which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Small Business Act relating to small business concerns owned and controlled by women, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H8741C83C96D04BD3A2AF59D97C7AB81C"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability in Women-Owned Small Business Contracting Act</short-title></quote>.</text></section><section id="idCF41D9A611B64D96963860D42EFA61EE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id06C0E24F5FBF40ACA67219CD0CF7AF73"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="id8ACF3E0790BC478693BE49AED065AB7D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Small business concern owned and controlled by women</header><text>The term <term>small business concern owned and controlled by women</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id2bdd3916c6424a4b9d1d1df6eca6dc9c"><enum>3.</enum><header display-inline="yes-display-inline">Eliminating Self-Certification for Women-Owned Small Businesses</header><subsection commented="no" display-inline="no-display-inline" id="id4a6d76eba6b946708d90d1c289bf611e"><enum>(a)</enum><header display-inline="yes-display-inline">Eliminating Self-Certification in Prime Contracting and Subcontracting for WOSBs</header><paragraph commented="no" display-inline="no-display-inline" id="id7c7a027cc6a447e9a651a5317ef02d4a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each prime contract award and subcontract award that is counted for the purpose of meeting the goals for participation by small business concerns owned and controlled by women in procurement contracts for Federal agencies, as established in section 15(g)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(2)</external-xref>), shall be entered into with small business concerns certified by the Administrator to meet the requirements under section 3(n) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(n)</external-xref>) to be a small business concern owned and controlled by women.</text></paragraph><paragraph id="ide105441fc0a94378990d28bd1f76c010"><enum>(2)</enum><header>Effective date</header><text>Paragraph (1) shall take effect on October 1 of the fiscal year beginning after the Administrator promulgates the regulations required under subsection (c).</text></paragraph></subsection><subsection id="id6cec935b38c541db857dbeaa05932967"><enum>(b)</enum><header>Phased Approach to Eliminating Self-Certification for WOSBs</header><text>Notwithstanding any other provision of law, any small business concern that self-certified as a small business concern owned and controlled by women may—</text><paragraph id="iddea85afce8714728a863fa5256da2c85"><enum>(1)</enum><text>if the small business concern files a certification application with the Administrator before the end of the 1-year period beginning on the date of enactment of this Act, maintain such self-certification until the Administrator makes a determination with respect to such certification; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5a63f12e39e4bb48c0ea6a5dcaea4c5"><enum>(2)</enum><text display-inline="yes-display-inline">if the small business concern does not file a certification application before the end of the 1-year period beginning on the date of enactment of this Act, lose, at the end of such 1-year period, any self-certification of the small business concern as a small business concern owned and controlled by women.</text></paragraph></subsection><subsection id="id8392729e095246f48252071666acc0c0"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall promulgate regulations to carry out this section. </text></subsection></section><section id="id8854be74ac1c47269c7e5f3600a1cf1f"><enum>4.</enum><header>Agency testimony before Congress</header><text display-inline="no-display-inline">Section 15(g)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide76bc65259524b5ea60eb09bd42187f4"><subparagraph id="id045e14dd4d154ace8b1cf04282bc9607"><enum>(G)</enum><header>Remediation</header><text>Any Federal agency failing to meet the goal for participation by small business concerns owned and controlled by women established under paragraph (1)(B) in a fiscal year shall—</text><clause id="id3398375399be4c3d96680cf00a8e3b6d"><enum>(i)</enum><text>submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives the report required under subsection (h)(1); and</text></clause><clause id="id3822ec9d69394afb8799d93978019e42"><enum>(ii)</enum><text>testify before the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives on the details of the report submitted under clause (i), in particular the justifications and remediation plan described in subparagraphs (C) and (D) of subsection (h)(1).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idB703BEA440D947F89919B1A7E4F43FD1"><enum>5.</enum><header>Interagency report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Secretary of Commerce, the Secretary of Agriculture, the Secretary of the Treasury, and the head of any other Federal agency that the Administrator determines appropriate, shall submit to Congress an interagency report that—</text><paragraph id="ida87c7e5018a74283b661aa1f68a53150"><enum>(1)</enum><text>identifies the leading economic barriers for small business concerns owned and controlled by women, particularly for industries underrepresented by small business concerns owned and controlled by women;</text></paragraph><paragraph id="idb0f7ecee78674efea3e760685395c765"><enum>(2)</enum><text>includes a detailed description of the impact of inflation and supply chain disruptions on small business concerns owned and controlled by women during the 3-year period preceding the report;</text></paragraph><paragraph id="idf1de0f5935a34531b229539e3023213d"><enum>(3)</enum><text>makes recommendations to improve access to capital for small business concerns owned and controlled by women; and</text></paragraph><paragraph id="id344c388201db4370ad142b67ca859a63"><enum>(4)</enum><text>in consultation with the Office of Federal Procurement Policy, makes recommendations for increasing the number of Federal contract opportunities for small business concerns owned and controlled by women.</text></paragraph></section></legis-body></bill>
