Penalties for hindering immigration, border, and customs controls.</toc-entry></toc></subsection></section><section id="idbe178ac7-a658-49f4-bdc4-e4ccf7bd30e6" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Coordination and information sharing</header><subsection id="id3ddcc2cf-9f7b-4d7b-806c-37a140105d4c"><enum>(a)</enum><header>Public-Private partnerships</header><paragraph id="idc7291c77-861a-4508-acc5-83fd127153bd"><enum>(1)</enum><header>Strategy</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall develop a strategy to strengthen existing and establish new public-private partnerships with shipping, chemical, and pharmaceutical industries to assist with early detection and interdiction of illicit drugs and precursor chemicals.</text></paragraph><paragraph id="id150ec592-bcea-4952-94a2-5d49a8c4595b"><enum>(2)</enum><header>Contents</header><text>The strategy required under paragraph (1) shall contain goals and objectives for employees of the Department of Homeland Security to ensure the tactics, techniques, and procedures gained from the public-private partnerships described in paragraph (1) are included in policies, best practices, and training for the Department.</text></paragraph><paragraph id="idd8891062-3b42-404a-9ed1-5402e4f06215"><enum>(3)</enum><header>Implementation plan</header><text>Not later than 180 days after developing the strategy required under paragraph (1), the Secretary of Homeland Security shall develop an implementation plan for the strategy, which shall outline departmental lead and support roles, responsibilities, programs, and timelines for accomplishing the goals and objectives of the strategy.</text></paragraph><paragraph id="id91641dd8-aea8-40aa-9a9f-074a039785c6"><enum>(4)</enum><header>Briefing</header><text>The Secretary of Homeland Security shall provide annual briefings to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made in addressing the implementation plan developed pursuant to paragraph (3).</text></paragraph></subsection><subsection id="idfe6a94ac-817e-42c5-af46-39d401848887"><enum>(b)</enum><header>Assessment of drug task forces</header><paragraph id="idf5926f1f-bad9-4adb-aede-adf2d2d93635"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall conduct an assessment of the counterdrug task forces in which the Department of Homeland Security, including components of the Department, participates in or leads, which shall include—</text><subparagraph id="id360a68fb-a89e-4d4e-81cb-563b161ca86c"><enum>(A)</enum><text>areas of potential overlap;</text></subparagraph><subparagraph id="idd64cdb11-535f-423d-ae99-36c87d4935d5"><enum>(B)</enum><text>opportunities for sharing information and best practices; </text></subparagraph><subparagraph id="idb4092f53-654f-422c-812e-fa6e4dba11f9"><enum>(C)</enum><text>how the Department’s processes for ensuring accountability and transparency in its vetting and oversight of partner agency task force members align with best practices; and </text></subparagraph><subparagraph id="id4f5903a1-16ce-44a8-a4e7-3a0f8467ae1a"><enum>(D)</enum><text>corrective action plans for any capability limitations and deficient or negative findings identified in the report for any such task forces led by the Department.</text></subparagraph></paragraph><paragraph id="idf0929cc5-c28f-4ad2-bb3b-d2446b4d97e8"><enum>(2)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that contains a summary of the results of the assessment conducted pursuant to paragraph (1).</text></paragraph><paragraph id="ida8bd53cc-63d6-4655-9feb-16ba823d560e"><enum>(3)</enum><header>Corrective action plan</header><text>The Secretary of Homeland Security shall—</text><subparagraph id="id89e36fab-dcac-424e-8e25-8f33c8585881"><enum>(A)</enum><text>implement the corrective action plans described in paragraph (1)(D) immediately after the submission of the report pursuant to paragraph (2); and </text></subparagraph><subparagraph id="idecbf97a8-ce24-4c46-8275-6c9930e85366"><enum>(B)</enum><text>provide annual briefings to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made in implementing the corrective action plans.</text></subparagraph></paragraph></subsection><subsection id="idf8cf949f-254c-4c3c-8a12-52bf18cfe890"><enum>(c)</enum><header>Combination of briefings</header><text>The Secretary of Homeland Security may combine the briefings required under subsections (a)(4) and (b)(3) and provide such combined briefings through fiscal year 2026.</text></subsection></section><section id="id9d7ebc6e-8b99-4b70-8850-9f3b64c6706e" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Danger pay for Department of Homeland Security personnel deployed abroad</header><subsection commented="no" display-inline="no-display-inline" id="id19bbc6f56be94f78811c95f5abffd4dc"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle H of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/451">6 U.S.C. 451 et seq.