which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a partnership program to assist the military forces of partner countries in developing and maintaining military-wide transformational strategies for operational energy, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Security for Overseas Troops Act</short-title></quote>.</text></section><section id="iddc0aa5331c004fed9428fe20cc083605"><enum>2.</enum><header>Assistance for partner countries to develop and maintain military-wide transformational strategies for operational energy</header><subsection commented="no" display-inline="no-display-inline" id="idc9949e1fc79b4e049482203a8a93e0bd"><enum>(a)</enum><header>Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="idade5852595974211bd089de4721ed117"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2025, the Secretary of Defense shall establish a partnership program to assist the military forces of partner countries in developing and maintaining military-wide transformational strategies for operational energy (in this section referred to as the <quote>Program</quote>).</text></paragraph><paragraph id="id2730080d095e46788911fb65a011680f"><enum>(2)</enum><header>Organization</header><text>The Assistant Secretary of Defense for Energy, Installations, and Environment, in consultation with the Under Secretary of Defense for Policy, the Secretaries of the military departments, the commanders of the combatant commands, and any other individual the Secretary of Defense considers appropriate, shall be responsible for, and shall oversee, the Program.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c7cb38770b142c8a740517eb5f7d768"><enum>(b)</enum><header>Objective</header><text>The objective of the Program is to promote the readiness of the United States Armed Forces and the military forces of partner countries for missions in contested logistics environments by reducing reliance on fossil fuels and employing more diverse and renewable operational energy sources so as to enhance energy security, energy resilience, and energy conservation, reduce logistical vulnerabilities, and ensure that supply lines are resilient to climate change, disruptions to energy supplies, and direct or indirect cyber attacks. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idadf58804c38141a19c3c4f41f34e4286"><enum>(c)</enum><header>Activities</header><paragraph commented="no" display-inline="no-display-inline" id="idce3c313f5e8844d985ea7e3221bfadfb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Under the Program, the United States Armed Forces and the military forces of each participating partner country shall, in coordination—</text><subparagraph id="ida05fc6d083c24073ada574e1218dc843"><enum>(A)</enum><text>establish policies to improve warfighting capability through energy security and energy resilience;</text></subparagraph><subparagraph id="id5dd7816dd85a4806a22e9d4416c72ba9"><enum>(B)</enum><text>integrate efforts to mitigate mutual contested logistics challenges through the reduction of operational energy demand;</text></subparagraph><subparagraph id="id03bbd0f1e754497286b83c0928cd5745"><enum>(C)</enum><text>identify and mitigate operational energy challenges presented by any contested logistics environment, including through developing innovative delivery systems, distributed storage, flexible contracting, and improved automation;</text></subparagraph><subparagraph id="idbe1f50e561714d64a962e0f1c735e043"><enum>(D)</enum><text>assess and integrate, to the extent practicable, any technology, including electric, hydrogen, nuclear, biofuels, and any other sustainable fuel technology or renewable energy technology, that may reduce operational energy demand in the near term or long term;</text></subparagraph><subparagraph id="id145623612fae4dce9cf96254d44c4624"><enum>(E)</enum><text>assess and consider any infrastructure investment of allied and partner countries that may affect operational energy availability in the event of a conflict with a near-peer adversary; and</text></subparagraph><subparagraph id="idb37a128ff55c424ba27ea9ad747b4b07"><enum>(F)</enum><text>assess and integrate, to the extent practicable—</text><clause commented="no" display-inline="no-display-inline" id="id43dfd250d0a44bd69fcd319ecb52d59b"><enum>(i)</enum><text display-inline="yes-display-inline">any technology that increases sustainability and lowers emissions; and</text></clause><clause id="idea8c7f88aee9446aaa7c31a0a927c409"><enum>(ii)</enum><text>any practice, technology or strategy that reduces negative impacts on human health.</text></clause></subparagraph></paragraph><paragraph id="id3ba14cea19ef43018da2bbfcb4e384ca" commented="no"><enum>(2)</enum><header>Country considerations</header><text>In carrying out any activity under paragraph (1), to the extent practicable, the relevant existing and past military conflicts and cultural practices of, and beliefs prevalent in, the participating country shall be taken into account.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id99102469b00049c08d8836e0d4b9c0d6"><enum>(d)</enum><header>Strategy</header><paragraph commented="no" display-inline="no-display-inline" id="id2e8b4ba6255844f4860fb084a14435ca"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than September 30, 2024, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a strategy for the implementation of the Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id768ac0e0e7c94ee2b6e06d98bdfb1e3d"><enum>(2)</enum><header>Elements</header><text>The strategy required by paragraph (1) shall include the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id04a0fff3fc774e2ba3497e67daeb03b1"><enum>(A)</enum><text>A governance structure for the Program, including—</text><clause id="idf01ca89b56f04fe2aa637ded7fecc588"><enum>(i)</enum><text>the officials tasked to oversee the Program;</text></clause><clause id="ide979541eed8445b08587920e802e5abb"><enum>(ii)</enum><text>the format of the governing body of the Program;</text></clause><clause id="idadd2e7bf5acc41df8eb5859e436ec8c1"><enum>(iii)</enum><text>the functions and duties of such governing body with respect to establishing and maintaining the Program; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id846edb4aee8544a7953bd68d2eff9184"><enum>(iv)</enum><text display-inline="yes-display-inline">mechanisms for coordinating with partner countries selected to participate in the Program.