Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the environmental review process, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revitalizing the Economy by Simplifying Timelines and Assuring Regulatory Transparency Act</short-title></quote> or the <quote><short-title>RESTART Act</short-title></quote>.</text></section><section id="ide8d01a96ed324b0083b70ec19bc60086"><enum>2.</enum><header>Modernizing the National Environmental Policy Act of 1969</header><subsection id="id8af50cd159eb4f3fa61bba147449cab8"><enum>(a)</enum><header>Existing NEPA requirements</header><text>Section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)</external-xref>) is amended—</text><paragraph id="iddad4fafc0ccd46d6a6eb148b3e375d43"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>insure</quote> and inserting <quote>ensure</quote>;</text></paragraph><paragraph id="id32d5c8ce67ec411a949d6391f7585c18"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>insure</quote> and inserting <quote>ensure</quote>;</text></paragraph><paragraph id="id44ba11babea24720b3b86cec73143141"><enum>(3)</enum><text>in subparagraph (C)—</text><subparagraph id="ida20d5b9dcdef4f92af3bec9e28190c36"><enum>(A)</enum><text>by inserting <quote>consistent with the requirements of this Act and except as provided by any other provision of law,</quote> before <quote>include in every</quote>;</text></subparagraph><subparagraph id="idec7e31ff30e949beb8556651564853a3"><enum>(B)</enum><text>by striking clauses (i) through (v) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide489ab8f78c040a3b0c0eca1e6bbff6e"><clause id="ida625caca75954ee4a3a72dc7b634c340"><enum>(i)</enum><text>a reasonable number of alternatives to the major Federal action and effects of those alternatives, including an analysis of any negative effects of not implementing the major Federal action in the case of a no action alternative;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67077fe3d3ae48ce934b2892d4718491"><enum>(ii)</enum><text>the relationship between local short-term uses of the human environment and the maintenance and enhancement of long-term productivity; and</text></clause><clause id="id458c7362dbe74e218e722ab274aad4ca"><enum>(iii)</enum><text>any irreversible and irretrievable commitments of Federal resources that would be involved in the major Federal action if the action is implemented.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id690e1feac5ba468ba97faa885b53e5d3"><enum>(C)</enum><text>in the undesignated matter following clause (iii) (as so amended), in the second sentence, by striking <quote>the responsible Federal official</quote> and inserting <quote>the head of the Federal lead agency</quote>;</text></subparagraph></paragraph><paragraph id="id474d61910302441a9dca50b6816e36e1" commented="no"><enum>(4)</enum><text>in subparagraph (D)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida4bcb7fc72f54707a569ea1b3d407c91"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>official, if:</quote> and inserting <quote>official if—</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef287367716f482a99c6fadb68a73659"><enum>(B)</enum><text display-inline="yes-display-inline">in each of clauses (i) and (ii), by striking the comma at the end and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8f855e50e4442a3bb47be0835041c59"><enum>(C)</enum><text>in clause (iii), by striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb3179090a0964792b2012b0eb7ab2118"><enum>(D)</enum><text>in clause (iv), by striking the period at the end and inserting a semicolon;</text></subparagraph></paragraph><paragraph id="idce197b4a85b14ad5832005cd792975bf"><enum>(5)</enum><text>by redesignating subparagraphs (D) through (I) as subparagraphs (F) through (K), respectively;</text></paragraph><paragraph id="id8e58720910dd4fd890cb87e3821cd772"><enum>(6)</enum><text>by inserting after the undesignated matter following subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaf83d3480d584bd6b0c108983fb8d888"><subparagraph id="id23ad8c6ed0f9482185ef5bbd8dcf321f"><enum>(D)</enum><text>ensure the professional integrity, including scientific integrity, of the discussion and analysis in an environmental document;</text></subparagraph><subparagraph id="idc5c040f75bf743f1a4d117fbfad58bf5"><enum>(E)</enum><text>make use of reliable existing data and resources in carrying out this Act;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae67cc3a65cb447d8584df09f5dd5f93"><enum>(7)</enum><text>by striking subparagraph (G) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id766E83A8E0154EABA580CB8FFCDD096A"><subparagraph commented="no" display-inline="no-display-inline" id="idc8e28336c8da42638466d804e08b03e2"><enum>(G)</enum><text>consistent with the requirements of this Act, study, develop, and describe technically feasible alternatives in the jurisdiction and authority of the Federal agency;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idc03b43140e0048f58f16bde99600c2f6" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text>in subparagraph (H) (as so redesignated), by inserting <quote>consistent with the requirements of this Act,</quote> before <quote>recognize</quote>.</text></paragraph></subsection><subsection id="id4e1818a1ba9b4523a19415bd6545f721"><enum>(b)</enum><header>Definitions</header><text>The National Environmental Policy Act of 1969 is amended by inserting after section 2 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref>) the following:</text><quoted-block id="iddda1d41edac4426c87745eab3bd395d2" display-inline="no-display-inline" style="OLC"><section id="id783cad11e71f45d2b1cbbfef249aff6b"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id1c932447275a4b1d90d2da9ffcc75f7d"><enum>(1)</enum><header>Alternative</header><text>The term <term>alternative</term> means an agency action, other than a proposed agency action, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf7d62cede5f74c2bb96a4054668f53de"><enum>(A)</enum><text display-inline="yes-display-inline">is technically and economically feasible;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13e536b87963462cbe0daf24b6c4dafb"><enum>(B)</enum><text>is within the jurisdiction of the Federal agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60fdead80b92450a985aca58a847cd0f"><enum>(C)</enum><text>meets the purpose and need of the proposed agency action; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id491ef70841ea407fa6b122956c34b77f"><enum>(D)</enum><text>meets the goals of the project sponsor. </text></subparagraph></paragraph><paragraph id="id5890807441224dac8e558e7b43a78b60" commented="no"><enum>(2)</enum><header>Authorization</header><subparagraph commented="no" display-inline="no-display-inline" id="id6bec4c1fe49848f19613ccf1b13f4609"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>authorization</term> means any license, permit, approval, finding, determination, or other administrative decision issued by a Federal agency that is required or authorized under Federal law to implement a proposed agency action.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb588834a09e4598be26f4328f459b7e"><enum>(B)</enum><header>Programmatic or planning actions</header><text>The term <term>authorization</term>, with respect to a proposed agency action that is a programmatic or planning action, does not include a site-specific decision that is intended to implement that action at a later date.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfeaba2b33c73412e96c6892e22fcad8e"><enum>(3)</enum><header display-inline="yes-display-inline">Categorical exclusion</header><text>The term <term>categorical exclusion</term> means a category of actions that a Federal agency has determined, according to procedures established by the Federal agency, do not normally have a significant effect on the human environment.</text></paragraph><paragraph id="idd4bc597723ea4342b98b02c765a2b257"><enum>(4)</enum><header>Cooperating agency</header><text>The term <term>cooperating agency</term> means any Federal agency or State, Tribal, or local agency that has been designated as a cooperating agency under section 111(a)(4).</text></paragraph><paragraph id="id0b514ffe056d435d861f630b364c5ecd" commented="no"><enum>(5)</enum><header>Council</header><text>The term <term>Council</term> means the Council on Environmental Quality.</text></paragraph><paragraph id="iddd1db93f6c73497690138b79f0e28a82"><enum>(6)</enum><header>Effects</header><subparagraph id="id04eaa24c23814264a5a38c1124e80107"><enum>(A)</enum><header>In general</header><text>The term <term>effects</term> means changes to the human environment as a result of a proposed agency action or an alternative, as applicable, to be carried out by a Federal agency that—</text><clause id="id2ea871238fac4d8b8f9d269f94c9d5a0"><enum>(i)</enum><text>are reasonably foreseeable, including changes that may occur not later than 10 years after the date on which the lead agency begins preparing an environmental document in an area directly affected by the proposed agency action or alternative, as applicable, such that an individual of ordinary prudence would take such occurrence into account in reaching a decision; and</text></clause><clause id="idad239210b309451daa2c3baa57d34540"><enum>(ii)</enum><text>have a proximate causal relationship to the proposed agency action or an alternative, as applicable.</text></clause></subparagraph><subparagraph id="id3719bdfc1df744f7a22401761a36da05"><enum>(B)</enum><header>Requirement</header><text>For purposes of subparagraph (A)(ii), a <term>but for</term> causal relationship is insufficient to establish a proximate causal relationship.</text></subparagraph></paragraph><paragraph id="id82de1312bf7e448da95ced747eaa6ab5"><enum>(7)</enum><header>Environmental assessment</header><text>The term <term>environmental assessment</term> means a concise public document prepared by a Federal agency to determine whether to prepare an environmental impact statement or a finding of no significant impact for a proposed agency action.</text></paragraph><paragraph id="idbd3f40ce1d3946d0826327427e352462"><enum>(8)</enum><header>Environmental document</header><text>The term <term>environmental document</term> includes an environmental assessment, a finding of no significant impact, a notice of intent, and an environmental impact statement.</text></paragraph><paragraph id="id8401066d467a4828913f68b7a88bae4d"><enum>(9)</enum><header>Environmental impact statement</header><text>The term <term>environmental impact statement</term> means a detailed statement required to be prepared for a major Federal action significantly affecting the quality of the human environment in accordance with title I.</text></paragraph><paragraph id="id67594d5a76774a7d947123c9c2c6bd5d" commented="no"><enum>(10)</enum><header>Environmental review</header><text>The term <term>environmental review</term> means the process of preparing, for a proposed agency action in accordance with this Act, an environmental impact statement, an environmental assessment, a categorical exclusion, a finding of no significant impact, or a record of decision.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb0e64da4b2648299960e950c08f073d"><enum>(11)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f3e179780bf41be931d2c5223c5d05c"><enum>(12)</enum><header>Finding of no significant impact</header><text>The term <term>finding of no significant impact</term> means a document prepared by a Federal agency briefly presenting the reasons why a proposed agency action, not subject to a categorical exclusion—</text><subparagraph commented="no" display-inline="no-display-inline" id="id46168503e11c4fb587eb216b1bf35eed"><enum>(A)</enum><text display-inline="yes-display-inline">will not have a significant effect on the human environment; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf68a82de18e4a73ab957f3f1e62b4bf"><enum>(B)</enum><text display-inline="yes-display-inline">will not have an environmental impact statement prepared for the action.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d288d01c26c4d7ebea1c901386d9590"><enum>(13)</enum><header>Involved Federal agency</header><text>The term <term>involved Federal agency</term> means a Federal agency that, with respect to a proposed agency action—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida5ab8f284a494d4faf3baee720daaf7a"><enum>(A)</enum><text display-inline="yes-display-inline">proposed the action; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a04e9cfa4a442e598da2c937fe0d6f7"><enum>(B)</enum><text>is involved in the action because the action is directly related, through functional interdependence or geographic proximity, to an action the Federal agency has taken or has proposed to take.</text></subparagraph></paragraph><paragraph id="idd228afda6e59476b9ae58f0057480dba"><enum>(14)</enum><header>Lead agency</header><text>The term <term>lead agency</term> means the agency or agencies, in the case of joint lead agencies, preparing or having taken primary responsibility for carrying out any requirements relating to an environmental review for a proposed agency action pursuant to this Act.</text></paragraph><paragraph id="id173dac25d9284c3eb184cd9a84938cb0"><enum>(15)</enum><header>Major Federal action</header><subparagraph id="id9a6d2076f4424ff19f49994d31b34c30"><enum>(A)</enum><header>In general</header><text>The term <term>major Federal action</term> means an action that the Federal agency carrying out the action determines is subject to substantial Federal control and responsibility.</text></subparagraph><subparagraph id="id672d3df21c484c1eb8091af6f5aa7a8e"><enum>(B)</enum><header>Exclusions</header><text>The term <term>major Federal action</term> does not include—</text><clause id="idebb7cee3429d490ab79edfeebe9d5ae9"><enum>(i)</enum><text>a non-Federal action—</text><subclause id="id3a008447e6c84e48a13c7e2ac5b2787a"><enum>(I)</enum><text>with no or minimal Federal funding;</text></subclause><subclause id="id8d87fdff164b41bcb70f40ddb0f95e83"><enum>(II)</enum><text>with no or minimal Federal involvement where a Federal agency cannot control the outcome of the project; or</text></subclause><subclause id="id0d77380d027f40eeb2e164fb06f88f7f"><enum>(III)</enum><text>that does not include Federal land;</text></subclause></clause><clause id="id52801f29da97449592d54ae09374c22f"><enum>(ii)</enum><text>funding assistance solely in the form of general revenue sharing funds that do not provide Federal agency compliance or enforcement responsibility over the subsequent use of those funds;</text></clause><clause id="id6cb881c9b1834553807cd13e4a265ece"><enum>(iii)</enum><text>loans, loan guarantees, or other forms of financial assistance where a Federal agency does not exercise sufficient control and responsibility over the effect of the action;</text></clause><clause id="idd3a660034ae0427595300016bd698053"><enum>(iv)</enum><text>farm ownership and operating loan guarantees by the Farm Service Agency pursuant to sections 305 and 311 through 319 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1925">7 U.S.C. 1925</external-xref>, 1941–1949);</text></clause><clause id="id58d2489565e44c62a011d192012af685"><enum>(v)</enum><text>business loan guarantees provided by the Small Business Administration pursuant to subsection (a) or (b) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>), or title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>);</text></clause><clause id="id60c26e8fb3e14a55b4fc28c88f5933a4"><enum>(vi)</enum><text>bringing judicial or administrative civil or criminal enforcement actions; or</text></clause><clause id="id1d8cb7e174a24fb5bf46ed21c1deddfe"><enum>(vii)</enum><text>extraterritorial activities or decisions, including agency activities or decisions with effects located entirely outside of the jurisdiction of the United States.</text></clause></subparagraph><subparagraph id="id9a87726d9ed24a4a98193e65744176ea"><enum>(C)</enum><header>Determination</header><text>An agency action may not be determined to be a major Federal action solely on the basis of—</text><clause id="idebc74e3edb59420da45a10a65e500474"><enum>(i)</enum><text>an interstate effect of the action or related project; or</text></clause><clause id="idfcb95685d317498cb7dfbd7789d59c91"><enum>(ii)</enum><text>the provision of Federal funds for the action or related project.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11d283b4875a45edb6f3540b600e44ad"><enum>(16)</enum><header>Notice of intent</header><text>The term <term>notice of intent</term> means a public notice that a Federal agency intends to prepare and consider an environmental impact statement for a proposed agency action.</text></paragraph><paragraph id="id29d9b91f46cf4c048f5e5a00ec134851"><enum>(17)</enum><header>Page</header><text>The term <term>page</term> means a page that contains not more than 500 words, not including any explanatory maps, diagrams, graphs, tables, or other means of graphically displaying quantitative or geospatial information.</text></paragraph><paragraph id="idbe16c99f5c284e149219c9ae86958391"><enum>(18)</enum><header>Project sponsor</header><text>The term <term>project sponsor</term> means the agency or other entity, including any private or public-private entity, that seeks an authorization for a proposed agency action.</text></paragraph><paragraph id="id7961827eb8f64c3996455c1b6cd696ea" commented="no"><enum>(19)</enum><header>Proposed agency action</header><text>The term <term>proposed agency action</term> means an action at a stage when a Federal agency—</text><subparagraph commented="no" display-inline="no-display-inline" id="idffb9d77a5ba0457a8ac53fbf98f1ff56"><enum>(A)</enum><text display-inline="yes-display-inline">has a goal;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32f0d15a770a44d19d04a1f5f64252e5"><enum>(B)</enum><text display-inline="yes-display-inline">is actively preparing to make a decision on 1 or more alternatives to accomplish that goal; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1887fb821db44778083d43413c224ca"><enum>(C)</enum><text>can meaningfully evaluate the effects of the action.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7e5a21eba604ec7bae9d27ff17aa6c2"><enum>(20)</enum><header>Special expertise</header><text>The term <term>special expertise</term>, with respect to a proposed agency action, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2285cc92b1cf49749948f03e3021a14a"><enum>(A)</enum><text>having statutory responsibility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53df5966542a44bfb82cb4b9cfe6b2e8"><enum>(B)</enum><text>that the proposed agency action aligns with the mission of a Federal agency; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1207f2e4ebf34e299a649618eaa75ed9"><enum>(C)</enum><text>having related program experience relating to that proposed agency action.