</external-xref>) is amended by inserting after section 881 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE9F66B601FE24848B8C6B41A5B01716A" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><section commented="no" display-inline="no-display-inline" id="idd0c165c5e10e42e7a19d06d800410ea0"><enum>881A.</enum><header>Danger pay allowance</header><subsection commented="no" display-inline="no-display-inline" id="id1663a682b28b4a5881d2b365ba8f0c4e"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">An employee of the Department, while stationed in a foreign area, may be granted a danger pay allowance, not to exceed 35 percent of the basic pay of such employee, for any period during which such foreign area experiences a civil insurrection, a civil war, ongoing terrorist acts, or wartime conditions that threaten physical harm or imminent danger to the health or well-being of such employee.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id12116d836cd146abac7496ad3f5de06e"><enum>(b)</enum><header>Notice</header><text>Before granting or terminating a danger pay allowance to any employee pursuant to subsection (a), the Secretary, after consultation with the Secretary of State, shall notify the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> of—</text><paragraph commented="no" display-inline="no-display-inline" id="idddbfee5d3cf1428da4fdb42e8612f67b"><enum>(1)</enum><text display-inline="yes-display-inline">the intent to make such payments and the circumstances justifying such payments; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24c355df72984b0fb51e76873c6bf44f"><enum>(2)</enum><text display-inline="yes-display-inline">the intent to terminate such payments and the circumstances justifying such termination.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="idc6022802-8607-4896-9880-a268477e940c" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>4.</enum><header>Improving training to foreign-vetted law enforcement or national security units</header><text display-inline="no-display-inline">The Secretary of Homeland Security, or the designee of the Secretary, may waive reimbursement for salary expenses of Department of Homeland Security for personnel providing training to foreign-vetted law enforcement or national security units in accordance with an agreement with the Department of Defense pursuant to section 1535 of title 31, United States Code.</text></section><section id="idd6859403-f4c3-47f4-a700-86a307c3d3df" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>5.</enum><header>Enhancing the operations of U.S. Customs and Border Protection in foreign countries</header><text display-inline="no-display-inline">Section 411(f) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211(f)</external-xref>) is amended—</text><paragraph id="id3397887c-684c-41a0-8d6f-5227d629116c"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="id64765001-e33f-4935-bd42-05a69ebcff60"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2ad7369c-9683-4eea-bb5a-89ff83c1a220" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="idf4c12248-5346-4a67-b9cf-65ee075cdf66"><enum>(4)</enum><header>Permissible activities</header><subparagraph commented="no" display-inline="no-display-inline" id="idd3fd9733b1b64588a957b4e59ad81f5d"><enum>(A)</enum><header>In general</header><text>Employees of U.S. Customs and Border Protection and other customs officers designated in accordance with the authorities granted to officers and agents of Air and Marine Operations may provide the support described in subparagraph (B) to authorities of the government of a foreign country, including by conducting joint operations with appropriate government officials within the territory of such country, if an agreement has been entered into between the Government of the United States and the government of such country that permits such support by such employees and officers. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb01851c7fe714fd0b8e83fabfadf9825"><enum>(B)</enum><header>Support described</header><text display-inline="yes-display-inline">The support described in this subparagraph is support for—</text><clause commented="no" display-inline="no-display-inline" id="id9b169a4bd05e4ea890933e3f1e69706a"><enum>(i)</enum><text display-inline="yes-display-inline">the monitoring, locating, tracking, and deterrence of—</text><subclause commented="no" display-inline="no-display-inline" id="ide0597aa9aea5448d918614cadbe52cdb"><enum>(I)</enum><text display-inline="yes-display-inline">illegal drugs to the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0992707512784850986e77c5e36e6960"><enum>(II)</enum><text display-inline="yes-display-inline">the illicit smuggling of persons and goods into the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id393e0c71f09c4495a6cdbc84e26388df"><enum>(III)</enum><text display-inline="yes-display-inline">terrorist threats to the United States; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida243e89ae97b4cb8b89bcb825217c351"><enum>(IV)</enum><text display-inline="yes-display-inline">other threats to the security or economy of the United States;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd7a2593b39ec4b1b94feca66a995f6d0"><enum>(ii)</enum><text display-inline="yes-display-inline">emergency humanitarian efforts; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idef6551ce988a4b2db1378db0685fbb6a"><enum>(iii)</enum><text display-inline="yes-display-inline">law enforcement capacity-building efforts.