Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that all Federal employees in the executive branch of the Federal Government are at-will employees, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAC366CA6D5084168B1570104A6496BDB"><section section-type="section-one" id="HDEB6D93DC4D3485BB2FEEFAA7651D017"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Service Reform Act</short-title></quote>.</text></section><section id="HF3428C6627E94BDCB33B4811C8465970"><enum>2.</enum><header>At-will employment for Federal executive branch employees</header><subsection id="H17A309EFCE5C461F829BF8126E694363"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HFB7CB5C16F944F829187B63A01F20513"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>adverse personnel action</term> means, with respect to an employee, a removal, a suspension for more than 14 days, a reduction in grade, a reduction in pay, or a furlough of 30 days or less; </text></paragraph><paragraph id="H5508DDBE269343EDA088D2EA4EB47EA8"><enum>(2)</enum><text>the term <term>career employee</term> means any employee who is not a political appointee;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93c147cb94e9406a94940679cefe0844"><enum>(3)</enum><text>the term <term>covered position</term> has the meaning given the term in section 2302(a)(2)(B) of title 5, United States Code;</text></paragraph><paragraph id="H22F611FBEBC143B19362F44F21F12EB3"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>employee</term>— </text><subparagraph commented="no" display-inline="no-display-inline" id="id3f8c8aa6ab4b4e0fa54fd6bf6f6d0190"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 2105 of title 5, United States Code; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4797b118d114989a36d8400becabb6d"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause id="HC80336ED8A07428BB4F2AF0CC4599785"><enum>(i)</enum><text>an officer or employee of the United States Postal Service or the Postal Regulatory Commission; and</text></clause><clause id="H4437926CCC5D49C5BA002B529C193287"><enum>(ii)</enum><text display-inline="yes-display-inline">notwithstanding subsection (b) of section 7425 of title 38, United States Code, any employee described in subsection (a) of such section 7425; and</text></clause></subparagraph></paragraph><paragraph id="H767FDEC9B9DE4855B68E290F8F8FD9B1"><enum>(5)</enum><text>the term <term>political appointee</term> means any employee who—</text><subparagraph id="H89BECAD324344E23A9306E8AE991AD44"><enum>(A)</enum><text>is appointed by the President;</text></subparagraph><subparagraph id="HE22722967A52439291AC4959E1CD7A22"><enum>(B)</enum><text display-inline="yes-display-inline">is a noncareer appointee (as that term is defined in section 3132(a)(7) of title 5, United States Code);</text></subparagraph><subparagraph id="HA6D7262E72934FE3B7BC5E7DCA62DFAB"><enum>(C)</enum><text display-inline="yes-display-inline">occupies a position under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any successor regulations; or</text></subparagraph><subparagraph id="H7DBD44F5D5C744C0A462A72EF57A8D33" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>occupies any other position in the civil service (as that term is defined in section 2101 of title 5, United States Code) that is classified as a political position after the date of enactment of this Act under regulations prescribed by the Director of the Office of Personnel Management.</text></subparagraph></paragraph></subsection><subsection id="H9142FE7623744101BE9045E2B4309A85"><enum>(b)</enum><header>At-Will employment</header><paragraph id="HFA292C271D4A4E509CEECD6E1183686B"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, rule, or regulation, and except as provided in paragraph (2), any employee in the executive branch of the Federal Government— </text><subparagraph commented="no" display-inline="no-display-inline" id="idd7d772a0a8364bffb1873d48aefe5f04"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered at-will;</text></subparagraph><subparagraph id="HEBA7F14575934FF7B4E728A8888D8AD9"><enum>(B)</enum><text>may be subject to any adverse personnel action (up to and including removal) for good cause, bad cause, or no cause at all; and</text></subparagraph><subparagraph id="HF2A132C7264B4688A650599809ED99BF"><enum>(C)</enum><text>may not challenge or otherwise appeal an action described in subparagraph (B), except as provided in subsections (c) and (g).