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="iddd04ae75d6db40149f6b0d99750326c8"><enum>(c)</enum><header display-inline="yes-display-inline">Procedure for determination of level of review</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8194FB321B704A1089488F3BA6AF5B0E"><section id="ida4e4376c73644bc6b66f9a6a91d47780"><enum>106.</enum><header>Procedure for determination of level of review</header><subsection id="ide7ef586b277c486b8d30aa9f39c683d1"><enum>(a)</enum><header>Threshold determinations</header><text>A Federal agency shall not be required to prepare an environmental document with respect to a proposed agency action if—</text><paragraph id="idba77cb97a710444aba563fd1aaf41ae2"><enum>(1)</enum><text>the proposed agency action is not a final agency action (within the meaning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code);</text></paragraph><paragraph id="ide8b543a4da334522b1998a1683859636"><enum>(2)</enum><text>the proposed agency action is covered by a categorical exclusion established by the agency, a Federal agency, or any other provision of law;</text></paragraph><paragraph id="id009f694b79a14f1e9e9143ac4bc655c4"><enum>(3)</enum><text>the preparation of an environmental document would clearly and fundamentally conflict with the requirements of another provision of law;</text></paragraph><paragraph id="id23ca4580c39c405d936c24c19c211176"><enum>(4)</enum><text>the proposed agency action is, in whole or in part, a nondiscretionary action with respect to which the agency does not have authority to take environmental factors into consideration in determining whether to carry out the proposed action;</text></paragraph><paragraph id="idb24ae783d93141e1a6998efc28c39645"><enum>(5)</enum><text>the proposed agency action is a rulemaking that is subject to section 553 of title 5, United States Code; or</text></paragraph><paragraph id="id2cfa59316946496084cc007a275355d5"><enum>(6)</enum><text>the proposed agency action is an action for which the compliance of the agency with the requirements of another law serves the same or similar function as the requirements of this Act with respect to the action.</text></paragraph></subsection><subsection id="id8a8a368b831842e6972c6775afd5dd9c"><enum>(b)</enum><header>Levels of review</header><paragraph id="idac1ba452c78349c79814aeb6adc5347d"><enum>(1)</enum><header>Environmental impact statement</header><text>Pursuant to section 102(2)(C), a Federal agency shall issue an environmental impact statement with respect to a major Federal action that has a significant effect on the quality of the human environment.</text></paragraph><paragraph id="id983f4748e1fe45a3be193f2222a2b2b1"><enum>(2)</enum><header>Environmental assessment</header><subparagraph commented="no" display-inline="no-display-inline" id="id19abeb7a5f074d2586043905321c6ea0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A Federal agency shall prepare an environmental assessment with respect to a proposed agency action—</text><clause commented="no" display-inline="no-display-inline" id="ideb2cb7c998f2499ca8c90123ea3eb126"><enum>(i)</enum><text display-inline="yes-display-inline">that is not likely to have a significant effect on the quality of the human environment; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id7ca643b5f8144c98a4a4a24e0fd571a0"><enum>(ii)</enum><text display-inline="yes-display-inline">for which the significance of the effect on the quality of the human environment is unknown.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id260d167a7a2e4b08b8149e54f313c072"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">An environmental assessment prepared under subparagraph (A) shall be a concise public document prepared by a Federal agency that briefly provides evidence and analysis for determining whether to prepare an environmental impact statement or a finding of no significant impact.</text></subparagraph></paragraph><paragraph id="id0b2e7a815a3947f69885b3cbb7f649e4"><enum>(3)</enum><header>Sources of information</header><text>In making a determination under this subsection, an agency—</text><subparagraph id="idc9cd3b7c589044e986db8ba013c513e7"><enum>(A)</enum><text>may make use of any reliable data source; and</text></subparagraph><subparagraph id="id88c48bc87c4547e78853677edbdc2eff"><enum>(B)</enum><text>shall not be required to carry out new scientific or technical research.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ideb2bcaef4d83486cacd544dac8528164"><enum>(d)</enum><header>Environmental impact statement requirements</header><paragraph id="id26cdb1ab7e3e44ce8d63478bf0cf795e"><enum>(1)</enum><header>In general</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) (as amended by subsection (c)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18a56e6fcb904741b8cbd84704924da1"><section id="idd1402576d9cd4de794946b615eadc138"><enum>107.</enum><header>Environmental impact statement requirements</header><subsection id="idd8f677b9c7e4405fb69aac5a59fc0f73"><enum>(a)</enum><header>Statement of purpose and need</header><paragraph commented="no" display-inline="no-display-inline" id="id9735479d683f4c9ca3df4edac5972e96"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), an environmental impact statement shall briefly specify—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33b644652448428aabecf48025dc2a6e"><enum>(A)</enum><text display-inline="yes-display-inline">the underlying purpose and need to which a Federal agency is responding; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id183941ce37ee45d48762ff1e8fab3a13"><enum>(B)</enum><text>the major Federal action, at least 1 alternative, and the effects of the major Federal action and any alternative.</text></subparagraph></paragraph><paragraph id="id9f173ba29e6646a1a9d59740def6a8ab"><enum>(2)</enum><header>Statutory authority</header><text>When the statutory duty of a Federal agency is to review an application for a proposed agency action, the Federal agency shall base the purpose and need to which the Federal agency is responding on the goals of the project sponsor and the authority of the Federal agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3758dfa2f5c64037a512bf3b379b81b9"><enum>(b)</enum><header>Cover sheet</header><text>The cover sheet for an environmental impact statement shall include a statement of the estimated total cost of preparing the environmental impact statement, including the costs of Federal agency full-time equivalent personnel hours, contractor costs, and other direct costs.</text></subsection><subsection id="id0a61eda43d0d4dcab8585bb65d9565d6"><enum>(c)</enum><header>Page limits</header><paragraph commented="no" display-inline="no-display-inline" id="id861b69e120be4e379ab08ca3f6de22c7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), an environmental impact statement for a major Federal action shall not exceed 150 pages.</text></paragraph><paragraph id="id801ba65f4ed44ef48f4896558cefe383"><enum>(2)</enum><header>Unusual complexity</header><text>An environmental impact statement for a major Federal action of unusual complexity, as determined by the applicable Federal agency, shall not exceed 300 pages.</text></paragraph></subsection><subsection id="idcf416184d59548349a9078208f7f4bb9"><enum>(d)</enum><header>Timeline for preparing an environmental impact statement</header><paragraph id="ide09431ec3f634638a0b200cb305ec1f9"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date on which a Federal agency issues a notice of intent for a major Federal action, the Federal agency shall publish in the Federal Register the final environmental impact statement or notice of availability of the final environmental impact statement for the major Federal action.</text></paragraph><paragraph id="id5125a3e630de42068947fd2e5e0b1931"><enum>(2)</enum><header>Failure to act</header><subparagraph commented="no" display-inline="no-display-inline" id="id02ed39eb26cf49de84dc919a4cc96226"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a Federal agency fails to publish a final environmental impact statement or notice of availability of the final environmental impact statement in accordance with the timeline described in paragraph (1), and the timeline has not been extended in accordance with paragraph (3), the requirements of this title shall be deemed to have been fulfilled for the major Federal action.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3676e9e5c4e4475ead2e3a5f1f03743c"><enum>(B)</enum><header>No judicial review</header><text display-inline="yes-display-inline">A major Federal action deemed to fulfill the requirements of this title under subparagraph (A) shall not be subject to judicial review under this title or subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subparagraph></paragraph><paragraph id="id3734eda9eeb743e4ab44e1315ab7becc"><enum>(3)</enum><header>Extension</header><text>The timeline established under paragraph (1) may only be extended if—</text><subparagraph id="id6a6e77bda31d40b79819f404d66b7abc"><enum>(A)</enum><text>the extension is requested, in writing, by the project sponsor; and</text></subparagraph><subparagraph id="id16d789073f0e48b594895d67b3ca0364"><enum>(B)</enum><text>the applicable Federal agency concurs, in writing, with the extension.</text></subparagraph></paragraph></subsection><subsection id="id28f0fee0443045759cc5a93153bf98b4"><enum>(e)</enum><header>Specificity of comments and information</header><paragraph id="id5e7fabbb26444e3d80fde9a3c37316e1"><enum>(1)</enum><header>Request for public comment</header><text>A notice of availability of a draft environmental impact statement or draft environmental impact statement published in the Federal Register shall include a request for public comment, within a comment period provided by the applicable Federal agency, on—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6b1ff714880f4c028fe8022c0fb0f71e"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable major Federal action, at least 1 alternative to the major Federal action, and the effects of each; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfda8fcf8506343d7ae42e92e7c525d57"><enum>(B)</enum><text display-inline="yes-display-inline">relevant information, studies, or analyses with respect to the applicable major Federal action.</text></subparagraph></paragraph><paragraph id="idecaa53a7fe4e48ff80eea5d9c4e1d9b3"><enum>(2)</enum><header>Comments on draft environmental impact statements</header><text>Comments and objections relating to a draft environmental impact statement for a major Federal action shall be raised within a comment period provided by the applicable Federal agency, as described in paragraph (1).</text></paragraph><paragraph id="id3d7e065713ec4d5982189e71756667c4"><enum>(3)</enum><header>Unexhausted and forfeited comments</header><text>Comments and objections not provided within a comment period described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id29844cb756314bcb96620c5d81aa3c24"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered unexhausted and forfeited; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4ee6aeab5c543afbe4ade39f5f978c3"><enum>(B)</enum><text>shall not be grounds for judicial review.</text></subparagraph></paragraph></subsection><subsection id="id6236647bc6684ce4af3d0af1f39ade84"><enum>(f)</enum><header>Record of decision</header><text display-inline="yes-display-inline">Each record of decision prepared for a final environmental impact statement by a Federal agency for a major Federal action shall—</text><paragraph id="idb1d15f6669094e458f6c32b137117e95"><enum>(1)</enum><text>contain a statement certifying that the Federal agency considered at least 1 alternative and information and analyses relating to the major Federal action submitted during the process of carrying out the requirements of this title; and</text></paragraph><paragraph id="id6ef2958badb3410c8501e31dae79cf8a"><enum>(2)</enum><text>be issued not later than 90 days after the date on which the Federal agency publishes the final environmental impact statement or notice of availability of the final environmental impact statement in the Federal Register.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc27b7bbb18c443f8cd5e26ccd37da2a"><enum>(g)</enum><header>Deadline for issuance of authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="id75922e2677ff43f885998e9b52921398"><enum>(1)</enum><header display-inline="yes-display-inline">Environmental impact statements</header><text>For a major Federal action for which a record of decision described in subsection (f) is prepared, all authorizations required under any other Federal law associated with the record of decision shall be issued not later than 90 days after the date on which the Federal agency publishes the final record of decision or notice of availability of the record of decision for the major Federal action in the Federal Register.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21c7c602f9d2468286267b8041402cd3"><enum>(2)</enum><header>Deemed fulfilled</header><text>For a major Federal action deemed to have fulfilled the requirements of this title under subsection (d)(2)(A), all authorizations required under any other Federal law shall be issued not later than 90 days after the date on which the requirements were deemed to have been fulfilled under that subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id2e37fbfc199c40bbab9fe3d9bfc78c68"><enum>(2)</enum><header>Conforming amendments</header><text>Section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)</external-xref>) (as amended by subsection (a)) is amended—</text><subparagraph id="id1b0151437f9b4088b46e1d6d5ca86a3a"><enum>(A)</enum><text>in subparagraph (C)—</text><clause id="id05b397a7a9ca4593961ff8fb78f63b8c"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>a detailed statement</quote> and inserting <quote>an environmental impact statement</quote>; and</text></clause><clause id="ida3befd0084884cfe8b6cbebb6539e53d"><enum>(ii)</enum><text>in the undesignated matter following clause (iii), in the first sentence, by striking <quote>Prior to making any detailed statement</quote> and inserting <quote>Prior to preparing an environmental impact statement</quote>; and</text></clause></subparagraph><subparagraph id="id8d9b33e254e246fb9ba569616aeb0a4f"><enum>(B)</enum><text>in subparagraph (F)—</text><clause id="id8f3080c3efef4728a2afa264d66b2ba7"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>detailed statement</quote> and inserting <quote>environmental impact statement</quote>; and</text></clause><clause id="id84ecdcee08854157a8d88943369e5b70"><enum>(ii)</enum><text>in clause (iv), by striking <quote>detailed statement</quote> and inserting <quote>environmental impact statement</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="id9a28730601cd4a46a0e74651dfc7566c"><enum>(e)</enum><header>Environmental assessment requirements</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) (as amended by subsection (d)(1)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id54dccd9aede44c9b8c25b3033bed1a11"><section id="idfd7a0fe59ab445d385faa6e180654875"><enum>108.</enum><header>Environmental assessment requirements</header><subsection id="id8BA50825F11C4C05812367F4808545B9"><enum>(a)</enum><header>Statement of purpose and need</header><paragraph commented="no" display-inline="no-display-inline" id="idF5596D2575F74A77A881330C5B324D35"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), an environmental assessment shall briefly specify—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB1184C40EED841E29716BF83C8CFB898"><enum>(A)</enum><text display-inline="yes-display-inline">the underlying purpose and need to which a Federal agency is responding; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C7E66EED5CB40BA9484434DB5FDB876"><enum>(B)</enum><text>the proposed agency action and the effects of the proposed agency action.</text></subparagraph></paragraph><paragraph id="idF1AF203921F34BA4BE7461B26363022D"><enum>(2)</enum><header>Statutory authority</header><text>When the statutory duty of a Federal agency is to review an application for a proposed agency action, the Federal agency shall base the purpose and need to which the Federal agency is responding on the goals of the project sponsor and the authority of the Federal agency.</text></paragraph></subsection><subsection id="id33d4eb2fef8841f2ac1aed0dd658414f"><enum>(b)</enum><header>Time limit for preparing and environmental assessment</header><paragraph id="id41baddeb63a442ce89affd9c21f1dfb5"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which a Federal agency decides to prepare an environmental assessment for a proposed agency action, the Federal agency shall publish in the Federal Register—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddb95979b926b43f1b2f19eedddf12cfa"><enum>(A)</enum><text display-inline="yes-display-inline">a notice of availability of the environmental assessment; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb79e536a15749d0843c3f2b94ba9b44"><enum>(B)</enum><text display-inline="yes-display-inline">the associated finding of no significant impact or notice of availability of the associated finding of no significant impact or notice of intent, as applicable.</text></subparagraph></paragraph><paragraph id="id1e230cc6d1cb4609abf20af61e7b78a7"><enum>(2)</enum><header>Failure to act</header><subparagraph commented="no" display-inline="no-display-inline" id="id6bed6baa3d34481fa250d781d816080a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a Federal agency fails to publish a notice of availability of the environmental assessment and associated finding of no significant impact or notice of intent, as applicable, in accordance with the timeline described in paragraph (1), and the timeline has not been extended in accordance with paragraph (3), the proposed agency action shall be deemed to have no significant impacts and the requirements of this title shall be deemed to have been fulfilled for that proposed agency action.