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9857b12754441df932da6a74e4cb99a"><enum>(C)</enum><header>Payment of claims</header><text>The Secretary may expend funds, which have been appropriated or otherwise made available to U.S. Customs and Border Protection for operations and support, to pay claims for money damages against the United States, in accordance with the first paragraph of section 2672 of title 28, United States Code, which arise in a foreign country in connection with U.S. Customs and Border Protection operations in such country.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5a6a867c-a01e-470e-9e48-020e934afb65" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>6.</enum><header>Drug seizure data improvement</header><subsection id="id453cd50a-9ee7-4c83-bb26-bca0ab182a75"><enum>(a)</enum><header>Study</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall conduct a study to identify any opportunities for improving drug seizure data collection.</text></subsection><subsection id="id877c771b-49d4-471d-b9e7-1835d5aaf400"><enum>(b)</enum><header>Elements</header><text>The study required under subsection (a) shall—</text><paragraph id="id03521f77-579b-44be-85e2-96de8d0edb01"><enum>(1)</enum><text>include a survey of the entities that use drug seizure data; and</text></paragraph><paragraph id="idfcc7bdb6-a6e5-4049-b3eb-325654f44544"><enum>(2)</enum><text>address—</text><subparagraph id="ida5380758-24da-4b1a-8b71-5612f781d4c9"><enum>(A)</enum><text>any additional data fields or drug type categories that should be added to U.S. Customs and Border Protection’s SEACATS, U.S. Border Patrol's e3 portal, and any other systems deemed appropriate by the Commissioner of U.S. Customs and Border Protection, in accordance with the first recommendation in the Government Accountability Office's report GAO–22–104725, entitled <quote>Border Security: CBP Could Improve How It Categorizes Drug Seizure Data and Evaluates Training</quote>;</text></subparagraph><subparagraph id="idc098c77e-9452-4dbc-915b-29fa0df4cdf2"><enum>(B)</enum><text>how all the Department of Homeland Security components that collect drug seizure data can standardize their data collection efforts and deconflict drug seizure reporting;</text></subparagraph><subparagraph id="idfd9eaaa0-4648-4cae-b6d7-23c65801d2fd"><enum>(C)</enum><text>how the Department of Homeland Security can better identify, collect, and analyze additional data on precursor chemicals, synthetic drugs, novel psychoactive substances, and analogues that have been seized by U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement; and</text></subparagraph><subparagraph id="idacc58dd7-768e-43f3-b6e2-c8d30bf7ccb4"><enum>(D)</enum><text>how the Department of Homeland Security can improve its model of anticipated drug flow into the United States.</text></subparagraph></paragraph></subsection><subsection id="idb7524e1d-d40c-462e-adfe-7f9f03e0e0e4"><enum>(c)</enum><header>Implementation of findings</header><text>Following the completion of the study required under subsection (a)—</text><paragraph id="id9cbc9406-41e9-47c0-8505-f99b7e019e62"><enum>(1)</enum><text>the Secretary of Homeland Security, in accordance with the Office of National Drug Control Policy’s 2022 National Drug Control Strategy, shall modify Department of Homeland Security drug seizure policies and training programs, as appropriate, consistent with the findings of such study; and</text></paragraph><paragraph id="id3e0f95be-7688-4a98-bb62-6499896142a7"><enum>(2)</enum><text>the Commissioner of U.S. Customs and Border Protection, in consultation with the Director of U.S. Immigration and Customs Enforcement, shall make any necessary updates to relevant systems to include the results of confirmatory drug testing results.</text></paragraph></subsection></section><section id="id7ba00009-8bfb-45c5-ac09-6c27b828307c" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>7.</enum><header>Drug performance measures</header><text display-inline="no-display-inline"> Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall develop and implement a Department of Homeland Security plan to ensure that components of the Department develop and maintain outcome-based performance measures that adequately assess the success of drug interdiction efforts and how to utilize the existing drug-related metrics and performance measures to achieve the missions, goals, and targets of the Department. </text></section><section id="idd4f9016e-e8c5-4f6d-bd7c-85eedc694e36" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>8.