Definitions. </toc-entry><toc-entry level="section" idref="id6802213CA36A4DAC8B8DCDFAFC2D9BD3">502. No validity or enforceability. </toc-entry></toc><section id="id5BE72E0EF149429A8FD0DD404107DAA8"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="id7748515688FE4293BA4823CCF6DAB6D5"><enum>(1)</enum><header>Predispute arbitration agreement; predispute joint-action waiver</header><text>The terms <term>predispute arbitration agreement</term> and <term>predispute joint-action waiver</term> have the meanings given the terms in section 401.</text></paragraph><paragraph id="idA69A54D11D884D4A92E75E31D2A2AEE8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Race discrimination dispute</header><text display-inline="yes-display-inline">The term <term>race discrimination dispute</term> means a dispute relating to conduct that is alleged to constitute discrimination (including harassment), or retaliation, on the basis of race, color, or national origin under applicable Federal, Tribal, State, or local law. </text></paragraph></section><section id="id6802213CA36A4DAC8B8DCDFAFC2D9BD3"><enum>502.</enum><header>No validity or enforceability</header><subsection id="id190e03aa2284478e8c179110fd197ef1"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this title, at the election of the person alleging conduct constituting a race discrimination dispute, or the named representative of a class or in a collective action alleging such conduct, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a case which is filed under Federal, Tribal, State, or local law and relates to the race discrimination dispute.</text></subsection><subsection id="id30ca63ea37a145ee85972c10d6543433"><enum>(b)</enum><header>Determination of applicability</header><text>An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide190f6457f5a46dcbfd0ddc17614479b"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="idae59e611da06424cbca1c1ccdf7e0d3d"><enum>(1)</enum><header>In general</header><text>Title 9, United States Code is amended—</text><subparagraph id="ida073cf754e244661a705e7fff08449d2"><enum>(A)</enum><text>in section 2, by inserting <quote>or 5</quote> before the period at the end;</text></subparagraph><subparagraph id="id7d9c6d825f5340d0ae8afdb1badc3f9d"><enum>(B)</enum><text>in section 208, in the second sentence, by inserting <quote>or 5</quote> before the period at the end; and</text></subparagraph><subparagraph id="ida67adfcd95d945cd8e948a3edb57d91f"><enum>(C)</enum><text>in section 307, in the second sentence, by inserting <quote>or 5</quote> before the period at the end.</text></subparagraph></paragraph><paragraph id="id0c66af462d3947d49121575f9f379759"><enum>(2)</enum><header>Table of chapters</header><text>The table of chapters for title 9, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBEE40B83F430403DB706BCF41E1069F6"><toc><multi-column-toc-entry level="chapter" bold="on"><toc-enum>5. </toc-enum><level-header level="chapter">Arbitration of disputes involving race discrimination</level-header><target>501.</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id9e3416847a0043dcaad086fa41651e6b"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply with respect to any dispute or claim that arises or accrues on or after the date of enactment of this Act.</text></section></legis-body></bill>
