which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the pay and enhance the training of United States Border Patrol agents, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id53E4AE56CC0A4B529A15AFE04897EBA8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Enhancement Act</short-title></quote>.</text></section><section id="idc563e1a6f6954538bac6e9495d7e2570"><enum>2.</enum><header>Authorized staffing level for the United States Border Patrol</header><subsection id="id6BADFB7D359A4374AE416EA5FF93B855"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9223CF620BD1473D90AB0A4474CF0306"><enum>(1)</enum><header>Qualified research entity</header><text>The term <term>qualified research entity</term> means an independent, not-for-profit, federally funded research entity with appropriate expertise and analytical capability to analyze and validate the personnel requirements determination model.</text></paragraph><paragraph id="id864AF0FA81174643B9AD06DABE47FA29"><enum>(2)</enum><header>Validated personnel requirements determination model</header><text>The term <term>validated personnel requirements determination model</term> means a determination of the number of United States Border Patrol agents needed to meet the critical mission requirements of the United States Border Patrol to maintain an orderly process for migrants entering the United States, that has been validated by a qualified research entity pursuant to subsection (d).</text></paragraph></subsection><subsection id="id1309a6adcd5543b198b453213ea261bb"><enum>(b)</enum><header>In general</header><text>The authorized personnel level for United States Border Patrol agents on the date of the enactment of this Act is 20,500.</text></subsection><subsection commented="no" id="idA669B5D00D32494C8D82ADFB040F1A98"><enum>(c)</enum><header>United States Border Patrol personnel requirements determination model</header><paragraph id="idd375ca77f7fe41fba41a50bb67fa100f"><enum>(1)</enum><header>Completion; notice</header><text>Not later than 180 days after the date of the enactment of this Act, the Commissioner shall complete a personnel requirements determination model for United States Border Patrol that builds on the 5-year United States Border Patrol staffing and deployment plan referred to on page 33 of House of Representatives Report 112–91 (May 26, 2011) and submit a notice of completion to—</text><subparagraph id="id80ea2430354b48cd8d1f0a497ca9a88e"><enum>(A)</enum><text>the appropriate congressional committees;</text></subparagraph><subparagraph id="id3132a82ee18749378840eea43ed1e153"><enum>(B)</enum><text>the Director of the Office of Personnel Management; and</text></subparagraph><subparagraph id="id792d4afefc1549a188e0089f5a027c19"><enum>(C)</enum><text>the Comptroller General of the United States.</text></subparagraph></paragraph><paragraph commented="no" id="id0dc722e03f204a288e6d096b5a91f991"><enum>(2)</enum><header>Certification</header><text>Not later than 30 days after the completion of the personnel requirements determination model described in paragraph (1), the Commissioner shall submit a copy of such model and a strategy for obtaining third-party validation of such model, to—</text><subparagraph commented="no" id="id278E349A353F46A0A1BD9A2FBB0D4A08"><enum>(A)</enum><text>the appropriate congressional committees;</text></subparagraph><subparagraph commented="no" id="id50A2E004D9A7414AA2F8798323FF1E17"><enum>(B)</enum><text>the Office of Personnel Management; and </text></subparagraph><subparagraph commented="no" id="id36B5F6F06DE54A6FA241E9FEBB9BF257"><enum>(C)</enum><text>the Comptroller General of the United States.</text></subparagraph></paragraph></subsection><subsection id="idd1beefd45a86412f955f9d9947a699fd"><enum>(d)</enum><header>Independent study of personnel requirements determination model</header><paragraph id="id588cba9de3fa45c0aee8698bce893adb"><enum>(1)</enum><header>Requirement for study</header><text>Not later than 90 days after the completion of the personnel requirements determination model pursuant to subsection (c)(1), the Secretary of Homeland Security shall enter into a contract with a qualified research entity to conduct a study that analyzes the validity of the model.</text></paragraph><paragraph id="id9f92d1b7b5194717a4139e5560710b1e"><enum>(2)</enum><header>Reports</header><subparagraph id="idacf7ebe2d82f46fa971bef82428575b1"><enum>(A)</enum><header>To secretary</header><text>Not later than 1 year after the completion of the personnel requirements determination model under subsection (c)(1), the qualified research entity shall submit a report to the Secretary of Homeland Security that includes—</text><clause id="id787a731ff66d4b9e815dc6a689cd1c66"><enum>(i)</enum><text>the results of the study required under paragraph (1); and</text></clause><clause id="id75f4068544f44ac19a953289e238b628"><enum>(ii)</enum><text>any recommendations regarding the model that the qualified research entity considers to be appropriate.