which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the purchase of certain telecommunications or aerospace goods or service from entities affiliated with the People's Republic of China or the Russian Federation and to require reporting relating to investment by foreign persons in the aerospace industry in the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Protection of American Command and Enterprise Act </short-title></quote> or the <quote><short-title>SPACE Act</short-title></quote>.</text></section><section id="idA882C07D5D284D4CB82816E5BE801EFB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id5051cc4fabfa4f458ec6e85be5beb704"><enum>(1)</enum><header>Certain telecommunications and aerospace goods or service</header><text>The term <term>certain telecommunications and aerospace goods or service</term> means any equipment, hardware or software, and services designed specifically to be used in—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcc5e83b130a64bbb9ffa547f7853a2ce"><enum>(A)</enum><text display-inline="yes-display-inline">offering telecommunications, as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>); or</text></subparagraph><subparagraph id="id790414387af64fd69a6d9d8017db7ec6"><enum>(B)</enum><text>the design, development, and making of aircraft, spacecraft, and rockets.</text></subparagraph></paragraph><paragraph id="id5A682FE758514B7A98E3867933A9C010"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means an entity—</text><subparagraph id="idB35EE0F3EB7249C6A7124BABEBBF2BA1"><enum>(A)</enum><text>that is a United States business; and</text></subparagraph><subparagraph id="id011E234AE7BF460897BEE3F2552670ED"><enum>(B)</enum><text>the business of which relates to exploration, manufacturing, telecommunications, or national security activities involving space.</text></subparagraph></paragraph><paragraph id="id65E994681CD14EEBBDC1C082057B8C34"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text></paragraph><paragraph id="id08fbb4f9f6bd45fe9f200a6a13d09c82"><enum>(4)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id2dd35ac1aa9d42e9bcb1e4ad0ed30b8b"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted to the United States for permanent residence; and</text></subparagraph><subparagraph id="id8b348bff12f44bf7a72659943b66acf8"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States (including any foreign branch of such an entity).</text></subparagraph></paragraph></section><section id="id9B43DFF53615448D884A3D3CF8C3A175"><enum>3.</enum><header>Report on space investment competition from the People's Republic of China and the Russian Federation</header><subsection id="idFD0A6FD1F84D4096B19F32135DF71D74"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the National Space Council shall submit to Congress a report on space investment competition from the People's Republic of China and the Russian Federation.</text></subsection><subsection id="idFF3F4F62F4114C8EB31AF5886D2772C5"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="idD12F4EF1B7A9440A801772896E3C833E"><enum>(1)</enum><text>A description of commercial investment activities used by the People's Republic of China and the Russian Federation to produce technologies and devices for space activities and programs, including—</text><subparagraph id="idC22FB5BB535F4B2FA3DCA35B06D7A56A"><enum>(A)</enum><text>launch vehicles and technologies; </text></subparagraph><subparagraph id="idD7BC354C9C1B4223985DAFF91F1DFED3"><enum>(B)</enum><text>satellites and telecommunications equipment and services; </text></subparagraph><subparagraph id="id8A88C5AD88744C278C65519261659701"><enum>(C)</enum><text>manned spaceships, cargo spaceships, deep space explorers, and space stations; </text></subparagraph><subparagraph id="idA5E82D7D4CF64143B29BC1B1C87DDBFD"><enum>(D)</enum><text>nuclear missiles, conventional ground-to-ground missiles, and air and missile defense equipment; </text></subparagraph><subparagraph id="idC9CB265F304C49BF942728C9305FC2A2"><enum>(E)</enum><text>space and zero-gravity manufacturing; </text></subparagraph><subparagraph id="id02A00956987746BC923C4480EBDBE0AA"><enum>(F)</enum><text>space-based precious minerals excavation and exploration technologies; </text></subparagraph><subparagraph id="idEAE76C82186F4050B30B93221E076086"><enum>(G)</enum><text>space-based solar power technologies; and </text></subparagraph><subparagraph id="idAB84274680614DFEAFBB7790616AB24A"><enum>(H)</enum><text>any other critical technologies and investment activities as determined by the National Space Council, particularly activities conducted by— </text><clause id="id50F5CD201AF94D53B7613A1486824275"><enum>(i)</enum><text>China Aerospace Science and Industry Corporation Limited; </text></clause><clause id="idEFFC92EB33194DFAA494C82C918E01D7"><enum>(ii)</enum><text>China Aerospace Science and Technology Corporation; </text></clause><clause id="id0117ADD2F3964811A71A5B1441A10F41"><enum>(iii)</enum><text>the China National Space Administration; </text></clause><clause id="idDD3EB9CA00514D7A8785EBBEC1EEEAAA"><enum>(iv)</enum><text>the BeiDou Satellite Navigation Experimental System; </text></clause><clause id="id431E56DF65234C36B0B4AC8A5498558A"><enum>(v)</enum><text>the Government of the People's Republic of China; or </text></clause><clause id="id989A8DCF09EA422DBBA018F542369ABE"><enum>(vi)</enum><text>the People’s Liberation Army.</text></clause></subparagraph></paragraph><paragraph id="idE817568D393F42A2B8F5DC7CF1675D5D"><enum>(2)</enum><text>An assessment of military-civil fusion activities in the People's Republic of China and the Russian Federation regarding space-related investments, including— </text><subparagraph id="idECDEAECB1C6C4449958FCACFE29A2B2C"><enum>(A)</enum><text>converting space-related technologies and resources to civilian entities; </text></subparagraph><subparagraph id="id89262D9CA98748BBBBD590BD25CCA2C7"><enum>(B)</enum><text>increasing commercial enterprise participation in space-related investments; and </text></subparagraph><subparagraph id="idC71049D532A246F28CB562DC8939C16E"><enum>(C)</enum><text>using investment vehicles affiliated with the People's Republic of China or the Russian Federation to acquire critical technologies in other countries. </text></subparagraph></paragraph><paragraph id="id975D93C3B7AC435CB35265EC30408785"><enum>(3)</enum><text>An assessment of and recommendation to strengthen the ability of the United States to protect the intellectual property and critical technologies of the United States regarding space-related investments from export, transfer, and foreign theft or imitation, particularly from entities affiliated with the Government of the People's Republic of China or the Government of the Russian Federation.</text></paragraph><paragraph id="id0E1FAAA5449A4A8B96343E7B1D3FD984"><enum>(4)</enum><text>A review and assessment of the research, technology, and commercial ties between the United States and the People's Republic of China and the Russian Federation regarding space-related investments to assess exposure and risks that may contribute to the development or enhancement of the space capabilities of the People's Republic of China and the Russian Federation.</text></paragraph><paragraph id="id06E07A38D5A34A6DAE6E6B7B667B142D"><enum>(5)</enum><text>An interagency strategy—</text><subparagraph id="id94A1D1170C944C0D8FF67575BDA14FC9"><enum>(A)</enum><text>to defend supply chains of the United States that are critical to competitiveness in space; and </text></subparagraph><subparagraph id="id2C7B2A51CC6B4AC88FDD5B5B7D4628DE"><enum>(B)</enum><text>to ensure that the United States remains the preeminent commercial leader in the global space industry.</text></subparagraph></paragraph></subsection></section><section id="id456FF21E7EC04B1AA3CC26CA6235D17E"><enum>4.</enum><header>Prohibition on use of funds to purchase certain telecommunications or aerospace goods or service from entities associated with the Government of the People's Republic of China or the Communist Party of China</header><text display-inline="no-display-inline">No funds made available to the Department of Commerce or the National Aeronautics and Space Administration may be used to purchase or lease certain telecommunications or aerospace goods or service from any telecommunications or aerospace corporation, subsidiary, or affiliate associated with any of the following:</text><paragraph id="idAF7290BE002947419B5A7F6E8DF52B60"><enum>(1)</enum><text display-inline="yes-display-inline">The Government of the People's Republic of China.</text></paragraph><paragraph id="idAE99D427D09B44C1833E8CF1A109358B"><enum>(2)</enum><text display-inline="yes-display-inline">The Communist Party of China.