<official-title>To require each agency to repeal 3 existing regulations before issuing a new regulation, and for other purposes.</official-title>

<section section-type="section-one" id="H309EFFF71EA14FCCA13227C6CAD902B1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expediting Reform And Stopping Excess Regulations Act</short-title></quote> or the <quote><short-title>ERASER Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="id13bdeb32247e4496b095e519aad3bc11"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H89C6B617135946129873733225BB570A"><enum>(1)</enum><header>Agency; rule</header><text display-inline="yes-display-inline">The terms <term>agency</term> and <term>rule</term> have the meanings given those terms in section 551 of title 5, United States Code.</text></paragraph> <paragraph commented="no" id="HE8B431FC4E4B4B83BA65A0E2318DD0BE"><enum>(2)</enum><header>Major rule</header><text display-inline="yes-display-inline">The term <term>major rule</term> has the meaning given the term in section 804 of title 5, United States Code.</text></paragraph> 
<paragraph id="HCFFDF8F9DA05476B8FE570D3E2B592BE" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian tribe. </text></paragraph></section> <section id="HC34F56AFB4FA4909AEDD88C700C94EC6"><enum>3.</enum><header>Repeal of regulations required before issuance of a new rule</header> <subsection id="HF8200276565A4A448B1496723CB37BF6"><enum>(a)</enum><header>Requirement for rule</header><text display-inline="yes-display-inline">An agency may not issue a rule unless the agency has repealed 3 or more rules described in subsection (c) that, to the extent practicable, are related to the rule.</text></subsection> 
<subsection id="H98FD56453D5044AE93BB62DEE7D99AE3"><enum>(b)</enum><header>Requirement for major rule</header> 
<paragraph id="HB627EB63A71146798F0CBC3C96BCB999"><enum>(1)</enum><header>Repeal required</header><text display-inline="yes-display-inline">An agency may not issue a major rule unless—</text> <subparagraph id="H9164542513104E899480A1D3AFC0E058"><enum>(A)</enum><text display-inline="yes-display-inline">the agency has repealed 3 or more rules described in subsection (c) that, to the extent practicable, are related to the major rule; and</text></subparagraph> 
<subparagraph id="H6CE7C3265B0442EE9B1942851E550E64"><enum>(B)</enum><text>the cost of the new major rule is less than or equal to the cost of the rules repealed.</text></subparagraph></paragraph> <paragraph commented="no" id="H3887614973094ABC836626DBD0F7F89B"><enum>(2)</enum><header>Certified cost</header><text display-inline="yes-display-inline">For any rule issued in accordance with paragraph (1), the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget shall certify that the cost of the new major rule is equal to or less than the cost of the rules repealed.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="idd8ddbd7b87ad43c7b3c9a73b2246b744"><enum>(c)</enum><header>Repealed rules described</header><text>A rule described in this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="id1882119b1ec94adf82b423547cc96439"><enum>(1)</enum><text display-inline="yes-display-inline">does not include an interpretative rule, general statement of policy, or rule of agency organization, procedure, or practice; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ide657bf63aa07488aaa498dc38fa08f45"><enum>(2)</enum><text>was issued through the notice and comment rulemaking process under section 553 of title 5, United States Code.</text></paragraph></subsection> <subsection id="H57593176290847FEB8BBC13C4D8370DB"><enum>(d)</enum><header>Publication required</header><text>Any rule repealed under subsection (a) or (b) shall be published in the Federal Register.</text></subsection> 
<subsection id="H53B39116B9A74E4A8FDA4EF4B45F19BB"><enum>(e)</enum><header>Applicability</header><text>This section—</text> <paragraph id="H401C4C8343FE473D8AEDD3AAA1BA4D01"><enum>(1)</enum><text display-inline="yes-display-inline">applies to any rule or major rule that imposes a cost or responsibility on a nongovernmental person or a State or local government; and</text></paragraph> 
<paragraph id="HB239A647F8A84DB4BAE42DD7C9A12B90"><enum>(2)</enum><text>shall not apply to any rule or major rule that relates to the management, organization, or personnel of an agency or procurement by the agency.</text></paragraph></subsection></section> <section id="id3bbc9e1b1d804168b5c213b5f6893b11"><enum>4.</enum><header>Government Accountability Office study of rules</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and every 5 years thereafter, the Comptroller General of the United States shall conduct a study and submit to Congress a report that includes, as of the date on which the report is submitted—</text> 
<paragraph id="id80036462f48247f8a43d8d971d983db7"><enum>(1)</enum><text>the number of rules that are in effect;</text></paragraph> <paragraph id="idea98c62c0c8d45b98e67b555feb6db17"><enum>(2)</enum><text>the number of major rules that are in effect; and</text></paragraph> 
<paragraph id="id18de01d7112548e0a591fbe72d35ea0b"><enum>(3)</enum><text>the total estimated economic cost imposed by the rules described in paragraphs (1) and (2).</text></paragraph></section> </legis-body> </bill>