</text></clause></subparagraph><subparagraph id="idfa14596c688a454b83ad74812924ae16"><enum>(B)</enum><header>To congress</header><text>Not later than 30 days after receiving the report described in subparagraph (A), the Secretary of Homeland Security shall submit such report, along with any additional views or recommendations regarding the personnel requirements determination model, to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>.</text></subparagraph></paragraph></subsection><subsection id="id7bf682514c4a419db9bc41b29afcb431"><enum>(e)</enum><header>Authority To adjust authorized personnel level</header><text>Beginning on the date that is 180 days after receiving a report pursuant to subsection (d)(2) that validates the personnel requirements determination model, the Secretary of Homeland Security may adjust the authorized personnel level for the United States Border Patrol to a level that does not exceed the level recommended by the validated personnel requirements determination model. </text></subsection></section><section commented="no" id="id971e1999afc44378bce8540ca4220a6c"><enum>3.</enum><header>Establishment of higher minimum rates of pay for United States Border Patrol agents</header><subsection id="id967102b646ba405e91e68a6bf08993c1"><enum>(a)</enum><header>Higher minimum rate of pay</header><text>Not later than January 1, 2023, the Director of the Office of Personnel Management—</text><paragraph id="id3110b01881464616a5ac23d47913627e"><enum>(1)</enum><text>shall, in accordance with section 5305 of title 5, United States Code—</text><subparagraph id="idF70A0A56B27D44689AE5AF926C172033"><enum>(A)</enum><text>increase the minimum rate of pay for United States Border Patrol agents at the grade GS–12 of the General Schedule by not less than 14 percent; and </text></subparagraph><subparagraph id="id6844DF35D2EA4FC6A83BACF056784145"><enum>(B)</enum><text>increase other grades or levels, occupational groups, series, classes, or subdivisions thereof, as determined by the Secretary of Homeland Security; and</text></subparagraph></paragraph><paragraph id="idb1810ab48a494c8088994406f868e7c7"><enum>(2)</enum><text>may make increases in all rates in the pay range for each such grade or level, in accordance with such section 5305.</text></paragraph></subsection><subsection commented="no" id="idb897a3b22dc84e7d9e1af34114f29484"><enum>(b)</enum><header>Inapplicability</header><text>The discretion granted to agency heads under section 5305(a)(2) of title 5, United States Code, shall not apply to increase in rates of pay authorized under subsection (a).</text></subsection></section><section id="id4c94c08f13704c408ccf9428cf1f8106"><enum>4.</enum><header>Continuing training</header><subsection id="idb14a58348b14422783b11060140b3a02"><enum>(a)</enum><header>In general</header><text>The Commissioner shall require all United States Border Patrol agents and other employees or contracted employees designated by the Commissioner, to participate in annual continuing training to maintain and update their understanding of—</text><paragraph id="idfcc4db41262945029be39d97262fdd70"><enum>(1)</enum><text>Department of Homeland Security policies, procedures, and guidelines;</text></paragraph><paragraph id="ida9f99ae214ea4fff91da35ded5d0e999"><enum>(2)</enum><text>the fundamentals of law, ethics, and professional conduct;</text></paragraph><paragraph id="id0ff38fa5420c4f6eb6446e0160e1411d"><enum>(3)</enum><text>applicable Federal law and regulations;</text></paragraph><paragraph id="idaf844debce2f473b837824c6b5d1dd58"><enum>(4)</enum><text>precedential legal rulings, including Federal Circuit Court and United States Supreme Court opinions relating to the duty of care and treatment of persons in the custody of the United States Border Patrol that the Commissioner determines are relevant to active duty agents;</text></paragraph><paragraph id="idf1af190fb7ec4f11833d5044ff6d7331"><enum>(5)</enum><text>applicable migration trends that the Commissioner determines are relevant;</text></paragraph><paragraph id="id11c7aa54e30d4af3b0afe3878e6468d8"><enum>(6)</enum><text>best practices for coordinating with community stakeholders; and</text></paragraph><paragraph id="idec9b905d92db4f1eb9e5dc3960880a3e"><enum>(7)</enum><text>any other information that the Commissioner determines to be relevant to active duty agents.