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7c665d381b743ffb56e3acda11d29cd"><enum>(B)</enum><header>No judicial review</header><text display-inline="yes-display-inline">A proposed agency action deemed to have no significant impacts and to fulfill the requirements of this title under subparagraph (A) shall not be subject to judicial review under this title or subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subparagraph></paragraph><paragraph id="idc5bc1905a4544da6b31dd6a0d7e63828"><enum>(3)</enum><header>Extension</header><text>The timeline established under paragraph (1) may only be extended if—</text><subparagraph id="idd6e99daedc1343f598ab99d951d42a7d"><enum>(A)</enum><text>the extension is requested, in writing, by the project sponsor; and</text></subparagraph><subparagraph id="id5d981df77bd24e929916aa1082f302ef"><enum>(B)</enum><text>the Federal agency concurs, in writing, with the extension.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8013911c02d64cfbb034899a7dd7444f"><enum>(4)</enum><header>Deadline for issuance of authorizations</header><subparagraph commented="no" display-inline="no-display-inline" id="id18d4843b3d8f4e5ba36176e5197e56f6"><enum>(A)</enum><header display-inline="yes-display-inline">Materials published</header><text>For a proposed agency action for which the materials described in subparagraphs (A) and (B) of paragraph (1) were published in the Federal Register, all authorizations required under any other Federal law shall be issued not later than 90 days after the date on which those materials were published.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3fefe65734b4023acc97095bb309a00"><enum>(B)</enum><header>Deemed to have no significant impacts</header><text>For a proposed agency action that is deemed to have no significant impacts and for which the requirements of this title are deemed to have been fulfilled under paragraph (2)(A), all authorizations required under any other Federal law shall be issued not later than 90 days after the date on which the proposed agency action was so deemed under that paragraph.</text></subparagraph></paragraph></subsection><subsection id="id56a2903659af49029be4b371bac0fd84"><enum>(c)</enum><header>Page limits</header><text>An environmental assessment shall not exceed 75 pages, unless otherwise approved and established, in writing, by the head of the lead agency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida71652db879747d79bdc05d204f6f81d"><enum>(f)</enum><header>Adoption of categorical exclusions</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) (as amended by subsection (e)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1C10B076A7FE4D7EA43FF1D3615BE407"><section id="idb95d4100785449bfb6697418a53b6ddf"><enum>110.</enum><header>Adoption of categorical exclusions</header><text display-inline="no-display-inline">A categorical exclusion established by a Federal agency for a category of proposed agency actions shall be adopted by all other Federal agencies and applied to any proposed agency action that is within the category of proposed agency actions for which the categorical exclusion was established.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8f95567ca93e49b894e941990b92f654"><enum>(g)</enum><header>Efficient reviews</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) (as amended by subsection (f)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddd6d556ae13640ef9aa4bfdddb041381"><section id="id57dae7254b4b48db8fbba9659466fa85"><enum>111.</enum><header>Efficient reviews</header><subsection commented="no" display-inline="no-display-inline" id="idc9b7148a1cda420ea3b1a4a3c4dcbda3"><enum>(a)</enum><header>Designation of lead agency</header><paragraph commented="no" display-inline="no-display-inline" id="id20bdb84993a54c868b6873c9b91b7cda"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If there are 2 or more involved Federal agencies that have authority with respect to a proposed agency action, the involved Federal agencies shall determine, by letter or memorandum, which Federal agency shall be the Federal lead agency based on consideration of the following factors:</text><subparagraph id="id2d93d8ef2ceb41c299d9cb5cda135ec8"><enum>(A)</enum><text>Magnitude of the involvement of each Federal agency.</text></subparagraph><subparagraph id="idf628d1c6627e43beb4641079e04ac840"><enum>(B)</enum><text>Special expertise concerning the effects of the proposed agency action.</text></subparagraph><subparagraph id="idb276ef6a604c4514802ff328d32e3131"><enum>(C)</enum><text>Duration of the involvement of each Federal agency.</text></subparagraph></paragraph><paragraph id="idc84bd5f1617c4bafb3915f89f149e180"><enum>(2)</enum><header>Joint lead agencies</header><subparagraph commented="no" display-inline="no-display-inline" id="idb71903024e324ed2862f6044f8a2ecb2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In making a determination under paragraph (1), the involved Federal agencies may appoint State, Tribal, or local agencies as joint lead agencies, as determined appropriate by the involved Federal agencies.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32a365178a0e4c7ab4d3960b6f47cdd8"><enum>(B)</enum><header>Roles</header><text display-inline="yes-display-inline">Joint lead agencies shall jointly fulfill the role described in paragraph (3).</text></subparagraph></paragraph><paragraph id="id5c5cc5addbe44a5d97de9b6328414193"><enum>(3)</enum><header>Role</header><text>A lead agency shall, with respect to a proposed agency action—</text><subparagraph id="id5c982491300f4899a52ff491c2759594"><enum>(A)</enum><text>supervise the preparation of an environmental document if, with respect to the proposed agency action, there is more than 1 involved Federal agency;</text></subparagraph><subparagraph id="id62855a7d5ac44024a6667791391eed69"><enum>(B)</enum><text>request the participation of each cooperating agency at the earliest practicable time;</text></subparagraph><subparagraph id="id442f44e7d1374eca9e63a5a2b998f006"><enum>(C)</enum><text>in preparing an environmental document, give consideration to any analysis or proposal created by a cooperating agency with jurisdiction by law or with special expertise;</text></subparagraph><subparagraph id="idf93baeae0451466ca8d64b8950346135"><enum>(D)</enum><text>develop a schedule with concurrent reviews, in consultation with each involved Federal agency, the project sponsor, and such other entities as the lead agency determines appropriate, for completion of any environmental review or authorization relating to the proposed agency action;</text></subparagraph><subparagraph id="id9ecdb8c9fd8646a6847bb39e0f220f8f"><enum>(E)</enum><text>if the lead agency determines that an authorization will not be completed in accordance with the schedule developed under subparagraph (D), notify the Federal agency responsible for issuing the authorization and request that the agency take such measures as the agency determines appropriate to comply with the schedule; and</text></subparagraph><subparagraph id="id62474a99c162493f8ff4bc181088e198"><enum>(F)</enum><text>meet with a cooperating agency that requests a meeting.</text></subparagraph></paragraph><paragraph id="id88b3e83bb59d47dfbc3eb74a6c31e644"><enum>(4)</enum><header>Cooperating agency</header><subparagraph commented="no" display-inline="no-display-inline" id="idbb389e4f6ed844c191cd9a27ef07099a"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">The lead agency may, with respect to a proposed agency action, designate any involved Federal agency or a State, Tribal, or local agency as a cooperating agency. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9279bc9114c04d9ab7f9931bc20baf0d"><enum>(B)</enum><header>Submission of comments</header><text display-inline="yes-display-inline">A cooperating agency may, not later than a date specified by the lead agency, submit comments to the lead agency, which shall be limited to matters relating to the proposed agency action with respect to which the cooperating agency has special expertise or jurisdiction by law with respect to an environmental issue.</text></subparagraph></paragraph><paragraph id="ida06087863d9d4372afbe873c1f111e53"><enum>(5)</enum><header>Request for designation of a Federal lead agency</header><subparagraph commented="no" display-inline="no-display-inline" id="id8cb3ff8c3195452690c74c56957329a9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A project sponsor or any Federal agency or State, Tribal, or local agency that is substantially affected by the lack of a designation of a lead agency with respect to a proposed agency action under paragraph (1) may submit a written request for such a designation to each involved Federal agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafa01b64452540248eed5a6b16d11711"><enum>(B)</enum><header>Submission</header><text display-inline="yes-display-inline">An agency that receives a request under subparagraph (A) shall submit the request to each involved Federal agency and the Council.</text></subparagraph></paragraph><paragraph id="id524e270622a7413c811370d4985b9b72"><enum>(6)</enum><header>Council designation of a Federal lead agency</header><subparagraph id="idbe7910749dd74e16ad777f183603f8ef"><enum>(A)</enum><header>Request</header><clause commented="no" display-inline="no-display-inline" id="id238cadf6403e4157841341d56e269e5d"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not earlier than 45 days after the date on which a request is submitted under paragraph (5), if no designation has been made under paragraph (1), the project sponsor or a Federal agency or State, Tribal, or local agency that is substantially affected by the lack of a designation of a lead agency may request that the Council designate a Federal lead agency. </text></clause><clause commented="no" display-inline="no-display-inline" id="idd15447a9708b43e7b8c999f77e5fb502"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">A request made under clause (i) shall include—</text><subclause id="id41b0e182e77a4ef0a1fefbe3b813aeaf"><enum>(I)</enum><text>a precise description of the nature and extent of the proposed agency action; and</text></subclause><subclause id="id31f14d98cedd43128f94db662dce1800"><enum>(II)</enum><text>a detailed statement with respect to each involved Federal agency and each factor described in subparagraphs (A) through (D) of paragraph (1) with respect to which Federal agency should serve as the Federal lead agency.</text></subclause></clause></subparagraph><subparagraph id="id51985cc4512f4e7b9850b98d93591921"><enum>(B)</enum><header>Submission</header><text>The Council shall submit a request received under subparagraph (A) to each involved Federal agency.</text></subparagraph><subparagraph id="id3cbac1387aeb4a90ad83dc38fa1cd7f5"><enum>(C)</enum><header>Response</header><text>An involved Federal agency may, not later than 20 days after the date of the submission of a request under subparagraph (A), submit to the Council a response to the request.</text></subparagraph><subparagraph id="ide0d465a839484fbc8c1bc1af9010dad6"><enum>(D)</enum><header>Designation</header><text>Not later than 40 days after the date on which an agency or a project sponsor submits a request under subparagraph (A)(i), the Council shall designate the Federal lead agency with respect to the applicable proposed agency action. </text></subparagraph></paragraph></subsection><subsection id="idc499556569224d57a481b798766080be"><enum>(b)</enum><header>Single environmental document and joint record of decision</header><paragraph id="id8569e18c84ff4dccb8e30830dff40009"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4), all authorizations relating to a proposed agency action shall rely on a single environmental document and joint record of decision for each kind of environmental document and joint record of decision prepared under this title under the leadership of a lead agency.</text></paragraph><paragraph id="idfff9b0628654419f8c6b59dd0de935cf"><enum>(2)</enum><header>Use of environmental document and record of decision</header><subparagraph id="id025eb26992fa44a5ae33f94cbe8b2ce7"><enum>(A)</enum><header>In general</header><text>The lead agency shall develop environmental documents and records of decision sufficient to satisfy the requirements for any authorization or other action required for or related to a proposed agency action, including authorizations by other Federal agencies.</text></subparagraph><subparagraph id="id8f5014635b8a4bcba5cda753115cee70"><enum>(B)</enum><header>Cooperation of involved Federal agencies</header><text>Involved Federal agencies shall—</text><clause commented="no" display-inline="no-display-inline" id="idcb3a76a7972c48478dfe823235544150"><enum>(i)</enum><text display-inline="yes-display-inline">cooperate with the lead agency; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idcae982650f8d4ea5b7ef2e71a88aa896"><enum>(ii)</enum><text display-inline="yes-display-inline">provide timely information to assist the lead agency in carrying out the requirements of this subsection.</text></clause></subparagraph></paragraph><paragraph id="ide06a1c26b90d4f889fc764a075f15299"><enum>(3)</enum><header>Treatment as involved Federal agencies</header><text>A Federal agency with responsibility to issue an authorization or take an action for or related to a proposed agency action shall work with the lead agency to ensure that the agency issuing the authorization or taking the action is treated as an involved Federal agency for the action.</text></paragraph><paragraph id="id01af08f799244d93bd7d96b03a44f6e0"><enum>(4)</enum><header>Exceptions</header><text>The lead agency may waive the requirements of paragraph (1) with respect to a proposed agency action if—</text><subparagraph id="id097c149e4a044101a1e42f00927e223d"><enum>(A)</enum><text>the project sponsor requests that agencies issue separate environmental documents; or</text></subparagraph><subparagraph id="id25d3bdc831984611b88c27af5b5838f8"><enum>(B)</enum><text>the obligations of a cooperating agency or other involved Federal agency under this title have already been satisfied with respect to the proposed agency action.</text></subparagraph></paragraph></subsection><subsection id="id158e9e77fca149cc9d1245a6126e1841"><enum>(c)</enum><header>Scope of review</header><text>In developing an environmental document for a proposed agency action, the lead agency and any other involved Federal agencies shall only consider the effects of the proposed agency action that—</text><paragraph id="id4707fd67b7494c8bb8840080505ab090"><enum>(1)</enum><text>occur on Federal land; or</text></paragraph><paragraph id="idd04e1a75bcf6441eac95963469202403"><enum>(2)</enum><text>are subject to Federal control and responsibility. </text></paragraph></subsection><subsection id="ida89fde8a10194110a38a782da72dc08a"><enum>(d)</enum><header>Project sponsor preparation</header><paragraph commented="no" display-inline="no-display-inline" id="id9cf304362cb44a7eade0266d1ab4b29a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A lead agency shall allow a project sponsor to prepare an environmental document for a proposed agency action on request of the project sponsor. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide878709f2a124ca489d561285bee8058"><enum>(2)</enum><header>Guidance</header><text display-inline="yes-display-inline">A lead agency may provide a project sponsor that elects to prepare an environmental document under paragraph (1) with appropriate guidance and assistance in the preparation of that environmental document.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7f74fbb1538d4fe6ae1ff539175d78e4"><enum>(3)</enum><header>Independent verification</header><text display-inline="yes-display-inline">A lead agency shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0f943be601e1476d822f29731bba55f2"><enum>(A)</enum><text display-inline="yes-display-inline">independently evaluate the environmental document prepared by a project sponsor under paragraph (1); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd55152347ade49f79f7a99506591e1a6"><enum>(B)</enum><text display-inline="yes-display-inline">take responsibility for the contents of the environmental document on adoption.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7ace2073739f44cfae281a9ded8cde89"><enum>(h)</enum><header>Judicial review</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) (as amended by subsection (g)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCD5EB0627ADB4F61B3680F20383751B2"><section id="id34621825c3b74bb1baea02722619dcc2"><enum>112.</enum><header>Judicial review</header><subsection id="id9aa7748dce8549a8950d701681c6d661" commented="no"><enum>(a)</enum><header>Definition of covered cause of action</header><text display-inline="yes-display-inline">In this section, the term <term>covered cause of action</term> means a cause of action that—</text><paragraph id="id5c8800ffecdf450cb0c7da3a006758d3" commented="no"><enum>(1)</enum><text>is filed on or after the date of enactment of this section; and</text></paragraph><paragraph id="ided71b0a0215845b4ad951ca78038c1b3" commented="no"><enum>(2)</enum><text>seeks judicial review—</text><subparagraph commented="no" display-inline="no-display-inline" id="id50aef49ec1464cc9ba85f726fa874a02"><enum>(A)</enum><text display-inline="yes-display-inline">of a record of decision or finding of no significant impact based on a claim that an environmental review was improperly conducted or an environmental document is invalid under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fb028e70efc49f189dafd92f3b777f1"><enum>(B)</enum><text display-inline="yes-display-inline">under Federal law of an authorization issued under section 107(g) or 108(b)(4).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id78b8928adefe4e75bd064135a57e2ec1"><enum>(b)</enum><header>Termination of cause of action</header><paragraph commented="no" display-inline="no-display-inline" id="ide9bdd534a827474294e8ecb6b4679a9a"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="ide970ac309aba448e9ded140df47d3636"><enum>(A)</enum><header>Fully constructed</header><text>The term <term>fully constructed</term>, with respect to a project or activity, means that construction of the project or activity was completed—</text><clause commented="no" display-inline="no-display-inline" id="idc7d8abadd8dc4f60a9c585dfed79bfc8"><enum>(i)</enum><text display-inline="yes-display-inline">on the date of enactment of this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id487c87d6ef234708b36f5db5d92361fb"><enum>(ii)</enum><text>at some point during the 180-day period preceding that date of enactment.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3c420b71264d492ab38a775cefbdbab9"><enum>(B)</enum><header>Operational</header><text display-inline="yes-display-inline">The term <term>operational</term>, with respect to a project or activity, means that the project or activity is in operation in some form, including test mode—</text><clause commented="no" display-inline="no-display-inline" id="idba3707d6c2024d04a25a2d68056d33f8"><enum>(i)</enum><text display-inline="yes-display-inline">on the date of enactment of this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2e8f30dd0cce43788002e49ef16e9096"><enum>(ii)</enum><text>at some point during the 180-day period preceding that date of enactment.