which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide a penalty for assault against journalists, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE9AEEDA6AD624B74B8874414E8D67332"><section section-type="section-one" id="H158E3A988832449FAFF06B9DDC996937"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Journalist Protection Act</short-title></quote>.</text></section><section id="HDAA2AB456F8245CCAAD017F7071FFC33"><enum>2.</enum><header>Assault against journalists</header><subsection id="HD5DBC47003C945C2B26E5146531E7CDD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H027CD2734C824DE19B420203F0891C93"><section id="HFB69E9FFB2B94F94A12B81C07A789A37"><enum>120.</enum><header>Assault against journalists</header><subsection id="HAA393A6DCEDF44EBAFA97A0762A9ACEF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3F78A8444C6F4E2F8DC236A823D58161"><enum>(1)</enum><header>Bodily injury; serious bodily injury</header><text display-inline="yes-display-inline">The terms <term>bodily injury</term> and <term>serious bodily injury</term> have the meanings given those terms in section 1365(h).</text></paragraph><paragraph id="H773D164F5BC5401FB44077AEEE41E461"><enum>(2)</enum><header>Journalist</header><text>The term <term>journalist</term> means an individual who—</text><subparagraph id="HA8AF958AC7AF4961930F6585364A7B7B"><enum>(A)</enum><text display-inline="yes-display-inline">is an employee, independent contractor, or agent of an entity or service that disseminates news or information—</text><clause id="HD61CB59DDA01491A921398889117273E"><enum>(i)</enum><text>by means of a newspaper, nonfiction book, wire service, news agency, news website, mobile application or other news or information service (whether distributed digitally or otherwise), news program, magazine, or other periodical (whether in print, electronic, or other format); or</text></clause><clause id="H949D9C517FD749D78D3C6A568118CA9E"><enum>(ii)</enum><text>through a television broadcast, radio broadcast, multichannel video programming distributor (as defined in section 602 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/522">47 U.S.C. 522</external-xref>)), or motion picture for public showing; and</text></clause></subparagraph><subparagraph id="H35589AC083424548AE2D82BE5FF62B30"><enum>(B)</enum><text display-inline="yes-display-inline">engages in newsgathering with the primary intent to investigate an event or procure material in order to disseminate to the public news or information concerning a local, national, or international event or other matter of public interest.</text></subparagraph></paragraph><paragraph id="H6D6746758F674281A883C67BA2319440"><enum>(3)</enum><header>Newsgathering</header><text display-inline="yes-display-inline">The term <term>newsgathering</term> means engaging in regular gathering, preparation, collection, photographing, recording, writing, editing, reporting, or publishing concerning a local, national, or international event or other matter of public interest.</text></paragraph></subsection><subsection id="idD491316C0B6A438EB16FECF84C3AC113"><enum>(b)</enum><header>Prohibited conduct</header><text display-inline="yes-display-inline">Whoever, in or affecting interstate or foreign commerce, intentionally commits, or attempts to commit—</text><paragraph id="H6AD7252365EA49808425E89563EB8D21"><enum>(1)</enum><text>an act described in subsection (c) shall be fined under this title or imprisoned not more than 3 years, or both; or</text></paragraph><paragraph id="HED029752D313480E8866F76459FA43BC"><enum>(2)</enum><text>an act described in subsection (d) shall be fined under this title or imprisoned not more than 6 years, or both.</text></paragraph></subsection><subsection id="H45232A3E549E44F9994B063D8C7F1D0A"><enum>(c)</enum><header>Bodily injury to a journalist</header><text display-inline="yes-display-inline">An act described in this subsection is an act—</text><paragraph id="H6A498E36EE274CC6A191AD5FA7EA94E2"><enum>(1)</enum><text>that causes bodily injury to an individual who is a journalist;</text></paragraph><paragraph id="H3EECD5668569472FAF9069B7F9EA828D"><enum>(2)</enum><text>committed with knowledge or reason to know the individual is a journalist; and</text></paragraph><paragraph id="H0970587A2B684CB2AAF1798295CC47E0"><enum>(3)</enum><text>committed—</text><subparagraph id="H3BDAB121319B4C0F8198378F055D275A"><enum>(A)</enum><text>while the journalist is taking part in newsgathering; or</text></subparagraph><subparagraph id="H29185719439E4592BC0D9A6E7DCF2438"><enum>(B)</enum><text>with the intention of intimidating or impeding newsgathering by the journalist.</text></subparagraph></paragraph></subsection><subsection id="H452CFB3E469F4797B6FB432425732D4E"><enum>(d)</enum><header>Serious bodily injury to a journalist</header><text display-inline="yes-display-inline">An act described in this subsection is an act—</text><paragraph id="H409F1A4DEFE64C1E90CE6E870A98B93A"><enum>(1)</enum><text>that causes serious bodily injury to an individual who is a journalist;</text></paragraph><paragraph id="HD77B711F038047CF81D3B48D452F2770"><enum>(2)</enum><text>committed with knowledge or reason to know the individual is a journalist; and</text></paragraph><paragraph id="H3A26BBAAAC014F56B4003D442CE61C3A"><enum>(3)</enum><text>committed—</text><subparagraph id="H89365783232F4043A3A038627905D899"><enum>(A)</enum><text>while the journalist is taking part in newsgathering; or</text></subparagraph><subparagraph id="H7B73A06767DF42C29A5DC2666B4B91C7"><enum>(B)</enum><text>with the intention of intimidating or impeding newsgathering by the journalist.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5D3371A52EAF405187C6181F3DBCD7BC"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC7624B77DDAB455AA04F07092124D184"><toc container-level="quoted-block-container" idref="H027CD2734C824DE19B420203F0891C93" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="HFB69E9FFB2B94F94A12B81C07A789A37" level="section">120.