</text></subparagraph></paragraph><paragraph id="H2CC3348FE5164FEE94FE756B287B509D"><enum>(2)</enum><header>Limitation</header><text>An employee may not be subject to any adverse personnel action under this Act for a reason that is prohibited under section 2302(b) of title 5, United States Code.</text></paragraph><paragraph id="H32DDE8FEC7BD409D8A756E4B15536D76"><enum>(3)</enum><header>Procedures</header><subparagraph commented="no" display-inline="no-display-inline" id="id27ab00cf16344323a4940ddb77bbef96"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The President shall establish procedures to enforce compliance with paragraph (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaecc91e572b749a2bcc2d03a509edc78"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to grant an employee the right to review or appeal an adverse personnel action outside of the procedures described in subparagraph (A), subsection (g), or subsection (h), as applicable.</text></subparagraph></paragraph></subsection><subsection id="HA31082FC06E9496DB096CEA1E3516A55"><enum>(c)</enum><header>Removal of career employees</header><text display-inline="yes-display-inline">With respect to the removal of a career employee, the following procedures shall apply:</text><paragraph id="H0DE4E39CD1BB448C87214D5ABB51656C"><enum>(1)</enum><text>Before the applicable agency removes the career employee— </text><subparagraph commented="no" display-inline="no-display-inline" id="idaff463251dca4131b34c6e64007f9723"><enum>(A)</enum><text display-inline="yes-display-inline">the agency official authorized to propose such action (referred to in this subsection as the <quote>proposing official</quote>) shall provide the career employee with written notification of the proposed removal and the reasons for the proposed removal; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1fb78d4a2c745eda47a7c7089a5a512"><enum>(B)</enum><text display-inline="yes-display-inline">the career employee shall have 14 days to provide a written response to the notification received under subparagraph (A), except that the head of the applicable agency shall have sole and exclusive discretion to alter that response period on a case-by-case basis.</text></subparagraph></paragraph><paragraph id="H626553082186410F9E40F788526735E6"><enum>(2)</enum><text>Under procedures prescribed by the applicable agency head, in the sole and exclusive discretion of the agency head, an agency official (who, except when the proposing official is the agency head, shall be an agency official other than the proposing official) (referred to in this subsection as the <quote>deciding official</quote>)— </text><subparagraph commented="no" display-inline="no-display-inline" id="id0fef160107b746ccacbd8b3318fcbc3c"><enum>(A)</enum><text display-inline="yes-display-inline">shall review the proposed removal and the response of the career employee under paragraph (1); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id809cb0195a364c4b8258b8935a8a2d5c"><enum>(B)</enum><text display-inline="yes-display-inline">may, in the sole and exclusive discretion of the deciding official, conduct a hearing on the matter; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90ee098dd1d946f99f6f0440ba406728"><enum>(C)</enum><text display-inline="yes-display-inline">after the review conducted under subparagraph (A), and any hearing conducted under subparagraph (B), shall decide whether to remove or retain the career employee.</text></subparagraph></paragraph><paragraph id="H0426E29783DD4296BB217CB5A57AFB76"><enum>(3)</enum><text>The determination of a deciding official under paragraph (2) shall be the final decision of the applicable agency with respect to the career employee, unless, not later than 7 days after the date on which the deciding official makes that determination, the agency head reverses the determination of the deciding official, in which case the decision of the agency head shall be the final agency decision.