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idadf8e3dfc8c1417a85c75e4dc94e01d1"><enum>(2)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">Any claim (including any claim pending in a court on the date of enactment of this section) that seeks judicial review of a record of decision or finding of no significant impact based on an objection that an environmental review was improperly conducted, and any claim that seeks judicial review of an environmental document as invalid under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), shall be moot and barred on the date of enactment of this section if—</text><subparagraph id="iddba6ce9aaaba423c980e3ce999ed50ef"><enum>(A)</enum><text>a record of decision or finding of no significant impact has been issued by a Federal agency at the time at which the project or activity began; and</text></subparagraph><subparagraph id="iddad9f3ff43a8425e8f0551a8cf98de98"><enum>(B)</enum><text>the project or activity for which the record of decision or finding of no significant impact was issued is fully constructed or operational. </text></subparagraph></paragraph></subsection><subsection id="id53bc3f50be5649a09eb1975b52470212"><enum>(c)</enum><header>Deadline for filing</header><paragraph id="id8a03d689111a47fb87730191fc84a2a6"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law, a covered cause of action shall be filed by the date that is 60 days after—</text><subparagraph id="id5267b9b76f254c759ab6421c731b5ff4"><enum>(A)</enum><text>the date on which the lead agency publishes in the Federal Register the record of decision or notice of availability of the record of decision, in the case of an environmental review resulting in a final environmental impact statement;</text></subparagraph><subparagraph id="idbc20e1441bcf4a10b3ea59597d5517aa"><enum>(B)</enum><text>the date on which the Federal lead agency publishes in the Federal Register a finding of no significant impact or notice of availability of the finding of no significant impact, in the case of an environmental review resulting in a finding of no significant impact; or</text></subparagraph><subparagraph id="ida6c2e32683604232886415808d80d703"><enum>(C)</enum><text>the date on which a Federal agency issues an authorization, in the case of an authorization issued under section 107(g) or 108(b)(4).</text></subparagraph></paragraph><paragraph id="ide1136827f2a24b9f87366a96602855f4"><enum>(2)</enum><header>Prohibition</header><text>A covered cause of action that is not filed by the deadline described in paragraph (1) shall be barred.</text></paragraph></subsection><subsection id="id9ecbf69dc63241f7b17bb0dfe431e1a6"><enum>(d)</enum><header>Deadline for resolution</header><text>A district court of the United States shall render a final judgment on a covered cause of action—</text><paragraph id="id44d4cb48a84c45a3a35470c14a4d9654"><enum>(1)</enum><text>as expeditiously as practicable; and</text></paragraph><paragraph id="id52d71c56240344b3a7caa961df5d719c"><enum>(2)</enum><text>not later than the date that is 180 days after the date on which the covered cause of action is filed.</text></paragraph></subsection><subsection id="id55dc7371633e48d0b0f901a5523470fd"><enum>(e)</enum><header>Appellate review</header><text>A court of appeals of the United States shall render final judgment on a covered cause of action subject to its original jurisdiction or an interlocutory order or final judgment, decree, or order of a district court of the United States in a covered cause of action—</text><paragraph id="id42f450036e0944bf98cde2fd6d6b143b"><enum>(1)</enum><text>as expeditiously as practicable; and</text></paragraph><paragraph id="id032d705754ec45ebb4439184c4b6a812"><enum>(2)</enum><text>not later than the date that is 180 days after the date on which the applicable interlocutory order or final judgment, decree, or order of the district court was issued.</text></paragraph></subsection><subsection id="ida8f043540e804f738968aed6291fb6b4"><enum>(f)</enum><header>Remanded actions</header><paragraph commented="no" display-inline="no-display-inline" id="idb3d9e9cf4e4640b39339c699e58bc566"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>If a court of competent jurisdiction remands a record of decision, a finding of no significant impact, or an authorization under this title to a Federal agency, the court shall set a reasonable schedule and deadline for the Federal agency to act on remand, which shall not exceed 180 days from the date on which the order of the court was issued.</text></paragraph><paragraph id="ida872ad5b602f42b0b558d4a25a9f5a82"><enum>(2)</enum><header>Expedited treatment of remanded actions</header><text>The head of the Federal agency to which a court remands a record of decision, a finding of no significant impact, or an authorization under paragraph (1) shall take such actions as may be necessary to provide for the expeditious disposition of the action on remand in accordance with the schedule and deadline set by the court under that paragraph.</text></paragraph></subsection><subsection id="id2aad6239010a4da683dda35f55b42738"><enum>(g)</enum><header>Random assignment of cases</header><text>To the maximum extent practicable, district courts of the United States and courts of appeals of the United States shall randomly assign cases seeking judicial review in a covered cause of action to judges appointed, designated, or assigned to sit as judges of the court in a manner to avoid the appearance of favoritism or bias.</text></subsection><subsection id="id592a23e17f974edb9225934dfc5b50f4"><enum>(h)</enum><header>Effect</header><text>Nothing in this section—</text><paragraph id="idaf3849c6b92e42288c20e05f777c7c78"><enum>(1)</enum><text>establishes a right to judicial review; or</text></paragraph><paragraph id="id9a873de67bf34e04b58835d438972745"><enum>(2)</enum><text>places any limit on filing a claim that a person has violated the terms of an authorization.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id017725c2bd584014bc5e22847c90bca2"><enum>(i)</enum><header>Application of categorical exclusions not subject to judicial review</header><text>Notwithstanding any other provision of law, the application of a categorical exclusion to a final agency action by a Federal agency shall not be subject to judicial review under this title or subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="id5e4979aff2524bb19d4b41666d284fe1"><enum>(j)</enum><header>Treatment of supplemental or revised environmental documents and records of decision</header><text>For purposes of a covered cause of action—</text><paragraph id="idb869bc15f2ff46738d60f688cb5000e5"><enum>(1)</enum><text>a supplemental or revised environmental document or record of decision for a proposed agency action, when required, shall be considered to be a separate environmental document or record of decision; and</text></paragraph><paragraph id="id4666563d2e79487c8598e1e89bb9921e"><enum>(2)</enum><text>the deadline for filing a claim for judicial review of an environmental document or record of decision described in paragraph (1) shall be the date that is 60 days after the date of publication in the Federal Register of a notice of availability of the environmental document or record of decision, unless a shorter time is specified in the Federal law pursuant to which judicial review is authorized.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id05c35418097e4090b2f1a30a143e2e07"><enum>3.</enum><header>Clean Water Act Permitting and State certification</header><subsection commented="no" display-inline="no-display-inline" id="id87478c6aed7c4d88b6916bdc86af0110"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 401 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1341">33 U.S.C. 1341</external-xref>) is amended—</text><paragraph id="id5A845DCFC620423297B0F93050B03960"><enum>(1)</enum><text>in subsection (d), by striking <quote>(d) Any certification</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2186D71024174662841C935787139FA8"><subsection id="id9727151BD19B4B39AB710325122DC4EB"><enum>(e)</enum><header>Limitations and monitoring requirements of certification</header><text>Any striking the heading and section designation and all that follows through <quote>may be.</quote> at the end of subsection (a)(1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcd0f6bac5b244bd79ec6a60c810e71a0"><section id="id84e3ec5f3c58497a93b7450078bd9cdd"><enum>401.</enum><header>Certification</header><subsection id="id9BEC3CC2506B4BAA8335B9AE34452F3C"><enum>(a)</enum><header>Definition of water quality requirements</header><text>In this section, the term <term>water quality requirements</term> means—</text><paragraph id="idEF8D8F4FB01341F0BF24186B6CD5FA04"><enum>(1)</enum><text>the applicable provisions of sections 301, 302, 303, 306, and 307; and</text></paragraph><paragraph id="id1733BF3DC469427A8473479DA6FD3AEF"><enum>(2)</enum><text>any applicable State or Tribal regulatory requirements for point source discharges into waters of the United States.</text></paragraph></subsection><subsection id="id1c18749f972e46f39c26d700e31966f4"><enum>(b)</enum><header>State certifications</header><paragraph id="idd448b831d832486884adf84bd850e836"><enum>(1)</enum><header>Certification required</header><subparagraph id="ida2c2de549ba14c5796eaa11c31788808"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="ida8095b652c9045bfbbc5502a9d32ff33"><enum>(i)</enum><header>Certification application</header><text>The term <term>certification application</term> means a request from an applicant for a certification described in subparagraph (B).</text></clause><clause id="ide030dbc28d594eb38a7f96d2a256ee9c"><enum>(ii)</enum><header>Certifying authority</header><text>The term <term>certifying authority</term>, with respect to a certification application, means, as applicable—</text><subclause id="id3bb586c79b4e4407958fdec1514c4e7a"><enum>(I)</enum><text>the State or interstate agency to which the certification application was submitted; or</text></subclause><subclause id="idc51d0f27950f44ffaac96837eac32f0a"><enum>(II)</enum><text>if no State or interstate agency has the authority to provide the certification described in subparagraph (B), the Administrator.</text></subclause></clause></subparagraph><subparagraph id="ida3ea86f742ff4427829e9bca872e4f35"><enum>(B)</enum><header>Compliance with limitations</header><clause id="id9cad2db95c994efc96d5a6e6c1557d19"><enum>(i)</enum><header>Certification source</header><subclause commented="no" display-inline="no-display-inline" id="idc6eecc66c9644d02933f02e2321c7610"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Any applicant for a Federal license or permit to conduct an activity, including the construction or operation of facilities, that may result in a discharge from a point source into the waters of the United States shall provide to the Federal licensing or permitting agency a certification from the State in which the discharge originates or will originate or, if appropriate, the interstate water pollution control agency with jurisdiction over the waters of the United States at the point where the discharge originates or will originate that the discharge will comply with water quality requirements.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2ecf53a4b46543a7bc0173e7cca75e86"><enum>(II)</enum><header>Certification by Administrator</header><text>If no State or interstate water pollution control agency has the authority to give a certification described in subclause (I), the Administrator is authorized to provide the certification to the Federal licensing or permitting agency.</text></subclause></clause><clause id="idbd29d4853c7f416d9d40bdf8a734881d"><enum>(ii)</enum><header>Certification of no limitation and standard</header><subclause id="id1006fb4b9eca47478e77a03c16ef458b"><enum>(I)</enum><header>In general</header><text>In the case of any discharge described in clause (i) for which there is not an applicable effluent limitation or other limitation under sections 301(b) and 302 and for which there is not an applicable standard under sections 306 and 307, the certifying authority shall so certify.</text></subclause><subclause id="ide4bc8d0048d345f7b4f999d71cb45b3f"><enum>(II)</enum><header>Effect</header><text>A certification under subclause (I) does not satisfy section 511(c).</text></subclause></clause><clause id="idf83b423f6c304225881fb15c7bae6af3"><enum>(iii)</enum><header>Certification required</header><subclause id="id2b04d8a45ed44cd095d4d8741013fbbe"><enum>(I)</enum><header>Activity prohibited until certification</header><text>Activity for which a certification is required under this subparagraph may not begin until the certification has been obtained, unless the requirement for the certification has been waived in accordance with this paragraph.</text></subclause><subclause id="id0e48dd902f5f4c3e92dc166fc128576f"><enum>(II)</enum><header>Effect of denial</header><text>If a certifying authority denies a certification application, the Federal license or permit for which the certification application was made may not be granted.</text></subclause></clause><clause id="idbf73c14a02c94c8c9568676a8ccf0fd4"><enum>(iv)</enum><header>Scope of certification</header><text>The scope of a certification provided under this section shall be limited to ensuring that a discharge from a federally licensed or permitted activity complies with water quality requirements.</text></clause></subparagraph><subparagraph id="id4cd2b4e7ceca4dd4a729806b0bc3eb1b"><enum>(C)</enum><header>Required procedures</header><clause id="idf9017649aaca439d86f47a444a716f2b"><enum>(i)</enum><header>Notice and hearings</header><text>Each certifying authority shall establish procedures for—</text><subclause id="id2faa627a12304f27b29c16642b9809c5"><enum>(I)</enum><text>public notice in the case of all certification applications;</text></subclause><subclause id="ida1586342d4ac40b99b5cd5f41315318e"><enum>(II)</enum><text>to the extent the certifying authority determines to be appropriate, public hearings in connection with specific certification applications; and</text></subclause><subclause id="id354e7f90f5cb49fc869cb668c9e1bd3a"><enum>(III)</enum><text>a prefiling meeting as described in clause (ii).</text></subclause></clause><clause id="idf974e7c6bdfd4d5bb41d6f95d92c56f5"><enum>(ii)</enum><header>Prefiling meeting</header><subclause id="id586862aa2ff44bc38203725b2fe3b4a4"><enum>(I)</enum><header>Request</header><text>Before submitting a certification application, the prospective applicant may request a prefiling meeting with the certifying authority—</text><item id="id40f4b2fcce75406ab820c58eb1dda830"><enum>(aa)</enum><text>to ensure that the certifying authority receives early notification of projects for which a certification under subparagraph (B) is necessary; and</text></item><item id="ide21c0bdde9104ea2b4f0c91cbabd6a94"><enum>(bb)</enum><text>to discuss informational needs with the certifying authority before submitting the application.</text></item></subclause><subclause id="id1b55c612630941f494f80e2ec6dda528"><enum>(II)</enum><header>Response required</header><text>If a prospective applicant requests a prefiling meeting with a certifying authority pursuant to subclause (I), the certifying authority shall—</text><item id="id9cc595a01bd3473c94d5ac2bd5a4709f"><enum>(aa)</enum><text>respond to the request not later than 30 days after the date on which the request is received; and</text></item><item id="id8ce36014cf324113a824418ff58b3dac"><enum>(bb)</enum><text>hold the prefiling meeting with the prospective applicant not later than 60 days after the date on which the request is received.</text></item></subclause></clause><clause id="id16d7c8ea4e1c487fa5fc6df067d5032a"><enum>(iii)</enum><header>Denials of certification</header><subclause id="idf35a9ddd9bb34e3a97a52083a046fd4d"><enum>(I)</enum><header>Individual licenses and permits</header><text>If a certifying authority denies a certification application for an individual license or permit, the certifying authority is authorized to provide to the applicable Federal licensing or permitting agency—</text><item id="id8bcdc03aaa89496f9122891dd4a04394"><enum>(aa)</enum><text>the specific water quality requirements with which the discharge will not comply;</text></item><item id="id07595952f0ee44498cae53501e0b0329"><enum>(bb)</enum><text>a statement explaining why the discharge will not comply with the identified water quality requirements; and</text></item><item id="id5763f98a35704dd48f81085e7a32fd00"><enum>(cc)</enum><text>if the denial is due to insufficient information, a description of the specific water quality data or information, if any, that would be needed to ensure that the discharge from the proposed project will comply with water quality requirements.</text></item></subclause><subclause id="id3b165f0a99a14596a4afb884a49bc632"><enum>(II)</enum><header>General licenses or permits</header><text>If a certifying authority denies a certification application for a general license or permit, the certifying authority shall provide to the applicable Federal licensing or permitting agency—</text><item id="id20feeda4756a41d6b5914afd39fdce4b"><enum>(aa)</enum><text>the specific water quality requirements with which discharges that could be authorized by the general license or permit will not comply;</text></item><item id="id62647947e1cc4b4e812f62c6a3333c5a"><enum>(bb)</enum><text>a statement explaining why discharges that could be authorized by the general license or permit will not comply with the identified water quality requirements; and</text></item><item id="id55cb40823ac741afa143736b0f42a7c2"><enum>(cc)</enum><text>if the denial is due to insufficient information, a description of the specific water quality data or information, if any, that would be needed to assure that the range of discharges that could be authorized by the general license or permit from potential projects will comply with water quality requirements.</text></item></subclause></clause></subparagraph><subparagraph id="id756f3dbf8e34410cbaea115250679f92"><enum>(D)</enum><header>Review period</header><clause id="id02cfcf4aa4184719b8366d924ffe3ef3"><enum>(i)</enum><header>In general</header><text>Subject to clause (iii), a licensing or permitting agency shall, categorically or on a case-by-case basis for each certification application, establish a reasonable period of time (not to exceed 1 year from the date of receipt of the certification application) within which a certifying authority shall issue a final action on the certification application.