</text></paragraph></subsection><subsection id="idd8787363415f4f19b003df2894d30e88"><enum>(b)</enum><header>Training subjects</header><text>Continuing training under this subsection shall include training regarding—</text><paragraph id="id3838ceeac3414ffdabbedd1eb5cfa59a"><enum>(1)</enum><text>non-lethal use of force policies available to United States Border Patrol agents and de-escalation strategies and methods; </text></paragraph><paragraph id="idEB45B82AAE744222B27DF4DEAD07EED8"><enum>(2)</enum><text>identifying, screening, and responding to vulnerable populations, such as children, persons with diminished mental capacity, victims of human trafficking, pregnant mothers, victims of gender-based violence, victims of torture or abuse, and the acutely ill;</text></paragraph><paragraph id="id1f89fb24cdfe4ad0bbf64feb425f9e67"><enum>(3)</enum><text>trends in transnational criminal organization activities that impact border security and migration;</text></paragraph><paragraph id="id099b04a096c34945995d5568aa820867"><enum>(4)</enum><text>policies, strategies, and programs—</text><subparagraph id="id84FD42108A3244D3966B28EB092A890C"><enum>(A)</enum><text>to protect due process, the civil, human, and privacy rights of individuals, and the private property rights of land owners;</text></subparagraph><subparagraph id="id4416A701003144D8B7F9CF8965D2F45F"><enum>(B)</enum><text>to reduce the number of migrant and agent deaths; and </text></subparagraph><subparagraph id="id5C254675FE4744AF81037B8DA9E34186"><enum>(C)</enum><text>to improve the safety of agents on patrol;</text></subparagraph></paragraph><paragraph id="id10cb6a351dd64d1280fe18791bd29e0c"><enum>(5)</enum><text>personal resilience;</text></paragraph><paragraph id="id9478b56c366043148ad6325a297f0c9a"><enum>(6)</enum><text>anti-corruption and officer ethics training;</text></paragraph><paragraph id="id4da418fb2ec647799fda25c1bae11791"><enum>(7)</enum><text>current migration trends, including updated cultural and societal issues of nations that are a significant source of migrants who are—</text><subparagraph id="id496E4C20214642C19EE4C755CDC85797"><enum>(A)</enum><text>arriving at a United States port of entry to seek humanitarian protection; or </text></subparagraph><subparagraph id="idE7A235B4D73D4AFBB0566420D2A991D3"><enum>(B)</enum><text>encountered at a United States international boundary while attempting to enter without inspection;</text></subparagraph></paragraph><paragraph id="id9153532b098743afabaa8d95a81b9ccf"><enum>(8)</enum><text>the impact of border security operations on natural resources and the environment, including strategies to limit the impact of border security operations on natural resources and the environment;</text></paragraph><paragraph id="id17d80230110c4a5c9cd2403d9941a6fd"><enum>(9)</enum><text>relevant cultural, societal, racial, and religious training, including cross-cultural communication skills;</text></paragraph><paragraph id="id0cfa206c2a0e414da400cfc1eef3e024"><enum>(10)</enum><text>training authorized under the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/15601">42 U.S.C. 15601 et seq.</external-xref>);</text></paragraph><paragraph id="ida600d75da4b94dc884e971655c890a5a"><enum>(11)</enum><text>risk management and safety training that includes agency protocols for ensuring public safety, personal safety, and the safety of persons in the custody of the Department of Homeland Security;</text></paragraph><paragraph id="id2fa088c637344f6faac4d77f7c1886f1"><enum>(12)</enum><text>non-lethal, self-defense training; and</text></paragraph><paragraph id="idb2294ee4d6174ff7b053da55cbf5fd4b"><enum>(13)</enum><text>any other training that meets the requirements to maintain and update the subjects identified in subsection (a).</text></paragraph></subsection><subsection id="id3043dc8de337428bb88a2c1e1df449e0"><enum>(c)</enum><header>Course requirements</header><text>Courses offered under this section—</text><paragraph id="ide8ccb6750c594ead9249ee88dcb3ce50"><enum>(1)</enum><text>shall be administered by the United States Border Patrol, in consultation with the Federal Law Enforcement Training Center; and</text></paragraph><paragraph id="id41764f85add146989447e2596b4fa7ad"><enum>(2)</enum><text>shall be approved in advance by the Commissioner of U.S. Customs and Border Protection to ensure that such courses satisfy the requirements for training under this section.</text></paragraph></subsection><subsection id="idfde68066eaa44ee49774159838497ba6"><enum>(d)</enum><header>Assessment</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that assesses the training and education provided pursuant to this section, including continuing education.</text></subsection><subsection id="id48df0a3b227a413f8223ff176977166e"><enum>(e)</enum><header>Frequency requirements</header><text>Training offered as part of continuing education under this section shall include—</text><paragraph id="idd96fc043a6c64b0bb08164adb15a19c4"><enum>(1)</enum><text>annual courses focusing on the curriculum described in paragraphs (1) through (6) of subsection (b); and</text></paragraph><paragraph id="ida1cbe85db20c4b6db65a9b55b4f415fa"><enum>(2)</enum><text>biannual courses focusing on curriculum described in paragraphs (7) through (12) of subsection (b).</text></paragraph></subsection></section></legis-body></bill>