</text></paragraph><paragraph id="H0560361DEA1649ABA3A4986092D12622"><enum>(4)</enum><text display-inline="yes-display-inline">The final decision of an agency under paragraph (3) shall be final and not subject to any appeal or challenge, except that the President may overrule that final decision of the agency in accordance with such procedures or regulations as the President may prescribe.</text></paragraph></subsection><subsection id="H63F494C874E34D5283AAB61841A6E47B"><enum>(d)</enum><header>Application</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">Chapter 43</external-xref> of title 5, United States Code, shall not apply to any personnel action taken with respect to an employee under this Act.</text></subsection><subsection id="H4184AB312E0C43E5B3286A5D703833DD"><enum>(e)</enum><header>Abolishment of MSPB</header><paragraph commented="no" display-inline="no-display-inline" id="id535b8ca3f54f481dbe664281992e0195"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Effective on the date of enactment of this Act, the Merit Systems Protection Board (referred to in this subsection as the <quote>Board</quote>) is hereby abolished. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9efc07ee8b7e4afca390f13002255d2d"><enum>(2)</enum><header>Disposal of assets, obligations, and liabilities</header><text display-inline="yes-display-inline">The Chairman of the Board may take such actions as are necessary to dispose of the assets, obligations, and liabilities of the Board.</text></paragraph></subsection><subsection id="H9E3944896AB74BBC9979A9FE24DE64E0"><enum>(f)</enum><header>Technical and conforming amendments</header><paragraph id="HA4AC7BA864284F2D8E38845DFC32A39E"><enum>(1)</enum><header>Repeal</header><text>The following provisions of title 5, United States Code, are hereby repealed:</text><subparagraph id="HF1F37D2FA0AC4D4CA321AD8D319B1331"><enum>(A)</enum><text>Subchapter I of chapter 12.</text></subparagraph><subparagraph id="HC4A62B1E389849D385BBCCA9D3AD4011"><enum>(B)</enum><text display-inline="yes-display-inline">Section 1212(c).</text></subparagraph><subparagraph id="H99B5EFF6A48645DA9AB80283ACE50B2D"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to section 1214, the following provisions:</text><clause commented="no" display-inline="no-display-inline" id="idafaca67c453f4529b001d7242ce97a61"><enum>(i)</enum><text display-inline="yes-display-inline">Subsection (b)(1). </text></clause><clause commented="no" display-inline="no-display-inline" id="id74779dbcaab14d5eb9307263ccced9f6"><enum>(ii)</enum><text display-inline="yes-display-inline">Subparagraphs (B) through (D) of subsection (b)(2). </text></clause><clause commented="no" display-inline="no-display-inline" id="id17ce384bda21490f960eaeae3cd61884"><enum>(iii)</enum><text display-inline="yes-display-inline">Paragraphs (3) and (4) of subsection (b). </text></clause><clause commented="no" display-inline="no-display-inline" id="id70ff7cd3c26e41e0b1a89c7b83546b20"><enum>(iv)</enum><text display-inline="yes-display-inline">Subsections (c), (g), and (i).</text></clause></subparagraph><subparagraph id="HD4FB81B511644EC6B8E91AB8AA9D776C"><enum>(D)</enum><text>Sections 1215 and 1221.</text></subparagraph><subparagraph id="H1020CDD52A07410790B9DF7C29BE5BC8"><enum>(E)</enum><text>Section 4303.</text></subparagraph><subparagraph id="H7BD481A9027446DBAA357793809922ED"><enum>(F)</enum><text>Chapter 75.</text></subparagraph><subparagraph id="H48C85E86F19743E587B2665E43CB76ED"><enum>(G)</enum><text>Chapter 77. </text></subparagraph></paragraph><paragraph id="HBAC22E1CCBB24349BD4EE9607BE12637"><enum>(2)</enum><header>Other amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">Chapter 71</external-xref> of title 5, United States Code, is amended—</text><subparagraph id="H9F36D24D78E547098626FEB96B797922"><enum>(A)</enum><text>in section 7103(a)(14)— </text><clause commented="no" display-inline="no-display-inline" id="id6f7b364ae7474817b34fb48473df1474"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idc38cdd257def471abb62997da9a8b9b5"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (A) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H79949569332E49ACA8DF5769252BACB7"><subparagraph id="HDD5A9118EFAE49528AD5F25229FA1D2B"><enum>(B)</enum><text display-inline="yes-display-inline">relating to adverse personnel actions, as provided by