which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt certain entities from liability under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 for the release of certain perfluoroalkyl or polyfluoroalkyl substances, and for other purposes.</official-title></form><legis-body><section id="id433242A5D65649F59DFBD83B09D74C9A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Suppression PFAS Liability Protection Act</short-title></quote>.</text></section><section id="id3fa3eb663784457bbf89fad6c7dc559f"><enum>2.</enum><header>Exemption under cercla</header><subsection id="idd753d4f6a4d74a3ab1b62f14d55daa7c"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idfe1d6110867645d7aeee8441c3c630cc"><enum>(1)</enum><header>Covered perfluoroalkyl or polyfluoroalkyl substance</header><text>The term <term>covered perfluoroalkyl or polyfluoroalkyl substance</term> means a non-polymeric perfluoroalkyl or polyfluoroalkyl substance that contains at least 2 sequential fully fluorinated carbon atoms, excluding gases and volatile liquids, that is a hazardous substance (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)).</text></paragraph><paragraph id="idb1bbce879e55438a93512e6de0278d7e"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id1ff0ef9f1ff747c4ab94473868a6d790"><enum>(3)</enum><header>Lawful discharge</header><text>The term <term>lawful discharge</term>, with respect to an aqueous film forming foam agent, means a release of the aqueous film forming foam agent through equipment calibration, firefighter training, a timed-response drill, a scheduled release, an emergency response activity, or the use of a fire suppression system.</text></paragraph><paragraph id="id83a2a17ad8c54b44839716fb93304c9f"><enum>(4)</enum><header>Protected entity</header><text>The term <term>protected entity</term> means an entity with a fire suppression system installed, or otherwise in use, in accordance with applicable Federal, State, and local fire codes that uses an aqueous film forming foam that contains a covered perfluoroalkyl or polyfluoroalkyl substance.</text></paragraph></subsection><subsection id="idd76bdf8ab62a4cc391a1542642a7309f"><enum>(b)</enum><header>Exemption</header><text>Subject to subsection (c), no person (including the United States, any State, or an Indian Tribe) may recover costs or damages from a protected entity under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) for costs arising from a release to the environment of a covered perfluoroalkyl or polyfluoroalkyl substance.</text></subsection><subsection id="id8f2f83ad62884f788350256d99ff7567"><enum>(c)</enum><header>Requirement</header><text>Subsection (b) shall only apply if the release of the covered perfluoroalkyl or polyfluoroalkyl substance resulted from the lawful discharge of an aqueous film forming foam in connection with a fire suppression system that—</text><paragraph id="id8bb2902602c047c9b262aedceb05425e"><enum>(1)</enum><text>conforms to applicable Federal, State, and local fire codes; and</text></paragraph><paragraph id="id8970574af0e4450a83f1a2bc813d534e"><enum>(2)</enum><text>is compliant with the most recently approved engineering standards at the time of the discharge.</text></paragraph></subsection><subsection id="idf688cff72cfc4b0cbc05241690add6a6"><enum>(d)</enum><header>Savings provision</header><text>Nothing in this section precludes liability for damages or costs associated with the release of a covered perfluoroalkyl or polyfluoroalkyl substance by a protected entity if the protected entity—</text><paragraph id="id8d4ae550cf234c059ff32f2f2db83f99"><enum>(1)</enum><text>acts with gross negligence or willful misconduct in the discharge of the covered perfluoroalkyl or polyfluoroalkyl substance; or</text></paragraph><paragraph id="id124240f1eb28427197b657469c665707" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>continues to use an aqueous film forming foam agent in the fire suppression system of the protected entity on or after the date that is 5 years after the date on which approved engineering standards were updated to no longer require the use of an aqueous film forming foam.</text></paragraph></subsection></section></legis-body></bill>