</text></clause><clause id="idf3276b6cd65f451c87af7da1a9e98ab6"><enum>(ii)</enum><header>Failure to act</header><text>If a certifying authority fails or refuses to issue a final action as described in subparagraph (F) on a certification application by the end of the reasonable period of time established under clause (i) and the reasonable period of time has not been extended in accordance with clause (iii), the requirement for a certification under subparagraph (B) shall be waived.</text></clause><clause id="id0f241ed8f4c642b5ac8dfd038a8750eb"><enum>(iii)</enum><header>Requirement for extension</header><text>With respect to a certification application, the reasonable period of time established under clause (i) may only be extended if—</text><subclause id="idaf1ee11c66e841519ffdf6bacae30f9f"><enum>(I)</enum><text>the extension is requested, in writing, by the applicant; and</text></subclause><subclause id="idced7aa2369ee441495b9b68d90b89834"><enum>(II)</enum><text>the certifying authority concurs, in writing, with the extension.</text></subclause></clause></subparagraph><subparagraph id="id02b69bf536ee45d0a35829230dfb7854"><enum>(E)</enum><header>Waiver of certification requirement</header><clause id="id95e4df31176249089b37c9c064b62a0f"><enum>(i)</enum><header>In general</header><text>A certifying authority may, at any time during the reasonable period of time described in subparagraph (D), affirmatively waive the requirement for a certification under subparagraph (B).</text></clause><clause id="idb8dccc06542b47fead8cc59f4670c58e"><enum>(ii)</enum><header>No judicial review</header><text>Notwithstanding any other provision of Federal law, including any provision of this section, a waiver pursuant to clause (i) shall not be subject to judicial review.</text></clause></subparagraph><subparagraph id="id88819aa5ec81469daf890e2a3ccc3aba"><enum>(F)</enum><header>Final action</header><clause id="id0f575dd4d8074fae81ca7eac7fb3d979"><enum>(i)</enum><header>In general</header><text>Not later than the date on which the reasonable period of time established under subparagraph (D) for a certification application ends or on the date of a waiver pursuant to subparagraph (E)(i), as applicable, the certifying authority or Federal licensing or permitting authority, as applicable, shall apply only 1 of the following final actions to the certification application:</text><subclause id="ide4f93c5e1b424036819e22f9af0500e3"><enum>(I)</enum><text>The certification application is granted.</text></subclause><subclause id="id8205a479f58140259e3581a5f43c6a6b"><enum>(II)</enum><text>The certification application is granted with conditions.</text></subclause><subclause id="id815378dd0ca84cf299848a20f20f4efc"><enum>(III)</enum><text>The certification application is denied.</text></subclause><subclause id="id6780f3b4907d4abd837b413dcb978511"><enum>(IV)</enum><text>The certification requirements under subparagraph (B) have been waived in accordance with subparagraph (D) or (E) with respect to the activity for which the certification application was submitted.</text></subclause></clause><clause id="idafd856e05829428291392071c7429443"><enum>(ii)</enum><header>No other final actions</header><text>No other final action may apply to a certification application except as described in clause (i).</text></clause></subparagraph><subparagraph id="id463bdf1a82e043de81e188880c15dd74"><enum>(G)</enum><header>Enforcement of conditions</header><text>The licensing or permitting authority to which a certification under this subsection was issued may enforce any conditions included with that certification.</text></subparagraph><subparagraph id="id9e18475846094be68ee031086b2943a1"><enum>(H)</enum><header>Timeline for action</header><text>If a Federal court remands or vacates a certification under this paragraph, the Federal court shall set and enforce a reasonable schedule and deadline, not to exceed 180 days from the date on which the Federal court remands or vacates the certification, for the certifying agency to act on the remand or vacatur.</text></subparagraph></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3de382a1e05e473ea19c3873891f3b23"><enum>(5)</enum><text>in subsection (b) (as so redesignated)—</text><subparagraph id="id671fea8a52774f629b596a59c43900eb"><enum>(A)</enum><text>in paragraph id="id941f272101ed49a4ac1c29ecdaa6c3c5"><enum>(B)</enum><header>Exclusions</header><text>The terms <term>navigable waters</term> and <term>waters of the United States</term> do not include—</text><clause id="idc6f92ca013484255a14d9a183093e44a"><enum>(i)</enum><text>a body of water or a water feature that is not described in subparagraph (A);</text></clause><clause id="ide0b88384ccd14b88ab6685238a7d715c"><enum>(ii)</enum><text>groundwater, including groundwater drained through a subsurface drainage system;</text></clause><clause id="idf5032d873f464050ac678b01aee41b59"><enum>(iii)</enum><text>an ephemeral feature, including an ephemeral stream, swale, gully, rill, or pool;</text></clause><clause id="ide04d886438b24abbb570396e1034484a"><enum>(iv)</enum><text>diffuse stormwater run-off and directional sheet flow over upland;</text></clause><clause id="idc941c2c2b23d4410b3a93f7e50dabd06"><enum>(v)</enum><text>a ditch that is not described in clause (i), (ii), or (iii) of subparagraph (A);</text></clause><clause id="id172f578dd03344679de579388e43eae0"><enum>(vi)</enum><text>the portion of a ditch constructed in an adjacent wetland that does not meet the requirements described in subparagraph (C)(i);</text></clause><clause id="idd1168f3aacea4b4792b48fed7183e1c7"><enum>(vii)</enum><text>prior converted cropland;</text></clause><clause id="id39695e7b06f545f38a36879f5defd5c8"><enum>(viii)</enum><text>an artificially irrigated area, including a field flooded for agricultural production, that would revert to upland if the application of irrigation waters to that areas cease;</text></clause><clause id="ida6e476d4bbde44f981e3918896f37d58"><enum>(ix)</enum><text>an artificial lake or pond, including a water storage reservoir and a farm, irrigation, stock watering, or log cleaning pond, that is constructed or excavated in upland or in a body of water that is not otherwise described in subparagraph (A), if the artificial lake or pond is not otherwise a lake, pond, or covered impoundment;</text></clause><clause id="id6a2ed609a5cf47afb6db489fae42823a"><enum>(x)</enum><text>a water-filled depression constructed or excavated in upland or in a body of water that is not otherwise described in subparagraph (A) that is incidental to mining or construction activity;</text></clause><clause id="id4ed3f48a796642e0bbc92926c99a3c5a"><enum>(xi)</enum><text>a pit excavated in upland or in a body of water that is not otherwise described in subparagraph (A) to obtain fill, sand, or gravel;</text></clause><clause id="ida01c65cd19bf445799d6379fc98ff4f5"><enum>(xii)</enum><text>a stormwater control feature constructed or excavated in upland or in a body of water that is not otherwise described in subparagraph (A) to convey, treat, infiltrate, or store stormwater runoff;</text></clause><clause id="idf143588974f145f5bc7b3512fbe89431"><enum>(xiii)</enum><text>a groundwater recharge, water reuse, or wastewater recycling structure, including a detention, retention, or infiltration basin or pond, that is constructed or excavated in upland or in a body of water that is not otherwise described in subparagraph (A); or</text></clause><clause id="idc0b95aadd69d4b8cb6881d142e4d9eda"><enum>(xiv)</enum><text>a waste treatment system.</text></clause></subparagraph><subparagraph id="id1a9296ca22d14e22bd54fcb75101545a"><enum>(C)</enum><header>Associated definitions</header><text>In this paragraph:</text><clause id="id4eb11992b5d74febbae7dc149b5734f3"><enum>(i)</enum><header>Adjacent wetland</header><subclause id="idc1c928dea8314457b50d57851b5cc112"><enum>(I)</enum><header>In general</header><text>The term <term>adjacent wetland</term> means a wetland that—</text><item id="id76145c5290ce41e2a378f16072839d53"><enum>(aa)</enum><text>touches at least 1 point or side of a body of water described in clause (i), (ii), (iii), or (iv) of subparagraph (A);</text></item><item id="idcee54c2806714b8e91e2603d30aa9e9b"><enum>(bb)</enum><text>is inundated by flooding from a body of water described in clause (i), (ii), (iii), or (iv) of subparagraph (A) in a typical year; or</text></item><item id="id616499bf02734257bc530367c11ec558"><enum>(cc)</enum><text>is physically separated from a body of water described in clause (i), (ii), (iii), or (iv) of subparagraph (A) only by—</text><subitem id="idcb8914b4c6e84e278bd07d893f2a4e49"><enum>(AA)</enum><text>a natural berm, bank, dune, or similar natural feature; or</text></subitem><subitem id="id636d26f48ad24a3a949505052a02c43d"><enum>(BB)</enum><text>an artificial dike, an artificial barrier, or a similar artificial structure, if that structure allows for a direct hydrologic surface connection between the wetland and the body of water described in clause (i), (ii), (iii), or (iv) of subparagraph (A) during a typical year, such as through a culvert, flood or tide gate, pump, or similar artificial feature.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id7ba9f6a1269e4cb4b6ef88d12c8d37ed"><enum>(II)</enum><header>Effect of roads and other structures</header><text>For the purposes of subparagraph (A)(v), the division of an adjacent wetland by a road or similar artificial structure does not prevent the adjacent wetland in its entirety from being a navigable water or water of the United States if the road or similar artificial structure allows for a direct hydrologic surface connection through or over that structure in a typical year.</text></subclause></clause><clause id="idcb50b1b3793d4a0b9c47b7d7277319a4"><enum>(ii)</enum><header>Body of water subject to the ebb and flow of the tide</header><subclause id="id702b7ed3aec348f7afcfad0f059e42ff"><enum>(I)</enum><header>In general</header><text>The term <term>body of water subject to the ebb and flow of the tide</term> means a body of water that rises and falls in a predictable and measurable rhythm or cycle due to the gravitational pulls of the moon and sun.</text></subclause><subclause id="idaac44d76283541a687a579d5e5f8b391"><enum>(II)</enum><header>End of influence</header><text>For purposes of this clause, a body of water described in subclause (I) ends when the rise and fall of the water surface can no longer be practically measured in a predictable rhythm due to masking by hydrologic, wind, or other effects.</text></subclause></clause><clause id="idb403b9016d644b2c9f15a7179b12aed5"><enum>(iii)</enum><header>Ditch</header><text>The term <term>ditch</term> means a constructed or excavated channel used to convey water.</text></clause><clause id="idd5e9bbaa2eb04aca9e927ce6c5ad2c4f"><enum>(iv)</enum><header>Ephemeral</header><text>The term <term>ephemeral</term> means surface water flowing or pooling only in direct response to precipitation, such as rain or snow fall.</text></clause><clause id="id468e8acf66c34feaa0a40a5bc6b620a5"><enum>(v)</enum><header>High tide line</header><subclause id="idec7d8a1138164027836513e9a7d166bc"><enum>(I)</enum><header>In general</header><text>The term <term>high tide line</term> means the line of intersection of the land with the surface of a body of line</term> includes the maximum height reached by a spring high tide or other high tide that occurs with periodic frequency.</text></subclause><subclause id="id2b24479270244e29bb8a9ad85a32ba81"><enum>(III)</enum><header>Exclusion</header><text>The term <term>high tide line</term> does not include the maximum height reached as a result of a storm surge in which there is a departure from the normal or predicted reach of the tide due to the piling up of water against a coast by strong winds, such as those accompanying a hurricane or other intense storm.</text></subclause><subclause id="idc4739d388ea141a99bfba3f6de8d5360"><enum>(IV)</enum><header>Methods of determination in the absence of data</header><text>For purposes of this clause, in the absence of data on the high tide line, the high tide line may be determined by—</text><item id="id3291a9602a9148358ec32fecf8f018c1"><enum>(aa)</enum><text>a line of oil or scum along shore objects;</text></item><item id="id3bf1f7d8e07c495aa74cb72688ffc730"><enum>(bb)</enum><text>a more or less continuous deposit of fine shell or debris on the foreshore or berm;</text></item><item id="id071bf5aaacc24f93a71fa4e0316b0fb2"><enum>(cc)</enum><text>other physical markings or characteristics;</text></item><item id="id63d9bfa6b2304e07af364813acd55f03"><enum>(dd)</enum><text>vegetation lines;</text></item><item id="id1463dcc74ad3450e855d337e768591ce"><enum>(ee)</enum><text>tidal gages; or</text></item><item id="id4ad43429454c45388f69d34e5df5989c"><enum>(ff)</enum><text>other suitable means that delineate the general height reached by a rising tide.</text></item></subclause></clause><clause id="ide9031a207f204f0789fa00b722b43c0d"><enum>(vi)</enum><header>Intermittent</header><text>The term <term>intermittent</term> means surface water that flows continuously during certain times of the year and more than in direct response to precipitation, such as water that flows seasonally when the groundwater table is elevated or when snowpack melts.</text></clause><clause id="id565a34aea3a84909b5942227cdd696ad"><enum>(vii)</enum><header>Lake, pond, or covered impoundment</header><subclause id="id4c8eb5314c84408491353fb4043505a8"><enum>(I)</enum><header>In general</header><text>The term <term>lake, pond, or covered impoundment</term> means a standing body of open water that contributes surface water flow to a body of water described in clause (i) or (ii) of subparagraph (A) during a typical year through—</text><item id="idc198ff5dd787413e976b7e3aea31ee08"><enum>(aa)</enum><text>direct means; or</text></item><item id="id46a0eb4ec72b45ee84fde1d2f1fe40ee"><enum>(bb)</enum><text>1 or more bodies of water described in clause (iii), (iv), or (v) of that subparagraph.</text></item></subclause><subclause id="id498a89f4d185465ba3e4fde36130f10f"><enum>(II)</enum><header>Inclusion</header><text>The term <term>lake, pond, or covered impoundment</term> includes a body of water described in subclause (I) that—</text><item id="id0b9c9415eeba439b841282eb372fc2d6"><enum>(aa)</enum><text>contributes surface water flow to a downstream body of water described in subparagraph (A) in a typical year through—</text><subitem id="id4494a7ac941f4dce959a5f8e1b107d50"><enum>(AA)</enum><text>a channelized surface water feature that is not otherwise described in that subparagraph;</text></subitem><subitem id="id24a9e7a888ad4cb9ab713a0054b9d201"><enum>(BB)</enum><text>a culvert, dike, spillway, or other similar artificial feature; or</text></subitem><subitem id="id0daf24e7faec4b5caef1a714bf5a32af"><enum>(CC)</enum><text>a debris pile boulder field, or similar natural feature; or</text></subitem></item><item id="id354f345778a4496e860f6ff3e2cf5db2"><enum>(bb)</enum><text>is inundated by flooding from a body of water described in clause (i), (ii), (iii), or (iv) of subparagraph (A) during a typical year.</text></item></subclause></clause><clause id="iddb408240fa614929888700f829b5b651"><enum>(viii)</enum><header>Ordinary high water mark</header><text>The term <term>ordinary high water mark</term> means a line on the shore of a body of water—</text><subclause id="id217d12c7962048cdaa03bb90cac2e682"><enum>(I)</enum><text>established by the fluctuations of the water; and</text></subclause><subclause id="idbd0192631b21490b9dfcd5cb0dde8ac1"><enum>(II)</enum><text>indicated by physical characteristics such as—</text><item id="id16c093fd7fda4c68b84dd5e79d6ac600"><enum>(aa)</enum><text>a clear, natural line impressed on the bank;</text></item><item id="idf95653575ffc4a739396c2b669da036d"><enum>(bb)</enum><text>shelving;</text></item><item id="id95e78d1ab4594cef882a44d560530472"><enum>(cc)</enum><text>changes in the character of the soil;</text></item><item id="id877a9dbb59c2458ba7b2e620a96e022f"><enum>(dd)</enum><text>destruction of terrestrial vegetation;</text></item><item id="ida60441dcb0bc48af967bb0a38bed4d01"><enum>(ee)</enum><text>the presence of litter and debris; and</text></item><item id="id1168dd7e7169427a8f3cb2d5989cc41b"><enum>(ff)</enum><text>other appropriate means that consider the characteristics of the surrounding areas.</text></item></subclause></clause><clause id="id2a351cfd28f3412cb5ad7026a0483bf6"><enum>(ix)</enum><header>Perennial</header><text>The term <term>perennial</term> means surface water that flows continuously throughout the year.</text></clause><clause id="ida5259e5e0c4c4c8d8cf77deebb6dd798"><enum>(x)</enum><header>Prior converted cropland</header><subclause id="id0aa0019e2f0445fcaf5cc85f232a4371"><enum>(I)</enum><header>In general</header><text>The term <term>prior converted cropland</term> means an area that, prior to December 23, 1985, was drained or otherwise manipulated for the purpose, or having the effect, of making production of an agricultural product possible.</text></subclause><subclause id="id36f1d146cbe6449aabb453a7b62776b4"><enum>(II)</enum><header>Designation by Secretary of Agriculture</header><text>For purposes of this clause—</text><item commented="no" display-inline="no-display-inline" id="idd22baaad2abf4ea2bc0993bd0821aeed"><enum>(aa)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture may designate an area as prior converted cropland; and</text></item><item commented="no" display-inline="no-display-inline" id="id0899142aa40342b6bb6f59d7f7e30be3"><enum>(bb)</enum><text display-inline="yes-display-inline">except as provided in subclause (III), the Administrator and the Secretary shall recognize a designation by the Secretary of Agriculture under item (aa) for purposes of this Act.</text></item></subclause><subclause id="idca9288accbd140cd852e7c5ecca42708"><enum>(III)</enum><header>Exclusion</header><item id="id3469b5a5c6a14b39b8ae445e7b330de9"><enum>(aa)</enum><header>In general</header><text>The term <term>prior converted cropland</term> does not include an area described in subclause (I) that has, as determined by the Secretary, in coordination with the heads of other relevant Federal agencies, as appropriate—</text><subitem id="id7905663c11a54c62bf5a82fb33a8a1b4"><enum>(AA)</enum><text>subject to items (bb) and (cc), been abandoned; and</text></subitem><subitem id="id3ba2506d99ec43b8baf69083ba0fb45d"><enum>(BB)</enum><text>reverted to a wetland.