3C770C30E7DEC8"><enum>(B)</enum><text>better deploy resources and strategies to prevent illegal substances from entering and harming communities throughout the United States; and</text></subparagraph><subparagraph id="id98BFCCB99E1B467FB92E7951F8FB3345"><enum>(C)</enum><text>share spectral data with other law enforcement agencies and State and local fusion centers.</text></subparagraph></paragraph></subsection><subsection id="idE8347D120F9A4B03B74EC39116A85EAD"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to provide grants to State, local, territorial, and Tribal law enforcement agencies to purchase chemical screening devices and train personnel to use chemical screening devices in order to—</text><paragraph id="id1DCDFD4DD12B47C8BC5CE3EC1E15E188"><enum>(1)</enum><text>enhance law enforcement efficiency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD66CCB70314A4589AFF07890B520FFCD"><enum>(2)</enum><text>protect law enforcement officers.</text></paragraph></subsection></section><section id="id4A38B2965C0244BBBE2B2E27C4B1F854"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id26e153aeb6bc4e838da563ddea1e9b8e"><enum>(1)</enum><header>Applicant</header><text>The term <term>applicant</term> means a law enforcement agency that applies for a grant under section 4.</text></paragraph><paragraph id="id78BCDEF2980A44D39455E5A859F07152"><enum>(2)</enum><header>Attorney General</header><text>The term <term>Attorney General</term> means the Attorney General, acting through the Director of the Office of Community Oriented Policing Services.</text></paragraph><paragraph id="id9FD7DC9DE91644F1B0E8954747EE2F6C"><enum>(3)</enum><header>Chemical screening device</header><text>The term <term>chemical screening device</term> means an infrared spectrophotometer, mass spectrometer, nuclear magnetic resonance spectrometer, Raman spectrophotometer, ion mobility spectrometer, or any other scientific instrumentation that is able to collect data that can be interpreted to determine the presence and identity of a covered substance.</text></paragraph><paragraph id="id77123cf89b3b4d12be4a0a6aa085538f"><enum>(4)</enum><header>Chief law enforcement officer</header><text>The term <term>chief law enforcement officer</term> has the meaning given the term in section 922(s) of title 18, United States Code.</text></paragraph><paragraph id="id3DA01715FB014F2182C24482CA1DA840"><enum>(5)</enum><header>Covered substance</header><text>The term <term>covered substance</term> means—</text><subparagraph id="idB5D140477B4543ACB534D16B77D26943"><enum>(A)</enum><text>fentanyl;</text></subparagraph><subparagraph id="id16FE698507A6450A9DEFEA049A331D43"><enum>(B)</enum><text>any other synthetic opioid; and</text></subparagraph><subparagraph id="idAD01DBFC40344E399BF3C23F4C5CA4A6"><enum>(C)</enum><text>any other narcotic or psychoactive substance.</text></subparagraph></paragraph><paragraph id="idFB202AF98B73401EB0413C072AC2AA13"><enum>(6)</enum><header>Grant funds</header><text>The term <term>grant funds</term> means funds from a grant awarded under section 4.</text></paragraph><paragraph id="id8AB36EF297A14F71AA03574DDE124839"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id154305B198944C849CA11D084E5F091E"><enum>(8)</enum><header>Law enforcement agency</header><text>The term <term>law enforcement agency</term> means an agency of a State, unit of local government, or Indian Tribe that is authorized by law or by a government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text></paragraph><paragraph id="idD11C813D309241CAB8CFA675D586CFB0"><enum>(9)</enum><header>Personnel</header><text>The term <term>personnel</term>—</text><subparagraph id="idF42C8C5AFA3A4A39AB30BD31257DB533"><enum>(A)</enum><text>means employees of a law enforcement agency; and</text></subparagraph><subparagraph id="idB9EC034EA5F244FCAA0F072E6DBDF328"><enum>(B)</enum><text>includes scientists and law enforcement officers.</text></subparagraph></paragraph><paragraph id="idDD7761AB2F2B4E6D90FA2C707F9E95DD"><enum>(10)</enum><header>Recipient</header><text>The term <term>recipient</term> means an applicant that receives a grant under section 4.</text></paragraph><paragraph id="idD6A4308761984253BFB3B6F79092C7EF"><enum>(11)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph></section><section id="idF5BDBA965C72475183402D264FBA2EDB"><enum>4.</enum><header>Grants</header><subsection id="id01299DB14AFE42958A74618D0EE8CDE3"><enum>(a)</enum><header>Grants authorized</header><text>The Attorney General may award grants to applicants to—</text><paragraph id="iddbff54f2742e4aa1bf3b916bc0313baf"><enum>(1)</enum><text>purchase a chemical screening device; and</text></paragraph><paragraph id="id93c4f5ccd9fb4e1c83c238d7bc0eaecb"><enum>(2)</enum><text>train personnel to use, and interpret data collected by, a chemical screening device.