which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certification of small business concerns as small business concerns owned and controlled by service-disabled veterans in order to be counted toward goals for contract awards, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Stolen Valor for Service-Disabled Veteran-Owned Small Business Contractors</short-title></quote>.</text></section><section id="id45aff737a4f646b2a8e8d47188be65cc"><enum>2.</enum><header>Eliminating self-certification for service-disabled veteran-owned small businesses</header><subsection id="id0ca4af47279a4575a886b67d8106efaa"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id35a841069ae14fceb73a8bfd0f0b62a6"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="id09d0a870166e423283674908bc5264f2"><enum>(2)</enum><header>Small business concern; small business concerns owned and controlled by service-disabled veterans</header><text>The terms <term>small business concern</term> and <term>small business concerns owned and controlled by service-disabled veterans</term> have the meanings given those terms in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4a6d76eba6b946708d90d1c289bf611e"><enum>(b)</enum><header display-inline="yes-display-inline">Eliminating Self-Certification in Prime Contracting and Subcontracting for SDVOSBs</header><paragraph commented="no" display-inline="no-display-inline" id="id7c7a027cc6a447e9a651a5317ef02d4a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each prime contract award and subcontract award that is counted for the purpose of meeting the goals for participation by small business concerns owned and controlled by service-disabled veterans in procurement contracts for Federal agencies, as established in section 15(g)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(2)</external-xref>), shall be entered into with small business concerns certified by the Administrator as small business concerns owned and controlled by service-disabled veterans under section 36 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657f">15 U.S.C. 657f</external-xref>).</text></paragraph><paragraph id="ide105441fc0a94378990d28bd1f76c010"><enum>(2)</enum><header>Effective date</header><text>Paragraph (1) shall take effect on October 1 of the fiscal year beginning after the Administrator promulgates the regulations required under subsection (d).</text></paragraph></subsection><subsection id="id6cec935b38c541db857dbeaa05932967"><enum>(c)</enum><header>Phased Approach to Eliminating Self-Certification for SDVOSBs</header><text>Notwithstanding any other provision of law, any small business concern that self-certified as a small business concern owned and controlled by service-disabled veterans may—</text><paragraph id="iddea85afce8714728a863fa5256da2c85"><enum>(1)</enum><text>if the small business concern files a certification application with the Administrator before the end of the 1-year period beginning on the date of enactment of this Act, maintain such self-certification until the Administrator makes a determination with respect to such certification; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5a63f12e39e4bb48c0ea6a5dcaea4c5"><enum>(2)</enum><text display-inline="yes-display-inline">if the small business concern does not file a certification application before the end of the 1-year period beginning on the date of enactment of this Act, lose, at the end of such 1-year period, any self-certification of the small business concern as a small business concern owned and controlled by service-disabled veterans.</text></paragraph></subsection><subsection id="id8392729e095246f48252071666acc0c0"><enum>(d)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall promulgate regulations to carry out this Act.</text></subsection></section></legis-body></bill>