</enum><header>Penalties for hindering immigration, border, and customs controls</header><subsection id="id0beeb8d7-8ac1-4f99-9a83-7faf92427f8c"><enum>(a)</enum><header>Personnel and structures</header><text>Title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151 et seq.</external-xref>) is amended by inserting after section 274D the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38f9807d-12ae-4831-9b89-873202563ea2" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><section section-type="section-one" id="ida4626bb5-b7cb-426b-b8c3-6eddb0b911e5"><enum>274E.</enum><header>Destroying or evading border controls</header><subsection id="id7b1a078b-a50b-4f2b-8862-96b2d559baa7"><enum>(a)</enum><header>Illicit spotting</header><paragraph id="idadd2c1e0-5642-4889-a7c7-26268646f677"><enum>(1)</enum><header>In general</header><text>It shall be unlawful to knowingly surveil, track, monitor, or transmit the location, movement, or activities of any officer or employee of a Federal, State, or Tribal law enforcement agency with the intent to knowingly and willfully—</text><subparagraph id="idabc0681b-278d-4514-bfd5-1e28c86c0628"><enum>(A)</enum><text>secure a financial gain;</text></subparagraph><subparagraph id="idfa9c0b6e-dced-4b47-bea2-41a3be407866"><enum>(B)</enum><text>further the objectives of a criminal organization; and</text></subparagraph><subparagraph id="id1d52ff21-443d-4b5d-b298-9a750e345c9a"><enum>(C)</enum><text>violate—</text><clause id="ida7d40db7-dd4c-4ceb-9796-7a7955980ff1"><enum>(i)</enum><text>section 274(a)(1)(A)(i);</text></clause><clause id="id622f3339-c9a8-4f26-9cad-b8afcb8c691a"><enum>(ii)</enum><text>the customs and trade laws of the United States (as defined in section 2(4) of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/125">Public Law 114–125</external-xref>));</text></clause><clause id="idfc9cd691-e7f5-4a99-9966-b8d2ad17b657"><enum>(iii)</enum><text>any other Federal law relating to transporting controlled substances, agriculture, or monetary instruments into the United States; or</text></clause><clause id="id5ad991ea-7568-44d5-beb3-6994058ee9c2"><enum>(iv)</enum><text>any Federal law relating to border controls measures of the United States.</text></clause></subparagraph></paragraph><paragraph id="ida330bbb4-87d6-46be-b0e7-fd8b23de3017"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both.</text></paragraph></subsection><subsection id="ida490fd94-9092-444c-a5ae-d943af9a4722"><enum>(b)</enum><header>Destruction of United States border controls</header><paragraph id="id8959fdbb-9b73-449d-9d2f-3567db81fcb1"><enum>(1)</enum><header>In general</header><text>It shall be unlawful to knowingly and without lawful authorization—</text><subparagraph id="id1bebf787-ec3e-4ec5-8007-2ed664f1d684"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id448e2ceb-9c38-4e71-bbbf-af43ea720601"><enum>(i)</enum><text>destroy or significantly damage any fence, barrier, sensor, camera, or other physical or electronic device deployed by the Federal Government to control an international border of, or a port of entry to, the United States; or</text></clause><clause id="id87031e49-371e-42b9-8192-aff70aea94fe" indent="up1"><enum>(ii)</enum><text>otherwise construct, excavate, or make any structure intended to defeat, circumvent or evade such a fence, barrier, sensor camera, or other physical or electronic device deployed by the Federal Government to control an international border of, or a port of entry to, the United States; and</text></clause></subparagraph><subparagraph id="id990be3ea-78ce-4460-93aa-4368f13adad6"><enum>(B)</enum><text>in carrying out an act described in paragraph (1), have the intent to knowingly and willfully—</text><clause id="id68d2d200-7922-4a19-b3d6-1498dad8b2f2"><enum>(i)</enum><text>secure a financial gain; </text></clause><clause id="idccace10f-f957-4568-afd0-648551944d81"><enum>(ii)</enum><text>further the objectives of a criminal organization; and</text></clause><clause id="id03b4bc23-7347-4ffc-bc90-287521504b46"><enum>(iii)</enum><text>violate—</text><subclause id="id4b6862b1-3598-4051-bc9e-1c077e208948"><enum>(I)</enum><text>section 274(a)(1)(A)(i);</text></subclause><subclause id="id9678d46a-a1bd-4ff5-8323-833bb275e17d"><enum>(II)</enum><text>the customs and trade laws of the United States (as defined in section 2(4) of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/125">Public Law 114–125</external-xref>));</text></subclause><subclause id="idb04c2bba-12d4-42db-8040-e4e367cfc8a6"><enum>(III)</enum><text>any other Federal law relating to transporting controlled substances, agriculture, or monetary instruments into the United States; Penalties for hindering immigration, border, and customs controls.</toc-entry></toc></subsection></section><section id="id89fa2d70-8c71-4877-a3eb-61f01b277236" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Coordination and information sharing</header><subsection id="id178c9a5f-8a94-43de-b847-346409fcdc53"><enum>(a)</enum><header>Public-private partnerships</header><paragraph id="id0480efd3-2c93-4978-9dce-7cafcdf25c41"><enum>(1)</enum><header>Strategy</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall develop a strategy to strengthen existing and establish new public-private partnerships with shipping, chemical, and pharmaceutical industries to assist with early detection and interdiction of illicit drugs and precursor chemicals.