which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt certain aviation entities from liability under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 for the release of certain perfluoroalkyl or polyfluoroalkyl substances, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airports PFAS Liability Protection Act</short-title></quote>.</text></section><section id="ida4a0e9f5ad61454a95ee85345aece8ed"><enum>2.</enum><header>Exemption under CERCLA</header><subsection id="id2d0a023f27174d35aa8f1b0554ba7112"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idAE67A76CDEDA42ADA1729B03A3AD5717"><enum>(1)</enum><header>Covered perfluoroalkyl or polyfluoroalkyl substance</header><text>The term <term>covered perfluoroalkyl or polyfluoroalkyl substance</term> means a non-polymeric perfluoroalkyl or polyfluoroalkyl substance that contains at least 2 sequential fully fluorinated carbon atoms, excluding gases and volatile liquids, that is a hazardous substance (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)).</text></paragraph><paragraph id="idb1bbce879e55438a93512e6de0278d7e"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8d8574ecdbc491297291c2aed0fef54"><enum>(3)</enum><header>Sponsor</header><text display-inline="yes-display-inline">The term <term>sponsor</term> has the meaning given the term in section 47102 of title 49, United States Code. </text></paragraph></subsection><subsection id="idcc5ef85d8887468e852afd8f2dae50c5"><enum>(b)</enum><header>Exemption</header><text>Subject to subsection (c), no person (including the United States, any State, or an Indian Tribe) may recover costs or damages from a sponsor, including a sponsor of the civilian portion of a joint-use airport or a shared-use airport (as those terms are defined in section 139.5 of title 14, Code of Federal Regulations (or a successor regulation)), under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) for costs arising from a release to the environment of a covered perfluoroalkyl or polyfluoroalkyl substance.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf0f37a467bfc4bebbbae5c33d71dffb6"><enum>(c)</enum><header>Requirements</header><text display-inline="yes-display-inline">Subsection (b) shall only apply—</text><paragraph commented="no" display-inline="no-display-inline" id="ideab0dbd28a274e6f83b39ff8a5bc8b1c"><enum>(1)</enum><text display-inline="yes-display-inline">if the release of a covered perfluoroalkyl or polyfluoroalkyl substance by a sponsor resulted from the use of an aqueous film forming foam; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id893b21527aaf41c4a5088f9e7da1dafe"><enum>(2)</enum><text>if the use described in paragraph (1) was—</text><subparagraph id="idbbb948fb0edb4445b72cfc9c7b4f3068"><enum>(A)</enum><text>required by the Federal Aviation Administration for compliance with part 139 of title 14, Code of Federal Regulations (or successor regulations); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9afeed47f3d34fa18fa1e3b7171f14ba"><enum>(B)</enum><text display-inline="yes-display-inline">carried out in accordance with Federal Aviation Administration standards and guidance on the use of that substance.</text></subparagraph></paragraph></subsection><subsection id="id59f546cc7f6e4b68ba7d551419cda06c"><enum>(d)</enum><header>Savings provision</header><text>Nothing in this section precludes liability for damages or costs associated with the release of a covered perfluoroalkyl or polyfluoroalkyl substance by a sponsor if that sponsor acted with gross negligence or willful misconduct in the use of an aqueous film forming foam.</text></subsection></section></legis-body></bill>
