which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt certain entities from liability under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 with respect to releases of perfluoroalkyl and polyfluoroalkyl substances, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resource Management PFAS Liability Protection Act of 2023</short-title></quote>.</text></section><section id="id4EA6AE7260CA473F892736DCEFDC5470"><enum>2.</enum><header>Exemption for owners and operators of certain resource management facilities from CERCLA liability for releases of PFAS</header><subsection id="idFA64601D6AC742079C66E9E24ED60313"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idc7ca29d82bf54ae6883a45c0961069fc"><enum>(1)</enum><header>Compost</header><text>The term <term>compost</term> has the meaning given the term in section 205.2 of title 7, Code of Federal Regulations (or a successor regulation).</text></paragraph><paragraph id="id88E89D00C71B431298422EF2E7405AD2"><enum>(2)</enum><header>Covered perfluoroalkyl or polyfluoroalkyl substance</header><text>The term <term>covered perfluoroalkyl or polyfluoroalkyl substance</term> means a non-polymeric perfluoroalkyl or polyfluoroalkyl substance that contains at least 2 sequential fully fluorinated carbon atoms, excluding gases and volatile liquids, that is a hazardous substance (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)).</text></paragraph><paragraph id="idb1bbce879e55438a93512e6de0278d7e"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id079ABB976FDC49CA8E1488D4DFB612BA"><enum>(4)</enum><header>Protected entity</header><text>The term <term>protected entity</term> means an owner or operator (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)) of—</text><subparagraph id="id811377c712f44ef7aecc3b4d377054be"><enum>(A)</enum><text>a solid waste management facility (as defined in section 1004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80e193bed7ef4a83ba3e891590e36150"><enum>(B)</enum><text>a facility that processes compost for sale or distribution to the public.</text></subparagraph></paragraph></subsection><subsection id="idE5AE26FBF93D4E8994B20A29DDE7061D"><enum>(b)</enum><header>Exemption</header><text>Subject to subsection (c), no person (including the United States, any State, or an Indian Tribe) may recover costs or damages from a protected entity under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) for costs arising from a release to the environment of a covered perfluoroalkyl or polyfluoroalkyl substance. </text></subsection><subsection id="id13C03976954B42F6935950205C4784EC"><enum>(c)</enum><header>Requirements</header><text>Subsection (b) shall only apply if the release of a covered perfluoroalkyl or polyfluoroalkyl substance by a protected entity resulted from—</text><paragraph id="idcd1490b46868416392d6ad7b9bce0857"><enum>(1)</enum><text>the disposal or management of any residuals or byproduct of municipal solid waste in accordance with a permit issued under the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>), or similar State or local authority;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e19a481a63f44ac99f18e035969b0a9"><enum>(2)</enum><text>the disposal or management of biosolids consistent with section 405 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1345">33 U.S.C. 1345</external-xref>); or</text></paragraph><paragraph id="idaaca87d3f83b42538c9acfa9b007f2fc"><enum>(3)</enum><text>the application or processing of compost in accordance with State law.</text></paragraph></subsection><subsection id="id59f546cc7f6e4b68ba7d551419cda06c"><enum>(d)</enum><header>Savings provision</header><text>Nothing in this section precludes liability for damages or costs associated with the release of a covered perfluoroalkyl or polyfluoroalkyl substance by a protected entity if that protected entity acted with gross negligence or willful misconduct in the discharge, disposal, management, processing, conveyance, or storage of the covered perfluoroalkyl or polyfluoroalkyl substance. </text></subsection></section></legis-body></bill>