</text></paragraph><paragraph id="id6d4d9fac-3b0a-42ec-b49b-5b2013983e8b"><enum>(2)</enum><header>Contents</header><text>The strategy required under paragraph (1) shall contain goals and objectives for employees of the Department of Homeland Security to ensure the tactics, techniques, and procedures gained from the public-private partnerships described in paragraph (1) are included in policies, best practices, and training for the Department.</text></paragraph><paragraph id="id3db053d3-ee92-40a8-948d-c4f8770a909a"><enum>(3)</enum><header>Implementation plan</header><text>Not later than 180 days after developing the strategy required under paragraph (1), the Secretary of Homeland Security shall develop an implementation plan for the strategy, which shall outline departmental lead and support roles, responsibilities, programs, and timelines for accomplishing the goals and objectives of the strategy.</text></paragraph><paragraph id="idde88eb76-2f87-41dc-845f-aebf035ee853"><enum>(4)</enum><header>Briefing</header><text>The Secretary of Homeland Security shall provide annual briefings to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made in addressing the implementation plan developed pursuant to paragraph (3).</text></paragraph></subsection><subsection id="idb9c220c6-470f-4095-9553-ecb3278fb945"><enum>(b)</enum><header>Assessment of drug task forces</header><paragraph id="id2976367c-b5ec-499c-aaf6-2a749b8d94b1"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall conduct an assessment of the counterdrug task forces in which the Department of Homeland Security, including components of the Department, participates in or leads, which shall include—</text><subparagraph id="id3f37fb21-ea3d-40c6-9553-f6d8106f7b25"><enum>(A)</enum><text>areas of potential overlap;</text></subparagraph><subparagraph id="id85307949-1947-49b6-8154-18155beaaa64"><enum>(B)</enum><text>opportunities for sharing information and best practices; </text></subparagraph><subparagraph id="id9e1b388e-acf6-4656-8bbd-bc6847564a3c"><enum>(C)</enum><text>how the Department’s processes for ensuring accountability and transparency in its vetting and oversight of partner agency task force members align with best practices; and </text></subparagraph><subparagraph id="idc03606a5-8453-495c-ba8b-fd48d51478ab"><enum>(D)</enum><text>corrective action plans for any capability limitations and deficient or negative findings identified in the report for any such task forces led by the Department.</text></subparagraph></paragraph><paragraph id="id8c2e7793-a2ff-4d5d-a81c-d24c3f32f779"><enum>(2)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that contains a summary of the results of the assessment conducted pursuant to paragraph (1).</text></paragraph><paragraph id="idddfda38f-e8b7-4925-95f7-4b134f699e6d"><enum>(3)</enum><header>Corrective action plan</header><text>The Secretary of Homeland Security shall—</text><subparagraph id="ide4c36817-89d7-483e-9847-be230409c2fd"><enum>(A)</enum><text>implement the corrective action plans described in paragraph (1)(D) immediately after the submission of the report pursuant to paragraph (2); and </text></subparagraph><subparagraph id="id42fe0b81-709c-44d1-aee2-23c8c399dc1a"><enum>(B)</enum><text>provide annual briefings to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made in implementing the corrective action plans.</text></subparagraph></paragraph></subsection><subsection id="idc2962dcb-d188-4cd3-ac27-8fe0e2d55844"><enum>(c)</enum><header>Combination of briefings</header><text>The Secretary of Homeland Security may combine the briefings required under subsections (a)(4) and (b)(3) and provide such combined briefings through fiscal year 2026.</text></subsection></section><section id="idd5102492-19db-4dcd-a452-fc2686de6891" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Danger pay for Department of Homeland Security personnel deployed abroad</header><subsection commented="no" display-inline="no-display-inline" id="id262398c9-cd95-4bd2-9c99-a79336c04384"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle H of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/451">6 U.S.C. 451 et seq.</external-xref>) is amended by inserting after section 881 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb0b2198d-9c8d-40f7-a064-fc6da79ad9b6" changed="added" reported-display-style="italic" committee-id="SSGA00"><section commented="no" display-inline="no-display-inline" id="id9a1cd7f5-4e77-4840-b1ec-f41ea1915963"><enum>881A.