</text></clause></subparagraph><subparagraph id="id144d72d900574b43973b994e75763120"><enum>(B)</enum><text>With respect to the selection of partner countries initially selected to participate in the Program—</text><clause commented="no" display-inline="no-display-inline" id="id9183f96c587c4acb9d7d0aacb9bf4377"><enum>(i)</enum><text display-inline="yes-display-inline">an identification of each such country;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc516e08311e047479566a6e94efe0313"><enum>(ii)</enum><text display-inline="yes-display-inline">the rationale for selecting each such country, including a description of—</text><subclause commented="no" display-inline="no-display-inline" id="id85e0af586f5f47109e032b021e8c78d7"><enum>(I)</enum><text display-inline="yes-display-inline">the benefits to the military forces of the partner country; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida9b4619ce1a14c19a41a39f695f19416"><enum>(II)</enum><text>the benefits to the United States Armed Forces of participation by such country; </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6d93c898997e4e43841cca0c088a6725"><enum>(iii)</enum><text>a description of any limitation on the participation of a selected partner country; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id62c4de0b25a141a996c4149fc02c2cac"><enum>(iv)</enum><text>any other information the Secretary of Defense considers appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05d7ae32f7944b32a9fbce93ec4ab86d"><enum>(C)</enum><text>A list of additional authorities, appropriations, or other congressional support necessary to ensure the success of the Program.</text></subparagraph><subparagraph id="idcb4581cd906a4ad3af94de72fe632f4b"><enum>(D)</enum><text>A campaign of objectives for the first three fiscal years of the Program, including—</text><clause id="id9ba37c6824c44a10ad1e2f55a220d4f3"><enum>(i)</enum><text>a description of, and a rationale for selecting, such objectives;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2d8bee79100040d4ae38a922da3e5e14"><enum>(ii)</enum><text display-inline="yes-display-inline">an identification of milestones toward achieving such objectives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5441dcbe01934a4d9a1e9adbd0474ef8"><enum>(iii)</enum><text>metrics for evaluating success in achieving such objectives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a7619766bef4ee18136c91d90e75809"><enum>(E)</enum><text>A description of opportunities and potential timelines for future Program expansion, as appropriate.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5459f3f71b8b48c18b8725cd816adba3"><enum>(F)</enum><text>Any other information the Secretary of Defense considers appropriate. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a5293b5e59e4202814e37f85d5f918a"><enum>(3)</enum><header>Form</header><text>The strategy required by paragraph (1) shall be submitted in unclassified form but may include a classified annex.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3a7ebecc4b7d4bc792085b6a46928f60"><enum>(e)</enum><header>Report</header><paragraph commented="no" display-inline="no-display-inline" id="idf506b453d4c54c86a776d348fe503b8a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than September 20, 2025, and annually thereafter, the Secretary of Defense shall submit to the congressional defense committees (as defined in section 101 of title 10, United States Code) a report on the Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id314593c334eb43d5afe58b766af7f812"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report required by paragraph (1) shall include the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="iddbc9f28841084540a6ba4a85cb1ffff8"><enum>(A)</enum><text>A narrative summary of activities conducted as part of the Program during the preceding fiscal year.</text></subparagraph><subparagraph id="id3019628057af4ed7876d4256aa278b2b"><enum>(B)</enum><text>Except in the case of the initial report, an assessment of progress toward the objectives established for the preceding fiscal year described in the preceding report under this subsection using the metrics established in such report.</text></subparagraph><subparagraph id="id4b4b250886714c2d8c8d8a66a13a8193"><enum>(C)</enum><text>A campaign of objectives for the three fiscal years following the date of submission of the report, including—</text><clause id="ida2cf11749c10457aa52474684f4508ad"><enum>(i)</enum><text>a description of, and a rationale for selecting, such objectives;</text></clause><clause commented="no" display-inline="no-display-inline" id="id71072b030e8b4302a54a7b29c74d8996"><enum>(ii)</enum><text display-inline="yes-display-inline">an identification of milestones toward achieving such objectives; and</text></clause><clause id="id0cd568a8a1c040ad8ff69f4956f504a5"><enum>(iii)</enum><text>metrics for evaluating success in achieving such objectives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfab3ba6e02924ff0b18b1498297517ae"><enum>(D)</enum><text>A description of opportunities and potential timelines for future Program expansion, as appropriate.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE44C3EFC1A6446CE80FBDB424B6FBA9C"><enum>(E)</enum><text>Any other information the Secretary of Defense considers appropriate. </text></subparagraph></paragraph><paragraph id="id256e6fd6e293499385cf867ba2ddd357"><enum>(3)</enum><header>Form</header><text>Each report required by paragraph (1) shall be submitted in unclassified form but may include a classified annex. </text></paragraph></subsection><subsection id="id71a336701aed4be9a0224473a5e6f70d"><enum>(f)</enum><header>Termination</header><text>The Program shall terminate on December 31, 2029.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd0a9709f627c42d596f6780ae7a1bd2b"><enum>(g)</enum><header>Contested logistics environment defined</header><text>In this section, the term <term>contested logistics environment</term> means an environment in which the United States Armed Forces or the military forces of a partner country engage in conflict with an adversary that presents challenges in all domains and directly targets logistics operations, facilities, and activities in the United States, abroad, or in transit from one location to the other. </text></subsection></section></legis-body></bill>