</text></subitem></item><item id="idce1e202fb10647c7b3940360ca5f6f5a"><enum>(bb)</enum><header>Abandonment</header><text>For purposes of subitem (AA) of item (aa), an area described in that item is considered abandoned when the area is not used for, or in support of, agricultural purposes at least once in the 5-year period immediately preceding a determination described in that item.</text></item><item id="idd7b94080ddc7490ca016340e2a457173"><enum>(cc)</enum><header>Final authority</header><text>Notwithstanding a determination by the Secretary of whether an area described in subclause (I) has been abandoned, the Administrator shall have final authority to make that determination.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3d4bd97ed37e46fd8fc207569e04a452"><enum>(xi)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Army, acting through the Chief of Engineers.</text></clause><clause id="ida9783f8397dd48758e73650c99a00888"><enum>(xii)</enum><header>Snowpack</header><text>The term <term>snowpack</term> means 1 or more layers of snow that have accumulated over an extended period of time in certain geographic regions or at high elevations, such as in northern climes or in mountainous regions.</text></clause><clause id="idf61bcc6fea58407b9121792a2af836a7"><enum>(xiii)</enum><header>Tributary</header><subclause id="id8187a481cc2447e8b79f8b9a6735bedd"><enum>(I)</enum><header>In general</header><text>The term <term>tributary</term> means a river, stream, or similar naturally occurring surface water channel that contributes perennial or intermittent surface water flow to a body of water described in clause (i) or (ii) of subparagraph (A) in a typical year through—</text><item id="idcf497e9f9bb14f1d9f94066ef59edba9"><enum>(aa)</enum><text>direct means; or</text></item><item id="ide2029968ba0c40a6897b6a766d7122b8"><enum>(bb)</enum><text>1 or more bodies of water described in clause (iii), (iv), or (v) of that subparagraph.</text></item></subclause><subclause id="id765c4c1d18de43c99bed57fc678aaf47"><enum>(II)</enum><header>Inclusion</header><item id="id57ce73d1c21e42a4ac17b6e2d9419dc6"><enum>(aa)</enum><header>Alteration or relocation</header><text>The alteration or relocation of a channel described in subclause (I) does not otherwise modify the status of the channel under this paragraph if the channel continues to meet the requirements of subclause (I) after that alteration or relocation.</text></item><item id="ida0de914adf214090a4254622e89252be"><enum>(bb)</enum><header>Effect of flow through certain features</header><text>A channel described in subclause (I) shall be considered a tributary for purposes of this clause if the channel contributes surface water flow in a typical year through—</text><subitem id="idc858245569f24210b86656f238ad40b8"><enum>(AA)</enum><text>a channelized surface water feature that is not otherwise described in subparagraph (A);</text></subitem><subitem id="id6df24a4fd1144ea9a0684da7db0f1b3c"><enum>(BB)</enum><text>a subterranean river;</text></subitem><subitem id="ide773113355a44e84a564f42c60cb8522"><enum>(CC)</enum><text>a culvert, dam, tunnel, or similar artificial feature; or</text></subitem><subitem id="id60a98cf630b5482f8d5b8dd1dd252e4e"><enum>(DD)</enum><text>a debris pile, boulder field, or similar natural feature.</text></subitem></item><item id="idf1f8d5b184b7418a89f24d74c6cb763b"><enum>(cc)</enum><header>Relocation</header><text>A ditch that relocates a tributary, is constructed in a tributary, or is constructed in an adjacent wetland is a tributary if the ditch meets the requirements of subclause (I).</text></item></subclause></clause><clause id="idcbaf3d96b85e43d08ca64176a67bd45d"><enum>(xiv)</enum><header>Typical year</header><text>The term <term>typical year</term> means a year within which precipitation and other climactic variables are within the normal periodic range (e.g., seasonally, annually) for the geographic area of the applicable body of water based on the most recent 30-year period.</text></clause><clause id="id157059dc2b3d4ca0b7e4cf0f69e677ab"><enum>(xv)</enum><header>Upland</header><text>The term <term>upland</term> means a land area that, under normal circumstances—</text><subclause id="idcf667d8c09814f3d859bda3d8a956d22" commented="no"><enum>(I)</enum><text>is not a wetland because it does not meet the requirements described in each of items (aa), (bb), and (cc) of clause (xvii)(I); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc474cc6348e74d97ad84efede9f42986"><enum>(II)</enum><text display-inline="yes-display-inline">does not lie below the ordinary high water mark or the high tide line of a body of water described in subparagraph (A).</text></subclause></clause><clause id="id87e20421690c44349f6f34769475fcaf"><enum>(xvi)</enum><header>Waste treatment system</header><text>The term <term>waste treatment system</term> includes all components, including lagoons and treatment ponds (such as settling or cooling ponds), that are designed to either convey or retain, concentrate, settle, reduce, or remove pollutants, either actively or passively, from wastewater prior to discharge (or eliminating any such discharge).</text></clause><clause id="id45ca3044dede4149b257c63ff8e3343e"><enum>(xvii)</enum><header>Wetland</header><subclause id="id6c1737b429b84ea69bea165e840bfe83"><enum>(I)</enum><header>In general</header><text>The term <term>wetland</term> means an area—</text><item id="id57e85a2d0900428688d85551cd652a08"><enum>(aa)</enum><text>that is inundated or saturated by surface water or groundwater;</text></item><item id="id718ec87df8fc47b9984a0e0915a512cf"><enum>(bb)</enum><text>for which the inundation or saturation described in item (aa) is at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation; and</text></item><item id="iddce9fe2c9d564f58bdf02f343cef09bc"><enum>(cc)</enum><text>in which the vegetation described in item (bb) is typically adapted for life in saturated soil conditions.</text></item></subclause><subclause id="idc3a81687166a4456b3f41189e9d953c4"><enum>(II)</enum><header>Inclusions</header><text>The term <term>wetland</term> includes swamps, marshes, bogs, and similar areas.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0b73d16993084bbeab6ab19266cdcdd0"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id3d9f4bdccec0448297eda57ddc8819a8"><enum>(1)</enum><text>Section 109(e) of the Deep Seabed Hard Mineral Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1419">30 U.S.C. 1419(e)</external-xref>) is amended—</text><subparagraph id="ide30a4d32631a4accb84a95b8e125b753"><enum>(A)</enum><text>by striking <quote>section 502(12)(B) of the Clean Water Act</quote> and inserting <quote>paragraph (5)(B) of section 502 of the Federal Water Pollution Control Act</header><subsection id="idb9902a8566894dcdbcca09464c01f906"><enum>(a)</enum><header>Codification of nationwide permits</header><paragraph commented="no" display-inline="no-display-inline" id="idc049f55f24bd405c92cd916fa8eb225c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Nationwide Permits issued, reissued, or modified, as applicable, in the following final rules of the Corps of Engineers are enacted into law:</text><subparagraph id="ideb40ef6666b641069cf799e0c8b3c134"><enum>(A)</enum><text>The final rule of the Corps of Engineers entitled <quote>Reissuance and Modification of Nationwide Permits</quote> (86 Fed. and</text></subparagraph><subparagraph id="id5edb44f8d2334a188446a2bcb78f4995"><enum>(F)</enum><text>the Federal Emergency Management Agency.</text></subparagraph></paragraph><paragraph id="id3eff8a22e86148c2bd06472a56e3cf1f"><enum>(2)</enum><header>No permitting required</header><text>Notwithstanding any provision of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), a permit under section 402 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) shall not be required for the discharge of fire retardant in connection with fire suppression, control, or prevention activities carried out by a Federal land management agency, a State government, a political subdivision of a State, or a Tribal government.</text></paragraph></subsection></section><section id="id857cc7cad09c42c9b30206e31c85d930"><enum>6.</enum><header>Prohibition on retroactive permit vetoes</header><text display-inline="no-display-inline">Section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended by striking subsection (c) and inserting the following:</text><quoted-block id="iddd651ce9370a4ee3b5ff574e41b6622f" display-inline="no-display-inline" style="OLC"><subsection id="id03e488bdad704d089ff7e3e7de8e9ea5"><enum>(c)</enum><header>Authority of EPA Administrator</header><paragraph id="id3bbfdf30561f421796ff1574023e84a2"><enum>(1)</enum><header>Possible prohibition of specification</header><text>Until such time as the Secretary has issued a permit under this section, the Administrator may prohibit the specification (including the withdrawal of specification) of any defined area as a disposal site, and the Administrator may deny or restrict the use of any defined area for specification (including the withdrawal of specification) as a disposal site, whenever the Administrator determines, after notice and opportunity for public hearings, that the discharge of those materials into that area will have an unacceptable adverse effect on municipal water supplies, shellfish beds and fishery areas (including spawning and breeding areas), wildlife, or recreational areas.</text></paragraph><paragraph id="id83fc09c09f5941f0a709e88e8ef4d53f"><enum>(2)</enum><header>Consultation required</header><text>Before making a determination under paragraph (1), the Administrator shall consult with the Secretary.</text></paragraph><paragraph id="id8ab8b16293544cebb41ec0bcf30e26d8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Written findings required</header><text>The Administrator shall set forth in writing and make public the findings and reasons of the Administrator for making any determination under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3d881a77b22b494c808edd8de31b9a84"><enum>7.</enum><header>Efficient consultations under the Endangered Species Act of 1973</header><subsection id="idd34cc00acec747ee9784d63146ccd9e9"><enum>(a)</enum><header>Timelines for section 7 consultations</header><text>Section 7(b)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(b)(1)</external-xref>) is amended—</text><paragraph id="id03d40180fe4846a8adac76e375685391"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>90-day</quote> and inserting <quote>60-day</quote>; and</text></paragraph><paragraph id="id3a9aff5d701c475aba182c82849da064"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="idc9d850f8ae6e42978d72a49486ae0d65"><enum>(A)</enum><text>in the matter preceding clause (i)—</text><clause id="id55aabb90268b47c18e8b10477910423e"><enum>(i)</enum><text>by striking <quote>90 days</quote> and inserting <quote>60 days</quote>; and</text></clause><clause id="id5bf10b2a22c54d5fbf249e3a24ea147e"><enum>(ii)</enum><text>by striking <quote>90th day</quote> and inserting <quote>60th day</quote>;</text></clause></subparagraph><subparagraph id="id223ee2b5a2124720844ddf41a4b58be2"><enum>(B)</enum><text>in clause (i), in the matter preceding subclause (I), by striking <quote>150th day</quote> and inserting <quote>100th day</quote>; and</text></subparagraph><subparagraph id="id2e5a20792b644aadadb2add32dc8c8a6"><enum>(C)</enum><text>in clause (ii), by striking <quote>150 or more</quote> and inserting <quote>100 or more</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbf6731a77ac543bb91ef4a4b8d5127f9"><enum>(b)</enum><header>State assumption of consultation responsibilities</header><paragraph id="id9B0EDA9B3DAF473D891D33BF722CCF11"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id4E4D67C0A1C546069FA751827A6855CB"><enum>(A)</enum><header>Program</header><text>The term <term>program</term> means the program carried out by the Secretary pursuant to this subsection.</text></subparagraph><subparagraph id="id140763C73AA443C59EE500FF5037C91B"><enum>(B)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></subparagraph><subparagraph id="idF245730B0D834647A7F8AD45C4D5A63B"><enum>(C)</enum><header>State</header><text>The term <term>State</term> means—</text><clause id="id42B6BC2A7E4F488E8EF9A082C92A020D"><enum>(i)</enum><text>each of the several States of the United States;</text></clause><clause id="id0A04750F0CB54385AF63B79E2C6C7EEC"><enum>(ii)</enum><text>the District of Columbia;</text></clause><clause id="id876941F5C9E94C3AB9F2E3292159513F"><enum>(iii)</enum><text>the Commonwealth of Puerto Rico;</text></clause><clause id="id2E64282668CD499489E72C47ADF874AB"><enum>(iv)</enum><text>Guam;</text></clause><clause id="id05B6486EB61846F4BAE388D808319EAD"><enum>(v)</enum><text>American Samoa;</text></clause><clause id="idc106fb4383614fc08d4498c227d0efef"><enum>(vi)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e4d6df0562d4fdfaa72f009366ec7c9"><enum>(vii)</enum><text>the United States Virgin Islands.</text></clause></subparagraph><subparagraph id="id8737781C295C47A49F3F4DD200B002D6"><enum>(D)</enum><header>State agency</header><text>The term <term>State agency</term> means any agency, department, board, commission, or other governmental entity in a State with primary jurisdiction over environmental or wildlife management matters in the State, as determined by the Governor of the State.</text></subparagraph></paragraph><paragraph id="id60005C3279C24D1DAC2B2D5C6CEBE78A"><enum>(2)</enum><header>Program</header><subparagraph id="id5C4D81054DAF4F6E92BB1FD575701B45"><enum>(A)</enum><header>In general</header><text>The Secretary shall carry out a program under which the Secretary may assign consultation responsibilities described in subparagraph (B)(i) to States.</text></subparagraph><subparagraph id="id332756C902BD4B5CB850152C3AA60609"><enum>(B)</enum><header>Assumption of responsibility</header><clause id="idA0FF934B8F874028926CFD097255F286"><enum>(i)</enum><header>In general</header><text>Subject to the requirements of this subsection, with the written agreement of the Secretary and a State, which may be in the form of a memorandum of understanding, the Secretary may assign, and the State may assume, the consultation responsibilities of the Secretary within the boundary of the State under subsections (a), (b), and (c) of section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text></clause><clause id="idD911381A145C42518F93FF043DAAF69B"><enum>(ii)</enum><header>Procedural and substantive requirements</header><text>A State shall assume responsibility under the program subject to the same procedural and substantive requirements as would apply if that responsibility were carried out by the Secretary.</text></clause><clause id="idEC1EE23415344FE59961C71712D677A8"><enum>(iii)</enum><header>Federal responsibility</header><text>Any responsibility of the Secretary not explicitly assumed by the State by written agreement under the program shall remain the responsibility of the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id1662E3FDAA5841A8BA1AD4C6791B3540"><enum>(3)</enum><header>State participation</header><subparagraph id="id1314FAD811324137B029F5633553060E"><enum>(A)</enum><header>Participating States</header><text>All States are eligible to participate in the program.</text></subparagraph><subparagraph id="id394A00E0412D4EA785076BCD3A2E5140"><enum>(B)</enum><header>Application</header><clause id="idB1BA74A835EB4016BD48FC14E2E9B536"><enum>(i)</enum><header>In general</header><text>A State seeking to participate in the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, which shall include—</text><subclause id="idf698140bdc3e4c2f97101749c9bf7376"><enum>(I)</enum><text>verification of the financial and legal resources necessary to carry out the authority that may be granted to the State under the program;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5c0eee02bc24465f8860cc110ef1fe89"><enum>(II)</enum><text display-inline="yes-display-inline">verification of the personnel resources or a plan to hire the personnel, not later than 1 year after the date on which the application is approved, necessary to carry out the authority that may be granted to the State under the program; and</text></subclause><subclause id="iddf6d2d5bd997485ea87321b51211d629"><enum>(III)</enum><text>evidence of the notice and solicitation of public comment by the State relating to participation of the State in the program, including copies of comments received from that solicitation.</text></subclause></clause><clause id="idED53A27310414A8FA3D0B06B2DA9A72F"><enum>(ii)</enum><header>Denial</header><subclause commented="no" display-inline="no-display-inline" id="idb0187fa3a61f4ce590b8adb9ea357529"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall only deny an application submitted by a State under clause (i) if the Secretary determines that the State does not demonstrate the legal, financial, or personnel capability to assume responsibility under the program.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id69ecd0b5aae248b7bf488687383a7d85"><enum>(II)</enum><header>Denial requirements</header><text display-inline="yes-display-inline">On denial of an application submitted by a State under clause (i)—</text><item id="idCBC9E432799A4298B2C6DAD7AAB6FD73"><enum>(aa)</enum><text>the Secretary shall—</text><subitem id="idB534A653B55C4B0CB4FE6A9F9377DAE5"><enum>(AA)</enum><text>respond to the State in writing, identifying the reasons for the denial; and</text></subitem><subitem id="id3F9015A1981A48F082AD412FB5F77697"><enum>(BB)</enum><text>at the request of the State, provide technical assistance to the State to address the reasons identified under subitem (AA); and</text></subitem></item><item id="idAC28EA0508CC48C4A0EA8640E8279B97"><enum>(bb)</enum><text>the State may reapply in accordance with the requirements of clause (i).</text></item></subclause></clause></subparagraph><subparagraph id="idfbc797ad157046d4bbfd7961461b12ce"><enum>(C)</enum><header>Public notice</header><clause commented="no" display-inline="no-display-inline" id="id2eb267576b0744ce9f5a4b38a353a82f"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not less than 30 days before the date of submission of an application of a State under subparagraph (B)(i), the State shall, in accordance with the applicable public notice law of the State—</text><subclause id="id821bd7556500494fb7b4457408dacc33"><enum>(I)</enum><text>publish the complete application of the State; and</text></subclause><subclause id="idb4eb5f48191849978eeb51389acba2a9"><enum>(II)</enum><text>provide an opportunity for public comment on the application, which shall not exceed 30 days.