</enum><header>Danger pay allowance</header><subsection commented="no" display-inline="no-display-inline" id="idf7e1f719-e4bc-4f1b-9452-54a22222a555"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">An employee of the Department, while stationed in a foreign area, may be granted a danger pay allowance, not to exceed 35 percent of the basic pay of such employee, for any period during which such foreign area experiences a civil insurrection, a civil war, ongoing terrorist acts, or wartime conditions that threaten physical harm or imminent danger to the health or well-being of such employee.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida7393c03-8c07-4918-9b71-82c3a75263a5"><enum>(b)</enum><header>Notice</header><text>Before granting or terminating a danger pay allowance to any employee pursuant to subsection (a), the Secretary, after consultation with the Secretary of State, shall notify the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> of—</text><paragraph commented="no" display-inline="no-display-inline" id="id98281ced-0887-4977-baf8-728f3609cafa"><enum>(1)</enum><text display-inline="yes-display-inline">the intent to make such payments and the circumstances justifying such payments; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a9096ed-4696-41a1-a91d-1a4cf9c4cd19"><enum>(2)</enum><text display-inline="yes-display-inline">the intent to terminate such payments and the circumstances justifying such termination.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="id4c8e6ea5-c2ad-4495-8c26-a2ab60285a0d" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Improving training to foreign-vetted law enforcement or national security units</header><text display-inline="no-display-inline">The Secretary of Homeland Security, or the designee of the Secretary, may waive reimbursement for salary expenses of Department of Homeland Security for personnel providing training to foreign-vetted law enforcement or national security units in accordance with an agreement with the Department of Defense pursuant to section 1535 of title 31, United States Code.</text></section><section id="id3524b9da-6eb1-4bb2-b03e-44b65145772b" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>5.</enum><header>Enhancing the operations of U.S. Customs and Border Protection in foreign countries</header><text display-inline="no-display-inline">Section 411(f) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211(f)</external-xref>) is amended—</text><paragraph id="id51148319-513a-48b7-8e53-db47299471cd"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="id6501ab25-7c2c-4a36-9728-b1f8f02d00eb"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9f618d1b-c1f9-4806-a316-50946d5a9849" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="idf3e90c82-e0a9-4191-9d9a-6961c9634752"><enum>(4)</enum><header>Permissible activities</header><subparagraph commented="no" display-inline="no-display-inline" id="idd660575b-96c6-40cb-8246-c7abc096b6b3"><enum>(A)</enum><header>In general</header><text>Employees of U.S. Customs and Border Protection and other customs officers designated in accordance with the authorities granted to officers and agents of Air and Marine Operations may provide the support described in subparagraph (B) to authorities of the government of a foreign country, including by conducting joint operations with appropriate government officials within the territory of such country, if an arrangement has been entered into between the Government of the United States and the government of such country that permits such support by such employees and officers. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffe3fb09-1cf2-40d5-9bb5-f331f52cbef6"><enum>(B)</enum><header>Support described</header><text display-inline="yes-display-inline">The support described in this subparagraph is support for—</text><clause commented="no" display-inline="no-display-inline" id="idd704a4e0-22a4-408e-8e5b-739d1987f7a2"><enum>(i)</enum><text display-inline="yes-display-inline">the monitoring, locating, tracking, and deterrence of—</text><subclause commented="no" display-inline="no-display-inline" id="id1a0f28df-c182-4637-a8c8-866ec73cd6e3"><enum>(I)</enum><text display-inline="yes-display-inline">illegal drugs to the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id22edbf75-683a-44c7-8882-352e7efd16bc"><enum>(II)</enum><text display-inline="yes-display-inline">the illicit smuggling of persons and goods into the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id58362048-b0d8-4bcd-bef9-3bda1b907376"><enum>(III)</enum><text display-inline="yes-display-inline">terrorist threats to the United States; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id32aebf69-c46a-42ec-9818-21f0662af840"><enum>(IV)</enum><text display-inline="yes-display-inline">other threats to the security or economy of the United States;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1599fa80-08ac-45b9-85d1-0fff2017f79e"><enum>(ii)</enum><text display-inline="yes-display-inline">emergency humanitarian efforts; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5725b6a9-9197-4a78-a3f8-4458cf25a447"><enum>(iii)</enum><text display-inline="yes-display-inline">law enforcement capacity-building efforts.