<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1504</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230509">May 9, 2023</action-date><action-desc><sponsor name-id="S374">Mr. Cotton</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure peace through strength in Israel by requiring a Department of Defense assessment of the quantity of precision-guided munitions and other munitions for use by Israel, and for other purposes.</official-title></form><legis-body><section id="idc48bdca4aa4846b1bcfa74c489b90c7c" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Peace Through Strength in Israel Act</short-title></quote>.</text></section><section id="idbfd9f4662fc147e6adfef0a14cc68346"><enum>2.</enum><header>Ensuring peace through strength in Israel</header><subsection commented="no" display-inline="no-display-inline" id="idcd147303cbc84261a6d82692a8a9aa4a"><enum>(a)</enum><header>Department of Defense assessment</header><text display-inline="yes-display-inline">Subsection (b) of section 1273 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; 132 Stat. 2066) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0575e6752f9140d0a8fdb7ab166465b1"><subsection id="id5463662f38e94fc283a0b226088c7129"><enum>(b)</enum><header>Department of Defense assessment of quantity of precision-Guided munitions and other munitions for use by Israel</header><paragraph id="id326310550c83487e8f149a1c781ac1f0"><enum>(1)</enum><header>In general</header><text>Not later than April 1, 2024, and annually thereafter through 2028, the Secretary of Defense shall conduct an assessment with respect to the following:</text><subparagraph id="idca16fbc8276a4320a38cff3fc2488dd3"><enum>(A)</enum><text>The quantity and type of precision-guided munitions necessary for Israel to protect Israel and prevail in the event of a sustained armed confrontation between Israel and the Islamic Republic of Iran and the proxy forces of the Islamic Republic of Iran, including Hezbollah and Hamas.</text></subparagraph><subparagraph id="ide4e130eb14f549fd80fb010dd9f8db50"><enum>(B)</enum><text>The quantity and type of other munitions necessary for Israel to protect Israel and prevail in the event of a sustained armed confrontation between Israel and the Islamic Republic of Iran and the proxy forces of the Islamic Republic of Iran, including Hezbollah and Hamas.</text></subparagraph><subparagraph id="idea0c3fb14e6c486286257ff39624e782"><enum>(C)</enum><text>The quantity and type of precision-guided munitions necessary for Israel to protect Israel and prevail in the event of a sustained armed confrontation between Israel and Hezbollah.</text></subparagraph><subparagraph id="id177e5346d2da4b4a903061d54034138a"><enum>(D)</enum><text>The quantity and type of precision-guided munitions necessary for Israel to protect Israel and prevail in the event of a sustained armed confrontation between Israel and any other armed group or terrorist organization, such as Hamas.</text></subparagraph><subparagraph id="idda6b41c2fa304fcaa8c22bf5001fd0b0"><enum>(E)</enum><text>The resources the Government of Israel would need to dedicate to acquire the quantity and type of munitions described in subparagraphs (A) through (D).</text></subparagraph><subparagraph id="id7c69dba6379d4a1c8146539a03997b3f"><enum>(F)</enum><text>Whether, as of the date on which the applicable joint assessment is completed, sufficient quantities and types of munitions to conduct operations described in subparagraphs (A) through (D) are present in—</text><clause id="ide3b3852c4f934a478acc7d0dbdf43810"><enum>(i)</enum><text>the inventory of the military forces of Israel;</text></clause><clause id="id7cb3979e8b144c3a8a76133ec19ac6ea"><enum>(ii)</enum><text>the War Reserves Stock Allies-Israel;</text></clause><clause id="idcc3edb0a59b2430aa0bbdaa6ae86a222"><enum>(iii)</enum><text>any other United States stockpile or depot within the area of responsibility of United States Central Command, as the Secretary of Defense considers appropriate to disclose to the Government of Israel; or</text></clause><clause id="id3b2a4c345c084e6381e24841e4387076"><enum>(iv)</enum><text>the inventory of the United States Armed Forces, as the Secretary of Defense considers appropriate to disclose to the Government of Israel.</text></clause></subparagraph><subparagraph id="id146830376f18482ca747d4764cd4317a"><enum>(G)</enum><text>United States planning—</text><clause commented="no" display-inline="no-display-inline" id="id644c3702b3b94761a206a0e4d295e47d"><enum>(i)</enum><text display-inline="yes-display-inline">to assist Israel to prepare for the contingencies described in subparagraphs (A) through (D); and </text></clause><clause commented="no" display-inline="no-display-inline" id="id5c04c951e91544c6b75d512e21d18de5"><enum>(ii)</enum><text display-inline="yes-display-inline">to resupply Israel with the quantity and type of munitions described in subparagraphs (A) through (D) in the event of such a contingency.</text></clause></subparagraph><subparagraph id="id60617d083d6342a8a399162b9e884f8e"><enum>(H)</enum><text>The quantity and pace at which the United States is capable of pre-positioning, rapidly replenishing, or assisting in the rapid replenishment of stockpiles of such munitions in the inventory of the military forces of Israel and the War Reserves Stock Allies-Israel in preparation for, and to conduct, the operations described in subparagraphs (A) through (D). </text></subparagraph></paragraph><paragraph id="id83d4a1382f3c40a6bc8938b9e6d0f4fe"><enum>(2)</enum><header>Consultation</header><text>In carrying out the assessment required by paragraph (1), the Secretary of Defense shall consult with the Government of Israel, provided that the Government of Israel agrees to be so consulted.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id8bee007fe0564815916a944980643385"><enum>(b)</enum><header>Report</header><text>Subsection (c) of such section is amended—</text><paragraph id="id176e68b80164450fab062a2781157b13"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Report</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Reports</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b16d7d25f994e5fbf6607adb7589381"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54c26c6b38624203ae07d1fe38d98068"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">In general</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Department of Defense assessment</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ec06bd1fe0d424087b40bd07423a5f6"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the President</quote> and inserting <quote>the Secretary of Defense</quote>;</text></subparagraph></paragraph><paragraph id="ide1abd56e467f4353b5a40aa09eb33a31"><enum>(3)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4); and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94a06dad8c874c3abb726d19b41f8030"><enum>(4)</enum><text>by inserting after paragraph (1) the following new paragraph (2):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F54E97C2A124203957FE2705E319A78"><paragraph id="idda9497e752d94100b2d7be55287e6a1c"><enum>(2)</enum><header>Inventory</header><text>Not later than 90 days after the date on which the report in paragraph (1) is submitted, and every 90 days thereafter through December 31, 2028, the Secretary of Defense shall submit to the appropriate congressional committees a report on the actions being taken and the progress made by the United States, since the date on which the preceding report under paragraph (1) was submitted, to pre-position and ensure that the inventory of the military forces of Israel and the War Reserves Stock Allies-Israel have sufficient quantities and types of munitions in preparation for, and to conduct, the operations described in subparagraphs (A) through (D) of subsection (b)(1), including procedures implemented by the United States for rapidly replenishing, or assisting in the rapid replenishment of, stockpiles of such munitions for use by Israel as may be necessary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