</text></paragraph></subsection><subsection id="id76C7E3DA6825463490E1AC79CDD5A178"><enum>(b)</enum><header>Applications</header><paragraph id="id6649F787BA214F36A60FA0AF80B9F59F"><enum>(1)</enum><header>In general</header><text>The chief law enforcement officer of an applicant shall submit to the Attorney General an application that—</text><subparagraph id="id71E7224947E849D2B7C1FC1C9B96EFAC"><enum>(A)</enum><text>shall include—</text><clause id="id44569B50AD0542A8BF531E47979C68B3"><enum>(i)</enum><text>a statement describing the need for a chemical screening device in the jurisdiction of the applicant; and</text></clause><clause id="idb6b39fd961244dc4bf0987804c63db05"><enum>(ii)</enum><text>a certification—</text><subclause id="id287D9658F41F4B6182B3C7EEFB9A2B89"><enum>(I)</enum><text>of the number of chemical screening devices the applicant owns or possesses;</text></subclause><subclause id="id63c53c5b9a0048a0ac2c643cf38a5246"><enum>(II)</enum><text>that not less than 1 employee of the applicant will be trained to—</text><item id="id784FE58E817143EDA8E82F31651C335F"><enum>(aa)</enum><text>use any chemical screening device purchased using grant funds; and</text></item><item id="idFC7E8A60148C4EAE8F6882813759B4BD"><enum>(bb)</enum><text>interpret data collected by any chemical screening device purchased using grant funds; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ideb9d5394b2fa42609a845292477b2e6c"><enum>(III)</enum><text>that the applicant will make any chemical screening device purchased using grant funds reasonably available to test a covered substance seized by a law enforcement agency near the jurisdiction of the applicant; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB21E4A9D866D4F0F84A273DE9AC5DBA6"><enum>(B)</enum><text>in addition to the information required under subparagraph (A), may, at the option of the applicant, include—</text><clause id="id01ac9f1a09e64d3ba1850e517dd23703"><enum>(i)</enum><text>information relating to—</text><subclause id="idCCAEED19367D4BDFA08261ED1C5883C8"><enum>(I)</enum><text>the process used by the applicant to identify a covered substance seized by the applicant, including—</text><item id="id6BB4C6546A6449AF8B301C1E02F8B342"><enum>(aa)</enum><text>the approximate average amount of time required for the applicant to identify a covered substance; and</text></item><item id="id05945E3127C24B63A7BA1D6AA99F9E7F"><enum>(bb)</enum><text>as of the date of the application, the number of cases in which the applicant is awaiting identification of a covered substance;</text></item></subclause><subclause id="id54E69FA418C94734B998DBA991E365E4"><enum>(II)</enum><text>any documented case of a law enforcement officer, first responder, or treating medical personnel in the jurisdiction of the applicant who has suffered an accidental drug overdose caused by exposure to a covered substance while in the line of duty;</text></subclause><subclause id="idAEE00E232DBC4B47BC66BCA54DE8848B"><enum>(III)</enum><text>any chemical screening device the applicant will purchase using grant funds, including the estimated cost of the chemical screening device; and</text></subclause><subclause id="idA6BB328ED4E14CADBB040D8910CAD5A7"><enum>(IV)</enum><text>any estimated costs relating to training personnel of the applicant to use a chemical screening device purchased using grant funds; and</text></subclause></clause><clause id="id65982F08E9094E099FCE8B440E1FE913"><enum>(ii)</enum><text>data relating to—</text><subclause id="id60D33B828AC74F3CA4B94578FE748407"><enum>(I)</enum><text>the approximate amount of covered substances seized by the applicant during the 2-year period ending on the date of the application, categorized by the type of covered substance seized; and</text></subclause><subclause id="idd992879899194e6fa8c2f97757f7d130"><enum>(II)</enum><text>the approximate number of covered substance overdoses in the jurisdiction of the applicant that the applicant investigated or responded to during the 2-year period ending on the date of the application, categorized by fatal and nonfatal over­doses.