</text></paragraph><paragraph id="id080e55fdb3934150a37330e48b8ec489"><enum>(3)</enum><text>The People’s Liberation Army. </text></paragraph><paragraph id="id6B96E3B60340465BAB347158ADBD3E96"><enum>(4)</enum><text>The China National Space Administration. </text></paragraph><paragraph id="id0AD690E4BC854089A69889C225077B84"><enum>(5)</enum><text>China Aerospace Science and Industry Corporation Limited.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC043CEFCB78040B388ECDA3D4BD57B81"><enum>(6)</enum><text>China Aerospace Science and Technology Corporation.</text></paragraph><paragraph id="idE24DD3E6C0FF4F50B25D4CDC2380BE7B"><enum>(7)</enum><text>The BeiDou Satellite Navigation Experimental System. </text></paragraph><paragraph id="id53B1DF8CDA7B4CF0BEB18A631C63BC4C"><enum>(8)</enum><text>Any Communist Chinese military company identified by the Secretary of Defense under section 1237(b) of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/105/261">Public Law 105–261</external-xref>). </text></paragraph></section><section id="idFA5E2D16DD564409B2991E5BF5F84756"><enum>5.</enum><header>SEC reporting</header><subsection id="idAAB21C61F3BB42A998219BE327BE2871"><enum>(a)</enum><header>Definitions</header><text>In this section— </text><paragraph id="id26583C98B8CF4D15A5CDE1A882D5688E"><enum>(1)</enum><text>the term <term>Commission</term> means the Securities and Exchange Commission;</text></paragraph><paragraph id="id0115C06DE5314BE6B83839510A791623"><enum>(2)</enum><text>the term <term>Schedule 13D</term> means a statement containing the information required under section 240.13d–101 of title 17, Code of Federal Regulations, or any successor regulation; and</text></paragraph><paragraph id="id37C6755E62C143CAA1BB3B3316D15228"><enum>(3)</enum><text>the term <term>Schedule 13G</term> means a statement containing the information required under section 240.13d–102 of title 17, Code of Federal Regulations, or any successor regulation. </text></paragraph></subsection><subsection id="id9195D5816D454BD0A0B96023377D9D39"><enum>(b)</enum><header>Reporting required</header><text>Notwithstanding section 240.13d–1 of title 17, Code of Federal Regulations, or any successor regulation, the Commission shall require any foreign person who, after acquiring directly or indirectly the beneficial ownership of any equity security of a class which is specified in paragraph (i) of such section 240.13d–1 and that is issued by a covered entity, is directly or indirectly the beneficial owner of more than 2 percent of the class, to file with the Commission Schedule 13D or Schedule 13G, as determined under such section 240.13d–1.</text></subsection><subsection commented="no" id="id3999532FA49F410DB222D332160264DE"><enum>(c)</enum><header>Updates to rules</header><text>The Commission may make any updates to the rules of the Commission that may be necessary as a result of this section. </text></subsection></section><section id="id4389147846484a1baaf2f2b0d7ec5633"><enum>6.</enum><header>Annual report on foreign investment in United States exploration, manufacturing, telecommunications, and national security involving space</header><subsection id="id56972535AB5845F8B3ECC2A5408E2F13"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense, in coordination with the Secretary of Commerce and the Secretary of the Treasury, shall submit to Congress a report on investment by foreign persons in activities conducted in the United States or by United States persons relating to exploration, manufacturing, telecommunications, or national security activities involving space.</text></subsection><subsection id="idC13EAADDB42749E483FAB66D93CC1B00"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include—</text><paragraph id="idED48BA4FC8004C9593E2DD0FEE487C5B"><enum>(1)</enum><text>the country of origin of the foreign person;</text></paragraph><paragraph id="id7D37E9B27C6A40DF841CCBB4A8D9EDE7"><enum>(2)</enum><text>the source of funds for investment by the foreign person in space; and</text></paragraph><paragraph id="id8B45C4BCBB574375B59CA2361F63641E"><enum>(3)</enum><text>any other information that the Secretary of Defense considers appropriate.</text></paragraph></subsection><subsection id="id109B6466943A4625BEC4F5DDFAA049B3"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form but may contain a classified annex.</text></subsection></section></legis-body></bill>
