which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide an affirmative defense for certain criminal violations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stand Your Ground Act of 2023</short-title></quote>.</text></section><section id="H891DC2969172447ABF0899464599CB95"><enum>2.</enum><header>Certain affirmative defenses</header><subsection id="HCDB8A39007194867AC8FF39687235176"><enum>(a)</enum><header>Affirmative defense</header><paragraph commented="no" display-inline="no-display-inline" id="id128e2558455c46d59295bb03d4d292f5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/1">Chapter 1</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H70A0853053264A22BF45C5F59E015873" display-inline="no-display-inline"><section id="HED8B3BE408D84D1BB93B44C7429D3A4B"><enum>28.</enum><header>Affirmative defense for certain criminal violations</header><subsection id="H7AD9F4CB32AE4649A6EFA149F1141817"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>forcible felony</term> includes treason, murder, manslaughter, sexual battery, carjacking, home-invasion robbery, robbery, burglary, arson, kidnapping, aggravated assault, aggravated battery, aggravated stalking, aircraft piracy, unlawful throwing, placing, or discharging of a destructive device or bomb, and any other felony which involves the use or threat of physical force or violence against any individual.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6d689248d4894d48b3427155ef28b582"><enum>(b)</enum><header display-inline="yes-display-inline">Use or threatened use of non-Deadly force in defense of person</header><paragraph commented="no" display-inline="no-display-inline" id="id07df2f598dbd44848951a7281c0d111f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be an affirmative defense to a prosecution under this title that the defendant used, threatened to use, or attempted to use force, except deadly force, against an aggressor if, and to the extent that, the defendant reasonably believed that the use, threat to use, or attempt to use such force was necessary to defend the defendant or another individual against the imminent use of unlawful force by the aggressor. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4f85c8595134a5c91ec45492508138e"><enum>(2)</enum><header>No duty to retreat</header><text>For purposes of paragraph (1), an individual who is at risk of becoming a victim of a forcible felony shall not be required to first seek retreat as the preferred alternative to using force to act in self-defense.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf33652deb1744b96b801f4b77078c590"><enum>(c)</enum><header>Use or threatened use of deadly force in defense of person</header><paragraph commented="no" display-inline="no-display-inline" id="idda8f50d07bca460ba9d6758e5eedaf79"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>It shall be an affirmative defense to a prosecution under this title that the defendant used, threatened to use, or attempted to use deadly force against an aggressor if the defendant reasonably believed that the use, threat to use, or attempt to use such force was necessary to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idabfbdfc94abc4c28b28b5d692cc7141f"><enum>(A)</enum><text display-inline="yes-display-inline">prevent imminent death or great bodily harm to the defendant or another individual; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5996a8c78af4253bca9b725a1597872"><enum>(B)</enum><text display-inline="yes-display-inline">prevent the imminent commission of a forcible felony.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87fe6d5960004889b89591becc14fef0"><enum>(2)</enum><header>No duty to retreat; right to stand your ground</header><text>For purposes of paragraph (1), an individual who is at risk of becoming a victim of a forcible felony—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7e106afa115f44e2b714c190000b542b"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be required to first seek retreat as the preferred alternative to using force to act in self-defense; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbc73881d3294832a88fbe3f14bec2cf"><enum>(B)</enum><text>may use any means necessary to defend himself or herself if the individual—</text><clause id="id93953859225748719382d360095826f9"><enum>(i)</enum><text>is not engaged in criminal activity; and</text></clause><clause id="id2c5d2f61a47143409dccf8eda99d2137"><enum>(ii)</enum><text>is in a place where the individual has a right to be.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide679625762234ff6adc9fe77d4488047"><enum>(d)</enum><header>Burden of proof</header><text display-inline="yes-display-inline">The defendant has the burden of proving a defense under this section by a preponderance of the evidence.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H13828FC8CFB341868A2DECA6300AE0FD" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/1">chapter 1</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAA7D1A396E1D46A3BECB1EF5217C24C0"><toc regeneration="no-regeneration"><toc-entry level="section" bold="off">28. Affirmative defense for certain criminal violations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id494d57367cf845c3a4f6f5fe5acc52b3"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date; applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e418e6001a54bd788537a87c860427f"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date of enactment of this Act; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38004378e5314aadb8042fdcf96c825e"><enum>(2)</enum><text display-inline="yes-display-inline">apply to any prosecution commenced after the date of enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