</text></clause></subparagraph><subparagraph id="id87BCDC839A0D48989FA5BDF0E6B4C93B" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Payment of claims</header><clause commented="no" display-inline="no-display-inline" id="id4b137549036b4510bd34ef2f0aba4168"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clauses (ii) and (iv), the Secretary may expend funds that have been appropriated or otherwise made available for the operating expenses of the Department to pay claims for money damages against the United States, in accordance with the first paragraph of section 2672 of title 28, United States Code, which arise in a foreign country in connection with U.S. Customs and Border Protection operations in such country.</text></clause><clause commented="no" display-inline="no-display-inline" id="idff202ce68ef74c7c9d24c7e0e39838d2"><enum>(ii)</enum><header>Submission deadline</header><text display-inline="yes-display-inline">A claim may be allowed under clause (i) only if it is presented not later than 2 years after it accrues.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6591139c20eb40378d0e1ba1817e9f8e"><enum>(iii)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the expenditure authority under clause (i) expires pursuant to clause (iv), the Secretary shall submit a report to Congress that describes, for each of the payments made pursuant to clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="id562c14b067ab4152b27ee30ada21acd6"><enum>(I)</enum><text display-inline="yes-display-inline">the foreign entity that received such payment;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id061bceb2f7a940fb9c131a5ee5217799"><enum>(II)</enum><text>the amount paid to such foreign entity; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide3223bcfb99549b2828928996d159e9e"><enum>(III)</enum><text display-inline="yes-display-inline">the country in which such foreign entity resides or has its principal place of business; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3049fbc59acd435fb9d0048e9f10b32d"><enum>(IV)</enum><text display-inline="yes-display-inline">a detailed account of the circumstances justify such payment.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id299b61b27bca4b8d989bc0d2aa26bdf5"><enum>(iv)</enum><header>Sunset</header><text display-inline="yes-display-inline">The expenditure authority under clause (i) shall expire on the date that is 5 years after the date of the enactment of the <short-title>Enhancing DHS Drug Seizures Act</short-title>.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id6e48f036-6681-45a2-a590-a7efbe132f0e" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>6.</enum><header>Drug seizure data improvement</header><subsection id="id5c539c92-f43a-48b1-b19e-60d08e749b49"><enum>(a)</enum><header>Study</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall conduct a study to identify any opportunities for improving drug seizure data collection.</text></subsection><subsection id="idf0560a79-8dac-49ac-8fb5-f3232ce3632c"><enum>(b)</enum><header>Elements</header><text>The study required under subsection (a) shall—</text><paragraph id="idc7f4c8c1-109c-402b-9aaf-09fae20e5dd2"><enum>(1)</enum><text>include a survey of the entities that use drug seizure data; and</text></paragraph><paragraph id="id4973191d-8da7-41f3-9c80-ff5b8e5ee7f6"><enum>(2)</enum><text>address—</text><subparagraph id="id9e5b8619-c3c6-493c-af04-0c370a83e6f6"><enum>(A)</enum><text>any additional data fields or drug type categories that should be added to U.S. Customs and Border Protection’s SEACATS, U.S. Border Patrol's e3 portal, and any other systems deemed appropriate by the Commissioner of U.S. Customs and Border Protection, in accordance with the first recommendation in the Government Accountability Office's report GAO-22-104725, entitled <quote>Border Security: CBP Could Improve How It Categorizes Drug Seizure Data and Evaluates Training</quote>;</text></subparagraph><subparagraph id="id971d0c2b-68fd-4dc2-acd4-a9b12f4fa5a7"><enum>(B)</enum><text>how all the Department of Homeland Security components that collect drug seizure data can standardize their data collection efforts and deconflict drug seizure reporting;</text></subparagraph><subparagraph id="id53afda5c-e51b-47d0-92ee-3d0ae9928d6b"><enum>(C)</enum><text>how the Department of Homeland Security can better identify, collect, and analyze additional data on precursor chemicals, synthetic drugs, novel psychoactive substances, and analogues that have been seized by U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement; and</text></subparagraph><subparagraph id="id9604ca0b-281e-4a29-8ca8-420e725e7c25"><enum>(D)</enum><text>how the Department of Homeland Security can improve its model of anticipated drug flow into the United States.