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide71703924dea40db83b9b25b83eb470f"><enum>(ii)</enum><header>Response to comments</header><text>Notwithstanding any other provision of law, a State shall not be required to respond to public comments received under clause (i)(II).</text></clause></subparagraph><subparagraph id="id45012029e2b640fd968d9befa23b9354"><enum>(D)</enum><header>Selection criteria</header><text>The Secretary shall approve the application of a State submitted under subparagraph (B)(i) if—</text><clause id="idad5392f2f38843258d56322c2cd0ddce"><enum>(i)</enum><text>the Secretary determines that the State has demonstrated the legal, financial, and current or future personnel capability to assume the responsibility; and</text></clause><clause id="idc89eaace2f3c4cfd8224498c5b3e0841"><enum>(ii)</enum><text>the head of the State agency enters into a written agreement with the Secretary described in paragraph (4)(A).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id109d388c13a448678aa72e1f77a1925d"><enum>(E)</enum><header>Failure to approve or deny application</header><text display-inline="yes-display-inline">If the Secretary fails to make a determination with respect to any application submitted under subparagraph (B)(i) within 180 days after the date on which the Secretary receives that application—</text><clause commented="no" display-inline="no-display-inline" id="id38af4ebc668e41e6be99426dca3fe308"><enum>(i)</enum><text display-inline="yes-display-inline">the application shall be deemed approved; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id90f84945724140499cf6ebea3ff1f4dd"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="id0954ffe5166b44f88988aa641ccc920f"><enum>(I)</enum><text display-inline="yes-display-inline">notify the State that submitted the application of the approval; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbe3d08b1b7124c5aaf2a131fc87ed7d4"><enum>(II)</enum><text>execute a written agreement described in paragraph (4)(A).</text></subclause></clause></subparagraph></paragraph><paragraph id="id6ed96118a2494e19834fdee54dc4f7aa"><enum>(4)</enum><header>Written agreement</header><subparagraph id="idCB7FD24B182F4D858A5E02B9D8BB48EC"><enum>(A)</enum><header>In general</header><text>A written agreement referred to in paragraph (3)(D)(ii) shall—</text><clause id="idca1a6f3d442c471c95285ad87937ccf7"><enum>(i)</enum><text>be executed by the Governor or the top-ranking environmental official in the State who is charged with responsibility for environmental matters;</text></clause><clause id="idffc0f5c4dda44073a2f72ea9c84c5a85"><enum>(ii)</enum><text>be in such form as the Secretary may prescribe;</text></clause><clause id="id12997bc17076406b869b04ee278d32ac"><enum>(iii)</enum><text>provide that the State—</text><subclause id="id536c60a6e15c4410bf25dfb564f06ace"><enum>(I)</enum><text>agrees to assume all or part of the responsibilities of the Secretary described in paragraph (2)(B);</text></subclause><subclause id="id9e83deffcd2d463fb04713a5f43671eb"><enum>(II)</enum><text>expressly consents, on behalf of the State, to accept the jurisdiction of the Federal courts for the compliance, discharge, and enforcement of any responsibility of the Secretary assumed by the State;</text></subclause><subclause id="idfdb43c2d63f64c1f949b8ce7164885b4"><enum>(III)</enum><text>certifies that State laws (including regulations) are in effect that—</text><item id="id3db3d054269b4446a3eb3196d229d7b5"><enum>(aa)</enum><text>authorize the State to take the actions necessary to carry out the responsibilities being assumed; and</text></item><item id="id474986224147445282d38dffcff581cb"><enum>(bb)</enum><text>are comparable to section 552 of title 5, United States Code, including providing that any decision regarding the public availability of a document under those State laws is reviewable by a court of competent jurisdiction; and</text></item></subclause><subclause id="id2d65a3262ae34573b1f45c7f7f8db56d"><enum>(IV)</enum><text>agrees to maintain the financial resources necessary to carry out the responsibilities being assumed;</text></subclause></clause><clause id="id5888b45c2e544da9bf43ba238d9c1bf8"><enum>(iv)</enum><text>require the State to provide to the Secretary any information the Secretary reasonably considers necessary to ensure that the State is adequately carrying out the responsibilities assigned to the State;</text></clause><clause id="idddd2ae5fbc214def855158f3e75585c9"><enum>(v)</enum><text>be renewable; and</text></clause><clause id="idAAF00A35CF7E4AE9B9096DE4AA95E6CE"><enum>(vi)</enum><text>have a term of—</text><subclause id="idA11699BD00214FC38544EF389D52A9CE"><enum>(I)</enum><text>not more than 5 years; or</text></subclause><subclause id="id4C645744BFE34947A2D1F99D6602F10D"><enum>(II)</enum><text>10 years, in the case of a State that has participated in a program under this subsection (or under a predecessor program) for not less than 10 years.</text></subclause></clause></subparagraph><subparagraph id="id573c73dcb8944ae9b63f327f8006ceef"><enum>(B)</enum><header>Role of Secretary</header><text>The Secretary shall not delegate the responsibilities of the Secretary with respect to entering into a written agreement with a State under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idcac352d419fa4f12b7e0dad76e27f2ef"><enum>(5)</enum><header>Jurisdiction</header><subparagraph id="id643f90dac28a47af918843a0b6cc41d2"><enum>(A)</enum><header>In general</header><text>The district courts of the United States shall have exclusive jurisdiction over any civil action against a State for failure to carry out any responsibility of the State under the program.</text></subparagraph><subparagraph id="idb5fe3002dd1045d5ae2d22c23b2a8946"><enum>(B)</enum><header>Legal standards and requirements</header><text>A civil action under subparagraph (A) shall be governed by the legal standards and requirements that would apply in such a civil action against the Secretary had the Secretary taken the actions in question.</text></subparagraph><subparagraph id="id883aef6944ee4113af7848bb77361f1f"><enum>(C)</enum><header>Intervention</header><text>The Secretary shall have the right to intervene in any action described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idb7aa152c2ce948649ed61fa22d770bc1"><enum>(6)</enum><header>Effect of assumption of responsibility</header><text>A State that assumes responsibility under paragraph (2)(B) shall be solely responsible and solely liable for carrying out, in lieu of and without further approval of the Secretary, the responsibilities assumed under that paragraph, until the Secretary or the State, as applicable, terminates the participation of the State in the program in accordance with subparagraph (A) or (B) of paragraph (11), as applicable.</text></paragraph><paragraph id="id7a418777c11348efac5e2f68ba924868"><enum>(7)</enum><header>Limitations on agreements</header><text>Nothing in this subsection permits a State to assume any rulemaking authority of the Secretary under any Federal law.</text></paragraph><paragraph id="idd723c6c18d064e36988de23cc9769bf4"><enum>(8)</enum><header>Audits</header><subparagraph id="id9df3dbb23d6f47a4bab01fa96c88df4d"><enum>(A)</enum><header>In general</header><text>To ensure compliance by a State with any agreement of the State under paragraph (3)(D)(ii) (including compliance by the State with all Federal laws for which responsibility is assumed under paragraph (2)(B)), for each State participating in the program, the Secretary shall—</text><clause id="ide00e36dc62584a20bd4d02b1a8083b30"><enum>(i)</enum><text>not later than 180 days after the date of execution of the agreement, meet with the State to review implementation of the agreement and discuss plans for the first annual audit;</text></clause><clause id="id752c8c39bd7f419db888e7dc315d6ac9"><enum>(ii)</enum><text>conduct annual audits during each of the first 4 years of State participation;</text></clause><clause id="idd66fdd9fb4ba4098a95672ddb7eca1b7"><enum>(iii)</enum><text>in the case of an agreement period of greater than 5 years pursuant to paragraph (4)(A)(vi)(II), conduct an audit covering the first 5 years of the agreement period; and</text></clause><clause id="id782a4a7d621e425285b02abd0e79a431"><enum>(iv)</enum><text>ensure that the time period for completing an audit, from initiation to completion (including public comment and responses to those comments), does not exceed 180 days.</text></clause></subparagraph><subparagraph id="id2512d9f6862c42b0af8e933a673da4a8"><enum>(B)</enum><header>Public availability and comment</header><clause id="id840ec79db58c4a78921f2682c03297cb"><enum>(i)</enum><header>In general</header><text>An audit conducted under subparagraph (A) shall be provided to the public for comment.</text></clause><clause id="id25b4522731fd48cab869cf408954bcc2"><enum>(ii)</enum><header>Response</header><text>Not later than 60 days after the date on which the period for public comment ends—</text><subclause commented="no" display-inline="no-display-inline" id="id979b935d5279499b908738a8c836ed9a"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary shall respond to public comments received under clause (i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id323115b763424d3a87034b17a25e4c33"><enum>(II)</enum><text>to the extent necessary, the applicable State agency may respond to those comments.</text></subclause></clause></subparagraph><subparagraph id="id22c50e41f5114006900e2a3139b1bed0"><enum>(C)</enum><header>Audit team</header><clause id="idd65ac13cab0c4e6a83d326da4badb571"><enum>(i)</enum><header>In general</header><text>An audit conducted under subparagraph (A) shall be carried out by an audit team determined by the Secretary, in consultation with the State, in accordance with clause (ii).</text></clause><clause id="ide581fd506dfa4d699f6f466448698b3f"><enum>(ii)</enum><header>Consultation</header><text>Consultation with the State under clause (i) shall include a reasonable opportunity for the State to review and provide comments on the proposed members of the audit team.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2aae24a72d2443f2bb096fa872c84b85"><enum>(iii)</enum><header>Limitation</header><text>An audit team shall only include—</text><subclause id="id853b9ffba5e24350ae5124c70234a0de"><enum>(I)</enum><text>qualified staff of regional and headquarters offices of the United States Fish and Wildlife Service;</text></subclause><subclause id="id2460f747da204f52bfe9c0ca9508c26b"><enum>(II)</enum><text>staff of the Department of the Interior Office of Inspector General; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id28ee55794e7a4fc4a8c878841a2e5f39"><enum>(III)</enum><text>staff of the applicable State agency.</text></subclause></clause></subparagraph></paragraph><paragraph id="idee29bf92abf34aefb94532c67adc860d"><enum>(9)</enum><header>Monitoring</header><text>After the fourth year of the participation of a State in the program, the Secretary shall monitor compliance by the State with the written agreement entered into under paragraph (3)(D)(ii), including the provision by the State of financial resources to carry out the written agreement.</text></paragraph><paragraph id="id7fcdc15d68934e468bb1d846cd254b5e"><enum>(10)</enum><header>Report to Congress</header><text>The Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives an annual report that describes the administration of the program, which shall include an identification of—</text><subparagraph id="id8EA57D41CD4A48999557F94B60F9B64B"><enum>(A)</enum><text>the number of active written agreements entered into under paragraph (3)(D)(ii) being carried out;</text></subparagraph><subparagraph id="id63D396A20CD24585895D81527A43F0A1"><enum>(B)</enum><text>the number of pending written agreements entered into under that paragraph;</text></subparagraph><subparagraph id="id1686F61E01BD439F9F3AC55DEC028509"><enum>(C)</enum><text>the number of applications denied under paragraph (3)(B)(ii) and the reasons for those denials, if any; and</text></subparagraph><subparagraph id="id66ECC4388766405CB805C527AC5837A4"><enum>(D)</enum><text>the results of any audits completed pursuant to paragraph (8) in the year covered by the report.</text></subparagraph></paragraph><paragraph id="id99b8bf5ea6b34a1381e06f2c5f2dae7c"><enum>(11)</enum><header>Termination</header><subparagraph id="id7554e5300318488b8c4e5960ef85f968"><enum>(A)</enum><header>Termination by the Secretary</header><text>The Secretary may terminate the participation of a State in the program if—</text><clause id="idd8d499c7fad144d9bec5901aaa1d794a"><enum>(i)</enum><text>the Secretary determines that the State is not adequately carrying out the responsibilities assigned to the State;</text></clause><clause id="idee3678cb0e9542c0a06e2342a83d50bb"><enum>(ii)</enum><text>the Secretary provides to the State—</text><subclause id="idda3a9579f04c4a4882c8b9b97ddc4b81"><enum>(I)</enum><text>a notification of the determination of noncompliance;</text></subclause><subclause id="idfada2026e5fa4b45aae0384767935525"><enum>(II)</enum><text>a period of not less than 120 days to take corrective action as the Secretary determines to be necessary to comply with the applicable agreement; and</text></subclause><subclause id="idd2976eab81414623a51b9c52010dda20"><enum>(III)</enum><text>on request of the Governor of the State, a detailed description of each responsibility in need of corrective action relating to an inadequacy identified under clause (i); and</text></subclause></clause><clause id="id657109325a564318a4394b6f7e945c67"><enum>(iii)</enum><text>the State, after the notification and period provided under clause (ii), fails to take satisfactory corrective action, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="id2dc405c2c0c743919b901222a75abfb6"><enum>(B)</enum><header>Termination by the State</header><text>The State may terminate the participation of the State in the program at any time by providing to the Secretary a notice not later than the date that is 90 days before the date of termination, subject to such terms and conditions as the Secretary may provide.</text></subparagraph></paragraph><paragraph id="id2b42da16aa2745938fed48f63c8ced2c"><enum>(12)</enum><header>Capacity building</header><text>The Secretary, in cooperation with relevant State officials, shall provide funding for education, training, peer-exchange, and other initiatives as appropriate—</text><subparagraph id="id9a3b3543da914d7e883ded10bd9b7e9d"><enum>(A)</enum><text>to assist States in developing the capacity to participate in the program; and</text></subparagraph><subparagraph id="id7d8edc1c1e684bd69b2509c75dbc22d4"><enum>(B)</enum><text>to promote information sharing and collaboration among States that are participating in the program.</text></subparagraph></paragraph><paragraph id="idc6975a50f5f944c4b205a1c38524a649" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header>Agency deemed to be federal agency</header><text>A State agency that is assigned a responsibility under an agreement under the program shall be deemed to be an agency for the purposes of section 2412 of title 28, United States Code. </text></paragraph></subsection></section><section id="id9137f6af029d45c69850957d002dc5fe"><enum>8.</enum><header>New source review permitting</header><subsection id="id9af9aae9ef25407b91606ffd930f3043"><enum>(a)</enum><header>Clarification of definition of a modification for emission rate increases, pollution control, efficiency, safety, and reliability projects</header><text>Paragraph (4) of section 111(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(a)</external-xref>) is amended—</text><paragraph id="id433161dd5e0b4e64ba570bcc64b90eba"><enum>(1)</enum><text>by inserting <quote>(A)</quote> before <quote>The term</quote>;</text></paragraph><paragraph id="id3f654c65f9ed4331af024fa30a204d50"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>. For purposes of the preceding sentence, a change increases the amount of any air pollutant emitted by such source only if the maximum hourly emission rate of an air pollutant that is achievable by such source after the change is higher than the maximum hourly emission rate of such air pollutant that was achievable by such source during any hour in the 10-year period immediately preceding the change</quote>; and</text></paragraph><paragraph id="id7a19fa1e70d64de9914379d45b3492a9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6c10d9551d3e46a8ad2eca784033ea55"><subparagraph id="idc8be1f26bdbb439dba5703280e70b728"><enum>(B)</enum><text>Notwithstanding subparagraph (A), the term <term>modification</term> does not include a change at a stationary source that is designed—</text><clause id="idc4fa11bf47944878bd076746b1734479"><enum>(i)</enum><text>to reduce the amount of any air pollutant emitted by the source per unit of production; or</text></clause><clause id="id9e2a61cb74ce4c58aabe5586bf668888"><enum>(ii)</enum><text>to restore, maintain, or improve the reliability of operations at, or the safety of, the source,</text></clause><continuation-text continuation-text-level="subparagraph">except, with respect to either clause (i) or (ii), when the change would be a modification as defined in subparagraph (A) and the Administrator determines that the increase in the maximum achievable hourly emission rate of a pollutant from such change would cause an adverse effect on human health or the environment.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id044b5e5bf6ff4f7b945078ad5d019b60"><enum>(b)</enum><header>Clarification of definition of construction for prevention of significant deterioration</header><text>Section 169(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7479">42 U.S.C. 7479(2)</external-xref>) is amended by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddc149f133c824b3587d0ab9d0add0510"><subparagraph id="id1b68d045d23c487a9b7044ed98b47b1f"><enum>(C)</enum><text>The term <term>construction</term>, when used in connection with a major emitting facility, includes a modification (as defined in section 111(a)) at such facility, except that for purposes of this subparagraph a modification does not include a change at a major emitting facility that does not result in a significant emissions increase, or a significant net emissions increase, in annual actual emissions at such facility.