</text></subclause></clause></subparagraph></paragraph><paragraph id="id81E31E273BA54D31821CD24366D0FA85"><enum>(2)</enum><header>Joint applications</header><subparagraph id="id0CE0E8FDC8B2408DBEF4FFE380B828C1"><enum>(A)</enum><header>In general</header><text>Two or more law enforcement agencies, including law enforcement agencies located in different States, that have jurisdiction over areas that are geographically contiguous may submit a joint application for a grant under this section that includes—</text><clause id="id586212b1cea0464891d339210626ad02"><enum>(i)</enum><text>for each law enforcement agency—</text><subclause id="idD8D8786D98AE4D3083676694663144B8"><enum>(I)</enum><text>all information required under paragraph (1)(A); and</text></subclause><subclause id="id4BF5DEFC86C14347A2670A41DA541384"><enum>(II)</enum><text>any optional information described in paragraph (1)(B) that each law enforcement agency chooses to include;</text></subclause></clause><clause id="id4f110ee736b1454fb727602abd9b6e67"><enum>(ii)</enum><text>a plan for the sharing of any chemical screening devices purchased or training provided using grant funds; and</text></clause><clause id="id6436ffacc23b4b6a8d707659288150f6"><enum>(iii)</enum><text>a certification that not less than 1 employee of each law enforcement agency will be trained to—</text><subclause id="idE476276F0CC942138901ABC6CD47EB03"><enum>(I)</enum><text>use any chemical screening device purchased using grant funds; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE02ACE3B07234A7EB615EBDB3EDE25CD"><enum>(II)</enum><text>interpret data collected by any chemical screening device purchased using grant funds.</text></subclause></clause></subparagraph><subparagraph id="idE4AE2421C6A041C794BB54525925D9EA"><enum>(B)</enum><header>Submission</header><text>Law enforcement agencies submitting a joint application under subparagraph (A) shall—</text><clause id="idB32EF4ED09CE4ECCB74050492C1FD3A1"><enum>(i)</enum><text>be considered as 1 applicant; and</text></clause><clause id="id07B3E45F60D249E9BA837856E7A75F8F"><enum>(ii)</enum><text>select the chief law enforcement officer of 1 of the law enforcement agencies to submit the joint application.</text></clause></subparagraph></paragraph></subsection><subsection id="id9871932EC0E240258334DFF7A48A343B"><enum>(c)</enum><header>Restrictions</header><paragraph id="idF3EE720A589547BF8368230D4A27DF21"><enum>(1)</enum><header>Supplemental funds</header><text>Grant funds shall be used to supplement, and not supplant, State, local, and Tribal funds made available to any applicant for any of the purposes described in subsection (a).</text></paragraph><paragraph id="id6E5D9D3B10664F348C63A7A51D5A5B74"><enum>(2)</enum><header>Administrative Costs</header><text>Not more than 3 percent of any grant awarded under this section may be used for administrative costs.</text></paragraph></subsection><subsection id="id50E3ED1DD1954F4BB3E08571FF9D02B4"><enum>(d)</enum><header>Reports and records</header><paragraph id="id36371D58E728466BBF5E6FEAE91BC6E4"><enum>(1)</enum><header>Reports</header><text>For each year during which grant funds are used, the recipient shall submit to the Attorney General a report containing—</text><subparagraph id="id6d623d0627924db2a2738eb1b1de815a"><enum>(A)</enum><text>a summary of any activity carried out using grant funds;</text></subparagraph><subparagraph id="id334882DB92C440148E9F876E65E07D81"><enum>(B)</enum><text>an assessment of whether each activity described in subparagraph (A) is meeting the need described in subsection (b)(1)(A)(i) that the applicant identified in the application submitted under subsection (b); and</text></subparagraph><subparagraph id="id9788bfd348504583bb631b867b7d862e"><enum>(C)</enum><text>any other information relevant to the purpose of this Act that the Attorney General may determine appropriate.</text></subparagraph></paragraph><paragraph id="id8C06DD43B04243319D2557AD170F3CA6"><enum>(2)</enum><header>Records</header><text>For the purpose of an audit by the Attorney General of the receipt and use of grant funds, a recipient shall—</text><subparagraph id="id635EF7BFBB0F49DC9BDA80835521E340"><enum>(A)</enum><text>keep—</text><clause id="id94E793042BAD49B18678D7EDDF572E95"><enum>(i)</enum><text>any record relating to the receipt and use of grant funds; and</text></clause><clause id="id86E2D42B8D07418DA889DACB1BAE80A6"><enum>(ii)</enum><text>any other record as the Attorney General may require; and</text></clause></subparagraph><subparagraph id="id069D54CC767F463DBC3C71FD647B200B"><enum>(B)</enum><text>make the records described in subparagraph (A) available to the Attorney General upon request by the Attorney General.</text></subparagraph></paragraph></subsection></section><section id="id11295FFC8B304FC195196634BBF1ED49"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Attorney General $20,000,000 for fiscal year 2023 to carry out section 4.</text></section></legis-body></bill>