</text></subparagraph></paragraph></subsection><subsection id="id0c2db6e9-87e0-4bb8-a646-6210f1e1bdc8"><enum>(c)</enum><header>Implementation of findings</header><text>Following the completion of the study required under subsection (a)—</text><paragraph id="id667704a8-376f-4a3d-a576-d020722b3a67"><enum>(1)</enum><text>the Secretary of Homeland Security, in accordance with the Office of National Drug Control Policy’s 2022 National Drug Control Strategy, shall modify Department of Homeland Security drug seizure policies and training programs, as appropriate, consistent with the findings of such study; and</text></paragraph><paragraph id="ida7d02a0c-0f10-4463-acde-a931a3285dfd"><enum>(2)</enum><text>the Commissioner of U.S. Customs and Border Protection, in consultation with the Director of U.S. Immigration and Customs Enforcement, shall make any necessary updates to relevant systems to include the results of confirmatory drug testing results.</text></paragraph></subsection></section><section id="idefcbdc56-50de-4c2b-8c77-9169bbd72496" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>7.</enum><header>Drug performance measures</header><text display-inline="no-display-inline"> Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall develop and implement a Department of Homeland Security plan to ensure that components of the Department develop and maintain outcome-based performance measures that adequately assess the success of drug interdiction efforts and how to utilize the existing drug-related metrics and performance measures to achieve the missions, goals, and targets of the Department. </text></section><section id="iddfa76c92-ba35-40ae-b8f5-2f690bf21e90" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>8.</enum><header>Penalties for hindering immigration, border, and customs controls</header><subsection id="id6bd5a365-1d1c-4493-9ade-cf4fa91b4d18"><enum>(a)</enum><header>Personnel and structures</header><text>Title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151 et seq.</external-xref>) is amended by inserting after section 274D the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3efd1c4b-9211-437d-80f5-7b91e0fa937d" changed="added" reported-display-style="italic" committee-id="SSGA00"><section section-type="section-one" id="id5507d9ca-5486-4e29-a05f-b3a8d4de0e27"><enum>274E.</enum><header>Destroying or evading border controls</header><subsection commented="no" display-inline="no-display-inline" id="id703c742df56d4c7dbe6259a90e3a312b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful to knowingly and without lawful authorization—</text><paragraph commented="no" display-inline="no-display-inline" id="id0b9a0c59ba164918a56d6a86baf5004e"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id893ac62ff07f4a1bbc596560b071baec"><enum>(A)</enum><text display-inline="yes-display-inline">destroy or significantly damage any fence, barrier, sensor, camera, or other physical or electronic device deployed by the Federal Government to control an international border of, or a port of entry to, the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7fa9ef7a2f647ba9f79265978ac0371" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise construct, excavate, or make any structure intended to defeat, circumvent or evade such a fence, barrier, sensor camera, or other physical or electronic device deployed by the Federal Government to control an international border of, or a port of entry to, the United States; and</text></subparagraph></paragraph><paragraph id="idEA8BAEAB7E7E4520A280C575BDD8A6BE"><enum>(2)</enum><text>in carrying out an act described in paragraph (1), have the intent to knowingly and willfully—</text><subparagraph id="idD1F74196BE494FEA9A2FDFADE769B589"><enum>(A)</enum><text>secure a financial gain; </text></subparagraph><subparagraph id="id16894613E1634EE19272AB6F12A9FD23"><enum>(B)</enum><text>further the objectives of a criminal organization; and</text></subparagraph><subparagraph id="id125B5111E9B3433AA80B4DE8683B4748"><enum>(C)</enum><text>violate—</text><clause id="id1D6C6369BF16412DBA86A63C664FD802"><enum>(i)</enum><text>section 274(a)(1)(A)(i);</text></clause><clause id="idB2A675A1B4C34E3594D79A771ED8361E"><enum>(ii)</enum><text>the customs and trade laws of the United States (as defined in section 2(4) of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/125">Public Law 114–125</external-xref>));</text></clause><clause id="id9A42847D77644F2F87773902A1CDFB57"><enum>(iii)</enum><text>any other Federal law relating to transporting controlled substances, agriculture, or monetary instruments into the United States; or</text></clause><clause id="id143CEE131E8240F9BBE043321ABCBCD3"><enum>(iv)</enum><text>any Federal law relating to border controls measures of the United States. </text></clause></subparagraph></paragraph></subsection><subsection id="id3A8B24A467D942D893A7266B2FB10927"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb00e1fad-a0b4-4885-a2bd-631acea4a0e9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 274D the following:</text><quoted-block style="OLC" id="ida541c351-35af-476c-a2fb-284bb13eb4b5" changed="added" reported-display-style="italic" committee-id="SSGA00"><toc changed="added" reported-display-style="italic" committee-id="SSGA00"><toc-entry level="section">Sec. 274E.