the <short-title>Public Service Reform Act</short-title>;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA122CBCDBE61472987A7FB7E76011C04"><enum>(B)</enum><text>in section 7121(c), by amending paragraph (3) to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H8BFD71DC952545F2A0EA225175058359"><paragraph id="HE55966773D4D40E893CE13BB47D4E298"><enum>(3)</enum><text display-inline="yes-display-inline">any adverse personnel action under the <short-title>Public Service Reform Act</short-title>;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HF797CFB324C04E67AD71E4AE083288FE"><enum>(g)</enum><header>Whistleblower protections</header><paragraph id="H3115FB40AF78411EA88B19A10DF89E92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">During the period described in subsection (c)(1)(B), the Office of Special Counsel may make a recommendation to the applicable agency head or deciding official (as described in subsection (c)(2)) regarding whether an adverse personnel action proposed against an individual was in retaliation for making a disclosure described in section 2302(b)(8) of title 5, United States Code.</text></paragraph><paragraph id="H1A73EA44C729415F841EBA0D7F341639"><enum>(2)</enum><header>Appeal</header><subparagraph commented="no" display-inline="no-display-inline" id="iddeff5e5907644020af14d29a38224d9b"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An individual in a covered position who is subject to an adverse personnel action and who claims that action was taken for a reason prohibited under paragraph (8) or (9) of section 2302(b) of title 5, United States Code, may appeal that action to the United States court of appeals in the circuit in which the duty station of the individual is located.</text></subparagraph><subparagraph id="H28596662A97248E38A8ADDC21A881E9F"><enum>(B)</enum><header>Decision</header><clause id="HA6064B951BDB45168644F298D6C84CF0"><enum>(i)</enum><header>Frivolous or bad faith appeal</header><text display-inline="yes-display-inline">If the court, in an appeal brought by an individual under subparagraph (A), finds that the appeal is brought in bad faith or is frivolous, the annuity of the individual under chapter 83 or 84 of title 5, United States Code, shall be reduced by 25 percent.</text></clause><clause id="HF3D39CB841884CEDA75D1B2804CA4738"><enum>(ii)</enum><header>Successful appeal</header><text>If an individual prevails in an appeal brought under subparagraph (A), the individual shall—</text><subclause id="H9DA1213E7D1F404A904F15057F1B87A9"><enum>(I)</enum><text display-inline="yes-display-inline">be placed, as nearly as possible, in the position the individual would have been in had the adverse personnel action not been taken against the individual; and</text></subclause><subclause id="H7A3248B416B045A293A9323E6EE373FE"><enum>(II)</enum><text display-inline="yes-display-inline">be reimbursed for— </text><item commented="no" display-inline="no-display-inline" id="ida4b33d3fa7914d858dbbac53613b626b"><enum>(aa)</enum><text display-inline="yes-display-inline">attorney fees, back pay, and related benefits in accordance with section 5596 of title 5, United States Code; and </text></item><item commented="no" display-inline="no-display-inline" id="idd711269768ed4d31a7d71971d5e25440"><enum>(bb)</enum><text display-inline="yes-display-inline">medical costs incurred, travel expenses, any other reasonable and foreseeable consequential damages, and compensatory damages (including interest, reasonable expert witness fees, and costs).</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="H7EF87E9FCA614D299CAFC6A71CC013A7"><enum>(h)</enum><header>EEOC appeals</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>), an individual who is an employee (or an applicant for a position as an employee) and who alleges that the individual was subject to an adverse personnel action that is a prohibited personnel action described in section 2302(b)(1) of title 5, United States Code, shall seek relief for that action from the Equal Employment Opportunity Commission as if that individual were an employee of an employer, as that term is defined in section 701 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref>).</text></subsection></section></legis-body></bill>