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2ffe05ce7d1d4bc68a9cb4c0b49fbad1"><enum>(c)</enum><header>Clarification of definition of modifications and modified for nonattainment areas</header><text>Section 171 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7501">42 U.S.C. 7501</external-xref>) is amended by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16a36a7d4d794d29af2d1ceb9f0eebd7"><paragraph id="idb1dd8495b82c44fb803dc1c446bdf050"><enum>(4)</enum><text>The terms <quote>modifications</quote> and <quote>modified</quote> mean a modification as defined in section 111(a)(4), except that such terms do not include a change at a major emitting facility that does not result in a significant emissions increase, or a significant net emissions increase, in annual actual emissions at such facility.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbca28deb473841129477bf86a55a03af"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section or the amendments made by this section shall be construed to treat any change as a modification for purposes of any provision of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) if such change would not have been so treated as of the day before the date of enactment of this Act. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id5d7f2470e4ad493aa919082db669f983"><enum>9.</enum><header>Prohibitions on use of social cost of greenhouse gas estimates</header><subsection id="id44fb20a2cbb84f22b89f22bc5f0332fe"><enum>(a)</enum><header>In general</header><text>In promulgating regulations, issuing guidance, or taking any agency action (as defined in section 551 of title 5, United States Code) relating to the social cost of greenhouse gases, no Federal agency shall adopt or otherwise use any estimates for the social cost of carbon, methane, or nitrous oxide that—</text><paragraph commented="no" display-inline="no-display-inline" id="id87ab75434cd540eb99744c87ce5891f4"><enum>(1)</enum><text display-inline="yes-display-inline">may increase the cost of energy, including the levelized cost of electricity and gasoline prices, as determined through a review by the Energy Information Administration; or</text></paragraph><paragraph id="idf46dc01592c04853829e8ab4616741c1"><enum>(2)</enum><text>could prolong the timeline necessary to promulgate that regulation, guidance, or agency action.</text></paragraph></subsection><subsection id="idcaf98f7b40104e37b6d4819561755fb6" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Inclusion</header><text>The estimates referred to in subsection (a) include the interim estimates in the document of the Interagency Working Group on the Social Cost of Greenhouse Gases entitled <quote>Technical Support Document: Social Cost of Carbon, Methane, and Nitrous Oxide Interim Estimates under Executive Order 13990</quote> and dated February 2021.</text></subsection></section><section id="id1ce90f12a98f42f98cc4b02ec13fa89f"><enum>10.</enum><header>Policy review under the Clean Air Act</header><text display-inline="no-display-inline">Section 309 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7609">42 U.S.C. 7609</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idecf0faa7f9a242e09ed4dcb65d696fa9"><section id="idd2c9fec9ed814b16b34b205f181dc312"><enum>309.</enum><header>Policy review</header><subsection id="id6b2649312dd347c3bbb5c5b3583b4185"><enum>(a)</enum><header>Environmental impact of proposed legislation</header><paragraph id="id0daecb9b91574d87bbca2c7427e505b0"><enum>(1)</enum><header>In general</header><text>The Administrator shall review, and comment in writing, on the environmental impact of any matter relating to the duties and responsibilities granted to the authority of the Administrator pursuant to this Act or any other law contained in any legislation proposed by a Federal department.</text></paragraph><paragraph id="id29124151da36467f91a1544247abf45b"><enum>(2)</enum><header>Publish</header><text>A written comment referred to in paragraph (1) shall be made public at the conclusion of any review conducted under that paragraph.</text></paragraph></subsection><subsection id="idcd459027ca1a46cfb2e87c49804bbda5"><enum>(b)</enum><header>Unsatisfactory legislation</header><text>If the Administrator determines that any legislation reviewed under subsection (a)(1) is unsatisfactory from the standpoint of public health, welfare, or environmental quality, the Administrator shall publish the determination of the Administrator and the matter shall be referred to the Council on Environmental Quality.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id24e14c0a445743c2bbebe09c608e6cbc"><enum>11.</enum><header>Domestic energy independence report</header><text display-inline="no-display-inline">Not later than 120 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency, in consultation with the Secretary of Energy, shall submit to Congress a report that identifies and assesses regulations promulgated by the Administrator of the Environmental Protection Agency during the 15-year period ending on the date of enactment of this Act that have—</text><paragraph id="idfd4aa9bad8634482b2fd875730928780"><enum>(1)</enum><text>reduced the energy independence of the United States;</text></paragraph><paragraph id="id1e5a5563cf024086a1781fda2bb21018"><enum>(2)</enum><text>increased the regulatory burden for energy producers in the United States;</text></paragraph><paragraph id="id74a7a0a6af7948d0b455b548392d9fc6"><enum>(3)</enum><text>decreased the energy output by those energy producers;</text></paragraph><paragraph id="idfa4598b5aa08403a91c5665821b94dc8"><enum>(4)</enum><text>reduced the energy security of the United States; or</text></paragraph><paragraph id="id89c4aa22511949d0b4d5f4283f3de83b" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>increased energy costs for consumers in the United States. </text></paragraph></section><section id="idca6e3bd4a0e44cfea9dc8380a844f721"><enum>12.</enum><header>State primary enforcement responsibility</header><subsection id="id39e27d1b9dc8464db9d3b1dcfdb67e9d"><enum>(a)</enum><header>Amendments</header><text>Section 1422(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)</external-xref>) is amended—</text><paragraph id="ida4d3d2b7ba9c4a10bd174dcfeec82904"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddbf26d36bc434cc8a8d6bbba37012785"><enum>(A)</enum><text>by striking <quote>(2) Within ninety days</quote> and inserting the following:</text><quoted-block id="idE15D56960E9942B3B286E04478FE69E1" style="OLC" act-name=""><paragraph id="id6EDDEA0B777D45D3BA96EFB082CB7A7D"><enum>(2)</enum><header>Required timeline</header><subparagraph commented="no" display-inline="no-display-inline" id="id593e1dbde4b343289aecd575804fef3e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Within 90 days</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id93a910c9d189489db2803ab9fcf0ba3c"><enum>(B)</enum><text>in subparagraph (A) (as so designated), by striking <quote>and after reasonable opportunity for presentation of views</quote>; and</text></subparagraph><subparagraph id="id94ed4b31c8dc44899ea6035427995594"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb15c7e00f5d348f489d01324d16e28a1"><subparagraph id="id864dd1fa2f1c44128f96a9871eb1be13"><enum>(B)</enum><header>Failure to act</header><clause commented="no" display-inline="no-display-inline" id="idc36256f63e6446a3b6663b2f5bbe6be7"><enum>(i)</enum><header display-inline="yes-display-inline">Definition of Class VI Well</header><text>In this subparagraph, the term <term>Class VI well</term> means a well described in section 144.6(f) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this subparagraph).</text></clause><clause commented="no" display-inline="no-display-inline" id="id8635e810f7d14f169b2393a92252c08b"><enum>(ii)</enum><header>Notice to State</header><text display-inline="yes-display-inline">If, 180 calendar days after the date on which a State’s application is submitted under paragraph (1)(A) or notice is submitted under (1)(B), the Administrator has not, pursuant to subparagraph (A), by rule approved, disapproved, or approved in part and disapproved in part the underground injection control program of the State for Class VI wells, the Administrator shall submit to the State, in writing, a detailed explanation as to the status of the application or notice.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0472944e9bde4c9388c68da7e09faa4d"><enum>(iii)</enum><header>Deemed approval</header><text>The underground injection control program of a State for Class VI wells shall be deemed to be approved if—</text><subclause commented="no" display-inline="no-display-inline" id="idd387c242430b449d84e844c82a77f5cf"><enum>(I)</enum><text display-inline="yes-display-inline">by the date that is 30 days after the end of the 180-day period described in clause (ii), the Administrator has not by rule approved, disapproved, or approved in part and disapproved in part the underground injection control program of the State for Class VI wells; and</text></subclause><subclause id="idF369C4593D9D4E91BED97C2F303B33D4" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the State has established and implemented a primary enforcement authority program for 1 or more classes of underground injection control wells (including adequate recordkeeping and reporting) to prevent underground injection that endangers drinking water sources.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id2f362530cc17466095d41d77217fbcfd"><enum>(iv)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Administrator shall not condition the processing or approval of a State's application under paragraph (1)(A) or notice under paragraph (1)(B) for a primary enforcement authority program for Class VI wells on the addition or revision of any other program, including any primary enforcement authority program for 1 or more classes of underground injection control wells that are not Class VI wells.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4335e142d3240ccbb7e2a99d0506788"><enum>(2)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD3396E7628AA4A89ABF8C79850881F80"><paragraph id="id5269404db55d4b30b70a0c37c3fe2fd6"><enum>(4)</enum><header>Opportunity for presentation of views</header><text>Before promulgating any rule under paragraph (2) or (3) of this subsection, the Administrator shall—</text><subparagraph id="id4bf7505cccc0477194a87117cea440c8"><enum>(A)</enum><text>provide a reasonable opportunity for presentation of views with respect to that rule, including a public hearing and a public comment period; and</text></subparagraph><subparagraph id="id55230a411064409aaa2a85277cb8fa95"><enum>(B)</enum><text>publish in the Federal Register notice of the reasonable opportunity for presentation of views provided under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3dade27857964561bbc3b7d5a8d832dc"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb57a68123105487e80783029d86d1ab6"><paragraph id="idc4e59ec55aa7494f92367e967fdfdb11"><enum>(5)</enum><header>Preapplication activities</header><text>The Administrator shall work as expeditiously as possible with States to complete any necessary activities relevant to the submission of an application under paragraph (1)(A) or notice under paragraph (1)(B).</text></paragraph><paragraph id="id2335dc08fe7646228b9d98f3926af85c"><enum>(6)</enum><header>Report</header><subparagraph id="idc5a95ce7a16a4c72b71ee3a5f307fca0"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this paragraph, the Administrator shall submit to the appropriate congressional committees a report, including recommendations, regarding the availability of staff and resources to promptly carry out the Class VI wells (as defined in paragraph (2)(B)(i)) program.</text></subparagraph><subparagraph id="id7a4bea3df2d24046855c490267e1feb8"><enum>(B)</enum><header>Appropriate congressional committees defined</header><text>In this paragraph, the term <term>appropriate congressional committees</term> means—</text><clause id="idf385b22888fb458b9d3191c7d0917180"><enum>(i)</enum><text>in the Senate—</text><subclause id="idf302ddc95af949369d37e4d844f7e3ed"><enum>(I)</enum><text>the Committee on Environment and Public Works; and</text></subclause><subclause id="ide56d982d060249c8b03a3baf551ae2b5"><enum>(II)</enum><text>the Committee on Appropriations; and</text></subclause></clause><clause id="id855cfbb5101042b8ad3dec7109bcce2e"><enum>(ii)</enum><text>in the House of Representatives—</text><subclause id="id6090e263f4024f9dbd17582fba1f7c27"><enum>(I)</enum><text>the Committee on Energy and Commerce; and</text></subclause><subclause id="id01b364f9a97e404691868e3d2cdea995"><enum>(II)</enum><text>the Committee on Appropriations.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8a1b84336a6a461b81a3cc8f33e00191"><enum>(b)</enum><header>Rules of construction</header><paragraph id="idda00008c67b54b7bb7ea9278c3243bf8"><enum>(1)</enum><header>Applicability to new applications</header><text>The amendments made by this section apply to all applications submitted to the Environmental Protection Agency after the date of enactment of this Act to establish an underground injection control program under section 1422(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)</external-xref>).</text></paragraph><paragraph id="id4885c189373244879948735f7ce68628" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicability to pending applications</header><text>With respect to any applications described in paragraph (1) submitted prior to the date of enactment of this Act, the 180-day and 210-day deadlines established under clauses (ii) and (iii), respectively, of section 1422(b)(2)(B) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)(1)(B)</external-xref>) (as added by subsection (a)(1)(C)) shall begin on the date of enactment of this Act. </text></paragraph></subsection></section><section id="id413057a88e644a84b0dd2f12f006ac95"><enum>13.</enum><header>Expediting completion of the Mountain Valley Pipeline</header><subsection id="id28c3a793c62b4598946380304dfb7184"><enum>(a)</enum><header>Definition of Mountain Valley Pipeline</header><text>In this section, the term <term>Mountain Valley Pipeline</term> means the Mountain Valley Pipeline project, as generally described and approved in Federal Energy Regulatory Commission Docket Nos. CP16–10 and CP19–477.</text></subsection><subsection id="idb9e1fc20b78e4a04ae3a4abfb5df87fc"><enum>(b)</enum><header>Expedited approval</header><text>Notwithstanding any other provision of law, not later than 21 days after the date of enactment of this Act and for the purpose of facilitating the completion of the Mountain Valley Pipeline—</text><paragraph id="iddf12dd42d00e42608ca0947014eb0237"><enum>(1)</enum><text>the Secretary of the Army shall issue all permits or verifications necessary—</text><subparagraph id="idc7eb430a2f214c11b24d48ca535b77b0"><enum>(A)</enum><text>to complete the construction of the Mountain Valley Pipeline across the waters of the United States; and</text></subparagraph><subparagraph id="ida3de6440e1014ce6b1d6be47373068bc"><enum>(B)</enum><text>to allow for the operation and maintenance of the Mountain Valley Pipeline;</text></subparagraph></paragraph><paragraph id="id90574c60ba1f43d1b10f849e32ba2c21"><enum>(2)</enum><text>the Secretary of Agriculture shall amend the Land and Resource Management Plan for the Jefferson National Forest in a manner that is substantively identical to the record of decision with respect to the Mountain Valley Pipeline issued on January 11, 2021, as may be modified by a subsequently issued record of decision following the supplemental environmental impact statement issued on April 13, 2023; and</text></paragraph><paragraph id="ideff81bb6776e46fa9860d98fa453212e"><enum>(3)</enum><text>the Secretary of the Interior shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7740bd7294fa4295ad27fad5a79f9202"><enum>(A)</enum><text display-inline="yes-display-inline">continue to maintain the biological opinion and incidental take statement for the Mountain Valley Pipeline in a manner that is substantively identical to the biological opinion and incidental take statement issued on February 28, 2023; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3475d7e1447477aa860f5ffa4e745f2"><enum>(B)</enum><text display-inline="yes-display-inline">grant and maintain all necessary rights-of-way and temporary use permits in a manner that is substantively identical to those rights-of-way and temporary use permits approved in the record of decision with respect to the Mountain Valley Pipeline issued on January 14, 2021, or as may be modified by any subsequently issued rights-of-way and temporary use permits.</text></subparagraph></paragraph></subsection><subsection id="id157e39e94feb480c8ab95e3e079b38c2"><enum>(c)</enum><header>Judicial review</header><paragraph commented="no" display-inline="no-display-inline" id="id8622151655f245679dedc5f4913a0202"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No action taken by the Secretary of the Army, the Federal Energy Regulatory Commission, the Secretary of Agriculture, or the Secretary of the Interior that grants an authorization, permit, verification, biological opinion, incidental take statement, or any other approval related to the Mountain Valley Pipeline, including the issuance of any authorization, permit, verification, biological opinion, incidental take statement, or other approval for the Mountain Valley Pipeline, whether issued prior to, on, or after the date of enactment of this section, shall be subject to judicial review.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f26ff2ae0ac45e099ac8d55a955b564"><enum>(2)</enum><header>Effect</header><text>Any lawsuit (including any lawsuit pending in a court on the date of enactment of this Act) seeking judicial review of an agency order or action described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id858dafc7bbbc4541a99f81963d5e6dd2"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be maintained in any court; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4bd57936e7844461836808cc60d341e4"><enum>(B)</enum><text>shall be promptly dismissed.</text></subparagraph></paragraph></subsection><subsection id="idf89220de2c5c427f830d1b4a05518b7d"><enum>(d)</enum><header>Effect</header><text>This section supersedes any other provision of law (including any other section of this Act or another Act of Congress), any regulation, any judicial decision, or any agency guidance that is inconsistent with the issuance of any authorization, permit, verification, biological opinion, incidental take statement, or other approval for the Mountain Valley Pipeline.</text></subsection></section></legis-body></bill>
